Filling vacancy left by Nancy Lindoerfer (retired)]

Mrs. Lorraine Kelley was present for the appointment. She stated this positionwas created in 1972 by the Connecticut State Legislature and that the MunicipalAgent position is responsible for informing the elderly of programs and servicesand to help them obtain these things.

Mr. O'Brien moved the Town Council approve theappointment by the Mayor of Lorraine Kelley (D) asMunicipal Agent for the Elderly for the term March 28,2011 through May 6, 2012, The motion was seconded byMs. Buck - Taylor and carried unanimously.

Economic Development CommissionNancy I. Saggese (U) 03/28/2011 - 11/30/2015

Filling vacancy left by Maureen Laurer (U)J

Ms. Nancy Saggese was present for the appointment. It was noted that she usedto sit on the subcommittee for education for the Economic DevelopmentCommission and runs a business in town.

Mr. Esposito felt that Ms. Saggese would be a great addition to the Commissionand welcomed her.

Mr. O'Brien moved the Town Council approve theappointment by the Mayor of Nancy I Saggese (U) to theEconomic Development Commission for the term March28, 2011 through November 30, 2015. The motion was

seconded by Mr. Esposito and carried unanimously.

Re- Amointment Correction —Ethics Commission

Norman D. Koch (D) 12/01/2009 - 11/30/

Mr. O'Brien moved the Town Council approve the re-appointment by the Mayor ofNorman D. Koch (D) to theEthics Commission for the term March 28, 2011 throughNovember 30, 2014. The motion was seconded by Mr.Esposito and carried unanimously.

5. FINANCE

Update from the Director of Finance

Director Raymond Jankowski was present for the discussion. He stated that taxcollections are strong and slightly ahead of last year. He expects a lack ininvestment yield. He has budgeted for $300,000 and as of March 21" the townhas earned $45,200. He hopes to make $100,000.

Efforts continue to find a remedy for the personal property tax pro rate for thisyear and future years. The State is thinking about eliminating the program butimplementing higher sales tax, additional conveyance taxes, occupancy tax, aswell as additional boat and truck taxes.

He went to the State Treasurer's meeting last week and met the new OPMSecretary. He got no indication as to which way the State is leaning. A lot isdependent upon negotiations with the State employee unions.

He hopes to have more solid numbers before the town budget goes to referendum.

When asked by Dr. Mullen, Mr. Jankowski gave an overview of the personalproperty tax program implemented by the State. This program from the State (aformula grant) started out 6 -7 years ago as 100 cents on the dollar reimbursementon new manufacturing machinery that is purchased by industry in our town. Thegrants have been adjusted since then by the State (going both up and down) andare now being prorated. The State is considering eliminating this program andthus eliminating the town's ability to tax this property. Next year it is proposed at80 cents on the dollar and prorated if it is still around.

Dr. Mullen then asked how much was in the Contingency account at this time.Mr. Jankowski stated there is $155,177.39.

Mr. O'Brien wondered why the State did not just leave the town revenue streamsalone because the proposed new revenues options would reduce town fundingresources. Several examples were discussed. Mayor Murphy stated that aftertalking with the new OPM Secretary, she was told that this is what the State isproposing to do.

Mr. Bass asked if there were any Town fee accounts that Mr. Jankowski thoughtmight be lowering. Mr. Jankowski stated there were not and he is confident withthe numbers as they now stand. He stated land use fees have been decreasingover the years as well as building fees taken in, but he has seen a little upswingand hopes the fees continue to rise.

Mr. Bass asked if the Contingency funds were unencumbered. He was told theyare and Mr. Jankowski does not foresee any use of these funds at this time. Healso noted that there are some stresses on benefits such as heart and hypertension,unemployment, and deductibles in insurance lines. That might influence theContingency fund at the end of the year.

Mr. Bass asked if money used by the town for the flood such as overtime, etc.would be taken from Contingency. Mr. Jankowski stated it would not be taken

from Contingency and at this time required an emergency appropriation of up toone eight of a mil or $300,000. He does not feel the town will come close to that.Some of that also comes out of the departments' overtime as it now exists.

