Dear Voter and Friend of the Family,

FRC Action presents our Vote Scorecard for 2018, the Second Session of the 115th Congress. This scorecard contains a compilation of significant votes on federal legislation affecting the family that FRC Action either supported or op-posed. These recorded votes span votes in the 2018 calendar year. As Republicans enjoyed unified control of the federal government under President Donald Trump, 2018 presented enormous opportunities for the enactment of conservative, pro-life, and pro-family legislation and the confirmation of pro-life judges and cabinet secretaries.

In the U.S. Senate, FRC Action scored in favor of confirming Brett Kavanaugh to be an Associate Justice on the U.S. Supreme Court to fill the seat Justice Anthony Kennedy left vacant. FRC Action also scored in favor of confirming Mike Pompeo to be U.S. Secretary of State, Sam Brownback to be Ambassador-at-Large for International Religious Freedom, and Kyle Duncan to be U.S. Circuit Judge for the 5th Circuit. FRC Action also scored in favor of an amend-ment to defund Planned Parenthood and for a bill to restrict abortion at five months when science shows babies can experience severe pain.

In both chambers, FRC Action scored in favor of an amendment to eliminate the District of Columbia healthcare individual mandate, because that mandate effectively requires people to purchase plans with abortion coverage since all plans in the District cover elective abortion.

After Republicans spent much of the previous year trying to repeal the Obamacare mandate and they successfully passed the Tax Cuts and Jobs Act in 2017, the House voted on fewer values issues in the 2018 election year. FRC Ac-tion did score House votes on the Born Alive Survivors Protection Act to ensure born alive babies after failed abortions are not killed. Votes also included another tax bill that included a provision to expand 529 education savings accounts to “unborn children,” and another tax bill that contained provisions to gut the Johnson Amendment restriction on 501(c)(3) ability to speak on campaign matters and a provision repealing the Tax Cuts and Jobs Act tax on transportation deduction for employee benefits.

This vote scorecard contains five votes in the House and eight votes in the Senate for the Second Session of the 115th Congress. While Congress passed, and the president signed, key pieces of pro-life and pro-family legislation last year, much more needs to be done to rebuild a culture where all human life is valued, families flourish, and religious liberty thrives. 1. Rule to Allow a Vote on the Born Alive Abortion Survivors Protection Act

Sponsored by Rep. Liz Cheney (R-WY), this resolution (H.Res.694) was a procedural rule to allow for a vote on Rep. Marsha Blackburn’s (R-Tenn.) Born-Alive Abortion Survivors Protection Act (H.R. 4712). H.R. 4712 would require a health care practitioner to provide life-saving medical care to a baby born alive who survives an attempted abortion.

3. Amendment to Defund the D.C. Healthcare Individual Mandate

Sponsored by Rep. Gary Palmer (R-Ala.), this amendment (H.AMDT. 946) to the Interior, Environment, Financial Services, and General Government Appropriations Act, 2019 (H.R. 6147) would prevent funding for the District of Columbia (D.C.) law mandating residents purchase health insurance. In December 2017, Congress passed and the President signed the Tax Cuts and Jobs Act (H.R. 1), which repealed the individual mandate penalty contained in the Patient Protection and Affordable Care Act. However, D.C. passed the Health Insurance Requirement Amendment Act on June 26th of this year to re-impose an individual mandate on D.C. residents. Since all plans available through the D.C. health care exchange cover elective abortion, the mandate in effect requires the purchase of insurance plans that cover elective abortion.

4. Family Savings Act of 2018

Sponsored by Rep. Mike Kelly (R-Pa.), the Family Savings Act of 2018 (H.R. 6757) would expand 529 education savings plans to make “unborn children” eligible for benefits. The provision also would expand the use of such savings plans for homeschooling expenses. This vote was on passage of the bill.

5. Retirement, Savings, and Other Tax Relief Act of 2018

Sponsored by Rep. Kevin Brady (R-Texas) the Retirement, Savings, and Other Tax Relief Act of 2018 (H.R. 88) would include three important pro-faith and pro-life tax provisions. First, to expand 529 education savings plans to make “unborn chil-dren” eligible for benefits. Second, to remove a tax on non-profits and churches that offer parking and transit benefits to their employees. Third, to address the Johnson Amendment which forbids tax exempt organizations from engaging in any activity that may be interpreted as campaign related. This vote was on an amendment to the Conference Report.

6. Amendment to Defund the D.C. Healthcare Individual Mandate

Sponsored by Sen. Ted Cruz (R-TX), this amendment (S.AMDT. 3402) to the Interior, Environment, Financial Services, and General Government Appropriations Act, 2019 (H.R. 6147) would prevent funding for the District of Columbia (D.C.) law mandating residents purchase health insurance. In December 2017, Congress passed and the President signed the Tax Cuts and Jobs Act (H.R. 1) which repealed the individual mandate penalty contained in the Patient Protection and Affordable Care Act. However, D.C. passed the Health Insurance Requirement Amendment Act on June 26, 2018, to re-impose an individual mandate on D.C. residents. Since all plans available through the D.C. health care exchange cover elective abortion, the mandate in effect requires the purchase of insurance plans that cover elective abortion. The Cruz amendment was tabled on a procedural vote. A similar amendment passed in the House on July 18, 2018.
