Hospitals (Licensing and Conduct of Private Hospitals) Regulations 1987 amended

3. After regulation 4 of the Hospitals (Licensing and Conduct o f Private Hospitals) Regulations 1987* the following regulation is inserted - &L

Endorsement of licence to allow admission etc. under Mental Health Act 1996

4A. (1) , An application to the Commissioner for a licence to be endorsed under section 26DA of the Act is to be made in a form approved by the Commissioner.

(2) An applicant for a licence to be endorsed under section 26DA of the Act shall cause a fee of $100 to be paid to the Commissioner before the endorsement is made.

(3) The fee to be paid under subregulation (2) is in addition to any other fee payable in respect of a licence.

MENTAL HEALTH (CONSEQUENTIAL PROVISIONS) ACT 1996

lMENTAL HEALTH (TRANSITIONAL) REGULATIONS 1997

Made by the Governor in Executive Council.

Citation

1. These re lations may be cited as the Mental Health ~Tramitwnal) Regulations 1@7.

Commencement

2. These re lations come into operation on the same day as the Mental f= Health Act 19 6 comes into operation.

Interpretation

3. In these regulations, the definitions set out in section 53 of the Act apply.

Patient discharged to after-care under the repealed Act

4. (1) The psychiatrist in charge of psychiatric services at a hos ital from R which, immediately before the commencement, a patient is disc arged to after-care under the repealed Act may, a t any time until a determination is made in respect of that person under section 69 (3) of the Act, rescind the discharge of the patient to after-care and recall the patient to that hospital or another authorized hospital.

(2) A patient who has been recalled under subregulation (1) is to be regarded as a person sub'ect to detention as an involuntary patient by force of an order under section 4 B (2) (a) of the new Act.

(3) A patient who does not return when recalled under subre Iation (1)

and may be apprehended under section 58 of that Act. R.' is absent without leave within the meaning of that expression in t e new Act

(4) A patient discharged to after-care under the repealed Act immediately before the commencement may, a t any time until a determinat~on is made in respect of that person under section 69 (3) of the Act, seek re-admission to an authorized hospital and such a patient is to be received into the authorized hospital and -

(a) ma be detained there for 72 hours after the time of reception; an B

(b) is to be examined by a psychiatrist who is to determine, having regard to section 26 of the new Act, whether the person - (i) should be an involuntary patient under the new Act; or

(ii) should be discharged from status as a patient.

(5) If the ps chiatrist determines that subre lation (4) &) (i) applies, he or she is to m&e an order under section 43 (2) &or (b) of the new Act.

(6) If the psychiatrist determines in writing that subregulation (4) 01) (ii) applies, the patient is by that determination discharged from any status as a patient.

(7) In this regulation, unless the contrary intention appears -

"patient" means patient as defined under the repealed Act.

Commissioner m a 've directions with respect t o hostels approved under the r e p e a l e B E t

5. (1) The Commissioner may give such directions as he or she thinks fit to the holder of a licence to conduct a private psychiatric hostel referred to in section 57 of the Act, requiring any matter or thing to be done in relation to the hostel for the purpose of ensuring that the premises are suitable for use as a private psychiatric hostel.

(2) If a direction under subregulation (1) has not been complied with within the time s ecified in the direction the Commissioner may, by notice in writing given to t R e holder of the licence, cancel the licence.

(3) The holder of a licence cancelled under subregulation (2) may within 30 days of the cancellation appeal to the Local Court against the cancellation.

2. This order comes into operation on the same day as the Mental Health Act 1996 comes into operation.

Interpretation

3. In this order -

"hostel" has the same meaning as it has for the purposes of the regulations;

"regulations" means the Hospitals (Licensing and Conduct of Priuate Psychiatric Hostels) Regulations 1997.

Appointed days fixed 2. (1) The appointed day in relation to section 26K (1) (a) and (b) of the Act as applicable to and in relation to private psychiatric hostels is the same day as the Mental Health Act 1996 comes into operation.

(2) The appointed day in relation to section 26K (1) (c) of the Act as applicable to and in relation to private psychiatric hostels is the day that is 30 days after the day on which the Mental Health Act 1996 comes into operation. Dated: 28th October 1997.

Part 1 Amended 6. The principal local laws are amended in section 37 of Part 1, by deleting the words "marine stores,".

Part M Amended 7. The principal local laws are amended in Part IX-

(a) in Division A- (i) in section 14 by deleting "Wool-scouring establishments" and "Soap and

candle works"; (ii) in section 15 by deleting 'Wool-scouring establishments", "Fish shops" and

"Soap and candle works"; and (iii) by deleting Schedule "D".

(b) by repealing Divisions L, N, P and R.

