Grouting materials accep table for use to pennanently seal wells and tesl borings "'"

neat cement, sand-cement slun:y I concrete, cement bentonite or bentonite pellets. The

materia1s selected depend on field conditions and must be approved by the ChaiIpen;on

prior 10 5Caling. After grouting, ,11 wells must be sounded to determine if the grout has

settled.

Cement used for neat ce:nent, concrete, cement-bentonite and sand-cement slurry

sball conform to the requirements of ASlM C150 for Portland cement, Type I.

(1) Sand-Ceme!lt Slurry. Sand-cement for grouting shall be mixed at a

ratio of not more than one part s.md to one pan cement, by weight, and not more than six

gallons of water per sack of cem:nt Clean well sorted sand shall be used.

(2) Neal Cemctl Grout. Neat cement shall be mixed at a ratio of one 94-

pOlU1d sack of Portland cement t, not more than six gallons of potable water.

(3) Concrete. Concrete shall contain 5.3 sacks of ASlM CI50 type 2

Portland cement per cubic yard (If concrete and a maximum of7 gallons of water per 94-

pound sack of cement. The agg-egate shall consist of 47 percent sand and 53 percent

coarse aggregate conforming to ,-\STM C33.

(4) Cement-Ben tonite: a s1un:y of cement, bentonite and water. The amount

of bentonite added shall nol exceed 8% bentonite per dry weight of cement (7.s pounds of

bentonite per 94 pound sack of .:emenl). The volume of additional water USEd in preparing

these slurries is limited to three (iuartetS (0.75) of a gallon per 94 pound sack of cement for

each 1% of bentonite added

(5) Bentonite gn:ut Bentonite grout sbalI consist of a high-solids bentonite

grout and water mixture with a minimum of twenty percent solids, mixed and placed in

accordance with the manufuctUlu'S written instructions. Bentollite shall not be used in

brackish or salt water wells. 8entonite has a higher tendency to settle and may not be

appropriate for some conditions

We are pleased to inform you that the Pump Installation work permitted for the Maluhia Well (Well No. 5018-01) is complete and acceptable and welcome you as a new member to the community of well owners and groundwater users in Hawaii. This certificate of pump installation completion allows you to commence pumping your well for reasonable & beneficial water use.

To protect Hawaii's natural ground water resources for the benefit of all, the following requirements apply to the use of your well:

1. If the well is not in use it must be properly capped.

2. If the well is to be abandoned then the landowner must cause a licensed contractor to apply for a well abandonment permit in accordance with § 13-168-12(f) prior to any well sealing or plugging work.

3. In the event that the well operator and/or landowner changes, the Commission shall be notified of the change prior to the change, and all forms shall be transferred to the new owner.

4. In the event the benchmark in the concrete base of the well is altered in any way, an updated elevation survey (page 5 of the Well Completion Report Part I) shall be submitted to the Commission. The Well Completion Report Part I can be obtained by contacting staff or at www.hawaii.gov/dlnr/cwrm/forms.htm.

5. Your approved pump has a capacity of 48 gpm at a head of 1800 ft. In the future, pump replacements of equal or lesser capacity will not require an additional permit from the Commission, but will require the submission of a Well Completion Report Part II by the licensed pump installer. If the pump replacement is greater than the existing pump, you will need to apply for a new pump installation permit.

6. The landowner shall cause the well operator to maintain the installed meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on a annual basis, on forms provided by the Chairperson (attached), in accordance with § 13-168-7, HAR.

7. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. The authorization to drill a well and/or install a pump shall not constitute a determination of correlative water rights. The landowner and well operator are notified that the quantity of water taken from the well and/or the pump capacity could be reduced by the Commission in the future.

8. In the event that your installed pump is less than 70 gallons per minute, and no elevation survey has been completed, you may be required to do one in the future.

Because groundwater in Hawaii is a public trust, and adverse effects at one well may affect other water resources, any violation of the above conditions, or any other provision of the Hawaii Administrative Rules, may be subject to fines of up to $5,000/day. The Commission needs your help and asks that you to do your part in utilizing this shared resource. We prefer to work with you in meeting the goal of protecting our ground water resources together.

