BILLS OF QUANTITIES

PREAMBLES AND INSTRUCTIONS TO BIDDERS ON BILLS OF QUANTITIES

A. GENERAL INSTRUCTIONS

1. The bidder is required to check the numbers of the pages of these Bills of Quantities against the contents statedon the Table of Contents and should he find any missing, in duplicate or indistinct he must inform the ProjectManager at once and have the same rectified

2. These bills of quantities have been issued in three volumes (volume 3: Builder's Work, Volume 4, MechanicalInstallations and Volume 5, Electrical Installations). The total amounts for each element in the Mechanical andElectrical Bills of Quantities shall be carried forward to the Final Summary page of the Volume 3 and inserted in thespaces allocated. Therefore, the bid price shall include all amounts from Volume 3, Volume 4 and volume 5.

3. Should the bidder be in doubt about the precise meaning of an item or figure, for any reason whatsoever, heshall inform the Project Manager in order that the correct meaning may be decided before the date for submissionof Tenders. No liability will be admitted or claim allowed in respect of errors in the Contractors bid due to mistakesin the Bills of Quantities which should have been rectified in the manner described.

4.The accurate ordering of materials is the sole responsibility of the Contractor in accordance with the finaldrawings and the instructions from the Project Manager. No claim for any loss or expense will be entertained fororders for materials based upon Bills of Quantities.

5. The Bills of Quantities shall be priced in Uganda Shillings.

6. The unit rates used to price these bills of quantities shall be inclusive of duties and taxes but exclusive of ValueAdded Tax which shall be added at the Final Summary Page of these bills

B. DEFINITIONS OF TERMS

The terms, phrases and abbreviations shall be deemed to have the following meanings wherever used hereinafterand in all Contract Documents.

Approved shall mean approved by the Project Manager at his absolute discretion

Directed shall mean directed by the Project Manager at his absolute discretion.

Selected shall mean selected by the Project Manager at his absolute discretion.

m3 shall mean cubic metre.

m2 shall mean square metre.

m shall mean linear metre.

mm shall mean linear millimeter.

Kg shall mean Kilogramme.

No shall mean Number.

Prs shall mean Pairs.

B.S. shall mean the current British Standard Specification published by the British Standards Institution, 2 Park,Street, London, W.I., England.

AAMA. shall mean the current Standard Specification published by the American Architectural Manufacturer'sAssociation.

FGMA. shall mean the current Standard Specification published by the Flat glass Marketer's Association of theUnited States of America.

ASTM. shall mean the current Standard Specification published by ASTM International.

As described shall mean as described in the Description of Materials and Workmanship contained in the appendicesto these Bills of Quantities.

Ditto shall mean the whole of the preceding description except as qualified in the description in which it occurs.Where it occurs in descriptions of succeeding items it shall mean the same as in the first description of the series inwhich it occurs except as qualified in the description concerned. Where it occurs in brackets it shall mean thewhole of the preceding description, which is contained within the appropriate brackets.

Do shall mean the whole of the preceding description except as qualified in the description in which it occurs.

Fix only shall mean take delivery in Kampala (unless otherwise stated), pay all demurrage and transport charges,load and transport to site where necessary, unload, store, unpack, check contents against orders and packing lists,assemble as necessary, distribute to position, hoist and fix only.

"PCC " Shall mean "Particular Conditions of Contract" of the General Conditions of Contract

"Clerk of Works" shall mean a person engaged by the Employer and stationed on site to ensure that works aregenerally executed to the required specified standards and monitors the works on a day to day basis."SiteEngineer" shall mean a person engaged by the Employer and stationed on site to ensure that structural and civilworks are executed to the required specified standards and monitors the works on a day to day basis.

C. GROUPED SIZES.

Girths, depths or sizes grouped together in the Bills of Quantities item descriptions by means of hyphenated upperand lower limits shall be interpreted as exceeding the lower limit and not exceeding the upper limit.

D. DESCRIPTION OF THE SITE

The site of the proposed works is located on Plot 8-10 on Lourdel Road, Kampala in the Republic of Uganda. Thesite is situated on the slopes of Nakasero Hill, north of the business district of the city. The site is bounded byYusuf Lule Road and Lourdel Road. The size of the plot is approximately 1.348 hectares with a gentle slope (leveldifference of 10m) between the southwest and north eastern ends.

The site is presently overgrown with grass and bush. Several big trees are on the site, some of which shall beremoved and others preserved.

There exist eight dilapidated houses on site, which will have to be demolished to pave way for construction.

Sewere lines, storm drains, water mains, power lines, telephone and optical fiber utilities exist along Yusuf Luleand Lourdel Roads.

The site is surrounded by existing office buildings that are currently in use. The Contractor shall ensure that noiseor any other nuisance to these neighbouring properties is avoided or minimised at all times.

