Inspection report
of STPs in Agra with reference to Hon'ble NGT Court Order dated 09.12.2015 in the matter of 0.A. No. 145 of 2015, D.K. Joshi Vs Union of India & Others
The Hon'ble National Green Tribunal passed the order in Original Application No. 145 of
2015, D.K . Joshi Vs Union of India & Others on dated 09.12.2015 that " ... We direct the Joint
inspection team of CPCB and representative of MoEF&CC and UPPCB to inspect the STPs and
submit a complete and comprehensive report on the operation and maintenance of the plant. They
shall collect effluent of the input as well as the output, analysis the same and submit the report
both in comparison to earlier standards as well as current standards. We make it clear that it will
be stated whether STPs have capacity to treat the Coliform Fecal or otherwise.
Report be categorically deal with the situat ion whether sewer connection when provided,
whether the plants would be in a position to handle the quantum of sewage and waste ... "
In compliance of above said Hon'ble NGT order; joint inspection team comprises of CPCB,
MoEF&CC & UPPCB has been formed with following Officers:
1. Dr. A.K. Gupta, Scientist-D, MoEF&CC, Regional Office Lucknow
2. Shri Kamal Kumar, Scientist-C, CPCB, Project Oftiee, Agra
3. Sbri Niranjan Sharma, Regional Officer (fie), UPPCB. Agra
The alwve joint committee visited the Buri Ka Nagla, Mau Road and Jaganpur, dayalbagh ,
agra STPs sites and collected the samples on dated 14.01.2016. During inspection following
observations has been made: -
L 2.2~MLD STP, Buri Ka Nagla, Mau Road, Agra:
TP working on oxidation pond/waste stablisation pond technology and found operational
during site visit. The STP is consist of uni ts as sump, screen, gr it chamber and three nos. of
setlling tank in two series (06 nos.) of setlling tanks (photo-A). There are following di crepancies
has been not.iced:
• lt has been found that there is no measuring device (flow meter, V-shaped Notch etc.), at
inlet and outlet to measure the quantity of effluent passes, was installed. The inlet screen
was found partially functional.
• The ~rcated effluent from oxidation/ waste stabl isation pond is being discharge directly to
river Y<1muna (photo-8).

• It has been found that few quantity of overflow untreated sewage is being also discharge
directly to river Yamuna (photo-C).
• It has been found that installed enclosed type DG set (62.5KVA) is not 111 working
condition.
• It has been found that there is no fecal coliform treatment facility avaialble at Buri ka
Nagla STP.
• UPPCB, Lucknow has also rejected their application for consent to operate (CTO) under
the Water (pollution prevention & control) Act 1974, on dated 15.01.2016. (copy
enclosed as annexure-[)
• During the inspection samples of inlet and outlet discharged were also collected as per
the norms of CPCB and sealed in presence of Project Manager, Yamuna Pollution
Control Unit, UP Jal Nigam, Agra (photo-D). The collected samples were analysed in
laboratory of CPCB, Zonal Office, Lucknow.
• The analysis reports of outlet of Budhi ka Nagla STP effluent is enclosed as table- I. (as
annexure-II). Analysis results were also comapred with the General Standard for
discharge of Environmental Pollution Part-A (Exiting standrad, copy enclosed as
annexure-III) and new Standard (draft Notification dated: 24.11.2015, time frame for
implementation, copy enclosed as annexure-[V) for STPs. Analysis reports depcited that
values of parameters including pH, TS , NH4-N, N-total and P04-P are well within the
exiting standard limit, however, values of BOD and COD are above the prescribed limit.
• However, in comparision with new stanadrd, only values of pH is within the limit,
whereas, parameeters including TSS, NH4-N, N-total, P04-P, BOD, COD and Fecal
coliform are above the new standard limit.
2. 14.0MLD Jaganpur STP, Dayalbagh, Agra:
The above STP working on UASB (Upflow Anaerobic Sludge Blanket) technology
and found operational. The STP having primary treatment (inlet chamber, mannual screen,
grit chamber), two UASB reactor (07MLD each), distribution box (04 nos.), s ludge sump,
filtrete sump, sludge drying bets (14 nos.), gas holder etc. (photo-E). There are following
discrepancies has been noticed:
• It has been found that there is no measuring device (flow meter, V-shaped Notch etc.), at
inlet and outlet to measure the quantity of effluent pasess, was installed.
• It has been found that treated effluent is also going direclty to river Yamuna (photo-F).
• ft has been found that installed enclosed type DG set (62.5KVA) is in working condition.