In accordance with Department of Land and Natural Resources, Commission on Water Resource Management's Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", this document permits the abandonment/sealing of MaluhiaAttempt (Well No. 5018-01) at TMK 2-4-008:010, Maui, subject to the Hawaii Well Construction & Pump Installation Standards (HWCPIS - February 2004) which include but are not limited to the following conditions:

I. The Chairperson of the Commission on Water Resource Management, P.O. Box 621, Honolulu, Hawaii 96809, shall be notified in writing before any work covered by this permit commences.

2. This permit shall be prominently displayed, or made available, at the site of construction work until work is completed.

3. The well construction permit application is incorporated into this permit by reference and is subject to the HWCPIS. If the HWCPIS are not followed and as a consequence water is wasted or contaminated, a lien on the property may result.

4. The Well Abandonment Report form shall be submitted to the Commission on Water Resource Management within sixty (60) days after completion of the work. Please contact staff or visit our website at www.state.hi.us/dlnr/cwrm for the current form.

5. The permittee shall comply with all applicable laws, rules, and ordinances.

6. The sealing shall be completed within two (2) years.

7. Special conditions in the attached cover transmittal letter are incorporated herein by reference.

This is reponse to your e-mail sent on Friday to Mel Lima.

1) The ground elevation should be 1841 and the benchmark is 6" higher not 6', this would also make the elevation to top of casing 1841' 6", sorry.

2) The water level was measured with a sounder. The water level was encountered while drilling. We double checked it prior to the installation of the casing and final check was prior to the installation of the pump. I have no additional explanation as to why the level is twice as high as the Pookela Well.

In accordance with Department of Land and Natural Resources, Commission on Water Resource Management's Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", this document permits the abandonment/sealing of MaluhiaAttempt (Well No. 5018-01) at TMK 2-4-008:010, Maui, subject to the Hawaii Well Construction & Pump Installation Standards (HWCPIS - February 2004) which include but are not limited to the following conditions:

1. The Chairperson of the Commission on Water Resource Management, P.O. Box 621, Honolulu, Hawaii 96809, shall be notified in writing before any work covered by this permit commences.


3. The well construction permit application is incorporated into this permit by reference and is subject to the HWCPIS. If the HWCPIS are not followed and as a consequence water is wasted or contaminated, a lien on the property may result.

4. The Well Abandonment Report form shall be submitted to the Commission on Water Resource Management within sixty (60) days after completion of the work. Please contact staff or visit our website at www.state.hi.us/dlnr/cwnn for the current form.

5. The permittee shall comply with all applicable laws, rules, and ordinances.

6. The sealing shall be completed within two (2) years.

Thank you very much for your pursuit of this matter. Our apologies for discovering your January 30,2007 fax message so late. We look forward to learning more about this situation, and resolving some concerns of ours.

The original applicant for this project at John C. Baldwin's residence, 490 Olinda Road, was Wayne Arakaki for Relo Construction. Checking with DCCA, we discovered that Wayne Arakaki possessed an inactive C-57 license (CT-11912), although he himself is not a driller. Relo Construction also has a C-57 license under the name of Rick Lopes (ABC 18398). The well construction and pump installation permits were issued to Rick Lopes June 28, 2006.

On January 24,2007, we received a fax letter from Baldwin notifying us ofa change in contractors and some amendments to the application specifying more precisely the proposed water use and enlarging the casing and borehole size. Attached were copies of the well drilling and pump installation permits signed by Mel Lima of Mel's Water Works (C-18254) as the new contractor. Later the same day, we received a phone call from Rick Lopes, explaining that after a series of incidents and disagreements with the landowner Baldwin, he might have to withdraw his permit for the project.