This information is issued without warranty and the Contractor must visit the site and will be deemed to havesatisfied himself with regard to the conditions of the site, the nature of and conditions under which the works willhave to be carried out and materials and goods delivered to the site, the supply of and conditions affecting labour,means of vehicular and pedestrian access and circulation, security requirements, hoarding and phasingrequirements and the facilities for storage and obtaining the articles or materials referred to in these Bills ofQuantities.

No claim by the Contractor for additional payment will be allowed on the ground of any misunderstanding ormisapprehension in respect of any such matter or otherwise. Any damage caused to existing accesses, buildings,property and roads must be made good as directed by and to the approval of the Project Manager.

E. DESCRIPTION OF THE WORKS.

The works within this contract comprise construction of the following:-

The Works consist of construction to completion of the following:

1. Administration WingThe Administration Wing comprises four floor levels, that is, Lower Ground Floor, Ground Floor, First Floor

and Second Floor. Construction is generally of reinforced concrete frame with concrete block walling, steel roofstructure, galvanized roof covering, aluminium framed glazed windows, timber, steel and aluminium doors,terrazzo, granito and ceramic wall and floor finishes, mild steel balustrading, joinery and fittings. Under this phaseof construction, construction of this wing shall be restricted to the Lower Ground Floor only.

Electrical and mechanical installations comprise small power and lighting, installations, voltage regulation,uninterruptible power supply, lifts, structured cabling, surveillance, fire detection, fire fighting, mechanicalventilation, plumbing and drainage installations.

2. Records WingThe Records Wing building comprises five floor levels, that is, Basement, Lower Ground Floor, Ground

Floor, and First Floor. Construction is generally of reinforced concrete frame with concrete block walling, steel roofstructure, galvanized roof covering, aluminium framed glazed windows, timber, steel and aluminium doors, securitydoors, terrazzo, granito and ceramic wall and floor finishes, mild steel balustrading, joinery and fittings.

Electrical and mechanical installations comprise small power and lighting, installations, voltage regulation,uninterruptible power supply, lifts, structured cabling, surveillance, fire detection, fire fighting, mechanicalventilation, plumbing and drainage installations.

3. Electrical and mechanical installations are to be executed by domestic sub contractors that shall be approved bythe Project Manager.

This information is given for guidance purposes only and is without warranty.

F. VALUATION OF LUMP SUM PRELIMINARY COSTS

Lump sums entered in these Bills of Quantities against any item of General Conditions, Preliminaries or any otherlump sums will be included in appropriate valuations based on breakdown of lump sums into costs ofestablishment, maintenance and removal.

G. MATERIALS ON SITE

All materials and workmanship used in the execution of the works shall be of the best quality and descriptionunless otherwise described.

The contractor shall order all imported materials in good time and shall also order materials to be obtained fromlocal sources as early as necessary to ensure that they are all on site when required for use in the works.

The Bills of Quantities shall not be used for the purpose of ordering materials.

H. PAYMENT FOR MATERIALS ON SITE

All materials for incorporation in the works must be stored on or adjacent to the site before payment is effected,unless specifically exempted by the Project Manager. This is to include the materials of the contractor, NominatedSub-contractors, and Nominated Suppliers.

Payment for materials stored off site will only be permitted if the Project Manager is satisfied as to the condition ofthe store, its security, insurance of materials stored therein and the identification and legal ownership of thematerials.

I. AGREEMENT AND CONDITIONS OF CONTRACT

These works shall be based on the Standard Bidding Documents, Procurement of Small Works, publishedby the the World Bank, Washington D.C., November 2010 edition together with any other amendments andclarifications published thereafter.

Any reference to Clauses will be deemed to mean clauses of the above document. The contractor is advised toacquaint himself with the provisions of these clauses.

J. SUFFICIENCY OF TENDER

The contractor shall be deemed to have satisfied himself before tendering as to the correctness and sufficiency ofhis tender for the works and of the rates and prices stated in the priced bills of quantities, which rates and pricesshall cover all his obligations under the contract and all matters and things necessary for the proper completionand maintenance of the works.

K. STANDARD METHOD OF MEASUREMENT

These bills of quantities have been prepared in accordanace with th Standard Method of Measurement for BuildingWorks, Second Edition (Metric) (Third Reprint), February 1996 Edition, published by the Architectural Association ofKenya.

L .DISCREPANCIES IN DESCRIPTIONS

Drawings and Technical Specifications shall take precedence over descriptions contained in Bills of Quantities in theevent of discrepancies, unless the Project Manager shall otherwise direct.

M. MATERIALS ARISING FROM EXCAVATIONS AND DEMOLITIONS

Materials of any kind obtained from the excavations and demolitions shall be the property of the client. Unless theProject Manager directs otherwise such materials shall be dealt with as provided in the contract.