• To minimize the fecal coliform population in the waste water, chlorine dosing has been
in practiced. It was noticed that the chlorine dosing system was not working at the time
of inspection (photo-G).
• UPPCB, Lucknow also rejected their consent to operate (CTO) under the Water
(pollution prevention & control) Act 1974, on dated 18.12.2015. (copy enclosed as
annexure-V)
• During the inspection samples of inlet and outlet discharged was also collected as per the
norms of CPCB and sealed in presence of Project Manager, Yamuna Pollution Control
Unit, UP Jal Nigarn, Agra (photo-H). The collected samples were analysed in laboratory
of CPCB, Zonal Office, Lucknow.
• The analysis reports of outlet of Jaganpur STP effluent is enclosed as table-2. (as
annexure-II). Analysis results were also comapred with the General Standard for
discharge of Environmental Pollution Part-A (Exiting standrad, copy enclosed as
annexure-lII) and new Standard (draft otification dated: 24.11.2015, time frame for
implementation, copy enclosed as annexure-JV) for STPs. Analysis reports depcited that

sewage and waste". In this connection In-charge, UPPCB, RO, Agra requested to Municipal
Commissioner, Agra Nagar Nigam, Agra and Project Manager, Yamuna Pollution Control
Unit, UP Jal Nigam, Agra to provide related information to the joint inspection committee.

Quantum limit shall be applicable for discl1arge of total effluent (process effluent, cooling water blow down including sea cooling water blow down, washings, etc.) to receiving environment ( excluding direct application on land for irrigation/horticulture purposes within the premises of refinery) . In orcler to measure the quantity of effluent (separately for discharge to receiving environment, application for irrigation/horticulture purposes within the premises of refinery & blow-down of cooling systems), appropriate flow measuring devices (e.g. V-notch. flow meters) shall be provided with. Quantum of pollutants shall be calculated on the basis of daily average of concentration values (one 24-hourly composite sample or average of three grab samples, as the case may be), average flow of effluent during the day and crude throughput capacity of the refinery. Limit for quantity of effluent discharged (excluding blow-down from seawater cooling) shall be 400 m3/1000 tonne of crude processed. However, for refineries located in high rain fall area, limit of quantity of effluent only during rainy days shall be 700 m3!1000 tonne of crude processed1.

('1) the waste waters and gases are to be treated with the best available technology (BAT) in order to achieve the prescribed standards.
(2) the industries need to be encouraged for recycling and reuse, of waste materials as far as practicable in order to minimize the discharge of wastes into the environments.
(3) the industries are to be encouraged for recovery of biogas, energy and reusable materials.
(4) while permitting the discharge of effluent and emission into the environment, State Boards have to take into account the assimilative capacities of the receiving bodies, especially water bodies so that quality of the intended use of the receiving waters is not affected . Where such quality is likely to be effected discharges should not be allowed into water bodies.
(5) the Central and State Boards shall put emphasis on the implementation of clean technologies by the industries in orcler to increase fuel efficiency and reduce the generation of environmental pollutants
(6) All efforts should be made to remove colour and unpleasant odour as far as practicable.
(7) The standards mentioned in the Schedule shall also apply to all other effluents discharged such as industrial mining , and mineral processing activities and sewage.
(8) the limit given for the total concentration of mercury in the final effluent of caustic soda industry, is for the combined effluent from (a) Cell house, (b) Brine Plant, (c) Chlorine handling, (d) hydrogen handling and (e) hydro choleric acid plant.

