The Executive Board adopted the agenda set out in documents 102 EX/l Rev. andAdd. & Corr., and decided to add a new item 3. 5: Methods of work of the Execu-tive Board.

3. Considering that the adoption of the recommendations made by the Director-General in paragraphs 8, 9 and 10 of document 102 EX/2 would make it pos-sible to improve the efficiency of intergovernmental committees and councilsand would contribute to their proper functioning,

4. Recalling the terms of its decision 6.2 adopted at its 98th session,

5. Recommends that the General Conference take account, during elections tosuch intergovernmental committees and councils, of the criterion of equit-able geographical distribution, and ensure that such distribution in thesebodies conforms to the system adopted for elections to the Executive Board;

6. Recommends that the General Conference amend the statutes of the Inter-governmental Council for the General Information Programme, the Interna-tional Co-ordinating Council of the Programme on Man and the Biosphere,and the International Council of the International Hydrological Programme,so that their members’ terms of office may be so fixed as to terminate withthe closure of the second ordinary session of the General Conference follow-ing that at which they are elected, half the membership of those councils tobe renewable at each ordinary session of the General Conference;

7. Further recommends that the names of the members of each council whoseterm of office will expire with the closure of the first session following theone at which they have been appointed be designated by the drawing of lots,to be carried out, after the first election, by the President of the GeneralConference;

8. - Invites the Director-General to submit to the General Conference at itstwentieth session the necessary draft amendments to the statutes of thosecouncils;

9. Invites the Interim Intergovernmental Committee for Physical Education andSport to take account of the foregoing recommendations in preparing thedraft statutes of the permanent committee, which are to be submitted to theGeneral Conference at its twentieth session;

10. Considers it desirable that Member States which are members of a commit-tee or a council appoint the same persons to represent them throughouttheir term of office and ensure that they effectively participate in the workof such councils and committees.

Having examined the new statute of the Joint Inspection Unit (United NationsGeneral Assembly resolution 31/192) as requested by the General Confer-ence in the above-mentioned resolution,

Finds that acceptance of the statute requires formal action by the GeneralConference at its twentieth session;

Considering that such action could not be taken until after the coming intoeffect of the new statute and that interim arrangements would therefore berequired,

4.1 Examination of the structure of the C/5 document, in the light of the decisionsof the General Conference, with particular reference to the relationship betweenthe C/4 and C/5 documents (102 EX/8)

The Executive Board,

1. Having examined document 102 EX/8 concerning the structure of the C/5document in the light of the decisions of the General Conference, withparticular reference to the relationship between the C/4 and C/5 documents,

2. Considering that document C/5 should:

(a) bring out clearly the conceptual structure of the programme, i. e. thelinks between medium- term objectives and activities,

(b) make it possible to identify conveniently for each activity the unit ofthe Secretariat responsible for its implementation and conversely, foreach unit, the activities for which it is responsible,

(c) make it possible to assess the results and impact of the activities car-ried out with a view to solving the problems addressed in accordancewith the objectives,

3. Bearing in mind the views according to which the presentation of the C/5document by objectives, as set out in Annex I to document 102 EX/8, wouldrepresent for the future the most satisfactory solution for the purpose ofprogramming and evaluating the activities of the Organization,

4. Considering, however, that a decision on the adoption of this version, whichimplies drastic changes in the presentation of the C/5 document, should betaken only after a transitional period and in the light of experience gainedthrough the implementation of the Medium-Term Plan,

5. Further considering that the 20 C/5 document should reflect the objectivesof the Medium-Term Plan with sufficient clarity to make the implementationof the Plan fully significant,

6. Invites the Director-General to prepare document 20 C/5 along the lines setout in Annex II to document 102 EX/8, it being understood that a separateannex would contain a condensed presentation of Part II of the Draft Pro-gramme and Budget for 1979-1980, laid out by objectives, as outlined inAnnex I to document 102 EX/8.

