MEETING OF THE STRATEGIC CO-ORDINATION GROUP FOR THE WFD COMMON IMPLEMENTATION STRATEGY

BRUSSELS, BERLAYMONT BUILDING, 5TH OCTOBER 2006

DRAFT SUMMARY

The Commission, DG Environment D.2. (hereafter referred as COMM) invited delegates for the Strategic Co-ordination Group (SCG) meeting of the Common Implementation Strategy (CIS) for the Water Framework Directive (WFD) on 5 October 2006. The following Member States (MS) participated in the meeting: AT, BE, CY, CZ, DK, DE, EE, ES, FI, FR, HU, IE, IT, LU, LV, LT, MT, NL, PL, PT, SK, SI, SE and UK. In addition, representatives of Norway and Romania, CCNR, CDA, CEFIC, COPA/COGECA, EAA, ECPA, EEB, EREF, ESHA, ESPO, EURELECTRIC, EUREAU, EUWMA, EWA, INBO, WMO, WWF, and the Commission (DG ENV and JRC) were represented. A full list of meeting participants is provided in Annex 1.

The main objective of the meeting is to continue the work under the WFD Common Implementation Strategy and start preparation for the upcoming Water Directors meeting to be held in Lapland (Finland) on 30 November – 1 December 2006.

A draft agenda (see Annex 2) was distributed before the meeting.

A summary of the discussions under each point of the agenda and the conclusions are presented below.

ITEM 1. WELCOME AND INTRODUCTION

COMM welcomed the delegates and opened the meeting. Apologies from the Chairman of SCG, Mr Helmut Bloch and from the co-Chair, Mr Joachim D’Eugenio who had to attend a Council Meeting on Priority Substances in the morning. COM informed

participants that translation is available in EN, FR, IT, ES and DE. The Chairman reminded participants of the special rules concerning security in this building.

ITEM 2. APPROVAL OF THE AGENDA

The draft agenda was circulated before the meeting. The revised draft agenda (see Annex 2) was approved.

The list of documents was circulated before the meeting (Annex 3). The Chairman mentioned a mistake in that list should have indicated that the document on art 4.7 (ENV/SCG051006/2) was ready for endorsement.

ITEM 3. WATER DIRECTORS MEETING PREPARATION

The FI delegation presented progress on preparation of the Lapland Water Directors meeting on 30 November-1 December 2006 (1.5 day). There will be a dinner on 29th of November. FI warned participants of the need to register to the meeting for the 23 October. FI indicated that there were preferential rates for accommodation for the participants at the meeting. FI invited participants to register through the Presidency for the internal flight at the following email address: [email protected]

The German delegate briefly informed participants of the Water Director meeting which will take place in Dresden on 18-19 June 2007.

Discussions:

NL enquired about the agenda for the Finnish Water Director meeting.

FI responded that the invitation should have just gone out and that the agenda is still being discussed with COMM but should be ready soon.

Action:

SCG members to take note of the deadline for registration and to contact the FI presidency for the internal travel arrangements to the Finnish Water Director meeting.

ITEM 4. COMPLIANCE CHECKING AND TRANSPOSITION OF WFD

COMM presented a brief update of the WFD scoreboard and invited Member States to consult the scoreboard on Commission Europa web pages.

COMM informed the SCG that the technical assessment reports on Article 3 for the remaining Member States (i.e. EL, ES and PL) will be sent next week.

As IT has submitted their article 3 report, an assessment report will be also sent within the next few weeks.

COMM also informed SCG that the map of RBD has been updated (and is available on CIRCA) and invited SCG participants to comment during the lunch break or to send

their comments for 20 October. COMM urged IT to send their shape files ASAP for the update of the map.

COMM reminded participants that for a submission to be taken into account in the COMM implementation report to be prepared next year, information will have to be submitted before 30 October 2006 (to be in line with date mentioned in the resubmission letter rather than the previous 15 October deadline mentioned before).

Discussion:

NL enquired about the deadline for receiving the assessment report on Article 5. COMM promised the report at the beginning of next year (before March)

BE mentioned the deadline of the 30 October as final dates for resubmission.

Conclusions/Actions:

SCG took note of the information available on CIRCA/Commission Europa web pages and of the deadline for comments on the map of 20 October as well as the deadlines for any additional information on Article 3 report of the 30 October 2006.

ITEM 5. COMMISSION ACTIVITIES

a) Update on negotiations on proposals

Groundwater

The first conciliation meeting will be taking place next week.

Flood Protection

After a first reading, the European Parliament approved the proposal in June 2006. The Environmental Council adopted a political agreement on a common position on the Flood Directive. Second reading should take place in 2007.

The mandate for the Flood WG will be presented at the November meeting.

COMM had to cancel the October Stakeholders meeting but new dates (probably February and October) will be proposed.

