Proclamation Congratulating Bright Hope Baptist Church on its 100th Anniversary

WHEREAS, Bright Hope Baptist Church was founded in 1921 when the world was still recovering from the first great world war and entering the decade of the roaring twenties where the constraints of restrictive living were being relaxed. In the years that followed, particularly during the Great Depression and the turbulent sixties, Bright Hope served as a reminder to all people of faith who are supported by God that they are not to live as people with no hope, but rather are imbued with a new kind of hope, a bright hope; and

WHEREAS, the congregation of Bright Hope Baptist Church occupied several locations in Montclair until moving to its current location at 6 Mission Street where it has faithfully served the community for many decades. Among the many accomplishments of this church is the purchase of the two-family home at 8 Mission Street and the purchase of the property located at 140-144 Bloomfield Avenue where the Bright Hope Youth Center operated for many years. Bright Hope Baptist Church is a proud life member of the NAACP and is committed to standing up to injustice, condemning systemic racism, and answering the call for equality; and

WHEREAS, Bright Hope has a rich history of pastors, most notably Reverend William Wheeler (1961-1977), who guided the church through the tumultuous times of the ‘60s when the church was at the center of the Civil Rights Movement in Montclair along with Union Baptist, St. Paul’s Baptist and St. Mark’s African-American Methodist. Reverend William E. Woods (1978-2003) succeeded Wheeler, and guided the Church’s growth in the community, specifically the Youth Center. Reverand DeJon V. Morris was called to be the pastor of Bright Hope in 2016 and currently serves as the senior pastor; and

WHEREAS, Bright Hope Baptist Church is currently observing the 100th anniversary of its founding. Our entire community has benefited from the influence this church has exerted through the years and we celebrate the historical contributions of Bright Hope Baptist Church whose courage and moral leadership has led to increased social justice and a greater appreciation of diversity in our county, state, and nation.

NOW THEREFORE, the Mayor and Council of the Township of Montclair hereby extend our best wishes to Bright Hope Baptist Church congregation on this special occasion, offering our congratulations and appreciation for 100 years of faithful service and outreach to the Montclair community. Proclamation Americans with Disabilities Act Awareness Day

WHEREAS, the Americans with Disabilities Act (ADA) was passed on July 26, 1990, to ensure the civil rights of citizens with disabilities; and

WHEREAS, the Township Council of Montclair, New Jersey affirms the principals of equality and inclusion for

persons with disabilities as set forth for the State of New Jersey and as embodied in the ADA; and WHEREAS, numerous organizations in Montclair Township work with constituents and communities to bring

forth the promise of hope and freedom that is envisioned by the passage of the ADA; and WHEREAS, July 26, 2021, celebrates the 31st Anniversary of the Americans with Disabilities Act. FULLY FUNDED CAPITAL ORDINANCE PROVIDING FOR ACQUISITION OF VEHICLE AND REFURBISHING OF SEWER SLIP LINING TO REMOVE INFILTRATION July 20,2021 BE IT ORDAINED by the Township Council of the Township of Montclair, in the County

of Essex, New Jersey (not less than two-thirds of all members thereof affirmatively concurring) as

follows:

Section 1. The several improvements described in Section 2 of this capital ordinance

are hereby respectively authorized to be undertaken by the Township of Montclair, in the County

of Essex, New Jersey (the "Township") as Sewer Utility improvements.

Section 2. The several improvements hereby authorized and their respective purposes

and the estimated cost of each improvement and the appropriation therefor, are as follows:

(a) Refurbishing of sewer slip lining to remove infiltration within the sanitary sewer system

$2,000,000

(b) Vehicles - Pickup trucks $35,000 TOTAL $2,035,000.00

Section 3. The aggregate sum of $2,035,000 is hereby appropriated from Sewer Utility Capital

Improvement Fund of the Township to the payment of the costs of the improvements and

acquisitions authorized and described in Section 2 hereof.

Section 4. Said improvements and acquisitions are lawful capital improvements of the Township

Sewer Utility having a period of usefulness of at least five (5) years.

Section 5. The capital budget of the Township conforms with the provisions of this capital

ordinance.

Section 6. This Capital Ordinance shall take effect immediately after publication following the

final adoption as provided by law.

The aggregate sum of $2,500,000 is hereby appropriated from the Water Utility Capital Improvement Fund ($1,800,000) and the Water Utility Capital Surplus ($700,000) of the Township to the payment of the costs of the improvements and acquisitions authorized and described in Section 2 hereof.

