ORDER:

Whereas, the State of Andhra Pradesh was reorganized into State of Telangana

and residuary State of Andhra Pradesh in terms of AP Reorganization Act, 2014. The

Power Utility Companies have also undergone a change by constitution and

incorporation of separate Power Utilities in the State of Telangana.

2. Whereas, the allocation of the employees between the TS and AP Power Utility

Companies are to be made in terms of Section-82 of the AP Reorganization Act, 2014.

3. Whereas, the Hon’ble Supreme Court in C.A.No.11435 of 2018 and batch by

orders dtd.28-11-2018 appointed Sri. D.M. Dharmadhikari, Judge (Retired) Supreme

Court of India as One Man Committee to determine the modalities for distributing

personnel between TS and AP Power Utilities.

4. Whereas, the Hon’ble One Man Committee submitted the “Final Report”

dtd.26-12-2019, “Supplementary Report” dtd.11-03-2020, “Clarification Orders”

dtd.13-03-2020 and “Concluding Report” dtd.20-06-2020 allocating the employees

between TS and AP Power Utilities.

5. Whereas, the Hon’ble Supreme Court by its Judgment dtd.07-12-2020 in

MA.No.1286/2020 and batch in CA.No.11435 of 2018 and batch held that the decision

of the Hon’ble One Man Committee in the “Concluding Report” dtd.20-06-2020 that

655 employees are going from Telangana to Andhra Pradesh, same number should go

from Andhra Pradesh to Telangana. In the “Concluding Report” dtd.20-06-2020, final

list has been annexed which is utility-wise, and personnel-wise which is clear and

unambiguous. Accordingly, the Hon'ble Supreme Court disposed of the

M.A.Nos.1286, 1290, 1292 and 1291 of 2020 in CA.No.11435 of 2018 and batch filed

by the TS Power Utilities.

6. Whereas, the “Final List” Annexed to the “Concluding Report” contains the list

of “Out-going” 173 employees of various cadres from TSTRANSCO to APTRANSCO

and “In-coming” 173 employees of various cadres from APTRANSCO to

TSTRANSCO.

7. Whereas, the Direction No.I of the “Concluding Report” specifies that “the

employees who have attained or will be attaining the age of 58 years in the year 2020

will be kept out of the allocation process and their names in the Allocation Lists will be

removed”.

8. Whereas, the Member, Sub-Committee, AP, vide letter dtd.26-06-2020 identified

39 employees out of 173 employees, allocable from TSTRANSCO to APTRANSCO,

who have attained or will be attaining the age of 58 years in the year 2020.

9. Whereas, in process of implementation of the “Concluding Report”, the ratio of

1:1 as specified in Para No.23 of the “Concluding Report” and as affirmed by the

Hon'ble Supreme Court has to be adhered to. Accordingly, equal number of employees

should be allocated Utility-wise, Personnel-wise. Since 39 employees of “Out-going”

list from TSTRANSCO to APTRANSCO are to be excluded as per the Hon’ble One

Man Committee; similarly, 39 employees allotted to TSTRANSCO from

APTRANSCO are also to be excluded.

10. Whereas, on careful consideration of the orders of the Hon'ble Supreme Court,

the “Concluding Report” dtd.20-06-2020 of the Hon’ble One Man Committee, and the

letter of the Member, Sub-Committee, AP Power Utilities, dtd.26-06-2020, the total

allocable employees from TSTRANSCO to APTRANSCO are 134 [173 – 39]. Thus,

134 employees are allocable to TSTRANSCO in terms of the Direction No.I of the

“Concluding Report” dtd.20-06-2020.

11. Whereas, out of 134 “In-coming” employees from APTRANSCO to

TSTRANSCO, in implementation of the “Supplementary Report” dtd.11-03-2020, 30

employees, who form part of the list of 71 employees allotted vide “Supplementary

Report” have already reported to and working in TSTRANSCO.

12. Whereas, the remaining 104 employees [173 – 30 – 39 = 104] enclosed to this

“Office Order” are identified from out of the “Final List” enclosed to the “Concluding

Report” as shown in Annexure-I, herein are hereby informed to report to the Chief

General Manager (HRD) and Joint Secretary, TSTRANSCO, Vidyuth Soudha,

Hyderabad, respectively, along-with (i) Salary Certificate with designation as on

01-06-2014; (ii) Relieving order from the competent authority; and (iii) Last drawn pay

certificate.

13. Whereas, the list of 39 employees who retired/retiring and dependents/legal

heirs of the employees expired as shown in the Annexure-II, herein are also hereby

informed to report to the Chief General Manager (HRD) and Joint Secretary,

TSTRANSCO, Vidyuth Soudha, Hyderabad, respectively along with Pension Payment

Orders , if any.

14. Whereas, the employees referred to in Annexure-I are governed by the following

conditions:-

1) The employees who are figuring in Annexure-I to this Office Order shall be

eligible for drawing their Salary only with effect from December, 2020.

2) All the employees in Annexure-I shall be governed by the APSEB Service

Regulations, as adopted by the TSTRANSCO.

3) The fixation of inter-se-seniority of the above incumbents shall be in the cadre

as on 02-06-2014 and review of promotions and the conditions governing

their service, if any, shall be issued separately.

4) The employees/pensioners/family pensioners referred to in Annexure – I &

II, shall be eligible for drawing their Salary/Pension/Family Pension only

with effect from December, 2020, since the TSTRANSCO have paid

salary/pension/family pension to all 143 employees, whose names are

indicated in the letter dtd.12-03-2020 of Member, Sub-Committee, AP, and

relieved on 14-03-2020 up to 30-11-2020 in terms of the orders dated:

08-04-2020 in M.A. No. 915 of 2020 read with orders dated 01-05-2020 in

M.A. No. 920 of 2020 in Civil Appeal No. 11435 of 2018 and batch.