Considering resolution 1.181 by which the General Conference decided, atits nineteenth session, to convene an International Conference of States(Category I) in 1978 for the adoption of a convention on the recognition ofstudies, diplomas and degrees in higher education in the Arab States, andauthorized the Executive Board and the Director-General to take all neces-sary steps to that effect,

Article 1

An International Advisory Committee on Earthquake Risk, hereinafter re-ferred to as the Committee, is hereby established.

Article 2

1. The principal function of the Committee shall be to advise Unesco, theOffice of the United Nations Disaster Relief Co-ordinator (UNDRO) and,whenever appropriate, other agencies, institutions and programmes of theUnited Nations system, and through them the Member States, on how bestto engage the wide range of relevant disciplines and how to achieve the mosteffective combination of scientific and administrative action, in a concertedattack on the problem of earthquake risk and its mitigation.

2. In the first instance, it will be required to advise Unesco and UNDRO on theimplementation of the recommendations and resolutions contained in the re-port of the Intergovernmental Conference on the Assessment and Mitigationof Earthquake Risk, held at Unesco Headquarters in February 1976. It willalso be expected to assist Unesco and UNDRO in the preparation of a long-term programme of interdisciplinary research and international co-operationin this field.

Article 3

The Committee shall be composed of ten members, serving in a personalcapacity. The members shall be appointed by the Director-General actingin consultation with the United Nations Disaster Relief Co-ordinator.

The term of office of members of the Committee shall be four years.Terms of office may be renewable. The Director-General, in appointingthe first members of the Committee, shall designate five members whosefirst term of office shall end two years after their appointment. In theevent of resignation or death of a member of the Committee, the Director-General shall appoint a replacement for the remainder of the term.

The members of the Committee shall be selected for their scientific qualifi-cations, in accordance with the principle of equitable geographical distribu-tion while giving particular consideration to those countries which havedirect experience of this problem, and in such a way as to ensure that theCommittee is able to give sound advice on the human, social and economic,as well as the scientific and technical aspects of the assessment and mitiga-tion of earthquake risk.

In addition to the ten members mentioned above, the Director-General, act-ing in consultation with the United Nations Disaster Relief Co-ordinator,may invite to sessions of the Committee, as non-voting consultants, per-sons who by reason of their functions can assist the Committee in its work.

The Director-General shall designate members of the Unesco Secretariat torepresent him on the Committee without right to vote.

The United Nations Disaster Relief Co-ordinator may designate members ofhis Office to represent him on the Committee, without right to vote.

The Secretariat of the Committee shall be provided by the Secretariat ofUnesco, in collaboration with the Secretariat of UNDRO.

Article 5

The Committee shall meet in ordinary session at least once in each calendaryear.

At each of its sessions, the Committee shall elect a chairman, a vice-chairman and a rapporteur, who shall form the Bureau of the Committeeand who shall remain in office until the following session.

Sessions of the Committee shall be convened by the Director-General ofUnesco, acting in consultation with the United Nations Disaster ReliefCo-ordinator.

Article 6

(a) organizations of the United Nations system with which Unesco hasnot concluded mutual representation agreements;

1. The Committee shall adopt its Rules of Procedure, which shall be submittedto the Director-General for approval.

3. Value and periodicity of the Prize

The Prize will take the form of an honorarium of $5, 000 with an appropriateplaque. The Prize will be awarded every second year coinciding with the year inwhich the General Conference of Unesco is held.

4. Eligibility

The candidate may be a person or a group of persons working privately oras members of a staff of a private or governmental organization.

5. The panel

All candidatures will be considered and recommended by a panel of fourscientists appointed by the Director-General. The panel shall include scientistseminent in academic life and in practice, belonging to various branches of micro-biology as well as different regions of the world. One of the members will be arepresentative of Cuba.

The Committee supersedes the UNISIST Advisory Committee and the Inter-national Advisory Committee on Documentation, Libraries and Archives(IACODLA).