Section 4. Said improvements and acquisitions are lawful capital improvements of the Township

Water Utility having a period of usefulness of at least five (5) years.

Section 5. The capital budget of the Township conforms with the provisions of this capital

ordinance. To the extent that the purposes authorized herein are inconsistent with the adopted capital or

temporary capital budget, a revised capital or temporary capital budget has been filed with the Division of

Local Government Services.

Section 6. This Capital Ordinance shall take effect immediately after publication following the

final adoption as provided by law.

RESOLUTION AUTHORIZING ELECTRONIC TAX LIEN SALE July 20, 2021

WHEREAS, N.J.S.A. 54:5-19.1 authorizes electronic tax sales pursuant to rules and regulations promulgated by the Director of Division of Government Services, Department of Community Affairs of the State of New Jersey and

WHEREAS, the Division of Local Government Services has promulgated rules and

regulations for electronic tax sales, and WHEREAS, an electronic tax sale is innovative and provides a greater pool of potential

lien buyers, thus creating the environment for a more complete tax sale process, and WHEREAS, N.J.A.C. 5:33-1.1(b) provides that an electronic municipal tax lien sale be

authorized by a resolution of the governing body.

NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Township of Montclair, in the County of Essex, that the Tax Collector is hereby authorized to conduct an electronic municipal tax lien sale; and BE IT FURTHER RESOLVED the Township Manager be and is hereby authorized to execute an agreement with a qualified vendor for conducting the electronic municipal tax lien sale, subject to the requirements of the Local Public Contract Law and the regulations set forth in N.J.A.C. 5:33-1.1.

WHEREAS, pursuant to N.J.S.A. 40A:11-12A and N.J.A.C. 5:34-7.29(c), the Township may, by resolution and without advertising for bids, purchase goods or services under the Educational Services Commission of New Jersey (ESCNJ) Co-Op Pricing System purchasing program for contracts entered into on behalf of the Township; and WHEREAS, Educational Services Commission of New Jersey (ESCNJ) Co-Op Pricing System purchasing program has awarded a contract to Storr Tractor Company, 3191 Route 22, Branchburg, New Jersey 08876, Contract Number #18/19-25; and WHEREAS, the Township of Montclair Department of Community Services desires to purchase one (1) new Toro Groundsmaster 3310-D Mower for a total price not to exceed $45,186.37; and WHEREAS, the procurement of goods and services through a cooperative purchasing program is an open and fair process under the New Jersey Pay-To-Play Law N.J.S.A. 19:44A-20.4 et seq.; now therefore BE IT RESOLVED, by the Council of the Township of Montclair, in the County of Essex, that the Township Manager accept the bid prices provided by Storr Tractor Company, 3191 Route 22, Branchburg, New Jersey 08876 through the Educational Services Commission of New Jersey (ESCNJ) Co-Op Pricing System purchasing program (Contract #18/19-25) for the purchase of one (1) new Toro Groundsmaster 3310-D Mower for a total price not to exceed $45,186.37; and BE IT FURTHER RESOLVED, the Chief Financial Officer has certified that funds for this purchase have been appropriated in the 2018 and 2019 Capital Budgets, Account Numbers 04-215-18-019-002 and 04-215-19-011-005 respectively.

RESOLUTION AUTHORIZING GRANT APPLICATION SUBMISSION AND EXECUTION OF A GRANT CONTRACT WITH THE NEW JERSEY DEPARTMENT OF TRANSPORTATION FOR THE HIGHLAND AVENUE IMPROVEMENTS PROJECT July 20, 2021 WHEREAS, the Township of Montclair intends to submit an application for a New Jersey Department of Transportation Municipal Aid Grant for the Highland Avenue Improvements project within the Township of Montclair. NOW, THEREFORE, BE IT RESOLVED that the Council of the Township of Montclair formally approves the grant application for the above stated project. BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit an electronic grant application identified as MA-2022-Highland Avenue Improvements-00072 to the New Jersey Department of Transportation on behalf of the Township of Montclair. BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the grant agreement on behalf of the Township of Montclair and that their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement.

