ABSENTEE BIDDING
1. if you are unable to attend you may bid before the sale, usingthe form provided. enter the maximum you are prepared tooffer for each lot and the auctioneer will represent you as if youare personally attending the sale. Lots are knocked down atone step above the next highest bid, and not necessarily atyour highest bid. example: your bid is €1,000 and next highestbid is €800 – the hammer price is €850.
2. Limit bidding: Absentee bidders may limit their totalpurchases to a set amount by entering their limit on thebidding form. this is especially useful for bidders wishing tocover as many lots as possible while setting a maximumamount to spend.
3. “or” bidding: Absentee bidders who wish to bid on two ormore lots, but only wish to purchase one, may do so byentering “or” between the bids – the lots will be bid on incatalogue order.
4. eQuAL bids: in the event of equal bids being received for thesame lot the first received will be given preference. if theinstruction “break ties” is entered on the bid form theauctioneer will increase the bid by one step in the event ofequal bids being received or in the event of a tie with a roombidder.
5. “buY” bids: unless otherwise instructed bids of “buy” or “buy atbest” shall be taken to indicate bids of up to three times thestated higher estimate in the catalogue.

However, the descriptions are not intended to be, are not andare not to be taken to be, statements of fact or representations of fact inrelation to the lot. they are statements of the opinion of the auctioneers,and attention is particularly drawn to clause 5 set out below. commentsand opinions, which may be found in or on lots as labels, notes, lists,catalogue prices, or any other means of expression, do not constitute partof lot descriptions and are not to be taken as such unless they are made orspecifically verified by the auctioneers.
Clause 1 (a) each lot is put up subject to any reserve price imposed by the vendor (b) subject to sub-clause (a) of this clause, the highest bidder for each lotshall be the purchaser thereof (c) if any dispute arises as to the highest bidder the auctioneer shall haveabsolute discretion to determine the dispute and may put up again andre-sell the lot in respect of which the dispute arises.
Clause 2(a) the bidding and advances shall be regulated by and at the absolutediscretion of the auctioneer and he shall have the right to refuse any bid orbids. note: Where an agent bids, even on behalf of a disclosed client, theauctioneer nevertheless has the right at his discretion to refuse any suchbid. (b) the purchaser of each lot shall immediately on its sale, if required bythe auctioneer, give him the name and address of the purchaser and payto the auctioneer at his discretion the whole or part of the purchasemoney. if the purchaser of any lot fails to comply with any suchrequirement the auctioneer may put up again and re-sell the lot; if uponsuch re-sale a lower price is obtained than was obtained on the first salethe purchaser in default on the first sale shall make good the difference inprice and expenses of re-sale which shall become a debt due from him. (c) Where an agent purchases on behalf of an undisclosed client suchagent shall be personally liable for payment of the purchase money to theauctioneer and for safe delivery of the lot to the said client.
Clause 3(a) the auctioneer reserves the rights to bid on behalf of clients includingvendors, but shall not be liable for errors or omissions in executinginstructions to bid. (b) the auctioneer reserves the rights, before or during a sale, to grouptogether lots belonging to the same vendor, to split up and to withdrawany lot or lots at the auctioneer's absolute discretion and without givingany reason in any case. (c) the auctioneer acts as agent only, and therefore shall not be liable forany default of the purchaser or vendor.
Clause 4(a) each lot shall be at the purchaser's risk from the fall of the hammer andshall be paid for in full before delivery and taken away at his expensewithin one day of the sale. the buyer will be responsible for all removal,storage and insurance charges in respect of any lot which has not beencollected within one day of the date of sale. (b) if any purchaser fails to payin full for any lot within 21 days of the date of sale such lot may at any timethereafter at the auctioneer's discretion be put up for sale by auction againor sold privately; if upon such re-sale a lower price is obtained than wasobtained on the first sale the purchaser in default on the first sale shallmake good the difference in price and the expenses of re-sale which shallbecome debt due from him. (c) interest at 2 per cent per month and legalcosts (if any) for recovery of monies due shall be payable by the purchaseron any overdue account.