Two days later, Lopes called again to confirm the withdrawal and to say that he would remove the well drilling rig from the property. Our staff called Mel Lima that day, who confirmed that he would be the supervising licensed contractor, and that Derrick Moreira would be doing the work. Staff noted for Lima that Lopes intended to remove the rig, and that there had been a disagreement between Lopes and Baldwin. Lima stated he was given to understand that the rig belonged to Baldwin, and that he would call Moreira to find out more, that Lima did not want to get caught in the middle of a dispute.

Later that same day, January 26, 2007, Paul Ueoka, attorney for Baldwin, called to ask about the process for transferring the permits, and it was explained that the process involved having the new contractor sign a copy of the permit, which had already been done, and sign the original application. Still later that day, Lima called back to relate what he'd heard about the ownership of the drilling rig, and noted that he had worked with Derrick Moreira in the past at Beylik Well Drilling and Pump Service, Inc., and that Moreira took Mel's place when Mel left that firm to go on his own. He said Moreira would be applying for his own driller's license·, and that Lima would not be doing the drilling in the future.

On January 29, 2007, Commission staff sent a letter to Baldwin, acknowledging that we received his letter on January 24, 2007, announcing that the permit to Rick Lopes was being cancelled, and that Mel Lima, as the new contractor signing the permit, would also need to sign the original application before commencing work.

Later on January 29,2007, we received a letter from Lopes confirming the request to withdraw the permit. Attached was a letter dated January 18, 2007 from Paul Ueoka to Lopes, asserting hat the well drilling rig being used by Lopes was funded by Baldwin, and was being held on Baldwin's property in collateral against expectations of repayment of loans.

On January 30, 2007, Lopes called back to say he had gone back to the Baldwin property with a police escort and successfully removed the drilling rig, after replacing a removed ignition mechanism.

On January 31,2007, we received a fax letter from Ueoka, reiterating the sequence of applications, permit issuance, and transfer of permits to the new contractor. He also claimed that title for the drilling rig should be with Baldwin, who would be filing suit against Relo Construction (Rick Lopes).

On February 22,2007, Mel Lima appeared at the Commission office and signed a copy of the original application, completing the transfer of the permits.

On March 23,2007, Lima called staff to indicate that Derrick Moreira was applying for a C-57 license, and that ifthat was successful, the permits might be transferred to Moreira. Other than these contacts, we have had no direct information about the Moreira brothers. It is also not clear whether any actual drilling work occurred during this period.

The Regulated Industries Complaints Office (RICO) has received a report of unlicensed, C-57 well drilling, contractor activity occurring at the Baldwin residence, 490 Olinda Road, Maui, Hawaii (#490).

Parties allegedly engaged in the unlicensed contracting activity are reported to be Derrick Moreira and Daryl Moreira (PARTIES) who have a State of Hawaii (SOH) registered trade name of Derrick's Water \I\fell Drilling & Pump Services (SERVICES).

Again, neither of the aforementioned Moreira parties, nor SERVICES hold any SOH contractor license.

Please be advised that we represent John C. Baldwin of Makawao, Maui, Hawaii.

In mid-2006, a Well Construction Permit and a Pump Installation Permit were issued for the Maluhia Well (Well No. 5018-01) on land owned by Mr. Baldwin. At the time, the drilling contractor was Relo Construction, Inc., with RME Wayne l. Arakaki of Wailuku, Maui, Hawaii.

Due to a number of problems with Richard A. Lopes, Jr., President of Relo Construction, Mr. Baldwin felt compelled to transfer the Permits, or have new Permits issued in favor of Mel's Water Works ("Mel's"). We understand that you have been contacted by Mel's regarding the transfer of the Permits and/or issuance of new Permits.

We spoke with Mr. Arakaki, and he has no objections to the transfer or the issuance of new Permits to Mel's. Mr. Arakaki can be reached at:

By way of information, the drilling rig and support equipment and materials were on Mr. Baldwin's land. We gave earlier notice to Relo Construction that title to the equipment should be transferred to Mr. Baldwin, or Mr. Baldwin should have a security interest or a lien on the equipment. All of the equipment, supplies, and materials were purchased with money from Mr. Baldwin, and Mr. Baldwin is supposed to have legal title or a lien on same. Mr. Lopes took

the equipment on Saturday, January 27, 2007. We will be filing a lawsuit against Relo Construction and Mr. Lopes.

