&ection 6. A--ro2a+, +icensin/ and re/istration of factories.*

&'( The State 9overnment may ma#e r!les-

&a( re6!iring for the p!rposes of this Act+ the s!)mission of plans of any

class or escription of factories to the Chief Inspector or the State9overnment 4

&aa( re6!iring the previo!s permission in $riting of the State

9overnment or the Chief Inspector to )e o)taine for the site on$hich the factory is to )e sit!ate an for the constr!ction ore0tension of any factory or class or escription of factories4

&)( re6!iring for the p!rpose of consiering applications for s!ch

permission the s!)mission of plans an specificatio6ns4

&c( prescri)ing the nat!re of s!ch plans an specifications an )y

$hom they shall )e certifie4

&( re6!iring the registration an licensing offactories+ or any class

or escription of factories+ an prescri)ing the fees paya)le for s!chregistration an licensing an for the rene$al of licences4

&e( re6!iring that no licence shall )e grante or rene$e !nless the

notice specifie in section @ has )een given.

&/( If on an application for permission referre to in cla!se &aa( of s!)-section &'( accompanie )y the plans an specifications re6!ire )y ther!les mae !ner cla!se &)( of that s!)-section+ sent to the State9overnment or Chief Inspector )y registere post+ no orer iscomm!nicate to the applicant $ithin three months from the ate on$hich it is so sent+ the permission applie for in the sai application shall)e eeme to have )een grante.

&1( "here a State 9overnment or a Chief Inspector ref!ses to grant

permission to the site+ constr!ction or e0tension of a factory or to theregistration an licensing of a factory+ the applicant may $ithin thirty aysfrom the ate of s!ch ref!sal+ appeal to the Central 9overnment if theecision appeale for $as of the State 9overnment+ an to the State9overnment in any other case.

E0planation. - A factory shall not )e eeme to )e e0tene $ithin themeaning of this section )y reason only of the replacement of any plant ormachinery+ or $ithin s!ch limils as may )e prescri)e+ of the aition ofany plant or machinery. If s!ch replacement or aition oes not re!cethe minim!m clear space re6!ire for safe $or#ing aro!n the plant ormachinery or aversely affect the environment conitions from the

evol!tion or emission of steam+ heat or !st or I!mes $hich are in2!rio!sto health.

&ection . Notice by occ-ier.*

&'( The occ!pier shall+ at least fifteen ays )efore he )egins to occ!py or+!se any premises as a factory+ sen to the Chief Inspector a $ritten noticecontaining-

&a( the name an sit!ation of the factory4

&)( the name an aress of the occ!pier4

&))( thc name an aress of the o$ner of the premises or )!iling

&incl!ing the precincts thereof ( referre to in section ,14

&c( the aress io $hich comm!nication relating to the factory may

)e sent4

&( the nat!re of the man!fact!ring process-

o &i( carrie on in the factory !ring the last t$elve months in

the case offactories in e0istence on the ate of thecommencement of this Act+ an

o &ii( to )e carrie on in the factory !ring the ne0t t$elvemonths in the case of all factories4

&e( the total rate horse po$er installe or to )e installe in the

factory+ $hich shall not incl!e the rate horsc po$er of anyseparate stan)y plant4

&f( the name of the rnanager of the factory for the p!rposes of this

Act4

&g( the n!m)er of $or#ers li#ely to )e employe in the factory8

&h( the average n!m)er of $or#ers per ay employe !ring the

last t$elve months in the case of a factory in e0istence on the ateof the commencement of this Act4

&i( s!ch other partic!lars as may )e prescri)e.

&/( In respect of all esta)lishments+ $hich come $ithin the scope of theAct for the first time the occ!pier shall sen a $ritten notice to the Chief

Inspector containing the partic!lars specifie in s!)-section &'( $ithinthirty ays from the ate of the commencement of this Act.

&1( efore a factory engage in a man!fact!ring process $hich isorinarily carrie o!t for less than one h!nre an eighty $or#ing aysin the year+ res!mes $or#ing+ thc occ!pier shall sen a $ritten notice tothe Chief Inspector containing the partic!lars specifie in s!)-section &'(that least thirty ays )efore the ate of the commencement of $or#.