The State Boards shall follow the following guidelines in enforcing the standards specified under Schedule VI:

In case of cement plants, the total dust (from all sections) shall be within 400 mg/Nm3 and 250 mg/Nm3 for the plants upto 200 t/d and more than 200 t/d capacities respectively.
In respect of calcinations process (e.g. Aluminum Plants) Kilns. and step Grate Bagasse fired-Boilers. Particulate Matter (PM) emissions shall be within 250 mg/Nm3
.
In case of thermal power plants commissioned prior to 01.01.1982 and having generation capacity less than 62.5 MW, the PM emission shall be within 350 mg/Nm3
.
In case of Lime Kilns of capacity more than 5 t/day and upto 40 t/day, the PM emission shall be within 500 mg/Nm3
.
In case of horse shoe/pulsating Grate and Spreader Stroker Bagassefired-Boilders, the PM emission shall be within 500 (12% C02) and 800 (12% C02) mg/Nm3 respectively. In respect of these boilers, if more than attached to a single stack, the emission standards shall be fixed, based on added capacity of all the boilers connected with the stack.
In case of asbestos dust, the same shall not exceed 2mg/Nm3.
In case of the urea plants commissioned after 01.01.92, coke ovens and lead glass units. the PM emission sha!! be within 50 mg/Nm3
.
In case of small boilers of capacity less than 2 tons/hour and between 2 to 5 tons/ hour, the PM emissions shall be within 1000 and 1200 mg/Nm3
.
In case of integrated Iron and Steel Plants. PM emission upto 400 mg/Nm3 shall be allowed during oxygen lancing .

In case of stone crushing units , the suspended PM contribution value at o distance of 40 meters from a controlled, isolated as well as from a unii located in cluster should be less than 600 micrograms/Nm3
. 1(-" '' *) These. units must also adopt the following pollution control measures :
(i) Oust containment cum suppression system for the equipment;
(ii) Construction of wind breaking walls;
(iii) Construction of the metalled roads within the premises;
(iv) Regular cleaning and wetting of the ground within the premises;
(v) Growing of a green belt along with periphery.
(k) In case ot Ceramic industry, from the other sources of pollution, such as. basic raw materials and processing operations, heat recovery dryers mechanical finishing operation, all possible preventive measures shou lcl be taken to control PM emis~ion as far as practicable.
2. The total fluoride emission in respect of Glass and Phosphatic Fertilize~ shall not exceed 5 mg/Nm3 and 25 mg/Nm3 respectively

Compliance report of the Order of
Hon'ble NATIONAL GREEN TRIBUNAL dated 08.06.2015
passed in Original Application Number 145/2015
D.K. Joshi vs. Union of India and Others.
It is submitted that Hon'ble NATIONAL GREEN TRIBUNAL was pleased to
announce an order on original application Number 145/2015 DK Joshi V/s Union of
India and Others on 08.06.15 which reads as follows:
"Report has been filed in furtherance to the order of this Tribunal dated
6.5.2015 from the report particularly the photographs filed on record it is evidently
clear that these projects would be clearly covered under the Schedule-I of the
Notification 2006. Furthermore, they are located in the flood plain area if it is taken
once in 25 years. Learned Counsel submits that demarcation of the flood plain are
is primarily duty of the Irrigation Department. However, upon instructions from the
Executive Engineer who is present before the Tribunal, Learned Counsel submits
that npne of these projects have obtained environmental clearance in terms of the
l\lotification 2006.
Let Notice be issued to all the builders specified in the report.
In the meanwhile , we restrain any further construction, occupancy or transfer
of possession of the built-up structure by the builders to any parties. They would not
further create third party interest. We direct SEIM, Agm Development Authority
and the UP Pollution Control Board to conduct a joint inspection of these buildings
in addition to the buildings which are otherwise located in the flood plain area and
submit a report before the next date of hearing.
The order of injunction shall be communicated by the Agra Development
Authority to all the builders. The Pollution Control Board shall ensure that the order
is fully implemented along with Agra Development Authority.
The 111speclion team shall also report as to the status of installation of STPs,
where the sewage is proposed to be discharged and whether the complete sewage
system has been installed. It will also be brought on record if there is any common

STP and if any domestic or other discharge is likely to be thrown directly into the
river Yamuna in that area.
The UP Jal Nigam shall also be made party to this inspection and would
inform the Tribunal on the next date of hearing as to whether the connected
chambers have been covered and sewage system has been provided to the
complex. In the meanwhile, Irrigation Department and the UP Jal Nigam shall
together determine the flood plain and start physical demarcation by fixation of
pillars.

