Affirmations & Assurances As the Director of Urban Discovery Academy Charter School, I, Cynthia A Kelley, hereby certify that the information submitted in this renewal petition for a California public charter school named Urban Discovery Academy Charter School Inc, and located within the boundaries of the San Diego Unified School District, is true to the best of my knowledge and belief, I also certify that this petition does not constitute the conversion of a private school to the status of a public charter school, and further, I agree that the Charter School:

• Shall meet all statewide standards and conduct the student assessments required, pursuant to Education Code Sections 60605 and 60851, and any other statewide standards authorized in statute, or student assessments applicable to students in non-charter public schools. [Ref. Education Code Section 47605(c)(1)]

• Shall be deemed the exclusive public school employer of the employees of the Urban Discovery Academy Charter School for purposes of the Educational Employment Relations Act. [Ref. Education Code Section 47605 (b)(5)(O)]

• Shall be non-sectarian in its programs, admissions policies, employment practices, and all other operations. [Ref. Education Code Section 47605(d)(1)]

• Shall not charge tuition. [Ref. Education Code Section 47605(d)(1)] • Shall admit all students who wish to attend the Urban Discovery Academy

Charter School and who submit a timely application, unless the Charter School receives a greater number of applications than there are spaces for students, in which case each application will be given equal chance of admission through a public random drawing process. Admission to the Charter School shall not be determined according to the place of residence of the student or his or her parents within the State. [Ref. Education Code Section 47605(d)(2)(A)-(B)]

• Shall not discriminate on the basis of the characteristics listed in Section 220 (actual or perceived disability, gender, nationality, race or ethnicity, religion, sexual orientation, or any other characteristic that is contained in the definition of hate crimes set forth in Section 422.55 of the Penal Code or association with an individual who has any of the aforementioned characteristics). [Ref. Education Code Section 47605(d)(1)]

• Shall adhere to all provisions of federal law related to students with disabilities including, but not limited to, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act of 1990 and the Individuals with Disabilities in Education Improvement Act of 2004.

• Shall meet all requirements for employment set forth in applicable provisions of law, including, but not limited to credentials, as necessary. [Ref. Title 5 California Code of Regulations Section 11967.5.1(f)(5)(C)]

• Shall ensure that teachers in the Charter School hold a Commission on Teacher Credentialing certificate, permit, or other document equivalent to that which a teacher in other public schools are required to hold. As allowed by statute, flexibility will be given to non-core, non-college preparatory teachers. [Ref. California Education Code Section 47605(l)]

• Shall at all times maintain all necessary and appropriate insurance coverage. • Shall, for each fiscal year, offer at a minimum, the number of minutes of instruction

per grade level as required by Education Code Section 47612.5(a)(1)(A)-(D). • If a pupil is expelled or leaves the Charter School without graduating or

completing the school year for any reason, the Charter School shall notify the superintendent of the school district of the pupil’s last known address within 30 days, and shall, upon request, provide that school district with a copy of the cumulative record of the pupil, including a transcript of grades or report card and health information. [Ref. California Education Code Section 47605(d)(3)]

Will follow any and all other federal, state, and local laws and regulations that apply to the Urban Discovery Academy Charter School including but not limited to: • The Urban Discovery Academy Charter School shall maintain accurate and

contemporaneous written records that document all pupil attendance and make these records available for audit and inspection.

• The Urban Discovery Academy Charter School shall on a regular basis consult with its parents and teachers regarding the Charter School's education programs.

• The Urban Discovery Academy Charter School shall comply with any jurisdictional limitations to locations of its facilities.

• The Urban Discovery Academy Charter School shall comply with all laws establishing the minimum and maximum age for public school enrollment.

• The Urban Discovery Academy Charter School shall comply with all applicable portions of the No Child Left Behind Act.

• The Urban Discovery Academy Charter School shall comply with the Public Records Act.

Introduction and Overview Executive Summary Urban Discovery Academy is a K-8 charter school which opened in August of 2008. The School is located at 2850 6th Avenue, Suite 110. Urban Discovery Academy is organized as an independent 501(c)(3) non-profit corporation. Urban Discovery Academy is directly funded by the State, operating under a separate charter with its own CDS number. Urban Discovery Academy continues to seek a long term, permanent facility, but may request an allocation of district facilities under Proposition 39 or seek to work other arrangements with the District. Urban Discovery Academy acts as the employer of all staff. The Academy uses certain District services including: student pupil accounting, SARC Reporting and student testing. Mission The mission of Urban Discovery Academy is to provide a rigorous education that develops the whole child as a scholar, athlete, artist and democratic member of society. Vision The vision of Urban Discovery Academy is to help “America’s Finest City” create an urban village that is not only physically beautiful but also a beautiful place to raise and educate children. Parents in the downtown community continue to look for quality public educational options for their children. We believe that Urban Discovery Academy attracts involved families who volunteer and participate in the education of their children. The school community is inter-connected with the community at large, with the support of civic leaders, businesses and resident organizations who believe our charter enhances and enriches our community. Historical Data and Successes Urban Discovery Academy was established in 2008 by a dedicated group of parents and educators. UDA opened its doors in September of 2008 with 98 students enrolled in the Kindergarten - 6th grade program. In the fall of 2009, UDA enrolled 197 students and added a second Kindergarten and 1st grade class, as well as a new 7th grade. The program for 7th graders builds on UDA’s mission of educating the whole child and implements the best teaching and learning philosophies for middle school children. UDA’s approach to middle school instruction is to challenge each student academically at his/her own ability level and provide project-based learning opportunities that engage the passions and interests of these students. In 2009, word of UDA’s rigorous academics balanced with exciting curriculum quickly spread and a waiting list for grades K – 3rd were formed. Today, UDA educates more than 300 students in grades K – 8th and maintains waiting lists for most grade levels. Of the current student population, approximately 27% are African American, 21% Hispanic

or Latino, 48% White, and the remaining population is comprised of students who are Asian, Filipino, Native American, and Pacific Islander. Successes • Student achievement at Urban Discovery Academy continues to exceed both the

State and District average. UDA currently has a State Rank API score of 8 which places the school in good standing regarding renewal under AB1137. Our most recent API score for the 2011 – 2012 school year was 876.

• The API scores for the previous years include: o 2009 = 834 o 2010 = 863 o 2011 = 836 o 2012 = 876

• Urban Discovery Academy (UDA) has had an outside audit every year and has

continually had no material weaknesses. • UDA continues to have a positive fund balance that exceeds the required • reserve amount • UDA has operated the school in a fiscally sound manner • In 2011 UDA joined the El Dorado SELPA and employed one Education Specialist

and two full time aides. Urban Discovery Academy also contracts out for a Psychologist, Speech Pathologist, and Occupational Therapist. With this program we have been able to work with the classroom teachers and the students to directly improve student performance in the classroom. The program is also responsible for implementing and creating Individual Education Plans (IEP’s).

• UDA has a very active community and parents volunteer well over their 40 • required hours • In September of 2011 UDA was granted Initial Full WASC Accreditation. We will

continue to work over the next 16 months to prepare for our full site visit and plan to receive WASC’s highest accreditation with a 6 year term.

• One of our teachers was recognized by a national teaching award, “The 7 Wonders of the USA Teacher Tour” sponsored by the Wonder Bread Company. Beth Teeple was selected out of an applicant pool of over 3,000 and won 25 Android Tablets for Urban Discovery Academy as well as a trip to Washington D.C. to teach a lesson that was live streamed into her classroom in May of 2012

• In 2008 Urban Discovery Academy was awarded News 8’s Cool School Award • In 2009 Lori Korovec, one of our teachers, won the local “Teachers Are Heroes”

contest sponsored by Azusa Pacific University & San Diego County Office of Education.

Description of Community and School Location Students who attend Urban Discovery Academy come from all areas of the county. Urban Discovery Academy is currently located at 2850 6th Avenue, Suite 110, San Diego, CA 92103. We are currently in search for a permanent facility located in, near or easily accessible to downtown San Diego. Urban Discovery Academy offers activities and adult supervision Monday – Friday from 7:00am to 6:00pm. The calendar year typically follows the traditional San Diego Unified school calendar. Students in all grade levels participate in more than the state mandated number of instructional minutes per school year. The instructional day is from 8:00am – 3:00pm for students in grades K – 3 and 8:00am – 3:30pm for students in grades 4th – 8th. Urban Discovery Academy Charter School Provides • A Project Based Learning curriculum that is both engaging and rigorous for all

students; • A balanced program that includes Visual and Performing Arts classes; • A physical education program that provides physical education classes,

structured recess, health, track and field, and team sports; • A program that develops the emotional and social self through the adopted

Olweus Bully Prevention Program, participation in School Families and community service projects through our Urban Outreach elective;

• A safe, nurturing environment that reaches all students; • A supportive professional development program that is and will be constantly

monitored and changed when necessary to maximize our positive impact.

Urban Discovery Academy Students Acquire • An education that allows students to meet or exceed California • Standards in all subjects including but not limited to: Reading/Language Arts,

Mathematics, Social Studies and Science allowing all students to meet or exceed comparable district-wide performance, and allowing Urban Discovery Academy to meet or exceed its Academic Performance Index target;

• Collaboration skills and the ability to work with others to solve problems both academic and social in nature;

• Emotional maturity, including empathy and the willingness to be responsible for personal actions;

• A clear understanding of responsibilities and rights concerning their schoolmates, staff and faculty, family members, community, country, and world;

• Critical thinking and individual learning opportunities;

Urban Discovery Academy Faculty The faculty members at Urban Discovery Academy are role models for developing a life-long love of learning, team collaboration and professionalism. The faculty is held accountable for ensuring that Urban Discovery Academy students achieve high academic standards through a rigorous education program. All faculty members have the freedom and the responsibility for supporting the development of all academic programs. Urban Discovery Academy identifies the following key points of our educational philosophy: 1. All students can achieve at high levels and should have high expectations. This

belief is: • Emphasized in the Mission, Vision, and Educational Plan • Utilized as a key component when hiring staff and planning professional

development • Seen in staff evaluations and classroom observations

2. All subjects are presented to all students with equal rigor and strategies,

materials, and approach will vary depending on each students educational needs. Urban Discovery Academy commits to: • Use of a wide range of materials including but not limited to state approved

texts and resources • Creation and implementation of Individual Education Plans (IEPs) for all

