General Information Vogel & Associates, on behalf of the Fraser River Development Company, is requesting a subdivision exemption in order to amend the lot lines for Roam Filing 1, Parcel A and Hideaway Park Lot 1, Block 1. Specifically, the applicant is requesting that the lot lines of Lot 1, Block 1 be amended in order to reduce the size of Lot 1, Block 1 and increase the size of Parcel A. The applicant is also platting a right-of-way to be dedicated to the Town within the Lot 1, Block 1 parcel. Per the Roam Final Development Plan, Ski Idlewild Road is intended to be extended to the south through the Roam property, hence requiring that right-of-way is dedicated within the Lot 1, Block 1 parcel. Subdivision Exemption Regulations Section 8-1-4 of the Subdivision Regulations allows the Planning Commission to exempt property from the subdivision process if one of eight conditions is met. Staff has determined that this Subdivision Exemption meets the requirements of Conditions 2 and 4.

2. Is for the purpose of revising lot lines from those shown on a recorded plat and which creates no more than the recorded number of parcels, subject to the following conditions:

a. Any lot or parcel created shall conform to the minimum requirements for area or dimension as established by the zoning ordinance or any other related ordinance.

b. If the lots of the original recorded plan were nonconforming, lots or parcels created shall not increase the existing nonconformity.

c. Applicable law relating to amendment of recorded plats is complied with.

4. Creates parcels for community facilities (including utility land acquisition) provided that the exemption conforms with the policies and regulations of this Title.

Exemptions Application Procedure:

3. The Planning and Zoning Commission shall approve only those applications which it finds to be in conformance with the conditions of this Section and with any applicable policies and regulations of this Code.

Section 8-1-4, Subsection E, gives guidance on determining which applications should be denied:

E. Denial of Exemption Applications: If the Planning and Zoning Commission denies an exemption application upon finding that the correction or amendment of an existing recorded subdivision plat would result in a plat which does not meet the standards and regulations of this Title, the Commission may require that the proposed exemption be submitted for full subdivision platting procedures.

The Subdivision Exemption process involves one meeting with the Planning Commission for approval. This does not receive review or approval from the Town Council.

Recommendation Staff finds that the applicant has submitted all required materials within the timeframe required and all materials comply with the conditions of Section 8-1-4 of the Town Code and conform with all applicable policies and regulations of this Code. Staff recommends approval of the Roam Filing 1, Parcel A Exemption Plat with the following conditions to be met and/or provided prior to any recording: 1. Prior to recordation, the applicant shall revise the plat in conformance with the red-marked print

dated December 10, 2019. 2. A digital file of the approved plat must be submitted. The digital file shall be in a format

acceptable to the Town's System. Requirements for digital submittal can be obtained from the Town's Planning Department.

3. That an executed Exemption Plat Mylar and other supporting documents, as well as recording fees, be provided prior to recording.

Box 3327 Winter Park, Colorado 80482 Re: Roam Filing No. 1, Parcel A, Exemption Plat Dear James, On behalf of the Fraser River Development Company, Vogel & Associates has prepared the enclosed Roam Filing No. 1, Parcel A, Exemption Plat. This subdivision is consistent with the exemption criteria outlined in Section 8-1-4 the Town of Winter Park Subdivision Regulations. The requested exemption is per Section 8-1-4, condition 2 that allows for the purpose of revising lot lines that are associated with Roam Parcel A and Hideaway Park Lot I, Block I. This exemption is also consistent with condition 4 that allows an exemption to occur to create community facilities which in this case is the public right-of-way for Ski Idlewild Rd. Fraser River Development Company purchased from the Town of Winter Park Lot I, Block I Hideaway Park parcel. Per the approved Roam Final Development Plan, the intent is to extend Ski Idlewild Road to the south of the Roam parcel including intersection with Vasquez Road. This requires right-of-way to be dedicated within the Lot I, Block I parcel. An existing right-of-way that extends into Roam Parcel A and along the east side of Lot I, Block I is in the process of being vacated. The Planning Commission has approved this vacation. Enclosed in this application is the subdivision exemption that illustrates the above considerations. Please review and call with questions or comments.
