License Format Eight digits; the last digit is a check-digit which may be numeric or alpha “A.” The license number is identical to the Vermont personal Identification Number (PID). Vermont reports there is no code or sequential arrangement which determines the characters making the license number, other than numeric order from the computer.

New residents must obtain a license no later than 60 days after moving to Vermont. Non-resident's home-state license is honored on a reciprocal basis not to exceed thirty days. To obtain licenses and ID cards, Vermont requires proof of residency. See details at http://dmv.vermont.gov/licenses/identity-documents/vermont-residency.

Renewal Renewal is birth month and day of second or fourth year. Driver keeps

same number when renewing. Renewal is available by mail and in person. Online renewal is not available, but drivers may change their addresses at https://secure.vermont.gov/dmv/express. If stationed out-of-state, military personnel licenses are valid for 4 years after expiration and until 30 days after discharge. Elderly-Related Restrictions None indicated.

Vehicle Insurance, Title, and Registration Facts Registration Renewal

Renewal is annual and is available at any DMV location online or by telephone. The site also allows one to change an address. Go to https://secure.vermont.gov/dmv/express or call 866-259-5368. This service is available 24/7. The registration and sticker are mailed.

New Residents Non-residents must register vehicles at expiration of time period granted by home-state reciprocity agreement, not to exceed six months; or within six months of accepting employment.

Inspections and Emissions Testing All motor vehicles registered must be inspected once each year at state approved inspection stations. Any newly registered vehicle not currently inspected in this state must be inspected within 15 days from the date of registration. Light trailers (less than 1,500 pounds) are exempt. All 1996 and newer gasoline powered vehicles, and 1997 and newer

diesel powered vehicles having a gross vehicle rating of 8,500 pounds or less, must have an On-Board Diagnostics (OBDII) examination as part of their annual safety equipment inspection. The OBDII examination tests the emission control system of the vehicle.

Passenger Plate Facts There are two plates. Until July 1, 2009 two decals each with the MO & YR were issued, one decal per plate. Effective July 1, 2009 the state began to issue one decal only, which is placed on the rear plate. Counties are not designated by code nor are they spelled out on the plate. When a vehicle is sold the plates remain with the seller.

Insurance and Financial Responsibility Vermont has compulsory insurance. Minimum liability limits are $25,000/50,000/10,000. The state does not have a no-fault insurance provision law. Evidence of insurance is required after certain violations or an uninsured reportable accident and when the vehicle is inspected. SR-22 forms are used.

Withdrawal Sanctions, and Alcohol and Drug Testing Alcohol and Chemical Testing

Vermont's illegal intoxication level is .08 percent and above; however, content of .05 to .08 percent can be used with other evidence for a conviction. Drivers under 21 have a legal limit of .02 percent, drivers of CMVs have a limit of .04 percent. Blood and breath testing are authorized. Vermont has both an implied-consent violation and a provision for an administrative suspension.

Suspensions and Revocations The Vermont DMV is in compliance with the provisions of the Motor Carrier Safety Improvement Act (MCSIA). See the Appendix for more information about these mandatory CDL disqualification sanctions. Vermont law does not provide for a "hardship license" or a "work license." Below is an overview of significant withdrawals. Habitual Offender (8 or more convictions with 6 or more points or major violations within 5 years).....Two-year revocation. Impersonating Another on an Application or Aiding an Applicant by False Representation ..................Ninety-day suspension. Points Accumulation.........................................................................Ten or more points in two years will initiate suspension proceedings. Refusal to Submit to Breath or Blood Alcohol Test -- Civil Violation .................................................... Six-month to life suspension. Under the Influence of Alcohol or Drugs All Offenses, Blood Alcohol Content .08 Percent or More .................. ......................................................Ninety-day to life suspension.

• Vermont law requires that anyone suspended for an alcohol-related offense must complete an alcohol treatment program. • The DMV now issues Ignition Interlock Device Restricted Drivers Licenses (RDLs) to applicants who are suspended for DUI offenses.

Reinstatement Requirements Suspension $80.00 fee; plus requirements specific to the suspension. Revocation $80.00 fee; investigation (for DWI); plus requirements specific to the revocation.