Exchange and information circles:

Flood forecasting: work proceeds on a guide on communicating with the public

Flood mapping: a document on existing practices in flood mapping is being prepared, next meeting 14-15 / 12 in the NL

A "Workshop on land use planning and water management, with focus on flood risk management" will be held in the Oslo area on 31/1 and 1/2 2007, aiming at initiating an activity in this area, probably an exchange and information circle under the working group on floods. Invitations to the workshop will be sent to the Floods stakeholder group, and nominations for 2 participants from each MS will be made, preferably 1 water/flood manager and 1 spatial planner. The workshop is co organised by NO, NL and the Commission.

Marine strategy

Political debate in Council is planned to take place on 23 October. It is the objective of the FI presidency to reach political agreement at December Council.

Priority Substances

Currently being discussed in Council.

Discussion: no comment

Conclusion/actions:

SCG take note of the information provided.

b) New SCG rules of procedure: attribution of clusters

A document was circulated before the meeting. These clusters were agreed by the Water Directors in June to prevent problems of space in future.

Two new members were welcomed and gave a brief presentation: CCNR and EUWMA.

Discussion:

CCNR and EUWMA will send some comments. CCNR could be included in RBMP and EUWMA is mentioned twice.

Conclusion/actions:

SCG take note that any comments on these new rules should be sent to COMM in writing by 20 October 2006.

c) Research/policy workshop on Climate Change and Water

A workshop took place on 25-26 September 2006 in Brussels organised by DG Research, Environment and JRC. A report will be prepared and sent to the Water Directors and to the next SCG as well as to the organisers of a German Conference on the subject in February 2007.

SCG took note of the future workshop report

e) New Commission proposals: pesticides strategy

SCG were informed of the web link to the new pesticide strategy published in July which includes special measures to protect the aquatic environment.

Discussion:

NL commented on coherence of this strategy with other pieces of legislation on chemicals as the Directive 91/414/EEC. NL wished for these concerns to be passed on to the COMM colleagues preparing the strategy and to the Priority Substances Group and to have an in-depth discussion within this group on this issue.

Conclusion/actions:

SCG took note of the new strategy

f) Other issues

- Meeting planning 2007

The list of future meetings for 2006 and 2007 were circulated before the meeting and put on CIRCA for information.

In 2006, GIS workshop in November and Flood stakeholder meetings in June and October had to be cancelled. Plan to have a WISE workshop in December – date to be communicated shortly.

In 2007, SCG to take note of the several meetings scheduled for Art 21 Committee – these may or may not all take place depending on the progress on the intercalibration decision. The Chair enquired about the most preferred dates for the SCG meeting in May – either 15-16 May or 24-25 May.

Discussion:

EEB enquired about the next WG A meeting in 2006. JRC confirmed that there is a workshop planned on 12-13 October in Brussels and that the dates for other meetings will depend on progress on Intercalibration work.

NL mentioned the importance for ECOSTAT to meet before the next Art 21 Committee

HU enquired about the future meetings for flood stakeholder group – COMM repeated the plan to have one meeting in February and October – dates to be confirmed.

Conclusion/Action(s):

SCG took note of the different dates and of the need to send their comments on the preferred date for the May Committee meeting.

- European Fisheries Fund

The Regulation on European Fisheries Fund was adopted in June – art 38 can potentially help funding WFD objectives.

- Recommendations from the EU carbon capture group

This group made recommendations published in September 2006 that EU water legislation should be amended to remove obstacles to deploy underground CO2

storage technologies. This is a reference to Article 11 of the WFD.

Discussion:

DE was opposed to reopening the WFD unless absolutely necessary and this does not seem to be the case – technical effect of CO2 storage needs to be looked closely.

EEB was also concerned about reopening WFD for such an issue – should ensure policy consistency and also be more careful in promoting one specific technology and overlooking sustainability. WFD provides all the mechanisms necessary as it stands.

Conclusion/Action(s):

SCG took note of the information provided.

ITEM 6 INTEGRATION INTO OTHER EU POLICY AREAS

a) Strategic Steering Group on “WFD and Agriculture”

Four documents have been approved by the Water Directors. Another document on impacts and pressures was sent to SCG before the meeting. A summary report (AGRI/SCG051006/15) has also been prepared and circulated before the meeting to seek SCG approval to present it to the Water Directors for endorsement in November 2006.

The Water Directors have decided to draw their own decision in a separate declaration.

Discussion:

ES made 2 comments – 1) the fact that there was no detailed information on the Pilot River Basins and 2) that there was no positive comments on the contribution from

agriculture in environmental protection in Mediterranean areas and others. COMM clarified the fact the PRB contribution has not yet been received and thus could not be incorporated in this report and that that the report reviewed the art 5 reports which deal with pressures and impacts.

