About the conference -

In order to foster the need for comprehensive legislative framework for

all the major forms of ADR and the effective and proper implementation

of ADR mechanism, the Legal Aid Committee is organizing this

International ADR Conference. The Conference aims at examining and

analyzing the framework, avenues, practices and procedure relating to

Arbitration and other forms of ADR. In furtherance with this basic

objective, the proposed conference aims to provide an independent

platform for an in-depth threadbare analysis of the recent trends vis-a-vis

the issues/challenges that the arbitration and other ADR mechanism in

our country are facing. The conference seeks detail reporting on regional

trends of ADR mechanism from the scholars, which would contribute to

the promotion and development of ADR and arbitration process.

The proposed conference seeks for participation of scholars in the area of

arbitration & ADR both from within and outside India. The deliberation of

the paper should highlight any form of ADR which is in practice in India or

outside and the corresponding issues in the practice of that form of ADR.

Papers dealing with challenges of ADR mechanism in commercial disputes

would be preferred. The theme for the conference is Challenges and

Prospects of Arbitration and other Forms of ADR.

Background

The right of ‘access to justice’ stands meaningless if individuals merely do

possess such right without any mechanism for the vindication of the same.

The effective access to justice enunciates the exploration of wide variety of

reforms within its notion and the reasons for such exploration are not

much in dispute. Congestion in courts, lack of adequate manpower and the

resources and the consequent procedural delay at every step of the

hierarchy of the court are some of the major factors which are ailing the

formal legal system of the traditional court room litigation. On the other

hand, the globalization of economy and the complexities of modern

commercial transaction demand speedy and effective mechanism for the

speedy redress of the allied disputes. With the Indian economy’s massive

strides towards becoming a global force, bolstering the dispute resolution

has been one of the top priorities for the policy makers given its direct

impact on ‘the ease of doing business’ in India. To cope with the

insurmountable challenge of arrears, the use of private and informal

dispute resolution mechanism which is known as Alternative Dispute

Resolution (ADR) hails as one of the most important attributes to the said

exploration of various reforms.

Dispute Resolution, being the ‘Genus’ acts as an indigenous healer with

Arbitration, Conciliation, Mediation and other similar forms as its ‘Species’

!!!!

The efforts to popularize the ADR mechanism and the promotion and

development of ADR facilities and techniques for early resolution of

disputes and lessening the burden of arrears in court are given a boost

through varied initiations. The enactment of the Legal services Authority

Act, 1987, The introduction to section 89 of the CPC, the enactment of the

Arbitration and Conciliation Act 1996 and its subsequent amendment in

2015, the establishment of mediation centers in different High courts etc

demonstrate the legislative consciousness and concern towards this goal.

But we need to remember that many factors that ail the formal legal

system, if not adequately addressed in the alternative systems, may hinder

the move for transformation. Needless to say that in our country, the ADR

mechanism is marred by various socio-economic and legal barriers. The

need for comprehensive legislative framework for all the major forms of

ADR, the effective and proper implementation of ADR mechanism, the

need of institutionalization as well as the evaluation and monitoring of the

mechanism and above all revolutionizing the mindset of the masses are

some of the urgent calls of the present day scenario.

The proposed conference seeks for participation of scholars in the area of

arbitration, conciliation, mediation  &  other forms of ADR, both from

within and outside India.

All the research papers submitted within the deadline shall be evaluated

by the Editorial Board and amongst those, only the Authors whose papers

have been shortlisted after evaluation shall be allowed to register and

present their papers in the Conference.

Amongst the papers that are presented in the conference, only a select

few shall be eligible for publication in the journal of the conference.

The research paper should be thematic, and identification of sub- themes is highly appreciated.

It will be desirable that the theme of the paper corresponds to the subthemes as mentioned below:

Submission Guidelines

The research papers should apply research skills and use of appropriate research methodology. It should have proper research questions and should also reflect the findings.

The abstract should be a maximum of 250 words indicating the theme, proposed research and five keywords.

The research paper should not be more than 8000 words. It must be typed in Times New Roman Font Size 12 on A4 size paper with 1”margin on all sides with 1.5 line spacing using MS word application.

Footnotes should follow ILI standard of footnoting. Endnotes are not allowed.

At the end of the paper, there should be a brief profile of the author with E-mail ID, contact number and address.

All abstract and paper submissions are to be mailed at [email protected].

It is to be noted that co-authorship is allowed to a maximum of two authors per research paper.

The registration fee for the authors/co-authors who shall be shortlisted for presenting their papers in the conference shall be as follows:

Kindly note the registration fee is inclusive of food for the delegates for all the three days of the conference and the

conference kit. Accommodation shall be given to participants who are students

and research scholars on a first come first serve basis on receipt of payment.

Participants who are Faculty and Professionals are required to arrange for their respective accommodation. However, the

Organizing Committee would facilitate in identifying the Hotels for the same while the payment has to be made by these

participants.

About The Competition 

The RMLNLU National Mediation Competition is a unique initiative that aims to upskill budding lawyers in Mediation, one of the widely followed

techniques of alternate dispute resolution. The term "mediation" broadly refers to any instance in which a third party helps others reach an

agreement.  In the year 2012, our University had successfully organized the first edition of RMLNLU Mediation Competition and the first of its kind in India, with an

overwhelming number of universities participating in it from all over the country. The second and third editions of the Mediation Competition,

organized in 2016 and 2017 respectively, were also hugely successful in garnering participation of about 40 teams from across the nation.  Mock sessions and lectures by eminent people in the field were conducted to

appraise the students of the pattern of the competition. With every passing edition, the competition continues to equip students in the field of

Mediation.

The Legal Aid Committee aspires to further its commitment

towards fostering ADR mechanisms by taking the Competition to

an international level. The Committee promises to make the

forthcoming IV edition bigger and better with increased

participation of students across the globe.

This year we have collaborated with ‘Peacekeeping And Conflict

Resolution Team’ (PACT) as our Chief

Advisory Organisation. PACT shall be organizing an Orientation

session for all the participants which shall enrich the Participants

with the requisite mediation and negotiation skills.

As part of the Orientation. sessions will be taken by a panel of

experts which includes

 Mr. Tom Valenti,  Ms. Claudia Winkler,  Mr. Pascal Comvalius, 

Ms.Catherine Davidson and  Mr. Jonathan Rodrigues.

A team shall consist of two members- one playing the role of a

mediator and the other of a client. In its one-of-a-kind pattern,

there shall be two mediators from different teams and two

different clients (all four from different teams) competing against

each other in a single round.

Each team shall contest in two preliminary rounds and based on

their cumulative scores top eight clients and mediators shall qualify

for quarter-finals.The top four mediators and clients will make it to

the semi-finals and the top two for finals.

Participation in the competition is through invitation only.

Any university/college/institute may request for an invite by sending us an email at

[email protected] before 23rd October, 2017.

The Competition has a team cap of 32 teams.While allotting slots to Universities; preference shall be

towards the invited teams, while the teams that apply to the organizing committee will be wait-listed until slots

are available. Registration Fees per team is INR 4000.