Pursuant to the powers contained in Section 33 of the Bush Fires Act 1954, as amended, owners and/ or occupiers of properties within the City of Subiaco are hereby required on or before 30 November 1997, and thereafter to 31 March 1998, or within fourteen (14) days of the date of becoming owner or occupier (should this be after 30 November 1997) to maintain a fire break or remove flammable matter as follows-

(a) Where the land is 2024m2 (approximately '/, an acre) or less, remove all flammable matter from the whole of the land, (for the purposes of this Notice, flammable matter does not include low standing trees, cultivated plants or shrubs in gardens).

(b) Where the land exceeds 2024 m2(approximately V, an acre) you shall have a fire break not less than three (3) metres wide and clear of all external boundaries of the land and immediately surrounding all buildings and improvements on the land.

If it is considered impractical for any reason to clear fire breaks, or remove flammable matter as required by this Notice, you may apply to the Council or its duly authorised officers not later than 15 November 1997, for permission to provide a fire break in alternative positions, or to take alternative measures to abate fire hazards on the land. If permission is not granted by the Council or its duly authorised officer, you shall comply with the requirements of this Notice. Fee for applications to Council

16A. (1) The fee for making an application to the Council for re istration as a training provider is the fee specified in item 7A of Sc &I edule 1.

(2) If an application for registration is not accompanied by a certificate of assessment in a form approved by the Council, the Council may charge the applicant for the costs and expenses incurred by the Council in considering the application.

(3) If a charge imposed under subregulation (2) is not paid within the time specified by the Council when the charge is imposed, the amount of the charge may be recovered in a court of competent jurisdiction as a debt due to the Crown.

Regulation 20 amended

4. ReguIation 20 (1) and (2) of the principal regulations are repealed and the following subregulations are substituted - 4L

(1) The Minister may by notice published in the Gazette -

(a) reduce or waive any fee payable;

(b) provide for the refund of all or part of any fee paid; or

(c) allow for the payment by instalments of any fee (including a fee reduced under this regulation) payable;

under these regulations by a person specified in, or within a class of persons specified in, the notice on such conditions as are specified in the notice.

(2) The Minister may by notice in the Gazette specify concessional rates of fees payable by persons to whom regulation 21 applies.

(2a) The Minister may amend or revoke a notice under subregulation (1) or (2).

Re ylation 22 amended

6. After regulation 22 (2) of the principal regulations the following subregulations are inserted -

(3) If a student fails to pay an instalment when it becomes due and payable the governing council of a college may -

(a) withdraw the allowance granted under subregulation (l) or (2) and require the student to pay the total unpaid portion of the fee by a date specified by the council; or

Cb) cancel the enrolment of a student.

(4) The governin council of a college may only exercise a power under subregulation (8 if -

(a) the council has given the student 21 days written notice of its intention to do so; and

(b) any instalment payable before the notice was given remains unpaid at the expiry of those 21 days.

(5) If a student fails to pay an instalment, or an amount payable under subregulation (3) (a), when it becomes due and payable the governing council of a college may recover that amount in a court of competent jurisdiction as a debt due to the college.

Commencement

2. These regulations are deemed to have come into operation on the day on which section 67 (2) (c) of the Vocational Education and Training Act 1996 came into operation.

3. After regulation 35 of the principal regulations the following regulations are inserted - i I

Funds and accounts of colleges

36. (1) Any account established for a college under section 38 (2) of Colleges Act 1978 is to be taken to be an account established for that college under section 49 of the Act.

(2) All moneys that had been credited to, or placed to the credit of, an account referred to in subregulation (1) and which were available to the Council of the college under section 38 (1) of the Colleges Act 1978 are to be taken to be funds of the college under section 48 Cb) of the Act.

Funds and accounts for technical schools or technical colleges

37. (1) All moneys standing to the credit of an account established for a technical school or technical college under section 9B of the Education Act 1928 are to be taken to have been transferred to, and placed to the credit of, an account established under section 49 of the Act for the college on the commencement of the Act.

(2) All moneys transferred to, and laced to the credit of, an account for a college under subregulation (l? are to be taken to be funds of the college under section 48 Cb) of the Act.

(3) For the purposes of the Financial Administration and Audit Act 1985 the accountable officer in respect of the accounts referred to in subregulation (1) for the period ending on 31 December 1996 is the chief executive officer of the department.

State Employment and Skills Development Authority Account

38. The funds standing to the credit of the State Employment and Skills Development Authorit Account established under section 34 of K the State Employment and S ills Development Authority Act 1990 are to be taken to have been transferred to, and placed to the credit of, the Vocational Education and Training Trust Fund established under section 15 of the Act on the commencement of the Act.