NL supported for the document to be presented to the Water Directors for endorsement. NL made some remarks: pg 11 – issues for further discussion – SSG AGRI will need at some point to decide which elements should be prioritise (can’t look at them all). NL also proposed for key topic 2 (pg 11) some minor rewording ‘reasonable standard of living’ – need to replace ‘define’ by ‘elaborate’. COMM reassured participants that this list does not pre-empt what will be in the future mandate of the group however the link with rural development will be an important topic. The reference to standard of living can be removed or redrafted and just wanted to highlight that this would need to be looking at.

AT would like to see mention the role of farm advisory services in the document COMM propose to add a new key topic to cover the role of advisory services.

SE and AT proposed some rewording in section 2 regarding the role of N versus P. statement not true as it is especially for inland waters and lakes but also Baltic sea. COMM agreed to rebalance this paragraph

Conclusion/action(s):

COMM took note of the comments made and will incorporate them into the document.

SCG agreed to present the revised summary document to the Water Directors in November without further review by SCG.

b) WFD and Hydromorphology

The COMM presented the progress report of this activity. Two types of documents are being prepared under this activity: 1) a technical document to be ready for the next SCG in November 2) A political paper (HYMO/SCG051006/13) which was discussed at the last SSG meeting on 7 September and the revised version was circulated before the meeting. COMM proposed for this document to be sent for endorsement by the Water Directors in November.

Discussion:

NL is concerned about point 3 in the policy summary (pg 4) that this lead to reopening the debate about water services/uses definition. In NL, flood protection is NOT a water services. It proposed to add at the end of the paragraph a reference to WATECO guidance document. COMM clarified that the aim of the paragraph is to highlight that the use of market based instruments’ needs to be stronger and is happy to have a reference to WATECO and remarked that art 9 does not exclude a-priori flood defence as a service.

EEB provided positive feedback on the document as providing good information to explain linkages between navigation, energy and flood. However, does not want to see

the general point of this paper lost. COMM specified that it does not wish to exclude any uses.

SE has sent comments in writing to COMM.

EEB and SE do not like the Norwegian case study and EEB would rather remove it from the text. NO did not oppose to this. COMM has tried to clarify with Norway the case study and wish to keep it in as this is the only example of hydropower.

ESPO is concerned that the paper singles out navigation when requiring a conservation approach (pg 5 par 8 and pg24) – should also mention flood, etc. ESPO and CCNR also concerned about pg 27/2 compensation for supplementaty measures as this is not required under WFD. COMM will take concern into account but does not agree with the last statement as WFD does not prohibit supplementaty measures.

NO mentioned that the delineation of RBDs is currently being revised and thus pg 36 the text is not correct.

DE wishes that comments will only be made on the new changes in the document– support the paper as a good compromise.

Conclusion/action(s):

COMM took note of the comments made and will incorporate them into the document.

SCG agreed to present the revised document to the Water Directors in November after a round of comments by mail from SCG.

ITEM 8 WORKING GROUPS ACTIVITIES

a) WG A- Ecological Status

WGL (JRC) presented progress report of WGA which was circulated before the meeting and the plan for future mandate of the group.

The intercalibration timetable will also be discussed in the WFD Committee.

EEB also made a presentation on progress on Intercalibration based on a report which was made available as room document Discussion:

Several Member States (FR, ES, IT, DE, SE, AT) commented on the progress made in intercalibration and on importance to have results and are well aware that work has to continue after 2006.

FR is concerned that due to delay in reporting some of the results – the timetable is too short to adjust their national classification.

ES and IT wished to amend the overview table as phytobenthos and macroinvertebrates are not relevant for Mediterranean reservoirs.

AT questioned the validity of phytobenthos as a quality element for lakes and propose to ask ECOSTAT to discuss this issue.

EEB reminded the participants of the need for Member States to support this process for data to be collected and for IC to be completed and strongly support for all quality elements to be covered even for lakes. EEB also enquire on where the data on fish will be coming from and when it will be made available.

SE proposed to elaborate the timetable before presenting it to the Water Directors to reflect which MS have completed the work and which MS are still lacking data.

Conclusion/s:

SCG took note of progress.

Clarification is needed for the overview table for Mediterranean lakes. Further discussion on the Intercalibration timetable will take place in the WFD Committee meeting.

c) WG C - Groundwater and Chemical Monitoring Groups

COMM presented progress on activities of the WG C on groundwater and chemical monitoring.

Groundwater:

The guidance on groundwater in the Mediterranean area (GW5) will be submitted to the Euro-Mediterranean Water Directors during their conference to be held on 6-7 November 2006 in Athens.

The Guidance document on groundwater monitoring (GW1) will be presented to the Water Directors for endorsement in November and is presented for approval to this SCG.