Such materials shall only be used in the works, in substitution of materials which the contractor would otherwisehave had to supply with the written permission of the Project Manager. Should the permission be given, thecontractor shall make due allowance for the value of the materials so used at a price to be agreed.

N. ALTERATIONS TO BILLS OF PRICING, ETC

Any unauthorized alterations or qualifications made to the text of the bidding documents may cause the bid to bedisqualified and will in any case be ignored.

The contractor shall be deemed to have made allowance in his prices generally to cover any items against whichno price has been inserted in the priced bidding documents.

All items of measured work shall be priced in detail and bids containing Lump Sums to cover trades or groups ofwork must be broken down to show the price of each item before they will be accepted. Lump Sums to cover anyitems of preliminaries shall be likewise broken if so required.

O. PROVISIONAL WORK

The work described as "Provisional" in these Bidding documents is subject to remeasurment in order to ascertainthe actual quantity executed for which payment will be made.

All "Provisional" and other work liable to adjustment under this contract shall be left uncovered for a reasonabletime to allow all measurements needed for such adjustment to be taken by the Project Manager. Immediately thework is ready for measuring, the contractor shall give notice to the Project Manager.

P. TRADE NAMES

Where trade names or manufacturers catalogue numbers are mentioned in these Bills of Quantities, the referenceis intended as a guide to the type of article or quality of materials required. The Contractor may use any article ormaterial equal in type or quality to those herein described subject to the prior approval of the Project Manager andat his absolute discretion. The onus of proof as to equivalent quality will rest with the Contractor, whose tenderwill be deemed to include for the makes described herein.

A ACCESS TO SITE

Means of access to site will be from Lourdel Road or as directed by the Project Manager.

The Contractor must allow for providing, forming and maintaining all necessary temporarycrossings and access roads to the site, removing same at completion and making gooddamaged or disturbed surfaces as directed by and to the approval of the Project Manager.

The contractor must allow for keeping the existing public highways and roads clean and formaking good all damage to the satisfaction of the Project Manager and Local Authority.

B AREA TO BE OCCUPIED BY THE CONTRACTOR

The areas to be occupied by the contractor for use as storage or for the erection ofworkshops etc., shall be defined on the site(s) by the Project Manager and the Contractormust confine his activities to the areas so marked and must ensure that his own andsub-contractors' workmen do not trespass on the adjoining property or cause inconvenienceto its occupiers.

C DRAWINGS

The Contractor will be deemed to have examined the drawings before tendering and tohave satisfied himself regarding their details and regarding the nature and extent of theworks and the method of construction involved. No claims arising out of misapprehension inthese respects will be allowed.

Drawings may be seen by appointment at the offices of the Employer during normalworking hours.

The works are to be executed in accordance with the drawings referred to in Section VI ofthis Bidding Document together with any drawings which may be supplied in amplificationor amendment thereof.

A OTHER CONTRACTORS

The Contractor shall cooperate and share the Site with other contractors, public authorities,utilities, and the Employer between the dates given in the Schedule of Other Contractors, asreferred to in the Particular Conditions of Contract. The Contractor shall also providefacilities and services for them as described in the Schedule.

B ENVIRONMENTAL MANAGEMENT

The contractor shall be required to ensure that damage to the environment is avoided orminimized and mitigation measures as prescribed by the National Environment Act (Cap 153of the Laws of Uganda), National Environment (Noise Standards and ControlRegulations),2003, and National Environmental and Management Authority (NEMA) and theEnvironmental Impact Assessment Statement from time to time are adhered to.

C POLICE REGULATION

The Contractor shall allow for complying with any relevant police or local authorityregulations.

D PROGRAMME AND PROGRESS

The Contractor shall furnish to the Project Manager, within a period of time specified inSection VIII: Particular Conditions of Contract, for approval and display in the site offices, aProgramme and Progress Chart devised in such a way that the lined programme is shownand progress can be marked up as the work proceeds. The Contractor shall keep this chartup to date at all times.

This chart shall be generated and up-dated by an approved computer programme such asMicrosoft Project or Primavera.

Approval by the Project Manager of the programme shall not relieve the Contractor of anyof his obligations under the Contract.

The Contractor shall not without the Project Manager consent make any material alterationto the approved programme.

The Contractor shall submit to the Project Manager for approval an updated Program atintervals no longer than the period stated in the Particular Conditions of Contract (PCC). Ifthe Contractor does not submit an updated Program within this period, the Project Managermay withhold the amount stated in the PCC from the next payment certificate and continueto withhold this amount until the next payment after the date on which the overdueProgram has been submitted.