Article 2

The Committee shall advise the Director-General on technical mattersrelating to Unesco’s General Information Programme. It can also be con-sulted by the Director-General on information aspects of other chapters ofthe Organization’s programme.

The Committee shall assess the changing requirements and trends of theworld’s user communities in respect of information for the development ofeducation, science, technology, culture and communication and shall advisethe Director-General thereon as well as assist him at periodic intervals toevaluate the relevance and adequacy of Unesco information programme per-formance in relation to these needs and trends.

2. Recalling the provision in the Appropriation Resolution for 1977-1978(Clause I. A. (b) (i)) to the effect “that the Appropriation Reserve underPart VI of the budget may be used after all possibilities of transfers withinParts I to V of the budget have been exhausted . . . ",

3. Noting further that the General Conference at its nineteenth session inresolution 10.1 “invites the Director-General to endeavour, in carryingout the programme, to make the biggest possible savings in staff costs andin executing the work plans, so as to be able to furnish increased aid to thedeveloping countries and more particularly to those which have been classi-fied as being among the least developed”,

4. Considering the Director-General’s statement that it would be more logicaland clearer that the statutory increases in staff salaries and allowances befinanced by withdrawal from the Appropriation Reserve, thus leaving savingswithin the budget for furnishing increased aid to developing countries and in par-ticular to the least developed countries, in accordance with 19 C/Resolution 10.1,

7 .1 .7 Remuneration of the Director-General and the Deputy Director-General (inprivate meeting)

The Executive Board,

1. Considering that the General Assembly of the United Nations at its thirty-first session revised the salaries and post-adjustments for staff in theProfessional category and above with effect from 1 January 1977,

2. Considering the terms of the contract between the Organization and theDirector-General which authorizes the Executive Board to make suchmodifications in the remuneration of the Director-General as may benecessary from time to time to maintain a constant relationship betweenthis remuneration and that of staff in the Professional and higher categories,

3. Decides that with effect from 1 January 1977:

(a) the gross salary of the Director-General shall be established at$99,350 per annum;

(b) after application of the staff assessment plan, this will result in a netsalary of:

(i) $53,200 per annum (with dependant rate); or

(ii) $48,079 per annum (without dependant rate);

(c) the post-adjustment applicable to the Director-General shall be estab-lished at $2, 200 (with dependant rate) or $1, 988 (without dependant rate)per annum for each class of adjustment;

(d) the allowance of $400 for dependent spouse will no longer be payable.

ANNEX

STATUTES OF THE APPEALS BOARD,AS AMENDED BY THE EXECUTIVE BOARD

Purpose of the Appeals Board

1. The Appeals Board shall advise the Director-General, with whom the finaldecision shall rest, on appeals made by members of the staff.

Membership of the Board

2. The Board shall consist of five members, having equal votes, selected asfollows:

(a) A chairman appointed by the Executive Board. An alternate chairmanmay be appointed in the same manner.

(b) Two members appointed by the Director-General, subject to (d) and(e) (i) below, for each appeal.

(c) Two members representing the staff, appointed in rotation, subject to(d), (e) and (f) below, for each appeal, by the Chairman of the Boardfrom a panel divided into two groups selected every two years by aballot of staff members as follows:

Group I: 15 members from the Principal Officer and Director and theProfessional categories.

Group II: 15 members from the General Service category.

Not more than two of the 15 members in Group I and not more thanthree in Group II shall be of the same nationality.

(d) In appointing members for each appeal the Director-General and theChairman of the Board shall not appoint any member from the appel-lant’s Department, Service or Bureau, and shall observe the principleof equitable geographical distribution.

(e) (i) On an appeal by a staff member in the Principal Officer and Direc-tor category, or in the Professional category, no member shall beappointed from the General Service category.

(ii) On an appeal by a staff member in the General Service category. atleast one of the representatives of the staff shall be appointed fromGroup II of the Panel.

(f) A staff member appealing to the Board may object to not more than twomembers of the staff panel and, in that case, the Chairman shallappoint two other members of the panel.