Clause 5(a) All lots are made available for inspection before each sale and eachbuyer, by making a bid, acknowledges that he has satisfied himself as tothe physical condition, age and catalogue description of each lot(including but not restricted to whether the lot is damaged or has beenrepaired or restored).
(b) All lots are sold with all faults and imperfections and errors ofdescription and the Auctioneer and its employees, servants or agents shallnot be responsible for any error of description or for the condition orauthenticity of any lot, save for clause 5 (c) below. Written or verbalcondition reports may be supplied by the Auctioneer on request but theseare merely statements of opinion, and any error or omission in thesereports may not be taken as grounds for a cancellation of sale or refund ofany part of the purchase price or the cost of any repairs to the lot or lotsreported on(c) A purchaser shall be at liberty to reject any lot if he - (i) gives theauctioneer written notice of intention to question the genuineness of thelot within seven days from the date of sale; And (ii) proves that the lot is adeliberate forgery and (iii) returns to the auctioneer within 20 days fromthe date of sale the lot in the same condition as it was at the time of sale;provided that the auctioneer may, at his discretion, on receiving a requestin writing from the purchaser, extend for a reasonable period the time forreturn of the lot to enable it to be submitted to expertisation. note: theonus of proving a lot to be a deliberate forgery is on the purchaser.(d) Where a lot has been submitted to expertisation, all costs of suchexpertisation shall be paid by the person who retains the certificate ofexpertisation and item or items to which the certificate relates.(e) Where the purchaser of a lot discharges the onus and acts inaccordance with sub-clause (b) of this clause, the auctioneer shall rescindthe sale and repay to the purchaser the purchase money paid by him inrespect of the lot.(f ) no lot shall be rejected if, subsequent to the sale, it has been marked byan expert committee or treated by any other process unless theauctioneer's permission to subject the lot to such treatment has first beenobtained in writing.(g) Any lot listed as a "collection, range, portfolio etc." or stated to compriseor contain a collection or range of items which are not described shall beput up for sale not subject to rejection and shall be taken by the purchaserwith all (if any) faults, lack of genuineness and errors of description andnumbers of items in the lot, and the purchaser shall have no right to rejectthe lot; except that, notwithstanding the foregoing provisions of this sub-clause, where before a sale a person intending to bid at the sale givesnotice in writing to, and satisfies the auctioneer that any such lot containsany item or items undescribed in the sale catalogue and that personspecifically describes that item or those items in that notice, then that itemor those items shall, as between the auctioneer and that person, to betaken to form part of the description of the lot. clause 6 the respectiverights and obligations of the parties shall be governed and interpreted byirish law, and the buyer hereby submits to the exclusive jurisdiction of theirish courts..

The Art Collection of Desmond P.H. Windle (1933-2014) Lots 1-38 Whyte’s are proud to present the selection from the collection of artworks formed by Desmond Windle, a distinguished lawyer and art lover. Desmond’s life-long interest in art developed as a young solicitor in 1950s Dublin, inspired by his aunt’s (Molly Matthews) love of art. A regular attendee at galleries and studios, he collected modern and contemporary Irish art for over 60 years. He supported many young emerging artists and, in the early days, acquired some paintings by way of barter in exchange for legal advice to the frequently impecunious artists being threatened with eviction. Invariably their tenancy was secured. He never stopped collecting and decorated all available wall space in his home with a diverse collection of works and, thereafter, most available floor space. Favourites included works by Patrick Collins, John Behan, Michael Kane, Gerald Davis, Felim Egan, Robert Ballagh, Charles Brady, Charles Harper, George Campbell, Bernadette Madden and Seán McSweeney. Works from this wonderful collection, included in this 23 October 2017 sale, are lots 1 to 38.