If the Project Manager decides that progress does not match the programme, he may orderCarried to Collection U G X

the Contractor to revise the programme. The Contractor shall thereafter revise theprogramme to show the modifications necessary to ensure completion of the works by theIntended Completion Date

The Project Manager shall notify the Contractor if the Project Manager decides that the rateof progress of the works or any section, is too slow to meet theIntended Completion Dateand that is not due to a circumstance for which the Contractor is entitled to an extension oftime under the Contract.

Following receipt of such a notice the Contractor shall take such steps as may be necessary,and as the Project Manager may approve, to remedy or mitigate the likely delay, includingrevision of the programme. The Contractor shall not be entitled to any additional paymentfor taking such steps.

The contractor, upon receipt of instructions on possession of the other sections, in the eventthat only section I had been taken possession of, revise the programme to incorporate thesection or sections taken possession of.

A PROGRESS AND RECORD PHOTOGRAPHS

The contractor shall provide a digital camera on site for use by the Clerk of Works in takingprogress and record photographs every fortnight, throughout the duration of the contract.The contractor shall also allow for downloading of the digital photographs to CD-ROMincluding provision of the discs and CD - writing facility.

The copyright of the digital photographs shall be and remain the copyright of the Employerand shall not be used for any purpose except with the express permission of the Employer.

B BLASTING OPERATIONS

No blasting shall be allowed.

A DAYWORKS

The Project Manager may, if in his opinion it is necessary or desirable, order in writing thatany additional or substituted work shall be executed on a Daywork basis. The Contractorshall then be paid for such work in accordance with Daywork rates and percentage additionsas inserted hereafter in these Bills of Quantities.

The Contractor shall furnish to the Project Manager all receipts or vouchers as may benecessary to prove the amounts paid and before ordering materials shall submit to theProject Manager quotations for the same approval.

In respect of all work executed on a Daywork basis the Contractor shall, during thecontinuance of such work, deliver each day to the Project Manager a list in duplicate of thenames, occupation and time of all workmen employed on such work and a statement also induplicate showing the description and quality of all materials and plant used thereon ortherefore (other than plant which is included in the percentage addition on net amount ofwages).

One copy of each list and statement will, if correct or when agreed, be signed by the ProjectManager and returned to the Contractor. At the end of each month the Contractor shalldeliver to the Project Manager a priced statement of the labour, material and plant (exceptas aforesaid) used and the Contractor shall not be entitled to any payment unless such listand statements have been fully and punctually rendered.

Provided always that, if the Project Manager shall consider that for any reason the sendingof such list or statement by the Contractor in accordance with the foregoing provision wasimpracticable, he shall nevertheless be entitled to authorize payment for such work either asDaywork (on being satisfied as to the time employed and plant and materials used on suchwork) or at such value thereof as he shall consider fair and reasonable.

B NO WORKMEN TO BE HOUSED ON SITE

Laborers shall not be housed on site. The cost of transporting labour to and from site orelsewhere shall be deemed to be included in the tender.

C APPROVED SUB-CONTRACTORS

Where in these Bills of Quantities work is described to be executed by an approvedSub-Contractor, the firms appointed will be treated as Sub-Contractors employed by theContractor and not as nominated Sub-Contractors. The unit prices for such work must,therefore, include not only the Sub-Contractors charges but also the Contractors overheads,profits and attendance.

A APPROVAL OF PROJECT MANAGER FOR EMPLOYMENT OF SUB-CONTRACTORS

The Contractor will be required to obtain approval of the Project Manager in writing beforeemploying any of his own domestic (i.e. not nominated) Sub-Contractors for any portion ofwork. Subcontracting shall not alter the Contractors obligations.

B EXISTING PROPERTY

The Contractor shall take every precaution to avoid damage to all existing propertyincluding roads, cables, drains and other services and he will be held responsible for alldamage arising from the execution of this Contract to the aforementioned and he shallmake good all such damage where directed at his own expense to the satisfaction of theProject Manager.

C WHITE ANTS AND TERMITES

Allow for destroying any white ants and termites nests found in the vicinity of the buildings,destroying Queen Ants, depositing cyanide lumps in holes and tunnels and filling withhard-core and murram well rammed and sealed.

D TESTING

GENERAL PRELIMINARIES

A PLANT, TOOLS AND VEHICLES

Allow for providing all plant, tools and vehicles required for the works except insofar as maybe stated otherwise herein and except for such items specifically and only required for theuse of other subcontractors as described herein. No timber used for scaffolding, formworkor temporary works of any kind shall be used afterwards in the permanent works.

B TRANSPORT

Allow for transport of workmen, materials, etc. to and from the site at such hours and bysuch routes as may be permitted by the local authorities.

The Contractor shall also be required to adhere to any rules and regulations imposed by theGovernment of the Republic of Uganda and allow for any costs arising therefrom.