3. The Director-General shall appoint a Secretary to the Board.

4. The Bureau of Personnel and the Staff Association may each be representedby an observer at all hearings by the Board. An effort shall be made toselect as observers persons to whom the appellant has no personal objection.

Jurisdiction of the Board

5. (a) The Board shall consider appeals against an administrative decision oragainst any disciplinary action where a staff member alleges that it con-flicts either in substance or in form with the terms of his contract, orwith any Staff Regulation or Staff Rule relevant to his case.

(b) In cases in which the decision appealed against is based on grounds ofinefficiency or relative efficiency, the Board shall not have jurisdictionto determine the substantive question of efficiency, but only the questionas to whether the decision was affected by prejudice or other extraneousfactor.

(c) In case of doubt, the Board shall itself decide whether it is competentin accordance with these terms of reference.

6. A staff member, in agreement with the Director-General, may waive hisright of recourse to the Board and appeal directly to the AdministrativeTribunal and in such case the decision impugned shall be considered asfinal and the staff member shall be deemed to have exhausted all othermeans of resisting it.

Preliminary procedure

7. (a) A staff member who wishes to contest any administrative decision ordisciplinary action shall first protest against it in writing. The protestshall be addressed to the Director-General through the Director of theBureau of Personnel, within 25 days of the date on which the decisionor action was communicated to the staff member if he is stationed atHeadquarters, and within 45 days if he is stationed away from Head-quarters or if he has been separated from the Organization.

(b) The Director-General’s ruling on the protest under (a) above shall becommunicated to the staff member by the Director of the Bureau of Per-sonnel within 25 days of the date of the protest if the staff member isstationed at Headquarters, and within 45 days if he is stationed awayfrom Headquarters, or if he has been separated.

(c) If the staff member wishes to pursue his contestation, he shall addressa notice of appeal in writing to the Secretary of the Appeals Board. Thetime limit for the submission of a notice of appeal, to be counted fromthe date of communication of the Director-General’s ruling (or, if noruling was communicated to the staff member within the time limit under(b) above, from the expiry of that time limit), is 25 days in the case ofa staff member stationed at Headquarters and 45 days in the case of astaff member stationed away from Headquarters or who has beenseparated.

(d) The notice of appeal under (c) above shall state the date and nature ofthe decision or action against which the appeal is directed, the date ofthe protest under (a) above and the date of the Director-General’s rul-ing under (b) above, or the fact that no ruling was communicated tothe appellant within the appropriate time limit.

8. The time limits laid down in paragraph 7 may be extended by the Director-General in exceptional circumstances.

Procedure before the Appeals Board

9. A staff member may have his appeal presented to the Board on his behalf byany other member of the Secretariat, stationed at Headquarters.

Within 25 days of the notice of appeal, the appellant or his representativeshall file a detailed appeal in accordance with the model set forth in theAppendix to these Statutes. If the detailed appeal is irregular in any res-pect, the Secretary of the Board shall return it for rectification, and maygrant up to 25 additional days for resubmission.

Upon receipt of the detailed appeal, the Secretary of the Board shall imme-diately forward copies to the Chairman of the Board and to the Director ofthe Bureau of Personnel. Further copies shall be forwarded to the membersof the Board, as soon as they are appointed in accordance with paragraph 13.

Within 25 days of the receipt of the detailed appeal, the Director of theBureau of Personnel shall submit to the Secretary of the Board his detailedreply with supporting documents in eight copies. The Secretary of theBoard shall immediately forward copies to the Chairman, to Board memberswhen appointed and to the appellant.

Upon receipt of the reply under paragraph 12 (or, failing such a reply, uponexpiry of the time limit for its submission), the Chairman and the Director-General shall appoint members of the Board, in accordance with paragraph 2,to hear the appeal. The Secretary of the Board shall inform the personsappointed and shall inform the appellant of their names. Members soappointed who are unable to serve shall notify the Secretary of-the Boardimmediately. They shall return to the Secretary any documents relating tothe case.

