RE: Electronic Participation Policy

Background

Trustee Grenier requested to remotely participate at the Village Board meeting on September 1 because of a surgical procedure. Preceding that procedure, he is being required to self-quarantine for 14 days as a precaution for COVID-19. The Village Board is asked to approve both an electronic participation policy and electronic participation for Trustee Grenier.

The Illinois Open Meetings Act allows elected officials to participate “electronically” in Village Board meetings, meaning by audio or video conference, if they cannot attend in person due to illness, travel for Village business, travel for personal employment reasons or a family or other emergency (5 ILCS 120/7). This type of participation predates the COVID-19 related amendments to the Illinois Open Meetings Act, which allows for completely remote meetings during the time a Governor has declared a public health related emergency that covers the Village.

In order for elected officials to participate at a Village Board meeting under the illness, travel and emergency provision, several conditions must be met, including:

1. The Village Board must have approved written rules allowing for this type of electronic participation.

2. A quorum of the Village Board (4 of the 7 of the Village President and Trustees) must be physically present at the meeting.

3. A majority of the Village Board must vote to allow the absent Board member to participate remotely, and the absent Board member must qualify to participate under one of the illness, travel or emergency exceptions and provide as much detail about the topic as possible.

ELECTRONIC PARTICIPATION POLICY FOR PARTICIPATION IN VILLAGE BOARD MEETINGS

BY AUDIO OR VIDEO CONFERENCE

SEPTEMBER 1, 2020 The Village of Berkeley President and Board of Trustees have the authority to allow Board member, meaning the Village President or a Trustee, participation in meetings by audio or video conference if that Board member is prevented from attending in person for one of the following reasons:

1. personal illness or disability; 2. employment travel purposes or business of the public body; or 3. family emergency

The following procedures must be followed for participation of a Board member by audio or video conference in an open or closed session meeting of the Board or a committee of the Board: A. The Board member must inform the Village Administrator, or his / her designee, as soon as possible, and at least 1 hour before the meeting, of expected participation in a meeting by audio or video conference so that necessary arrangements can be made. The Board member must state the reason why he / she cannot attend the meeting, and it must be one of the three reasons enumerated above. B. The Board member must participate by conference call broadcast by speaker phone or video conference so that all persons in attendance at the meeting (including members of the public) may hear the Board member and the Board member may hear all persons in attendance at the meeting. C. The Board member participating by audio or video conference must announce his or her presence and audio or video participation to all persons in attendance at the meeting. D. The majority of the members of the Board must be physically present at each meeting to establish a quorum. The Board member participating by audio or video conference may not be counted for purposes of establishing a quorum, but may participate fully in the meeting and any action to be taken upon approval of a majority of those Board members physically present at the meeting. E. If the Board member participating by audio or video conference has provided notice and a qualifying reason for his / her absence, that Board member shall be entitled to participate in the meeting unless the members physically present vote unanimously to exclude the Board member.

F. The minutes of the meeting must reflect the Board member’s presence and participation by audio or video conference. G. The meeting must comply with all other requirements for open meetings established by law. H. In the event that the audio or video conference equipment cannot be set up for some reason, the meeting and agenda will continue as planned.

4.2 ComEd Update – Rich Negrin, VP of Operations Mr. Negrin gave an update on the devastation of the storm that was felt in Berkeley and other areas (some areas were without electricity for a few days). Mr. Negrin also said that the reason the Village of Berkeley did not lose their power for too long is because of the investments that were made together (ComEd and Berkeley). Many outages have been prevented because of these investments by ComEd. Smart meters let ComEd know that an address is out of power.

9.2.5 Discussion on Video Gaming Terminal Fees Village Administrator Espiritu explained that a request came in that the terminal fees that is paid by the establishment be paid by the operator (the owner of the gaming terminals). The fee that the Village of Berkeley gets is $1,000 per machine per year. Attorney Smith explained to the Board about how the Video Gaming Terminal Fees can be paid. Attorney Smith shared with the Board the different options that they can approve regarding who pays the Terminal Fees. The Board agrees that they are going to consider the terminal fees to be paid 90% by the operator and 10% by the business. However, they want more research on the terminal fees. Village Administrator Espiritu will contact all the businesses with this information and will be brought back to the Board at the 1st meeting in October, 2020.

