UTAH MASTER AGREEMENT by and between

SIGNATORY EMPLOYERSand

OPERATING ENGINEERS LOCAL UNION NO. 3 OF THE INTERNATIONAL UNION OF THE OPERATING ENGINEERS, AFL-CIO

THIS AGREEMENT is entered into this 1st day ofJuly,2014,byandbetween,hereinafterreferredtoasthe“Employer,” and the OPERATING ENGINEERS LOCAL UNION NO. 3 of the International Union of OperatingEngineers,AFL-CIO,havingjurisdictionovertheStateofUtah,hereinafterreferredtoasthe“Union.”

WITNESSETH

WHEREAS, the Employer is engaged in general constructionworkintheStateofUtah;and

WHEREAS,theEmployeremploysmembersoftheUnion;and

WHEREAS, when the Employer desires to procureEmployeeswithsufficientskilltoinsurecontinuityofwork,andtheUnionagreestofurnishEmployeesfortheperformanceofsuchwork;and

WHEREAS, it is to the advantage of boththe Employer and the Union that the stability of wagerates, working conditions, and hours of employment beestablishedthroughoutthesaidarea;and

WHEREAS,itisthedesireofthepartiesheretoto establish effective methods for the settlement ofmisunderstandings, disputes, or grievances between the partieshereto to theend that theEmployer is assuredofcontinuity of operations and the Employees are assuredof continuity of employment and industrial peace ismaintained, and the business of industrial efficiencyincreases;

NOW, THEREFORE, in consideration of themutual desires mentioned above, and the agreements herein contained, it is hereby agreed that the work ofheavy-highway engineering and building construction in theStateofUtahshallbeperformedunderthefollowingconditions:

The Union agrees that its members shall individually and collectively perform loyal and efficient work in service,that they should use their influence and best efforts toprotectthepropertyoftheEmployeranditsservicesatalltimes. The Union agrees that there will be no solicitations inamannerthatwillcausedisruptionofnormaloperations.

ARTICLE I MANAGEMENT RIGHTS

Except as specifically modified, delegated or granted inthis Agreement, the Employer retains the exclusive right tomanagethebusinessoftheEmployerandthedirectionof the working force. Among those exclusive rights ofthe Employer, but not limited thereto, is management’s

right to operate and manage or close down the operation or any portion thereof; to direct the working force; tohire, schedule, promote, transfer, lay off and dischargeEmployees; to maintain efficiency of Employees; toestablish and enforce work regulations and rules ofconductofEmployees; todetermine the typeof servicestobeperformed.Suchmattersaretheresponsibilitiesandprerogative of the Employer, along with all other rightsthat have traditionally belonged to the Employer, except as specificallylimited,modifiedordelegatedbythetermsofthis Agreement.

ARTICLE IIEMPLOYMENT

SECTION 1 Hiring. All hiring shall be subject to and in accordance with the Job Placement Regulations, AddendumBofthisAgreement.

SECTION 2 This Agreement shall not apply to superintendents, executives, licensed engineers, professional Employees, assistant superintendents,mechanicalsuperintendents,generalforemen,timekeepers,guards,confidentialEmployeesandofficehelp.

SECTION 3 Owner-Operator. Whenever Owner-Operator is used in this Article, it means Operating Engineer Equipment Owner-Employee only, and does not apply to a Heavy Duty Repairman (Welder) or a Lubrication and Service Engineer or equipment (generators, welding machines,fixeddrills,lathes,pickuptrucks,greasetrucks,

lubetrucksortrucksandtrailers)usedbythemoreitherofthemandnecessaryoradvisablefortheperformanceofanyworkofaHeavyDutyRepairman(Welder)orLubricationand Service Engineer.

SECTION 4 The Owner-Operator shall be carried onthepayrollof theEmployerfromthefirsthourof thefirst day of employment as an Operating Engineer, anEmployee, and as such Employee, all of the terms andconditions of this Agreement, and any amendment oramendments thereto, shall be applicable to him. The Union shallbenotifiedofthename,addressandSocialSecurityNumber of the Owner-Operator within twenty-four (24)hoursaftertheOwner-Operatorishired.

SECTION 5 Legal or equitable title to the equipment mustbeinthenameoftheOwner-Operator.

ARTICLE IIICOVERAGE

SECTION 1 This Agreement shall apply to and cover theEmployeesoftheEmployeremployedintheStateofUtahintheperformanceofallconstructionwork.

SECTION 2 The intent of the parties to thisAgree-ment is to limit the applicability and coverage of thisAgreement to those Employees employed by the Signatory Employer notwithstanding any other commonly owned en-tity.

SECTION 3 The work covered by this Agreement is generally known as “Heavy Engineering, Field Construction and Building Construction,” which includes, but is not limited to, the construction, maintenance, repair, rehabilitation and demolition of railroads, highways,canals, airports, bridges, irrigation work, reservoirs, dams, pipelines, oil refineries,waterlines andmains, aqueductsandbuildingconstructionofalltypes;andtheworkcoveredbythisAgreementshallbeinterpretedasfieldconstructionwork. This Agreement does not apply to warranty work performeduponequipmentpurchased froma recognizeddealer,nordoes it limit the rightof theEmployer tousethefieldservicesofapermanentlyestablishedcommercialshop in emergencies.

ARTICLE IV APPLICATION TO SUBCONTRACTORS

SECTION 1 The purpose and intent of this Sectionis to preserve and protect employment opportunities and terms and conditions of employment of all Employeescovered by this Agreement to the maximum extent permitted by law.

SECTION 2 No on-site work covered by this Agreement,whichhistoricallyhasbeenperformedbytheEmployer,orbytheindustryiftheEmployerhasnosuchhistory,onthesiteofajoborprojectshallbeperformedoffthesiteofajoborproject,withtheexceptionofpre-castandpre-manufacturedmaterials.

SECTION 3 Definition of Subcontractor. A Subcon-tractor isdefinedasanyperson(other thananEmployeecoveredbythisAgreementoranOwner-Operator),firmorcorporationwho agrees orally, or inwriting, to perform,orwhoinfactperformsfor,oronbehalfof,theEmployer,anypartorportionoftheworkcoveredbythisAgreement.

SECTION 4 On-Site Work. With respect to on-site work covered by this Agreement, that is, work done or to bedoneatthesiteoftheconstruction,alteration,paintingorrepairofabuilding,structureorotherwork:

A.ThetermsandconditionsoftheAgreement(subjecttoBandCbelow)insofarasitaffectstheEmployeronon-siteworkshallapplyequallytoanySubcontractorofanytierunderthecontrolof,orworkingunderoralorwrittencontract with such Employer on any on-site work covered by this Agreement, and said Subcontractor with respect to such on-site work shall be considered the same as an Em-ployer covered hereby.

B.That ifanEmployershallsubcontracton-siteworkashereindefined,suchsubcontractshallstateinwritingthatsuch Subcontractor agrees to comply with the terms and provisions of thisAgreement (including allAddenda at-tached) in the performance of his subcontract; provided,however,

C.IfanEmployerisactuallyemployingEmployees,orhasemployed Employees, covered by this Agreement at a par-ticular jobsite, such subcontract shall state in writing that

such Subcontractor agrees to comply with and be bound byallthetermsandprovisionsofthisAgreementwithnoexclusions.

SECTION 5 Regardless of anything in this Agree-ment to the contrary, no on-site work covered by this AgreementofaHeavyDutyRepairmanoraLubricationor Service Engineer or an Employee who operates or main-tains thefollowingequipmentgeneratorsorweldingma-chinesorusesintheperformanceofhisworkfixeddrills,lathes, pickup trucks, grease trucks, lube trucks and trailers oranyorallofthemwillbesubcontractedtoanypersonorindividualifsuchpersonorindividualperformsanysuchwork.

SECTION 6 The Employer will provide the Union witha listofsubcontractorswhowillperformunitworkunderthisAgreementassetforthinArticleIII.Noticeatapre-jobconferencewillsatisfy therequirementsof thisSection. Furthermore, the Employer will give written no-ticeprior to thecommencementofworkby theSubcon-tractorofanysuchsubcontractenteredintosubsequenttoapre-jobconferencewithaSubcontractorwhowillperformunitworkunderthisAgreementassetforthinArticleIII.Any Employer who has given such notice and requires the Subcontractor to agree to comply with and observe the pro-visionsofArticleIVhereofwithrespecttothejobsiteworkshallnotbeliableforanydelinquencybysuchSubcontrac-torinthepaymentofanywages,fringebenefitsorcontri-butionsprovidedherein,exceptasprovidedhereafter.

SECTION 7 In the event the Union questions compli-ancebyaSubcontractorwiththeprovisionsofthisSection,theUnionshallsonotifytheEmployerandtheSubcontrac-tor inwriting, and theSubcontractor shall furnish to theUnionwithinfifteen(15)days,awritten itemizedrecordof all pertinent information. Additionally, where item-izedpayrollrecordsarerequiredforsubmissiontopubliccontractingagenciesonbehalfofsubcontractors,thesub-contractorsshallfurnishcopiesofsuchsubmissiontotheUnionuponwrittenrequest.If theSubcontractorrefuses,the Employer shall cause the Subcontractor to supply the information.TheprovisionsofthisSectionshallnotbeap-plicable if theSubcontractor isanEmployersignatorytothis Agreement.

SECTION 8 IfanySubcontractorshallbecomedelin-quentinthepaymentormeetingoftheobligationssetforthabove,theUnionshallpromptlygivewrittennoticethereofto theEmployerandSubcontractor specifying thenatureandamountofsuchdelinquency. Ifsuchnotice isgiven,the Employer shall withhold the amount claimed to be de-linquentoutofanysumsdueandowingbytheEmployertosuchSubcontractorandshallpayandsatisfytherefromtheamountofsuchdelinquencybysuchSubcontractor.

SECTION 9 TheEmployershallnotbeliableforanysuch delinquency occurring more than sixty (60) days prior tothereceiptofsuchwrittennoticefromtheUnion.

SECTION 10 Unless a Subcontractor is an Employer signatory to this Agreement, this Agreement shall not cov-eranyotherjobsorprojectsoftheSubcontractor,andtheapplicationofthisAgreementtotheSubcontractorpursu-ant to these provisions shall terminate contemporaneously withtheterminationofsuchsubcontractwiththeEmploy-er.

SECTION 11 TheUnionandtheEmployerrecognizethe importance of keeping Employees of the Employerworking. The Union shall periodically furnish the Em-ployerwithalistofcurrentsignatorySubcontractors.Ona weekly basis, such Subcontractors may contact the Em-ployer andobtain a current bid schedule reflectingworkbeing bid by the Employer. It is understood that in those instances when the Employer is unable to obtain com-petitive, signatory sub-bids necessary to secure work as a prime Contractor, the Union shall waive the Employer’s subcontractingrequirements,ascontainedinSection4ofthisArticle,forthoseparticularsubcontracts.

ARTICLE V BARGAINING RECOGNITION

SECTION 1 ForthetermofthisAgreement,theEm-ployervoluntarilyrecognizestheUnionsignatoryheretoasthe sole and exclusive collective bargaining representative forallEmployeesperformingworkfortheEmployerfall-ingwithinthejurisdictionoftheUnionsignatoryheretoonallcurrentandfutureprojectsthroughoutthetermofthisAgreement.

ARTICLE VISERVICING OTHER CRAFTS

SECTION 1 Employees on a particular project and assignedtoworkwithacraftorcraftstemporarilyshallnotbeentitled toanyof theconditionsof thecraftorcrafts.“Temporarily” shall be interpreted as meaning any work performedinasingledayoffour(4)hoursorless.

SECTION 2 When Employees covered by this Agree-mentareemployedonajoborprojectwhereanothercraftorcraftsworkashorterdayorshorterweek,suchEmploy-ees affected shall be afforded the opportunity to earn anamountequal toafullshift, fulldayorfullweek,as thecase may be, at the applicable straight-time wage rate.

SECTION 3 WhenEmployeesperformworkcoveredbythisAgreementinconjunctionwithanothercraftthatre-ceivesovertimeforanytimeworked,orbetween8:00a.m.and 4:30 p.m., on any day worked, such Employee shall be compensated on the same basis and the same overtime rate ofpay.

ARTICLE VII SUBSISTENCE AND TRAVEL, RENTED EQUIPMENT

SECTION 1 On any job, location or project located morethanfifty(50)milesfromthepermanentyardoftheEmployer, Operating Engineers employed by the Employ-er who are regularly engaged in the business of renting

cranes, truck cranes, hoisting equipment, gradalls, truck-mounted pavement breakers, or truck mounted earth au-gers,onafullyoperatedbasis,shallreceiveinadditiontotheirregularandovertimewagesadailysubsistenceasfol-lows:

SECTION 2 No subsistence shall be paid on any job when the Employee’s time starts and ends at the Employ-er’s permanent yard without any break in compensable hoursexceptformealperiods.

SECTION 3 On jobs on which an Employee does not receivesubsistence,theunderstandingoftheundersignedpartiesisasfollows:AnEmployeeshallnotreceivetraveltimeortravelexpenseexceptunderSection5ofthisAr-ticle.

SECTION 4 Travel Expense. Where the Employee is transported on the Employer’s equipment, travel expense shall not be due.

SECTION 5 Travel expense will be paid when mov-ingcranesfromyardtojob,jobtoyardandjobtojobwhencrane is not returned to its original starting point that day at theendoftheday,andwhentheEmployeereceivestraveltimeunderSection7ofthisArticle.

SECTION 6 Travel expense, when due an Employee furnishinghisowntransportation,shallbepaidattherateofthirtycents($.30)permile,andtheEmployershallalso

paybridge, ferryor toll fares involved;provided thatnoEmployeeshallberequiredtofurnishthemeansoftrans-portationasaconditionofemployment.

SECTION 7 Travel Time. On any day on which an Employee is required to report to the yard, the Employee’s time will start at the yard. On any day on which the Employer requires an Employee to return to the yard and when, absent a pre-arrangement to cover transportation under Section 7, an Employee is required to report to the yard on that date, an Employee’s time will end at the yard.

