Draft Provisional Rules of Procedure of the . Executive Board of the World Health Organization

I。MEMBERSHIP

Rule 1.

The Executive Board (hereinafter referred to as the "Board") shall

consist of eighteen persons (hereinafter referred to as the "members")

designated by as many S七ates Members elected Ъу the World Health Assembly.

Rule 2.

Rule Jo

States Members entitled to designate a person to serve on the Board

^diich are re-elected may designate again the person previously nominated

Rule 4o

If} for any reason, a definitive vacancy occurs in the membership

of the Board, the State Member concerned shall designate a successor to

fill the vanancy. The successor!

II. CREDENTIALS

Rule J .

The Governments of the States Members shall inform the Director-

General in writing of the names of persons designated Ъу thon to serve

as members of the Board, their alternates or successors.

III. SESSIONS,

Rule 8. 書供wwavtf

The Board shall meet at least twice a year in regular session. It

shall determine the place of meeting for each regular session. It shall

be convened Ъу the Director-General。

Rule 9专

The Director-General, in consultation with the Chairman, shall con-

vene the Board in special session at the ¿oint request Ъу any six maribers,

addressed to h±m in writing, and stating the reason for the request. In

this case the session shall be convened within • • • e。• days following

receipt of the request. The Director-General} in consultation with the

Chairraan? shall determine the place of meeting of the Board in special

session.

Rule 10,

The Board shall elect 3/ts officers, viz. a Chairman and two Vice-

Chairmen, from among i七s members each year at its first session after its

reconstitution Ъу the Health Assembly, The Chairman sheül not become

eligible for re-election until two years have ela-rsed since, he ceased to

hold office.

Rule lio

Thé record of thç decision taken at a regular session as to the date

of the next session shall constitute adequate n otice thereof to the members

of the Board.. In the case of a special session the Dii^ector'-General shall

give to the members sufficient notice of the date and place of the session.

If any matter of major importance to. the national interests of a

The provisional agenda of each regiüar session shall be drawn up by

made by a majority of the members present and voting.

Rule 22.

Each member of the Board shall have one vote. For the purpose H

of these rules, the phrase siembers present and voting" means members

casting an affirmative or negative vote. Members who abstain froa

voting shall be considered as not voting »

Rule 75.

The Board shall normally vote by show of hands # However, any

member may request a roll-call which shall then be taken in the English

alphabetical order of the names of the States Members concerned.

Rule 24,

The vote of each member participating in any roll-call shall be

inserted in the records.

Rule 25,

All elections and the nomination of the Director-General shall

be decided by secret ballot»

When only one elective place is to be filled and no candidate obtains

in the first ballot the majority required, a second ballot shall be taken

which shall be restricted to the two candidates obtaining the largest

number of votes• If in the second ballot the votes are equally divided,

the Chairman shall decide between the candidates by drawing lots.

Rule 28•

"When two or more elective places are t o b e filled at one time under

the same conditions those candidates obtaining in the first ballot the

majority required shall be elected. If the number "of candidates obtain-

ing such majority is less than the number of places to be filled, there

shall be additional ballots to fill the remaining places, the voting to

be restricted to the candidates obtaining the greatest number of votes in

the previous ballot to a number not more than twice the places remaining

to be filled.

Rule 29.

.If a vote is equally divided on matters other.than elections, the

proposal shall be regarded as rejected.

Rule 30.

Twelve members of the Board shall constitute a quorum.

In addition to exercising, the powers conferred upon him elséwhere

by thèse rules, the Chairman shall declare the opening ánd closing of

each meeting of the Board, shall direct the discussion, ensure the ob-

servance of these rules, accord the right to speak, put questions to the

vote and announce decisions and results of the voting• . • �

During the discussion of any matter, a member may rise to a point

of order, and the point of order shall be immediately: decided by the

Chairman in accordance with these rules.

Rule 33*

During the discussion on any mattery'a member may move the suspen-

sion or adjournment of the debate. Any such motion if seconded, shall

be put to the vote immediately and without discussion^ ;

Rule 34

The Board may limit the time to be allowed to each speaker.

Rule 35

A member may at any time move the closure of the debate^

•whether or not any other member has signified his wish to speakt

Rule 38

If two or more amendments arç. moved to a proposal, the Board

shall first vote on the amendment furthest removed in substance

from the original proposal and then on the amendment next furthest re*-

moved therefrom, and so on. until all the amendments have been put • - , '* ..

Rule 40 .

A motion may be iwithdrawi by its proposer at any time before

voting on it has begun, provided that the motion has not been amended•

When a proposal has been adopted or rejected it may not be recorw

RULES OF PROCEDURE

Rule 42

Any of these rules may be amended or stispended by the Board

provided that at least 48 hours1

notice of the proposal for such

amendment or suspension has been given to the Chairman and communier

bed by him to the members 24 hours before the meeting at nùich the

proposal is to be submit ted # If, however, on the advice of the

Chairman the Board is unanimously in favour. of such a proposal, it

may adopt it immediately and without notice.

