Fox Television Stations, Inc. ("Fox"), permittee of television station WDCA-DT,Washington, DC, File No. BMPCDT-200 I08 I6AAF, respectfully requests that the Commissionwaive the July 1,2006 "use-it-or-Iose-it" deadline for full-power DTV operation adopted by theCommission at paragraph 78 of the Second DTV Periodic Review Report and Order oftheCommission sRules and Policies Affecting the Conversion To Digital Television, MB Docket No.03-15, RM 9832, released September 7, 2004 (19 FCC Rcd 18,279), pursuant to the procedureset out in Public Notice DA 06-1255, released June 15,2005,
WDCA is one of Fox's 35 owned and operated stations, WDCA-DT has been operatingat low power from a tower owned by Gannett pursuant to Special Temporary Authority ("STA"),File No, BEDSTA-20020905ACF, since April 2002, providing the requisite coverage ofWashington, DC. By this letter, extensions ofWDCA-DT's STA and its Construction Permit alsoare requested,
Under ownership by the Paramount Stations Group of Washington, DC, prior to itsacquisition by Fox, WDCA-DT in 2000 proposed to locate its antenna at a new master antennacomplex to be constructed by American Tower at 40 I0 Chesapeake Street, NW, Washington, DC.Subsequently, in 200 Ithe District of Columbia government issued a stop-work order after only
300 feet of the new tower had been erected, Litigation between American Tower and the Districtof Columbia ensued. In light of the fact that this litigation would likely continue for a number ofyears, halting construction of the new tower beyond WDCA-DT's buildout deadline, WDCA-DTmoved to Garmett's tower, only about 100 feet away from the American Tower site. In order toutilize a combined antenna with WUSA-DT, WDCA-DT was forced to reduce power,
WDCA-DT initially hoped to be able to maximize its facilities on channel 20, its NTSCallotment, as this would provide coverage to the greatest number of persons in the Washington,DC DMA However, Fox was unable to reach an agreement with Shenandoah ValleyEducational Television Corporation, licensee of WVPY-DT, Channel 21, Front Royal, Virginia,Thus, on August 15,2005, WDCA-DT was forced to abandon its first round charmel election andinstead elected to operate post-transition on its allocated DTV channel, channel 35.

This change of plans created an interference issue with WTTG-DT, Channel 34, WDCADT's sister station. Aftcr engineering and structural analysis, Fox determined that the optimalsolution would be to collocate WDCA-DT and WTTG-DT on WTTG's tower at 5151 WisconsinAvenue, NW, Washington, DC. An application to modify WDCA-DT's Construction Permitaccordingly was filed on May 19,2006, File No. BMPCDT-20060519ACK. This has requiredstructural strengthening of the WTTG tower, as well as change out of equipment for WDCA-DTin order to utilize a combined antenna system with WTTG-DT. The work is ongoing at WTTGas of the instant date. WDCA-DT anticipates that it will be able to achieve approximately 80 %of its authorized power by July I, 2006 and will be at 100 % by August 1, 2006. Documentationof work ordered and expenses incurred to date is attached hereto. The cost figures are redacted,as this is proprietary information. A paper copy of this letter also is being filed with unredactedcopies of the documents. Fox respectfully requests that the cost figures in these documents bewithheld from public inspection pursuant to Sections 0.457(d) and 0.459 of the Commission'sRules, 47 CFR Sections 0.457(d) and 0.459, as this information is proprietary and not otherwiseavailable for public inspection.
In light of its financial commitment to WDCA-DT's full-power operation to date, Fox'sgood faith cannot be called into question. As additional evidence of Fox's good faith, theCommission merely need look to its overall in implementing DTV to date:
• Thirty-two of Fox's thirty-five owned and operated television stations currentlyare operating at full facilities;
• Of Fox's remaining three owned and operated stations, two are operating lowpower DTV facilities pursuant to STA; one of these, WGHP-DT, is awaiting grantof a Construction Permit modification application that will permit it to operate atmaximized facilities from a newly-constructed tower, and the other, KSTU-DT, ison the verge of completing its full-power buildout on a remote mountain siteoutside of Salt Lake City. Finally, KFTC, a full-power satellite station, will"flash cut" to DTV on its NTSC channel at the time of the DTV transition;
• All of Fox's DTV facilities implemented dynamic PSIP in a timely fashion;
• Fox has granted digital carriage rights to numerous multichannel video providersnationwide on behalf of all of its owned and operated stations and includes digitalcarriage provisions in all of its retransmission con sent agreements.

As the foregoing illustrates, Fox's commitment to DTV implementation cannot bequestioned, and the modest waiver of time sought for WDCA-DT's full-power operation shouldbe granted.

•Thank you for the opportunity ofquoting the installation your new Digital transmitter andassociated equipment. Attached is the terms and conditions that will apply for the installation. Itdefines both Fox's and Manion & Associates responsibilities.
The costs for these services is $85,000 for the WDCA Diamond transmitter and ChannelCombiner and the WTTG Analog Combining Equipment. All travel and local living expenses areincluded in this price. Terms will be 1/3 with Purchase Order, 2/3 net 30 days after theinstallation is complete.