C SIGN FOR MATERIALS SUPPLIED

The contractor will be required to sign a receipt for all articles and materials supplied by theEmployer at the time of taking delivery thereof, as having received them in good order andcondition, and will thereafter be responsible for any loss or damage with articles and/ormaterials which will be supplied by the Employer at current market prices including CustomsDuty, all at the Contractor's own cost and expense, to the satisfaction of the ProjectManager.

A SAMPLES

The Contractor shall furnish at his own cost any samples of materials or workmanship forthe works that may be called for by the Project Manager for his approval or rejection andany further samples in the case of rejection until such samples are approved by the ProjectManager, and the Project Manager may reject any materials or workmanship not in hisopinion up to the approved samples.

The Project Manager shall arrange for testing of such materials as he may at his discretiondeem desirable but the testing shall be made at the expense of the Project Manager andnot at the expense of the Contractor unless the materials fail to pass the test or are in theopinion of the Project Manager not in accordance with the specification, in either case theContractor shall pay for testing in accordance with the current scale of testing charges laiddown by the relevant local authorities.

The procedure for submitting samples of materials for testing and the method of markingfor identification shall be as laid down by the Project Manager .

B GOVERNMENT ACTS REGARDING WORKPEOPLE ETC

Allow for complying with all Government Acts, Orders and Regulations in connection withthe employment of labour and other matters related to the execution of the works and hisbid must include for all costs arising or resulting from compliance with any act, Order orRegulation relating to insurances pensions and holidays for workpeople or to the safetyhealth or welfare of workpeople.

The Contractor must make himself fully acquainted with current Acts and Regulations,including Police Regulations, regarding the movement, housing, security and control oflabour, labour camps, passes for transport, etc. It is most important that the Contractor,before bidding shall obtain from the relevant Authority the fullest information regarding allsuch regulations and/or restrictions which may affect the organisation of the works, supplyand control of labour etc., and allow accordingly in his bid.

No claim in respect of want of knowledge in this connection will be entertained.

A SAFETY AND PROTECTION OF WORKMEN

The Contractor shall be responsible for the Occupational Health and Safety of theemployees and any other visitors to the site.

The Contractor shall allow for training all employess on issues of site safety andoccupational health that should acquaint them with safety rules, regulations and practicalaspects of safety. In addition to this, the Contractor shall be required to maintain on site atall times a safety manual.

The Contractor shall ensure that all laws, rules or regulations relating to OccupationalHealth and Safety as stipulated by the Government from time to time are enforced at alltimes on site and he shall employ a safety professional that will be stationed on site at alltimes to ensure compliance. Such a safety professional shall must possess traing in first aid.

The Contractor shall allow for providing protective equipment and gear such as overalls,gum boots, steel capped boots, safety harnesses, dust coats, dust masks, gloves and hardhats to his workmen to protect against injury and occupational illness at all times.

He shall also ensure that all his equipment is at all times in good, safe working conditions toprevent accidents.

The Contractor must also maintain on site at all times a well stocked first aid kit foremergency use and ensure that its contents are replenished from time to time with use.

The Contractor shall maintain on site a log and summary of all recordable injuries andillnesses (resulting in a fatality, hospitalization, lost workdays, medical treatment, jobtransfer or termination, or loss of consciousness) for that location, and enter eachrecordable event no later than 6 working days after receiving the information. Where thecomplete log and summary records are maintained at a place other than the site, a copy ofthe log that reflects the injury and illnesses experience on the site must be completed andcurrent to date within 45 calendar days and must be available at the original site. Inaddition to the log of occupational injuries and illnesses, each employer must have availablefor inspection on site within 6 working days after notification of a recordable case, asupplementary record for each occupational injury or illness for that site.

An adequate supply of potable water must be provided on site. Portable drinking watercontainers must be capable of being tightly closed and equipped with a tap. Using acommon drinking cup is prohibited. Where single service cups (to be used but once) aresupplied, both a sanitary container for unused cups and a receptacle for used cups must beprovided.

A SECURITY OF WORKS, ETC

The Contractor shall be entirely responsible for the security of all work, stores, materials,plant, personnel, etc. both his own and other Sub-Contractor's and must provide allnecessary watching, lighting and other precautions as necessary, watching, Lighting andother precautions as necessary to ensure security against theft, loss or damage and theprotection of the public.

B VISIT SITE AND EXAMINE DRAWINGS

The contractor is adviced to examine the drawings and visit the site the location of which isdescribed in the Particular Conditions of Contract. He shall be deemed to have acquaintedhimself therewith as to its nature, position, means of access or any other matter which mayaffect his bid. No claim arising form his failure to comply with this recommendation will beconsidered.

C SITE LEVELS

Before commencing work the contractor must arrange for and agree with the ProjectManager the existing site levels and similarly establish and agree a benchmark.

