The Director has been notified by the Minister of Finance that the following corporations are in default in complying with the Corporations Tax Act.

NOTICE IS HEREBY GIVEN under subsection 241(1) of the Business Corporations Act, that unless the corporations listed hereunder comply with the requirements of the Corporations Tax Act within 90 days of this notice, orders will be made dissolving the defaulting corporations. All enquiries concerning this notice are to be directed to Ministry of Finance, Corporations Tax, 33 King Street West, Oshawa, Ontario L1H 8H6.

ONTARIO ENERGY BOARDAmendment to the Distribution System Code

The following amendments to the Ontario Energy Board’s Distribution System Code came into force on February 12, 2009 to facilitate the connection of smaller size Embedded Generation Facilities

Note: The text of the proposed amendments is set out in italics below, for ease of identification only.

1. Section 1.2 of the Distribution System Code is amended by adding the following immediately after the definition of ”point of supply”:

“queue exempt small embedded generation facility” means an embedded generation facility which is not a micro-embedded generation facility and which has a name-plate rated capacity of 250 kW or less in the case of a facility connected to a less than 15 kV line and 500 kW or less in the case of a facility connected to a 15 kV or greater line;

2. Section 6.2.4.2 of the Distribution System Code is amended by adding the following to the end of the first sentence:

or a queue exempt small embedded generation facility;

3. Section 6.2.4 of the Distribution System Code is amended by adding the following immediately after section 6.2.4.2:

6.2.4.3 Any application to connect a queue exempt small embedded generation facility that was received by a distributor prior to the date of coming into force of this section shall be processed by the distributor in accordance with the provisions of this Code applicable to such generation facilities as though the application to connect had been received by the distributor on the date of coming into force of this section.

4. Section 6.2.6 of the Distribution System Code is amended as follows:

i. by adding the following immediately after the first sentence:

Where the proposed micro-embedded generation facility will be located other than at an existing customer connection, the distributor shall, within 60 days of receiving the application, make an offer to connect or provide reasons for refusing to connect the proposed generation facility.

ii. by deleting the word “The” at the beginning of the sentence that starts “The distributor shall give…” and replacing it with the following:

i. by deleting the phrase “make any necessary metering changes and”; and

ii. by deleting the phrase “for the costs of any necessary metering changes“ and replacing it with the following:

for the connection costs, including costs for any necessary new or modified metering.

6. Section 6.2 of the Distribution System Code is amended by adding the following immediately after section 6.2.8:

6.2.8A Notwithstanding any other provision of this Code, a distributor shall, for the purposes of determining the connection feasibility of a queue exempt small embedded generation facility and of determining the impact of such facility on the distributor’s distribution system and on any customers of the distributor, treat any capacity associated with a generation facility that is in a queue referred to in section 6.2.4.1 as available capacity.

6.2.8B Where a distributor believes that, by virtue of the operation of section 6.2.8A, the connection of a queue exempt small embedded generation facility cannot reasonably be managed by the distributor without adversely affecting the queue position of a generation facility, the distributor shall promptly so notify the Board in writing. In such a case, and notwithstanding any other provision of this Code, the distributor shall not take any further steps to connect the queue exempt small embedded generation facility without further direction from the Board.

7. Section 6.2.12 of the Distribution System Code is amended by adding the following immediately after paragraph b:

An offer to connect made to an applicant proposing to connect a queue exempt small embedded generation facility may be revoked by the distributor if not accepted by the applicant within 60 days.

1. Section 2 of Ontario Regulation 420/97 is amended by adding the following subsections: (3.1) Despite subsection (3), the determination of the number of households in the Township of Pickle Lake and in the Municipality of Sioux Lookout shall be based on the data available from the Municipal Property Assessment Corporation for 2007 or the most recent data available from the Municipal Property Assessment Corporation, whichever results in a lower determination. (3.2) The determination of the number of OPP police officers providing police services in the Township of Pickle Lake and in the Municipality of Sioux Lookout shall be based on the data used by the OPP for 2007 or the most recent data used by the OPP, whichever results in a higher determination. 2. Subsections 2 (3.1) and (3.2) of the Regulation, as made by section 1 of this Regulation, are revoked on the third anniversary of the day this Regulation is filed. 3. This Regulation comes into force on the day it is filed.