Special Education students

3. A variety of assessments will be used to show what students know compared to the California State Standards / Common Core Standards. Urban Discovery Academy commits to: • Analyzing test scores and making adjustments to the curriculum and

professional development as needed • Parent-Teacher Conferences at least twice a year, and sometimes 3 times a

year, if needed • Creating portfolios for all students to show growth from the day they start

school at UDA until they graduate in 8th grade • Creating rubrics to assess student performance on projects and presentations

Urban Discovery Academy commits to: • Bi-weekly grade level team meetings • Aligning curriculum maps across grade level teams • Creating projects across grade levels to enforce collaboration amongst all

students 5. Professional development is ongoing and is based on what teachers and

professionals need to continue to grow and make certain that all students are held to high standards. Urban Discovery Academy commits to: • Create and implement Individual Teacher Professional Growth Plans

• Provide professional development and training on a monthly basis to meet school goals

Element 1 – Educational Program “A description of the educational program of the school, designed, among other things, to describe what the school intends to accomplish, to identify those whom the school is attempting to educate, what it means to be an 'educated person' in the 21 Century, and how learning best occurs. The goals identified in that program shall include the objective of enabling pupils to become self-motivated, competent, and lifelong learners.” California Education Code § 47605 (b) (5) (A). Students to be Served Urban Discovery Academy (UDA) educates students in grades kindergarten through eighth grade. UDA will continue to comply with minimum age requirements for public school attendance and maintains student records in compliance with Education Code section 47612.5. The student population will continue to be drawn from all of San Diego County. The school participates in events and outreach programs to continue to increase enrollment and develop a diverse student population. DESCRIPTION OF EDUCATIONAL PROGRAM Urban Discovery Academy provides students with a high-quality, inner-city education that is tailored to individual needs and that inspires student inquiry. That is: a rigorous education that develops the whole child as a scholar, athlete, artist and democratic member of society. Using a project based method of learning; students will become critical thinkers and problem solvers while developing the knowledge necessary for success in the 21st century. The curriculum is grounded in the idea that children learn through real-life interactions. Urban Discovery Academy accomplishes this by celebrating each individual’s achievements. Class sizes continue to be small, with a preferred student/teacher ratio of about 20 to 1 in the lower grades and 25 to 1 in the upper grades. Teachers will continue to work with a California standards based curriculum (“State Standards”), continuing to emphasize literacy and analytical skills. They function in cross-disciplinary teams to increase the integration and depth of subject matter, and increase student/instructor communication. Staff participates in on-going professional development and collaboration. Urban Discovery Academy prepares students to flourish in school and in the broader community as they meet the challenges of the 21st century. Urban Discovery academy is a school where education is the shared responsibility of the school, family, student and society.

Urban Discovery Academy’s course requirements meet all state academic standards applicable to charter schools. Pre-admission orientation sessions, parent and public communications, parent meetings, classroom instruction, and end of unit projects will clarify the Academy’s learning expectations to Urban Discovery Academy stakeholders. Urban Discovery Academy maps its curriculum to State Standards. The standards mapping is generated through professional development and the interaction of the teachers and the learning community. The primary measure of the success of the education program is performance on state assessments. Urban Discovery Academy has achieved full initial accreditation through WASC and will continue over the next 16 months to seek the full 6 year accreditation. Teaching Methodologies The curriculum fosters the natural curiosity of adolescents and focuses on the development of critical thinking. Children have the right to be educated in a safe, nurturing environment in which they are respected as unique individuals, and are challenged to achieve their full potential. By utilizing skill development clusters twice a day; once for reading and once for math, a comfortable environment for all students to reach their personal academic goals is created. Project based activities refine basic skills by interweaving cross-curricular content with reading, writing, and math. All of our students are graded using standards-based report cards. The programs and practices employed at Urban Discovery Academy are based on educating the whole child. Existing successful models are continually refined to meet the needs of San Diego’s inner-city learners. The Academy’s approach to learning will be derived from the works of Howard Gardner, Jean Piaget, and John Dewey. Urban Discovery Academy implements a Foreign Language program into the curriculum. Students of foreign languages have access to a greater number of career possibilities and develop a deeper understanding of their own and other cultures. Evidence suggests that children who receive second language instruction are more creative and better at solving complex problems. The benefits to society are many. Americans fluent in other languages enhance our economic competitiveness abroad, improve global communication, and maintain our political and security interests (Kathleen Marcos, 1998). Students of foreign languages score statistically higher on standardized tests conducted in English. In its 1992 report, College Bound Seniors: The 1992 Profile of SAT and Achievement Test Takers, the College Entrance Examination Board reported that students who averaged 4 or more years of foreign language study scored higher on the verbal section of the Scholastic Aptitude Test (SAT) than those who had studied 4 or more years in any other subject area. These

findings are consistent with College Board profiles for previous years. (Kathleen Marcos, 1998). Studies have shown, and experience has supported, that children who learn a language before the onset of adolescence are much more likely to have native-like pronunciation. A number of experts attribute this proficiency to physiological changes that occur in the maturing brain as a child enters puberty. Of course, as with any subject, the more years a child can devote to learning a language, the more competent he or she will become. Regardless, introducing children to alternative ways of expressing themselves and to different cultures generally broadens their outlook and gives them the opportunity to communicate with more people (Kathleen Marcos, 1998 & Bamford, K. W., and D. T. Mizokawa. 1991).

At Urban Discovery Academy, instruction aims to strike a balance between student interests/needs and providing an exemplary educational program that meets state standards. Based on John Dewey's philosophy that education begins with the curiosity of the learner, Urban Discovery Academy will use a spiral path of inquiry: asking questions, investigating solutions, creating new knowledge as we gather information, discussing our discoveries and experiences, and reflecting on our new-found knowledge. An old adage states: "Tell me and I forget, show me and I remember, involve me and I understand." The last part of this statement is the essence of inquiry-based learning. Inquiry implies involvement that leads to understanding. Furthermore, involvement in learning implies possessing skills and attitudes that permit you to seek resolutions to questions and issues while you construct new knowledge (Joe Exline 2004).

Urban Discovery Academy will continue to follow the State of California Framework/Content Standards in all subjects including: Language Arts, Math, Science, Social Studies, Physical Education, Health, Foreign Language and Visual and Performing Arts. Urban Discovery Academy implements the instructional materials, scope and sequence of skills to be taught as outlined in the various standards aligned curricula. The curricula is central in refining professional development and instructional methods. Additional resources are consistent with and supportive of student progress towards meeting state standards. Instructional Methods Our instructional strategies are simple practices that have proven highly effective in other inner-city programs: Direct Instruction: a rigorously developed lesson that provides constant interaction between teacher and student with clearly defined objectives. Literature Circles: a student centered reading activity that provides an opportunity for students to control their own learning; to share thoughts, concerns and their understanding of the events of the novel. Guided Reading: teacher provided support for small groups of readers as they learn to use various reading strategies (context clues, letter and sound relationships, word structure, and so forth). Field Trips: engaging with the greater community to enhance on-going classroom investigations. All of our students are tested at least bi-monthly in order to assess student performance. This process enables us to identify the individual performance and progress of students and if necessary, communicate these findings to parents and other educators. Advanced students are given the opportunity to expedite their learning by participating in Learning Clusters. This may include reading, and math

in higher grades. They also participate as peer tutors, helping other students who are struggling to understand concepts. Below grade level and other at-risk students have individualized intervention plans. These plans assist the students in becoming proficient and may include one-on-one tutoring with teachers, aids, or peers and small group rotations. Their work will be leveled and guided in order to master concepts. Urban Discovery Academy students meet all academic standards as adopted by the State Board of Education applicable to charter schools. Urban Discovery Academy intends to promote its students with: • A diploma from the Urban Discovery Academy • A transcript and course of study that meets all requirements for entry into a

traditional public school. • Skills that prepare each student to be positive, successful members of society in

school and life. Testing: All grades take monthly tests to track the progress of the students and the success of the school against state standards. Students with difficulties will require individualized intervention plans. Staff development workshops provide teacher training in testing and student test preparation. Field Trips: In order to engage students, they need “hands-on” exposure and real world experiences. Field trips with a specific academic focus are highly encouraged. They are typically planned at the culmination of a unit of study or at the commencement of a new unit. Field trips are planned by Teacher Teams. The practical application of aligned curriculum and sound pedagogy will continue to be essential components of the Urban Discovery Academy model. State-adopted curricula and State-recommended professional development will be followed. Urban Discovery Academy will adopt scientifically research-based, effective and replicable programs such as: Guided Reading, Guided Math, Literature Circles, and Writer’s Workshop. Instructional Minutes Urban Discovery Academy will continue to offer, at a minimum, the same number of minutes of instruction as set forth in Education Code section 46201(a)(3). The typical school day begins at approximately 8:30 A.M. and ends at 3:30 P.M. Urban Discovery Academy reserves the right to refine its master calendar at any time in the best interests of its student population. While Urban Discovery Academy envisions itself as a school of daily attendance, this charter also sanctions the possibility of independent study as an adjunct to its regular program. If independent study is provided, the Academy will comply with state laws relating to independent study as set forth in Education Code section 47612.5. MEETING THE NEEDS OF ALL STUDENTS Plan for English Language Learners Urban Discovery Academy will continue to meet all applicable legal requirements for English Language Learners (“ELLs”) relative to annual notification to parents, student identification, placement, program options, English Learner and core content instruction, teacher qualifications and training, reclassification to Fluent English Proficient (“FEP”) status, monitoring and evaluation of program effectiveness, and standardized testing requirement. Urban Discovery Academy shall implement policies to effectuate proper placement, evaluation, and communication regarding ELLs and the rights of parents and pupils. Every student, new to the California Public Schools, will be administered the Home Language Survey (“HLS”). All attempts will be made to retrieve a copy of the HLS from students previously enrolled in a California Public School. Urban Discovery Academy will follow all California English Language Development Test (“CELDT”) timelines to ensure ELLs receive appropriate instruction. The Academy will continue to comply with No Child Left Behind requirements with regard to ELLs. English Language Learners have daily access to the core curriculum. Instruction techniques, assessments, materials, and approaches will focus on achieving the California State goals for English Language Learners including: acquiring full proficiency in English as rapidly and effectively as possible and meeting state standards for academic achievement. Urban Discovery Academy also focuses on communicative competence and academic achievement covering listening, speaking, reading, and writing skills (aligned with California English Learner and Content Standards) in all areas of the curriculum. ELL students will continue to receive instruction and core content instruction appropriate for their English proficiency and grade levels. In addition, the instructional program for Urban Discovery Academy is designed to promote language acquisition and proficiency, oral language development, and enriched learning opportunities for all ELLs. Urban Discovery Academy uses the below criteria to determine Fluent English Proficiency for ELLs consistent with legal requirements regarding standardized testing and other required assessments. In addition, Urban Discovery Academy monitors ELLs to ensure on-going academic success for reclassified students for at least three years from their reclassification date. Reclassification procedures will utilize multiple criteria in determining whether to classify a pupil as proficient in English including, but not limited to, the following: • Assessment of language proficiency using an objective assessment instrument

including, but not limited to, the CELDT;

• Parental opinion and consultation, achieved through notice to parents or guardians of the reclassification and placement including a description of the reclassification process and the parent’s opportunity to participate, and encouragement of the participation of parents or guardians in the Academy’s reclassification procedure including seeking their opinion and consultation during the reclassification process.