Mayor Murphy stated that the costs were also submitted to FEMA; however,although Litchfield County has met its cost threshold, the State had not to date.The State then extended the deadline to March 31" and encouraged allmunicipalities to submit their damages whether they have insurance or not.

Mr. Jankowski stated those monies, if needed, would come from UndesignatedSurplus.

Dr. Mullen asked for clarification on several items that were just discussed. Mr.Jankowski explained that regarding State programs such as the personal propertytax program, the State will put a defined amount in to the line and will not putmore in. If there are many requests, the disbursements will be prorated.

Mr. Bass asked if there were more unfunded mandates proposed at the Statemeeting Mr. Jankowski attended.

Mr. Jankowski there was no talk about that, but noted it is hard to figure thenumbers because of the new government and legislation.

Mr. Bass then asked if the town would be additionally exposed with the newhealthcare plans that are being implemented. Mr. Jankowski stated the town

would be affected. It would be phased in by 2014 and as of July 1St the town mustcover dependents up to 26 years of age.

6. SOCIAL SERVICES

Discussion and possible action on request to accept a $5000.00 grant fromMVP -SOS to the Good Samaritan Fund. The grant will be used to pay forchildren's participation in the Family First program.

Mr. Bass moved the Town Council approve the request toaccept a $5,000.00 grant from MVP -SOS to the GoodSamaritan Fund. The grant will be used to pay forchildren'sparticipation in the Family Firstprogram. The

Mr. O'Brien asked that a thank you letter be sent on behalf of the Town and theTown Council.

7. YOUTH AGENCY

Discussion and possible action on request to accept a Grant donation fromHVCASA (Housatonic Valley Coalition against Substance Abuse) in theamount of $6,045.00. These funds are to be utilized to provide substanceabuse programming in concert with the New Milford Police Dept, NewMilford Hospital and the New Milford Middle School and High School.These funds will be placed in Account 5100- 503 -5761 and require a furtherappropriation in the amount of $6,045.00to Account 6066 - 270 - 0009.

8. MAYOR'SOFFICE

Discussion and possible action on the proposed Paramedic Programagreement.

Mayor Murphy stated that this program is with Campion, and services NewMilford and its surrounding towns. New Milford benefits from having theParamedic housed in town at the hospital. New Milford utilizes the paramedicmost of the time.

Mr. Szendy moved the Town Council authorize the Mayorto sign the proposed Paramedic Program agreement withCampion Ambulance Service, Inc. The motion was

seconded by Mr. O'Brien.

Mr. O'Brien asked what the hospital was doing with this agreement. MayorMurphy stated the hospital is out because it is no longer allowed to subsidize sucha program.

Donna Hespe stated that the hospital indicated that they did not want to donate the25,000 because they would be bidding on the contract. Mayor Murphy statedthey are also prohibited by law. New Milford's share of the increase would beabout $15;000.

Mr. Guendelsberger asked if the town uses Campion at this time. He was toldthat the town uses Campion now, but is in the third year of a two year contract.The contract itself is good for two years with two one year options ofcontinuation. The town is currently in an option year.

Mr. Guendelsberger asked if there was any place in the contract where the town isindemnified in case the Campion employees are negligent. Attorney DiBellastated there will be something in the contract. Mr. Guendelsberger then stated hewould like to see the contract before it is signed. Dr. Mullen and Mr. Espositoagreed.

Mrs. Hespe stated the town has until June 3&. Brief discussion ensued as to

when the Town Council must act for the contract to be executed for July 1St.

It was noted that all of the other towns have approved this proposal with theexception of New Milford. Mayor Murphy stated that New Milford requested itbe re -bid and brought to the Town Council. She noted this bid is lower than theother bid the town received.

This bid is higher than last year but lower than the other bid of $240,000. With abundle billing package it was $306,000. The bundle included getting a flat ratefor every run our local ambulance got and pay the City of Danbury for the use oftheir ambulance vehicle over and above the fee that the ambulance company got.

Mr. Szendy withdrew his motion to authorize the Mayor to sign the contract. Mr.O'Brien withdrew his second.

Mayor Murphy stated she would get a full copy of the contract to the TownCouncil members.

Mr. Bayer moved to adjourn at

8:05 p.m. The motion was seconded by Ms. Buck - Taylorand carried unanimously.