CONSTRUCTION SECTOR — EXEMPTIONS (PARTNERS AND EXECUTIVE OFFICERS)

Exemption, conditions

1. (1) One partner in a partnership carrying on business in construction or one executive officer of a corporation carrying on business in construction is exempt from the application of subsections 12.2 (1) to (4) of the Act if the following conditions are met: 1. The partner or executive officer does not perform any construction work. 2. A declaration is filed with the Board in accordance with section 2. (2) For the purposes of paragraph 1 of subsection (1), the exemption applies even if the partner or executive officer attends at a construction site, so long as he or she does not perform construction work there. (3) The exemption is effective on the day the Board receives the declaration. Declaration

2. (1) The declaration shall be made, in a form approved by the Board, by a person authorized to represent the partnership or corporation, and shall be filed with the Board. (2) The declaration shall, (a) identify the partner or executive officer by providing his or her full name and any other information that the Board

requires; (b) certify that the partner or executive officer meets the conditions set out in paragraphs 1 and 2 of subsection 1 (1); and (c) contain the partner’s or executive officer’s signed acknowledgment that he or she, (i) understands that he or she is not eligible for benefits under the Act in the case of an injury arising out of and in

the course of employment, and (ii) is aware of any other information that the Board includes in the declaration. Material change in circumstances

3. A partnership or corporation on behalf of which a declaration has been filed with the Board shall notify the Board of any material change in circumstances in connection with the exemption, within 10 days after the material change occurs.

1. (1) Un seul associé d’une société de personnes qui exerce des activités dans la construction ou un seul dirigeant d’une personne morale qui exerce des activités dans la construction est dispensé de l’application des paragraphes 12.2 (1) à (4) de la Loi si les conditions suivantes sont réunies : 1. L’associé ou le dirigeant n’effectue pas de travaux de construction. 2. Une déclaration est déposée auprès de la Commission conformément à l’article 2. (2) Pour l’application de la disposition 1 du paragraphe (1), la dispense s’applique même si l’associé ou le dirigeant est présent sur un chantier de construction, pourvu qu’il n’y effectue pas de travaux de construction. (3) La dispense prend effet le jour où la Commission reçoit la déclaration. Déclaration

2. (1) La déclaration est faite, selon la formule approuvée par la Commission, par une personne autorisée à représenter la société de personnes ou la personne morale et est déposée auprès de la Commission. (2) La déclaration satisfait aux exigences suivantes : a) elle identifie l’associé ou le dirigeant en indiquant ses nom et prénoms de même que tout autre renseignement exigé

par la Commission; b) elle certifie que l’associé ou le dirigeant satisfait aux conditions énoncées aux dispositions 1 et 2 du paragraphe 1 (1); c) elle contient une attestation signée de l’associé ou du dirigeant confirmant ce qui suit : (i) il comprend qu’il n’est pas admissible à des prestations sous le régime de la Loi dans le cas d’une lésion

survenant du fait et au cours de l’emploi, (ii) il a connaissance de tout autre renseignement que la Commission inclut dans la déclaration. Changement important

3. La société de personnes ou la personne morale au nom de laquelle a été déposée une déclaration auprès de la Commission avise cette dernière dans les 10 jours de tout changement important dans les circonstances en ce qui concerne la dispense. Absence de dispense

4. Si la Commission apprend que l’associé ou le dirigeant nommé dans une déclaration déposée auprès d’elle ne fait pas l’objet d’une dispense prévue par le présent règlement, elle en avise promptement par écrit la société de personnes ou la personne morale et donne une copie de l’avis à l’associé ou au dirigeant.

program of study at a post-secondary institution or earned or paid in the 16 weeks preceding attendance if, i. the member of the benefit unit is enrolled in at least 60 per cent of a full-time course load or 40 per cent of a full-

time course load if the person is in receipt of income support pursuant to subsection 3 (1) of the Act, ii. the member of the benefit unit, A. is enrolled in a program of study approved under section 7 of Ontario Regulation 268/01 (Ontario Student

