Frazer Barton

Frazer has been in partnership in Anderson Lloyd and its predecessor

firms since 1988. He heads the Dunedin litigation team and has worked

extensively throughout his career in the insurance field. He has acted for

insurers and against insurers through the Courts at all levels up to and

including the Supreme Court. In recent times he has been counsel in both

the Western Pacific Insurance litigation and the Altimarloch litigation. His

principal area of insurance practice is professional negligence.

Neil Beadle

Neil is an accomplished insurance litigator, who is regularly instructed by

insurers on a broad range of claims. He is widely recognised for his maritime

law expertise, having led the DLA Phillips Fox insurance team in a number of

important cases, succeeding in the Court of Appeal, and the Supreme Court.

Neil is ranked by Chambers Asia-Pacific Guide 2013 as a leading shipping

lawyer, and identified as “one of the top practitioners in the field.” He

is chair of the New Zealand branch of the Maritime Law Association of

Australia & New Zealand.

Leon Briggs

Leon is the National Chief Adjuster of Cunningham Lindsey, and is also

Chairman of the New Zealand Division of the Australasian Institute of

Chartered Loss Adjusters. Leon handles a wide range of major losses, both

in New Zealand and overseas. He has worked as a forensic accountant

in New Zealand, USA and Fiji, and is recognised as an expert witness on

economic loss in the High Courts of New Zealand and Fiji. Leon is a Fellow

of ANZIIF and of AICLA, as well as a member of the Association of Certified

Fraud Examiners and the New Zealand Institute of Chartered Accountants.

Speaker profiles

Justice Mark Cooper

Mark is a judge of the High Court, based in Auckland and was appointed in

March 2003. He chaired the Canterbury Earthquakes Royal Commission

from its appointment in March 2011 until the final report was delivered in

November 2012 and was based in Christchurch throughout that period.

Darryl Cowan

Darryl is the Chief Executive Officer of Cunningham Lindsey New Zealand,

the country’s leading firm of independent loss adjusters. He has been

with Cunningham Lindsey for over 30 years as a financial claims adjuster,

and has held various senior management positions culminating in his

appointment as CEO in 2013. He has been on the NZILA Committee, and

its Honorary Treasurer, for a number of years. He is well equipped to speak

on general insurance matters from the loss adjuster’s perspective.

Andrew Flitcroft

Andrew is General Reinsurance Australia’s Client Service Manager with

responsibility for managing all aspects of Treaty client relationships

in Australia and New Zealand, and acting as team leader on the most

strategic and complex accounts. He is based in Sydney, is a Fellow of

ANZIIF and has 28 years experience in local and international insurance

and reinsurance markets.

Andrew started his career with Commercial Union Assurance in Sydney.

He held multiple underwriting, claims and management roles there,

including two years as part of the corporate planning team in Melbourne.

He joined Gen Re in 1996 as Property Facultative Manager, Sydney and

for the last 7 years he was the Property Facultative Manager, Asia Pacific.

In that role Andrew gained an in-depth understanding of Asian insurance

and reinsurance markets, travelling extensively throughout the Asia Pacific

region while overseeing Gen Re’s operations, maintaining contact with key

clients and sourcing new business opportunities.

Andrew transferred to his current role in 2013.

Michael Gill

Michael Gill has practised for over 40 years as a specialist insurance

lawyer.

He is the President of AIDA (the International Insurance Law Association),

as well as a member of the National Board of AILA, and is the Independent

Chair of the Code Compliance Committee for the General Insurance

Industry.

Michael currently performs a consultancy role with DLA Piper and over the

past 40 years of practice he has handled a wide variety of insurance and

reinsurance related issues. He is recognised as one of the leading lawyers

in the field. For many years he was the principal lawyer for NIBA as well as

many of its members. He was instrumental in the drafting of the original

Code of Practice.

He has represented insurance brokers in professional indemnity, regulatory

and compliance matters.

Michael is also passionate about work in the not-for-profit sector. Within

the firm he assists with pro bono activities on the Community Investment

Committee as well as being an Ambassador for New Perimeter, which is a

unique nonprofit organisation set up to provide long-term, high-impact pro

bono legal support in less developed and post-conflict countries. Outside

the firm, Michael works with ActionAid Australia and is Deputy Chair of the

James Milson Nursing Home & Retirement Village.

