    Marketplace sent a first request for information to the person in charge of access to documents inthe Ministère de l'Éducation et de l'Enseignement supérieur on January 22nd. A response fromthe ministry stated that “The Ministry doesn’t possess documents about the disciplinary decisions,

    because they are handled by the difference school boards.”

     A second request, asking for decisions by the minister or the department to take action on thecertificates of teachers in the province, including the reason the action was taken was not returnedin time for publication.

    Hi Melissa,

     Apologies again for the delay in getting this to you. As discussed, here are the answers to your

    questions and the outline of the certificate revocation process:

    To your question related to the publication of decisions:

    The Department is currently reviewing its practices in communicating revocations, keeping in

    mind the balance between personal information and the public's right to know.

     As for your emailed questions:

    1. For the five arbitrations you sent us a few weeks ago:

    - How many of these ended with certificates being revoked? One is being considered for

    revocation.

    - Were all five of the complaints that started these arbitrations founded in the end?

    ∙ Of the five adjudications, three stemmed from founded complaints under Policy 701.

    ∙ Of these three, one teacher was suspended and two teachers were terminated. Of these

    two terminations, one was upheld by the adjudicator hearing the case, and this case is being

    considered for revocation, and the other was reinstated into his former position, however, a

    suspension was imposed.

    ∙ Therefore, of these 5 adjudications, the only teacher certificate being considered for

    revocation is the one where the termination was upheld. The process is ongoing.

    ∙ The other two adjudication hearings did not originate from complaints but rather frominsubordination and a personnel matter. One teacher was suspended, the other was dismissed

    and subsequently reinstated into a different position following the adjudication hearing.

    In addition, since January 2005, nine (9) teacher’s certificates have been revoked as per

    the Ministerial process. As these dismissals were not grieved, there was no adjudication

    hearing held for these cases.

    Hi Melissa,

    Sue sent me your request. School boards are the main employer and are responsible for teacher

    performance and regular discipline. The department only takes action related to teaching certificates (ex.

    suspensions, cancellations of certificates) in regards to serious incidents.

    Over the last 10 years (2005-2015 inclusive) the Minister has taken action on 46 teacher’s certificates. Thefollowing reasons for action being taken are (also attached in spreadsheet format):

    • 15 cases related to the following types of misconduct: Sexual Assault, Sexual Impropriety, Sexual

    Exploitation, Sexual Relationships with a Student and Sexual Misconduct.

    • 12 cases related to the following types of misconduct: Inappropriate Relationships, Inappropriate

    Communications, Child Luring.

    • 5 cases related to Child Pornography or Possession of Pornography.

    • The remaining 14 cases have involved a diverse range of misconduct not related to those

    mentioned above. The Department is unable to provide additional information without potentially identifying

    an individual, prohibited in the FOIPOP legislation.