The BRIDGE project has produced a draft Common methodology on threshold value, which will be further discussed before the end of the year (meeting planned in Paris on 15 December). The intention is to develop a paper for submission to the SCG in Spring 2007 and then to the Water Directors.

The Guidance document on Protected Areas (GW 2) is not completed and will be presented to the SCG in Spring 07.

The Guidance on Prevention/Limitation (GW3) needs also further work and in particular requires to wait for the adoption of the new Groundwater Directive to integrate elements of Article 6 on "prevention and limitation". The text is planned for submission to the SCG in Spring 07.

Chemical monitoring:

Two documents were prepared by the CMA (Chemical Monitoring Activity) expert group; Guidance on monitoring of SW/Coastal water which will be presented to SCG in Spring 07 in order to take on board elements issued from the Priority Substances Directive proposal (explaining the delay) and a QA/QC Decision which will be sent for internal consultation at the beginning of 2007. The next meeting of the activity will take place in Paris on 17 November 2006.

Discussion:

Several Member States made comments (FR, BE) and the Chair requested these to be communicated in writing to the WGL (PQ).

Conclusion/s:

SCG took note of the progress of the two activities and support for the guidance document on monitoring to be presented to Water Directors for endorsement.

c) Drafting group on Environmental Objectives

A draft document (ENV/SCG051006/2) was circulated before the meeting for comments. It is proposed for the document to be endorsed by Water Directors in November.

Discussion:

DK – pg 5, 2.2 ‘did not agree with the sentence’ changes between classes rather than within classes’ – propose to go back to wording in February version. COMM agreed to reword ‘In the context of art 4.7, rather deterioration between rather than within’ and to add an extra reference to the environmental objectives paper.

Several Member States are happy with the paper (UK, SE)

UK proposed to keep the annex which is the interpretation of COMM separate from the main document and not to be presented for endorsement to Water Directors, although it didn't disagree with the contents of the annex. COMM agreed to separate the document.

SE- pg 7, 2.6, 2nd par, 2nd sentence – proposed to delete this sentence ‘Even more, avoiding…’ as it is not clear how this joint procedure could be applied. COMM did not agree and maintained that ‘if possible’ offer sufficient flexibility and also mentioned that there are other possible examples of joint procedures for example on Habitat Directive.

NL – status box and disclaimer – confusion. COMM reassured NL that the status box will be deleted in the final version presented to Water Directors.

ES – pg 10,3.3 – proposed to add ‘ methodologies used to evaluate cost benefit should be consistent with method for disproportionate cost’. COMM proposed to wait before including this comment for next mandate.

Conclusion/s:

COMM took note of the comments made and will incorporate them into the document.

SCG agreed to present the revised document to the Water Directors in November without further discussion in next SCG.

ITEM 8 CIS WORK PROGRAMME 2007-2009

The Chair invited the SCG participants to send their comments in writing by 20 October 2006 and stressed that the main discussions will take place during the November SCG meeting.

a) Draft CIS Work Programme 2007-2009

Discussion:

ES proposed to mentioned water scarcity in the list of priorities and the need for a clear mandate for such activity.

NL wished to receive clarification on the status of this group

b) Draft mandate on Exemptions

Discussion:

AT enquired if disproportionate costs will be addressed under this activity? COMM confirmed that they will be.

FR mentioned the importance to have a unique document covering all exemptions and proposed to replace mid second paragraph practical examples ‘if’ by ‘how’.

COMM states the mandate is very ambitious and an active commitment of MS and stakeholders is needed to deliver results at the right time.

c) Draft mandate of the Working Group C on Groundwater

Discussion:

SE and NL commented on the need for the mandate of GW to be further developed, clarified and more detailed. On the Bridge project, NL stressed the need to interpret the results first.

d) Draft mandate of the Chemical Monitoring Activity

Discussion:

NL commented on the need for the mandate of CMA to be further developed, clarified and more detailed.

e) Draft mandate WFD and Hydromorphology

Discussion:

NL enquired where GEP will be discussed? ECOSTAT or HYMO? COMM clarified that the discussion will be taking place in the ECOSTAT group and results presented to HYMO.

f) Draft mandate WFD and Agriculture

Discussion:

HU – link to water scarcity should be mentioned in mandate. COMM agreed and stressed that more data is needed from Member States to know how they deal with this issue.

NL wished to see reflected the importance of rural development. COMM invited NL to make proposal on RD.

g) Proposal for a WFD Competent Authorities information exchange platform under CIS

SE presented to the SCG for information their proposal for an exchange platform of CA.

Discussion:

No comments

h) WG D

The mandate for this group will be discussed with FR at the meeting 17/18 October and will be presented at the next SCG.

Overall Conclusion/s:

The SCG took note to send their comments on this work programme and draft mandates in writing by 20 October 2006 and that the documents will be consolidated and presented for main discussions during the November SCG meeting.
