They have been handling all of the day-to-day operations now for the past three years. Well done ladies! I’d also like to thank our Maintenance Staff, Foreman Ike Snook, Rob Anderson and Charlie Carr. They have worked as a self-directed team for the last three years keeping our roads and common grounds in the best condition possible. I wish to extend my appreciation and that of the rest of the Board to out- going Director Steve Potestio and his family. The personal sacrifices he made did not go unnoticed and he is to be commended for his volunteerism to our community. I cannot say enough positive things in regard to our current Board of Direc- tors. Each one brings a different skill set and business background to the table, all pull together to do fine work for the membership. I deeply appreciate the honor of having been their presiding officer these past three years. Roads – We are nearing the completion of our annual grading of the stone roads in all sections as well as significant drainage work. We have a draft plan to address all of our roads; when finalized we will present it to the membership for comment and impute. The most important thing we as members need to remember is, that we are all in this together. No one member’s road is more important than another’s. The Board has a very difficult task of prioritizing projects such as the Clubhouse Drive Bridge repair over other much needed areas, as they are directed by the bylaws with the safety of the community. Elections – Soon you will be receiving ballots and biographies from the can- didates. Three candidates are members of Winona Lakes Homeowners for Reform: Janet Foster, Laura Massaro and myself, Bob Fenlon. Our agenda is a continuation of the progress and improvement to Winona Lakes instituted in the last three years including the permanent closure of skiing operations. We hope you will support us in our election efforts! For those of you who wish to try to open skiing and plunge the community into chaos, fighting and financial mismanagement you will have two candidates to vote for: Daniel J. D’Arco and Kenneth Anders. In this year’s election, the membership has never had a clearer choice! The Management Company – They are no longer with us. The Board, un- satisfied with their performance, entered into an early termination agreement with them. We paid them about six weeks fees (approximately $9,000) to exit a two-year contract. However, in doing so, we did lock the door to any potential future legal action with a release. Collections – The aggressive Collection Policy instituted approximately 18 months ago has now returned $843,617 to the Association in past dues collect- ed. The simple reality of our annual dues now is that they mirror the payment of our state and municipal taxes. Just like not paying taxes, the person loses the property; it’s not personal. We are initiating foreclosure actions against delin- quent accounts at every monthly meeting. It is patently unfair to the people who honor their financial obligations to the Association not to implement this policy, many of which make significant sacrifice to do so. President’s Message cont.office in regard to the violation of a properly adopted rule. In doing so, please if possible accompany the complaint with pictures or video as evidence of the violation. If there is sufficient cause, a fine will be issued. The person in receipt of the fine has a right to appeal in a hearing before the entire Board. This can be done in closed session or open session, whichever is preferred. The main goal with this is compliance. We do not enjoy issuing citations and we do not use this as a revenue stream. Any fines collected are used to subsidize the community recreation events such as the New Year’s Eve and St. Patrick’s Day celebrations. Under no circumstances does the Board encourage or condone any actions that go beyond the passive actions of documentation. Under no circumstances do we permit vigilantism. Sharing our Community with Nature It has become abundantly clear in some areas of Winona Lakes that wildlife is flourishing in the community. With many reported bear sightings late this summer, we thought it prudent to share some helpful tips from the Pennsylvania Game Com-mission to ward off raiding of garbage, gardens, or feeders on property. From the Pennsylvania Game Commission: “Some people draw wildlife into neighborhoods or onto their properties by of-

fering wildlife foods such as seed or suet; throwing table scraps out back; improper-ly storing garbage; outside pet feeding; or maintaining a grease-loaded grill. Litter – even discard-ed candy – also will attract wildlife. Stop-ping these activities can certainly make a difference when wildlife has become a nuisance in your area. Cleanliness should be a standard operating proce-dure for those not interested in sharing their space with wild animals.”

Ken AndersWhen was the last time you received the Winona gram? How do you get information about your community? How do you find out how to run for the board or join a committee? Did you know that we have a newspaper called the Winona gram that the board is required to publish 4 times a year per bylaw 7.3P.

My name is Ken Anders. I have been living in Winona Lakes for over 20 years and I am very concerned for the members and the health of the community. I have been seeing more rules, fines, gates locked and no trespassing signs as opossed to flyers for community events as was done in the past. This is very cold and uninviting; I remember the days when we used to have many parties and BBQ’s where neibhors could meet neighbors, I have served as president and the following committes, Executive, Management, Ethics, Architectual, Election, Recreation, Maintenance, Finance, and the Winonagram. The current board promised transparency and improvment to our roads and have not delivered. I want to bring us out of the dark, bring back the warm open enviorment, while informing you what is equitable and true reguarding your community! We need a change that is not abused by power but rather a board that is willing to work hard and explain to the community how the dues are being spent, what are the current projects and plans and how they are going to be implemented. Daniel J. D’Arco, MDAs a practicing physician I see people suffering every day, and truly, the source of much of the loss we feel stems from living alone in places without community, and this community is clearly starving; starving for ethical leadership, fairness, and heart

Many who have hoped to see our community grow have been on our knees hoping for change. But we are getting up and we want you to join us! We need you to join us – in supporting only 3 candidates this election: D’Arco, Anders, and Graham.