The operative instructions given by Hon'ble NATIONAL GREEN TRIBUNAL
which were to be complied with at various levels are underlined as follows:-
(1) Restraining any further construction, occupancy and transfer of
possession of the built-up structure by the builders to any parties and they
would not create further 3 rd party interest. The order of injunction shall be
communicated by Agra Development Authority to all builders.
(2) The UP Pollution Control Board shall ensure that the order is fully
implemented alongwith Agra Development Authority .
(3) UP Jal Nigam shall also be made party to this inspection and will inform
the Hon'ble NATIONAL GREEN TRIBUNAL on the next date of hearing
as to whether the connecting chambers have been made and sewage
system have been provided to the complex.
(4) Irrigation dept. and UP Jal Nigam shall together determine flood plain and
start physical demarcation by fixation of pillars.
(5) The SEIM, Agra Development Authority and UP Pollution Control Board
to conduct a join inspection of these buildings, in addition to the buildings
which are otherwise located in flood plain area and submit a report by the
next date of hearing. For the joint inspection team the terms of reference
as envisaged in the order under reference is as follows:-
(i) Status of installation of sewage treatment plant.

(iii) Whether the complete sewerage system has been installed ?
(iv) Is there any common STP in existence ?

(ii) The UP Pollution Control Board shall ensure that the order is
fully implemented alongwith Agra Development Authority.
It is submitted that Agra Development Authority is ensuring that the
order of Hon 'ble NATIONAL GREEN TRIBUNAL dated 8.6.2015 is fully
implemented and no violation takes place and instructions to this
regard have been given to UP Pollution Control Board.
(iii)UP Jal Nigam shall also be made party to this inspection and will
inform the Hon'ble NATIONAL GREEN TRIBUNAL on the next date
of hearing as to whether the connecting chambers have been
made and sewage system have been provided to the complex.
As per the orders of Hon'ble National Green Tribunal UP Jal Nigam was
made party to the joint team formed for inspection. Regarding the
information sought by Hon'ble Tribunal about connecting chambers and
provision of sewerage treatment plant, the department has informed that
it has constructed three common sewerage treatment plant in this general
area. The details are as follows :-

As per the report of UP Jal Nigam in the maximum area under reference,
Jal Nigam has laid sewer line which is connected to STPs but their are
certain colonies who have not connected their sewer line laid by UP Jal

Nigam. Yamuna Pollution Control Unit, UP Jal Nigam has intimated that
to facilitate the connection of sewer line and for the efficiency, ease and
maximum participation of public, a project for the construction of house
connecting chambers has been sanctioned by Uttar Pradesh Government
wide their letter no. 175/2015-1179/9-5-15-189budget 2014/nagar vikas
anubhag-5 date 12.06.15 and they have started construction of house
connecting chambers.
(iv)lrrigation dept. and UP Jal Nigam shall together determine flood
plain and start physical demarcation by fixation of pillars.
It is submitted that as per the instructions of Hon'ble National Green
Tribunal dated 08.06.15 Irrigation department and UP Jal Nigam have
completed the determination of flood plain zone as per 1 :25 years norms
and have started the work of fixation of pillars for physical demarcation of
the same on ground.
(v) SEIAA, Agra Development Authority and UP Pollution Control
Board to conduct a joint inspection of these buildings, in addition
to buildings which are otherwise located in flood plain area and
submit a report by the next date of hearing.
Pursuant to the instruction enumerated above a joint inspection team
was formed on 16.06.15 by the order of Vice-Chairperson, Agra
Development Authority which consisted of following officials/
department.
A) Agra Development Authority , Agra
B) Nominee of Member-Secretary SEIM, UP Lucknow.
C) Chief Engineer, UP Jal Nigam, Agra .
D) Regional Officer, UP Pollution Control Board, Agra.
E) Executive Engineer, Lower Division, Agra Canal, Agra.
It was also decided that, whether the construction sites which were to be
inspected were in the flood plain zone is an important determination to be made,