• Comparison of the pupil’s performance in basic skills against an empirically established range of performance and basic skills based upon the performance of English proficient pupils of the same age that demonstrate to others that the pupil is sufficiently proficient in English to participate effectively in a curriculum designed for pupils of the same age whose native language is English.

For English Language Learners, the Urban Discovery Academy ELL strategy provides a content-based ELL program during whole class instruction. Teachers draw on the ELL components of Language Arts curriculum and align curriculum with the ELL standards as set forth by the State of California. During whole class instruction teachers utilize materials within the curriculum and engage students by using thematic planning and SDAIE strategies. Use of manipulatives, visuals, graphic organizers, and interactive communication are just a few of the ways teachers create an educational environment that fosters language acquisition through content based lessons. Small group intervention will be provided. Teachers work on simplifying classroom materials using SDAIE methods in an English speaking setting. When needed, teachers work one-on-one with students to ensure that beginning English speakers progress at an accelerated rate. All teachers are or will be trained in or certified as BCLAD or CLAD Cross-cultural Language and Academic Development (“CLAD”). Urban Discovery Academy will continue to implement SDAIE strategies and the GLAD program in each classroom to meet the needs of all learners. Urban Discovery Academy monitors teacher qualifications and the use of appropriate instructional strategies with ELL learners. UDA continually audits student identification and placement as well as on-going progress. Urban Discovery Academy oversees the availability of adequate resources. Plan for Academically High-Achieving Students At Urban Discovery Academy, high-achieving students are identified as those scoring advanced on the adopted standardized tests. Gifted students at Urban Discovery Academy thrive in the student-centered learning environment. Skill-development

clusters in reading and math will allow students to go beyond grade level expectations and meet personal academic goals. Students achieving above grade level in any academic area will have opportunities for more challenging work and leadership roles within the school. Project-based learning provides opportunities for high-achieving students to take advantage of their interests and knowledge of a particular subject, while problem solving and using higher-order thinking skills. Teachers may also enlist parent volunteers to extend and enrich activities for students. High-achieving students will continue to be given opportunities to work cooperatively to solve problems and also to teach or lead a group in order to solidify concepts. Additional opportunities include small group instruction, supplemental coursework and homework. Plan for Academically Low-Achieving Students and Other At-Risk Students At Urban Discovery Academy, low-achieving students are those who fall below the 50th percentile on the adopted standardized test and/or fall below learning behavior, language acquisition, and fine and gross motor skills on a developmental continuum. Low Achieving students are also identified as those who score below basic or far below basic on the adopted standardized tests. At Urban Discovery Academy at-risk students are students who achieve at or below the 40th percentile on adopted state tests who may or may not qualify for special education services, and whose achievement potential is not being realized. Plan for Special Education As of July 1, 2011, Urban Discovery Academy Charter School is an LEA, under the auspices of El Dorado Charter SELPA for special education purposes, as approved by the California State Board of Education.

Urban Discovery Academy Charter School will follow the Special Education Local Plan and Policies and Procedures developed by El Dorado Charter SELPA. Urban Discovery Academy Charter School will utilize SEIS, the IEP Computer system used by El Dorado Charter SELPA to track IEPs and timelines. All required special education reports will be filed in a timely manner. Urban Discovery Academy Charter School will adhere to all special education state and federal regulations.

Urban Discovery Academy Charter School is a member of The San Diego Special Education Improvement Authority (JPA). The San Diego Special Education Improvement Authority will offer a continuum of services for all identified special education students.

All identified special education students attending Urban Discovery Academy Charter School will continue to receive the appropriate services as delineated on

• Extended School Year services beginning in the 2010 school year

Use of Technology in the Education Program Urban Discovery Academy recognizes that access to and utilization of technology is vital to preparing students for secondary and post secondary education as well as for productive placement in the business and professional world. We realize that access to technology and the Internet for low income families and for their school-age children are often limited. UDA creates, and maintains a computer lab with 26 laptops that students access at least once a week. UDA also maintains at least 3 or 4 computers in every classroom to ensure every student has easy access to technology and the Internet. Urban Discovery Academy continues to seek improved and increased technology every year. UDA also currently has 25 Android Tablets that students have access to for lessons and instruction. Urban Discovery Academy recently purchased iPads for classroom instruction as well. UDA will continue to strive to bring in more iPads, tablets, and laptops for the students to access. Students use technology to create projects, research information and organize presentations. UDA provides appropriate safeguards to ensure access to educational information, such as fire walls and other filters. UDA also provides students and parents with internet safety information.

BEING AN EDUCATED PERSON IN THE 21st CENTURY

An educated person in the 21st century needs critical thinking skills, creativity, collaboration and global connections; making easy and flexible associations among various disciplines of thought. They will need adaptability to new situations, new information and the ability to make informed judgments. This person will require keen critical and logical thinking skills; a facility for clear oral and written communication skills; information literacy competency; and the ability to respect others’ individuality and creativity, as well as one’s own. The educated 21st century person has integrity and accepts responsibility for personal decisions, is imaginative, manages their time in a responsible manner, has empathy and courtesy for others and respect for differences among people and cultures. They will lead healthy lifestyles, have the ability to listen, share opinions, negotiate compromise and help a group reach consensus. They will be self-confident, self-motivated, and productive members of our society. The essence of Urban Discovery Academy is self-discovery, curiosity and accountability. We enable students to become lifelong learners, self-motivated, and competent by providing them with a strong foundation in reading, writing, math, social studies, science, arts, and athletics through a program that educates the whole child. They appreciate and cherish their right to be an active member of the community and the world. HOW LEARNING BEST OCCURS Learning best occurs in a safe, nurturing school environment that fosters mutual respect, trust, intellectual curiosity and cooperation. Research shows that positive learning environments implement, “appropriate rules, regulations, and discipline policies that are well publicized consistently enforced and non-discriminatory, and that take into consideration the due process all students are entitled to receive.” (California State Board of Education Policy 01-02 1998). Learning outcomes must be relevant and meaningful to students to spark their inherent curiosity. Educational research asserts that students acquire and retain knowledge most effectively when they understand information well enough to apply it to new situations. Learning best occurs by doing. Learning occurs best in an environment that contains positive interpersonal relationships and interactions and in which the learner feels appreciated, acknowledged, respected, and validated. Collaboration is key to effective learning. Students are the most motivated to learn when they are truly invested and care about the knowledge they seek. The teacher is the main facilitator of learning he or she holds the requisite problem solving skills and helps students hone in on their end goals as framed by the standards. Through empowering students to take ownership of their educational outcomes and the process of learning; Urban Discovery Academy builds self esteem, and an appreciation and respect of new thoughts. The classroom environment allows students to make choices and take part in decision making. Research shows that learning best occurs when there is continual interaction and communication between school, home and the community. “We cannot look at the school and the home in isolation from one another; families and schools need to collaborate to help children adjust to the world of the school. This is particularly critical for children from families with different cultural and language backgrounds.” (California State Board of Education Policy 89-01 1994): Parent Involvement in Education of Their Children. The Goals of our Educational Program The following educational goals support the Urban Discovery Academy’s founding philosophy and addresses the needs of all learners including gifted, English Language Learners and those requiring special education services. achieving state standards. 5. Interactions within the urban community will lead way to a positive sense of self

and diverse cultures. 6. Curriculum and instruction will respond to individual differences in ability,

development, language and learning style. 7. Students with special needs will be accommodated through the IEP process. 8. Exceptional students will be accommodated through an Individual Academic

Program and Learning Clusters. 9. Cooperative groups will promote interdependence and inquiry. 10. Physical education, Visual and Performing Arts, and Foreign Language will be

seen as an integral part of the education program. 11. English Language Learners (ELL) will be identified through the California English

Language Development Test (CELDT) and staff will be Cross-Cultural Language and Academic Development (CLAD) certified or trained. Additional diagnostic tests will be employed for ELL students. Urban Discovery will adhere to the California standards for ELL Students. Staff members will participate in staff development for ELL such as GLAD and Systematic Focused English Language Learning Development.

ADDITIONAL ELEMENTS OF THE EDUCATION PROGRAM Professional Development We will continue to increase capacity to sustain and deliver our high quality instructional programs through professional development and through supporting local resource teachers. While cultivating relationships in the larger community with agencies like the San Diego County Office of Education, California Charter School Association, Charter School Development Corporation, a long term and short term professional development plan will be created. Opportunities for Grade Level Teams to meet and collaborate on establishing a standards-based “timeline” that incorporates the above and currently includes; McGraw Hill/SRA Literature and Math, Science, Social Studies, the Arts, Athletics, Frameworks and other content rich units of study. This facilitates the presentation to students of multi-faceted material to tap into multiple intelligences, modes of learning and comprehension for all English Language Learners. Code of Conduct – A code of conduct will be detailed in the student handbook shared by all students, faculty and families. The staff will follow a uniform protocol when handling student misconduct and disciplinary procedures. The School Code will reflect self-respect, respect for others and pride in oneself. Element 2– Measurable Student Outcomes “The measurable student outcomes identified for use by the charter school; ‘Student outcomes,’ for purposes of this part, means the extent to which all students of the school demonstrate that they have attained the skills, knowledge, and attitudes specified as goals in the school’s educational program.” California Education Code § 47605 (b)(5)(B). Urban Discovery Academy’s students will continue to meet all academic standards as adopted by the State Board of Education applicable to charter schools. Urban Discovery Academy intends to promote its students with: • A diploma from Urban Discovery Academy • A transcript and course of study that meets all requirements for entry into a

traditional public school • The ability to problem solve, communicate and manage behavior to solve

problems and avoid physical confrontation with others • The ability to express him or herself through an artistic medium such as music, art,

drama, singing or dance • Measurable progress toward the mastery (proficient or above) of California state

core content standards in English Language Arts, Mathematics, Social Studies / History and Science

Urban Discovery Academy will demonstrate student improvement on standardized tests that compare favorably with District schools that have similar student demographics. In terms of UDA’s instructional program, standardized test scores will serve as an indicator of the school's commitment to improvement in academic achievement. Urban Discovery Academy will aim to achieve scores on the Academic Performance Index (“API”) at or above those targeted by the State and No Child Left Behind (federal) Adequate Yearly Progress (“AYP”) and above those API scores of District schools that Urban Discovery Academy compares itself to.