If you elect us, we pledge and promise to run an ethical professional board and foster an environment where a healthy family oriented community can thrive again!

We pledge to balance our budget, to maintain priorities of maintaining critical infrastructure above all else, to follow Bylaws strictly especially in matters of dues and spending, and to dismantle pet projects that do not give the community at large a chance to benefit.

I wish to thank all of you for you past support and the honor of allowing me to serve on our board for the past eight years. I am one of the founding members of Winona Lakes Homeowners for Reform. Together we have made Winona Lakes one of the most owner-member empowered property owners association in all of Pennsylvania. Bylaw changes, which placed the power of Special Assessments, dues increases and most major decision making directly into the memberships hands, is something all attorneys find unique. We have always believed the collective wisdom of the entire membership is better than that of a handful of people; to date we have been right.

My most important goals if elected:• The permanent closure of skiing operations.• Lawful remedy to arbitrate every delinquent account.• A written plan to address and improve all roads, to be voted on by our

membership.• An aggressive plan to negate the internet-based short term rentals and

the detriment it has caused to our property values.• Closure and a full accounting to the membership of the 2011- 2013

I have had the privilege of being your President for six of the eight years I have served. During that tenure, I have acquired a great deal of knowledge, expertise and experience in the running of the affairs of Winona Lakes. Janet FosterHi, my name is Janet Foster and I am asking for your support once again in my election effort to the WLPOA Board of Directors. I am a member of Winona Lakes Homeowners for Reform.You may remember me from 3 years ago when I stated I was a fly on the wall waiting to see what happened next with our community. First I wish to say thank you for your support as I was elected to serve the community. I have gained much knowledge on the inner workings of our Association by serving as a Director.

I will say serving on the Board of Directors has been an eye opening experience, some good some bad, but it has been worth every minute. The current board has accomplished more in the last 3 years than any other board in the last 20 years. We have collected an enormous amount of past dues that will be used for improving the infrastructure of the Association. I am proud to have been part of that process.

Never has a board worked so well together and accomplished so much. Sure we don’t always agree but the bottom line is we vote with what’s best for the community as a whole and not a personal agenda.

If I am elected, I will continue to promote honesty and transparency within our Association to continue the good work the current board has done.

Laura MassaroAs a board member I plan to help improve our community and help protect the value of our homes. I will do this by learning more about our day-to-day operations and how to improve them. Also by getting to know more of our neighbors, understanding their needs and expectations and working with them to come up with ideas to help make the community better.

TheBoardofDirectorsbeingvestedwiththedutyandobligationofdeterminingallmattersofpolicyanddecisionsoftheAssociationandsuchotherdutiesassetforthbytheBy-Laws.TheBoardofDirectors,aspertheAssociationsBy-LawsshallLevydues,fees,charges,assessmentsandotherfinancialobligationsofmember-shipasauthorizedinthebudgets,theBy-Laws,Association’sRulesandRegula-tions,and/orcovenants.ARTICLEVII;Section7.3;Paragraph(D).

1. AspertheBy-LawsARTICLEXVIII;Section18.1: DuesNoticesshallbesubmittedtothemembershipnolaterthanthirty(30)dayspriortothebeginningofthefiscalyear.Saidnoticesshallincludethelot,blockandsectionnumber,themember’snameandpermanentaddress,theamountdueforthecurrentensuingfiscalyearandallunpaidpriorbalances.Allsuchamountsshallbedueandpayableinfullwithin30daysfromtheduedate

thereof,exceptasotherwiseprovidedbytheBoard.Interestattherateof1.5%permonthshallbeaddedtotheamountduetheAssociationforallpaymentsreceivedaftertheduedate.Intheeventfullpaymenthasnotbeenreceived,theAssociationshallemployallappropriatemethodsforsecuringcollectionsofthesame,including,butnotlimitedtothefilingofsuitsandtheseizureand/orsaleofthedelinquentmember’srealand/orpersonalproperty.Intheeventanysuch proceedings are brought, there shall be added to the amount due theAssociation’sreasonablecostsofcollection,includingcourtcostsandattorney’sfees.

2. The assessments (dues) are payableinfullnolaterthanOctober1stannually.ShouldthepaymentnotbereceivedbyOctober 30th the account shall be assesseda$35.00latefee.

