First, you must do the following to become a candidate: • File with the Public Disclosure Commission at www.pdc.wa.gov • Complete a Declaration of Candidacy during Candidate Filing Week • Pay filing fees (if any)

Candidate Filing Week is May 15 - 19. You may file: • Online: starting 9 a.m. May 15 thru 4 p.m. May 19 at www.ThurstonVotes.org • By mail: May 1 thru May 19 (must be received no later than 4:30 p.m. on Friday, May 19) • In person: May 15 thru May 19, 8 a.m. to 4:30 p.m. at the Thurston County Auditor’s Office.

We invite candidates to include their photo, campaign contact information and statement in the local voters’ pamphlet. To learn more about what you need for submission, please see pages 12-17 of this candidate guide.

Candidates lacking sufficient income or assets to pay the filing fee may submit a filing fee petition.

• The petition must be presented with the Declaration of Candidacy.

• The form is available on the Elections Division website: ThurstonVotes.org.

• The form must contain one valid, registered voter signature for each dollar of the filing fee. For example, if the filing fee is $421.06, the petition must contain 421 valid signatures of registered voters in the district/jurisdiction of the office you are seeking.

• Gather extra signatures to allow for invalid ones.

• No signatures may be submitted after Friday, May 19, 2017 at 4:30 pm.

• Petitions cannot be combined with money for the filing fee.

Declaration of Candidacy for Write-in Candidates

Declarations of Write-in Candidacy must be filed at least 18 calendar days prior to the election and the filing fee paid.

Primary Election: Order determined by lot drawing held on Friday of filing week at 4:30 pm in the Auditor’s Office.

• In the General Election, all voters in the county will be allowed to vote on the Port of Olympia commissioner position.

Candidates must be registered voters and a resident of Thurston County at the time of filing.

The treasurer provides banking, investment,debt and cash management services for the county and all local governments (except cities) within the county.

Position Description

Thurston County has two types of government:council-manager and mayor-council. Under both, the council is the legislative and policy-making body.

Cities & Towns

The mayor and council members are elected. The mayor administers day-to-day city affairs, presides over council meetings, and has veto power.

Mayor-Council: Bucoda, Rainier, Tenino, Tumwater, Yelm

The city council appoints a city manager to oversee day-to-day affairs and selects one member to act as chairman, with the title of mayor, presiding over council meetings and serving as ceremonial head of the city.

Council-Manager: Lacey

Council-Manager: Olympia

The mayor is elected, presides over council meeetings and serves as ceremonial head of the city.

There are nine school districts with five-member boards.District directors have four year terms and must live inthe district. If the office is listed as a “district,” then candidates must reside in the subdistrict. Directors oversee budget, policy development, curriculum approval, planning and communications for the school district.

School board director positions are nonpartisan. They receive no salary but may receive a per diem for attending school board meetings.

Thurston County has nine fire districts and two fire authorities. Commissioners hold office for six years. Commissioners oversee districts that provide fire prevention services, fire suppression, emergency medical services and the protection of life and property.

Voters’ Pamphlet InformationThe deadline to submit Voters’ Pamphlet (“pamphlet”) information for the Primary and General Elections is Friday, May 26, 2017 at 4:30 p.m.

The pamphlet provides an opportunity for candidates to publish a photo, statement and campaign information.

• A candidate biographical portion in not in the pamphlet.

• You are allowed 200 words and up to four paragraphs for your statement.

• Statements are not edited and will be printed exactly as submitted.

Send your statement and photo as early as possible.

If you experience technical problems, call the Auditor’s Elections Division immediately. Technical difficulties will not excuse candidates from meeting the deadline.

Thurston County publishes an official pamphlet for the Primary and General Elections and special elections when requested by a jurisdiction running an election.

Deadline is Friday, May 26, 2017 at 4:30 p.m.

These rules establish submission guidelines forwhen candidates appear on the ballot. Precinctcommittee officer candidates do not appear in the Local Voters’ Pamphlet.

