PROGRAMMATIC DOMAIN SBSA SUSPENSION• A letter was issued October 27, 2015 informing the

Programmatic BPA Holders that small business set-asides are being temporarily suspended in the Programmatic Domain.

• The rationale for this suspension is that since the protest resulted in the termination of the new BPAs, only two small businesses were left in the eligible pool of contractors. While it is true that the “rule of two” applies for making a set-aside determination, FAR 8.4 requires that the ordering activity provide the RFQ to at least three schedule contractors. Therefore, until new small businesses BPAs are added to the Programmatic Domain small business set-asides are suspended.