therefore , Irrigation department should also be included in the team. Similarly Jal
Sansthan, Nagar Nigam, Agra were also included in the joint inspection team for the
ease and efficiency of the task involved. UP Jal Nigam was also made party to this
inspection team as per the instructions of the Hon'ble NATIONAL GREEN
TRIBUNAL.
Though broad terms of reference were already illustrated in the order of the
Hon'ble NATIONAL GREEN TRIBUNAL. For the ease of task, certain additional
terms were added and the total terms of reference of the joint inspection team were
finalized in the meeting chaired by Vice-Chairperson, Agra Development Authority
on 25.06.15 and these terms of reference are as follows:
1. Whether the project is affected by the flood plain zone of river Yamuna in
1 :25 years if yes then specify the total area affected
2. Whether the Internal sewer line has been laid?
3. Whether the Internal Sewer Line is connected to main trunk sewer line
through connecting chambers?
4. Whether sewerage treatment plant has been constructed?
5. Whether trunk sewer line is connected to STP?
6. Whether sewage is directly being discharged into Yamuna river?
7. How the solid waste is being disposed off?
8. Type of Construction whether it is a Group Housing or a Colony?
9. If it is Group Housing then whether the total covered area of building is more
than 20,000 sqm.? (Yes or No.)
10. If it is a Colony then total plot area of colony is more than 1,50,000 sqm. or
not (Yes or No.)
11 . Whether environmental clearance is needed? (Yes/No)
12. If so whether EIA clearance obtained (Yes or No.)

Category - C : The Hon'ble NATIONAL GREEN TRIBUNAL had also
instructed to "inspect these buildings (the listed 19 constructions covered in
Category-A), in addition to the buildings otherwise located in flood plain area". The

It is again submitted that for the ease of assimilation and to avoid
unnecessary repetition hereinafter these construction shall be dealt under Category
A, Category-B and Category-C as defined above.
It is further submitted that individual inspection report of each construction
site/project is being annexed to this report as Annexure No.-2.
It is further submitted that during the joint inspection , all the illegally
developed colonies which were found during site visits , have been issued with
notices under relevant sections of UP Urban Planning and Development Act-1973.
The summary of the factual field/site visit status as per the questionnaire of
terms of reference given to the joint team for inspection as directed by Hon 'ble
NATIONAL GREEN TRIBUNAL in the order dated 08.06.2015, inclusive of
additional questions framed to give clarity to the issues involved is as follows :-
1. Whether The Project is affected by flood plain zone of River Yamuna

Category-A : Out of 19 projects only one is partially affected by flood
plain zone of once in twenty five years frequency criteria . This project is

Out of this about 2500 sqm. area is affected by flood plain zone. No other
project in Category-A is affected by flood plain zone of once in twenty five
years frequency criteria as reported by Irrigation department. It shall be
appropriate at this stage to underline and clarify that the map of Radha
Ballabh Public School was sanctioned by Agra Development Authority on
09.11 .2001 under reference no. 544/BFH/9/2001 . In the previous report
submitted before Hon'ble NATIONAL GREEN TRIBUNAL on 8.6.2015. It
was erroneously stated that the map of this school had not been
sanctioned. This was a factual error which humbly needs rectification .
Category - B : Out of 58 constructions, the Irrigation department
intimated that 24 numbers of constructions are affected by flood plain
zone of once in twenty five years frequency criteria. These are illegal
constructions and action is being taken against them by Agra
Development Authority under relevant sections of U.P. Urban Planning &
Development Act-1973 . The constructions which have been found to be