Michael was also President of the Law Council of Australia and the Law

Society of New South Wales, the founding Chairman of the Australian

Insurance Law Association, the inaugural Chairman of the Motor Accidents

Authority, and Chairman of the Solicitors Mutual Indemnity Fund.

Tim Grafton

Tim was appointed Chief Executive of the Insurance Council of New

Zealand in November 2012. Over the past 30 years he has had extensive

experience in the media, government, public relations and market research

sectors.

Prior to his appointment at ICNZ, he was Executive Director of leading market

research company, UMR Research, where he led a number of key research

projects particularly in the energy, primary industry and public sectors

providing strategic advice at Board and Chief Executive level. He has been

a senior adviser to former Prime Minister Rt Hon Dame Jenny Shipley, the

current Minister of Finance, Hon Bill English, and former Finance Minister

the Rt Hon Sir William Birch. He has also been a senior public relations

practitioner and lobbyist as well as a senior parliamentary reporter.

Chris Hlavac

Chris Hlavac is a partner at Young Hunter, a Christchurch based law firm

specialising in insurance law. Chris operates Young Hunter’s Auckland

branch office, and heads the firm’s insurance law team.

Chris has been in legal practice for 24 years. He acts for insurers and

intermediaries, specialising in the areas of general, liability and professional

indemnity insurance. He is regularly invited to speak at insurance industry

seminars.

Craig Langstone

Craig is a partner of Jones Fee, specialist insurance lawyers based in

Auckland. Craig has had almost 30 years’ experience in all facets of

insurance law since graduating from Auckland University in 1984. In that

time, Craig has acted for most New Zealand insurers and any number of

overseas insurers, syndicates and insurance brokers.

Craig’s practice encompasses a large amount of both property and liability

work. Liability work has taken something of a back seat over the past

couple of years as advice to insurers and (sometimes) insurance brokers

on the complex legal issues that have arisen out of the various earthquakes

in New Zealand, has taken a predominant role. Liability insurance

nevertheless remains a fundamental part of Craig’s practice.

Craig has been the President of the New Zealand Insurance Law Association

since 2007. He is well versed in speaking to insurance audiences on

topical insurance issues, both in New Zealand and overseas. His market

knowledge and legal expertise see him well placed to enlighten you on the

topics to be addressed at this year’s Annual Conference.

John Lucas

John Lucas started with the Insurance Council in 1996 as Insurance

Manager responsible for facilitating a number of the Councils technical

working committees and takes the leading role in coordinating the

industry response to an Insurance emergency event and is the Councils

spokesperson for property, marine and motor insurance issues.

Presently the Canterbury earthquake recovery involves much of John’s

time in coordinating various working groups in finding solutions to recovery

challenges.

John began his insurance career with NZI in the early eighties specialising

in farm insurance and commercial property underwriting. He made a move

to the UK where he worked for a number broker firms and eventually began

specialising in insolvency insurance placement both in the London and the

Sydney markets.

John is a Senior Associate of the Australian and New Zealand Institute of

Insurance and Finance

John Lyon

John has been CEO of Lumley NZ since May 2008. He has over 35 years’

experience in the insurance industry, across a range of functions and

markets which include Ireland, the UK and NZ (for the past 22 years). Prior

experience has included operational and strategic leadership of all major

insurance functions. Under John’s leadership, Lumley has undergone

significant change, with strong achievements in the turnaround of financial

performance, improved customer delivery, as well as significant and

positive cultural change. John sits on the Leadership Team of Wesfarmers

Insurance, which is responsible for the strategic leadership of the WI group

across NZ, Australia and the UK.

John is a past President of the Insurance Council of New Zealand, a

position he held for a two year term during the catastrophic Canterbury

earthquakes. In November 2012 John was recognised and honoured as

the Insurance Leader of the Year at the NZ Insurance Industry Awards.

Rob Merkin

Rob is Lloyd’s Professor at the University of Exeter, Honorary Professor at

the University of Auckland and consultant to international law firm Norton

Rose Fulbright. Rob is immediate past-president of the British Insurance

Law Association and vice-president of the International Association of

Insurance Law (AIDA). Rob has written a number of works on insurance

and arbitration, and is currently working on a New Zealand edition of

Colinvaux’s Law of Insurance.