Loans Made After July 31, 2001) made under the Ministry of Training, Colleges and Universities Act, or B. is enrolled in a program of study at an institution approved under section 8 of Ontario Regulation 268/01,

that prepares the member of the benefit unit for application for registration by a regulated profession named in Schedule 1 to the Fair Access to Regulated Professions Act, 2006 or for application for registration by a health profession named in Schedule 1 to the Regulated Health Professions Act, 1991,

iii. the earnings or the amount paid are used for a program of study referenced in subparagraph ii, and iv. the earnings are earned or the amount is paid while the person is a member of a benefit unit that is in receipt of

income support under the Act or income assistance under the Ontario Works Act, 1997. 2. Section 38 of the Regulation is amended by adding the following paragraph: 7. The earnings of, or an amount paid under a training program to, any member of a benefit unit in attendance in a

program of study at a post-secondary institution or earned or paid in the 16 weeks preceding attendance shall not be included in income if,

i. the member of the benefit unit is enrolled in at least 60 per cent of a full-time course load or 40 per cent of a full-time course load if the person is in receipt of income support pursuant to subsection 3 (1) of the Act, and

ii. the member of the benefit unit, A. is enrolled in a program of study approved under section 7 of Ontario Regulation 268/01 (Ontario Student

(2) Paragraph 6.2 of subsection 44 (1) of the Regulation is amended by striking out the portion before subparagraph i and substituting the following: 6.2 A monthly amount of $100 for work-related expenses for a recipient or a spouse included in the benefit unit who is not

in attendance at a post-secondary institution in at least 60 per cent of a full-time course load or 40 per cent of a full-time course load if the person is in receipt of income support pursuant to subsection 3 (1) of the Act or for a dependent adult who is not in attendance at secondary school full time or at a post secondary institution in at least 60 per cent of a full-time course load if,

. . . . . (3) Paragraph 7 of subsection 44 (1) of the Regulation is revoked and the following substituted:

UP FRONT CHILD CARE 7. An amount determined by the Director, up to a maximum in any 12-month period of the amount that the person would

be entitled to as a deduction for child care under section 38 if, i. a recipient, a spouse included in the benefit unit, a dependent adult or a dependent child, A. begins, changes or maintains employment, B. begins, changes or maintains an employment assistance activity under the Ontario Works Act, 1997, or C. begins, changes or maintains any other activity intended to assist the person to become and stay employed

that is approved by the Director, and ii. in the opinion of the Director, the person is required to pay in advance for child care that is reasonably necessary

to permit the person to begin, change or maintain his or her employment or activity. 4. Subsection 58 (1) of the Regulation is amended by striking out “10 days” and substituting “30 days”. 5. (1) Subject to subsections (2), (3) and (4), this Regulation comes into force on the day it is filed. (2) Subsection 3 (3) comes into force on March 1, 2009. (3) Sections 1 and 2 and subsections 3 (1) and (2) come into force on April 1, 2009. (4) Section 4 comes into force on May 1, 2009.

iv. les gains sont réalisés ou les montants sont payés pendant que la personne est membre d’un groupe de prestataires qui reçoit le soutien du revenu prévu par la Loi ou l’aide au revenu prévue par la Loi de 1997 sur le programme Ontario au travail.

2. L’article 38 du Règlement est modifié par adjonction de la disposition suivante : 7. Les gains qu’un membre du groupe de prestataires réalise, ou les montants qui lui sont payés dans le cadre d’un

programme de formation, pendant qu’il poursuit un programme d’études dans un établissement d’enseignement postsecondaire ou au cours des 16 semaines qui précèdent ces études, ne doivent pas être inclus dans le revenu si les conditions suivantes sont réunies :

i. le membre du groupe de prestataires est inscrit à au moins 60 pour cent du programme d’études à plein temps ou à 40 pour cent de ce programme s’il reçoit le soutien du revenu conformément au paragraphe 3 (1) de la Loi,

ii. le membre du groupe de prestataires est : A. soit inscrit à un programme d’études approuvé en vertu de l’article 7 du Règlement de l’Ontario 268/01

