AGREEMENT

THIS AGREEMENT, entered into this __ day of , 2016, between Racine County, a quasi-municipal corporation (hereinafter referred to as "County") and the Village of Rochester, a municipal corporation located within Racine County (hereinafter referred to as the "Village"),

WHEREAS, the Village desires to purchase police services and protection within the Village, the Village being willing to assume the cost of this protection; and,

WHEREAS, the County is willing to provide this police protection to the Village under certain terms and conditions.

NOW, THEREFORE, IT IS AGREED by and between the parties as follows:

1. That the County agrees to furnish and the Village agrees to pay for police services upon the terms and conditions as set forth and appendix "A" as attached.

2. The law enforcement services provided by the County shall generally include the enforcement of all local ordinances in effect in the Village. The Sheriff of Racine County shall have supervisory control over the personnel providing these services. The Sheriff shall consider any requests or suggestions made by the Village, but the Sheriff shall retain final authority to make the final decision as to the manner in which such services shall be rendered.

3. It is agreed that, whenever possible, all arrests made in the Village by Deputy Sheriffs contracted for and assigned to the Village shall be made under municipal ordinance. It is understood that prosecution costs are not covered in the administrative costs.

4. It is agreed that the Sheriff, whenever possible, will cooperate with the Village Municipal Court in scheduling the Deputies to perform the services herein, so as to permit a Deputy to testify in court during his regularly scheduled shift in an effort to minimize overtime for court appearances.

5. By June 1st of any year, either party may terminate this agreement for the following year by notifying the other parties in writing. If the Village desires a reduction or increase in services for the following year it must notifY the County by June 1st. In the event that both parties desire to continue to contract for police services for the following year, the County shall provide to the Village by August 1st of any year the estimated costs for police services for the following year. By August 1st, the Village shall provide to the County any schedule or format changes they would like the following year.

6. This agreement shall be for a one-year period commencing on January 1st of any given year unless the parties mutually agree upon a different period.

APPENDIX "A"

This appendix contains the terms and conditions for the provision of police services by the County of Racine for the Village of Rochester for the contract year 2017. The terms and conditions for this agreement for the year 2017 are as follows:

1. The total cost of law enforcement services is based on 1800 hours of service for one deputy in a calendar year. The cost includes; salaries, fringe benefits, administrative costs, vehicle depreciation, fuel, and maintenance.

2. The total yearly per officer cost for law enforcement services is based on 1,800 working hours per year. The hourly rate and total cost per year is indicated in Appendix "B".

3. The Village will be billed monthly based on the services provided on an hourly basis, plus mileage. Mileage is based on the average of the last 3 years at the per mile rate indicated in Appendix "B". The village will be billed the "Monthly Cost" indicated in Appendix "B".

4. The County will provide coverage based on the need for services. The method of deployment will be in the manner set forth in the scheduling of squad cars as approved by the Sheriff and the Village.

5. The only adjustment to be made will be a reduction when a "Village Squad" is called out of the Village to answer a Sheriff's Department call. This reduction will be at the same hourly rate indicated in Appendix "B".

To whom it may concern, My name is Jared Werth.  I am the head coach for the 3rd/4th graders Waterford Youth Football.  We are looking for a place to practice.  Our practices will be on Monday, Tuesday, and Fridays.  From August 15, 2016 ‐ October 28, 2016.  Our practices would run from about 5:00PM until 7:00PM. I was interested in practicing in the grassy area north of the baseball diamonds and east of the parking lot.  I have attached a picture of the area I'm hoping to use. I have 18 children on the team.  These kids are all from the area.   Rochester, Waterford, Wind Lake, Burlington, etc.  We are insured through our league. Thank you for your consideration.  I will wait for your reply.  Jared  Werth

Staff Report To: Plan Commission Members From: Betty Novy, Clerk-Treasurer/ Jon Schattner, Zoning Administrator Date: July 28, 2016 Re: Recommendation regarding ordinance and procedural requirements for development on Private roads

