โครงการนำาเสนอรายงานคขนานตอคณะกรรมการกตการะหวางประเทศวาดวยสทธทางเศรษฐกจ สงคมและวฒนธรรม ประจำาองคการ

สหประชาชาตวนท 29 พฤษภาคม 2559 เวลา 9.30-12.00 น.

หลกการและเหตผล1.ประเทศไทยเขาเปนภาคกตการะหวางประเทศวาดวยสทธทางเศรษฐกจ

สงคม และวฒนธรรมโดยการภาคยานวตเมอวนท 5 กนยายน 2542 และมผลบงคบใชเมอวนท 5 กนยายน 2542 รฐภาคจะตองเสนอรายงานภายในปแรก นบจากวนทกตกามผลใชบงคบ และทกๆ 5 ป หลงการสงรายงานฉบบแรก หรอเมอไดรบการรองขอจากคณะกรรมการสทธทางเศรษฐกจ สงคมและวฒนธรรม โดยรฐบาลไทยไดจดสงรายงานฉบบแรกหลงการใหสตยาบนไปแลวเปนเวลา 16 ป และเมอวนท 1 ตลาคม 2557 ทางคณะกรรมการไดจดสงหวขอททางภาคประชาสงคมจะนำาเสนอตอกระบวนการ Pre -session ทไดจดมขนไปแลวเมอวนท 1-5 เดอนธนวาคม 2557 พรอมกนนนไดกำาหนดวาจะมการทบทวนรายงานและการพจารณารายงานคขนาน ณ นครเจนวา ประเทศสวสเซอรแลนด ในวนท 4-5 เดอนมถนายน ป 2558 การเขยนรายงานของภาครฐนน จะตองครอบคลมผลการดำาเนนงานเพอใหเปนตามพนธกรณของไทยวาดวยการสงเสรมคมครองและปกปองสทธทางเศรษฐกจ สงคม และวฒนธรรม โดยเฉพาะอยางยงเพอไมใหมการละเมดสทธของกลมชนทเสยเปรยบและอยชายขอบมากทสดของประเทศไทย

องคกรภาคประชาชนสงคมทงไทยและตางประเทศหลายองคกรไดจดทำารายงานคขนาน (shadow report) การจดทำารายงานคขนาน(shadow report)นนเปนการสงเสรมการมสวนรวมขององคกรประชาสงคมทกภาคสวนทมสวนเกยวของทงโดยทางตรงและทางออมมความจำาเปน เพราะจะชวยใหการจดทำารายงานมความสมบรณครอบคลมทงเนอหาทเปนสถานการณปญหา การเรยนรรวมกนผานกระบวนการจดทำารายงาน และการไดขอเสนอทตรงประเดน

บางองคกรไดการจดทำารายงานคขนาน (shadow report) ทเนนเฉพาะในประเดนทเปนสถานการณปญหาเรงดวน เชน นโยบายและแผนแมบทแกไขปญหาการทำาลายทรพยากรปาไม การบกรกทดนของรฐ และการบรหารจดการทรพยากรธรรมชาต การแกปญหาแรงงานขามชาต สขภาพของบคคล เร องสทธเดกอนเกยวเนองกบสทธการศกษา ฯลฯ

องคกรสทธมนษยชนทมสวนรวมในการจดสงรายงานคขนานจะจดใหมการเผยแพรรายงาน รบฟงความเหนจากทงหนวยงานราชการและเอกชน รวมทงเพอใหสอมวลชนไดเผยแพรรายงานและความรความเขาใจเรองกลไกคมครองสทธมนษยชนทงทเกยวของกบประเทศไทยโดยตรงและเกยวกบบทบาทขององคการสหประชาชาต โดยจะจดใหม โครงการนำาเสนอรายงานคขนานตอคณะกรรมการกตการะหวางประเทศ วาดวยสทธทางเศรษฐกจ สงคมและวฒนธรรม ประจำาองคการสหประชาชาตใน วนท 29 พฤษภาคม 2559 ทส ำานกงานนกเรยนครสเตยน เวลา 9.30-12.00 น.

