Affidavits are usually drafted by nonlawyers in the midst of a criminal investigation; many warrants are (properly) issued on the basis of common sense judgment of laymen applying a standard less demanding than those used in more formal legal proceedings. 

Gates, 462 U.S. at 235‐36.

The Fourth Amendment has a strong preference for searches conducted pursuant to warrants, therefore reviewing courts should not invalidate warrants by interpreting affidavits in a hypertechnical manner.

Probable cause is a “practical, nontechnical, conception” that deals with “ ‘the factual and practical considerations of everyday life on which reasonable men, not legal technicians, act.’ ”

Finely tuned standards such as proof beyond a reasonable doubt or by a preponderance of evidence, has no place in the decision as to whether there is probable cause.

Nexus Btwn PC of Guilt and PC to Search Home

The affidavit must set forth a sufficient nexus between the suspected illegal activity and the placeThe affidavit must set forth a sufficient nexus between the suspected illegal activity and the place to be searched. 

The magistrate must make a common‐sense decision whether, given all the circumstances set forth in the affidavit, there is a fair probability that contraband or evidence of a crime will be found in a particular place.

Mere fact that a person is suspected of a crime does not justify the conclusion that fruits of that crime will be found at his residence.

Crimes relating to the possession and transportation of child pornography is much more tied to a place of privacy, seclusion, and Internet connectivity (such as a home or an office) than the crime of possession of narcotics; drugs can be stored “in a car, in a ditch, in a hole in the ground, etc.”

While there may be other possibilities, I.e. a hacker could be using defendants account and screen name, but probable cause does not require “near certainty,” only a “fair probability.”screen name, but probable cause does not require  near certainty,  only a  fair probability.

Reviewing court found that district court did not err in finding that as a matter of common sense, if a pornographic image originated or emanated from an individual’s email account, , p g p g g ,it is logical to believe the image will likely be found on that person’s computer or storage media associated with the computer.

“#w0nderland” was an Internet chat channel devoted to distribution of cp. Membership required (1) possession of 10,000 images of pre‐teen children engaging in explicit sexual 

( )conduct, and (2) images must be stored on a server that enabled other members to have access via “FTP” (File Transfer Protocol.)

Investigation into “#w0nderland,”, revealed screen names of 197 users in 18 countries, including “sassybabe.” 

Information identifying account associated with “sassybabe” screen name revealed theInformation identifying account associated with  sassybabe  screen name revealed the user connected to Internet via the ISP IBM Global Network Services. IBM records showed that “sassybabe” screen name was registered to Grant.

Affidavit in support of search warrant need not prove it was defendant, not an imposter, who was using his IBM account to traffic in child pornography. While possible that one other than the account’s registrant might access the account illicitly, there was a fair g g y, fprobability that Grant was the user and evidence of child pornography would be found in his home.

Affidavit established that defendant paid $94.95 “for the privilege of downloading child pornography, and having paid that fee it is fairly probably that he availed himself of the pornography, and having paid that fee it is fairly probably that he availed himself of thedownload opportunity.” No images were actually intercepted.

Finding of probable cause to search defendant’s home affirmed. Defendant purchased subscription giving him access to child pornography website, although the credit card used gave the address of defendant’s office, not home.g ,

Evidence that an individual subscribed to child pornography websites supports the conclusion that he has likely downloaded, kept, and otherwise possessed the material.

Agent’s affidavit detailing defendant’s membership in an Internet group whose goal was to collect and distribute child pornography supported a finding of probable cause for issuance of search warrant for defendant’s homeof search warrant for defendant s home.

Purpose of Egroup as stated on its website: “This group is for people who love kids. You can post any type of messages you like too [sic] or any types of pics and vids you like too [sic]. P.S. IF WE ALL WORK TOGETHER WE WILL HAVE THE BEST GROUP ON THE NET.

Affidavit in support of warrant to search home and computer of a subscriber of two e‐groups principally devoted to sharing child pornography was sufficient to supply probable cause:cause:

Defendant used screen name “LittleLolita Love.”

As a member of e‐groups, D. had access to downloadable images of cp for over a month until Yahoo shut down the groups.

While investigating Lolitagurls.com website, FBI received subscriber records indicating defendant Gourde was a member. Information contained his home address, email address, DOB and duration of membership (two months until site was shut down by FBI )DOB, and duration of membership (two months until site was shut down by FBI.) 

As a member, defendant had unlimited access to website and was allowed to download images directly from website.

Site contained adult and child pornography. 

First page of site contained images of nude and partially nude girls, some prepubescent p g g p y g , p pgirls and the text:

Lolitagurls.com offers hard to find pics! With weekly updates and high quality pix inside, you can’t go wrong if you like young girls!

Second page contained testimonials from members, i.e. “I’ve never seen in my life the pics of so cute pre‐teen girls,” “this lolita site has everything with young girls.” Also contained images of nude girls (some prepubescent) with the caption, “Lolitas age 12‐17” and the following text:following text:

Welcome to Lolitagurls. Over one thousand pictures of girls age 12‐17.

• Issuing Judge must be supplied with sufficient information to support independent judgment that probable cause exists.

• ISPs assign a IP address to every computer each time it accesses the Internet. An ISP  will have a block of addresses which it can assign –will have a block of addresses which it can assign

• Fixed IP addresses are assigned to only one computer;

• Static IP addresses – your home computer may be assigned a different IP   address if it access the Internet several times during the day.

• It might be possible to show that an IP address assigned to a defendant was used to purchase a subscription to a CP website, or that images of cp were located on a computer with a specific IP address and that these images were made availablecomputer with a specific IP address, and that these images were made available through a P2P program. 

• While IP such information can contribute to the totality of the probable cause determination, it is not an indispensable prerequisite for obtaining a search warrant.

Every digital image or file has a hash value – a unique set of 32 numbers and letters calculated using a mathematical algorithm. It is, in effect, the unique “fingerprint” of the digital image or file.

P2P networks facilitate the sharing of information among computers. Once a computer user downloads readily available (and often free) software, he can share and obtain any type of file from any other computer that is part of the P2P network.

The hash values of all known images of cp are logged by law enforcement.

During investigation of P2P network, agents can track which IP addresses download digital i k b hild h b d h i h h l Th h b blimages known to be child pornography based on their hash values. The agent may then be able to link the IP address to a particular user.

Because crimes involving CP are generally carried out in the secrecy of the home and over a long period, the same time limitations applied to more fleeting crimes do not control the staleness inquiry for child pornography.

“The observation that images of child pornography are likely to be hoarded by persons interested in those materials in the privacy of their homes is supported by common sense and the cases. Since the materials are illegal to distribute and possess, initial collection is difficult. Having succeeded in obtaining images, collectors are unlikely to destroy them.  Because of their illegality and the imprimature of severe social stigma such images carry, collectors will want to secret  them 

in secure places, like a private residence. This proposition is not novel in  either state or federal court: pedophiles, preferential child molesters, and child  pornography collectors maintain their materials for significant periods of time.”