ARTICLE VIII NON-DISCRIMINATORY OPERATION

AND APPEALS PROCEDURE

SECTION 1 The Union will conduct such Job Place-ment Centers and operate such Job Placement Centers withoutdiscriminationeitherinfavororagainstEmploy-eesorapplicantsforemploymentoranyof thembyrea-sonofrace,color,creed,sex,age,religion,nationalorigin,handicap, veteran status, membership or non-membership inanyUnion,orbyreasonofactingonbehalfoforinop-positiontoanyUnion.TheprovisionsofthisSectionshallgovernoveranyconflictingprovisionsor requirementofthe Union’s Constitution, By-Laws, working rules or other rulesoftheUnionandselectionofEmployeesandappli-cants for employment for dispatch to jobs shall be on anon-discriminatory basis and shall not be based on or in anyway affected byUnionmembership, by-laws, rules,

regulations, constitutional provisions or any other aspect or obligationofUnionmembership,policiesorrequirements.

SECTION 2 The Employer shall not discriminate ei-ther in favororagainstEmployeesorapplicants forem-ploymentoranyof thembyreasonof race,color,creed,sex, age, religion, national origin, handicap, veteran status, membership or non-membership in any Union, or by rea-sonofactingonbehalfoforinoppositiontoanyUnion.

SECTION 3 AnyEmployeeorapplicantforemploy-ment aggrieved by the operation of such Job PlacementCenteroftheUnionortheseregulationsasappliedtohimshallhavetherighttosubmithisgrievancetotheBoardofAdjustmentcreatedbyArticleXIIofthisAgreementbyfil-ing the grievance with the Job Placement Center, provided that such submission is made in writing within ten (10) daysaftertheoccurrenceofthegrievance.TheBoardshallhave full power to adjust thegrievance, and its decisionthereonshallbefinalandbindingupontheEmployeesorapplicantforemploymentanduponallotherpartieshereto.Formsforsubmissionofsuchgrievancesshallbeavailableat all times in each Job Placement Center.

SECTION 4 The Union will take affirmative actioninorder to implement theFederalGovernmentpolicyofequal employmentopportunityand follow theguidelinessetforthinExecutiveOrderNo.11246,andwillestablishasourceofrecruitmentforjobapplicantsbycontactingrec-ognizedrepresentativesofminoritygroupsinthisStateinordertoobtainapplicantsfromsuchgroups.

SECTION 5 Itistheintentofthepartiesheretotoob-serve all laws, rulings or regulations relating to the Ameri-cansWithDisabilitiesActof1990(ADA)andtheFamilyandMedicalLeaveActof1993(FMLA).

ARTICLE IXJURISDICTIONAL DISPUTES

SECTION 1 DuringthetermofthisAgreement,thereshallbenostrikes,slowdown,orstoppageofwork,occa-sioned by jurisdictional disputes between the Union signa-toryheretoandanyotherUnionaffiliatedwiththeBuild-ing Trades Department.

SECTION 2 The Employees covered by this Agree-ment shall perform the work customarily performed bythem andwill cooperate andworkwithmembers of theorganizationsaffiliatedwiththeBuildingandConstructionTradesDepartmentoftheAFL-CIOwithoutregardtopast,presentorfuturedisputes,onjurisdictionalclaims.Wherea jurisdictional dispute involves the Union and another UnionaffiliatedwiththeBuildingandConstructionTradesDepartment, AFL-CIO, which cannot be settled at the local level,itshallbereferredtotheInternationalPresidentsofthetwoUnionsfordetermination,andtheworkshallpro-ceed as assigned by the Employer until such determination by the International Presidents has been determined and decided by the two International Presidents.

SECTION 3 The Employer shall assign work on the basisoftraditionalcraftjurisdictionallines.Allquestions,complaintsordisputesdealingwithcraftjurisdictionshallbe referred to thebusiness representativesof theUnionsinvolved in the jurisdictional dispute and the Employer’s authorizedrepresentative,whoshallmeetatalocationoffthejobsiteacceptabletoallparties. Ifnoagreementcanbe reachedbetween the local business representatives oftherespectiveUnions,thedisputeshallbereferredtotheInternationalUnionsinvolvedforreviewandappropriatedisposition.

ARTICLE X COMPOSITE CREWS

TheEmployershallassignworkonthebasisoftraditionalwork jurisdictional lines. It is, however, recognized thaton some jobs effective production will require the useof composite crews. When such circumstances exist,the Employer shall, at a pre-job conference or prior tocommencementofwork,discusstheworkinvolvedandthemake-upofthecrewsonthebasisoftheamountofworkinvolvedforeachUnion.Intheperformanceofsuchwork,allEmployeeswillperformtheworktheyareassigned.

ARTICLE XI UNIVERSAL WORKING RULES

ThefollowingworkingrulesshallgoverntheemploymentofEmployeesemployedbyEmployers in theHeavyandHighwayConstructionworkasdefinedherein:

SECTION 1 Hours of Work. On single shift opera-tions,eight(8)orten(10)hoursofwork(exclusiveofmealperiod), shall constitute a day’s work. The regular starting timeof the single shift shall be established andmust beworkedaminimumoffive(5)consecutiveshifts,providedhowever, start times may be adjusted during the workweek to meet maintenance requirements on all projects. Start times may also be adjusted during the workweek to meet UDOT and Federal Transportation Project requirements.

SECTION 2 Workweek.Five(5)consecutivedaysofeight(8)hoursofworkorfour(4)consecutivedaysoften(10)hoursofworkeach(exclusiveofmealperiod),Mon-day through Friday, shall constitute a week’s work, except asprovidedforshiftwork

SECTION 3 Rolling Four (4) by Eleven (11) Work-week. To the extent permitted by law, the Employer may utilizearollingfour(4)byeleven(11)shiftoperation.Un-der this operation, the day shiftwork force is organizedintotwo(2)teams.The“A”teamworksfour(4)consecu-tiveeleven(11)hourdays.Onthefifth(5th)day,the“B”teamcontinuestheworkactivitiesforfour(4)consecutiveeleven (11) hour days. On the ninth (9th) day, the “A” team returns to work to continue the construction activities. The four(4)dayalternating“A”and“B” teamoperationcancontinue on a year-round basis. The same pattern applies forasecond(2nd)shift.Iftwo(2)shiftsareestablished,they shall be consecutive. Eleven (11) consecutive hours

(exclusiveofmeal period) shall constitute a day’swork.Theworkday for eachEmployee shall be defined as thetwenty-four(24)hourperiodwhichbeginswiththeregu-larstartingtimeoftheEmployee’sshiftandendswiththeregularstartingtimeoftheEmployee’sshiftthefollowingday.

In this shift arrangement, the day shift shall be workedbetweenthehoursof5:00a.m.and6:00p.m.,asdescribedabove.AllholidaysasoutlinedinSection6ofthisArticle,ifworkedunderthisSection,willbepaidattheapplicableovertimerate.Notwithstandingtheforegoing,arollingfour(4) by eleven (11) workweek shall only be allowed when Employees are engaged in rock crushing, snow removal and mine work. Other work may be performed underthis shift arrangement bymutual agreement between theEmployer and the Union. On a Rolling Four (4) by Eleven (11) shift operation there shall be two (2) pay periodsestablished each week to ensure the Employees working underthisshiftarrangementarepaidforeachfour(4)dayscheduledshiftcycleregardlessiftheshiftcyclestartsinone (1) week or pay period and extends into the second (2nd)weekorpayperiod.TheintentofthissectionistoensurethattheEmployeehastheabilitytoreceivepayforallhoursworkednolaterthan7daysfromthecompletionofeachscheduledfour(4)dayshiftcycle.

SECTION 4 Saturday Make-Up Day. To the ex-tent permittedby law,Saturdayworkmaybeperformed

at straight-time rates in theeventof time lostduring theworkweekduetooneormoreofthefollowingconditions:(1) inclementweather; (2)majormechanicalbreakdown;or, (3) other conditions, except holidays, which are beyond the control of the Employer, provided the total straight-time hours worked by any Employee in any one (1) week includingSaturdaymake-upwork,shallnotexceedforty(40) hours. Employees will be given thirty-six (36) hours noticeofaSaturdaymake-upshift tobeworked, ifsuchnotice is not given, Saturday make-up work shall be per-formedonavoluntarybasisonly,andnoEmployeeshallbe discharged or otherwise disciplined for his refusal toperformsuchwork.

SECTION 5 Shifts.

A. WhensoelectedbytheEmployer,multipleshiftsmaybeworkedforfive(5)ormoreconsecutivedays.

B. Whentwo(2)shiftsareemployedforfive(5)ormoreconsecutivedays,eight(8)consecutivehoursofwork(exclusiveofmealperiod)shallconstituteaday’sworkforthefirst(1st)and/orsecond(2nd)shifts.Onatwo(2)shiftoperation,thefirstshiftshallhavearegularstartingtimenot earlier than 5:00 a.m. and not later than 8:00 a.m.

C. Whenthree(3)shiftsareemployedforfive(5)ormoreconsecutivedays,thefirst(1st)shiftofthedayshallwork eight (8) consecutive hours (exclusive ofmeal pe-riod);second(2nd)shiftshallbesevenandone-half(71/2)

consecutive hours (exclusive ofmeal period); third (3rd) shift shall be seven (7) consecutive hours (exclusive ofmealperiod)forwhichEmployeesoneachshiftshallre-ceivetheequivalentofeight(8)hours’payatthestraight-timerates(MondaythroughFriday).Onthree(3)-shiftop-erations,thefirst(1st)shiftofthedayandoftheworkweekshall start at 8:00 a.m. Monday, and such workweek shall endwiththeclosingofthethird(3rd)orgraveyardshiftat8:00a.m.,Saturday.Allworkperformedbetweenthehoursof8:00a.m.Saturdayand8:00a.m.Mondayshallbecom-pensatedforattheapplicableovertimerate.

D. It is agreed that the Employer and the Union may mutuallyagreeinwritingupondifferentstartingorquittingtimesforanyoftheabove-mentionedshiftarrangements.

E. On “multiple-shift operations” a special singleshiftmaybeestablishedtomeetUDOTandFederalTrans-portation Project requirements but shall in no way exclude an employee from the ability to work a forty (40) hourworkweek.NoarrangementofshiftsshallbepermittedthatpreventsanyEmployeefromsecuringeight(8)consecutivehours of rest in any consecutive twenty-four (24) hours.Such twenty-four (24)hoursshallbecomputed from thestartoftheEmployee’sassignedshift.Therestperiodmaybe reduced to four (4)hourswhenspecialcircumstancesariseoutoftheEmployer’scontractualobligationswithitscustomersand/orotheroperationalnecessity.

F. Shift assignments shall be rotated at least everytwo(2)weeksifamajorityoftheEmployeesonallshiftsso elect.

G. On single and two (2)-shift work, Saturdayshall be the twenty-four (24) hour period commencingat 12:00midnightFriday.On a three (3)-shift operation,Saturday shall run from8:00 a.m.Saturday to8:00 a.m.Sunday.

H. Overtime.ExcludingSection3ofthisArticle,allworkperformedonSunday,exceptwhenstartinganightshiftonanewworkweek,onorafter8:00pm(excludingcommercialplants)oroverforty(40)hoursinaregularlyestablishedworkweek, or after ten (10) hours in a regu-larly established work day, Monday through Friday, shall bepaidatoneandone-half(11/2) times the regular straight-timerate.AllworkperformedonHolidaysshallbepaidattwo (2) times the regular straight-time rate, except when theownerorContractingAuthorityspecifiesandrequiresa different schedule in writing. In that event, Saturday,Sunday and holidays are excluded from overtime. If anEmployeeisgrantedarestperiodofnolessthanfour(4)hoursfollowingthecompletionofashift,theworkperiodfollowingthatrestperiodshallconstitutethestartofanewtwenty-four(24)hourworkday.ThisprovisionshallonlyapplyfromtimetotimeasrequiredbytheEmployer’scon-tractualobligationswithitscustomersand/orotheropera-tional necessity.

SECTION 6 Holidays. Holidays shall be New Year’s Day,MemorialDay,FourthofJuly,Twenty-fourthofJuly,Labor Day, Thanksgiving Day and Christmas Day. When aholidayfallsonSunday,thedayobservedbytheStateorNation as such holiday shall be observed. No work, except incaseofemergency,shallbeperformedonLaborDay.

SECTION 7 Reckoning of Time

A. Show-Up Time. When an Employee is ordered by theEmployer,orhisrepresentative,toreportforwork,andthroughnofaultoftheEmployee,isnotputtowork,theEmployershallpayaminimumoftwo(2)hoursreportingexpense. When a new Employee is dispatched to the com-panyonhisfirstdaytoajobsiteandnoworkisavailable,theEmployeragreestopaytwenty-fivedollars$25.00ortwo (2) hours reporting expense. When no work is avail-ablebecauseof(1)adverseweather;(2)majormechanicalbreakdown;or,(3)worksuspendedbywrittenconfirmationofthecontractingauthority,theEmployershallberelievedofshow-uppaybyprovidingEmployeeswithreasonablenotice(atleasttwo[2]hourspriortothestartofshift)thattheyarenotrequiredtoreport toworkorofachangeinthe scheduled reporting time. The Employee shall keep the Employer informedofhiscurrentaddressandaccessibletelephone number.

TheEmployerwillarrangetoprovideforatollfree800 number so that Employees may determine whether their services are required on the project any particular day.

Such announcements shall constitute notice under this Sec-tion. Any Employeewho reports for work, andworks,shallbeguaranteedtwo(2)hours’workorpay;however,anyEmployeevoluntarilyquittingshallbepaidfortheac-tualtimeworkedtothenearesthalfhour.

Any Employee who works more than two (2) hours,butlessthanafullshift,shallbepaidbythehourthereafter,exceptas follows:When theEmployee is laidoffforreasonofbadweather,workontheprojectissus-pendedbywrittenconfirmationoftheContractingAuthor-ity, or work is suspended due to major mechanical break-downor shortage ofmaterials beyond the control of theEmployer,saidEmployeeshallbepaidforthetimeactu-allyworkedafterthefirsttwo(2)hours.

