    I am contacting you as the Sheriff of Waukesha County Wisconsin. I am sure you canappreciate concern that all law enforcement agencies with the presence ofillegal alienslimmigrants who are not only in this country illegally, but have alsocommitted serious against the law abiding citizens of Waukesha County.We attempt to assist other law enforcement in fulfilling their responsibilitiesunder local, state or federal law. One of the areas that is increasingly becoming morefrustrating is the illegal immigrants who have committed serious violations of law butdue to the limited resources available to Immigration and Customs EnforcementAgency (ICE) are not being detained and/or deported. This is the reason I amcontacting you.Recently, we were made aware that there is a provision in the United Code thatwould allow local law enforcement agencies to the immigration officer in relationto the investigation, apprehension or detention of aliens in the United States. I amspecifically referring to 8, Section 1357 (g). Pursuant to this provision, the AttorneyGeneral may enter into a written agreement with a state or political sub-division of thepursuant to which an officer or employee of that political sub-division (whodetermined by the Attorney General to be qualified to perform a function of animmigration officer) may carry out such function at the expense of the state or politicalsub-division to the extent consistent with state and local law, I am aware that severalstates have already advantage of this "287 (9) provision."

    I am therefore that 287 (g) Delegation of Authority for training, afforded tothe Waukesha County Sheriffs Department. I understand that the Memo ofUnderstanding will specify necessary training and what exactly the localenforcement officers can cannot do pursuant to that authority.Your consideration in this matter is appreciated.

Immigration and CustomsEnforcement (ICE) received your request for 287(g) Delegation of Authority training forthe Waukesha County Sheriff's Department.On June 2007, the Program Manager for 287(g) Authority at ICEHeadquarters forwarded your request for participation the 287(g) to the SpecialAgent in (SAC), Field Operations Director (FOD) for the SACFOD Chicago areas of responsibility (AOR). The SAC and FOD, along with ayour staffwill need to conduct a feasibility assessment study.