Element 3 – Methods of Assessment “The method by which student progress in meeting those student outcomes is to be measured.” California Education Code § 47605 (b)(5)(C). State Mandated Assessments Urban Discovery Academy participates in the California Standardized Testing and Reporting (STAR) Program, including utilization of the California English Language Development Test (with initial assessment within the September/October time period). We believe that student progress is most accurately measured using a variety of assessment tools as well as authentic student work. Like all public schools, UDA will comply with all state (API) and federal (AYP) assessment and accountability requirements applicable to charter schools. UDA will continue to certify that enrolled students have participated in the state-testing program in a manner that is consistent with other District pupils. Both aggregate and disaggregate data from the STAR Program will be used to inform instruction at both the individual and classroom level and will be used to measure student progress toward mastery of state content standards. Curriculum Materials Used to Achieve Student Outcomes Urban Discovery Academy uses a wide range of materials to address students’ learning needs. These materials include state-adopted textbooks and additional

supplemental materials. UDA annually reviews student achievement data and curriculum materials to identify gaps and target expenses for additional curriculum materials. A sample curriculum materials list can be found in Element One of this petition. The Academy will make available a traditional transcript for each student in order to ease transfer of credits to other schools and to better communicate with parents. Students receive standards based report cards to fully communicate what students are expected to know and be able to do as set forth by the California State Standards. The Standards-Based Report Card measures how well an individual student is doing in relation to grade level standards. This gives parents an understanding of their child’s strengths and weaknesses and encourages all students to do their best. It allows students an awareness of what is expected of them. It gives teachers an understanding of what the child should know and be able to do at each grade level. It provides parents with a more detailed outline of the expectations in each of the major academic areas (Language Arts, Math, Science, and Social Studies) as well as Physical Education, Performing and Visual Arts and Foreign Language. Additional Assessments All students develop a portfolio of information, work samples, evaluations, and reflections on learning. Portfolios are used to measure student progress toward and mastery of state-wide standards using school-wide rubrics. Projects represent the culmination of skills and knowledge acquired in a given investigation. These may include written or oral presentations or other multi-media displays. On-going teacher observations assess student work habits, and acquisition of knowledge. Additionally, further local assessment systems may be developed to measure student progress. The results of these assessments will drive intervention groups, professional development and instructional practice and the informing of stakeholders. Urban Discovery Academy will comply with the performance expectations and provisions of the state and federal accountability systems including the provisions of the No Child Left Behind Act of 2001 (“NCLB”).

Element 4 – Governance “The governance structure of the school, including, but not limited to, the process to be followed by the school to ensure parental involvement.” California Education Code § 47605 (b)(5)(D). Incorporation as a Non-Profit While Urban Discovery Academy intends to collaborate extensively with the San Diego Unified School District, the Academy shall be operated by a separate legal entity, independent of the San Diego Unified School District. Urban Discovery Academy will operate as a duly constituted California 501(c)(3) non-profit public benefit corporation, governed in accordance with applicable California Corporations Code Sections, and established to operate charter schools. As provided for in the California Corporations Code, Urban Discovery Academy will be governed by its corporate Board of Trustees (“Board”), whose members have a legal fiduciary responsibility for the well-being of the Academy. The Corporation will be managed by its Director, with duties and responsibilities as delegated by the Board. Parent and Community Involvement Research shows that the more intensively parents are involved in their children's learning; the more beneficial are the achievement effects. This holds true for all types of parent involvement in children's learning and for all types and ages of students. Researchers have found that the more active forms of parent involvement produce greater achievement benefits than the more passive ones. That is, if parents receive phone calls, read and sign written communications from the school, and perhaps attends and listens during parent teacher conferences, greater achievement benefits accrue than would be the case with no parent involvement at all. However, considerably greater achievement benefits are noted when parent involvement is active--when parents work with their children at home, certainly, but also when they attend and actively support school activities, when they help out in classrooms or on field trips, and so on. Research reveals many benefits for school systems and for parents themselves when parents become involved in their children's learning. School personnel benefit from the improved rapport that generally accompanies increased parent involvement. This rapport is often expressed in parents' increased willingness to support schools with their labor and resources during fundraising activities or special projects. And certainly, the many ways in which parent involvement benefits students' achievement, attitudes, and behavior have a positive impact on school staff (Collins, C. H.; Moles, O. C, 1982). The research also reveals that improved parent attitudes toward the school and improved parent self-concepts characteristically result when parents become involved in their children's learning. Parents often begin their

participation doubting that their involvement can make much difference, and they are generally very gratified to discover what an important contribution they are able to make. In this connection, it is important for school personnel and parents to be aware that parent involvement supports students' learning, behavior, and attitudes regardless of factors such as parents' income, educational level, and whether or not parents are employed. That is, the involvement of parents who are well-educated, well-to-do, or have larger amounts of time to be involved has not been shown to be more beneficial than the involvement of less-advantaged parents. All parent involvement works and works well (Becher, R. M, 1984). Urban Discovery Academy, in collaboration with parents, will continue to develop The Network. The Network consists of parents, teachers, and any other staff member who wishes to participate. The Network engages parents, teachers and community leaders and meets on a periodic basis to provide input to Urban Discovery Academy on the operations of the programs, staff, teachers, students and fundraising, all with the purpose of increasing student achievement. The Network also serves as a support group for school families and current families act as mentors to families who are new to the school. In addition to The Network, Urban Discovery Academy will continue to hold Parent Nights, Parent Socials, and Family Socials to get to know one another outside of the school, to build strong bongs amongst one another. Parents are engaged by participation in parent advisory groups, oral and written communication, parent nights and day coffees, web-site, participation in school events, and fundraising opportunities. Governance Structure The Urban Discovery Academy Board has at least five members. Board members have been selected to represent the community-at-large, the business community and educators. All future board members will be selected with skills and experience to match their board responsibilities by a majority vote of the then current board. The Board of Directors will meet about every other month, and will abide by all Brown Act laws for all meetings.Urban Discovery Academy agrees to be bound by applicable laws, has adopted a conflict of interest code, and will continue to comply with applicable open meetings e.g. The Brown Act and public records act laws. The governing board of SDUSD shall be entitled to a representative on the Urban Discovery Academy non-profit corporation Board of Trustees.

The Urban Discovery Academy Board will be responsible for: • Hiring and evaluating the Director/chief executive officer of the Academy • Approving and monitoring the implementation of general policies of the

Academy. These will include effective human resource policies for career growth and compensation of the staff.

• Developing and monitoring an operational business plan that focuses on student achievement.

• Approving and monitoring the Academy’s annual budget. • Contracting an external auditor to produce an annual financial audit according to

generally accepted accounting practices and certifying the audit prior to submission to the District.

• Contracting with an educational management organization, if deemed appropriate.

• Regularly measuring progress of both student and staff performance. • Involving parents and the community in the support of the Academy’s programs. • Executing all other responsibilities provided for in the California Corporations

Code, The Articles of Incorporation Bylaws, and this charter necessary to ensure the proper operation of the school.

Amendments Material revisions to the charter must be approved by the District's Board of Trustees. However, any proposed revisions to the charter will be presented to the District for a determination as to whether it is a material revision that must be approved by the District Board of Trustees. The District will make its determination and, if required, the District Board of Trustees will consider the revision for approval within a time mutually agreed to.

Element 5 – Employee Qualifications “The qualifications to be met by individuals to be employed by the school.” California Education Code § 47605 (b)(5)(E). Qualifications for Employment To the extent required by law, teachers at Urban Discovery Academy are required to hold a Commission of Teacher Credentialing certificate, permit, or other document equivalent to that which a teacher in other public schools would be required to hold. As provided by law, the Academy may exercise flexibility with regard to those teaching non-core, non-college preparatory courses. All requirements for employment set forth in applicable provisions of law will be met, including but not limited to credentials as necessary. Urban Discovery Academy will continue to comply with the “Highly Qualified” provisions of NCLB. Teachers will meet the requirements of NCLB for any core academic subject. Paraprofessionals will also comply with the Highly Qualified provisions of NCLB pursuant to section 1119(c)-(e) of the NCLB. The Academy will maintain a highly qualified plan for all applicable staff. Urban Discovery Academy may employ qualified adults to assist credentialed teachers in student instruction. A teacher may supervise another teacher when mutually agreed to by the teachers and Urban Discovery Academy. Within the provisions of the law, Urban Discovery Academy reserves the right to recruit, interview and hire anyone at anytime who has the best qualifications to fill any of its position vacancies so long as the provisions of NCLB are followed. Also within the provisions of law, the Academy reserves the right to evaluate the expertise of each teacher and accordingly assign that teacher classrooms, curriculum subjects or mentoring assignments as it deems in the best interest of students so long as the provisions of NCLB are followed. Urban Discovery Academy is staffed with qualified teachers that also demonstrate high interest in Science, Physical Education, Computers and the Visual and Performing Arts as well as Spanish. Urban Discovery Academy will continue to avail itself of any and all credentialing methods approved by the State of California, as needed. This includes the development of or participation in a charter intern and/or induction program consistent with standards established by the California Commission on Teacher Credentialing.