Whenever an Employee is called out to work on Saturday,Sundayorholidays,saidEmployeeshallbeaf-fordedtheopportunitytoearnaminimumoffour(4)hoursat the applicable rate, unless such call-out immediately pre-cedesanEmployee’sregularshift,andtheworkcontinuesintosaidEmployee’sregularshift.Alltimeworkedbeyondthe first four (4) consecutive hours on Saturday, Sundayand holidays shall be reckoned by the hour at the appli-cable rate.

Onfirstreferral,iftheEmployeeactuallytravelsfifty (50)milesormoredistance from thenearestUnionoffice,andnoworkisprovided,four(4)hourswillbepaid.IfsaidEmployeeworks,notlessthaneight(8)hourswill

bepaid.TheaboveshallnotapplyiftheEmployee’sper-manentresidenceiswithinfifty(50)milesofthejob.

SECTION 8 Call-Back Time. Any Employee recalled towork,withinfour(4)hoursofthecompletionofhisreg-ularlyworkedshift,shallbepaidtheovertimerateofwag-eswithinaminimumpaymentequivalenttofour(4)hoursofworkathisregularrate.This,however,shallnotapplytoovertimeworkperformedconsecutivetotheregularshift.Call-BackworkshallbeperformedbytheEmployeecov-ered by this Agreement on a voluntary basis only, and no Employeeshallbedischargedsolelyforhis/herrefusaltoperformsuchwork.

SECTION 9 Meal Period. There shall be a regularly scheduledmealperiod.Themealperiodshallbeone-half(1/2)hourandshallbescheduledtobeginnotmorethanone-half (1/2) hour before and completed not later thanone(1)hourafterthemid-pointoftheregularlyscheduledhoursofworkforeachEmployee’sshift.ThemealperiodforMechanics,ServiceandLubricatingEngineers,maybescheduled to permit work at the applicable straight-time rate during the regularly scheduled meal period.

If the Employer requires the Employee to perform anywork through his scheduled meal period, the Employee shallbepaidattheapplicableovertimerateforsuchmealperiodandshallbeaffordedanopportunity toeatontheEmployer’s time.

SECTION 10 Payment of Wages.

A. Payment of Wages. Payday shall be once a week. The Employee shall be paid on the job or a mutually agreed place,includingdirectdepositsand/ormailingchecktothehome, to be agreed to by the Employer and the Union. Ac-companyingeachpaymentofwagesshallbeastatementidentifying the Employer, showing the total earnings,straight-time,overtime,theamountofdeductions,thepur-posethereof,andthenetearnings.

B. An Employee receiving payment of wages that areinsufficient,duetoanincorrectpayrateorfortimenotpaid,mustnotifyhisdirectsupervisorinwritingtocorrectthisshortage.TheEmployeragreestomakepaymentforanyshortagetotheEmployeebytheendofthesecondbusinessday from the date theEmployer received notification. Ifagreed to by the Employee, the shortage may be paid by the Employer no later than the next regular scheduled pay day. The Employer would agree that if the originalshortage has not been corrected by the next regular pay day,theEmployeragreestopaytheequivalentofone(1)hourstraight-timepayperdayforeachadditionaldaytheshortagecontinuesforuptoamaximumoffourteen(14)days.

C. Wages ofEmployees laid off or discharged shall bedueandpayableinfullwithintwenty-four(24)hours.Anynotice required by the Utah State Employment Service shall be submitted the same day. Employees quitting

or resigning shall be paid, in no case later than, the next regular payday.

SECTION 11 Safety Measures.

A. Thepartiesagreetocooperateandusetheirbesteffortsin carryingout health and safetymeasures andpracticesandagreeintheinterestofhealthandsafetytoobserveallStateandFederalhealthandsafetyrules.Employeesshallnotberequiredtoworkonunsafeequipmentorinunsafeconditions.

B. If an Employee is injured on the jobsite and has toleave the job to be taken to a hospital or similar medical facility, theEmployeeshall receivewages for thedayofinjury. The Employee must immediately notify the JobSuperintendentorForeman, ifphysicallypossible,of theinjury.IftransportationisrequiredonsaiddaytotransporttheEmployeetothehospitalorsimilarmedicalfacility,theEmployershallfurnishsaidtransportation.

C. The Union agrees that the Employees shall cooperate with theEmployer in theuseofsafetyequipmentand infurtheranceoftheEmployer’ssafetyprograms.

D. Toinsurethattheequipmentbeoperatedsafelyandtoeliminate occupational accidents, the Employer agrees that equipmentshallbeproperlycabbed,screened,heatedand/or curtained where necessary, and shall also have mirrors, windows, windshields, mud flaps and adequate steering and braking systems.

SECTION 12 Safety Meetings.Recognizingthatsafe-tyon the job is a primary concernof theUnion and theEmployer,itisagreedthatregularsafetymeetingswillbeattended by the Employer’s representative and his Em-ployees,duringaregularlyscheduledshift,andmaybeat-tendedbyarepresentativeoftheUnion.

SECTION 13 Only an Employee covered by this Agreement shall start and warm up equipment, and the rec-ognizedestablishedpracticeregardingtheclassificationofEmployeeused in thestartingandwarmingupofequip-ment shall not be changed.

SECTION 14 Change Rule. An Employee may be changedbetweenclassificationsandpiecesofequipmentprovidedanypieceofequipment theEmployee leaves isnot operated except by an Employee covered by this Agree-ment.However,anEmployeewhoistransferredtoanotherpieceofequipmentandwhoisnotqualifiedtooperatethatpieceofequipment, shallnotbedischarged,but shallbereturned to the equipment to which he was originally dis-patchedifworkisavailable.

SECTION 15 Highest Classification. The Employer agreesthatwagescalesshallberecognizedasapplyingtoclassificationsratherthantoEmployees;thatanyEmploy-eeperformingworkshallbepaidattheratetheclassifica-tionofhisworkcallsfor.Intheeventthatitbecomesnec-essaryfortheEmployeetoworktwo(2)hoursormoreat

morethanoneclassificationinanyoneday,theEmployeeshallreceivetherateofpayofthehighest-paidclassifica-tiononwhichhehasbeenassignedforthefulldayorshift.

SECTION 16 Regular Crews. It shall be the practice that when overtime is to be worked, the regular Employee operating the particular piece of equipment, or regularlyperformingtheparticularkindofwork,shallbegiventhefirstopportunitytobeemployedforsuchovertimework.

SECTION 17 Transportation.

A. No Employee covered by this Agreement shall be re-quired,asaconditionofemployment,tofurnishtranspor-tationwithinthejobsite,betweenjobsites,orfromyardtojobsitefor transportationofEmployees, tools,equipmentorforanyotherpurpose.

B. WhentheEmployertransportsEmployeesfromyardto jobsite, or within jobsite, or to power lines or pipelines, safeandsuitabletransportationshallbeprovided.

C. Whentheaccesstowheretheworkisbeingperformed(at a job or project, or within a job or project) is unsuitable, ornoparkingfacilitiesareprovidedwithinafive(5)min-utewalkfromtheEmployee’sjobsite,theEmployershalltransporttheEmployeetoandfromthejobsite,andsuchtransport shall be one-half (1/2) on theEmployer’s timeandone-half(1/2)ontheEmployee’stime.

D. The transportation, by means of its own power, ofequipment of the type or kind operated by Employees

covered by this Agreement shall be performed byEmployees covered by this Agreement.

E. Transportation on Jobsite. Employees will not be required to drive their own vehicles over a privately owned road that is unfit for travel. If said private road is unfitfor travel, theEmployershallprovide transportation inacoveredvehicle.Useof this transportationwillbeat theEmployee’s option.

SECTION 18 Facilities.

A. TheEmployer agrees to furnish suitable shelter andprotectiontoprotecttheEmployeesfromfallingmaterialor fromtheelements (including,butnot limited to,dust,heat, rain and cold).

B. On all jobs, clean drinking facilities and coolwatershall be provided the Employees by the Employer.

C. Suitable,adequateandsanitarytoiletfacilitiesshallbeprovided on all jobs.

D. If the Employermaintains a camp on the jobsite, itshall be maintained in a sanitary condition. Such accom-modations shall be provided to Employees at a reasonable cost.

SECTION 19 Employee Bonds. No Employee shall be required by the Employer to deposit a cash bond with the Employer or any other person. In the event that a surety bond is so required, the Employer shall pay the premium upon said bond.

SECTION 20 Supplementary Working Conditions.

A. Tools. The Employer shall provide on each jobsite, a secure place where his Heavy Duty Repairman may keep histools.Ifall,oranypart,ofaHeavyDutyRepairman’skitofworkingtoolsislostbyreasonoffailureoftheEm-ployertoprovidesuchasecureplace,orbyfire,flood,ortheft involving forcible entry while in the secure placedesignated by the Employer, the Employer shall reimburse suchHeavyDutyRepairmanforanysuchlossfromamini-mumofonehundreddollars($100.00)toamaximumoftwenty-fivethousanddollars($25,000.00).Inordertoob-tainthebenefitsofthisSection,aHeavyDutyRepairmanmustprovidetheEmployerwithaninventoryofhistoolsatthe time he commences work and an additional inventory everythirty(30)days.HeavyDutyRepairmenshallfurnishtheirownhandtools,butspecial toolsshallbefurnishedby the Employer as needed, such as: pin presses, spanner wrenches, air or electric wrenches, testing and measuring devices other than a hand rule, gear and bearing pullers, electric drills, reamers, taps and dies, oxy-acetylene hoses, gauges, torches and tips, torque wrenches, twenty-four-inch (24”) pipe wrenches, or socket wrenches, and sockets requiringoverthree-quarter-inch(3/4”)drive.HeavyDutyRepairmenand/orRegisteredApprenticesshallbeentitledtoatoolpick-uptimebeforetheendofeachshiftwhichshallnotbelessthanfive(5)minutes.

B. Special Tools.Employeesshallbeheldresponsibleforthe returnof special tools furnished to themby theEm-ployer.

C. Coveralls. All maintenance and mechanics shall be providedeleven (11)pairsofcoveralls,or inaccordancewith current practice, on a biweekly basis. Such coveralls shall be cleaned at the Employer’s expense.

D. Welding Gloves. Welders/Heavy Duty Repairmenshall be provided with welding gloves and replaced on an as-needed basis.

E. Collection of Property and Tools. Employees shall be givensufficienttimebytheEmployeratthecloseofeachshifttocollectandputawaypropertyandtools.Incaseoflayoffordischarge,sufficienttimeshallbegivenEmploy-ees by the Employer to return any Employer’s property or tools in their possession and to collect their personal prop-ertyandtoolsbeforetheendoftheirshift.Adequatestor-agespacefortoolswillbeprovided.

F. Working Alone After Dark. No Employee shall be re-quiredtoworkaloneduringhoursofdarknesswhenper-formingmaintenanceworkonequipment.Thisprovisionshall not apply to Employees servicing and/or startingequipmentone(1)hourpriortothestartofashift.

SECTION 21 Registered Apprentices. The wages, rates ofpay,hoursoflaborandtheotherconditionsofemploy-mentofRegisteredApprenticesshallbeandaregoverned

entirely by the terms and conditions of thisAgreementexceptasmodifiedinAddendumD,Sections19and20.

SECTION 22 The education, training and disciplining ofRegisteredApprenticesshallbegovernedbytheOper-atingEngineersJointApprenticeshipCommitteeforUtahand the Registered Apprenticeship Standards.

SECTION 23 Thestraight-timehourlyrateoftheReg-isteredApprentice shall be the following percentages ofHeavyDutyRepairman classification (Group 2A) in theAddendum or Agreement which the Apprentice is working. IntheeventanApprenticeWageequalsorexceedsthatoftheJourneymanrateintheClassificationhe/sheisworkingit shall be agreed that the wage will be set at twenty cents ($0.20) less than the Journeyman rate.

SECTION 24 Employeesengaginginwillfulornegli-gentactsthatresultindamagetoanypropertyorfacilities,or injury to other Employees will be subject to immediate termination.

SECTION 25 Intheeventofareductioninforce,theEmployerhasthesolerighttoretaintheEmployeesofhischoice.

SECTION 26 Discharge. No Employee shall sufferdischarge without “just cause”; provided, however, theEmployer shallbe the sole judgeof thequalificationsofhis Employees and may on such grounds discharge any of them. In theeventof adispute, theexistenceof “justcause” shall be determined under Article XII, Adjustment ofDisputes,setforthherein.

SECTION 27 Business Representative.

A. The Business Representative of the Union shall bepermittedonalljobsaftercheckingatprojectofficeandorcontactingtheprojectsuperintendanttoreceiveauthoriza-tionandproperorientationfortheproject,whenapplica-ble,butwillnotinterferewiththeEmployeesduringwork-ing hours unless permission is granted by the Employer.

B. The Union party to this Agreement may appoint a working Employee to act as Steward on each job or proj-ect, and the Employer will cooperate with and respect the dutiesofSteward(s).

TheUniondutiesoftheSteward(s)shallnotinterferewiththe regular production on the project. The Employer shall not discriminate against Steward(s) for performing theirofficialUniondutiesandshallnotdischarge,transferorlayoffSteward(s)byreasonoftheperformanceofsuchdutiessolongasthesamedonotinterferewithregularproduc-tionontheproject.TheUnionshallnotifytheEmployer,inwriting,ofthenameoftheSteward(s).

ARTICLE XII ADJUSTMENT OF DISPUTES

The Employer agrees to notify the Steward or BusinessRepresentative upon disciplining any of the Employeescovered by this Agreement.

ShoulddifferencesarisebetweentheUnionandEmployeror between the Employer and an Employee or Employees as to the meaning or application of the provisions ofthisAgreement, an earnest effort shall bemade to settlesuch differences immediately in the following manner.Grievances not satisfactorily resolved at one (1) step orlevelaretobereferredtothenextstep.