Grenier) 8.5.1 Trustee Liaison Report – Trustee Hammar wanted to acknowledge

Public Works, the Fire Department and the Police Department on behalf of the Board. He thanked them for all the hard work and appreciate them working together. Public Works have been out since August 10th working on only trees. There were many residents that were in need and they did their best to assist them. Since Public Works has been working very hard on the devastation of the storm, they have gotten behind on other jobs that need to be done, including the water main project. As of today, they will stop dedicating all their time to the storm devastation, the will go back to the watermain project and work they need to complete. Superintendent Wagner informed the Board that they will need assistance and it will have a financial impact on the Village.

8.6.1 Trustee Liaison Report – Trustee Perez met with Lions Club. He informed the Board that if anyone has a financial situation (a form will need to be filled out), the Lion’s Club will assist them with purchasing glasses or a hearing aid. The Neighborhood Watch will be distributing masks for Berkeley residents. They are interested in having their meeting at the Village Hall. They will contact Assistant to the Village

9 Village President 9.1 President’s Report

9.1.1 9/1/20 Village Board Meeting at 6:30 p.m. All departments stepped up to assist with the storm damages. Thank you to Superintendent Wagner, Fire Chief Kuryla, and Police Chief Larem and their whole team.

Rainbow Farms will pick up the chips and leaves. There will be a fee to remove them.

Thank you to Police Chief Larem and Commander Bednar for all their assistance.

Code has done good work and Commander Bednar has done an outstanding job.

10 Village Administrator – Covid-19 numbers gone up. Infection rate over the weekend went up but is now slowly going down. We need to educate people to continue to be careful, wear face masks, wash hands, and practice social distancing as much as possible.

11 Village Attorney – Attorney Smith explained that Illinois may go back from phase 4 to phase 3.5. Due to the pandemic rate going up, some businesses may have to close.

12 Public Comments and Questions Dan O’Connell, Berkeley resident, gave suggestions on how funds for the Village can be found. Laurie Stolle, Berkeley resident – Will trees be evaluated before taken down? Trees will be evaluated based on balance before they are taken down.

RE: Landscaping and Mowing Services Bid

Background With the continued vacancy of a Public Works Laborer due to a recent retirement and hiring freeze, the Public Works Department made the decision to bid out mowing and landscaping duties previously performed by staff. The Village published a Request for Proposals (RFP) in order to obtain competitive pricing for landscaping and mowing services. The Village received a total of two bids from J.P. Landscaping and HL Landscaping, respectively. The apparent low bidder was J.P. Landscaping at a cost of $922/total, per service. Pricing information can be found in attachment. Public Works staff has previously worked with J.P. Landscaping and has found their services to be satisfactory. Previous Action No previous action has been taken on this matter. Recommendation Staff recommends that the Village Board of Trustees approve a Resolution Authorizing an Agreement Between the Village of Berkeley, Cook County, Illinois and J.P. Landscaping Incorporated for Lawn Maintenance Services at Pre-Determined Locations. Budgeted Amount The cost for calendar year 2020 is $6,084 and $20,736 for calendar year 2021. The total between both years is $26,820. This cost reflects the schedule in the bid and could change. Sufficient monies are currently in the budget to cover this cost. A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF BERKELEY, COOK COUNTY, ILLINOIS

AND MOWING, J.P. LANDSCAPING INC. FOR LAWN MAINTENANCE SERVICES AT PRE-DETERMINED LOCATIONS

WHEREAS, the Village of Berkeley (“Village”) is a duly organized and validly

existing home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and WHEREAS, the Village has pre-determined properties selected by the Village’s Public Works Superindent that require regularly scheduled lawn maintenance by an outside contractor; and WHEREAS, the Village’s Public Work’s staff previously performed the required lawn maintenance; but, due to COVID-19 and reduced staff, they are unable to perform this required work: and WHEREAS, thereafter, the Village solicited and reviewed competitive quotes from several firms that provide lawn maintenance services; and

WHEREAS, after review of the quotes submitted, the President and Board of Trustees of the Village desire to enter into the agreement for lawn maintenance services with Mowing, Inc. attached hereto as EXHIBIT A and made a part hereof (“Agreement”); and WHEREAS, the Village has the authority to enter into the Agreement pursuant to its home rule authority, and the President and Board of Trustees of the Village find that entering into the attached Agreement is in the best interests of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BERKELEY, ILLINOIS AS FOLLOWS: SECTION 1: Incorporation. That each Whereas paragraph above is incorporated by reference into this Section 1 and made a part hereof as material and operative provisions of this Resolution. SECTION 2: Approval and Execution. That the President and Board of Trustees of the Village authorize the execution of, and approve entering into, the Agreement, and authorize and direct the Village President, the Village Administrator and the Village Clerk, or their designees, to execute and deliver the Agreement and all other instruments and documents that are necessary to fulfill the Village’s obligations under the Agreement. The President and Board of Trustees of the Village find that all purchasing requirements have been met with respect to the Agreement. Further, the President and Board of Trustees of