The Board may at its discretion apply such Rules of Procedure

DRAFT PROVISIONAL RULES OF PROCEDURE OF THE EXECUTIVE BOARD OF THE WORLD HEALTH ORGANIZATION

1. MEMBERSHIP

Role 1.

The Executive Board (hereinafter referred to as the "Board") shall

consist of eighteen persons (hereinafter referred to as the "members")

The States Members shall be elected by the World Health Assembly

(hereinafter referred to as the "Health Assembly") for a three-years

meeting of the Board held after the election of the State Member

concerned and shall end at the expiration of the period for "which such

State Member has been elected•

During this period the State Member may change the person so

designated•

Rule 3.

"When a member designated to serve on the Board is prevented from

attending a meeting of the Board, the State Member concerned may

designate an alternate to serve in his place váth the same status as

the absent member.

R u l e 4 .

Should a member of the Board be absent at two consecutive sessions

of the Board, the Director-General report this fact to the Health

The Board shall hold at least two sessions a year. It shaU.

Rule 7.

The Director-General^ in consultation with the Chairman, shall also

convene the Board at the joint request by any six members, addressed to

him in witing and stating the reason for the request. In this case

the session shall be convened within 30 days following receipt of the

request. In this case the session shall be held at Headquarters unless

the Director-General, in consultation with the Chairman of the Board,

determine otherwise»

Rule 8.

If any matter of particular concern to a State Member which has not

been elected to designate a member of the Board or to a non-Member State

is to be discussed at any meeting of the Board, the Director-General

shall give adequate notice thereof to the State concerned so as to enable

that State, if it so desires, to designate a representative -who shall

have the ri^it to speak, but not to vote.

Rule 9.

The meetings of the Board shall be held in public unless the Board

decides otherwise•

Rule 10.

The provisional agenda of each session shall be drawn up by the

Director-General in consultation -with the Chairman. Except in the case

of sessions convened under Rule П,it shall be despatched by the

Director-General to the members of the Board and the Members of the World

Health Organization (hereinafter referred to as the "Organization") at

least six weeks prior to the commencement of the session together with

the notice convening the Board•

Rule IX.

The provisional Agenda of each session shall include, inter alias

(a) all items the inclusion of "which has been ordered by the

Health Assembly; ,

(b) all items the inclusion of -which has been ordered by the

Board at a previous session;

(c) any item proposed by a Member or Associate Member of the

Organization;

(d) any item proposed by a member of the Beard;

(e) subject to such preliminary consultation as may be necessary

between the Director-General and the Secretary-General of the

United Nations, any item proposed by the United Nations ; and

(f) any item proposed by any specialized agency with which the

Organization has entered into a formal agreement, subject to

the relevant provisions thereof^

Rule 12 о

The Director-General may, in consultation with the Chairman,

include any question suitable for the agenda i/vhich may arise between

despatch of the provisional agenda and the opening day of the session

in a supplementary agenda -vriiich the Board shall examine together "with

the provisional agenda

V。 OFFICERS OF THE BOARD

The Board shall elect its officers, viz. a Chairman and two

Vice-Chairmen, from among its members each year at its first session

after its reconstitution by the Health Assembly. The Chairman shall

not become eligibla for re~clcction until two years have elapsed since

he ceased to hold office..

Rule 14.

If the Chairman is aDsent from a meeting or аду part thereof, he

shall designate one of the Vice-Chairmen to preside. The same

procedure shall be adopted iwhen the Chairman is unable to attend a

session of the. Board.

If the Chairman is unable to make this designation, the Board

shall elect one of the Vice-Chairmen to preside during the session.

Rule 15.

If the Chairman for any reason is unable to complete his term

of office, the Board shall elect a new Chairman for the remaining

period of his term*

minutes shall be prepared in both working languages and shall be

meeting to -which they relate « Within forty-eight hours thereafter

members shall inform the Secretariat in writing of any corrections they

All resolutions^ recoimnendations^ and other important decisions of

Chinese, English, French, Russian and Spanish shall be the

pfficial languages, and English and French the working languages of

the Board

Rule 22.

Speeches made in either of the working languages shall be

interpreted into the other working language•

Speeches made in any of the other three official languages

shall be interpreted into both working languages*

Rule 24,

Any delegate may speak in a language other than the official

languages. In this case, he shall himself provide for interpretation

into one of tiie working languages. Interpretation into the other

working language by an interpreter of the Secretariat may be based

on the interpretation given in the first working language.

Rule 25.

All resolutions, reccnraendatiens and other decisions of the Board

shall be drawn up in both working languages.

When a proposal has been adopted or rejected it may not be

reconsidered at the same session of the Board, unless the Board, by a

two-thirds majority of the members present and voting, so decides•

Permission to speak on a motion to reconsider shall be accorded

only to speakers opposing the motion, after which it shall be inmie-

diately put to the vote.

