How does this relate to the legal profession?

In February this year Martyn Stead of Quinn Wilson Associates was presenting social media to a group of business people, one of whom was a solicitor specialising in employment law. She was a LinkedIn user, but could not see the benefi t of Twitter to her fi rm. This was the week in which Pfi zer had announced the potential closure of their research and development plant in Kent.

A quick search on Twitter for the words “Pfi zer” and “redundant” immediately showed an enterprising solicitor who had arranged a seminar for the workers whose jobs were under threat.

OK, that solicitor was unlikely to take the business of all the threatened workers, but by the enterprising use of social media he had certainly stolen a march on other solicitors.

Some UK insurers have introduced “mould exclusion” clauses in an effort to reduce claim exposure from material damage and health claims which are expected to explode in the UK as many diseases including asthma are now linked to mould. The reality is that most of these exclusions cannot stand scrutiny and even where successful, subrogation issues often exist which invariably lead back to the same insurer.

Currently Building Forensics have initiated a £12 million new build defect claim and supported a tenant in a £300,000 contents claim which has been agreed. Put simply, when correct and recognised investigation protocol provides evidence of mould or contamination or material defect, there can be no defence as the evidence is basically irrefutable and can be repeated.

The importance of accurate evidence was recognised in the US courts where mold claims outstrip asbestos and lawyers there sought irrefutable often new detection and gathering techniques. Building Forensics have trained and worked for more than 10 years with American colleagues in the development of these protocols and techniques and now offer the UK legal profession with the

same high quality and accurate investigation techniques required for successful litigation in building defect and mould or contamination claims.

Mould is now internationally recognised as a major health hazard which affects occupants of water damaged and mould contaminated buildings and their contents, refl ecting liability of builders, landlords and even fl ood restoration companies and their insurers.

Mould has been recognised as a health hazard since written in Leviticus 14 of the Old Testament but today the situation is worse due to the quest for tighter energy effi cient buildings relying on paper and tape, (plasterboard and sealants). Today mould contamination and its health effects can be measured and consequence assessed against historic medical records and proven causation in the form of contamination and or building defect identifi ed.

In 2009 the World Health Organisation published its document Dampness and Mould and indoor air quality, this document written by the worlds most respected scientists, provides all the necessary information on mould health hazards and identifi cation and most importantly, the techniques for collection of evidence.

Science has moved on from culture plates for identifying mould presence and litigation in the USA resulting in multi million dollar settlements, has provided the current irrefutable investigation and analysis techniques to support the legal profession. These techniques identify hidden mould and even dead mould which can be as hazardous as live mould.

Water is the single most important factor in mould growth in buildings and this can be the result of construction design or building defect which opens a door for potential litigation for a vast majority of new build or refurbishments. Flood and water damage insurance claims invariably use insurer nominated contractors who have no recognised certifi cation and almost never provide meaningful drying or decontamination certifi cation at the end of a restoration.