Urban Discovery Academy evaluates teachers based on attitude, student performance on state tests, taking on an extra leadership role, attendance at extra-curricular events, classroom observations as well as the state standards for the teaching profession. The evaluations are completed by the Academy Director/Principal using objective measures and instruments, before the last day of the academic school year, at which time teachers may be offered a contract to work at the Academy for the next year. Urban Discovery Academy maintains current copies of teacher certificates on file and ready for inspection. The Principal/Director, or any other administrator (including potential Vice Principals) at Urban Discovery Academy, must have leadership abilities and a comprehensive educational vision that is consistent with the Academy’s mission and educational program. In addition, the Principal/Director should possess skills in hiring and supervising and motivating excellent teachers, technological and data-analysis experience, and if possible, business experience. Urban Discovery Academy may also employ or retain non-certificated instructional support staff in any case where a prospective staff member has an appropriate mix of subject matter expertise, professional experience, and a demonstrated capacity to work successfully in an instructional support capacity. The Principal/Director designs a staff development plan for each school year which is data driven, consistent with measurable student goals, enhances the California framework/content standards, strives to meet API, AYP targets, and enhances the cultural mission of Urban Discovery Academy.

Element 6 – Health and Safety Procedures “The procedures that the school will follow to ensure the health and safety of students and staff. These procedures shall include the requirement that each employee of the school furnish the school with a criminal record summary as described in § 44237.” California Education Code § 47605 (b)(5)(F). Urban Discovery Academy will comply with all applicable safety laws. Urban Discovery Academy has developed further health, safety, and risk management policies, attached as appendix, in consultation with its insurance carriers and risk management experts. Procedures for Background Checks Employees and contractors of Urban Discovery Academy will be required to submit to a criminal background check and to furnish a criminal record summary as required by Education Code Sections 44237 and 45125.1. All volunteers shall be fingerprinted and receive background clearance prior to volunteering with any students of Urban Discovery Academy. Tuberculosis Mandate Urban Discovery Academy conducts initial and on-going tuberculosis screenings of employee candidates as well as screenings of all adults assigned to classrooms on an on-going unsupervised basis, all as required by law. Urban Discovery Academy provides health screening of pupils’ vision and hearing and the screening of pupils for scoliosis to the same extent as would be required if the pupils attended a traditional Public School. Urban Discovery Academy ensures all required staff receive child abuse reporter training and complete appropriate certifications and affirmations. Urban Discovery Academy requires immunization of students as a condition of school attendance to the same extent as would apply if students attended a non-charter public school. Urban Discovery Academy, at its own cost and expense, is responsible for obtaining appropriate permits prior to occupancy from the local public entity with jurisdiction over the issuance of such permits, including building permits, occupancy permits, fire/life safety inspections and conditional use permits, all as may be required to ensure a safe school and facilities for staff and students.

Our intent is to keep Urban Discovery Academy housed in a facility within the boundaries of the SDUSD. Ideally, the facility will be located in or easily accessible to the San Diego City’s Downtown. Urban Discovery Academy will continue to maintain, on file and ready for inspection, a copy of facilities inspections occurring prior to and after its initial occupancy. Urban Discovery Academy will continue to maintain safety and disaster plans appropriate to its site and ready for inspection.

Element 7 – Achieving Racial and Ethnic Balance “The means by which the school will achieve a racial and ethnic balance among its students that is reflective of the general population residing within the territorial jurisdiction of the school District to which the charter petition is submitted.” California Education Code § 47605 (b)(5)(G). Urban Discovery Academy will continue to, at a minimum, do the following as it strives to achieve a racial and ethnic balance of students that reflects the general population of the entire school District: • Announce the Academy's interest in seeking applications in publications the

District provides for such purposes. • Expend at least 20 hours of staff time annually in community and regional outreach

efforts, including presence at public meetings, to recruit applicants of diverse backgrounds.

• Annually print and use electronic media, flyers and direct mail to recruit applicants of diverse backgrounds.

• Development of promotional and informational materials in languages other than English to appeal to limited English proficient populations;

• Hosting information meetings and campus tours; and • Maintaining an informative web page.

Urban Discovery Academy will continue to establish an open enrollment period of at least 60 consecutive days each year within the months of October through May. Notice of the open enrollment period, the admissions process, and the place of any lottery will be included in public literature. This includes the appropriate recruitment materials, advertisements and forums mentioned above. Urban Discovery Academy will continue to maintain auditable records of the above activities and expenditures. The Academy will also maintain an accurate accounting of the ethnic and racial balance of students enrolled in the School. Recruitment materials will include the following information about admission requirements included below, in Element 8.

Element 8 – Admission Requirements “Admission Requirements, if applicable.” California Education Code § 47605 (b)(5)(H). Urban Discovery Academy endeavors to accommodate all students who apply for admission. For Applicants to qualify for admission: • The student and a parent or guardian must attend one complete Urban Discovery

Academy orientation session. These sessions will be held at convenient times. They will detail what the Academy expects of the student and his or her family as well as what the student and family should expect of the Academy;

• A parent or guardian must attend a tour of the UDA campus offered multiple times a week from October through March;

• A parent or guardian must complete and return a simple, non-discriminatory application by a published deadline ending the open enrollment period;

• The student and a parent or guardian must sign a statement that they are familiar with and agree to abide by all policies and procedures set forth in the Academy’s student handbook;

• A student seeking admission to any grade within Urban Discovery Academy must be successfully promoted from their prior grade.

If more students apply and qualify than can be admitted, priority for admissions shall be assigned in the following order: • Returning or existing students – guaranteed admission; • Siblings of returning or existing students – guaranteed admission; • Children of faculty and founders of the Urban Discovery Academy; • As long as the district school whose boundaries Urban Discovery Academy is

physically located has over 70 percent or more of the pupil enrollment eligible for free or reduced priced meals, Urban Discovery Academy will give preference in admissions to pupils who are currently enrolled in that public elementary school and to pupils who reside in the elementary school attendance area where the charter school-site is located.

• All other students permitted by law.

All qualified applicants from the open enrollment period become members of the Urban Discovery Academy's applicant pool. If more people apply for admission than can be admitted a single lottery shall be held for all and only qualified applicants. Applicants will be admitted in the order their names are drawn from a lottery hat. After capacity has been reached for that grade, names shall be placed on a waiting list, again in the order they are drawn from the hat. Sibling applicants shall be drawn

individually and then given the same placement on the waiting list in their respective grades as the best one drawn between them. An adult citizen of good standing, not otherwise employed by Urban Discovery Academy, will testify in writing, under penalty of perjury, that he or she personally witnessed each lottery pursuant to the above, and that each was random, public and conducted as advertised. As space becomes available during a school year, Urban Discovery Academy will mail a letter to the applicant with the highest rank on the applicable waiting list by U.S. mail and / or email. The letter will give the applicant five full business days to notify the Academy Director or clerk, in person or by phone, fax or email of the applicant's intentions to accept or decline the offer for enrollment If there is no response after 5 business days UDA will attempt at least two phone calls to contact those applicants with phones and then the vacancies will be considered declined and the application will be withdrawn and will be offered to the next student on the waiting list. All waiting lists extinguish annually at the end of the Academy's formal academic year, or as otherwise determined by the Urban Discovery Academy Corporate Board of Trustees. Urban Discovery Academy will continue to maintain auditable records of the above activities. Urban Discovery Academy shall be non-sectarian in its programs, admission policies, employment practices, and all other operations, shall not charge tuition, and shall not discriminate against any pupil on the basis of ethnicity, national origin, gender or disability. The Academy certifies that all its admissions procedures, policies and criteria comply with non-discrimination statutes and applicable law. The Academy and its parent corporation shall defend, indemnify and hold harmless the District from any and all challenges alleging that the Academy’s admission procedures do not comport with applicable laws.

Element 9 – Financial Audits “The manner in which annual, independent, financial audits shall be conducted, which shall employ generally accepted accounting principles, and the manner in which audit exceptions and deficiencies shall be resolved to the satisfaction of the chartering authority.” California Education § 47605 (b) (5) (I). Fiscal: Urban Discovery Academy will continue to be funded as a directly funded school. Urban Discovery Academy contracts with an independent auditor qualified to conduct an audit in school district finance for an annual financial audit that will be produced according to state audit guidelines for charter schools accounting principles and Generally Accepted Accounting Principles (“GAAP”). Urban Discovery Academy will continue to transmit a copy of the audit to the District - as well as to the County Superintendent of Schools, the State Controller and the State Department of Education - by December 15 of each year. Should the audit note any exceptions or deficiencies, the Academy will follow a procedure whereby the Academy: • Informs in writing all audit recipients of any exception and/or deficiency the

Academy disputes or believes it has already corrected by the time of submitting the audit, along with supporting documentation;

• Informs all audit recipients in writing of a proposed timetable with benchmarks for the correction of each exception and/or deficiency still outstanding at time of audit submission; and

• Resolves all outstanding or disputed exceptions and/or deficiencies to satisfaction of the District and the Academy by no later than the following June 30th or other time as may be mutually agreed to.

• As long as the district school whose boundaries Urban Discovery Academy is physically located has over 70 percent or more of the pupil enrollment eligible for free or reduced priced meals, Urban Discovery Academy will give preference in admissions to pupils who are currently enrolled in that public

The Academy will: • Prepare and file with the District on or before September 15 an annual statement

of receipts and expenditures of the charter school for the preceding fiscal year (Education Code section 42100); and

• Prepare and file with the District a preliminary budget on or before July 1, an interim financial report on or before December 15, a second interim financial

report on or before March 15, and a final un-edited report for the full prior year on or before September 15 (Education Code section 47604.33).

Insurance and Safety Policy Urban Discovery Academy currently maintains general liability insurance coverage of $5,000,000 per occurrence for bodily injury, personal injury, and property damage; automobile liability of $2,000,000 per occurrence; workers compensation insurance with a minimum limit of $1,000,000; and errors and omissions insurance, property insurance, and employment practices liability insurance. Personnel policies have been developed and adopted by the Board of Urban Discovery Academy, attached as an appendix item. Urban Discovery Academy is deemed to be the exclusive public school employer of the employees of the charter school for the purposes of the Educational Employment Relations Act (EERA).

Element 10 - Student Suspension and Expulsions “The procedures by which students can be suspended or expelled.” California Education Code § 47605 (b) (5) (J) Urban Discovery Academy regards suspension and expulsion as a last resort. Criteria for suspension and expulsion of students shall be consistent with all applicable federal statutes and state constitutional provisions and state law. All related hearings conform to the applicable state and federal laws regarding discipline, special education, confidentiality, and access to records. The following represents grounds for suspension and/or expulsion: • The threat, causation or attempted causation of physical injury to another person,

including sexual assault. • Possession of a weapon (e.g., firearms, knives or explosives) or possession of a

replica firearm. • Unlawful possession, use, sale, offer or being under the influence of any

controlled substance, alcoholic beverage or any intoxicant. • Robbery or attempted theft of Academy or private property. • Destruction or attempted vandalism of Academy or private property. • Extortion. • Obscene, racist or offensive acts or habitual profanity or vulgarity. • Bullying, sexual harassment, excessive disruption in class, fighting

The student/parent and the faculty/staff handbooks describe and discuss the above policies, along with other issues.