The Secretary of the Board shall convene the Board to hear the appeal assoon as possible and not later than two months after receiving the replyunder paragraph 12 (or, failing such a reply, after the expiry of the timelimit for its submission).

The hearing shall be in camera. It shall commence with a brief oral state-ment of the case by the appellant or his representative, followed by an oralreply by the Director of the Bureau of Personnel or other representative ofthe Director-General. The parties may give evidence and call witnesses.The parties, and in the discretion of the Chairman, any member of the Boardmay question all those who give evidence. The two parties and any memberof the Board may request the production of any relevant documents. Evi-dence shall be voluntary.

On the completion of the hearing, the Board shall consider the case inprivate.

At the end of these deliberations, the Board shall by a majority vote adopt areport summarizing the case and advising the Director-General on whataction, if any, he should take. Dissenting votes, and dissenting opinions (ifthe dissenting member desires) shall be stated in the report. The recom-mendations shall be made in relation to the Staff Regulations and the StaffRules.

The Chairman of the Appeals Board may, in agreement with the Director-General, extend the time limits provided for in paragraphs 9 to 14 above.

The Secretary shall forward the report as soon as possible to the Director-General and a copy to the appellant.

The Director-General shall make a decision thereon as soon as possibleand shall notify the Chairman of the Board and the appellant.

Records and reports

21. (a) All proceedings of the Board shall be confidential. Records of the Boardshall be confidential and shall be kept by the Secretary of the Board.

(b) The report of the Board shall be confidential unless otherwise decidedby the Director-General. An appellant may disclose the report to theAdministrative Tribunal. Reports of the Board and decisions of the

Director-General thereon shall be communicated for information to themembers of the Executive Board.

(c) Intending appellants who have protested under paragraph 7, members ofthe Board appointed for any particular case, and the President of theStaff Association may examine all previous reports of the Board, anddecisions made thereon by the Director-General.

Appeals by staff members serving away from Headquarters

22. In the case of an appeal by a staff member serving away from Headquarters,if the Director-General, after consultation with the Chairman, decides thatthe presence of the appellant is necessary, he may arrange for the journey tobe made at the Organization’s expense, either by combining it with officialtravel or otherwise. If the Director-General does not consider the appel-lant’s presence necessary, the appellant has the right nevertheless to attendthe hearing provided that he travels at his own expense and at a timeapproved by the Director-General.

Amendment of these statutes

23. Paragraphs 2, 5 and 6 may be amended only by the General Conference.The remainder of the statutes and the Appendix may be amended only by theGeneral Conference or the Executive Board.

The Executive Board,

1. Considering the provisions of paragraph 4 of resolution 31.1 adopted by theGeneral Conference at its nineteenth session, designed to authorize the addi-tional appropriations needed to complete the work of constructing the sixthbuilding,

2. Having taken cognizance of the recommendations made by the HeadquartersCommittee at its 74th session,

Item 7. 1. 7 - Remuneration of the Director-General and the DeputyDirector-General

The Board unanimously adopted a decision concerning the remuneration ofthe Director-General, which will be found under 7. 1. 7 above.

It noted the measures the Director-General intended to apply with effectfrom 1 January 1977 with respect to the remuneration of the DeputyDirector-General.

Item 7.1.8 - Consultations pursuant to Rule 54 of the Rules of Procedureof the Executive Board

Under this item, the Director-General consulted members of the Board oncertain staff matters. In this context, the Board resumed consideration of apersonnel problem which had been brought to its attention by the Director-General during its 100th session. The Board expressed great concern that theproblem remained and that it had not been possible to solve it in a satisfactorymanner. It continued to express firm approval of and support for the actiontaken by the Director-General in this matter according to the guidance given tohim by the Board. It further authorized its Chairman to take additional stepswith a view to arriving at a solution satisfactory to the Organization.

4. At the last private meeting one member raised a problem concerning one ofthe language editions of the Unesco Courier. One other member also spoke.The Director-General replied to the question raised.