That if any Section, paragraph or provision of this Resolution shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such Section, paragraph or provision shall not affect any of the remaining provisions of this Resolution. SECTION 4: Repeal. That all resolutions, motions or parts thereof in conflict with this Resolution shall be and the same are hereby repealed. SECTION 5: Effectiveness. That this Resolution shall be in full force and effect upon its adoption and approval according to law. RE: Intergovernmental Agreement for Multi-Jurisdictional Drug and Gang Task Force

Background

The continual efforts of the Berkeley Police Department have led to the arrest of multiple violent offenders and the recovery of an unprecedented number of illegal weapons, narcotics and other contraband. The Berkeley Police Department takes pride in its ability to do “more with less” but recent cases have shown that there is a limit to what can be accomplished without outside assistance.

Neighboring agencies have taken advantage of their combined resources to field a multi-jurisdictional drug and gang task force. The primary purpose of this task force is to execute arrest warrants, search warrants and other high-risk police operations that would otherwise be difficult for a single department to undertake at the patrol/investigative level. Further partnering with our neighboring agencies and assigning officers to this task force will allow the Berkeley Police Department to continue to expand its investigative and enforcement capabilities and minimize the impact of crime on within the community.

Staff recommends that the Berkeley Village President and Village Board of Trustees approve a Resolution Approving and Authorizing the Execution of an Intergovernmental Agreement Concerning the Sharing of Police Services, Personnel, Equipment and Resources through a Multi-Jurisdictional Drug and Gang Task Force.

Budgeted Amount

The expenses related to this agreement will draw from existing training, uniform and asset forfeiture funds. No extra funding will be needed at this time.

RE: Village of Berkeley Draft Diversity Statement

Background

The discussion of racial equality continues to be at the forefront of every community throughout our nation and Berkeley is no exception. Recently, the Village of Berkeley helped coordinate a peaceful protest for Black Lives Matter on June 13, 2020. This protest started in Berkeley Park and marched down the Prairie Path to the Hillside Commons. The Berkeley Police Department and Village Administration worked with event organizers and partner agencies to ensure a peaceful and safe demonstration. The protest was chiefly organized by a Berkeley resident.

As we pause to reflect on our own community in Berkeley, our biggest strength is the diversity of our village. According to the CMAP Community Data Snapshot, the race and ethnicities represented in Berkeley is approximately one-third Hispanic or Latino, one-third Black and one-third White. Village residents have consistently have shown their commitment to diversity by electing a diverse group of Village Board members, including females and Black and Hispanic or Latino Trustees. The Mayor and Village Board have continued to hire a diverse village staff, including hiring chief administrative officers (Village Administrators) who were female or minorities. The draft Diversity Statement reflects what the Village has been and continues to build upon as an inclusive, respectful and accepting community.

It is the recommendation of Village staff that the Village Board of Trustees discuss the draft Diversity Statement and recommend changes or edits as needed.

RESOLUTION NO. ______

A RESOLUTION OF THE VILLAGE OF BERKELEY, COOK COUNTY, ILLINOIS ADOPTING A DIVERSITY STATEMENT

WHEREAS, the Village of Berkeley (“Village”) is a duly organized and validly

existing home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and WHEREAS, the Village is a diverse community with residents and workers from a wide variety of backgrounds and experiences; and WHEREAS, diversity strengthens the fabric of the Village and makes it a wonderful place to live and work; and WHEREAS, the President and Board of Trustees of the Village recognize and acknowledge the importance of diversity in the Village, the State of Illinois and the United States of America; and WHEREAS, the Village mourns the tragic death of George Floyd on May 25, 2020 and denounces injustices that continue to plague the United States of America; and WHEREAS, the President and Board of Trustees of the Village value dignity and respect for all people and condemn racism, bigotry and hate in all forms and desire that the Village be a safe place for everyone; and WHEREAS, the Village is a leader in diversity in senior staff appointments, where of the five (5) Village Administrators in the history of the Village, three (3) were females; and WHEREAS, the Village continues to be a trailblazer in municipal management, appointing Rudy Espiritu as Village Administrator in December of 2016 and in appointing Rudy Espiritu, the Village made history by employing the first Asian-American Chief Administrative Officer in municipal government in the State of Illinois; and