Special education students can be suspended for suspend-able offences; just like general education students. For suspension of 10 days or less for special education students, no special procedures are required.

In-School Suspensions may be counted as part of the cumulative suspension days, if the student does not have access to his/her special education services while they are serving the in-school suspension.

Once an identified special education student is suspended for the eleventh cumulative school day, the student’s IEP Team must be convened (no later than 10 school days) to hold a “Manifestation Determination IEP Meeting.”

At the Manifestation IEP Meeting, the IEP team must consider the following: • The most recent diagnostic evaluation. If the first evaluation is more than one year

old, a new evaluation must be completed • Any teacher observations of the student • Any discipline incident reports • Relevant information supplied by parent • The most recent IEP (including Positive Behavior Supports already in place) • Any other relevant information in the student’s file, including health records

Using the above information, the IEP Team must determine the answers to two questions:

1. Was the conduct in question caused by the student’s disability or did it have a direct and substantial relationship to the disability?

2. Was the conduct in question the direct result of the school’s failure to implement the current IEP?

If the IEP Team determines that the answer to either or both questions is “yes”: If it is determined at the meeting that the student’s misconduct was directly caused by the student’s disability and/or the current IEP was not being implemented properly, the determination is then made that the behavior was a manifestation of the disability. Termination of disciplinary action is implemented and the student is reinstated into his/her school placement that was in effect prior to the 11th suspension removal, unless the school and the parent agree otherwise.

A functional assessment/behavior intervention plan is then initiated or review for revision.

Exceptions: • Special circumstances may necessitate an interim education setting for not more

than 45 days, because the behavior involved one of the following special circumstances: drugs, weapons, or infliction of serious bodily harm.

• Parent and School agree to change in placement.

If the IEP Team determines that the answer to both questions above is “no”:

If it is determined at the meeting that the disability had no direct causal effect on the misconduct, and the IEP was being properly implemented, then the student may be disciplined in the same manner as a non-disabled student. The school may then take disciplinary action, such as suspension or expulsion.

These protections may extend to students “not yet eligible” for special education, if it is shown that the school had knowledge that the student had a disability before the

behavioral incident occurred. In such case, or when a parent requests an evaluation of a general education student who is suspended or expelled, the evaluation must be expedited.

Note: Special Education students can be suspended for up to 20 days total for the school year, if not a manifestation of their disability.

A student expulsion may only be applied with the approval of the school Director or his or her designee(s). Urban Discovery Academy will provide the parent/guardian of a student with a notice of suspension or expulsion and the reasons therefore. An expulsion notice may be appealed to a sub-committee authorized by the Urban Discovery Academy Board that shall have the right to determine whether the student should be expelled. The parents or guardians of the student will have ten days from delivery of the written notice of expulsion to declare in writing their request for an appeal. The sub-committee shall convene a hearing within fifteen days of a receipt of a timely request for an appeal. If an appeal hearing is requested the School will give written notice to the student’s parent/guardian that will include the following information: • The date and place of the hearing; • A statement of the specific facts and charges upon which the proposed expulsion

is based; • A copy of the disciplinary rules that relate to the alleged violation; • A notice of the parent, guardian, or student’s obligation pursuant to subdivision

(b) of Education Code section 48915.1; • Notice of the opportunity for the student or student’s parent or guardian to appear

in person or to be represented by legal counsel or by a non-attorney adviser, to inspect and obtain copies of all documents to be used at the hearing, to confront and question all witnesses who testify at the hearing, to question all other evidence presented, and to present oral and documentary evidence on the student’s behalf, including witnesses.

At the hearing, the student shall have the right to representation, the right to present evidence and the right to question School representatives. The sub-committee members will consider evidence and/or testimony as it deems appropriate and render a written decision that shall be in the best interests of the student and the School. That decision shall be final. Urban Discovery Academy will notify the home district of any expelled student within 30 days of disenrollment.

Element 11 – Retirement Programs Offered to Employees “The manner by which staff members of the charter schools will be covered by the State Teachers’ Retirement System, the Public Employees’ Retirement System, or federal social security.” California Education Code § 47605 (b) (5) (K). Urban Discovery Academy may elect to participate in the State Teachers Retirement System (“STRS”) (for certificated staff) and/or Public Employees Retirement System (“PERS”) (for classified staff) for all eligible employees and coordinate such participation, as appropriate, with the social security system or other reciprocal system. The District agrees to include the Academy's monthly STRS and PERS reports with the District's reports for submission to STRS and PERS. Urban Discovery Academy will provide the data in the District required format with all required information. Further, the Academy will bear full responsibility for monitoring and reporting membership information. The District will bear no responsibility for any reporting errors or omissions. The Academy agrees to defend and indemnify the District from any charter employees’ claims related to STRS and PERS reporting errors or omission Urban Discovery Academy may establish other retirement plans for employees that include, but shall not be limited to, establishment of section 403(b) or 401(k) plans.

Element 12 – Attendance Alternatives “The public school attendance alternatives for students residing within the school District that chooses not to attend charter schools. California Education Code § 47605 (b) (5) (L). As per state law, no governing board of a school district shall require any pupil enrolled in a school or district to attend a charter school. Urban Discovery Academy is a school of choice. No student is required to attend. Students choosing not to attend Urban Discovery Academy may attend other public schools within their home school district. The Academy provides information about attendance alternatives to inquiring parents or students. Transportation is the parental responsibility for families who choose to attend Urban Discovery Academy, unless such transportation is provided by the Academy at its sole discretion. Urban Discovery Academy informs each parent or guardian that their student has no right to admission in a particular school as a result of charter enrollment, except to the extent the right is extended by the local educational agency.

Element 13 – Description of Employee Rights “A description of the rights of any employee of the school District upon leaving the employment of the school District to work in a charter school, and of any rights of return to the school District after employment at a charter school.” California Education Code § 47605 (b) (5) (M). District employees will have no special rights to work at Urban Discovery Academy. Applications for employment by District employees will be evaluated on a similar basis as all other applicants. District employees who leave to work at UDA and subsequently desire to return to District employment may have return rights, as the District may specify.

Element 14 – Dispute Procedures

“The procedures to be followed by the charter school and the entity granting the charter to resolve disputes relating to provisions of the charter.” Ed. Code § 47605 (b) (5) (N). Both the District and Urban Discovery Academy will always attempt to resolve any disputes between them amicably and reasonably without resorting to formal procedures. In the event of a dispute between the Academy and the District regarding the terms of this charter or other issue regarding the Academy’s and the District’s relationship, both parties agree to apprise the other, in writing, of the specific disputed issue(s) and that writing shall include relevant facts. In the event that the District believes that the dispute relates to an issue that could lead to revocation of the charter, this shall be specifically noted in the written dispute statement the District provides the School. Within 30 business days, or longer if both parties agree, of sending written correspondence, an Academy representative and a District representative shall meet and confer in an attempt to resolve the dispute. If this joint meeting fails to resolve the dispute, an Academy representative and a District representative shall meet again within 10 business days or longer if both parties agree to identify a neutral, third-party mediator to assist in dispute resolution. The format of the third-party aspect of the dispute resolution process shall be developed jointly by the representatives and shall incorporate informal rules of evidence and procedure unless both parties agree otherwise. The finding or recommendation of any arbiter shall be non-binding, unless the governing boards of the Academy and District jointly agree to bind themselves. Unless jointly agreed, the process involving the assistance of a third-party participant shall conclude within 30 business days of identifying the mutually agreed to third-party. The Academy and the District shall share all mediation and/or arbitration costs and all other costs associated with dispute resolution equally. The school shall be solely responsible for its attorney’s fees associated with resolving a dispute with the District.

In the event that the above process does not result in an agreement over the dispute, both parties agree to continue negotiations in good faith toward a resolution of the dispute. If the matter cannot be mutually resolved, the charter school shall be given a reasonable period of time to correct the violation, unless the District determines, in writing, that the violation constitutes a severe and imminent threat to the health and safety of the School’s pupils. In such event, the District reserves the right to take any action it deems appropriate and the School reserves the right to seek legal redress for any such actions under the law. In addition, the dispute is not required to be referred to mediation in those cases where the District determines the violation

constitutes a severe and imminent threat to the health and safety of the School’s pupils. The dispute resolution process permits oral notice, followed immediately by written notice. Complaints to the District relating to the operation of the Academy and not to the terms of this charter or other issue regarding the Academy’s and the District’s relationship will be resolved as set forth below, Element 21- Internal Dispute Resolution.

Element 15 – Employer Status and Collective Bargaining “A declaration whether or not the charter school shall be deemed the exclusive public school employer of the employees of the charter school for the purposes of the Educational Employment Relations Act (Chapter 10.7 (commencing with Section 3540) of division 4 of Title 1 of the Government Code).” California Education Code § 47605 (b) (5) (O). Urban Discovery Academy declares that through its corporation it shall be the exclusive public school employer of the employees at the Academy for the purposes of the Educational Employment Relations Act. Further, the Urban Discovery Academy shall retain the right to establish its own lawful procedures for discipline and dismissal. Urban Discovery Academy will select all school staff. No employee of SDUSD, or any other district, shall be required to work at Urban Discovery Academy. Those selected for employment shall enter into a contractual agreement with the Academy’s corporation to make their services available to Urban Discovery Academy. Urban Discovery Academy shall have the authority to terminate the position in accordance with the terms of that agreement. Employees shall have the option to join, or not to join, an exclusive representative of their choice. The fact that an employee chooses to become a member of a particular exclusive representative shall not make any collective bargaining agreement applicable to the Academy. The Academy’s Board of Trustees must expressly agree, consistent with legal requirements for the recognition of exclusive representatives and the negotiation of collective bargaining agreements, to be bound by the provisions of a collective bargaining agreement in order for its provisions to apply to any employee of the Academy.