History:  The attached report documents existing private roads in the Village of Rochester. Most private roads existed prior to the adoption of county zoning in 1971. Since zoning regulations have been in place (45 years), there have been only three instances of private roads being allowed in the (previous) Town or Village of Rochester. Approval of each of these instances was through Planned Unit Development (overlay) zoning. PUD zoning allows exception to underlying zoning district regulations for lot size, frontage, setback, and various other zoning requirements but does not allow exception to the underlying use (e.g. residential or commercial). In Question: Two Changes to the Zoning and Land Division Code adopted 7/1/2014 (underlined) 35-15B. Site Restrictions (Zoning Code). “All Lots shall abut upon a public street, or a private road approved by the Village, or other means of access if that access was in existence prior to the adoption of this chapter……”

Previous Village Zoning: Ch. 15, s.2.06 b.) “All Lots shall abut upon a public street, and each lot shall have a minimum frontage of thirty (30) feet.” Previous County Zoning: 20-986(d) “A minimum of thirty-three (33) feet of all lots shall abut upon a public street, or other means of access if that access was in existence prior to the adoption of this chapter…”

30-84F. Lot and Block Standards (Land Division Code). “All lots shall abut publicly dedicated streets, or private streets when allowed by the Village Board.”

Previous Village Land Division Code: Ch. 16, s.7.6 “Lots.” Access. “Every lot shall front or abut for a distance of at least thirty-three (33) feet on a public street or other officially approved means of access”. Previous Town Land Division Code: Section 27.804. “Lot and Block Standards”. Subsection f. “All lots shall abut publicly dedicated streets”.

While the private road language was recently inserted into the code, no process was included to guide the Plan Commission or Village Board in terms of private road approval. This is NOT good, because there should be a process to determine what circumstances warrant approval of a private (vs. public) road. Otherwise, decisions might seem arbitrary (defined: based on random choice or personal whim, rather than any reason or system). These are the types of decisions that can get a village in trouble. It seemed that Plan Commission discussion last month was leading in the direction of NOT viewing private roads favorably, but that if they were to be allowed, that they be platted and constructed to public road standards. The public road platting and construction aspect is supported in the appendices of the Land Division Code which provide direction for the construction of improvements (as follows):

SECTION 1 - ENGINEERING AND ADMINISTRATIVE PROCEDURES, 1.1 INTRODUCTION: These standards have been prepared to insure that the design and construction of public improvements will meet the minimum requirements of the Village. The intent of Section 1 is to provide an overview of requirements and procedures required by Chapter 30, Land Division, which govern the design and construction of public improvements. These standards are also intended to provide uniform design criteria for facilities designed for or directly by the Village, as well as provide specifications for private development within the Village. The appendixes provide administrative and construction standards for erosion control, utility, stormwater, and roadway improvements. ALSO discussed last month, certain other items need to be addressed with the approval of private roads such as public access and utility easements, development agreements with the village, restrictions and covenants, and financial considerations affecting not only initial construction of the road- but also ongoing maintenance and upkeep. Newly inserted language.. Private road approved by the village; private streets approved by the Village Board The key to this language is “approved by”. We recommend the PUD zoning process be utilized as the guideline for private road approval. The land division code supports all engineering, construction, and legal requirements applicable to private development being the same as public development in its appendixes. In some ways, private roads are more complicated due to the need to create more easements and create all the legal documents necessary to address future maintenance and upkeep of road and stormwater improvements. Hence, there really is no financial advantage to developing on a private road. However, some may still want to develop this way to create an “exclusive” development that provides benefits or services, above and beyond those that are publicly provided, to those that purchase lots there. This, again, is best accomplished through the Planned Unit Development Overlay zoning and process. In regards to the Franciscan Missions CSM, the ordinance provides that “All Lots shall abut upon a public street, or a private road approved by the Village, or other means of access if that access was in existence prior to the adoption of this Chapter and was previously approved by the municipality.” This access easement was platted before county zoning was implemented. The Town has approved and signed off on at least two CSM’s displaying this particular access easement since then- it even took actions to name the road for emergency response purposes. These actions suggest that the access was previously approved by the municipality. This CSM will be coming back for further consideration at a future meeting. In regards to new private road development proposals: To be consistent with past practice, we recommend that the approval process for private road developments be developed under PUD zoning guidelines; or that they simply proceed with the development proposal to construct and develop on a publicly dedicated road. Either process can be accomplished via CSM when creating four or less lots. We also recommend that both zoning and land division codes be amended to clarify that private roads be approved through the Planned Unit Development zoning process.