It is again submitted that the developers of above 6 projects have been
issued notices to lay internal sewer line and get it connected with main
trunk sewer line, in the absence of which , to construct sewage treatment
plant within their complex in next 2 months. In the location of PG College
there is no external sewer line therefore PG College has been issued
notice to establish sewage treatment plant within their premises in next 2
months. Ram Mohan Vihar colony has been transferred to Nagar Nigam,
Agra, therefore, Nagar Nigam, Agra has been instructed to get sewerage Page 13 of 25

treatment plant constructed for this colony by its own resources or by the
developer.
Two projects namely Pushpanjali Seasons and Ganpati Wonder City are
under construction. In Indra Estate colony, construction has not started.
Manglam Estate Extension has neither been sanctioned nor being
constructed. It shall be pertinent to reiterate here at the cost of repetition
that the developer of Manglam Estate Extension had constructed
boundary wall in flood plain zone of river Yamuna which was demolished
by Agra Development Authority, some remnants of which are still present
on the site.

Out of remaining 34, one site , namely Maa Gauri Town is a project of
row-housing in which internal sewer line is mandatory but at site internal
sewer line was not found. The se.wage was found being disposed off in a
septic tank whose over-flow is being discharged into river Yamuna via
drain by the side of road. Maa Gauri Town colony has been developed
illegally. Against this illegal construction action under relevant sections of
UP Urban Planning and Development Act-1973 is being taken and
demolition order has been passed by competent authority . Action against
this illegal colony is proposed to be carried out shortly as per rules.

before the establishment of Agra Development Authority and they are as

they consist of one or two rooms as single dwelling unit and the rest of
the area is open. In such constructions, internal sewer line is not required .
All these 27 constructions are illegal whose map has not been sanctioned
by Agra Development Authority and they have been issued notices under
relevant sections of UP Urban Planning and Development Act-1973 and
demolition order has also been passed. Proceedings will be completed as

Among 6 colonies enumerated above, 2 colonies, namely Shivam Vihar
and Rahul Vihar have been transferred to Nagar Nigam, Agra for
maintenance. As such Nagar Nigam, Agra has been instructed to put

sewage treatment plant in place, for these colonies either by their own
resources or by the developers. Two colonies namely Krishna Colony and
Krishna Vihar Colony have been found discharging their sewage directly
into river Yamuna. Out of these 2 colonies one Krishna Vihar colony is
illegally developed and Krishna colony was developed for Refugee before
existence of Agra Development Authority. Action against Krishna Vihar
colony under section 27 of UP Urban Planning and Development Act-
1973 has been initiated. UP Pollution Control Board has been directed to
take action against Krishna Colony. The developer of balance 2 colonies,
namely Vaibhav Kunj and Maitri Bagh who have not laid internal sewer
line, have been given notice to construct sewage treatment plant in next
two months.
3. Has sewer line been connected to trunk sewer line through
connecting chambers?
Category - A : Out of 19 projects following 6 are connected with trunk
sewer line :-

Two projects, namely, Vibhav Vatika and Taj View Apartment on the
Yamuna Kinara Road have laid internal sewer line but are not connected
to the trunk sewer line. They have been given notices to get their internal
sewer line, connected to the trunk sewer line. Two projects namely
Pushpanjali Seasons and Ganpati Wonder City are under construction . In
Indra Estate colony construction has not started. Manglam Estate
Extension has neither been sanctioned nor is being constructed. Tanishq
Raj Shree Estate has internal sewer line but is not connected to main
trunk sewer line. They have a 'sub-standard sewerage treatment plant