Rule 47

The Chairman may at any time require any proposal, motion,

resolution^ or amendment to be seconded»

XI. SUSPENSION AND AMENDMENT RUbES OF PROCEDURE

Rule 48

Subject to the provisions of the Constitution, any of these rules

may be amended or suspended by the Board provided that at least 48

hours1

notice of the proposal for such amendment or suspension has

been given to the Chairman and coimniinicated by him to the members 24

hours before the meeting at which the proposal is to be submittecU If

however, on the advice of the Chairman the Board is unanimously in

Rule 49

The record of the decision-taken at a regular session as to the

date of the next session shall constitute adequate hotice thereof to

the. members of the Board• In the case of a special session the

Director-General shall give to the members sufficient notice of the

Rule 12,

If any matter of major importance to the national interests of a

State "Mèmber; whiçh has not been elected to designate a member of the

Board Is'to be discussed at any meeting of the Board, the Director-

General shall give.adequate notice thereof to.the Government of the

State concerned so as to enable that átate, if' it so desires, to

designate a representative who shall have the right to speak, but not

to vote on the item in question.

Ru le 13•

The provisional agenda of each session shall be drawn up by the

Director-General. It shall indicate the date and place of meeting

of the session and shall be despatched by the Director-General at

least two months prior to the opening day。

The Director-General shall include any question suitable for the

agenda "which may arise between despatch of the provisional agenda and

the opening day of the session, in a supplementary agenda which the

Board shall examine together with the provisional agenda.

V. COMMITTEES OF THE BOARD

Rule 14/

The Board may establish such Committees as it may deem necessary

for the study of and report on any item on its agendaé

It may delegate to such Committees any of its powers.

The Board shall review from time to time, and in any case once

each year, the need to maintain each Standing Committee established

under its authority•

VI. SECRETARIAT

Rule 15.

The Director-General shall act as the Secretary of the Board and

of any sub-division thereof. He may speak at meetings, but not vote.

He may delegate his functions. •

Rule 16,

Unless otherwise decided by the Board, the Secretariat shall

prepare only suxmaïj records of its meetings. These records shall be

prepared in both working languages and shall be distributed to the

members in draft form as soon as possible after the close of the

meeting to iwhich they relate. Within fortyeight hours thereafter

members shall inform the Secretariat in writing of any corrections they

wish to have made.

VII. LANGUAGES

Ru le 17>

English and French shall be the working languages of the Board/.

Rule 18.

Speeches made in either of the working languages shall be inter-

preted into the other working language•

Rule 19.

All resolutions, recommendations and other formal decisions of

the Board shall be drawn up in both working languages.

Rule 20.

All resolutions, recommendations and other official decisions

adopted by the Board shall be communicated by the Director-General to

the members of the Board and to all Members of the Organization

without delay.

VIII- VOTING

or resolved by the Health Assembly, the decisions of the Board shall

be made by a majority of the members present and voting.

Rule 22.

Each member of the Board shall have one vote. For the purpose

of these rules^ the phrase M

members present, and voting^ means members

casting an affirmative or negative vote. Members who abstain from

voting shall be considered as not voting.

Rule 23>

The Board shall normally vote by show of hands. However, any

member may request a roll-call iwhich shall then be taken in the

English alphabetical order of the names of the States Members concerned.

Rule 24.

The vote of each member participating in any roll-call shall be

inserted in the records.

Rule 25>

A secret ballot shall be taken if the Board so decides. All

elections and the nomination of the Director-General shall be decided

by secret ballot.

Rule 26

When only one elective pla.ce is to Ъе filled and no candidato

obtains in the first ballot the majority required p a second ballot shall

Rule 32

During the discussion on any matter, a niember may move the

Rule 35

Parts of a proposal shall be voted on separately if a member

requests that a proposal be divided.

Rule 37

If two or more amendments are moved to a proposal, the Board

therefrom, and so on, until all the amendments have been put to the

Rule 38

Irtihen an amendment revises^ adds to, or deletes from a proposal,

the amendment shall be voted on first, and if it is adopted, the

amended proposal shall then be voted on.

Rule 39

A motion may be withdrawn by its proposer at any time before

voting on it has begün, provided that the motion has not been

amended. A motion thus withdrawn may be re-introduced by any

member.

Rule 40

When a proposal has been adopted or rejected it may not be

reconsidered at the same session of the Board, unless the Board,

by a two-thirds majority of the members present and voting, so

decides. Permission to speak on a motion to reconsider shall be

accorded only to speakers oppcsinrr the motion, after which it shall

be immediately put to the vote.

X. SUSPENSION AND AMENDMENT OF ~ R U L E S OF PROCEDURE

Rule 41

Any of these rules may be amended or suspended by the Board

provided that at least 48 hours丨 notice of the proposal for such

amendment or suspension has been given to the Chairman and

communicated by him to the members 24 hours before the meeting at

which the proposal is to be submitted. If, however, on the advice

of the Chairman the Board is unanimously in favour of such a pro-

posal, it may adopt it iirmediately and without notice.

Rule 42

The Board may at its discretion apply such Rules of Procedure

of the Health Assembly as it may deem appropriate to particular

circumstances.