The levels and bench mark thus agreed will then be used for the duration of the works forall purposes. The contractor should therefore make allowance forall costs incurred.

D SETTING OUT

The Contractor shall set out the works in accordance with the dimensions and levels shownon the drawings and shall be responsible for the correctness of all dimensions and levels soset out by him and will be required to amend all errors arising from inaccurate setting out athis own cost and expense. In the event of any error or discrepancy in the dimensions orlevels marked on the drawings being discovered, such errors or discrepancies must bereported by the Contractor to the Project Manager for his immediateattention.

Before any work is commenced by sub-contractors or specialist firms, dimensions must bechecked on the site and agreed with the Contractor irrespective of the comparabledimensions shown on the drawings. The Contractor shall be responsible for the accuracyof such dimensions.

A EXISTING SERVICES

Prior to the commencement of any work the contractor is to ascertain from the relevantauthority the exact position, depth and level of all existing services in the area and he/sheshall make whatever provisions that may be required by the authorities concerned for thesupport, maintenance and protection of such services.

B SITE OFFICES

The contractor shall erect and maintain site offices to the approval of the Project Manager.The site office shall accomodate the Contractor's site management staff, Site Engineer,Clerk of Works and shall have adequate space for storage of drawings and bills ofquantities. The site office shall also have a meeting room of enough capacity to accomodatea minimum of fifty persons.

The same shall be removed at completion and all surfaces disturbed made good.

The contractor shall allow for providing furniture for proper storage of drawings,bills ofquantities, other records, chairs and meeting desk to accommodate all project teammembers during meetings.

The Contractor shall also allow for making available a water closet and wash basin for thesole use of the Project Manager and other Consultants, and for paying all costs inconnection therewith.

The contractor shall also allow for providing the services of a messenger, for keeping bothoffice and closet in a clean sanitary condition from the commencement to the completion ofthe works, and or dismantling at completion and making good all disturbed surfaces. Theoffice shall be completed before the contractor will be permitted to commence the works.

C SHEDS FOR STORAGE OF MATERIALS

The Contractor shall provide, erect and maintain on the site, in such positions as may bedirected, ample temporary watertight, lock-up sheds for the proper storage and protectionof cement and other materials liable to damage and shall remove same at completion andmake good all surfaces disturbed. He shall also provide space for storage accommodationwhich Sub-Contractors may wish to erect for themselves.

A SIGNBOARD

The Contractor must allow for providing, erecting and maintaining one site signboardlocated along Lourdel road and adjacent to to the site gate, the size, type of constructionand lettering of which shall be to the Project Manager's design. The names of theConsultants are to be in lettering 50mm high. The Contractor shall also allow for any feespayable to the Local Authority in relation to the signboard.

The board is to be fixed in an elevated position on the site (s) where indicated by theProject Manager. On completion of the works, the notice board shall be removed andmaking good shall be carried out as necessary.

B SANITATION OF THE WORKS

The sanitation of the works shall be arranged and maintained by the Contractor to thesatisfaction of the Government and/or Local Authorities, Labour Department and the ProjectManager.

The contractor shall allow for, erecting and maintaining where directed a lock-up hutcontaining a pedestal type water closet and wash basin for the sole use of the Employer'sRepresentatives, Project Manager and other consultants, including providing equipment,making temporary connections to drains and water supplies and paying all charges forconnections, conservancy and bills arising from the use of the services.

The shed and water closet shall be completed before the contractor will be permitted tocommence the works.

The Contractor shall also allow for providing the necessary temporary toilets for the labouremployed on the works, including labour employed by Sub-Contractors and otherContractors employed by the Employer, to the satisfaction of the Health and MedicalAuthorities and for maintaining the same in a thoroughly clean and sanitary condition andpaying all charges.

Pit latrines shall not be allowed.

The Contractor shall allow for removing the said facilities and leaving the ground clean andfree form pollution upon completion to the satisfaction of the Health and MedicalAuthorities.

A SUPERVISION DURING THE WORKING HOURS

The works shall be executed under the direction and to the entire satisfaction in all respectsof the Project Manager who shall at all times during normal working hours have access tothe works and to the yards and workshops of the contractor and other subcontractors orother places where work is being prepared for the contract.

The working hours shall be those generally worked by good employers in the building andcivil engineering trades in Uganda. No work shall be carried out at night or on gazettedholidays unless the Project Manager shall so direct. No work shall be carried out in theabsence of the Clerk of Works or Site Engineer without the prior approval of the ProjectManager in writing.

B HOARDING

The contractor shall enclose the whole area of the site or part of the works underconstruction as directed by the Project Manager, with a hoarding 2400mm high consisting ofiron sheets (minimum Gauge 28) on 100 x 50mm timber posts firmly secured at 1800mmcentres with two 75 x 50mm timber rails. The hoarding shall have a gate to allow forpedestrian and heavy commercial vehicle and mobile plant accee to the site. The hoardingshall also have a window to enable site security personel to scrutinise visitors to the site.