which is not as per norms. UP Pollution Control Board has issued notice
to the promoters of Tanishq Rajshree Estate for installation of sewerage
treatment plant as per standards and connect it to main trunk sewer line.
Remaining 6 projects have no internal sewer line. They have been issued
notices to get internal sewer line laid and get it connected to trunk sewer
line, in the absence of which, they have been instructed to construct
sewage treatment plant in next 2 month.
Category - B : Out of 58 constructions 24 have been demolished the list
of which already been mentioned on page no. 17-19 and to avoid
repetition it is not being reproduced here. Remaining 34 construction sites
do not have sewer line and they have not been connected to trunk sewer
line. These are illegal constructions and action shall be taken against
them under relevant provision of the UP Urban Planning and
Development Act-1973. They are also scheduled to be demolished
shortly as per rules .
Category - C : The 9 projects under this category have no internal sewer
line and as such they are not connected to trunk sewer line through
connecting chambers. Out of 9 colonies, 7 colonies are sanctioned
colonies of Agra Development Authority and 1 colony was develop8d
before the existence of Agra Development Authority and 1 has been
developed illegally. The 1 colony , Krishna Vihar colony , developed
illegally has been dealt with under section 2'7 of UP Urban Planning and
Development Act-1973. Krishna colony is old refugee colony developed in
1947 and UP Pollution Control Board has been instructed to take action
to ensure that pollution does not take place. Colonisers of 3 colonies
namely Sharda Vihar Phase-I, Pushpanjali Garden and Nav Bharat
Apartment, where internal sewer lines exist, but the same has not been
connected to the trunk sewer line, have been issued notices to get the
connections in the main trunk sewer line by the Agra Development
Authority. Two colonies namely Shivam Vihar and Rahul Vihar have

already been transferred to Nagar Nigam, Agra for maintenance.
Therefore Nagar Nigam, Agra has been instructed to get sewage
treatment plant in these colonies in place either by their own resources or
by the developers. Colonisers of Vaibhav Kunj has been issued notice to
lay internal sewer line and get it connected to trunk sewer line, in absence
of which , they have been instructed to construct sewage treatment plant
in next two months. Remaining , Maitri Bagh colony has the facility of
septic tank for individual buildings. This colony was developed in the year
1984 when there was no provision of internal sewer line and sewage
treatment plant in the agreement made between Agra Development
Authority, Agra and developer. Therefore Yamuna Pollution Control Unit
of UP Jal Nigam has been requested to ensure laying of internal sewer
line in the colony.
4. Is sewage being discharged directly in River Yamuna?
Category - A : As stated before, barring 6 projects which have internal
sewer line, and are connected to trunk sewer line, the following projects
are using septic tank whose overflow is being discharge directly in River.
Yamuna.
1. Rajshree Garden (Mauja Jagaripur)
2. Radha Ballabh Public School
3. PG College (Mauza Naraich)
4. Jawahar Bagh-2
Projects mentioned at s.no.1 and 2 have been issued notices to connect
their inter sewer lines to trunk sewer lines and projects mentioned at s.no.
3 and 4 have been issued notices to get sewerage treatment plant made
within two months.
The Septic tank overflow of 3 projects namely Taj View on Yamuna
Kinara Road, Ram Mohan Vihar and Astha City Centre is being
discharged in the drain (nala) which is connected to sewerage treatment
plant. Ram Mohan Vihar colony was sanctioned in 1990 when there was
no provision of sewer line and sewerage treatment plant in the agreement

between Agra Development Authority and developer. therefore for laying
of internal sewer line Yauma Pollution Control Unit of UP Jal Nigam has
been requested for the same. Taj View developer has been issued notice
to ensure connection to main trunk sewer line. Astha City Center is bEiing
given notice to make sewerage treatment plant within two months. During
inspection it was found out that in Vibhav Vatika complex there is
common septic tank for each buildings and the overflow of the septic tank
is being utilized for maintenance of park. Same is the case in Tanishq Raj
Shree Estate, where sewerage treatment plant is constructed and its
overflow is used for park. For both these projects UP Pollution Control
Board has intimated that the sewerage treatment plant constructed is not
as per standards. Accordingly UP Pollution Control Board has been
directed that they should initiate action against the promoter of these
projects under relevant provisions of Water (Pollution , Prevention &
Control) Act-1974. Pushpanjali Seasons, Ganpati Wonder City are under
construction and work has not started in Indra _Estate, whereas Manglam
Estate Extension has not been sanctioned by Agra Development
Authority, Agra .
Category - B : Barring 24 sites out of 58 which have been demolished ,
the outflow of septic tank of remaining sites is being discharged directly in
River Yamuna as enumerated before. These illegal constructions have
been dealt with under relevant section of U.P. Planning & Development
Act-1973 and demolition orders in respect of all these constructions have
been passed by competent authority. These illegal constructions shall be
proceeded against as per rules shortly. The list of all these constructions
has already been appended on page no. 20 to 22.
Category - C : The 9 sites covered in this category were inspected and
their drainage and sewerage is been disposed off by septic tank whose
overflow is being discharged in River Yamuna through S.W. Drain . The
inspection team also found out certain residential colonies where there is