PRIVATE ROADS EXISTING IN THE VILLAGE OF ROCHESTER 

Platted 1920?:  Honey Lake Subdivision Roads (Paved) 

Substandard Roads‐ Owned, Managed & Maintained by the Honey Lake Protection & Rehabilitation District 

Narrow (some only 8’ wide)   

Current structures and landscaping prohibit converting roads to standard road right of way width 

Enforcement of laws applicable to traffic on public streets do not apply so law enforcement has had to 

get creative at times to deal with that. 

Residents are subject to additional taxes for road maintenance and street lights. 

‐Established 1928:“Unnamed Road” off of Academy Road (Gravel‐ 33’ Wide) 

Provides Access to DNR Hunting grounds and adjacent parcel to the west, now owned by KES Holdings, on 

Academy Road.   Each party has ½ ownership interest.  The private road has been in common use since 1928, 

with the DNR gaining ownership of their parcel in 1958.   ½ ownership interest was recorded with the Register of 

Deeds in 1985. 

Spoke with Marty Johnson, Property Manager, with the DNR.   All costs for maintenance are “generally” split 

between the two owners. 

Earliest Record 1936:  “Beguhl Road” (off of N. Maple Lane) 

No recorded easements or agreements on file.   No houses access off road.   Property was being maintained by 

the Town of Rochester until 2011 when it was finally determined to be a private drive.  Now, maintenance, if 

any, is performed by surrounding property owners. 

Existed prior to county zoning (1971) “Timberlane Drive” (Gravel – 25’ Wide Easement) 

Right of way agreement was executed in 1987 to document access to the eight parcels and provide a mechanism 

for paying for the upkeep of the road, snowplowing, etc.   This was required by the bank when one of the 

residents went to re‐finance a mortgage. 

Existed prior to county zoning (1971): “Hunters Trail” (Paved – 66’ Wide Easement) 

Created via easement in early 1971‐ granted by the Buss family to Lang Engineering in exchange for them 

constructing and maintaining the road. 

Private roads created through PUD* (Planned Unit Development) Overlay Zoning: 

1996:  Rodaza Drive (Gravel – 66’ Wide‐ terminates in a bulb 90’ cul de sac –not improved) 

Created via CSM‐ “Declaration of Easement” leaves it completely up to the owners, by unanimous consent, as to 

how the private road is improved, but provides mechanism for future cost sharing  for maintenance, repairs and 

replacement.  This was a previous gravel pit owned by Donald Lang. 

2005:  Settlement Drive; Oak Hill Circle (Paved – 28’ Wide)  

Created via CSM & Condominium Plat‐ Restrictive Covenants, Access & Utility Easements in place  

2006:  Millgate Drive  (Paved‐ 66’ Wide) 

Created via CSM‐ 

CSM documents public ingress/egress, stormwater & sanitary sewer easements 

Declaration of Restrictions, Covenants, & Easements addresses upkeep of road and other matters 

*PUD zoning allows exception to the underlying zoning district regulations for lot size, frontage, setback, and 

various other zoning provisions subject to plan commission and village board approval.

BE IT RESOLVED that t~e Racine County Board of Supervisors a~thorizes a project for the improvement.of County Trunk Highway (CTH) D, from State Street to State Trunk Highway (STH) 36, in the Village of Rochester.

BE IT FURTHER RESOLVED by the Racine County Board of Supervisors that there are funds available for this project in existing account numbered 44.1570.100 and 44.1570.415.

BE IT FURTHER RESOLVED by the Racine County Board of Supervisors that the funds available will be transferred as set forth in Exhibit "A" that is attached hereto to a new account number.

BE IT FURTHER RESOLVED by the Racine County Board of Supervisors that the County Board Chairman, the County Clerk, and/or the County Executive are authorized to sign any necessary documents or contracts to carry out the intent of this resolution.
