ELIGIBILITY

1. In order to be enrolled in to Symphony Rewards, members must provide all information requested on the web site on joining and notify Symphony Coatings immediately of any change to that information via the self update of the Member Details section. Updates to user’s information can be made through the Individuals or Members sections of the web page.

Standard enrollment takes place on the first working day in January, staff are eligible for the scheme when they have been with the company for 12 months or by directors approval.

2. Symphony Coatings has the right to remove individual Members from the program at any time, without notice.

3. Members have the right not to be part of Symphony Rewards, please contact Symphony Coatings directly to advise that you wish to be removed from this site.

SECURITY

4. Login IDs and passwords will be issued for all levels of required or appropriate access to Symphony Rewards for Members. Staff with Symphony Coatings system access will be able to use their current login and password on the Rewards website.

5. Each time a Member attempts to gain access to his or her area of the web site, they will be asked to key in their Login ID and password. If the Login ID or password is not correct, then access will be denied.

6. Symphony Coatings is entitled to act on instructions from a Member, or someone purporting to be that Member if the Login ID and password are correct.

7. Login IDs and passwords should not be divulged to anyone, be composed from information that could be guessed by anyone, or recorded anywhere in a format that can be deciphered. Symphony Coatings will not be held responsible for transactions that have taken place without the authority of the Member, where the correct login ID and password have been used.

8. If a Member suspects that a third party has become aware of their login ID and password, they should change their password immediately. Changes to passwords can be made through the “My Profile” area of the web site or by contacting Symphony Coatings directly.

ACCRUAL OF POINTS

9. Reward points will be awarded in accordance with criteria determined by Symphony Coatings.

10. Reward points will only be added to a Members account once the current invoice has been paid in full and an account is not in arrears if they are a current employee and in good standing with the company.

11. Reward points will normally be added to a Members account on a periodic basis.

12. Reward points will be input to Member accounts by Symphony Coatings and will be available for use on the same working day. Members should ascertain from Symphony Coatings how frequently and when points are forwarded for input.

13. Reward points may not be redeemed until they have been added to a specific account and confirmed by Symphony Coatings.

14. Accrued reward points do not constitute the property of a Member. Reward points cannot be transferred to any other person. Reward points will only be available while the member is an employee of Symphony Coatings.

15. Points awarded in connection with another loyalty program cannot be transferred to Symphony Rewards and vice versa.

16. Reward points that remain unused after the expiry date of a campaign or a previously defined period will be deducted from the points balance appearing on a Members account.

17. It is the responsibility of the Member to regularly check to ensure that rewards points have been correctly credited or deducted from their account.

REDEMPTION OF REWARDS

18. Rewards points can be redeemed by Members for a wide range of reward items as listed in the online catalogue section of Symphony Rewards web site at the time of redemption.

19. At the time of redemption, Members must have sufficient reward points in their account to cover the listed reward Point value of the item they wish to redeem otherwise the Member will be unable to purchase the item. Reward point value of online catalogue items may change without notice.

20. Redeemed reward points will be deducted from the nominated account at the time of request for redemption.

21. When an order has been processed for points to be redeemed, the request cannot be amended, withdrawn or exchanged for another reward. Please contact the customer service centre to advise.

22. Symphony Coatings is not responsible or liable for any reduction or redemption of reward points where the reduction or redemption is not authorised.

23. All reward items are subject to availability. One of the Symphony Rewards customer service team will advise the Member if rewards are out of stock and either offer an alternative product or a point credit.

24. Any warranty claims must be taken up directly with the manufacturer of the reward item should a warranty issue arise. Please contact the customer service centre for full details of the correct supplier and proof or purchase.

28. The time taken to deliver a Reward will vary. Symphony Coatings shall not be liable for any delay in delivery of a Reward item.

29. Where a reward takes the form of a voucher or gift card, it must be used before the expiry date. Symphony Coatings is not responsible for lost, stolen or expired vouchers or gift cards.

30. Where a reward takes the form of travel, Government taxes or airline surcharges may not be included and will have to be paid for by the recipient should it be required.

GENERAL

31. Subject to any responsibilities that cannot be excluded at law, Symphony Coatings is not responsible for rewards received under a rewards program, any death or injury, loss or consequential loss or damage from a reward or the loss, theft or destruction of a reward or a reward voucher.

32. Any dispute concerning goods or services received as a reward item shall be settled between the Member concerned and the rewards provider who supplied the goods or services. Symphony Coatings will bear no responsibility for resolving such disputes or for the dispute itself.

33. Companies, Branches, Members and Individuals are responsible for any taxation liability (including GST/VAT) or other government charges or reporting requirements arising from Membership of Symphony Rewards or redemption of points for rewards. Symphony Coatings does not offer any advice or accept any responsibility with respect to these matters.

34. Symphony Coatings reserves the right to change these Terms and Conditions of Use at any time.

35. Failure to enforce a particular Term and Condition of Use does not constitute a waiver of that term or condition by Symphony Coatings.

36. Symphony Coatings may exercise any right, power or remedy in this document at its discretion and separately or concurrently with any other right, power or remedy.

37. These Terms and Conditions are governed by the laws of the State of NSW.

38. If any provision of these Terms and Conditions are held to be invalid or unenforceable that provision:

(a) may be read down to the extent necessary to make it valid and unenforceable; or

(b) may be severed and the remaining provisions of the Terms and Conditions enforced.