(Ontario Student Loans Made After July 31, 2001) pris en application de la Loi sur le ministère de la Formation et des Collèges et Universités,

groupe de prestataires qui n’est pas inscrit à au moins 60 pour cent du programme d’études à plein temps d’un établissement postsecondaire ou à 40 pour cent de ce programme s’il reçoit le soutien du revenu conformément au paragraphe 3 (1) de la Loi, ou d’un adulte à charge qui ne fréquente pas une école secondaire à plein temps ou n’est pas inscrit à au moins 60 pour cent du programme d’études à plein temps d’un établissement postsecondaire si, selon le cas :

ou change d’activité ou la conserve, C. soit commence une autre activité qu’approuve le directeur et qui vise à l’aider à trouver et à conserver un

emploi, ou change d’activité ou la conserve,

i. the member of the benefit unit is enrolled in at least 60 per cent of a full-time course load, and ii. the member of the benefit unit, A. is enrolled in a program of study approved under section 7 of Ontario Regulation 268/01 (Ontario Student

in Schedule 1 to the Fair Access to Regulated Professions Act, 2006 or for application for registration by a health profession named in Schedule 1 to the Regulated Health Professions Act, 1991.

11. Subject to paragraph 12, the exemption of earnings or amount paid under a training program under paragraph 10 shall not apply when income is being determined for the purposes of,

i. determining whether an applicant is eligible for assistance, or ii. determining the amount of assistance payable for the first three months during which an applicant is eligible to

receive income assistance. 12. Paragraph 11 does not apply with respect to an application if, i. income assistance under the Act or income support under the Ontario Disability Support Program Act, 1997 was

continuously paid for at least three months to the applicant or to another person on behalf of the applicant, ii. that assistance or income support was cancelled, iii. the effective date of the cancellation was less than six months before the date of the application, and iv. on the effective date of the cancellation, the applicant’s income included income from employment or amounts

paid under a training program. 3. (1) Paragraph 6 of subsection 55 (1) of the Regulation is amended by striking out “a dependent adult who is not attending school full time” and substituting “a dependent adult who is not attending secondary school full time”. (2) Paragraph 7 of subsection 55 (1) of the Regulation is revoked and the following substituted:

UP FRONT CHILD CARE 7. An amount determined by the administrator, up to a maximum in any 12-month period of the amount that the person

would be entitled to as a deduction for child care under section 49 if, i. a recipient, a spouse included in the benefit unit, a dependent adult or a dependent child, A. begins, changes or maintains employment, or B. begins, changes or maintains an employment assistance activity under the Act, and ii. in the opinion of the administrator, the person is required to pay in advance for child care that is reasonably

necessary to permit the person to begin, change or maintain his or her employment or activity.

4. Subsection 69 (1) of the Regulation is amended by striking out “10 days” and substituting “30 days”. 5. (1) Subject to subsections (2) and (3), this Regulation comes into force on the day it is filed. (2) Subsection 3 (2) comes into force on March 1, 2009. (3) Sections 1 and 2, subsection 3 (1) and section 4 come into force on May 1, 2009.

programme de formation, pendant qu’il poursuit un programme d’études dans un établissement d’enseignement postsecondaire ou au cours des 16 semaines qui précèdent ces études, ne doivent pas être inclus dans le revenu si les conditions suivantes sont réunies :

i. le membre du groupe de prestataires est inscrit à au moins 60 pour cent du programme d’études à plein temps, ii. le membre du groupe de prestataires est : A. soit inscrit à un programme d’études approuvé en vertu de l’article 7 du Règlement de l’Ontario 268/01

l’aide au revenu. 12. La disposition 11 ne s’applique pas à l’égard d’une demande si les conditions suivantes sont réunies : i. l’aide au revenu prévue par la Loi ou le soutien du revenu prévu par la Loi de 1997 sur le Programme ontarien de

soutien aux personnes handicapées a été versé de façon continue pendant au moins trois mois à l’auteur de la demande ou à une autre personne au nom de ce dernier,