Governing Statutes and Rules Title 23 is the primary reference for motor vehicle law in Vermont. See assembled list of just Vermont DMV Laws at: http://dmv.vermont.gov/enforcement-and-safety See all Vermont State Statutes at: http://legislature.vermont.gov/statutes/ Vermont implemented a Driver Privacy Protection Policy in accordance with Title 23-VSA Chapter 3. The state did not specifically mention the following DPPA exemptions in the state policy: (11), (12), and (13). Vermont added the following exception: Unrestricted or specified use

with written consent of the person who is the subject of the information. The VG118 Request Form mentioned below provides a list of the 12 permissible uses, pretty much verbatim per DPPA. The form states that for use by any licensed private investigative agency or licensed security service as per any purpose permitted, appropriate documents indentifying the requester must be presented. Appropriate document include copies of one’s identification documents verifying one is authorized to obtain this information. Release of personal information is restricted and only given to those demonstrating permissible use or signed release. Personal information

includes photo or computerized image, SSN, address other than 5 digit ZIP Code, telephone number, and medical or disability information.

Request and Consent Forms Ongoing requesters for driver and vehicle records must process a certain form depending on access mode. Ongoing requesters must also complete and submit a VG-118 - Agreement as to the Driver Privacy Protection Policy, State of Vermont, Department of Motor Vehicles and a subscriber agreement with the Vermont Information Consortium, through whom records are disseminated. There is also a VG-118a-DPPA form used for eligible companies purchasing data on a bulk basis. Occasional users with a permissible purpose must use form VG-116. This form requires the signature of the subject, regardless if the request is a permissible use per statute. All forms are found at http://dmv.vermont.gov/forms-and-information.

Vendor and Third Party Access Policy The restrictions upon the use, storage or resale of records after a

completed transaction coincide with the current disclosure and permissible user policies. Approved online vendors can access records for other vendors (who are not online, etc) who will then sell to an end use, providing the following—

1. If other vendor (reseller) is registered with the state 2. If contract between original vendor and reseller contains same

language as contract between the state and the original vendor 3. If contract between reseller and end-user contains same language as

contract between the state and the original vendor. 4. Records of all sales and purposes of the sales must be kept by the

original vendor for five years

Records Ordered For Non-permissible Uses Non-permissible use requesters must provide written authorization (by subject) using Form VG116. A notary is not needed. If no consent and/or for a non-permissible use, records without personal information are released.

Access to Driver-Related RecordsDriving Records

General Information and Fees Driver Improvement Information, 120 State Street, Montpelier VT 05603, 802-828-2050, fax is 802-828-2098. The fee for a certified three-year driving record accessed by mail or walk-in is $14.00.The fee for a complete (all years) certified record is $ $20.00. The fee for an electronic three-year record is $18.00. Fee increases are mandated by the legislature. The agency charges a full fee for processing a “no record found” report. In-Person – The only location in the state for walk-in or (mail-in) record requests is the address listed above. Requests made over-the-counter are processed while you wait. Mail – Requests mailed to the state are processed within approximately six days of receipt. The driver's full name and date of birth are needed when ordering; the license number may be helpful, but is not required. The fee must accompany each request. Electronic – Access is available to approved subscribers, but not the general public. Users must complete and submit VG118 discussed above and have a subscriber agreement with Vermont Information Consortium, through whom records are disseminated. A $75.00 annual subscription fee is also required. The fee is $18.00 per record, there is a full charge for a no hit. The system offers both immediate response single inquiry and a batch mode delivery for higher volume users. Records are available 24/7 except for periods of file maintenance. Only the driver's license number is needed when ordering; the system does not accept the driver name or date of birth. Bulk – The state will sell data from the license file to approved requesters, but cannot program or customize requests. Social Security Numbers are not released. Form VG-118a must be submitted (found at web site). Fees are indicated at http://dmv.vermont.gov/fees/misc. Call Information Management. By Person of Record – VT drivers may obtain their driving record by mail or walk-in as described above. At present, there is no online method for drivers to view or order their own record. It is suggested to use the Record Request Form VG116 found at http://dmv.vermont.gov/forms.

Notification/Monitoring Program At present, Vermont does not offer a mechanism for employers or insurance companies to monitor or track drivers and be notified if there is active on a driver’s record or license.

Crash Reports Reporting – Crashes involving death, injury, or property damage in excess of $3,000.00 must be reported within seventy-two hours to the DMV, Agency of Transportation, 120 State Street, Montpelier VT 05603. Use Crash Report Form VA004 to file a report of a crash. The form is found at http://dmv.vermont.gov/forms/all. There are no other special state reporting criteria for commercial drivers. Record Access – Copies of crash reports may only be obtained from at the 120 State Street location. The fee for a police report is $15.00, for an individual's crash report is $12 and is certified, for insurance information of an accident is $8.00. Use record request Form VG16 (find at http://dmv.vermont.gov/forms/all). The SSNs and individual's addresses are protected and are not released. Fax requests can be sent to 802-828-3577.Records are available for 4 years to present. Normal turnaround time is up to 15 days. If there is criminal action involved (DWI, fatality) it may take as long as three months after the crash to get a copy of the report.