SECTION 1 Step One. The Union, Employer, any Employee, or group of Employees having a grievance,shallalone,orwithUnionrepresentation,firstpresentthegrievance to the immediate supervisor, who shall attempt toadjustit.Thegrievanceshallbepresentedwithinfive(5)workingdaysafterthecauseofthegrievanceisknownorshould have been known to exist.

SECTION 2 Step Two. If the grievance is not satis-factorilyresolvedattheStepOne,eitherpartymay,withinten(10)workingdaysoftheStepOnedecisionreducethegrievance to writing and present it to a designated repre-sentative of the Employer and designated representativeoftheUnion.ThegrievingpartyshallhavetherighttoahearingbeforetheBoardofAdjustmentandtoprovideallrelevant evidence including but not limited to witness tes-timonyinsupportofthegrievancewithinten(10)workingdaysafter itssubmission.TheBoardofAdjustmentshallrenderadecisionwithinfive(5)workingdays.TheBoardofAdjustmentshallbeaboardoffour(4)neutralrepresen-tatives, two (2) chosen by the Employer and two (2) chosen by the Union. The Employer representatives shall not be EmployeesoftheEmployerandtheUnionrepresentativesshallnotbeaffiliatedwiththeUnion.TheChairmanistobechosenbyagreementofthepartiestothisAgreement.IfagrievanceisnotresolvedfollowingthecompletionofStep Two, it shall then proceed to Step Three.

SECTION 3 Step Three. The grievance shall be sub-mitted to arbitration by the Employer and the Union sub-mitting a joint request to the Federal Mediation and Con-ciliationServiceforalistoffivepersonsqualifiedtoactasarbitrators.Withinten(10)daysfromthereceiptofsuchlistofarbitrators,thepartiesshallbeginalternatelystrikingnames and the remaining name shall be designated as the arbitrator to hear the grievance. Both parties agree that the

decisionof thearbitratorshallbefinalandbinding. TheexpenseofthearbitratorwillbesharedequallybyboththeEmployer and theUnion.Nothing in the foregoing shallbeconstruedasamending,changing,subtractingfromoraddingtotheprovisionsofthisAgreement.Itisunderstoodandagreedthatthewagescale,whichispartoftheAgree-ment, shall not be subject to arbitration

Bymutualagreementbetweenthepartiesanyofthetimelimits provided in this Section shall be extended.

ARTICLE XIII SAVINGS CLAUSE

SECTION 1 General Savings Clause. It is the intent of thepartieshereto toobserveall laws, rulingsor regu-lationsofallapplicableStateandFederallegislation,andGovernmental authorities or agencies having jurisdiction on the subjectmatter of thisAgreement, and the partieshereto agree that in the event that anyprovisionsof thisAgreementarefinallyheldordeterminedtobeillegalorarevoidasbeingincontraventionofanysuchlaws,rulingsorregulations,theremainderofthisAgreementshallremaininfullforceandeffect,unlesstheprovisionssofoundtobevoidarewhollyinseparablefromtheremainingportionofthisAgreement.Shouldanyclause,sentence,paragraphorsectionofthisAgreementbeheldinvalidbyacourtofcompetent jurisdiction, the parties hereto agree to meet im-mediatelyandrenegotiatethepartorpartsaffected.

SECTION 2 Market Recovery Provision. The par-ties to thisAgreement recognize theconstantlychangingnatureof the industryand thenecessityof theEmployerto maintain a competitive position in the construction in-dustrywithin theStateofUtah toprotect andassure thecontinuedwork opportunities of the affected Employeescovered by this Agreement.

Therefore,thepartiesherebyestablishaMarketRecoveryCommittee composed of three (3) representatives of theEmployerandthree(3)representativesoftheUnion,andanon-votingEmployeerepresentativewithintheStateofUtah. The Committee comprised of the Union’sMarketRecovery Committee and Employer representatives shall evaluateallrequestsforchangesormodificationsbelievednecessary to meet market or geographic area competition anddetermineifadequateeconomicjustificationispresenttosupportsuchachangeormodification.TheEmployeemembers serving on the Committee shall be selected by the Union in the State of Utah on a rotating basisdepending on the particular market or geographic area whereevaluationofthearea,changesand/ormodificationmay be necessary. The Committee shall review requests for changes in any of the terms and conditions of theMaster/GeneralAgreement,whichcoveranarealimitedtotheStateofUtahandbelievednecessarytopreserveandprotect work opportunities for affected Employees andthe Employer covered by this Agreement. The Employer will provide its request seven (7) calendar days prior to bid date and the Committee shall respond to the request

nolater than two(2)workingdaysfollowingthedateofrequest. The Committee, on a majority decision, by the three (3) Employer and three (3) Union Committeemen isauthorizedtoapprovesuchchangesasitdeterminestobe in thebest interestof theaffectedEmployeesand theparty to thisAgreement andmaymodify theAgreementaccordingly;provided,however,ifinanyparticularmarketarea, a determination is made by the Committee that a market area has been substantially lost or is rapidly being lost to non-union Employers, an addendum may be placed in effect covering that market which may apply for theduration of theAgreement; it is further provided that inthemonthofJanuaryofeachcontractyear,theCommitteeshallmeetandrevieweachmarketaddendum,andif theSignatory Employers have recovered sixty percent (60%) ormoreofthemarket,theCommitteeshalldetermineiftheapplicable addendum shall continue to apply, be terminated orotherwisemodified.Provided,further,anyjoborprojectcoveredbyanaddendumshall remaincovereduntil job/project completion. The Committee may also consider requests for multicraft project agreements, regardless ofdollar amount initiated through the National Heavy and Highway Committee and/or the National Building andConstruction Trades Department.

ARTICLE XIV PRE-JOB CONFERENCES

Thepartiesagreeapre-jobconferenceintheconstructionindustryisbeneficialtotheEmployerandtheUnion.Upon

requestofeitherparty,therewillbeapre-jobconferenceheldpriortothestartofthejobinquestion,atwhichtimeallphasesoftheworkcoveredbythisAgreementwillbethesubjectofdiscussion.BymutualAgreement,thepartiesmayforgoapre-jobconferencewiththeunderstandingthatthe Employer would agree to submit a completed pre-job informationformfurnishedbytheUnion.

Note: It is agreed that in some circumstances additional jobconferencesmaybenecessarytocovercertainphasesoftheproject.

ARTICLE XV PUBLIC WORK PROJECT - DAVIS BACON

ACT AND RELATED STATUTES: TITLE #34, CHAPTER 30 UTAH CODE ANNOTATED, AS

AMENDED

Public Work Project – Davis Bacon Act and Related Statutes: Title #34, Chapter 30 Utah Code Annotated, As Amended

SECTION 1 In the event an Employer bids a public job or project being awarded by a Federal, State, County, City,orotherpublicentitywhichistobeperformedatapredetermined and/or prevailing wage rate establishedpursuanttotheprovisionsoftheDavis-BaconActandre-lated statutes, or established by the Industrial Commission ofUtah pursuant to the provisions ofTitle #34,Chapter30,of theUtahCodeAnnotated, theEmployershallpaythepublishedhourlywage rate and fringes applicable to

such public jobs or projects with the provision that the Em-ployer would also agree to use the current Utah General wageratesandthecontractfringeratesasthebaseandnowageor fringebenefitsonpublic jobsorprojectswouldbe paid below this level. It would also be agreed upon that the Employer could adjust prevailing wages that are above thecurrentUtahGeneralWageratestothefringesinordertobringthemuptothecurrentfringebenefitratesofthisagreement.

IntheeventthattheDavis-BaconFringeBenefitsmayatsometimebehigherthanthefringebenefitratesinthecur-rent Agreement, any excess shall be applied to the employ-ees wage rates.

Itisalsoagreedthatthewageandfringebenefits,Pensionexcluded,onDavis-Baconjobsand/orprojectswillbefro-zenfromtheactualdaythejoband/orprojectbeginsforaperiodoftwenty-four(24)months.Pensioncontributionswillfollowthecurrentcontractincreases.Itisalsoagreedthaton thedayafter this twenty-four (24)monthperiod,thewageandfringebenefitsshallbeadjustedtothecurrentUtahGeneralWageratesandcontractfringerates.

SECTION 2 Inaddition,ifanEmployerisawardeda public job or project, wherein the award contains pro-visionsforhonoringdeferredwageandfringebenefitin-creasesorescalatorswhicharesetforthincollectivebar-gaining agreements to which the Employer is bound, the Employeragreestoadjustthewageandfringebenefitsthe

samepercentageasoutlinedintheawardedbidspecifica-tions;provided,however, theEmployer isreimbursedbytheowner foranyactualcosts incurredby theEmployerunder this Section.

SECTION 3 IftheDepartmentofLaborWageDe-terminationdoesnotincludethewageand/orfringeofoneormoreclassificationsonanyjobbeingbid,theUnionandEmployer will negotiate a proposed wage and/or fringebenefitpackage for themissingclassifications tobesub-mitted to thecontractingauthorityforapproval.TheDe-partmentofLaborwillmakethefinaldetermination

ARTICLE XVI SPECIAL PROVISIONS CONCERNING

FOREMEN OTHER THAN GENERAL FOREMEN

SECTION 1 General Provisions. The provisions ofthisArticle,totheextenttheydifferfromanyspecificpro-visionofotherSectionsofthisAgreement,shallsupersedesuch provisions.

SECTION 2 Classified As Supervisors. Foreman shall notbeclassifiedasEmployeesasthattermisdefinedintheJobPlacementRegulationsofthisAgreement,butshallbeconsidered “Employees” as that term is used elsewhere in thisAgreement.Notwithstandingtheforegoingprovision,Foremanwho performwork covered by thisAgreementshallbedispatchedtotheEmployerasprovidedforintheJobPlacementRegulationsofthisAgreement.

SECTION 3 Foremen and Shifters. The Employer shallhavetheright todeterminethenumberofForemenandShifters,providedhowever, thatoncrewsoffive(5)operators or less, the Employer may utilize a workingForeman.Onpavingcrewsofsix(6)operatorsorless,theEmployermayutilizeaworkingForeman.

SECTION 4 Heavy Duty Repairman Foremen or Master Mechanics (Heavy Duty) shall have the right to workwiththeirowntoolsoncrewsoffive(5)Mechanicsand less and at any time a Heavy Duty Repairman is absent or there is an emergency.

SECTION 5 Fringe Benefits. The Employer shall abide by Addendum A, Article 2 with respect to Foremen, Shifters, Heavy Duty Repairmen Foremen, and MasterMechanics (Heavy Duty) in the same manner as applies to all Employees covered by this Agreement.

ARTICLE XVII SPECIAL PROVISIONS COVERING

SUPERVISORY PERSONNEL ABOVE THE RANK OF FOREMAN

Fringe Benefits. The Union and the Employer agree that the Employer covered by this Agreement may cover their supervisory personnel above the rank of Foremen in theOperatingEngineers’HealthandWelfareTrustFundandPensionTrustFundforOperatingEngineersbypayingintoallTrustssetforthinthisAgreementmonthlyonthebasis

ofonehundredandsixty-eight (168)hourspermonth inaccordancewiththeschedulessetforthinthisAgreement,regardlessofthehoursworkedbyanysuchEmployeeinamonth.ASupervisorabovetherankofForemanmayelectattheirdiscretiontoceaseparticipatinginalloftheTrustFunds,underthetermsofthisAgreement.

ARTICLE XVIII WORK STOPPAGE AND LOCKOUT PROVISION

ForthetermofthisAgreement,theUnionforandonbe-halfofitself,itsofficers,agents,andmembers,agreethattherewillbenostrike,stoppageofworkofanykind,in-cluding the observanceof any lawful or unlawful picketline established by the Union party to this Agreement or any other union not a party to this Agreement, slowdown, work stoppage, picketing, boycott, deliberate withholding ofproduction,orinterferencewithorsuspensionofworkonthepartoftheUnion,oritsmembers,oranyEmployee.Any Employee or groups of Employees participating inanyoftheaboveenumeratedacts,inviolationofthispro-vision, whether done singly or in concert, shall individu-allybesubject,inthesolediscretionoftheEmployer,toimmediatedischargeand/orotherdisciplinaryaction.Anytypeofcurtailmentand/orrestrictionofproductionshallbeconsideredaviolationofthisArticle.

It is specificallyagreedbyandbetween theparty to thisAgreement that the refusal of anyEmployee coveredbythisAgreementtocrossanypicketlineofanyunion,which

refusalinterfereswiththeperformanceoftheEmployee’swork duties, shall subject said Employee to discipline, in-cluding discharge, without recourse to the grievance and arbitrationprocedureofthisAgreement,exceptasspecifi-cally provided elsewhere in this Article.

The party hereto specifically agree that so called “sym-pathy” strikes are prohibited by this Agreement, and that such so-called “sympathy” strikes are subject to the griev-anceandarbitrationprovisionsofthisAgreement,exceptas noted above.

ForthetermofthisAgreement,theEmployeragreesitwillnot occasion any lockout of its Employees as a form ofeconomicpressureagainstitsEmployeesintherecognizedbargaining unit.

IntheeventanyviolationofSection1ofthisArticleoc-curs,theUnionshalltakethefollowingsteps:

A. Notify the participating Employees and the otherunionsthatsuchactionisunauthorized;

B. Promptly order its members to resume their normal duties,notwithstandingtheexistenceofanypicketline;

C. The Union and Employer shall waive all time limits for any grievance filed by the Employer orUnion partyhereto,allegingaviolationofthisArticle,andshallsubmittoaprompt,expeditedarbitrationagreeingthattimeisofthe essence with respect to any claim by the Employer or UnionofaviolationofthisArticle.

TheEmployer,uponpresentationbytheUnion,ofcompel-ling factual evidence bearing upon anyEmployee’s lackofparticipationintheprohibitionsofthisArticle,agreetoarbitratetheissueoffact(notEmployerdecisionsofdisci-pline)withrespecttothatspecificEmployeeorthosespe-cificEmployeesasthecasemaybe.