&( "henever a ne$ manager is appointe+ the ccc!pies shall sen to theInspector a $ritten notice an to the Chief Inspector a copy thereof $ithinseven ays from the ate on $hich s!ch person ta#es over charge.

&=( >!ring a perio for $hich no person has )een esignate as managerof a factory or !ring $hich the person esignate oes not manage thefactory+ any person fo!n acting as manager+ or if no s!ch person isfo!n+ the occ!pier himself+ shall )e eeme to )e the manager of thefactory for the p!rposes of this Act.

&ection A. enera+ dties of the occ-ier.*

&'( Every occ!pier shall ens!re+ so far as is reasona)ly practica)le+ thehealth+ safety an $+elfare of all $or#ers $hile they are at $or# in thefactory.

&/( "itho!t pre2!ice to the generality of the provisions of s!)-section&'(+ the matters to $hich s!ch !ty e0tens+ shall incl!e-

&a( the provision an maintenance of plant an systems of $or# in

the factory that are safe an $itho!t ris#s to health4

&)( the arrangement in the factory for ens!ring safety an a)sence

of ris#s to health in connection $ith the !se+ hanling+ storage antransport of articles an s!)stances4

&c( the provision of s!ch information+ instr!ction+ training an

s!pervisions as are necessary to ens!re the health an safety of all$or#ers at $or#4

&( the maintenance of all places of $or# in the factory in a

conition that is safe an $itho!t ris#s to health an the provisionan maintenance of s!ch means of access to+ an egress from+ s!chplace as are safe an $itho!t s!ch ris#s4

&e( the provision+ maintenance or monitoring of s!ch $or#ing

environment in the factory for the $or#ers that is safe+ $itho!t ris#s

&'( Every person $ho esigns+ man!fact!res+ imports or s!pplies any

article for !se in any factory shall-

&a( ens!re+ so far as is reasona)ly practica)le+ that the article is so

esigne an constr!cte as to )e safe an $ithovt ris#s to thehealth of the $or#ers $hen properly !se4

&)( carry o!t or arrange for tlle carrying o!t of s!ch tests an

e0amination as may )e consiere necessary for the effectiveimplementation of the provisions of cla!se &a(4

&c( ta#e s!ch steps as may )e necessary to ens!re that ae6!ateinformation $ill )e availa)le-

o &i( in connection $ith the !se of the article in any factory4

o &ii( a)o!t the !se for $hich it is esigne an teste4 an

o &iii( a)o!t any conitions necessary to ens!re that the article+

$hen p!t to s!ch !se+ $ill )e safe+ an $itho!t ris#s to thehealth of the $or#ers8

&1( othing containe in s!)-sections &'( an &/( shall )e constr!e tore6!ire a person to repeat the testing e0amination or research $hich has)een carrie o!t other$ise than )y him or at his instance on so far as it isreasona)le for him to rely on the res!lts thereof for the p!rposes of thesai s!)-sections.

&( An !ty impose on any person )y s!)-sections &'( an &/( shalle0ten only to things one in the co!rse of )!siness carrie on )y him

&ection 8. Ins-ectors.*

&'( The State 9overnment may+ )y notification in the :fficial 9azette+appoint s!ch persons as possessing the prescri)e 6!alification to )eInspectors for the p!rposes of this Act an may assign to them s!ch locallimits as it may thin# fit.

&/( The State 9overnment may+ )y notification in the :fflcial 9azette+appoint any person to )e a Chief Inspector $ho shall+ in aition topo$ers conferre on Chief Inspector !ner this Act+ e0ercise the po$ersof an Inspector thro!gho!t the State.

&/A( The State 9overnment may+ )y notification in the :fficial 9azette+appoint as many Aitional Chief Inspectors+ 5oint Chief Inspectors an>ep!ty Chief Inspectors an as many other offlcers as it thin#s fit to

assist the Chief Inspector an to e0ercise s!ch of the po$ers of the ChiefInspector as may )e specifie in s!ch notification.