Element 16 – Closure of Charter School “A description of the procedures to be used if the charter school closes. The procedures shall ensure a final audit of the school to determine the disposition of all assets and liabilities of the charter school, including plans for disposing of any net assets and for the maintenance and transfer of student records.” California Education Code § 47605 (b) (5) (P) Should the Academy cease operation, the assets of the Academy shall be first prioritized towards paying any debts of the Academy including any overpayment or over apportionment of state funding, and any and all fees or sums due to the authorizer . All other assets will be distributed in accord with laws and regulations in force that govern the dissolution of non-profit public benefit corporations. To the extent consistent with applicable law, the assets of the corporation shall be distributed to a California charter school, as approved by the District, with preference given to a charter school operating within the District, or if there are no charter schools operating within the state, to the District. The School will comply with all portions of EC Section 47605(b) (5) (P) and CCR, Title 5, Sections 11962 and 11962.1, The Academy will comply with all portions of EC47605 (b) (5) (P), including the requirement that there shall be “a final audit of the school to determine the disposition of all assets and liabilities of the charter school, including plans for disposing of any net assets and for the maintenance and transfer of pupil records”. This audit will be completed within six months of school closure. Further, the Academy will notify parents, students, the California Department of Education, districts affected by the closure, and the San Diego County Office of Education. A copy of student records should be given to parents or guardians and the original student records should be returned to the district. District property that is transferred to the Academy together with the facilities remains District property, is not an asset of the Academy, and must be returned to the District when the Academy closes.

Other Charter Elements Legal Status and Liability Urban Discovery Academy will be operated by a non-profit public benefit corporation. As such, San Diego Unified School District shall not be liable for the debts or obligations of the Academy. The Academy and its corporation shall hold harmless, defend and indemnify the District, the Board of Education, its officers and employees, from every liability, claim or demand which may be made by reason of: (a) any injury to person or property sustained by the Academy, its officers, employees or authorized volunteers; and (b) any injury to person or property sustained by any person, firm or corporation caused by any act, neglect, default, or omission of the Academy, its officers, employees, agents, or students. In cases of such liabilities, claims or demands, the Academy at its own expense and risk shall defend all legal proceedings which may be brought against it and/or the District, the Board of Education, its officers and employees, and satisfy any resulting judgments up to the required amounts that may be rendered against any of them. UDA purchases and maintains, as necessary, general liability, automotive liability, errors and omissions, property, workers compensation and unemployment insurance policies, as part of its own insurance program. The charter school insurance shall be equivalent to the District's program with respect to limits and coverage. UDA will develop, implement, and ensure compliance with health, safety, and risk management guidelines in consultation with its insurance carriers and risk management experts. UDA shall maintain at its sole cost and expense, without reimbursement, adequate policies in the areas of Comprehensive or Commercial General Liability; Comprehensive or Business Automobile Liability, Worker’s Compensation; Professional or Directors Liability (Errors & Omissions); Property Insurance (including contents); and employment practices liability. UDA shall provide a written notice to be mailed to the District 30 days prior to the effective date of a cancellation or non-renewal of any insurance coverage. General Liability UDA shall maintain at its own expense, general liability insurance with limits of liability of $5,000,000 per occurrence for bodily injury, personal injury and property damage. If any form with a general aggregate limit is used, either the general aggregate limit shall apply separately to this location or the general aggregate limit shall be twice the required per occurrence limit. This insurance shall include products and completed operations of the same limits as the policy limits. This insurance shall be endorsed to include the following: (i) the District, its officers, officials, employees, agents, and volunteers as additional insured; and (ii) a waiver of

any right to contributions from any other coverage purchased by, or on behalf of, the District. Automobile Liability UDA shall maintain at its own expense automobile liability insurance with limits of liability of $2,000,000 per occurrence, for owned, non-owned or hired vehicles. If any form with a general aggregate limit is used, either the general aggregate limit shall apply separately to this location or the general aggregate limit shall be twice the required occurrence limit. Such insurance shall apply to any automobile, Symbol 1 of the ISO Form. Such insurance shall be endorsed to include the following: (i) the District, its officers, officials, employees, agents, and volunteers as additional insured; and (ii) a waiver of any right to contributions from any other coverage purchased by, or on behalf of, the District. Workers’ Compensation Insurance Workers’ Compensation insurance to cover obligations imposed by federal and state statutes having jurisdiction over UDA’s employees, and employers’ liability insurance with a minimum limit of $1,000,000. Errors and Omissions Liability Insurance Errors and Omissions Liability Insurance conforming to the following requirements: • Errors and Omissions Liability Insurance shall cover UDA for those sources of

liability arising out of the rendering or failure to render professional services in the performance of this MOU, including all provisions regarding financial management and indemnification.

• The insurance shall be subject to a maximum deductible not to exceed $5,000/$1,000 deductible per claim.

• The minimum limits to be maintained by the Charter School shall be no less than • $1,000,000/$2,000,000 per claim/annual aggregate.

Property Insurance Property Insurance shall include coverage (including contents) to address business interruptions and casualty needs including fire and other hazards with replacement costs coverage for all assets listed in UDA’s property inventory and consumables. UDA shall also pay an equitable share of the cost of insuring the structures if it occupies a District-owned facility. Employment Practices Liability Insurance UDA shall obtain employment practices liability coverage with minimum limits no less than $1,000,000/$2,000,000 per claim/annual aggregate, or equivalent. Any and all policies of insurance maintained by UDA shall be deemed primary to any potentially applicable policy or policies of insurance maintained by the District

and/or their respective officers, agents, employees, and representatives. The District may specify that it be named as ‘separately insured. To the extent that UDA obtains insurance providing ‘claims made’ coverage, such coverage shall include a rider or endorsement that shall provide for coverage for no less than three (3) years following termination of the policy. Funding Urban Discovery Academy elects to receive funding directly from the State of California through the County Treasurer and the County Office of Education in accordance with applicable law and the State’s block grant program for charter schools. The Academy through its corporation will act as its own fiscal agent. The District agrees it will use its ability to transfer funds from the Academy's Treasury Account to the district only with specific permission from the school’s director While Urban Discovery Academy does not expect the District to advance to the Academy future revenues (i.e., smooth out the Academy's revenue stream), nothing in this charter shall prevent the District from electing to do so at the Academy’s request. The District agrees to forward the Academy's full share of local aid to the Academy's account at the County Treasurer each month when due and to send separate notice to the Academy of each deposit amount without delay. District Services Urban Discovery Academy and the District will negotiate in good faith on an annual basis to develop a Memorandum of Understanding (“MOU”) separate from this charter, one that establishes more specifically the financial and service relationship between the two parties. The Academy’s purchase of goods and services, if any, from the District shall not negate the operational independence of the Academy from the District. Breach of the MOU shall not necessarily constitute breach of this charter. Urban Discovery Academy does not anticipate purchasing any optional services from the District other than services for, nursing services for students, teachers’ media center, and fiscal control for SRTS/PERS reporting, SARC preparation, student pupil accounting and testing. The District may charge for the cost of supervisory oversight of the school not to exceed statutory limitations.

INFORMATION EXCHANGE Academy and District – Records, Reports and Visits Urban Discovery Academy agrees that the Academy will promptly respond to all reasonable inquiries, including inquiries regarding its financial records. The records of the Academy are public records under the California Public Records Act. However, a record differs meaningfully from a report that must be newly prepared.. The District may inspect or observe any part of Urban Discovery Academy at any time. The District agrees it will not do so unreasonably, without notice or by causing a disruption of student instruction or Academy operations except in the case of an emergency. Urban Discovery Academy shall provide the District reports as required by current law: • CBEDS • ADA reports J18/19 • Budget on or before July 1st • A school accountability report card using a state approved format • Copies of the annual, independent financial audit

And, as an accommodation to the District, the Academy shall further supply the District, copies of all state mandated test results: • STAR • CELDT • SABE/2

Finally, on or before September 15, the Academy will approve, in a format prescribed by the Superintendent of Public Instruction, an annual statement of all receipts and expenditures of the Academy for the preceding fiscal year and will file a copy of that statement with the District. Changes in these reporting requirements may be incorporated by reference into this charter when the District and the Academy mutually update their MOU (See Funding, Element 19). The Academy shall permit the District to inspect and receive copies of all records relating to the operation of the Academy, including financial, personnel and pupil records, unless law prohibits disclosure to the District of any such records. The Academy shall promptly comply with all such reasonable written requests. The

records of the charter school are public records under the Public Records Act (Government Code section 6520 et seq.). Pursuant to Education Code 47607, the District shall have the right to inspect or observe any part of the Academy at any time, upon reasonable notice. Internal Dispute Resolution The Urban Discovery Academy Board of Trustees will adopt policies and processes for airing and resolving disputes (other than those between the District and Urban Discovery Academy relating to provisions of this charter or the relationship between them, which are covered in Element Fourteen, above). The District agrees to refer all complaints regarding operations of Urban Discovery Academy to the Academy's Director for resolution in accordance with the Academy's adopted policies. In the event that the Academy's adopted policies and processes fail to resolve the dispute, the District agrees not to intervene in the dispute without the consent of the Academy unless the matter directly relates to one of the reasons specified in law for which a charter may be revoked. Notwithstanding the above, the District Board of Trustees shall have the ability to intervene in and respond to complaints about the operation of Urban Discovery Academy as is required by law. Mandated Cost Recovery The Academy will be responsible for recovering from the State all eligible mandated costs applicable to the Academy. Administrative Services Urban Discovery Academy will continue to contract with Charter School Management Corporation (“CSMC”) for the provision of back office and compliance services for the Academy. CSMC currently provides back office services for over 80 charter schools throughout California. CSMC has committed to providing dedicated, local San Diego support for the Academy. A CSMC project manager, with former experience as a charter schools business manager in San Diego County at both the County Office of Education and school level, will provide local support. CSMC assists the Academy with all accounting, fiscal, attendance, audit related, and compliance issues including but not limited to payroll, purchasing, grants, categorical funding, contributions, inventory, employee contributions, and mandated fiscal reports. The Academy reserves the right to contract with another equally competent vendor for back office services should the need arise. Urban Discovery Academy uses templates provided by the District’s financial operations office to complete required financial records. Urban Discovery Academy annually prepares and submits the following reports to the District and the County Superintendent of the schools as prescribed in Education Code section 47604.33: • On or before July 1, a preliminary budget, a charter school in its first year of

operation, the information submitted pursuant to subdivision (g) of section 47605 satisfies this requirement.

• On or before December15, an interim financial report. This report shall reflect changes through October 31.

• On or before March 15, a second interim financial report. This report shall reflect changes through January 31.

• On or before September 15, a final unaudited report for the full prior year.