• Each statement shall be limited to 200 words for local candidates. State candidates will utilize the state online voters’ pamphlet submission tools where word counts are specified in RCW 29A.32.121.• Microsoft Word will be used to verify word counts.• No changes will be allowed after submission.

If a statement exceeds the word limit the Auditor’s Office will delete sentences from the end of the statement until the word limit is met.

Up to four paragraphs may be used for local races. Candidates for state and federal offices must use the number of paragraphs specified in the State Candidate Guide. Italics may be used to emphasize specific words or sentences. Other formatting such as all caps, balding, underlining, lists, and bullets are not allowed.

Pursuant to RCW 29A.32.230, the Auditor’s Office may reject any material submitted for publication in the Local Voters’ Pamphlet. These materials include candidate statements, photos, or contact information that:• Is obscene.• Is libelous.• Contains a commercial advertisement.• Contains matter prohibited by law from distribution through mail.• Contains matter not limited to the candidate himself or herself or to the political office for which the candidate is filing.• Contains matter that is otherwise inappropriate or that does not comply with applicable law.• Was received after the submittal deadline.

Changes to contact information are subject to the discretion of the Auditor.

• Submissions for candidates who go directly to the General Election Voters’ Pamphlet are due on the Friday following filing week at 4:30 p.m.

If a submission is not received by the deadline, the text “No photo submitted,” “No information submitted,” and/or “No statement submitted” will appear in the applicable sections.

Submissions do not represent the position of the Thurston County Auditor or Thurston County. Neither the Thurston County Auditor nor Thurston County is responsible for the validity or accuracy of the submissions.

Submissions should be edited and prepared as carefully as one would edit and prepare a resume. Spelling, grammar and punctuation errors will not be corrected. Statement content will be printed exactly as received, as long as it complies with format and content rules.

Rejection and Appeal ProcessRCW 29A.32.230

Voters’ Pamphlet Administrative RulesThe Auditor’s Office reserves the right to rejectany submission to the Local Voters’ Pamphlet, if itdoes not meet submission requirements. Material submitted for publication in the Local Voters’ Pamphlet may be rejected if:• It is obscene.• It is libelous.• Contains a commercial advertisement.• Contains matter prohibited by law from distribution through the mail.• Contains matter not limited to the candidate himself or herself or to the political office for which the candidate is filing.• Contains matter that is otherwise inappropriate or that does not comply with applicable law.• Photo does not meet statutory or administrative criteria.• Was received after the submittal deadline.

If a statement, photo, or contact information is rejected, the candidate will be notified by email and given 48 hours from the time of notification to submit an adjusted statement as long as their statement was submitted on time. The time of notification will be the time the email was sent to the candidate. The email shall set forth specific grounds for the rejection.

Any candidate whose submission is rejected may appeal the Elections Division Manager’s decision. A written notice of appeal shall be submitted to the Auditor by email([email protected]) not more than 48 hours after notice of rejection was sent and shall set forth the specific grounds for appeal. The Auditor shall issue a written decision granting or denying the appeal by email not more than 48 hours after receiving the notice of appeal. The decision of the Auditor to grant or deny an appeal shall be final.

If material is rejected the voter pamphlet will be printed with the rejected material omitted and the appropriate space left blank.

State Sign Classifications

In accordance with Washington Administrative Code (WAC) 468-66-050, classification of signs, political signs are considered a Type 3(d) on-premise sign for which no fee or application is necessary. Temporary political signs are signs which express the property owner’s endorsement of a political candidate or ballot issue, with the following restrictions:

• Temporary political campaign signs are limited to a maximum size of thirty-two (32) square feet in area.

• Temporary political campaign signs must be removed within ten (10) days after the election.

• Sign installers must have permission of the underlying property owner prior to placing signs.

• Temporary political campaign signs are subject to all other applicable provisions of Chapter 47.42 RCW and Chapter 468-66 WAC that pertain to Type 3 on-premise signs.