&ection 9. oers of Ins-ectors.*

S!)2ect to any r!les mae in this )ehalf+ an Inspector may+ $ithin thelocal limits for $hich he is appointe+-

&a( enter $ith s!ch assistants+ )eing persons in the service of the

9overnment+ or any local or other p!)lic a!thority or $ith ane0pert+ as he thin#s fit+ any place $hich is !se+ or $hich he hasreason to )elieve+ is !se as a factory4

&)( ma#e e0amination of the premises+ plant+ machinery+ article or

s!)stance4

&c( in6!ire into any accient or angero!s occ!rrence+ $hether

res!lting in )oily in2!ry+ isa)ility or not+ an ta#e on the spot orother$ise statements of any person $hich he may consiernecessary for s!ch in6!iry4

anything lying therein+ shall )e left !nist!r)e &$hether generallyor in parttic!lar respects( for so long as is necessary for the p!rposeof any e0amination !ner cla!se &)(4

&g( ta#e meas!rements an photographs an ma#e s!ch recorings

as he consiers necessary for the p!rpose of any e0amination !ner

cla!se &)(+ ta#ing $ith him any necessary instr!ment or e6!ipment4

&h( in case of any article of s!)stance fo!n in any premises+ )eing

an article or s!)stance $hich appears to him as having ca!se or isli#ely to ca!se anger to the health or safety of the $or#ers+ irectit to )e ismantle or s!)2ect it to any process or test &)!t not so asto amage or estroy it !nless the same is+ in the circ!mstancesnecessary+ for carrying o!t the p!rposes of this Act(+ an ta#epossession of any s!ch article or s!)stance or a part thereof+ anetain it for so long as is necessary for s!ch e0amination4

&/( The State 9overnment may ma#e r!les prescri)ing the type ann!m)ers of spittoons to )e provie an their location in any factory an

provie for s!ch f!rther matters relating to their maintenance in a cleanan hygienic conition.

&'( o yo!ng person shall )e re6!ire or allo$e to $or# at any machineto $hich this section applies+ !nless he has )een f!lly instr!cte as to theangers arising in connection $ith the machine an the preca!tions to )eo)serve+ an-

&'( The occ!pier shall+ in every factory $here a hazaro!s process ta#esplace+ or $here hazaro!s s!)stances are !se or hanle+ set !p aSafety Committee consisting of e6!al n!m)er of representatives of$or#ers an management to promote co-operation )et$een the $or#ersan the management in maintaining proper safety an health at $or# anto revie$ perioically the meas!res ta#en in that )ehalf.

&'( "here the $or#ers employe in any factory engage in a hazaro!sprocess have reasona)le apprehension that there is a li#elihoo ofimminent anger to their lives or health !e to any accient+ they may+)ring the same to the notice of the occ!pier+ agent+ manager or any otherperson $ho is in-charge of the factory or the process concerne irectly

or thro!gh their representatives in the Safety Committee ansim!ltaneo!sly )ring the same to the notice of the Inspector.

&/( Tt shall )e the !ty of s!ch occ!pier+ agent+ manager or the personin-charge of the factory or process to ta#e immeiate remeial action ifhe is satisfie a)o!t the e0istence of s!ch imminent anger an sen areport forth-$ith of the action ta#en to the nearest Inspector.

&1( If the occ!pier+ agent+ manager or the person in-charge referre to ins!)-section &/( is not satisfie a)o!t the e0istence of any imminent

anger as apprehene )y the $or#ers+ he shall+ nevertheless+ refer thematter forth-$ith to the nearest Inspector $hose ecision on the 6!estionof the e0istence of s!ch imminent anger shall )e final.

&/( If+ in the opinion of the Chief Inspector+ the $or#ers in any factoryengage in a partic!lar man!fact!ring process or $or#ing in a partic!larroom+ are a)le to o their $or# efficiently in a sitting position+ he may+ )yorer in $riting+ re6!ire the occ!pier of the factory to provie )efore aspecifie ate s!ch seating arrangements as may )e practica)le for all$or#ers so engage or $or#ing.