WHEREAS, the Village prepared the “Diversity Statement” in EXHIBIT A attached hereto and made a part hereof, documenting the Village’s past, present and future commitment to diversity; and

WHEREAS, the President and Board of Trustees of the Village find that approving the Diversity Statement is in the best interests of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BERKELEY, ILLINOIS AS FOLLOWS:

SECTION 1: Incorporation. That each Whereas paragraph above is incorporated by reference into this Section 1 and made a part hereof as material and operative provisions of this Resolution. SECTION 2: Approval. That the President and Board of Trustees of the Village authorize and approve the Diversity Statement. SECTION 3: Severability. That if any Section, paragraph or provision of this Resolution shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such Section, paragraph or provision shall not affect any of the remaining provisions of this Resolution. SECTION 4: Repeal. That all resolutions, motions or parts thereof in conflict with this Resolution shall be and the same are hereby repealed. SECTION 5: Effectiveness. That this Resolution shall be in full force and effect upon its adoption and approval according to law. VILLAGE OF BERKELEY

DIVERSITY STATEMENT

The Village of Berkeley (“Village”) celebrates our diversity as our biggest strength, proving that people of different backgrounds can live harmoniously in an equitable, respectful and accepting community. The Village values dignity, equity and respect and the Village condemns and rejects racism, bigotry, hate and injustice. Diversity comes in many forms including race, color, religion, sex, national origin, ancestry, age, marital status, physical or mental disability, familial status, gender identity, military status and sexual orientation. The Village values and encourages diversity in all of its forms. The Village is a diverse community and our residents and workers have a variety of backgrounds and experiences, all of which are important and respected. Based on data from the United States Census Bureau, the Village’s residents are approximately one-third White, one-third Black and one-third Hispanic/Latino, making the Village a wonderful melting pot of different races and ethnicities. The Village’s diversity is also reflected in the varied background of our residents, our workers, the Village President and Board of Trustees and Village staff. Over the past thirty (30) years Village residents have shown their commitment to diversity by electing a diverse group of Village Board members, including females and Black and Hispanic or Latino Trustees. The strength of the Village’s diversity creates the safe and family-friendly community that our residents and workers appreciate, know and love. The Village’s Police Department adopted and has committed to follow the NAACP’s “Ten Shared Principles.” The Village adopts the Ten Shared Principles for the Village’s operations as a whole, not just the Police Department, as follows:

1. We value the life of every person and consider life to be the highest value.

2. All persons should be treated with dignity and respect. This is another foundational value.

3. We reject discrimination toward any person that is based on race, color, religion, sex, national origin, ancestry, age, marital status, physical or mental disability, familial status, military status or sexual orientation.

4. We endorse the six (6) pillars in the report of the President’s Task Force on 21st Century Policing for the Village’s operations as a whole. The first pillar is to build and rebuild trust through procedural justice, transparency, accountability and honest recognition of past and present obstacles.

5. We endorse the four pillars of procedural justice for the Village’s operations as a whole, which are fairness, voice (i.e., an opportunity for residents and Village staff to believe they are heard), transparency and impartiality.

6. We endorse the values inherent in community policing for the Village’s operations as a whole, which includes community partnerships involving law enforcement and other Village departments, engagement of police officers and Village staff with residents outside of interaction specific to enforcement of laws, and problem-solving in all aspects of the Village’s operations that is collaborative, not one-sided.

7. We believe that developing strong ongoing relationships between the Village and communities of color at the leadership level and street level will be the keys to diminishing and eliminating racial tension.

8. We believe that the Village and community leaders have a mutual responsibility to encourage all residents to gain a better understanding and knowledge of the law to assist them in their interactions with the Village.

9. We support diversity in Village staff and in the local government profession as a whole. Village staff and citizens have a mutual responsibility and should work together to make a concerted effort to recruit diverse local government staffs.

10. We believe de-escalation training should be required to ensure the safety of community members and Village staff. We endorse using de-escalation tactics to reduce the potential for confrontations that endanger law enforcement officers, Village staff and residents. We endorse the principle that human life should be taken only as a last resort.

The Village encourages all our residents and workers to commit to implement these Ten Shared Principles in the Village.