The contractor is in addition required to take all precautions necessary for the safe custodyof the works, materials, plant, public and Employer's property on site.

The contractor should also allow for any local authority costs associated with hoarding.

The Contractor shall also allow for thoroughly maintaining the same throughout theContract and clearing away and making good disturbed surfaces on completion. Allmaterials arising shall remain the property of the Contractor and he should allow creditagainst this accordingly.

The hoarding shall not be used for advertising.

C FOREMAN IN CHARGE

The Contractor shall keep constantly on site a General Foreman in charge of the Projectwho shall be experienced and fluent in English.

He shall also keep other trades foremen as specified in Volume I (Section III, part 2.5) ofthese Bidding Documents who shall properly qualified and experienced in their trades all tothe approval of the Project Manager.

A WATER FOR THE WORKS

The Contractor shall allow for providing all temporary water supplies required for the worksincluding Sub-Contract works, and works by others engaged directly by the Employer,together with all necessary storage tanks and distribution systems for the same and mustallow for bearing all expenses incurred in application, connection and paying for all waterconsumed without charge to any Sub-Contractor. Expenses in connection with NominatedSub-Contractors should be allowed for in the attendance items under the relevant P.C.Sums.

The Contractor shall also allow for thoroughly maintaining the same throughout theContract and clearing away temporary installations and making good disturbed surfaces oncompletion.

B LIGHTING AND POWER FOR THE WORKS

The Contractor shall allow for providing all temporary lighting and power supplies requiredfor the works, including Sub-Contract works, works by others engaged directly by theEmployer and all testing of installations, together with all necessary distribution systems forthe same and must allow for bearing all expenses incurred in application, connection andpaying for all current consumed without charge to any Sub-Contractor or any othercontractor engaged directly by the Employer. Expenses in connection with NominatedSub-Contractors should be allowed for in the attendance items under the relevant P.C.Sums.

The Contractor shall also allow for thoroughly maintaining the same throughout theContract and clearing away temporary installations and making good disturbed surfaces oncompletion.

C CROSSINGS AND TEMPORARY ROADS

The Contractor must allow for providing, forming and maintaining necessary crossings on tothe site and temporary roads as may be required by the Project Manager and removingsame at completion and making good damaged or disturbed surfaces as directed by and tothe approval of the Project Manager.

A TELEPHONE

The Contractor shall arrange for a telephone to be installed in the site office. TheContractor shall pay all charges for hire or purchase of equipment, licenses, connecting,rental and calls made.

Cell phone services could also be provided for use on site and the contractor should beresponsible for all expenses involved as in the case of normal land line.

B WORK TO BE OPENED UP AT THE REQUEST OF THE PROJECT MANAGER

The Contractor shall, at the request of the Project Manager within such time as the ProjectManager shall name, open for inspection any work covered up, and should the Contractorrefuse or neglect to comply with such request, the Project Manager may employ workmenother than those employed by the Contractor to open up the same. If the said work hasbeen covered up in contravention of the Project Manager's instructions, or if, on beingopened up, it be found not in accordance with the drawings, specifications or Bills ofQuantities or the instructions of the Project Manager, the expenses of opening and coveringit up again whether done by the Contractor or by the Project Manager, shall be borne byand be recoverable from the Contractor or may be deducted from any monies due to theContractor.

If the work has not been covered up in contravention of such instructions and be found inaccordance with the said drawings and Bills of Quantities, then the expenses aforesaid shallbe borne by the Employer, and be added to the Contract Sum; provided always that, in thecase of foundations or of any other urgent work so opened up and requiring immediateattention, the Project Manager shall within a reasonable time after the work has beenopened, make or cause to be made the inspection thereof, and at the expiration of suchtime, if such inspection shall not have been made the Contractor may cover up the sameand shall not be required to open it up again for inspection except at the expense of theEmployer.

C SCAFFOLDING

The Contractor shall allow for providing, erecting and dismantling all general scaffoldingrequired for the works. The Contractor must allow here or in his rates for providing allspecial scaffolding required by his Sub-Contractors, other than Nominated Sub-Contractors,or other contractors engaged directly by the Employer, carrying out works for which P.C.Sums are required in these Bills. Where the Contractor is required to provide specialscaffolding for these latter Sub-Contractors, an item is included for pricing under therelevant P.C. Sum.

A PROTECTION OF WORKS

The Contractor shall allow for the protection of his own and his Sub-Contractors work liableto damage including provision of temporary roofs, gutters, drains, etc., if necessary andshall case-up, cover or in other suitable ways protect all finished work liable to damage, tothe satisfaction of the Project Manager until completion of the Contract.