In any event, you indicated that this information is irrelevant because the transfer of the Permits and/or issuance of new Permits do not depend upon title or ownership of the drilling rig and equipment. You are mainly concerned that a properly licensed driller is responsible for the well.

Thank you for your faxed letter dated January 23, 2007, noting a change in contractor to perform work under permits approved for well construction and pump installation in the captioned well, and noting other changes for the application. You also included copies of the permits signed by the new contractor, Mel Lima, License No. C-18254.

We are cancelling the permit issued to Rick Lopes (C-18398) of Relo Construction, who has requested that the permit he signed on December 29,2006 be retracted, as he is no longer doing work on this project as of January 22,2007.

We are following up to have your new licensed contractor, Mel Lima, sign the application form, indicating he is responsible for the representations of construction that was approved therein. When Mr. Lima has also signed the original application with amendments, he may commence work. Until then, you do not have an active permit to construct this well.

01) for John C. Baldwin. Mr. Baldwin (almost 70) was climbing high up on the rig trying to do maintenance without safety gear or other personnel standing by, starting up the engine, etc. all without authorization or permission from the licensed driller and rig owner (Lopes). He was concerned about safety, his own insurance and license, and might have to retract the permit. He's very upset about this because he has been associated with Baldwin for some time (like a father and son), and Baldwin invested in the company to buy the rig owned by Relo Construction.

26 Jan 07 call from Rick Lopes again. He wants to retract the permit he signed, remove his rig, and prevent any further liability to his license and unsafe, illegal activity. He says he "sent the cops up there", and has tried to work out an understanding with Mr. Baldwin. Unlicensed drill workers from the Big Island are on site, and it seems Baldwin is hiring them to do the work. They have been associated with Mel Lima, but Lopes says Lima doesn't want this responsibility. Lopes says Lima does not have a rig there. [Note: independently, Baldwin representatives have called to say they are changing drillers, and have submitted the original permits with Lopes crossed out, and the signature of Mel Lima.]

I suggested to Lopes that he send a letter with all the particulars, and that he remove his rig as soon as possible. I also said I would contact DoCaRE to pay a site visit.

I've called Mel Lima, and he acknowledges signing the permit, and would be supervising the work, but another guy (Derrick _?) would be doing the work. I noted that Lopes intends to remove his rig; Lima had been given to understand that the rig belonged to Baldwin. He said he wanted to call Derrick and follow up. He doesn't want to get caught in a problem. [Question for the record: what does licensed driller mean? the supervisor, not the actual driller? what is supervision - occasional visits from another island?]

two more calls from Rick Lopes, indicating his investigation with RICO has turned up drug and firearm allegations; he's concerned for Baldwin.

call from Paul Ueoka (?) atty for Baldwin, asking about whether and how to transfer a permit. i explained this had already been done, and explained the process.

spoke with Mel Lima two more times. Derrick MoreiraNierra (?) worked at Beylik with Lima, they have good working relationship; Derrick took Mel's place when Mel left; Mel not doing drilling any more, but using his license while MoreiraNierra is getting his. Mel also heard from Paul Ueoka (Carlsmith Ball LLP), a letter he forward faxed to us to the effect that Baldwin loaned $532,945 for the purchase of a drilling rig at auction from Maui DWS, expected other details not performed for the drilling of Maluhia Well, and that Relo failed to pay workers at the job (Lopes says he did pay them); Baldwin is holding tha rig as collateral.

30 Jan 07 Rick Lopes called to say he went up to fetch his rig Saturday with his driller, his wife, and a police escort, meeting the Baldwin family, bodyguards, and lawyers. He successfully removed the rig, after finding the ignition removed, by replaCing it.

