GUARANTEE Clause 1 Subject to the conditions and limitations set out below and only in as far as all the instructions of the Users' guide and the glazing industry's code of practice, mentioned in clause 2 hereafter, have been applied, SURFACE SPECIALTIES guarantees that its UVEKOL TM products satisfy the functional requirements of producers of laminated acoustic and safety glass, known to SURFACE SPECIALTIES at the date of invoicing, and that these products will provide and preserve the acoustic and safety characteristics for which they were designed for a period of 5 (five) years if the laminated glazing is used in Germany and 10 (ten) years in all other cases, from each individual invoice date. This guarantee shall apply exclusively to conventional laminated glass. By way of example, the following shall not be regarded as conventional laminated glass: textured glass; coated glass in case the coating is in direct contact with the resin; laminated glass in which the thickness of the glass exceeds 12 mm on both sides; laminated glass in which at least one of the sheets is a synthetic polymer (organic glass). UVEKOL TM resins have a shelf-life of nine (9) months from the date of manufacture. This date is indicated on containers by the first three digits. For example, batch no. 30100251 3 = the year 2003 01 = the month of January 002 = batch number 51 = indication of production site In exceptional specific cases SURFACE SPECIALTIES can extend the guarantee under certain conditions. Such an extension of the guarantee must always be confirmed in writing. The guarantee shall not be valid if the UVEKOL TM resins are used beyond their expiration date. Clause 2 The guarantee shall only be valid provided that the products mentioned above and supplied by the vendor are used: in accordance with the instructions contained in the user guide issued by SURFACE SPECIALTIES; in accordance with the glazing industry's code of practice in force at the time when the invoice is issued. The term "code of practice" is understood to refer to the guidelines relating to glass installation issued by the national institutions of the countries where UVEKOL TM is used, e.g. Institut für Fenstertechnik (Rosenheim, Germany) or Institut National du Logement (Belgium). In the event that no such guidelines exist in the countries where UVEKOL TM is used, those issued in Belgium by the National Housing Institute, will apply. Clause 3 No claim from the producer of the laminated glazing shall be considered by SURFACE SPECIALTIES unless the producer has received a written claim from the end-user under the terms of this present guarantee. Any such claim must be made before the defective glazing has been handled following discovery of the defect, in order to allow the producer of the laminated glazing and SURFACE SPECIALTIES to carry out an expert assessment of the method of installation used and more specifically to verify that the installation has been carried out in accordance with the code of practice and the instructions from SURFACE SPECIALTIES' User's Guide. Clause 4 In the event of it being demonstrated that the defect is attributable to SURFACE SPECIALTIES’ UVEKOL product non- conforming to the requirements and/or characteristics set out in clause 1 hereof and provided that the claim is submitted within 5 (five) respectively 10 (ten) years as defined in Clause 1 of the present guarantee and subject to all other conditions as set out above, SURFACE SPECIALTIES will be responsible for the replacement of the laminated glazing acknowledged as having been defective, and with a guarantee covering the remaining period of the initial guarantee. SURFACE SPECIALTIES will also meet the costs incurred for dismantling, assembling and the installation of the laminated glazing, with the exclusion of all other costs. This guarantee shall be interpreted in accordance with the laws of Belgium. Any disputes arising out of or in conncection with this guarantee, if not amicably settled, shall be submitted to the Courts of Brussels.