3. Member(s)mayparticipateinatwo-paymentinstallmentpaymentagreementifallpriorbalancesarepaidinfull.Thefirstpaymentof50%oftheannualassessment (dues) is due October 1st;anypaymentnotreceivedbyOctober30thshallincurlatefeeof$35.Thesecondpayment/remainingbalancemustbepaidinfullbyFebruary1st;anypaymentnotreceivedbyMarch2nd shall incuralatefeeof$35.

4. Simpleinterestatanannualrateof18%calculatedonamonthlybasisfromthe due date, shall be added to all member accounts past due, including all currentyearassessmentsoutstandingafterOctober1stofeachyear,aspertheAssociationsBylaws.

5. AmembermayalsoparticipateinaBoardofDirectorsapprovedInstallmentPaymentAgreement.AnyandallpriorbalancesmustbepaidinfullpriortocommencementandapprovalofenteringintotheInstallmentPaymentAgreement.TheInstallmentPaymentagreementmustbenolongerthanaten(10)monthtermandbepaidinfullnolaterthanJuly30thofeachyear.Thereshallbea$50administrativefeetoparticipateintheInstallmentPaymentAgreement.TheadministrativefeemustbepaidinfullatthetimeoftheapplicationinorderfortheInstallmentPaymentAgreementtoberatified.PaymentsmustbereceivedintheAdministrationOfficebythelastdayofeachmonth;anypaymentnotreceivedbythelastdayofthemonthshallincuralatefeeof$5.

a. AnInstallmentPaymentAgreementshallbeconsiderednullandvoidiftwo(2)ormorepaymentsarelate.PertheAssociationsBy-Laws,ARTICLEIV;Section4.3;Paragraph(C)TheAssociationmayenterintoinstallmentpaymentagreementswithmembersrequestingsoforfinancialhardships.ThisshallbedoneatthediscretionoftheCommunityManagerinAssociationwiththeExecutiveCommittee.Membersonapprovedpaymentplansshallnotbechargedinteresttotheoutstandingamountbutshallbeassessedwithanadministrativefeewhichshallbeincorporatedintothepaymentagreement.MembersonapprovedInstallmentPaymentAgreementshallsignanagreementfortheplanwhichstatesthemonthlyamount,duedatesandrightsandprivilegesofmembership,andconsequencesshouldthememberfailtomeettheobligationsoftheagreement.

6. WhenacheckpresentedtoWinonaLakesforanypaymentdueisreturnedunpaidbythebank,themembershallpaya$50chargetotheAssociation.

7. Memberswhoarenotingoodstandingshallnotbeentitledtoamenitybadges.

8. Inadditiontotheabovepenalties,thefollowingactionwilltakeplaceagainstmemberswhohavepastduebalances:

November:Latenotice,whichwillincludepenaltiesaccruedasofOctober30.

December:WarninglettertoadvisethattheAssociationisauthorizedtobegincollectionproceedingsifpaymentisnotreceivedbyDecember31st.Mem-ber(s)willbeadvisedthatsuchactionshallinclude,butnotbelimitedto,thefilingofliens,judgments,seizureandsaleforthepurposeofcollectingsaidfeesandreasonableattorneyfees,asauthorizedbytheWLPOABylaws.

January:Notificationoflegalintenttofileacomplaintinthejudicialsystemifpaymentisnotreceivedwithinten(10)daysfromdateofnotification.Ifpaymentisnotreceived,theAssociationwillfileallnecessarydocumentationinordertohavejudgmentontheownerofrecord,placealienontheproper-tyaswellasexecuteonjudgmentforthesaleofrealorpersonalpropertyinordertosatisfyalloutstandingdebtstotheAssociation.

9. A$200.00collectionfee,inadditiontoallfilingandcourtfeesshallbeappliedtothedelinquentmembersaccountimmediatelyuponenteringthecollectionphase.TheAssociationshallfileallnecessarydocumentstosecureajudgmentandobtainsubsequentlienontheproperty,judgmentofowner(s)ofrecordandmayfileforthesaleofthepropertyand/orpersonalassetsbytheSheriffofMonroeorPikeCountytosatisfyanyandalloutstandingobligations/debtstoWinonaLakes.

10. TheCommunityManagermay,ifallin-housemeanshavebeenexhausted,sendtheaccounttotheAssociationscounselforfurthercollection/enforcement.

11. Owner-membersareresponsibleforanyandallattorneyfeesandcostsassociatedwiththecollectionofsuchdebt.

Please note that all owners shall remain responsible for any and all assessments (dues), fees and charges regardless of the owners’ failure/lack of use of the ame-nities and/or abandonment of said property.