From the beginning to the completion of the works, the same shall be under the entire careand control of the Contractor, who shall take all precautions required by the ProjectManager to prevent any nuisance, inconvenience or injury to the holders or occupiers ofsurrounding properties and to the public generally, and shall at all times keep all paths androads affected by the works in a safe and clear state, and shall use proper precautions toensure the safety of all wheeled traffic and pedestrians.

The Contractor shall allow for providing all watching, lighting, barriers, covering opentrenches and protection of the works, including Sub-Contract works, as may be necessaryfor the safety of the works and for the protection of the public and his own Sub-Contractorsemployees.

In event of any damage or loss occurring to the works, or to materials or any sewers,gullies, drains, paths, or other works on the site in temporary possession of the Contractorfor the purpose of this Contract, either from the weather, want of proper protection,defects, theft, insufficiency of the works, or any other cause whatsoever during the progressof the works, or for any accident or damage to property or persons by the reason of thesaid works, the Contractor alone shall be responsible and shall without extra charge, makegood all damage and pay all costs incurred.

B REMOVAL OF PLANT, RUBBISH ETC.

The Contractor must allow for removing and clearing away all plant, rubbish and unusedmaterials, and leaving the whole of the site of the works in a clean and tidy state atcompletion to the satisfaction of the Project Manager. He must also allow for removing allrubbish and dirt from the site as it accumulates during the performance of the Contract inaccordance to provisions of the Kampala City Council (solid Waste Management )Ordinance, 2000.

A REMOVAL OF EXCAVATED MATERIALS

The Contractor must allow for in his rates any restrictions imposed by the Government ofUganda, its agencies or local authorities. Such restrictions may relate to time of ferryingexcavated material from site and restrictions on the location of dump sites.

It shall be assumed that the contractor has acquainted himself to any such restriction andhas identified suitable dumping sites approved by the Government of Uganda, its agenciesor local authorities and rates for loading and carting away of such materials are deemed toinclude any resultant costs.

It is the sole responsibility and risk of the Contractor to identify such suitable dumpingsite(s) and no claims shall be entertained whatsoever for his failure to do so.

B WORKS TO BE DELIVERED UP CLEAN

On completion of the contract, the site and the works shall be cleared of all plant,scaffolding, rubbish and unused materials and shall be delivered up clean and in perfectcondition in every respect to the satisfaction of the Project Manager. Particular attention isto be paid to leaving all windows and floors clean and removing all paint and cement stains.

NOTE: The contractor is strongly instructed to visit the siteand fully ascertain the nature and scope of structureshereafter described as for demolition before pricing, and isrequested to raise any questions that appertain to thebuildings to be demolished, that may affect or influence thepricing. Questions should be addressed to the ProjectManager.

No claims arising from his failure to do so shall beentertained.

The Contractor is to allow for all temporary protectionrequired during the works including ordinary and specialdust screens, hoarding, barriers, warning signs etc asdirected by the Project Manager and as necessary for theprotection of the existing structure and finishings, workmenemployed upon the site and the public.

All protective devices are to be removed on completion ofthe work and any necessary making good consequent uponthis is to be executed to the satisfaction of the ProjectManager.

The works shall be executed in such order and sequence asthe Project Manager may direct and with as little disruptionand inconvenience as possible shall be caused to the normalfunctioning for the Employer, the staff and the publicincluding the adjacent property occupiers.

All existing works shall be propped and strutted andsupported as necessary before the demolition work iscommenced. Prices shall include for all necessarypreparatory work to structure and finishings and all making

Unless described as being stored on site all arisings, debrisand surplus materials resulting from the demolitions shall becarted away from the site and prices shall be deemed toinclude all credit allowances, unless an additional credit isoffered by means of a lump sum deduction on the collectionpage of this bill. All existing work shall be made good up tonew surface and cleaned to the entire satisfaction of theProject Manager.

Items described as being stored on site shall be carefullyremoved from the existing building and stored securely onsite until required for re-use. Materials to be re-used shallbe cleaned down, made good as necessary and re fixed inposition. The contractor shall be entirely responsible forany breakages or damage which may occur during thisprocess unless it is certified by the Project Manager thatsuch breakage or damage was inevitable as a result of thecondition of the item concerned or its method of fixing, inwhich case the cost of replacement will be borne by theEmployer.

DIRECT CHARGES

Payment for direct charges authorised by the Project Managerto be incurred in Dayworks will be the approved net cost ofsuchdirect charges plus the percentage addition to be insertedbelow by the Contractor.

The ' approved net cost of direct charges' ( covered by aprovisional sum below) shall mean the approved invoiced costof work executed by the Sub-Contractors or specialists afterdeduction of trade discounts but without deduction of cashdiscounts not exceedind 2.5% which shall be retained by theContractor.