TheprovisionsofthisArticlearenotapplicablewhenanEmployerisdelinquentinthepaymentofwagesandfringebenefitsrequiredbythisAgreementwheresatisfactoryar-rangementsfortheresolutionofsaiddelinquenciesarenotmet by said delinquent Employer.

Any Employee or groups of Employees participating inanyoftheaboveenumeratedacts,inviolationofthispro-vision, whether done singly or in concert, shall individu-allybesubject,inthesolediscretionoftheEmployer,toimmediatedischargeand/orotherdisciplinaryaction.Anytypeofcurtailmentand/orrestrictionofproductionshallbeconsideredaviolationofthisArticle.

ARTICLE XIX POLICY ON DRUGS AND ALCOHOL

SECTION 1 The Employer’s Policy on Drugs and Al-cohol will apply to all Employees covered by this Agree-ment.

SECTION 2 Illegal drugs, intoxicating liquors or impairment levelsof anydrugswillnotbeallowed; any

persons engaging in such shall be subject to immediate dis-ciplinary action up to and including discharge.

SECTION 3 In the event the Employer has no Policy on Drugs and Alcohol, the Union’s Substance Abuse Poli-cy shall apply.

ARTICLE XX FAVORED NATIONS

SECTION 1 In the event the Union negotiates a more beneficialtermorconditionofemploymentwithanyotherEmployerinanyothercollectivebargainingagreementofthesamescopeofworkofheavyhighwayconstruction,theEmployer shall be entitled, at its discretion, to adopt that specificcollectivebargainingagreementinitsentirety.

SECTION 2 The provisions of thisArticle will notapply to any Agreement determined by the Market Recov-ery Committee under the procedures set forth inArticleXIII, Section 2 or to any Project Agreement.

SECTION 3 The parties recognize that it is in theirmutual interest for the Union to organize non-signatoryEmployers and to sign collective bargaining agreements with thoseEmployers.Theparties further recognize thatit is not always possible for the Union to secure a firstcontract with a non-signatory Employer that has the same termsandconditionsofthisAgreement.Therefore,ArticleXX, Section 1, shall not apply to any agreement the Union signs with a non-signatory Employer for the first three

yearsfollowingthedatetheUnionandthenon-signatoryEmployersigntheirfirstagreement.

ARTICLE XXI UNION DUES CHECK-OFF

SECTION 1 Union Dues Check-Off. The Employer agreestodeductinitiationorreinstatementfeesandduesfromanEmployee’swageswhenauthorized todosobythe Employee in a written assignment by the Employee and submitted to the Employer by the Union. (See Exhibit “B” attached hereto and incorporated herein.) Any money so deducted shall be transmitted to the Union monthly. The Employer agrees to honor such dues check-off in accor-dance with its terms.

ARTICLE XXII AREA DEFINITIONS

SECTION 1 Article XXIII provides a description ofAreas1,2and3baseduponadriven distancefromapin-pointed location in Salt Lake, Weber, Utah and other countieswithinthestateofUtah.

SECTION 2 The wages rates set forth in theAddendatobepaidforallworksetforthherein.

SECTION 3 If the Employee works in Area 1,he/she shall be paid the applicablewage and fringe ratefromtheAddenda.IftheEmployeeworksinArea2,he/sheshallbepaidtheapplicablewageandfringeratefrom

theAddendaandsubsistence in theamountof thirty-five($35.00)dollarsperdayorlodging.Iflodgingisprovidedby the Employer, Employees may be required to double up where practical. At the Employer’s sole discretion an equitableequivalentmaybeprovidedwithnotificationtothe Union. IftheEmployeeworksinArea3,he/sheshallbepaidtheapplicablewageandfringeratefromtheAddendaandsubsistenceintheamountoffifty($50.00)dollarsperday or lodging. If lodging is provided by theEmployer,Employees may be required to double up where practical. At the Employer’s sole discretion an equitable equivalent maybeprovidedwithnotificationtotheUnion.

ARTICLE XXIII MAP DESCRIPTION FOR

SECTION 1 General Provisions. The Employer will makethefollowingpaymentsforeachhourworkedorpaideach Employee by the Employer covered by this Agree-ment. SECTION 11 Supplemental Dues. Effective for allwork performed on and after July 1, 2011, it is agreedthatuponwrittenauthorization,providedbytheUnion,asrequired by law, the amount designated by the Union shall bededucted from theVacation andHolidayPayof eachEmployee and remitted directly to the Union. The amount of the Supplemental Dues transmittal shall be specifiedon a statement sent to the Employees. Such remittance shall be made to the Union monthly. Supplemental Dues arespecificallypartoftheuniformmonthlyduesofeachEmployee of this Agreement. The Employees shall beobligated to make such payment directly to the Union on a monthlybasisiftheduesauthorizationprovidedforhereinisnotexecuted,undersuchtermsandconditionsasfromtime to time may be prescribed by the Union.

SECTION 12 The Union shall exonerate, reimburse and hold harmless the Employer, each Individual Employer, and theirrespectiveofficers,directors,agents,andemployees,individually and collectively, against any and all liabilities andreasonableexpensesarisingoutofthepayment,receiptoradistributionof theamountsdesignatedbytheUnionapplicable to Vacation and Supplemental Dues.

PART I

AllEmployeesandapplicantsforemploymentemployedfor the performance of work and/or the operation ofequipmentofthetypeandkindusedintheperformanceofsuch work covered by the Utah Master Agreement or any otherAgreementincorporatingtheprovisionsoftheseJobPlacement Regulations shall be secured in accordance with thefollowing:

01.00.00 COMMITTEE

01.01.00 There shall be a Joint Committee composed offour(4)membersrepresentingtheIndividualEmployersandtheUnionasfollows:Two(2)membersappointedbytheEmployersandtwo(2)membersoftheUnionwhoareappointed by the Union.

01.02.00 TheJointCommitteewillbeauthorizedandempoweredtoamendtheproceduresoftheJobPlacementCenterandtohearappealsunderSection6oftheseregula-tionsandtothatendwillperformitsfunctionasefficientlyandeffectivelyandfairlyaspossible.

01.03.00 The Committee shall operate by majority rule, with equal numbers voting.

01.04.00 In the event that the Committee should be deadlocked,themattermaybereferredtoarbitrationunderthe Utah Master Agreement.

02.00.00 NON-DISCRIMINATORY OPERATION

02.01.00 The Union will conduct such Job Placement Centers and operate such Job Placement Centers without discriminationeitherinfavoroforagainstEmployeesorapplicants for employment or any of them by reason ofreligion, color, sex, age, handicap, or national origin or membership or non-membership in any union, or by reason ofactingonbehalfoforinoppositiontoanyunion.TheUnionrecognizesitsobligationsandthereforeassumesfullresponsibilitytoeachEmployeeorapplicantforemploy-mentforanylossordamageresultingfromanysuchdis-criminationorotherviolationofthelawbytheUnion.TheprovisionofthisSectionshallgovernoveranyconflictingprovisionorrequirementoftheConstitutionoftheInter-nationalUnionofOperatingEngineersoroftheConstitu-tion,By-Laws,workingrulesorotherrulesoftheUnion,andselectionofEmployeesandapplicantsforemploymentfordispatch toJobsshallbeonanon-discriminatoryba-sisandshallnotbebasedon,or inanywayaffectedbyunion membership, By-Laws, rules, regulations, constitu-tionalprovisions,oranyotheraspectorobligationofunionmembership,policies,or requirements. It is the intentof

03.00.00 BASIC PRINCIPLES

03.01.00 ForthepurposeoftheseJobPlacementReg-ulations, “Employment Credit” means three hundred and fifty (350) pension hours as reported toOperatingEngi-neersLocalUnionNo.3PensionTrustFundbyreasonofemploymentinanyoneormoreclassificationscoveredbythis Agreement, including but not limited to those set out in Part1ofthisAgreementonthetypeorkindofcraftworkcovered by this Agreement.

03.01.01 Subject to the limitations in Section 03.01.00 last set out: Hours worked or hours reported to another pensionbyreasonofon-siteworkintheareacoveredbythePensionTrustFundforOperatingEngineers,orofthetypeorkindofworkcoveredbythisAgreementinthemin-ingindustryintheStateofUtahwhichare,and/oris,es-tablished by any objective criteria, shall be equated to three hundred andfifty (350)pensionhours as are reported tothe Operating Engineers Local Union No. 3 Pension Trust Fund, and as so equated shall be an “Employment Credit.” Objective criteria shall be either other pension records or

letters fromEmployerscertifiedunderpenaltyofperjuryspecifying how many hours the individual has workedeachyearonaparticularpieceofequipment.Suchhoursworkedforotheremployersmaybeverifiedbyanauditoftime cards or other payroll records.

03.02.00 ForthepurposeoftheseJobPlacementReg-ulationsonlytheEmployeesshallbeclassifiedasfollows:

03.02.01 Class A. Persons who have earned three (3) or more Employment Credits at any time within thirty-six (36) months immediately preceding registration for em-ploymentshallbeclassifiedasClassA.

03.02.02 Class B. Persons who have earned one (1) Employment Credit or more, but less than three (3) Em-ployment Credits at any time within twelve (12) months immediatelypreceding registration for employment shallbeclassifiedClassB.

03.02.03 Class C. Persons who do not meet the re-quirementofeitherClassAorClassBsetoutabove.

03.03.00 The Individual Employer may employ a ClassAEmployeeasdefinedhereinthroughawrittenre-quest to the Job Placement Center that such Employee be dispatched to such Individual Employer by name, or may employ such Class A Employee directly, provided that no EmployeeshallbelaidofftomakeroomforsuchEmploy-ee,andthatinthecaseofaClassAEmployeeobtaineddi-rectly,theIndividualEmployershallnotifytheJobPlace-

ment Center promptly in writing so that a dispatch slip may be issued to and received by said Class A Employee within five(5)days.

03.03.01 During the months of April throughNovember, if there is less than fifteen percent (15%)registered on the out-of-work list in the Job PlacementCenter servicing the job or project, an Individual Employer mayrequestanyemployeefromtheA,BorClistthrougha written request to the Job Placement Center.

03.04.00 Hiring.TheEmployershallfirstcontact theJob Placement Center to secure all Employees and applicants for employment to be employed in the performance ofanyworksetforthinPartIof theseregulations.WhenaJob Placement Center receives a request, it shall dispatch satisfactory and competent personswithin thirty-six (36)hours,excludingSaturdays,Sundaysandholidays,ofthetime they are requested if they are available, and in theevent they cannot be or are not dispatched within such period, the Employer may employ any person but shall arrange for a dispatch to be obtained for such person asprovidedinSection03.03.00hereof.

03.04.01 Hiring Violation-Definition. A hiring violation occurs when an Employer violates Section 03.04.00of the JobPlacementCenter regulations and/orhasthepropernumberofpersonsonapieceofequipmentbut one or more is not properly dispatched, such as a non-dispatched invidual performing work covered by thisAgreement.

03.04.02 Hiring Violations-Penalties. An Employer whohasviolatedanyofthehiringprovisionsofthisAgree-ment shall be required to immediately discharge any im-properly hired Employee and shall be assessed penalties as follows:

First Offense. The Employer shall pay any person wrong-fullydeprivedofemploymentanamountnottoexceedthewages,straight-timeandovertime,togetherwithfringeben-efitstotheappropriatetruststhatwouldhavebeenpaidbytheEmployerbutfortheviolation.Suchpaymentsshallbefornotmorethantwo(2)daysofsaidviolationpriortothenotificationoftheEmployer.

Second Offense. The Employer shall pay any person wrong-fullydeprivedofemploymentanamountnottoexceedthewages,straight-timeandovertime,togetherwithfringeben-efitstotheappropriatetruststhatwouldhavebeenpaidbytheEmployerbutfortheviolationandinadditiontwenty-fivepercent(25%)ofthetotalamount,notasapenaltybutbywayofliquidateddamages,totheOperatingEngineersTraining andApprenticeship Trust Fund for the damagessufferedbytheUnion.Suchpaymentsshallbefornotmorethanfive(5)daysofsaidviolationpriortothenotificationoftheEmployer.

Third and Successive Offenses. The Employer shall pay anypersonwrongfullydeprivedofemploymentanamountnot to exceed the wages, straight-time and overtime, to-gether with fringe benefits to the appropriate trusts that

wouldhavebeenpaidbytheEmployerbutfortheviola-tionandinadditiontwenty-fivepercent(25%)ofthetotalamount,notasapenaltybutbywayofliquidateddamages,to the Operating Engineers Training and Apprenticeship TrustFundfor thedamagessufferedby theUnion.Suchpaymentsshallbefornotmorethanten(10)daysofsaidviolationpriortothenotificationoftheEmployer.

03.04.03 Dispute Resolution. Disputes arising between theEmployerandtheUnionfromallegedviolationsoftheJob Placement Regulations shall be resolved through the AdjustmentsofDisputesprovisionsoftheapplicableCol-lective Bargaining Agreement.

03.05.00 Rejection of Employee/Applicant. The Indi-vidual Employer may reject any Employee or applicant for employment dispatched by a Job Placement Center;provided, however, that any such Employee or applicant reporting forworkat theagreed timeand thedesignatedplace and rejected by the Individual Employer shall be entitled to show-up time in the amount provided in the agreement unless such Employee or applicant is rejected becausehereportedinaconditionunfitforwork.

TheIndividualEmployermayrejectanEmployeefordis-patchwhohasbeendischargedbytheEmployerforcauseforupto(18)eighteenmonthsfromsaidterminationdateby submitting a written request to the Job Placement Cen-terwithin(10)tendaysofEmployeesdischargedate.

Further,anyEmployeeorapplicantdischargedforafirst-timefailureofanEmployer’sdrugtestmayonlybecomeeligibleforre-employmentwiththesameEmployeraftersuccessfully completing an approved substance abuserehabilitationprogram.Employees failingmore thanonedrug testof theEmployer shallonlybecomeeligible forre-employmentwiththesameEmployeraftersuccessfullycompleting an approved substance abuse rehabilitation programandatthesolediscretionoftheEmployer.