Sounds like things are smoothing out. Rick Lopes (Relo) got his rig off the site, with a police escort, on Saturday, and Susan says the change of contractor materials went out yesterday. So Mel Lima does not have a rig, and the Baldwin family will have to decide what to do. Lopes says there may be some negotiations.

I have attached the following documents wlth appropriate changes.

1. Application for Well Construction/Pump Tnstallation Permit 2. Well Construction Pennit 3. Pump Installation Pennit

In addition., the following changes have been made to the original application:

1. Proposed use (#18 on application) should read: Irrigation, grass, nursery, plants, trees, water troughs fur cattle on approximately 19 acres.

2. Change to 6" casing from 8" casing - "ve teaIize that there needs to be a 2" annulus on either side of the casir:g and wen bore needs a minimum 12" bore hole.

Thank you for the opportunity to review and comment on the well and pump application for the proposed installation of the Maluhia well and pump, which was received by our staff on May 26,2006. Our review is based on reports, maps, and aerial photographs maintained at the State Historic Preservation Division (SHPD); no field inspection was conducted on the subject property.

Based on the submitted documents, the subject action for the proposed undertaking consists of the construction of a well and the installation of an associated pump. The proposed undertaking is located at 490 Olinda Road and is on the property of the BaldwinlRice residence, which is listed on the Hawai'i Register of Historic Places (8/4/90).

A search of our records indicates that an archaeological survey has not been conducted of the subject parcel. This area in general is likely to have once been the location of pre-Contact fanning, perhaps with scattered houses. Previously documented archaeological sites in the general vicinity consist of rock terraces, rock mounds, petroglyphs (rock carvings), modified rock outcrops, rock alignments, and historic plantation camp (and related) features. Additionally, a human burial was identified in a nearby pineapple field during shallow backhoe trench excavations conducted by Maui Pineapple Company [TMK: (2) 2-4-012:005].

Therefore, in order to determine the effect of the proposed undertaking on historic sites, we recommend that no action be taken on the proposed well and pump installation until an archaeological field inspection has been conducted in the areas of potential affect. The field inspection shall be conducted by an independent qualified archaeologist to determine whether historic sites are absent or present and whether archaeological monitoring shall be required. Our revised comments will be based on the findings of the field inspection.

As part of the Chairperson's approval, the following special conditions were added and are part of your permit under Permit Condition 13:

1. Attached for your information are copies of the Department of Health's (DOH) review comments. Please note DOH's requirements related to discharge of effluent from well drilling and testing activities.

2. Attached for your information is a copy of the State Department of Land and Natural Resources Land Division's comments related to water lease requirements.

Please refer to the Permit Processes Worksheet (transmitted with your acknowledgement letter) for further information regarding the process of drilling a well and installing a pump.

No withdrawal of water shall be made other than for testing purposes until a certificate of pump installation completion has been issued by the Commission.

IMPORT ANT - Drilling work shall not commence until a fully signed permit is retnrned to the Commission. The Chaireerson of the Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, at least two (2) weeks before any work authorized by this permit commences and staff shall be allowed to inspect installation activities in accordance with §13-168-15, Hawaii Administrative Rules.

This permit shall be prominently displayed, or made available, at the site of construction work until work is completed.

The well construction permit shall be for construction and testing of the well only. The permittee shall coordinate with the Chairperson and conduct a pumping test in accordance with the HWCPIS (the latest rump test worksheet can be obtained by contacting Commission staff or at www.hawaii.gov/dlnr/cwrmlforms.htm). The permittee shal suomit to the Chairperson the test results as a basis for supporting an application to install a permanent pump. No permanent pump may be Installed until a pump installation permit is approved and issued by the ChaIrperson. No withdrawal of water shall be made for purposes other than testing without a Certificate of Pump Installation Completion. The permitted pump capacity described on the pump installation permit may be reduced in the event that the pump test does not support the capacity.

In basal ground water, the depth of the well may not exceed one-fourth (1/4) of the theoretical thickness (41 times initial head) ofthe basal ground water unless otherwise authorized by the Chairperson.