ii. cette aide ou ce soutien du revenu a été annulé, iii. la date de prise d’effet de l’annulation tombait moins de six mois avant la date de la demande, iv. à la date de prise d’effet de l’annulation, le revenu de l’auteur de la demande comprenait un revenu d’emploi ou

des montants payés dans le cadre d’un programme de formation. 3. (1) La disposition 6 du paragraphe 55 (1) du Règlement est modifiée par substitution de «un adulte à charge qui ne fréquente pas l’école secondaire à plein temps» à «un adulte à charge qui ne fréquente pas l’école à plein temps». (2) La disposition 7 du paragraphe 55 (1) du Règlement est abrogée et remplacée par ce qui suit :

4. Le paragraphe 69 (1) du Règlement est modifié par substitution de «30 jours» à «10 jours». 5. (1) Sous réserve des paragraphes (2) et (3), le présent règlement entre en vigueur le jour de son dépôt. (2) Le paragraphe 3 (2) entre en vigueur le 1er mars 2009. La Gazette de l’Ontario paraît chaque samedi, et les annonces à y insérer doivent parvenir à ses bureaux le jeudi à 15h au plus tard, soit au moins neuf jours avant la parution du numéro dans lequel elles figureront. Pour les semaines incluant le lundi de Pâques, le 11 novembre et les congés statutaires, accordez une journée de surplus. Tarifs publicitaires et soumission de format:

1) Envoyer les annonces dans le format Word.doc par courriel à [email protected]

2) Le tarif publicitaire pour la première insertion envoyée électroniquement est de 75,00$ par espace-colonne jusqu’à un ¼ de page.

3) Pour chaque insertion supplémentaire commandée en même temps que l’insertion initiale, le tarif est 40,00$

4) Les clients peuvent confirmer la publication d’une annonce en visitant le site web de La Gazette de l’Ontario www.ontariogazette.gov.on.ca ou en visionnant une copie imprimée à une bibliothèque locale.

Abonnement:

Le tarif d’abonnement annuel est de 126,50$ + T.P.S. pour 52 ou 53 numéros hebdomadaires débutant le premier samedi du mois de janvier (payable à l’avance) L’inscription d’un nouvel abonnement au courant de l’année sera calculée de façon proportionnelle pour la première année. Un nouvel abonné peut commander des copies d’éditions précédentes de la Gazette au coût d’une copie individuelle si l’inventaire le permet.

Le remboursement pour l’annulation d’abonnement sera calculé de façon proportionnelle à partir de 50% ou moins selon la date. Pour obtenir de l’information sur l’abonnement ou les commandes s.v.p. téléphonez le (416) 326-5306 durant les heures de bureau.

Copies individuelles:

Des copies individuelles de la Gazette peuvent être commandées en direct en ligne au site www.serviceontario.ca/publications ou en téléphonant 1-800-668-9938.

The Ontario Gazette is published every Saturday. Advertisements/notices must be received no later than 3 pm on Thursday, 9 days before publication of the issue in which they should appear. For weeks including Easter Monday, November 11th or a statutory holiday allow an extra day. For the Christmas/New Year holiday schedule please contact the Gazette at (416) 326-5310 or by email at [email protected]

Advertising rates and submission formats:

1) Please submit all notices in a Word.doc format to: [email protected]

2) For a first insertion electronically submitted the basic rate is $75 up to ¼ page.

3) For subsequent insertions of the same notice ordered at the same time the rate is $40 each.

4) Clients may confirm publication of a notice by visiting The Ontario Gazette web site at: www.ontariogazette.gov.on.ca or by viewing a printed copy at a local library.

Subscriptions:

The annual subscription rate is $126.50 + G.S.T. for 52 or 53 weekly issues beginning the first Saturday in January, payable in advance. In-year new subscriptions will be pro-rated for the first year. A new subscriber may order back issues of the Gazette at the single-copy rate as inventory permits.

Refunds for cancelled subscriptions will be pro-rated from 50% or less depending upon date. For subscription information/orders please call (416) 326-5306 during normal business hours.

Individual Gazette copies may be ordered on-line through the website at www.serviceontario.ca/publications or by phone at 1-800-668-9938.