In addition to the above restrictions, the posting of advertising signs within the right-of-way of all state highways is illegal. Accordingly, any sign placed within the right-of-way* of any state highway will be removed by the Department of Transportation.

A campaign sign cannot be designed in a manner that resembles an official traffic control sign.

* The road right-of-way includes the paved road and strip of land, usually on either side of the road, that is reserved for shoulders, drainage ditches, sidewalks, traffic signs, electrical traffic signal control boxes, utility lines and future road expansion.

Political Signs: State and County - ExcerptsThurston County Code Title 20.40.020General provisions

1. No sign shall protrude over the street right-of-way.2. No sign shall be erected that interfers with the

visibility of traffic control devices or street name signs.

3. Signs may be luminous, reflecting, or illuminating, but no sign shall be flashing or oscillating.

4. No sign shall be placed so as to cause visual obstruction of a public right-of-way.

5. All signs shall conform to Washington State statutes or building code, if in effect.

Thurston Co Code Title 20.40.035: Exempt Signs

The following signs shall be permitted and are exempt from the provisions of this chapter and shall not be included in the computation of sign size area for regulated signs. This shall not be construed as relieving the owner of the sign from the responsibility of its erection and maintenance and its compliance with any other applicable law or ordinance.

Exempt signs are:

16.75.020 (DD): Definitions“Political sign” means a sign advertising a candidate or candidates for public elective office, or a political party, or sign urging a particular vote on a public issue decided by ballot.

16.75.100 Temporary SignsTemporary signs are permitted subject to the applicable limitations:

Political signs or posters may be placed upon private property only and shall not be larger than ten (10) square feet of sign area and shall not be posted or attached to telephone poles, power poles or other public utility facilities. 16.75.120 Enforcement and sign removalA. Termination of Illegal Signs. The right to maintain any sign shall terminate and shall cease to exist whenever the sign is:

1. Abandoned. No persons shall maintain or permit to be maintained on any premises owned or controlled by such persons any sign which has been abandoned. 2. Damaged or destroyed beyond fifty percent. The determination whether a sign is damaged or destroyed beyond fifty percent shall rest with the code administrator and shall be based upon the actual cost of replacing said sign; and/or

3. Structurally substandard under any applicableordinance of the city to the extent that the sign becomes a hazard or a danger.

City of Lacey - Excerpts16.75.120 (C) Violation & Penalty

1. Violation of the provisions of this code or failure to comply with any of its requirements shall constitute a misdemeanor and such violation shall be punished as provided by the statutes of the State of Washington for the commission of a misdemeanor. Each day such violation continues shall be considered a separate offense.

2. The erector, owner or user of an unlawful sign or the owner of the property on which an unlawful sign is located and who maintains such violation may each be found guilty of a separate offense and suffer the penalties herein provided.(Ord. 1454 §2, 2015)

E. Removal. All political signs must be removed 5 days after the election in which the candidates or issue on the sign has been determined. However, after primary elections, if the candidate or issue is going into the general election, signs may remain until 5 days after the general election. The candidate or committee for which the sign is displayed, shall be responsible for its removal. The candidate or committee for which the sign is displayed, shall be subject to the penalties and fines for violation of these requirements, as set forth in this title. (Ord. 6093 §17, 2001).

(1) In the case of voter registration records received through the department of licensing or an agency designated under RCW 29A.08.310, the identity of the office or agency at which any particular individual registered to vote is not available for public inspection and shall not be disclosed to the public. Any record of a particular individual's choice not to register to vote at an office of the department of licensing or a state agency designated under RCW 29A.08.310 is not available for public inspection and any information regarding such a choice by a particular individual shall not be disclosed to the public.