Employeesreturnedtoworkafterfailureofanydrugtestsshall be subject to a maximum of twelve (12) randomdrugtestsintheirfirsttwelve(12)monthsofemployment.The cost of such random tests shall be assumed by theEmployer.

Notwithstandingtheforegoing,theEmployershallbethesole judge of qualifications, of all of its Employees andmayonsuchgroundsdischargeanyofthem.Further,theEmployer, in its sole discretion, may reject any Employee or applicant for employment found to be unfit forworkthrough pre-employment drug testing, or if lacking inspecialized experience pursuant to a prior request of theEmployer.

03.06.00 LossofClassification–ClassA. A Class A Employee who does not earn one (1) Employment Credit inanyperiodofthree(3)consecutivecalendaryearsshalllosetheirClassAstatusandshallbeclassifiedasaClassB Employee.

03.06.01 LossofClassification–ClassB.A Class B Employee who does not earn at least one (1) Employment credit in any calendar year shall lose their Class B status andshallbeclassifiedasaClassCEmployee.

03.06.02 In each instance, for a ClassA Employee,theperiodofthree(3)consecutiveyearsorforaClassBEmployee one (1) year, as the case may be, will be extended foranyperiodof:

A. incapacity,

B. military service,

C.full-timepaidemploymentwiththeUnion,Apprenticeand Journeyman or other training program, the Operating Engineers Local Union No. 3 Credit Union, or theInternationalUnionofOperatingEngineers,

D.employmentwithapublicagencyonthetypeorkindofcraftworkcoveredbythisAgreement,

E.employmentinasupervisorycapacityabovetherankofforemanwithanIndividualEmployer,

F.orforanyperiodinwhichhe/sheistransferredbyanIndividual Employer to a job or project outside Northern California, Northern Nevada, Hawaii, and Utah, and isthere employed by such Individual Employer or by a joint venture with which said Individual Employer is associated onthetypeorkindofcraftworkcoveredbythisAgreement,

G.retirementbyanEmployeewhosubsequentlyfindsitnecessarytoreturntoworkandhassonotifiedthePensionTrustFundofhischangeinstatus.

03.07.00 Registrations may be accomplished in per-son, by telephone, or by mail. The Job Placement Center shall make appropriate registration cards available to Indi-vidual Employers on their request.

03.08.00 TheIndividualEmployermaytransfertoem-ployment covered by the Agreement persons then in his employwhowould,ifregisteringatthattime,berequiredtoregisteronListCintheratioofone(1)suchpersontoeach ten (10) Employees. A dispatch slip will be obtained forsuchpersonasprovidedinSection03.03.00above.

03.09.00 The Union will cooperate with the Individual Employer in theplacingof student trainees so longas itdoesnotmateriallyaffectthenormalemploymentofregu-lar Employees.

03.10.00 The IndividualEmployermay transferEm-ployeesfromonejobtoanotherwithintheterritoryofthisAgreement.

03.11.00 Workmen employed by an Individual Em-ployerpursuant to the termsof thisAgreement shall notberemovednortransferredbytheUnionunlessthepriorapprovaloftheIndividualEmployerhasbeenobtained.

03.12.00 SeparateListsshallbekeptforAssistantstoEngineeronthesamebasisasforOperatingEngineers.

03.12.01 Registration on the “Assistant to Engineer” Lists shall be limited to Employees who possess A or B status as an “Assistant to Engineer” or Employees who are eligibletomakeapreferredregistrationasaresultofem-ployment under a collective bargaining agreement with the Union.

03.13.00 TheemploymentofaRegisteredApprenticeonworkcoveredbyanAssistanttoEngineerclassificationby an Individual Employer shall terminate on the Friday followingnotificationbytheJobPlacementCenterservic-ing the job or project that an A or B Assistant to Engineer oranEmployeeinapreferredclassificationwhohasbeencurrentlyregisteredonitsListsforatleastten(10)workingdays is seeking such employment.

03.13.01 TheforegoingshallbereviewedfromtimetotimebytheJointCommitteecomposedoffour(4)mem-bersassetforthinSection01.00.00oftheseregulations.The Committee may temporarily reopen the Lists to new registrants as it deems it appropriate to do so.

03.14.00 A. Individuals desiring to register on the A, B or C List who have not been employed by Individual Employersforatleastfivehundred(500)hoursinthepriorthirty-six (36) months, may be required to take a minimum qualifications test administered by the JourneymanApprenticeship Training Program, for each piece ofequipmentavailableat the trainingcenterforwhichtheywanttoregister.Oncepassingsuchminimumqualifications

test foraparticularclassification,noadditional testneedbe taken for that classification unless the individual hasbeendeemedbyIndividualEmployer(s)tobeunqualifiedto work in that classification. An individual who failsto pass the minimum qualifications test for a particularclassification shall not be allowed to register in thatclassificationuntilhe/shesubsequentlypassesaminimumqualificationstestforthatclassification.Anindividualmaynottakeaminimumqualificationstestmorethanonceinsix(6)monthsforaparticularclassification.

B. The provisions stated above in subsection (A) will be waived when there are fewer than fifteenpercent(15%)registeredontheout-of-worklistontheJobPlacement Center servicing the job or project during the monthsofAprilthroughNovemberofanycalendaryear.

C. Any Individual who has been discharged twice forbeingunqualifiedtoworkregardlessof classification,shallnotbeallowedtoregisterinthatclassificationinwhichhe/shewishestoregisteruntilhe/shesubsequentlypassesaminimumqualificationstestforthatclassificationortheclassificationforwhichhe/sheisregistering.Anindividualmay not take a minimum qualifications test more thanonceinsix(6)monthsforaparticularclassification.TherequirementtopasstheminimumqualificationstestforaparticularclassificationshallbewaivedforanyindividualwhopresentsaletterfromanIndividualEmployerthattheindividual has within the prior twenty-four (24) months

provenhisorherqualificationsbysatisfactorilyoperatinginthatclassification.AnIndividualEmployermayqualifythe Employee in those classifications not covered bythe Training Center. The minimum qualifications test isnot designed to verify that an individual is a “qualified”journeyman. The Individual Employer may waive the requirement to pass the minimum qualifications test bymeansofwrittennoticetotheJobPlacementCenter.

03.15.00 NoEmployee or applicantmay register foremployment as an Operating Engineer and Assistant to Engineer at the same time, except an Employee who is eli-gibletomakeapreferredregistration.

04.00.00 GENERAL PROCEDURES OF THE JOB PLACEMENT CENTER

04.01.00 Each Job Placement Center shall maintain the followingListsonwhichpersonsnotcurrentlyemployedin the highways, general building and heavy construction industryoronthetypeorkindofworkcoveredbyacollec-tivebargainingagreementwiththeUnionmayregisterforemployment at any time during which the Job Placement Center is open:

04.02.00 ListA for thosewhoareclassifiedasClassAEmployees.“Preferred” registrationonListAshallbepermitted with respect to the following classifications:Compressors, Pumps, Welding Machines, Generators, Chi-cago Booms, Material Hoist (1 Drum), Material Hoist (1

or more Drums) and Elevators. An Employee making a “preferred”registrationshall:

04.02.01 Be ineligible to register and shall not register forworkinanyclassificationwhichisnot“preferred;”

04.02.02 Befifty-five (55) ormore years of age andhavehadatleastten(10)yearsofemploymentoravailabil-ityforemploymentinanyone(1)ormoreclassificationssetoutinSection01.00.00ofthisMasterAgreementonthetypeorkindofcraftworkcoveredbythisMasterAgree-ment, or the Master Agreements covering Northern Cali-fornia,Hawaii,andNorthernNevada;provided,however,that a person who does not meet such requirements, but who has a physical handicap preventing his employment inanyclassificationexceptonewhichis“preferred”andisa Class A Employee or acquired such handicap as a result ofanIndustrialaccidentwhileemployedasanOperatingEngineer, shall be permitted to so register.

04.03.00 ListBforthosewhoareclassifiedasClassBEmployees.

04.04.00 List C for applicants for employment, per-sons who do not meet the requirements set out in Sections 04.02.00 through 04.03.00 above.

04.05.00 SeparateLists shallbekept forAssistant toEngineeronthesamebasisasforOperatingEngineers.

04.05.01 For the purpose of these hiring regulationsonly, the term “Assistant to Engineer” shall include the

following classifications: Oilers, Gradesetters, Firemen,Partsmen, Repairmen Helpers, Asphalt Plant Firemen, Brakemen-Locomotive.

04.05.02 Anypersonwhowhileregisteredforemploy-ment in a Job Placement Center accepts employment in the highway, general building and heavy construction industry otherthanunderthisAgreementoronthetypeorkindofwork covered by a collective bargaining agreement with theUnionshallnotifytheJobPlacementCenter(s)oftheUnionwhereregisteredinwritingwithinforty-eight(48)hours after such acceptance, to strikehis name from theList or Lists on which he is registered. Employees regis-teredshallset forth theirname,addressand/or telephonenumberandclassificationorclassificationsofworksoughtandwhichtheyarequalifiedtoperformandmaychangesuchclassificationorclassificationsatanytimebeforebe-ingdispatched.Applicantsregisteringshallsetforththeirname, address and/or telephone number and classifica-tionorclassificationsofworksoughtandtheirexperiencetherein andmay change such classification or classifica-tionsatanytimebeforebeingdispatched.

04.05.03 Amonthlyfeeintheamountequaltooneandonequarter(1-1/4)hoursofthe“averagewageandfringepackage” in the Master Agreement (Utah General) shall be chargedeachnon-dues-payingregistrantfortheOperating EngineersonListsA,BandC,andamonthlyfeeintheamountequaltooneandonequarter(1-1/4)hoursofthe“average wage package” in the Master Agreement (Utah

General) shall be charged each non-dues-paying registrant forAssistanttoEngineeronListsAandB,uponregistra-tion,andincaseofListC,re-registration,astheirfairshareofthecostofoperatingtheJobPlacementCenter.Regis-trants on List A or B in order to maintain their registration shall,aftertheirfirst(1st) payment on registration, pay on the first (1st) day but not later than the fifth (5th) day ofeachsucceedingcalendarmonthsuchfeeinorderthattheirregistrationremainvalid.Ifsuchpaymentisnotmade,thenameof thenon-paying registrant shallbe stricken fromthe list at the close of the fifth (5th) day of the calendarmonth regardlessof theprovisionsof thefirst (1st) para-graphofthisprovisionSection04.07.00.

04.05.04 Only one (1) such registration fee shall bechargedanysuchregistrantinanycalendarmonth.Theof-ficialreceiptforthepaymentofsuchregistrationfeeshallbe honored by any other Job Placement Center or Centers wherepresentedthatmonth.SuchfeesshallbereviewedfromtimetotimeandmaintainedatequitableamountsbytheCommitteeprovided for inSection01.00.00of theseJob Placement Regulations.

04.06.00 Registration on List A and B shall be valid for only eighty-four (84) days (twelve weeks) from thedateofregistration.AnEmployeewhosenameinthein-terimhasnot been stricken from theList as provided inothersubsectionsoftheseJobPlacementRegulationsmaymaintain his place on the List by successive reregistrations.

Suchreregistrationsmustbeaccomplishedonorbeforetheeighty-fourth(84th)dayafteroriginalre-registrationorlastre-registration, as the case may be, and each such registra-tionshallbevalidforanadditionaleighty-four-dayperiodonlyfromthelastdateofre-registration.ThenameofanEmployeewhofailstoexercisethisrightofre-registrationwithinthetimeprovidedhereinshallbestrickenfromtheappropriateListat thecloseofbusinessoneighty-fourth(84th)dayoratthecloseofbusinessonthenextworkdayfollowingthe84thdayifthe84thdayisanon-workday.

04.07.00 RegistrationsonListCshallbevalidforone(1) calendar month only, and no such registration shall be carried over to the succeeding month. Any person not dis-patched during the calendar month in which he registers shall,ifhedesires,beavailablefordispatchuponre-regis-tration.

04.08.00 In dispatching, each Job Placement Center shallfirstdispatchthoseonListAlivingeitherpermanent-ly or temporarily in the area serviced by the Job Placement Centerdispatching,solongasthereareanyintheclassifi-cationcalledforbytheIndividualEmployerwhoarereg-istered,availableforworkandwillingtoacceptadispatchand thereafter, those on ListA regardless ofwhere theylive,solongasthereareanyintheclassificationcalledforby the Individual Employer who are registered, available forworkandwilling to accept adispatchand thereafter,those on List B living either permanently or temporarily in

the area serviced by the Job Placement Center dispatching solongasthereareanyintheclassificationcalledforbytheIndividualEmployerwhoareregistered,availableforworkandwillingtoacceptadispatchandthereafter,thoseonListBregardlessofwheretheylivesolongasthereareany in theclassificationcalledforby theIndividualEm-ployerwhoareregistered,availableforworkandwillingtoacceptadispatchandthereafter,thoseonListClivingei-ther permanently or temporarily in the area serviced by the Job Placement Center dispatching so long as there are any intheclassificationcalledforbytheIndividualEmployerwhoare registered,available forworkandwilling toac-ceptadispatchandthereafter,thoseonListCregardlessofwheretheylivesolongasthereareanyintheclassificationcalledforbytheIndividualEmployerwhoareregistered,availableforworkandwillingtoacceptadispatch.

04.08.01 Theforegoingissubjecttospecialprovisionsgoverning specific Job Placement Centers as agreed tofromtimetotimebytheCommitteeprovidedforinSec-tion01.00.00oftheseJobPlacementRegulations.

04.09.00 All Employees on Lists A and B shall be dis-patchedonafirst-in,first-outbasis,byclassification,andthenameofanEmployeesodispatchedshallbestrickenfromtheListunless(a)thejobtowhichtheEmployeeisdispatchedisajobofshortduration,or(b)heisnotputtoworkbecauseofthelackofmaterialorotherreasonsbe-yondthecontroloftheIndividualEmployertowhomdis-

patchedandhenotifiestheJobPlacementCenterofsuchfactsnotlaterthannoonofthefollowingday.