Driving Record Content and Reciprocity What’s On or Not On the Driving Record

• For computer-printed driving records or records obtained online, the address of the driver does not appear.

• SSNs do not appear on the record. • All convictions are reported on the driving record. • Crashes which result in injury, death, or total damage of $3,000 or

more are reportable, but fault is not shown on the record. • The state does not permit driver school attendance in lieu of

conviction. • CDL drivers have convictions listed for life. The length of time

convictions stay listed for non-CDL driver depends whether a three-

year record or complete record is purchased.

CDL Medical Cert Data Medical Cert Information on CDL drivers is provided on both the manually processed and electronic version of the CDL driving record.

Data Retention CDL driver records are purged based on the timetable per the MCSIA (see the Appendix). Surrendered licenses (non-CDL) fall into the same purging criteria as listed above.

Court to Repository Conviction information is keyed in from paper abstracts manually transmitted from the courts to the state. There is no law mandating when convictions must be submitted. State files are updated daily, and most convictions are entered within one week. Adjudications are transmitted electronically from the “VT Judicial Bureau” to the DMV.

State Reciprocity for Non-CDL Drivers • Will suspend license of driver for unpaid out-of-state convictions.

• Record of new incoming driver is shown on MVR but only for majors.

• Out-of-state convictions are shown on MVR, but only for majors. • Out-of-state accidents are not shown on MVR. • Convictions of out-of-state drivers are sent to home state only if

criminal conviction with a notice of suspension. • Record is forwarded to new state upon surrender of license.

Access to Vehicle-Related Records General Information and Fees Department of Motor Vehicles, Registration-License Information, 120 State Street, Montpelier VT 05603-0001, 802-828-2000. The DMV maintains records on vehicles, motor homes, trailers, and boats. Lien record information is provided for all of these conveyances. The fee for listings of up to four current or expired registrations is $6.00. A certified copy of an original registration application is $6.00. A certified copy of a title is $6.00. A certified copy of a vehicle title search, and title info, and lien info is $20.00. A certified copy of a vessel, snowmobile or ATV title search is $13.00. Vehicle and vessel records are available for fifteen years to present. Potential lien-holders are provided a “yes or no” answer when asking about liens on a vehicle. If specific details (such as current lien-holder, etc.) are requested, a VG116 Form is required along with a title search

fee. Statistical research is provided at $35.00 per hour. At a minimum, a VIN or registration plate number must be provided by the requester. In-Person or Mail – Across-the-counter printed records are available in 30-60 minutes. Also, there is a public access terminal available in Montpelier. Turnaround time for mail requests is 7-10 days. Electronic – Vermont does not offer online inquiry access at this time. Bulk – Vermont offers bulk retrieval of vehicle or ownership records by contract per DPPA. Apply to the Office of the Director of Operations of Motor Vehicles, at 802-828-2066. Fees are indicated at http://dmv.vermont.gov/fees/misc.

Access to Vessel-Related Records General Information, Access and Fees Since July 1, 2007, Vermont titles all vessels that are 15 years old or newer, based on calendar year, with a length of 16 feet or longer (including shuttlecraft). Exceptions include any vessel which is a canoe, kayak, or similar watercraft designed to be manually propelled or such a vessel equipped with a motor of 10 horsepower or less. Previously, all boats that operate with an attached motor had to be registered. One may

operate in Vermont for a period of 90 consecutive days if the home state grants like privileges to Vermont boats or if the boat has a federally issued number. However, if the vessel is used in Vermont waters for 30 days or more one must obtain a vessel validation sticker. The agency above is the resource for records. A title search with lien information is $13.00; a registration check is $6.00. Use of the above mentioned VG116 Form is required.

License Classes, Restrictions, Endorsements, and Status License Classes– Commercial

Conviction Table with Code, Statute, ACD, and Points This table is presented in order of the Code column, the first part shows Codes that begin with a letter, followed by codes that begin with a number.

• In general, all codes starting with an “8” signify a snowmobile violation and codes starting with a “9” signify a motorboat violation. • The DMV indicated out-of-state convictions may appear as an ACD Code.