The permittee shall incorporate mitigation measures to prevent construction debris from entering the aquatic environment, to schedule work to avoid periods of high rainfall, and to revegetate any cleared areas as soon as possible.

In the event that historically significant remains such as artifacts, burials or concentrations of shells or charcoal are encountered during construction, the permittee shall stop work and immediately contact the Department of Land and Natural Resources' Division of Historic Preservation.

The proposed well construction shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct the well shall not constitute a determination of correlative water rights.

The Well Completion Report Part I shall be submitted to the Chairperson within sixty (60) days after completion of work (please contact staff or visit www.hawaii.gov/dlnr/cwrm/forms.htm for current form).

The permittee shall comply with all applicable laws, rules, and ordinances; non-compliance may be grounds for revocation ofthis permit.

The well construction permit application and any related staff submittal approved by the Commission are incorporated into this permit by reference. This permit is also subject to the HWCPIS. If the HWCPIS are not followed and as a consequence water is wasted or contaminated, a lien on the property may result. Any variances from the HWCPIS shall be approved by the Chairperson prior to invoking the variance.

The work proposed in the well construction permit application shall be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Chairperson upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Chairperson no later than the date the permit expires. .

If the well is not to be used it must be prorerly caf:,ped. If the well is to be abandoned during the course of the project then the permittee must apply for a well abandonment permit in accordance with § 3-168- 2(t) prior to any well sealing or plugging work.

The permittee, its successors, and assigns shall indemnity, defend, and hold the State of Hawaii harmless from and against any loss, liability, claim, or demand for property damage, personal injury, or death arising out of any act or omission of the applicant, assigns, officers, employees, contractors, and agents under this permit or relating to or connected with the granting of this permit.

This permit shall apply to the location shown on the application only. If the well is to be relocated, the permittee shall apply for a new well construction/pump installation permit In accordance with Hawaii Administrative Rules §13-168-12(t).

Special conditions in the attached cover transmittal letter are incorporated herein by reference.

In accordance with Department of Land and Natural Resources, Commission on Water Resource Management's Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", this document permits the pump installation for Maluhia Well (Well No. 5018-01) at TMK 2-4-8:10, Maui, subject to the Hawaii Well Construction & Pump Installation Standards (HWCPIS - February 2004) which include but are not limited to the following conditions:

I. The Chairperson to the Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, at least two (2) weeks before any work covered by this permit commences and staff shall be allowed to inspect installation activities in accordance with § 13-168-15, Hawaii Administrative Rules

2. No withdrawal of water shall be made other than for testing until a Certificate of Pump Installation Completion has been issued by the Commission.


4. The pump installation permit shall be for installation of a 48 gpm rated capacity, or less, pump in the well. This permanent capacity may be reduced in the event that the pump test data does not support the capacity.

5. A water-level measurement access shall be permanently installed, in a manner acceptable to the Chairperson, to accurately record water levels.

6. The permittee shall install an approved meter or other appropriate means for measuring and reporting withdrawals and appropriate devices or means for measuring chlorides and temperature at the well head.

7. Well Completion Report Part II shall be submitted to the Chairperson within 60 days after completion of work. This form can be obtained by contacting staff or on the internet at www.hawaii.gov/dlnr/cwrm.

8. The permittee, well operator, and/or well owner shall comply with all applicable laws, rules, and ordinances, and non-compliance may be grounds for revocation of this permit.

Thank you for the opportunity to comment on this permit review and application.

The applicant is proposing to construct a new well and install a new pump for a withdrawal of 20,000 gpd (gallons per day) for irrigation. The project site overlies the Makawao aquifer with a sustainable yield of 7 MGD (million gallons per day). In order to protect the groundwater resources, the Department encourages the applicant to adopt best management practices (BMPs) for well construction/pump installation to prevent contamination during construction and maintenance. These practices include:

1. Inspect exposed parts of the well periodically for problems such as cracked or corroded well casing, broken or missing well cap, damaged protective casing and settling or cracking of surface seals.