Exhibited: Royal Academy of Arts Summer Exhibition, London, 2001Born in Richmond, Surrey in 1932, he studied: at Worthing Technical and Art College 1949-1951. He lives and works in Dorset. A visit to the seminal exhibition, This is Tomorrow at the Whitechapel Gallery in 1956 proved to be a lasting influence on the work of Mike Geary. He was an early exponent of collage and silkscreen printing, taking inspiration and using images from the media and popular culture throughout the 1960s and 70s. As a young artist Geary admired the work of his contemporaries, Richard Hamilton, Eduardo Paolozzi, Peter Blake and Joe Tilson and developed his own language. His brightly coloured canvases, sensuous abstracted figures and images from space exploration reflect the vitality and aspirations of that era.

Andrew Painter was born in 1957 in Wolverhampton (Great Britain). After a year of preparatory school of Fine Arts, he joined the Goldsmiths College in London. He left the school after a few months and spent a year in Calcutta. Back in England, he led a group of artists and began to exhibit his works. He arrived in France around 1988 and settled in Angers, where he still lives. He has exhibited with the Origin Gallery, Dublin, from 2001, most recently in 2017.

Welsh born William Mason was a regular exhibitor with the McClelland Galleries in Belfast and at the Royal Academy. He studied at Newport College of Art from 1923-1927, the Royal College of Art from 1927-1931, and later taught at Scarborough School of Art and at St. Albans School of Art until retirement in the early 1970s. His brother, Gilbert Mason (1913-1972) also a painter, was based mainly in Birmingham.

Frederick O’ Neill Gallagher was an Irish landscape painter, who spent much of his life painting in France in the district of Corbeil, a small town on the Seine, south of Paris. He was fascinated by the French Post-Impressionist School of Painters and his work is reminiscent of Monet. Gallagher used a constrained palette of muted blues, greys, pinks and greens to convey the hazy summer morning light, in his paintings of the Seine. While living in France he sent work back to England and Ireland for exhibition in London and Dublin. He exhibited at the New English Art Club in 1910, and works are known dated 1905 to 1915. An example of his work, A View On The Seine 1915 is in The Ulster Museum. Although his birth date is not recorded it is believed he died circa 1937.

Phillip Moysey (13 July 1912 - 7 March 1991) was an English artist who lived in Kent, inspired by the people and landscapes of the county. During the 1930s, Moysey worked at several London advertising agencies, including Lintas Ltd from 1935 alongside Keith Vaughan (1912 - 1977). In 1940, he met the Austrian expressionist artist Oskar Kokoschka (1886–1980), who called Moysey “my first English pupil”. Another portrait of Jack Yeats sold at Whyte’s in 2005.

The Punch and Judy subject is significant in that it was Lowry’s first image to be reproduced in print in 1943 in the middle of WWII. It was produced as a lithograph by the Baynard Press, London where it was printed in an edition of 6,000 and sold for about £3 each. After the war Lowry participated in a project called the Rawnsley’s School Prints; an initiative aimed at brining Contemporary Art to a wider audience particularly children. Other artists involved included Henry Moore, John Nash and John Tunnard. All the prints were produced to the same size with the idea being that they would all fit into standard frames and would be interchangeable. The original work in oil sold most recently on 25 March 2014 through Sotheby’s for £962,500 GBP inclusive of buyer’s premium.

Mavis was a neighbour of George McClelland when he was living in London. One of the addresses recorded on her drawings is Yateley Road, Edgbaston, Birmingham. Among the collection is artwork for Lewis’s Children’s Week and for Lever Brother’s Lux product.

Phil May was an influential social and political charicaturist of the late 19th and early 20th century who worked in England and for a 3 year period in Australia, where he worked for the Sydney Bulletin. He was noted for his economy of line and sympathetic treatment of lowerclass city life. He began to publish his own annuals in 1892 and later was employed by Punch. Examples of his work are held by the Victoria and Albert museum and the British museum as well as by major Australian and English galleries.