neither internal sewer line nor septic tank and their sewerage is being
disposed off in River Yamuna directly these colonies are:
1. Krishna Colony
2. Krishna Vihar Colony
Out of these colonies Krishna Colony has been developed in year 1947
as a refugee colony, whereas Krishna Vihar Colony has been illegally
developed and procedure under relevant section of U.P. Urban Planning
& Development Act-1973 has been started against it. UP Pollution Control
Board has been instructed to take action against Krishna colony .
Remaining 7 colonies are sanctioned colonies of Agra Development
Authority. Out of these 7, 3 colonies namely Sharda Vihar Phase-I ,
Pushpanjali Garden, Nav Bharat Apartment have internal sewer line laid
but have not been connected to trunk sewer line. The developers of these
three projects have been issued ,notices by Agra Development Authority
to build their internal sewer line and get it connected to trunk sewer line.
Remaining 2 colonies namely Shivam vihar and Rahul Vihar have been
handed over to Nagar Nigam, Agra , as such Nagar Nigam, Agra has
been directed to get sewerage treatment plant constructed for these
colonies by their own resources or by the developers. Maitri Bagh colony
was sanctioned in 1984 when there was no provision of internal sewer
line and sewerage treatment plant in the agreement between Agra
Development Authority and Developer. Therefore Yamuna Pollution
Control Unit of UP Jal Nigam has been requested to ensure internal
sewer line in this colony. Vaibhav Kunj has been issued notice by Agra
Development Authority to build sewerage treatment plant within two
months.
5. How is the solid waste being disposed off?
Category - A : The residents of these projects deposit the solid waste of
their colonies/apartments in dustbins provided by Nagar Nigam, Agra. The

Nagar Nigam, Agra empties these dustbins in their tipper trucks and
disposes their solid waste on its landfill site at Kuberpur.
Category - B : The solid waste of these sites is disposed of on the nearest
vacant land which is collected by Nagar Nigam, Agra. The solid waste of
'Maa Gauri Town' colony is disposed off in the dustbins of Nagar Nigam,
Agra.
Category - C : The solid waste of colonies under these categories is
disposed off in the dustbins provided by Nagar Nigam, Agra . From time to
time Nagar Nigam Agra empties these dustbins in their tipper trucks and
disposes it at their landfill site at Kuberpur.
6. Whether environmental clearance/sanction is required ?
Category - A : Under this category there are 05 projects, whose 1.otal
covered area is more than 20,000 sqm. As per the notification of September
2006 of the Government of India, any project having total area more than
20,000 sqm. environmental clearance/sanction from SEIM in the form of EIA
is essential. Only one developer of the project namely 'Astha City Centre' has
got the environmental clearance. Rest 04 developers who need to have
environmental clearances/sanction but have not got it are as follows :--

All the above construction site have been completely/partially sealed
under the relevant provision of U.P. Urban Planning & Development Act-
1973. During the inspection of joint team it was found that the four projects
were sealed and there was no construction activity going on.

-(b) Out of 58 constructions which were said to be in Flood Plain Zone, 22
constructions have been demolished. Out of 36 remaining constrnctions , the covered area is not exceeding the limit of 20,000 sqm. area. !herefore, no environmental clearance 1s required.
(c) Other colonies/residential area which were inspected by the joint team , there 1s no requirement of EIA clearance
7- Has Environmental Clearance J sanction obtained?
(a} Out of 5 projects where EIA clearance was required only one project namely 'Ashtha City Centre' has been given environmental clearance. The developer of Manglam Shila has not yet app lied for Environmental Clearance in SEIM. Remaining 3 developers who have app lied For environmental clearance, are as follows-
