    protected animal meansany ani mal speci f i ed in the ThirdSchedule;protected bird means any bird other than the birds speci-fied in the Second Schedule;shooting season in relation to any kind of game birdsmeans, as respects any year the period declared by theMinister by order, in that year during whichthehuntingof game birdsof that kind is allowed;trap means any contrivance or structure, whether 6xcdor movable, used or intended to beused for taking orfacilitating the taking of f i sh;vehicle includes a motor vehicle as defined insection 11(1) of the Road Tr&c Act, a bicycle or an aeroplane;water includes the sea and any harbour, bay, creek, lake,lagoon, pond, river, streamorcanal.

    Animal s and Bi rds3.-(1) The areas specified in the First Schedule arehereby declared to be Game Sanctuaries.

    (2) The Minister may by order amend the FirstSchedule by adding thereto or deleting therefromamareaspecifiedinsuch order.4.-( 1) Every personwh-

    (a) hunts any animal or bird in a Game Sanctuary;or(b) takes the nest or egg of any bird in a GameSanctuary;or(c) is found within a Game Sanctuary under ci rcumstances showing that he was hunting any animalor bird or taking or intendingto take thenest oregg of any bir& or(d) takesany dog into or know ngl y permts any dogto enter or be in a Game Sanctuary; or(e) carries in aGame Sanctuary any gun, catapult orother weapon capable of being used to huntanimalsor birds,--- [ The nclusionof thispage i s authorized by L.N. 146/19991

    (2) Any person found in a Game Sanctuary in pos-session of any animal, bird, birds nest or egg shall bedeemed to have hunted such animal or bird or taken suchnest or egg insuch Game Sanctuary unless the contrary beproved.

    5 4 1 ) The Minister, on the written application of the :%Rowner or occupier of any lands, may by order apply in 5611960sions of section 4 with such modifications, to be specifiedin the order, as appear to the Minister to be appropriate.

    (2 ) An area in relation to which an order is in forceunder this section is in ths Act referred to as a GameReserve.

    (ii) during the shooting season on any day otherthan the first day thereof or a day prescribedunder subsection (1);(b) takes or has in hi s possession for sale, hawks, offersfor sale or sells, or stores in any commercial coldstorage, any game bird,shall be guilty of an offence against this Act.

    (3) Any Game Warden or Constable who has reason-able cause to suspect that game birds are being stored inany commercial cold storage may (without prejudiceto anyother powers conferred on him by this Act) at any reason-able time enter and i nspect such cold storage and maysei ze and detain for the purpose of proceedings under thisAct any game birds found therein.8. Every person who-

    ( U) takesor attemptsto take; or(b) sells or has in hi s possession for the purpose ofsale,any turtle eggs shall be gu lty of an offence against thisAct.

    8A. Any person whohunts any animal or bird inor takesany eggs from the exclusive economic zone without alicence issued under this Act shall be guirty of an offenceagainst this Act.

    Fish9.-(1) Every person who-

    ( U) takes or attempts to take; or(b) knowingly kills or injures or ac.2mpts to kll orinjure;or(c) knowingly buys, sells, exposes for sale or has inhis possession,

    (2) Paragraph (a) of subsection (1) shall not applyto any person who takes a fish accidentally and returnsittothe water with the least possible delay.(3) For the purposesof this section a fishisimmature8 it i s of a si ze smaller than the size prescribed by anyregulationsmade under secti on 14.

    10. Every personwhc+(a) uses, or causes to be used, dynamite or other 0 0 ~ 0 ~explosive substance with intent thereby to take,kill or injure fishin any wategor(b) placesor causes to be placed any poison, limeornoxious material in any water with intent therebyto take, kill or injure fish that may then be ormay thmafter beput therein;or(c) unlawfully and maliciously cuts through, breaksdown or otherwise damagesor destroys any dam,floodgate or slui ce with intent thereby to take,kill or injure fish; or0 uses or causes to be used in any river, streamorcanal any trap other than an authorized trap,

Notwithstanding anything to the contrary every p r o metperson who causes or knowingly permits to floworputs or -Gg=knowingly permits to be put, whether directly or indirectly g;d;dointo any harbour, river, stream, canal, lagoon or estuary,containing fish, any trade effluent or industrial waste or %y;liw8.