(2) Subject to the restrictions of RCW 29A.08.710 and 40.24.060, precinct lists and current lists of registered voters are public records and must be made available for public inspection and copying under such reasonable rules and regulations as the county auditor or secretary of state may prescribe. The county auditor or secretary of state shall promptly furnish current lists of registered voters in his or her possession, at actual reproduction cost, to any person requesting such information. The lists shall not be used for the purpose of mailing or delivering any advertisement or offer for any property, establishment, organization, product, or service or for the purpose of mailing or delivering any solicitation for money, services, or anything of value. However, the lists and labels may be used for any political purpose. The county auditor or secretary of state must provide a copy of RCW 29A.08.740 to the person requesting the material that is released under this section.

(3) For the purposes of this section, "political purpose" means a purpose concerned with the support of or opposition to any candidate for any partisan or nonpartisan office or concerned with the support of or opposition to any ballot proposition or issue. "Political purpose" includes, but is not limited to, such activities as the advertising for or against any candidate or ballot measure or the solicitation of financial support.

RCW 29A.08.740 Violations of restricted use of registered voter data -- Penalties -- Liabilities.

(1) Any person who uses registered voter data furnished under RCW 29A.08.720 for the purpose of mailing or delivering any advertisement or offer for any property, establishment, organization, product, or service or for the purpose of mailing or delivering any solicitation for money, services, or anything of value is guilty of a class C felony punishable by imprisonment in a state correctional facility for a period of not more than five years or a fine of not more than ten thousand dollars or both such fine and imprisonment, and is liable to each person provided such advertisement or solicitation, without the person's consent, for the nuisance value of such person having to dispose of it, which value is herein established at five dollars for each item mailed or delivered to the person's residence. However, a person who mails or delivers any advertisement, offer, or solicitation for a political purpose is not liable under this section unless the person is liable under subsection (2) of this section. For purposes of this subsection, two or more attached papers or sheets or two or more papers that are enclosed in the same envelope or container or are folded together are one item. Merely having a mailbox or other receptacle for mail on or near the person's residence is not an indication that the person consented to receive the advertisement or solicitation. A class action may be brought to recover damages under this section, and the court may award a reasonable attorney's fee to any party recovering damages under this section.

(2) Each person furnished data under RCW 29A.08.720 shall take reasonable precautions designed to assure that the data is not used for the purpose of mailing or delivering any advertisement or offer for any property, establishment, organization, product, or service or for the purpose of mailing or delivering any solicitation for money, services, or anything of value. However, the data may be used for any political purpose. Where failure to exercise due care in carrying out this responsibility results in the data being used for such purposes, then such person is jointly and severally liable for damages under subsection (1) of this section along with any other person liable under subsection (1) of this section for the misuse of such data.

RCW 29A.84.510 Acts prohibited in voting center

“(1) During the voting period that begins eighteen days before and ends the day of a special election, general election, or primary, no person may: (a) Within a voting center: (i) Suggest or persuade or attempt to suggest or persuade any voter to vote for or against any candidate or ballot measure; (ii) Circulate cards or handbills of any kind; (iii) Solicit signatures to any kind of petition; or (iv) Engage in any practice which interferes with the freedom of voters to exercise their franchise or disrupts the administration of the voting center.

(b) Obstruct the doors or entries to a building in which a voting center or ballot drop box location is located or prevent free access to and from any voting center or ballot drop location.

(2) Any sheriff, deputy sheriff, or municipal law enforcement officer shall stop the prohibited activity, and may arrest any person engaging in the prohibited activity.

(3) Any violation of this section is a gross misdemeanor, punishable to the same extent as a gross misdemeanor that is punishable under RCW 9A.20.021, and the person convicted may be ordered to pay the costs of prosecution.”

RCW 29A.84.540 Ballots - Removing from voting center or ballot drop box location.

“Any person who, without lawful authority, removes a ballot from a voting center or ballot drop location is guility of a gross misdemeanor punishable to the same extent as a gross misdemeanor that is punishable under RCW 9A.20.021.”

Campaign Materials

Campaign materials cannot be placed in or on top of mailboxes without paying postage(U.S. Postal Service, Private Express Statute), nor should campaign materials be placed in newspaper delivery tubes. Please be courteous to these agencies.