04.09.01 Employmentof“shortduration,”forthepur-posesoftheseJobPlacementRegulationsonly,shallmeanemployment which is terminated by the Individual Em-ployerotherthanforjustcausewithoutsuchEmployee’shavingreceivedfromsuchemploymenttheequivalentofforty(40)hoursofstraight-timewages.

04.09.02 AnEmployeewhoselastemploymentwasof“short duration” shall be restored to his original place on theList,orListsonwhichhewasregisteredatthetimeofhis last dispatch, provided he notifies the JobPlacementCenterofhisavailabilityforworknot later thannoonofthedayfollowingtheterminationofsuchemployment.

04.10.00 All persons on List C shall be dispatched in accordance with their experience, i.e., the most experi-encedfirstandthosewithoutexperienceintheorderofreg-istration, and when dispatched their names shall be stricken fromtheList.

04.11.00 Any Employee who refuses to accept four(4)consecutiveofferstodispatchhimshallhavehisnameplacedatthebottomoftheListonwhichheisregistered.

04.12.00 In all cases in which an Employee or ap-plicant fails to report forworkon theshift towhichdis-patched, or within the time agreed to, without good cause therefore, refuses toacceptemploymentandgo towork,

such Employee or applicant shall, be placed at the bottom of theList andhe shallnotbedispatched for thirty (30)daysfromthedateofthedispatch.

04.13.00 The Individual Employer may employ a ClassAEmployeeasdefinedhereinthroughawrittenre-quest to the Job Placement Center that such Employee be dispatched to such Individual Employer by name, or may employ such Class A Employee directly, provided that no EmployeeshallbelaidofftomakeroomforsuchEmploy-ee,andthatinthecaseofaClassAEmployeeobtaineddi-rectly,theIndividualEmployershallnotifytheJobPlace-ment Center promptly in writing so that a dispatch slip may be issued to, and received by said Class A Employee within five(5)days.

04.13.01 In either of the cases specified in Section04.14.00 above, at the time a dispatch is issued, the named ClassA Employeewill receive an employment notifica-tion card to be completed, signed and returned to the Job PlacementCenterservicingsuchjoborprojectwithinfive(5)daysbytheseniorrepresentativeoftheIndividualEm-ployer on such job or project.

04.13.02 In the event the named Employee is not reg-isteredornotavailable forworkornotwilling toacceptadispatchat the timeof thereceiptofarequest, theJobPlacementCentershallsonotifytheIndividualEmployeras soon as possible and the thirty-six (36) hour period pro-videdinSection03.04.00oftheseJobPlacementRegula-

tions shall not commence to run until receipt by the Job PlacementCenterofeitherarequestforanunnamedEm-ployeeby classificationor a further request for anamedEmployeewhoisregisteredandavailableforworkatthetimeoftherequest.

04.13.03 Theforegoingissubjecttospecialprovisionsgoverning specific Job Placement Centers as agreed tofromtimetotimebytheCommitteeprovidedforinSec-tion01.00.00oftheseJobPlacementRegulations.

04.14.00 Employees who are laid off because a jobor project is temporarily shut down because ofweather,lackofmaterialorotherreasonsbeyondthecontroloftheIndividual Employer shall, on the resumption of the joborprojectwithinsix(6)calendarmonthsofitsbeingshutdown,bedispatchedtosuchjoborprojectascallforbytheIndividual Employer by name.

04.15.00 WhenanorderforanEmployeeinarecog-nized“preferred”classificationisplaced,theJobPlacementCentershallfirstattempttofillsuchrequestwithanEm-ployeewhohasmadea“preferred”registration,contactingsuchpersonsintheorderprovidedinSection04.09.00oftheseJobPlacementRegulations.Then,ifunabletofilltherequest with such an Employee, the Job Placement Center willendeavortofilltherequestinthemannerprovidedinSection04.09.00oftheseJobPlacementRegulations.

04.16.00 Upon being dispatched, the Employee or applicant shall proceed to the job at once. When a call is

madetoaJobPlacementCenterformentoreporttoworkonthedayofrequestareasonabletimeshallbeallowedformentravelingfromtheJobPlacementCentertojobsiteasagreed by the Job Placement Center.

04.17.00 Recall and Termination Slip. Upon termina-tionofemployment, theEmployershallprovidetheEm-ployee with a Recall and Termination Slip. The Recall and Termination Slipwill designate the reason for dischargeand whether the Employee is subject to recall as provided by the Job Placement Regulations.

04.18.00 Retiree Work Agreement. Employees may be dispatched under a properly executed Retiree Work Agree-ment. (See Addendum A, attached hereto.)

05.00.00 CLASSIFICATION NUMBERS

05.01.00 The Individual Employer shall indicate the jobclassificationnumbersofallEmployeesinthecolumnmarked“JobClass(5)”ontheEmployer’sReportofCon-tributions to Operating Engineers Trust Funds. The Union shall add all classification numbers of newly dispatchedEmployees to said report. The above shall not be appli-cable to any Individual Employer who employs a computer fordataprocessing.

06.00.00 APPEALS PROCEDURE

06.01.00 AnyEmployeeorapplicantforemploymentaggrievedbytheoperationofsuchJobPlacementCenterof

the Union or these Regulations as applied to him shall have the right to submit his grievance to the Joint Committee createdbySection01.00.00oftheseregulationsbyfilingthe grievance with the Job Placement Center, provided that such submission is made in writing within ten (10) days aftertheoccurrenceofthegrievance.TheBoardshallhavefullpowertoadjustthegrievanceanditsdecisionthereonshallbefinalandbindingupontheEmployeeorapplicantforemploymentanduponallotherpartieshereto.

06.01.01 Formsforthesubmissionofsuchgrievanceshall be available at all times in each Job Placement Center.

06.02.00 This Section shall be posted on the bulletin board in each Job Placement Center and the bulletin boards of theIndividualEmployerswherenotices toEmployeesandapplicantsforemploymentarepostedwiththeregula-tions adopted by the Committee.

PART II

01.00.00 SPECIAL PROVISIONS GOVERNING SPECIFIC JOB PLACEMENT CENTERS

01.01.00 Utah Job Placement Center—Area I. RULES, REGULATIONS AND PROVISIONS(62 years or Over)

forUTAH MASTER AGREEMENT

RecognizingthatretiredEmployeesmayfromtimetotimewish to return to work on a temporary basis, the Employer and the Union have agreed that said Retiree may return to workonthefollowingbasis:

Retiree is age 62 years or over.

Retiree does not replace any Employee currently on the payrolloftheIndividualEmployer.

Retiree is requested to work only during the months ofAprilthroughNovemberofanycalendaryear.

ADDENDUM D

MANNING

SECTION 1 Assistance. All equipment shall be manned as provided in Addendum A, Article 1. In addi-tion to the manning provisions herein contained, when an Engineer requires assistance in addition to any that must beprovidedfor,heshallbeassistedbyanEmployeecov-ered by this Agreement (Assistant to Engineer, Deckhand orApprentice[RefertoArticleXI,Section23]).

SECTION 2 Notwithstanding any provisions of thisArticle relating tomanning, any piece of equipment in-volvedinexcavationforwhichnoEmployeeissettinglineorgrade,orperformingworkwhichhistoricallyhasbeenperformedbyAssistanttoEngineers,anAssistantEngineershallnotberequired.Ifassistanceisnecessary,suchassis-tanceshallbeperformedbyanAssistanttoEngineer.Intheevent a violation is alleged, and a dispute exists which can-not be resolved between the Employer and the Union, any EmployerfoundtobeinviolationofthisArticlethroughtheAdjustmentsofDisputesArticlehereinshallsuffertheapplicationofthisSectiononALL said Employer’s jobs or projectsfortheperiodoftimeandinthemannerprescribedhereunder:

The PlantEngineershallbeinchargeoftheentireplant.Inthecaseofanautomaticasphaltplant,theasphaltplantmini-mumcrew shall consist of aPlantEngineer andone (1)additional Employee.

SECTION 4 The Employer shall not assign an Assis-tanttoEngineertoperformtheworkofanOperatingEngi-neer. The Employer shall not assign an Operating Engineer toperformtheworkofanAssistanttoEngineerexceptbymutual agreement between the Union and the Employer. Theforegoingshallnotprecludetransfersforbriefemer-gencyorreliefperiods,providedareplacementhasbeenrequestedfromtheJobPlacementCenterservingthejobor project.

SECTION 5 An Operating Engineer shall maintain and service gasoline- or diesel-driven welding machines whentheweldingisbeingperformedbyanothercraft.

SECTION 6 Whenever an Employee starts, stops or operates pumps over 750 GPM (except automatic elec-tric pumps), compressors over 210 CFM (except electric compressors), more than three (3) welding machines, or generatorsover150KW,heshallbeanEmployeecoveredbythisAgreement.Anyservicingandmaintenanceoftheabove equipment regardless of size, including automaticelectric pumps and automatic electric compressors, shall alsobeperformedbyanEmployeecoveredbythisAgree-ment.

SECTION 7 Generators.

(1) Generator house: one (1) Engineer required.

(2) Not more than one (1) Engineer required on any single unit.

NOTE: Any plant (asphalt, batch, crushing plant, etc.) usingageneratorforpowerisexcludedfromSection9.

SECTION 8 Compressors. On compressor houses or manifoldcompressorsinthesamelocation:one(1)Engi-neer required.

SECTION 9 Field Survey Work. The classificationshereinreferredtoshallapplyonlytoEmployeescoveredhereby,regularlyemployedinfieldsurveywork,excluding

Employer, executive, administrative or supervisory per-sonnel, professional or office engineer personnel, drafts-men, estimators, timekeepers, messengers, guards, clerical helporfieldofficehelp,andexcludingtheuseofsurveyinstruments normally used by any other Employees in the performanceoftheirduties.

SECTION 10 Field survey work shall be that work performedbysuchEmployeesinconnectionwiththees-tablishment of control points governing construction op-erationswhenperformedbytheEmployeronanytypeofhome,officeorcommercialbuildingconstruction.“Con-trol points governing construction operations” shall be de-finedas suchvertical andhorizontal controls asmustbeestablished in connection with site preparation work be-foreactualconstructioncangetunderway.Oncommercial,office,ormulti-storiedbuildings,sitepreparationworkinconnectionwith theestablishmentof controlpointsgov-erning construction operations on locations and elevations of fills, excavations, piles, caisson, and utilities shall beconsideredtobefieldsurveywork.

SECTION 11 Onalltypesofheavy,highwayanden-gineering construction, when the Employer is required byContractingAuthority to furnishhisownfield surveyservice or when the Employer at his own discretion hires Employeestoperformfieldsurveywork,theninsuchin-stances,suchworkshallcomewithintheclassificationssetforthinArticle1oftheAddenda.

SECTION 12 Foranyfieldsurveyworkbeyondthedi-rectcontroloftheEmployer,thereferredtoclassificationsand conditions shall not apply.

SECTION 13 The Union will cooperate with the Em-ployer in the placing of student engineering trainees, solong as it does notmaterially affect the normal employ-mentofregularEmployees.

SECTION 14 When an Instrumentman is required by theEmployer toworkfromdrawings,plansorspecifica-tionswithout the direct supervision of a PartyChief, heshallbepaidattheChiefofPartyrate.

SECTION 15 When a Rodman or Chainman is re-quired to run an instrument, he shall be paid at the Instru-mentmanrateofpay.

SECTION 16 Apartyconsistingof three (3)ormoreEmployeesshallincludeaChiefofParty.

SECTION 17 On a large project using several small partiesandhavingaChiefofPartyon the jobsiteand inchargeofthesmallparties,eachsmallpartyshallhaveanInstrumentmanorChiefofPartyasoneofthemembersofthe small party.

SECTION 18 All Apprentice applicants will be select-ed in accordance with the Apprenticeship Standards and selection procedures outlined therein. All Apprentices en-tering the program shall be evaluated by the Joint Appren-ticeship Committee to determine whether they shall be a

first(1st)PeriodApprenticethroughaneighth(8th)PeriodApprenticeforOperatingEngineers,andafirst(1st)Periodthrougheighth (8th)PeriodApprentice forSurveyorAp-prentices, and they shall be paid the appropriate percent-agesas set forth inArticleXISection23. In suchdeter-minations the Joint Apprenticeship Committee’s decision shall govern.

SECTION 19 When the Employer employs more than three (3) up to and including nine (9) Journeymen Oper-ating Engineers, he may employ one (1) Registered Ap-prentice but not more than one (1). When the Employer employs more than nine (9) up to and including nineteen (19) Journeymen Operating Engineers he may employ two (2) Registered Apprentices but not more than two (2). When the Employer employs more than nineteen (19) up to and including twenty-nine (29) Journeymen Operating Engineers he may employ three (3) Registered Apprentices butnotmorethanthree(3).Thereafter,theEmployermayemploy Registered Apprentices in accordance with the above ratio. Foremen and Assistant to Engineers may not beincludedinthedeterminationofthenumberofJourneymanOperatingEngineersemployedbytheEmployerforthepurposesofthisSection.

SECTION 20 There shall not be more than one (1) RegisteredApprenticeassignedtoanypieceofequipmentmanned with more than one (1) Employee.

SECTION 21 Any Registered Apprentice absent fortwo(2)shiftswithoutpermissionoftheappropriateJ.A.C.shall be automatically replaced by an unemployed Regis-teredApprentice,andifnoneisavailable,byanapplicant.

SECTION 22 A RegisteredApprentice transferred toatrainingcenterforrelatedandotherinstructionshallbetemporarily replaced by an unemployed Registered Ap-prentice,andifnoneisavailable,byanapplicant.

SECTION 23 A Registered Apprentice may be as-signed(subject to thecontrolof theJointApprenticeshipCommittee)tooperateequipmentorperformworkcoveredby this Agreement, provided that the Registered Appren-ticeisunderthesupervisionofaJourneymanatalltimesandshallnotperformanyworkalonewhereaJourneymanor Journeymen are not present.TheutilizationofRegis-teredApprentices tooperate equipmentorperformworkshall be in accordance with the approved Apprenticeship Standards applicable to this Agreement.