    SecondandThirdSchedule&

    1 4 . 4 ) The Authority, with the approvalof the Ministermay make regulations generally for the better carrying outof the provisionsof this Act.(2) Regulations made under this section may, with-out prejudice to the generality of the power conferred bysubsection (1

    (U ) alter or amend the Second and Third Schedules;(b) control either generally or for any specified periodorperiodsthe taking of any fish or of any specifiedspecies of fish either throughout the Island or inany specified waterorarea;(c) make provision for the stockingof any water withfish and for the establishment and control of fishsanctuaries and hatcheries;(d) control either generally or in respect of any speci -fied water or area the methods and traps whichmay be employed in hunting any animal or birdor in taking any fish;(e) restrict or i mpose conditions in respect of thekeeping of any animal, bird or fish in captivity;v) limit the number of game birdsor fish which may

    (3) Notwithstanding the provisions of section 29 of L.Nthe Interpretation Act, regulations made under this Act 58j-1998.may prescribe greater penalties than those specifi ed in thatsection so, however, that the maximum penalty that maybe imposed shall be a fineof one hundred thousand dollarsand imprisonment for two years.(4) The Minister may, subject to afErmative resolu- LN.tion of the House of Representatives, amend the penalty 581 1998.specified in subsection (3).

    15.-(1) Any Fishery Inspector may for the purposeof- P t o(a) st ocki ng any water with fi sh; or mtabda(b) inspectingany water containing fi sh,at all reasonable times of the day enter, remain upon and

    traverse any lands.(2) Any Game Warden, Fishery I nspector or Con-stable may, where he has reason to suspect that any offenceagainst t h i s Act or against any regulations made thereunderis being committed or is about to be commtted, at anytime of the day or night enter, remain upon and traverseany lands.(3) Every person who refuses to admit or

    (a) any Fishery Inspector in the exer ci se of any ofthe powers conferred by subsection (1): or(6) any Game Warden, Fishery InspectororConstablein the exercise of any of the powers conf er r ed bysubsection (2),

    10 WILD LIFE PROTECTIONwhom he may have reasonable cause to suspect of havingcontravened any of the provisions of this Act or of anyregulations made thereunder, and may stop and search anyvehicle, boat or other conveyance in or upon which hehas good cause to suspect that there is any animal, bird orfish or the nest or egg of any bird in respect of which anyoffence against thisAct or any regulations made thereunderhas been committed or inor upon which hehas reasonablecause to suspect that there is any gun, catapult or otherweapon or any trap used in the commssion of any suchoffence.

    nW 17 Where any person is found committing, or is reason-ably suspected o being engaged in committing 811 offenceagainst this Act or any remlations made therander, anyGame Warden, Fishery Inspector or Constable may with-out warrant stop and detain himand if his name andaddress are not known and he fails to give them to thesatisfactionof the Game Warden, Fishery Inspector orCon-stable such Game Warden, Fishery Inspector,or Constable,may without warrant apprehend him and, where sucharrestis effected by a Game Warden or Fishery Inspector, shallforthwith deliver him into custody at the nearest pol i cestation to be dealt with according to law.

    18. Whereany person is found offending against this Actor against any regulations made thereunder, any otherperson may require the offender to give his name, descrip-tion and place of abode, and in case the offender does nottruly give hi s name, description and place of abode, suchoffender shall, in addition to any other penalty to whichhemay be liable under this Act, upon summary convictionbefore a Resident Magistrate, be liable to a fine not exceed-ing forty thousand dollars or to imprisonment for a termnot exceeding twelve months.

    19. Every person who- Penalty forassaultinggame(a) assaults, obstructs, hinders or resists; or warden,FisheryInspector or(b) aids, abets or incites any other person to assault,obstruct, hinder or resist,

    any Game Warden, Fishery Inspector or Constable in theexecution of his du ty under this Act shall be guilty of an offenceagainst this Act.20. Every person guilty of an offence against this Act for Penalty for