Carl O’Shea

Carl is an insurance industry leader. In 1987 he opened the Wellington

office of Crombie Lockwood which grew to be the company’s largest within

just a few years. When the company’s founder Colin Crombie stepped

back from the business Carl became a major shareholder.

Carl was instrumental in identifying, negotiating and concluding many of

the high profile acquisitions made over the company’s history. In every

case those acquisitions significantly enhanced the company’s individual

branch situations or its national capabilities and collectively contributed to

Crombie Lockwood becoming the country’s largest independently owned

broking business.

Corporately, Carl helped develop a common infrastructure and improved

governance structure for the company until agreement was reached in

2006 to sell to Wesfarmers.

Having guided the company through the completion stage of its acquisition

Carl, already a long-standing director took up the role of CEO in Crombie

Lockwood and was appointed to the board of OAMPS Australia in early

2010.

Chris Rodd

Chris, a lawyer, is a past president of AILA, having been national president

2008 and 2009. Chris is employed by CGU Insurance as a Technical

Counsel and heads up the companies Internal Dispute Resolution

Department. Prior to joining what was then CU Insurance in 1989 he was in

private practice for 10 years with a large insurance law firm in Melbourne,

primarily involved in insurance litigation.

Since joining CGU, he has had a number of different roles within the

organisation and has participated in numerous industry working parties

and committees both with the ICA and FOS during his 23 years with

the company. Actively involved in AIDA, (the international arm of AILA),

Chris is a member of international working parties on “Climate Change

and Insurance” and “Consumer Protection legislation” and has recently

presented papers at international insurance law meetings in Paris (2010)

and Amsterdam (2011), Istanbul in (2012) and London (2012) on these

issues. A member of the US based organisation FDCC ( Federation of

Defence and Corporate Counsel), he is also a part time lecturer in

insurance law at Monash University, Melbourne and a Senior Fellow in the

Law Faculty at Monash .

Mark Sedon

Mark has been a full time internationally qualified (IFMGA) climbing and

ski guide for 12 years. He has guided over a dozen Himalayan expeditions

including summiting Mt Everest. Mark has also guided six expeditions to

Antarctica including two ski expeditions. He’s guided in Europe, Alaska,

South America, Indonesia and extensively in New Zealand.

Mark is a respected avalanche forecaster and teaches courses to students

varying in experience from beginner to experienced guides. He is an

approachable, enthusiastic guide who is driven to deliver great quality,

enjoyable skiing, safely!

Mark wrote and supplied photos for his book on Classic Rock Climbing in

New Zealand and co-wrote Adventure Consultant’s Climbers Guide. He

works for Adventure Consultants Ltd all over the world, Harris Mountains

Heli Ski in Wanaka, and Kashmir Heli Ski in Gulmarg, India.

Stephen Todd

Stephen is a Professor of Law at the University of Canterbury and a

Professor of Common Law at the University of Nottingham in England. He

specialises in the law of torts, and is general editor and principal author

of The Law of Torts in New Zealand, published in its 6th edition in 2013.

His other main research interest is in the field of contract, and he is a joint

author of The Law of Contract in New Zealand (4th edition, 2012). He also

is a contributor to the 12th edition of Charlesworth on Negligence (2010)

and the 3rd edition of Principles of Medical Law (2010), is a member of

the Editorial Advisory Board of the Tort Law Review and the Journal of

Professional Negligence, and is a contributing editor to the New Zealand

Law Review. In 2006 he became the fourth recipient of the John Fleming

Memorial Prize for Torts Scholarship. This international prize is awarded

every two years on the recommendation of a committee whose members

are drawn from academics and judges around the world.

Emily Walton

Emily is a partner of Wynn Williams’ specialist Insurance Team.

A South Island girl, Emily credits growing up in Timaru for her ability to

get on with and understand people from all walks of life. In fact, being a

collaborative part of a client’s team of advisors is the part of law Emily most

enjoys. Emily has over a decade’s experience in insurance law acting for

both insurers and policyholders here in New Zealand and overseas. Most

recently that focus has been earthquake claims both material damage and

business interruption.