The Academy will adhere to the District’s reporting requirement and provide the following reports as required by law: • CBEDS (California Basic Educational Data System). • ADA (Average Daily Attendance) Reports J18/19. • SARC (School Accountability Report Card).

Urban Discovery Academy contracts with an independent auditor, in addition to CSMC, to conduct an annual audit of the school’s financial affairs. The audit will verify the accuracy of the school’s financial statement and reporting practices. The audit is conducted in accordance with GAAP as applicable to public schools and in compliance with the audit provisions of the Schools’ charters and charter school legislation. Clear audit reports are submitted to the District, County Office of Education, State Controller and CDE. The Urban Discovery Academy Board of Trustees meets routinely to review Academy profit and loss statements, cash flow projections, reports of budget to actual results, and balance sheets. It also addresses audit deficiencies, if any, formal or informal, and determine the means for resolving any such deficiencies in a timely fashion. Charter Term The petitioners request the San Diego Unified School District Board of Trustees approve a term of this charter that shall begin for a five-year period on July 1, 2013 and end on June 30, 2018. Urban Discovery Academy justifies this five-year term based on the strength of the Academy’s educational design.

Charter Revisions Material revisions to the charter must be approved by the District's Board of Trustees. However, any proposed revisions to the charter will be presented to the District for a determination as to whether it is a material revision that must be approved by the District Board of Trustees. The District will make its determination and, if required, the District Board of Trustees will consider the revision for approval within 60 days of submission or within a time mutually agreed to. Severability The terms of this charter are severable. In the event that any of the provisions are determined to be unenforceable or invalid for any reason, the remainder of the charter shall remain in effect, unless mutually agreed otherwise by the District and Urban Discovery Academy. The San Diego Unified School District and Urban Discovery Academy agree to meet to discuss and resolve any issue or differences relating to invalidated provisions in a timely and proactive fashion. Renaming Rights Urban Discovery Academy reserves the right, upon reasonable notice to those affected, to rename the School.

Appendix C: Board of Trustees Edward L. Abeyta, Ph.D. Edward is Director of K-16 Programs at UC San Diego (UCSD) Extension. Prior to joining UCSD Extension in 1995, Edward began his service at UCSD as a counselor for the Early Academic Outreach Program serving underrepresented students in San Diego high schools and later assumed the role of Registrar and Director of Academic Services at UC San Diego Extension. Dr. Abeyta has a B.A. from the University of New Mexico, a M.A. from the University of San Diego and his Ph.D. in Post Secondary Adult Education from Capella University. Edward has been recognized from UCSD and the UC Office of the President for his involvement in staff diversity and development initiatives. School Safety/Emergency Preparedness Plan

Criterion 1. Assessment of current status of school crime.

The principal will contact the San Diego Police Department in the event of any crime committed

on campus. A written report is kept on file if the incident resulted in disciplinary action for a

student of UDA.

Criterion 2. Child abuse reporting procedures

1. The Penal Code obligation to report child abuse or neglect applies, but is not limited to

certificated employees, health practitioners, school police, and employees of child care

centers. This law also applies to instructional aides, teachers’ assistants, and classified

employees who have been trained in the duties imposed by this law and where this training

has been declared by the State.

2. . When a suspected child abuse or neglect report is made, the individual who observed or has

knowledge of the abuse/neglect makes the report by telephone, written report using

“Suspected Child Abuse / Neglect Report” form or by Fax.

3. Persons observing evidence of suspected child abuse or neglect may inform the principal or

her designee. Although it is not required, it is strongly suggested that employees inform the

principal of the incident. If medical treatment is needed medical personnel will be contacted

via 911.

4. All UDA staff members participate in annual training regarding mandatory reporting

procedures. These trainings are conducted by staff from Child Protective Services. In

addition, all UDA staff members are required to sign statements regarding their

responsibilities for mandatory reporting.

5. The principal and staff of UDA support and maintain positive relationship with parents and

social workers. This work allows us to more effectively support students who have been

victims of abuse.

Criterion 3, Disaster procedure, routing and emergency

The site emergency preparedness plan has been developed by the staff, with input from all

sources on campus, to provide for the safety of students, staff, visitors, building, equipment and

supplies. It includes the organization of staff to meet an emergency, a system of warnings,

instructions and preparation of students, and appropriate drills.

Criterion 4 Policies related to suspensions, expulsion or mandatory expulsions and other

school-designated serious acts which would lead to suspension or expulsion.

The principal, principal’s designee, or the superintendent may suspend a student from school for

a maximum of five consecutive school days for any single cause enumerated on the suspension

form. Before suspending a student for any of the reasons starred on “Report on Suspension,” the

principal or principal’s designee shall immediately notify the San Diego Police Department, who

shall initiate investigation of any assault or possession of a firearm (as defined in Penal Code

240). The principal or principal’s designee should detain the student at school, when feasible and

without physical force, until a police officer obtains a statement from the student.

The principal shall recommend an investigation and possible expulsion for any of the following

acts, unless the principal finds, and so reports in writing to the Board of Directors, that expulsion

is inappropriate due to the particular circumstance set out in the report of the incident:

• Causing serious physical injury to another person, except in self-defense.

• Assault upon any school employee.

• Battery on any school employee.

The principal must recommend expulsion for the following acts (Education Code Section

48915(c), Zero Tolerance Policy, or District Alcohol, Tobacco, and Drug Policy):

• Third offense for fighting that inflicts injury in one year.

• Sexual assault.

• Attempted sexual battery.

• Possessed, sold, or furnished a weapon, including firearm, any knife, explosive, other

dangerous object, any object used in a threatening manner, or possession of an imitation firearm.

• Alcohol/intoxicants/controlled substance/inhalants: furnished, sold or in the student’s

possession

• Committed or attempted to commit robbery or extortion.

• Fourth offense for possessing product with tobacco or nicotine.

When a student’s behavior indicates a continuous threat to the safety, health or- emotional well-

being of others, and previous methods of prevention and intervention have failed, that student

will be suspended in accordance with district policy and state law. Parents will be notified as

soon as possible, provided they have given the school, appropriate home, work arid emergency

phone numbers and addresses. The purpose of parent contacts, conferences and suspensions is to:

1. Provide a clear, predictable and consistently applied system of school-wide discipline.

2. Support teachers in their efforts to enforce the classroom management policy.

3. Bring parents of involved parties into the discipline process to assist school personnel in

keeping students from infringing on the rights of other students and staff members.

Criterion 5 Notification to teachers of dangerous pupils on site

When the principal receives information from the court and/or the Probation Department

regarding students who previously have committed violent or dangerous crimes, such

information will be made available to teachers, counselors, and administrators with direct

supervisory experience over the student in order to enable staff to (a) work with the student in an

appropriate fashion, (b) avoid being needlessly vulnerable, and (c) protect other persons from

needless vulnerability.

Teachers, counselors, and administrators may access such information through the office

manager who maintains a notebook for this purpose. Any such information so received by a

teacher, counselor, or administrator shall be confidential and shall not be disseminated further.

Criterion 6 A sexual harassment policy

Harassment: UDA requires each student and employee to exhibit, in both conduct and

communications, sound judgment and respect for the feelings and sensitivities of every other

student and employee of the school. Verbal or physical conduct by a student or employee that

harasses, disrupts, or interferes with another work performance or which creates an intimidating,

offensive, or hostile work environment will not be tolerated. Harassment of any student by

another student will not be tolerated. This policy prohibits harassment of any kind, but

particularly that related to race, color, sex, religion, national origin, age, sexual orientation,

marital status, any handicap, or any medical condition or disability.

UDA will treat allegations of harassment seriously and will review and investigate such

allegations in a prompt, confidential, and thorough manner. Substantiated acts of harassment

will result in disciplinary action, up to and including dismissal. Students found to have filed

false or frivolous charges will also be subject to disciplinary actions, up to and including

dismissal.

Harassment occurs when an individual is subjected to treatment or a school environment, which

is hostile or intimidating because of the individual’s race, creed, color, national origin, physical

disability, or sex. Harassment can occur any time during school or during school related

activities. It includes, but is not limited to, any or all of the following:

VERBAL HARASSMENT: Derogatory comments and jokes: threatening words spoken to

another person:

PHYSICAL HARASSMENT: Unwanted physical touching contact, assault, deliberate impeding

or blocking movements or any intimidating interference with normal work or movement:

VISUAL HARASSMENT: Derogatory, demeaning or inflammatory posters, cartoons, written

words, drawings, gestures: and

SEXUAL HARASSMENT: Includes unwelcome sexual advance, requests for sexual favors, and

other verbal or physical conduct of a sexual nature

Recording a Complaint: UDA encourages prompt reporting of complaints so that rapid

response and appropriate action may be taken. This policy not only aids the complainant, but

also helps maintain an environment free from harassment for all employees. Any student or

employee who believes he or she has been harassed should promptly report the facts of the

incident to the Principal. A report made about the Principal should be made in writing and can

be given to a member of the Board of Directors. The school will investigate any complaints and

take appropriate corrective action.

Disciplinary Action: The school may take disciplinary steps, up to and including discharge,

against an employee who engages in any type of harassment.

Criterion 7 The provisions of school wide dress code.

UDA has set a dress code that requires students to wear attire that is neat in appearance and

appropriate for school. Their clothing shall not be a substantial disruption of school and school-

related activities. This code is for the health and safety of the school environment. The following

are the guidelines for Urban Discovery Academy Charter School:

• Attire should protect the health and safety of the students; this includes personal cleanliness.

• Attire should not interfere with the educational process.

• Attire should not advertise and/or advocate involvement in gang activity, or the use of alcohol,

drugs or tobacco. This also applies to garments with writing or pictures that are obscene,

suggestive, or depict violence.

• Shoes must be worn at all times.

Criterion 8 Procedures for safe ingress and egress of pupils, parents, and school employees

to and from school.

As required by state law, each Principal Site Administrator shall conduct safety drills

periodically (including fire, earthquake/disaster preparedness and lock down drill) to maintain

awareness of procedures.

All faculties will review the site evacuation procedures at the first staff meeting prior to each

semester.

Criterion 9. Safe and orderly school environment.

Students are under the direct supervision of staff members at all times while in school, or while

attending a school-directed activity. The discipline policies of UDA are designed to establish and

maintain an environment in which students and staff members can perform effectively in the

school setting, so that each student can exercise his or her right to obtain the best education

possible.