TOWNSHIP OF MONTCLAIR RESOLUTION RENEWING CONTRACT FOR ARBORIST CONSULTING SERVICES

July 20, 2021

WHEREAS, on April 23, 2019, the Township of Montclair authorized execution of an agreement with Rich View Consulting to provide Arborist Consulting Services required by the Township, for one year, with options to renew for two (2) additional, one (1) year extensions as prescribed by law; and

WHEREAS, the Township of Montclair desires to renew the contract with Rich View Consulting for one additional - one (1) year term as prescribed by law; now therefore

BE IT RESOLVED, by the Council of the Township of Montclair, in the County of Essex, that the Township enter into an agreement to renew the contract with Rich View Consulting to provide Arborist Consulting Services for the period June 1, 2021 through May 31, 2022 in an amount not to exceed $82,368.00 pending Certification of Funds by the Chief Financial Officer; and BE IT FURTHER RESOLVED, that the funds for this purchase have been appropriated in the 2021 Operating Budget, Account Number 01-201-26-312-029 and will be appropriated in the 2022 Operating Budget.

RESOLUTION AUTHORIZING THE RENEWAL OF A PROFESSIONAL SERVICE AGREEMENT WITH SUBURBAN CONSULTING ENGINEERS, INC. FOR ENGINEERING SERVICES RELATED TO THE TOWNSHIP’S WATER DISTRIBUTION AND TREATMENT SYSTEMS AND SANITARY SEWER SYSTEM FOR A PERIOD OF ONE ADDITIONAL YEAR July 20, 2021 WHEREAS, on June 23, 2020, the Township Council adopted Resolution R-20-104 authorizing the execution of a professional services agreement with Suburban Consulting Engineers, Inc. for engineering services related to the Township’s water distribution and treatment systems and sanitary sewer system; and WHEREAS, the agreement was awarded for a period of one (1) year with an option for the Township to renew the agreements for an additional period not to exceed a twelve-month period (one year) starting from the date of award by resolution; and WHEREAS, Suburban Consulting Engineers, Inc. has agreed, for the period of one additional year, to the terms and conditions of the original agreement in a letter dated June 29, 2021; and WHEREAS, the Township of Montclair wishes to exercise its right to renew the aforementioned agreement for an additional one-year period of July 20, 2021 through July 20, 2022 upon the same terms and conditions to SUBURBAN CONSULTING ENGINEERS, INC.; now therefore BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that the aforementioned agreement renewal is hereby approved, and the Mayor and Township Clerk be and they are hereby authorized to execute and attest an agreement for an additional one year for the period of July 20, 2021 through July 20, 2022 for professional engineering services to Suburban Consulting Engineers, Inc., as stated above and in a form approved by the Township Attorney; and BE IT FURTHER RESOLVED that this agreement renewal shall be in an amount not to exceed $100,000.00, pending adoption of the 2021 capital ordinances; and BE IT FURTHER RESOLVED that, pursuant to N.J.A.C. 5:30-5.5(b), prior to placing any order for goods or services in accordance with this Resolution, a certification of available funds shall be executed by the Chief Financial Officer and attached to the file copy of the purchase order or other similar document BE IT FURTHER RESOLVED that notice shall be published in the Montclair Times stating the nature, duration, service and amount of the attached agreements and that copies of this Resolution and the Agreement are on file and available for inspection in the Office of the Township Clerk.

RESOLUTION AUTHORIZING EXECUTION OF A PROFESSIONAL SERVICES AGREEEMENT WITH NEGLIA ENGINEERING ASSOCIATES FOR MUNICIPAL ENGINEERING SERVICES

July 20, 2021

WHEREAS the Township has a need to engage a professional engineering firm to provide Municipal Engineering Services, on an as-need basis, for various projects involving the Township’s daily engineering requirements as well as various capital improvement projects; and

WHEREAS the Local Public Contracts Law, N.J.S.A. 40A:11-5, authorizes the Township to enter into contracts for professional services without public bidding; and

WHEREAS this contract is being awarded in accordance with the requirements of N.J.S.A. 19:44A-20.5 et seq.; and

WHEREAS Neglia Engineering Associates has completed and submitted their Business Entity Disclosure Certification certifying that they have not made any reportable contributions to any political or candidate committee in the Township of Montclair in the previous one-year period, and the subject contract will prohibit said corporations from making any reportable contributions during the term of this contract;

NOW THEREFORE BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that the Township enter into an agreement with Neglia Engineering Associates for the provision of professional engineering services in an amount not to exceed $400,000 for a period not to exceed one year starting from the date of award by resolution, in accordance with the proposal submitted by the vendor, copies of which are made a part hereof and are available for inspection at the Office of the Township Clerk during regular business hours.