วตถประสงค1.เพอเผยแพรและสรางความเขาใจเกยวกบกตการะหวางประเทศ วาดวย

สทธทางเศรษฐกจ สงคมและวฒนธรรม และกลไกการรายงานสถานการณทเกยวของ

2.เพอเผยแพรรายงานความกาวหนาของรฐบาลและรายงานคขนานขององคการพฒนาเอกชนในประเดนเรองกา

3.แลกเปลยนำาเสนอขอเสนอในการแกไขปญหาระดบพนทและเชงนโยบาย กอนการทบทวนรายงานรวมกบคณะกรรมการกตการะหวางประเทศ วาดวยสทธทางเศรษฐกจ สงคมและวฒนธรรม ณ กรงเจนวา ประเทศสวสเซอรแลนด วนท 4-5 มถนายน 2558

4.การรณรงคและผลกดนขอเสนอเชงนโยบายจากทงจากพนท จากรฐบาล และจากหนวยงานอนๆ สามารถปกปองคมครองสทธมนษยชนในเร องสทธเศรษฐกจสงคมและวฒนธรรมเปนรปธรรมและตอบสนองตอสถานการณปจจบน

Public Presentation of Shadow Report to the UN Committee on Economic, Social and Cultural Rights

Rationale

Thailand ratified the International Covenant on Economic, Social and Cultural Rights (ICESCR) on September 5, 1999, and it became effective immediately. As a member country, Thailand was required to submit an initial report within the first year the Covenant became effective, and every five years after the submission of this initial report, or upon request by the Committee on Economic, Social and Cultural Rights. After sixteen years of membership, Thailand submitted one report in 2014. On October 1, 2014, the Committee informed Thailand’s civil society of the topics to be presented during the Pre-session, which took place December 1-5, 2014. In addition, the review of a Country Report and Shadow Report shall take place in Geneva, Switzerland, from June 4-5, 2015. The Country Report by the state is required to cover the results of the implementation of the Covenant and Thailand’s obligations regarding the promotion and protection of ESC rights. In particular, the focus will be on the efforts that have been made to prevent the violation of the most marginalized and vulnerable populations in Thailand.

A group of Thai and international civil society organizations have collaborated to produce a Shadow Report. The process was aimed at enhancing the collaboration and engagement of

civil society in all sectors, directly and indirectly, in order to ensure that the report features content most comprehensive and reflective of the current situation. It was also a chance to learn collaboratively in producing the report, and to come to terms with common proposals.

Some organizations have produced their shadow reports with an emphasis on contingent issues, such as the policy to suppress deforestation and encroachment on public land and the management of natural resources, solutions to migrant labour, personal health, and the right of a child to education.

All human rights organizations that have played a role in producing shadow reports plan to launch the reports publicly and receive input from both governmental and private agencies. In addition, they wish to have the content disseminated by media to raise public awareness about human rights protection mechanisms that concern Thailand, as well as the role of the United Nations. Thus, the presentation of the Shadow Report to the UN Committee on Economic, Social and Cultural Rights is proposed to take place on May 29, 2015 from 9.30-12.00 at the Student Christian Center (TBC).

Objectives 1. To disseminate information and raise public awareness about the International

Covenant on Economic, Social and Cultural Rights (ICESCR) and its concerned reporting mechanisms.

2. To publicize the government’s Country Report and the shadow reports of non-governmental organizations.

3. To exchange proposed solutions to problems at the local and policy levels prior to the review of the reports by the Committee on Economic, Social and Cultural Rights in Geneva, Switzerland, from June 4-5, 2015.

4. To advocate for the most concrete and up-to-date policy proposals from local communities, government and other agencies regarding the promotion and protection of ESC rights and human rights.