2. Slope the area around the well so that surface runoff drains away from the well. 3. Provide a well cap or sanitary seal to prevent unauthorized use of or entry into the well. 4. Provide for sediment removal or well cleaning as necessary. 5. Have the well tested once a year for fecal coliform or other constituents that may be of

concern. 6. Avoid mixing or using pesticides, fertilizer, herbicides, degreasers, fuels or other polu

tants near the well. 7. Do not locate any type of potentially polluting activity up slope from the well. 8. Keep accurate records of any well maintenance, such as disinfection or sediment removal

that might require use of chemicals in the well.

The Maui County Planning Department has received the above subject request. The site of the proposed work is not in the Special Management Area for the Island of Maui. However, it is on the property of the Baldwin/Rice residence, which is on the Hawaii Register of Historic Places, 8/4/90. We are therefore copying this letter and the materials you sent us to the Maui Office of your Department's Historic Preservation Division. From a review of the site plan you provided us, the well appears to be proposed to be located approximately 270 feet from the nearest point of the residence. This letter and the materials you sent us are also being copied to the County of Maui's Development Service Administration as well as the County Department of Water Supply in case they also might wish to comment.

This well qualifies as a source which will Serve as a source of potable water to a public water system (defined as serving 25 or more people at least 60 days per year or has) 5 or more service connections) and must receive Director of Health approval prior to its use to comply with Hawaii Administrative Rules (HAR), Title II, Chapter 20, Rules Relating to Potable Water Systems, §) 1-20-29.

This well does not qualify as a source serving a public water system (serves less than 25 people or more people at least 60 days per year or 15 service connections) and if the well water is used for drinking, the private owner should test for bacteriological and chemical presence before initiating such use' and routinely monitor the water quality thereafter. However, if future planned use from this source increases to meet the public water system definition then Director of Health approval is required prior to implementation.

If the well is used to supply both potable and non-potable purposes in a single system, the user shall eliminate cross-connections and backflow connections by physically separating potable and non-potable systems by an air gap or an approved backflow preventer, and by clearly labeling all nonpotable spigots with warning signs to prevent inadvertent consumption of non-potable water. Backflow prevention devices should be routinely inspected and tested.

It does not appear that this well will be used for consumptive purposes and is not subject to Safe Drinking Water Regulations.

For the applicant's information, a source of possible wastewater contamination ( Jis ( 1 is not located near the proposed well site (information attached).

An NPDES permit is required.

We have received your Well ConstructionJPump Installation permit application and filing fee for the Maluhia Well (Well No. 5018-01). However, a licensed C-57, C-57a, or A contractor is required to obtain a permit in accordance with the State Water Code, § 174C-84(a). The license for Relo Construction, Inc. (CT-11912) is an inactive contractor's license at this time. For this reason, your application will not be accepted as complete until a contractor with a valid active license signs and completes sections 24 & 25 on the application form.

However, we will process your incomplete application for review, and if the review warrants the issuance of a permit, a letter of assurance will be issued in lieu of the permit. The letter of assurance will indicate that a permit will be issued when the contractor signs the application, and the following conditions are met: a) the contractor has no outstanding issues with the Commission; b) there have been no significant changes to the application; c) there have been no significant changes to applicable laws, rules, regulations; d) there have been no significant changes to hydrologic conditions.

For your information, the attached table describes the process, responsible parties, and deadline requirements for drilling or modifying a well and installing, modifYing, or replacing a pump.

By this acceptance letter, we are also notifYing the well operatorllandowner that water may not be pumped for purposes other than testing until the certificate of well construction/pump installation completion letter is issued to the well operator and landowner. Additionally, the permitted pump capacity described on the pump installation permit may be reduced in the event that the pump test does not support the capacity. No certificate of pump installation will be issued until the Commission has determined that the pump capacity will not have adverse effects on the aquifer, other nearby wells, or streams. In other words, you may need to remove the pump and install a smaller pump at the Commission's discretion before you can withdraw water for purposes other than testing.