BE IT FURTHER RESOLVED that the Chief Financial Officer has certified that the funds for this contract have been appropriated in the 2021 operating budget and capital ordinances, Account Numbers (01-201-20-165-028 & 01-201-21-005-001); and

BE IT FUTHER RESOLVED that the Manager and Township Clerk be and they are hereby authorized to execute and attest an agreement with Neglia Engineering Associates in accordance with this resolution, forms of which shall be approved by the Township Attorney;

BE IT FUTHER RESOLVED that notice shall be published in the official newspaper stating the nature, duration, service and amount of the Agreement and that copies of this Resolution and the Agreement are on file and available for inspection in the Office of the Township Clerk.

RESOLUTION AUTHORIZING A SHARED SERVICES AGREEMENT WITH THE MONTCLAIR BOARD OF EDUCATION TO PROVIDE FOR SCHOOL RESOURCE OFFICERS FOR THE 2021-2022 SCHOOL YEAR

July 20, 2021

WHEREAS, there are police officers specifically trained in educating, counseling, and protecting the public in an educational setting within the Township of Montclair Police Department known as School Resource Officers (SROs), and

WHEREAS, the Township of Montclair (“Township”) and the Montclair Board of Education (“MBOE”) are partners in providing the School Resource Officers (SROs), and acknowledge that these officers have been a constructive and valuable presence in the schools, and

WHEREAS, the Uniformed Shared Services and Consolidation Act, N.J.S.A. 40A 65-1, et seq, (the “Act”) permits units of local government to share services for particular purposes and to effectuate agreements for any service or circumstance that will aid and encourage a reduction of local expenses, and

WHEREAS, the Township of Montclair and the Montclair Board of Education are public bodies corporate and politic of the State of New Jersey and are authorized under New Jersey Law to enter into a Shared Services Agreement pursuant to the Act, and

WHEREAS, the Township Council of the Township of Montclair supports the SRO program in the Montclair Public Schools and endorses this sharing of services between the Township and the MBOE, now therefore

BE IT RESOLVED, by the Mayor and Township Council of the Township of Montclair as follows

1. The Manager and Deputy Township Clerk are hereby authorized to execute a Shared Services Agreement, in substantially the form attached hereto,

2. The Shared Services Agreement shall be available for public inspection in the Clerk’s Office

3. The Shared Service Agreement shall take effect upon the adoption of this resolution and execution of the Agreement by both parties

WHEREAS, the Essex Regional Health Commission was established for the provision of

environmental and other public health services; and WHEREAS, the Township of Montclair is a member of the Commission; and WHEREAS, on August 16, 2002, Susan B. Portuese was appointed to serve as

Commissioner on the Essex Regional Health Commission representing the Township of Montclair; and

WHEREAS, Ms. Portuese has advised that, after a long and distinguished career, she will

retire shortly. NOW, THEREFORE, BE IT RESOLVED that in accordance with and pursuant to

N.J.S.A. 26:3-85, the Township of Montclair Governing Body serving as the Montclair Board of Health hereby appoints Acting Health Officer Keith Costello to serve as Commissioner of the Essex Regional Health Commission representing the Township of Montclair; and

RESOLUTION AUTHORIZING THE MEC TO DEVELOP A CLIMATE ACTION PLAN

July 20, 2021

WHEREAS taking action to mitigate climate change is one of the most pressing issues of our time;

and

WHEREAS the State of New Jersey is particularly vulnerable to the effects of climate change, for

example sea level rise in NJ is occurring at a greater rate than the rest of the country, the intensity and

frequency of precipitation events is anticipated to increase, and storms that result in extreme rain, such

as Superstorm Sandy, are expected to occur more frequently; and

WHEREAS all citizens will benefit from mitigating impacts of climate change; and

WHEREAS, climate change mitigation refers to efforts to reduce or prevent emission of

greenhouse gases; and

WHEREAS the Intergovernmental Panel on Climate Change (IPCC) Special Report 15 (SR15)

informs us that worldwide we must reduce greenhouse gas emissions by 45% by 2030 from 2010 levels

and reach net zero emissions by 2050; and

WHEREAS New Jersey’s Global Warming Response Act (GWRA) 80x50 Report calls for New

Jersey to develop strategies to reduce greenhouse gas emissions by 80% below 2006 levels by 2050

through rapid adoption of: (1) replacing internal combustion vehicles with electric vehicles, (2)

converting space and water heating in the residential and commercial buildings to electric heat, and (3)

replacing fossil fuels in the electric generation sector with renewable energy sources; and

WHEREAS, the Township has already taken steps to reduce greenhouse gas emissions, including

but not limited to:

● Promoting renewable energy aggregation

● Installing energy efficient LED lights in township buildings

● Installing electric vehicle recharging stations; and

WHEREAS, the MEC should assure that any climate action plan adheres to principles of

environmental justice so that efforts to mitigate climate change and create a just transition to

renewable energy sources be equitable such that the benefita and burdens do not fall on any particular

class of persons; now, therefore, be it

RESOLVED, by the Montclair Township Council that the Township and the community,

including town administration, residents, and businesses, consider climate mitigation in all relevant

decisions in an effort to accelerate change and help Montclair meet or exceed the goals set forth by the

IPCC SR15 report and the State of New Jersey in its Global Warming Response Act 80/50 report and

Energy Master Plan; and be it further

RESOLVED, that the Township would benefit from prioritized and coordinated action to meet

these goals, and that the following approaches should be undertaken:

1. An audit of greenhouse gas emissions, municipal and community, in key sectors, that will

serve as a benchmark for goals and ongoing measurement to ensure a data-driven process.

2. Development of a Climate Action Plan (CAP) that recommends emission reduction goals and

strategies for municipal operations, residents, and businesses, aligned with state and federal plans,

and takes into account equity and climate resiliency, with priority on buildings and transportation

sectors which make up 90% of emissions.

3. Expediting consideration of several proven strategies to reduce emissions, as acknowledged

in the 80/50 report including producing our own renewable energy via solar panels and using

100% renewable energy, increasing EV infrastructure and transitioning to electric vehicles,

enabling energy efficiency in homes, buildings and businesses and converting to electric heating;

And be it further

RESOLVED, that the Montclair Environmental Commission is authorized to coordinate and

manage the Plan’s development, consistent with the MEC’s statutory duties, and to solicit input from

key stakeholders, investigate state and federal incentives, build support for the actions prioritized, and

facilitate implementation; and be it further

RESOLVED, that the MEC shall prepare and submit the afore-described Climate Action Plan to

the Township Council for review and consideration; and be it further

RESOLVED, that the Township administration, to the extent practicable, should cooperate with

the MEC in this project, with the understanding that this resolution does not authorize any

expenditure of Township funds, and that the Council encourages the MEC to seek grant funding and

in-kind contributions to facilitate this work.

RESOLUTION AUTHORIZING THE ACCEPTANCE OF NJDOH GRANT FOR CHILDHOOD LEAD PROGRAM 2022 FOR JULY 1, 2021 THROUGH JUNE 30, 2022

WHEREAS, the New Jersey Department of Health has recognized that local health departments have been working to prevent and respond to children with high blood lead levels in the state, and grant funding will provide health departments with more resources to identify, track and address children with high blood lead levels; and,

WHEREAS, The Township Council of the Township of Montclair, County of Essex, State of New Jersey recognizes that the Montclair Department of Health and Human Services has been working in response to children with high blood lead levels; and,

WHEREAS, the Montclair Department of Health and Human Services has received a letter of intent from the New Jersey Department of Health (NJDOH) to receive grant funding in the amount of $127,507 for the “Childhood Lead Program 2022”, from July 1, 2021 through June 30, 2022 within the Townships of Montclair, Cedar Grove, Nutley and Verona: now, therefore

BE IT RESOLVED that the Council of the Township of Montclair, County of Essex, State of New Jersey hereby recognize the following:

1. The Township Council does hereby authorize acceptance of the NJDOH Childhood Lead Program 2022 grant in the amount of $127,507.

2. The Montclair Department of Health and Human Services acknowledges the terms and conditions for administering the NJDOH grant, including administrative compliance, and reporting requirements.

RESOLUTION APPROVING BOARD OF SCHOOL ESTIMATE BUDGET

WHEREAS, the Board of School Estimate of the Township of Montclair has fixed and determined the sum of $ 123,037,813 as the amount necessary to be appropriated for the use of the public schools of the Township of Montclair for the ensuing year; and

WHEREAS, the Board of School Estimate has delivered to the Council of the Township of Montclair a certificate of such amount duly executed by at least three members of said Board, and

WHEREAS, the amount so certified is in excess of one and one-half percent (1 ½ %) of the valuation of the assessed ratables of the Township of Montclair as determined by Essex County Board of Taxation.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Montclair, in the County of Essex, that in accordance with N.J.S.A. 18A:22-17, the Council does hereby concur in and consent to the appropriation of the amount so certified by the Board of School Estimate