SECTION 24 In the event there are no Assistant to En-gineersorPreferredClassificationEmployeesregisteredoravailable forwork inanAssistant toEngineerclassifica-tion, a Registered Apprentice shall be dispatched in lieu thereof.However,whensoemployed,theRegisteredAp-prentice shall receive the applicable Registered Apprentice rate or the applicable Assistant to Engineer rate, whichever isgreater;provided,however,aRegisteredApprenticebe-ing utilized as anAssistant toEngineer is subject to the

provisionssetforthintheJobPlacementRegulations,andsuch Registered Apprentice shall not be counted as a Reg-istered Apprentice under the Job Placement Regulations.

SECTION 25 Registered Apprentices, regardless ofanything provided in the Job Placement Regulations to the contrary, on completing their training under a Joint Ap-prenticeship Committee and achieving Journeyman status shall, on the day following, be classified aClassAEm-ployeesubjecttothelossorchangeofsuchclassificationasintheJobPlacementRegulationsofthisAgreement.

SECTION 26 Journeyman and Apprentice Training.

(1) Journeymen and Apprentices shall be entitled to six(6)weeksoftraininginanytwelve(12)monthperiodat a designated training center.

(2) IfthetrainingcenterislocatedoutsidetheStateofUtah,roomandboardforeligiblepersonsshallbepaidforby the Operating Engineers and Participating Employers, Pre-Apprentice,Apprentice and JourneymenAffirmativeAction Training Fund.

(3) Applications for training shall be made byapplying at a Utah Job Placement Center.

(4) Opportunities for training shall be on a spaceavailable basis.

ADDENDUM ESPECIAL WORKING RULES AND CONDITIONS

SECTION 1 The provisions of this Article withrespect to the work covered by this Article to the extent theydifferfromanyspecificprovisioninthisAgreementshall supersede such provision and this Section as to such provision, shall control.

SECTION 2 Single Shift.On single shift jobs, eight(8) hours between 6:00 a.m. and 5:00 p.m. shall constitute aday’swork;five(5)consecutivedaysofeight(8)hourseach, Monday through Friday inclusive, shall constitute a week’s work. To the extent permitted by law, the Employer, uponconsentoftheUnion,mayestablishafour(4)byten(10) hour workweek, Monday through Thursday only. In theeventthatworkcannotbeperformedMondaythroughThursdaybecauseofinclementweather,majormechanicalbreakdown or a holiday, Employees may make up such lost day on Friday and be paid at the applicable straight-time rate.

SECTION 3 Multiple Shifts.Multiple shifts may beestablishedbyworkingfive(5)consecutivedays.Allshiftworkundergroundshallbeeight(8)hours’workforeight(8)hours’pay.Theshiftsshallrunconsecutivelywithnotmorethanaone(1)hourbreakbetweenshifts.Thestart-ingtimeonthefirstshiftofmultipleshiftoperations,shallbe between 6:00 a.m. and 8:00 a.m. Once established, the starting time shall not be changed except by mutual con-sentoftheEmployerandtheUnion.

SECTION 4 The regular straight-time workweek, un-lessamendedbymutualconsentoftheEmployerandtheUnion,shallbeginandendasfollows:

(1) Single-shiftworkbeginsat6:00a.m.MondayandendsattheendofthedayshiftFriday.

(2) Two-shiftworkbeginsattheestablishedstartingtime between 6:00 a.m. and 8:00 a.m. Monday and ends at thequittingtimeofthesecond(2nd)shiftonFriday.Shiftsshall run consecutively with not more than a one (1) hour breakbetweenshifts.

(3) Three-shiftworkbeginsattheestablishedstartingtimeof8:00a.m.Mondayandendsatthequittingtimeofthethird(3rd)shiftonFriday.

UponmutualconsentoftheEmployerandtheUnion,afour(4) by ten (10) hour workweek, Monday through Thursday only,maybeestablishedfor two-shiftoperations. In theevent that work cannot be performed Monday through

Thursdaybecauseofinclementweather,majormechanicalbreakdown or a holiday, Employees may make up such lost day on Friday and be paid at the applicable straight-time rate.Allfour(4)byten(10)hourshiftworkshallbeten(10)hours’workforten(10)hours’pay.

SECTION 5 Once established, the three-shift opera-tionsasdefinedinSection4shallapplyonallworkthere-after, including Saturdays, Sundays and holidays. Oncesuchthree(3)shiftoperationshavebeenestablished,theyshall not terminate other than on a Friday, except upon completionofshiftoperations.

SECTION 6 Rolling 410 Shifts.(RefertoArticleXI,Section3,ofthisAgreement.)

SECTION 7 It is agreed that the Employer and the Unionmaymutuallyagreeinwritingupondifferentstart-ingorquittingtimesforanyoftheabove-mentionedshiftarrangements.

SECTION 8 IfanEmployeeworkspartofashiftun-dergroundandpart outside, they shall bepaid for actualtime worked underground and outside the tunnel.

SECTION 9 Overtime. Overtime will be paid under thetermsandconditionsofArticleXI,Section5KofthisAgreement.

SECTION 10 Holidays. Holidays will be the same as listedinArticleXI,Section6,ofthisAgreement.

SECTION 11 These Special Working Rules and Conditions cover all work and equipment involved in the excavationandinitiallining,ifapplicable,belowthesurfaceoftheearthexceptopenditches,excavationsandjackingoperations under highways, railroads, embankments, etc., but not limited to tunnels, shafts, tunnel shafts, adits,raises, subways, chambers and underground installations includingbutnotlimitedtopowerhouses,storagefacilities,offices, control centers or surge chambers including thelining of same which fall within the jurisdiction of theUnionor require theoperationof equipmentof thekindor type covered by this Agreement. Where open cutwork is covered over or decked, regardless of thematerial ormaterials used, and men are required to work under such cover, they shall work and be paid in accordance with the termsandconditionsofthisArticleforallexcavationwork.

SECTION 12 Compensation for Travel Underground. The Employer shall pay Employees covered by this Agreement working underground on a one-way travel basisonly.TheEmployershallpaythecostoftraveloneway over the longest distance traveled either going to or fromthejob.

SECTION 13 Change House. The Employer shall establish and maintain a change house within a reasonable distanceofeachworkingportaloftheundergroundwork.Itshallbeequippedwithshowers,toiletfacilities,lockersand heating and drying facilities in accordancewith the

numberofmenineachcrew.Eachchangehouseshallbeconstructed to provide that all clothing will dry between shifts. The Employer will reimburse Employees forclothing or personal belongings in an amount up to one hundred dollars ($100.00) in the event the change house is destroyedbyfire,providedaclaimformisfiledasrequiredby the applicable insurance company. This shall not apply to short dry tunnels, such as under highways or railroad embankments.

SECTION 14 If the change house is located morethan one thousand two hundred fifty (1,250) walkablefeet from a portal, then the time ofwork shall start andendforpaypurposesat thechangehouse.ThisshallnotaffectthewellestablishedpracticeofEmployeeswhoarerequiredtoreportbeforetheirregularstartingtimetofireup, grease, or maintain equipment, or are required to report earlyorremainaftertheirregularshift.TheseEmployeesshall be paid at the applicable overtime rate which shall be reckonedbythehourandthehalf-hour.

SECTION 15 Special Clothing. The Employer shall furnish rubber clothing, boots, safety hats, or any otherspecial gear required at no expense to the Employees. Such equipment shall be returned to the Employer in the same conditionsubjecttoreasonablewearandtear.Afterthefirstissue,specialclothingshallonlybereissuedafterthereturn to the Employer of the worn out or damaged clothing.Failure to return said worn out or damaged clothing shall

resultintheEmployerbeingabletodeductfromthenextor last paycheck, whichever the case may be, the actual costofsuchspecialclothing.

SECTION 16 Manhaul Vehicles for Underground Work.Manhaulvehiclesusedforpersonneltransport,butnotdesignedforthispurpose,shallbeprovidedwithsafeseatingandsideandendprotectiontopreventfalls.Con-venientmeansofmountinganddismountingthevehiclesshall be provided. Adequate protection shall be provided duringinclementweather.Abellorothermeansofcom-munication with the operator shall be installed.

SECTION 17 Any physical examination required by theEmployershallbepaidforsolelybytheEmployerandshall be accomplished on the Employer’s time.

STEEL FABRICATING AND ERECTING WORK

SECTION 1 Manning under this Article shall be as provided in Addendum E, “Manning,” except tank erection work or structural steel work which shall be manned as provided in this Article.

SECTION 2 The provisions of this Article withrespect to the work covered by this Article to the extent theydifferfromanyspecificprovisionsoftheAgreementshall supersede such provisions and this Section as to such provision shall control.

SECTION 3 A Heavy Duty Repairman performingworkonequipmentbeingoperatedtoserviceothercraftsshall be paid the wage rate set forth inArticle 1 of theAddenda.

SECTION 4 Coverage. This Article shall cover and apply to all work performed and power-operated equip-ment customarily operated by the Union in conjunction withthecrewsoftheInternationalAssociationofBridge,Structural and Ornamental Iron Workers Union, with the International Brotherhood of Boilermakers, Iron Ship-builders, Blacksmiths and Helpers, or with the United As-sociationofJourneymenandApprenticesofthePlumbingandPipeFittingIndustryoftheUnitedStatesandCanada,orwiththeInternationalBrotherhoodofElectricalWork-ers,orwiththeInternationalBrotherhoodofBricklayers.

SECTION 5 Crews. Employees working four (4)hours or more in conjunction with a crew or crews consisting of four (4) men or more of the crafts listedbelow shall be covered by and under this Article:

(1) International Association of Bridge, Structural andOrnamental Iron Workers Union

(2) International Brotherhood of Boilermakers, IronShipbuilders, Blacksmiths, and Helpers

(3) UnitedAssociationofJourneymenandApprenticesofthePlumbingandPipeFittingIndustryoftheUnitedStatesand Canada

(4) InternationalBrotherhoodofElectricalWorkers

(5) InternationalBrotherhoodofBricklayers

SECTION 6 Group Wage Classifications. On all work coveredbythisSection,whenperformed,refertoArticle1, Classifications and Rates for Steel Fabrication andErection,oftheAddenda.

SECTION 7 Hiring. The hiring of Employeescovered by this Agreement shall be in accordance with the Job Placement Regulations established in the Agreement between the Union and the Employer.

SECTION 8 Working Rules. On the work covered by this Article, the general working rules shall be the same as thoseoutlinedinArticleXIofthisAgreement.

SECTION 9 IfanEmployeeperformsworkcoveredby thisAgreement in conjunctionwith another craft thatreceivesovertime for any timeworked, or between8:00a.m. and 4:30 p.m., on any day worked, such Employee shall be compensated on the same basis and the same overtimerateofpay.

SECTION 10 The fringe benefits in thisArticle shallbe the same as those contained in the Addenda.

SECTION 11 ThisArticle shall not apply toworkofa temporary nature. “Temporary” shall be interpreted as meaninganyworkperformed ina singledayof four (4)hours or less.

SECTION 12 In lieu of subsistence, the Area 2differentialofthreedollars($3.00)perhourshallapply.

PILEDRIVING

SECTION 1 The provisions of this Article withrespect to the work covered by this Article to the extent theydifferfromanyspecificprovisioninthisAgreementshall supersede and such provision and this Section as to such provision shall control.

SECTION 2 Coverage. This Section shall cover all workoftheEmployerintheStateofUtahthatcomesunderthe recognized jurisdiction of the InternationalUnion ofOperatingEngineersandisperformedinconjunctionwithPiledrivers,Bridge,WharfandDockBuilders(U.B.ofC.&J.ofA.,AFL-CIO).

SECTION 3 Crews. Employees working in conjunctionwithacrew(acrewshallconsistof four[4]menofwhomone[1]shallbeaForeman)ofPiledrivermenfour(4)hoursormoreonanyshiftshallbecoveredbyandundertheprovisionsofthisArticle.

SECTION 4 Wages and Classifications. On all work coveredbythisSectionwhenperformed,refertoArticle1,ClassificationsandRatesforPiledriversoftheAddenda.

SECTION 5 The fringe benefits applicable to thisArticle shall be the same as those contained in the Addenda.

SECTION 7 Overtime. If an Employee performswork covered by this Agreement in conjunction with anothercraftthatreceivesovertimeforanyperiodoftimebetween 8:00 a.m. and 4:30 p.m., on any day worked, such Employee shall be compensated on the same basis and the sameovertimerateofpay.

SECTION 8 On offshore work, where the amountof time spent in travel from shore exceeds fifteen (15)minutes, Employees are to travel on the Employer’s time.

SECTION 9 On diesel or gasoline crane rigs with boilers or compressors attached, the crew shall consist of two (2) Operating Engineers, and they shall receivea minimum of one-half (1/2) hour at time and one-half(1-1/2) (in addition to their pay for straight-time work)forraisingsteamontheboilerandoilingthecranewhenrequiredbeforethestartoftheregularshift.Oncranerigswith boilers detached, the Employee assigned to the boiler shallreceiveaminimumofone-half(1/2)hourattimeandone-half(1-1/2)(inadditiontotheirpayforstraight-timework).

SECTION 10 On equipment with detached boiler, the crew shall consist of three (3) Employees: anOperatingEngineer and an Assistant to Engineer, and either an

AssistanttoEngineeror,whentheEmployeeinchargeofthe boiler operates the hammer valve, a Group 4 Operating Engineer.

SECTION 11 For raising steam on any equipment before a shift begins, except as otherwise provided,effective:

July 1, 2006 - $15.30

SECTION 12 When Employees covered by this Articleareemployedtoserviceanothercraftorcraftsthatwork a shorter day or shorter week, such Employees shall beaffordedtheopportunitytoearnanamountequaltoafullshift,fulldayorfullweek,asthecasemaybe,attheapplicable straight-time wage rate.
