Conditions of Sale

1) The bid form contained in this notice of sale must be completed and submitted.2) The bid form must be delivered by one of the methods described in Item 1, H above labeled

Bid Submissions.3) A deposit of $500.00, in the form of cash or a bank check (i.e. cashier’s, certified, money order)

is required with each bid. This deposit will be held for a period of up to 45 days for the Townto evaluate the bids and notify the parties of our decision. Personal checks will not be acceptedas forms of deposits.

4) Once informed by the Town that a bid has been accepted, successful bidder will have fifteen(15) days in which to pay the bid amount for the parcel bid upon. This will be held until theclosing. If the bid price on the parcel is not delivered within said fifteen (15) days, anyexpenses incurred by the Town between the date of acceptance of the bid and the date whenthe bid price was not tendered will be deducted from the initial bid deposit of $500.00 andwill become the property of the Town. Additionally, the Town may sell the subject parcel toan alternate bidder.

5) In addition to the purchase price and a lump sum fee of $500.00 to cover the Town's costs, thesuccessful bidder must pay the transfer tax, the recording fee for any notices of a merger oflots, and any similar closing costs of which none are currently known to exist.

6) The property is being sold in “As Is” condition. The Town makes NO WARRANTY of anyinformation contained herein. The parcel is being sold without warranty as to suitability forbuilding, the ability to gain any desired regulatory approval from the Town (i.e. zoningcompliance), or the absence of any environmental hazard. The property is being sold as a taxdeeded property without any warranties or guarantees regarding chain of title or condition ofthe real estate. Bidders are responsible for performing their own due diligence appropriate tothe purchase of any real estate.

7) The Town will provide the successful bidder with a Deed with No Covenants for the realestate and will record the deed at the Strafford County Registry of Deeds.

8) The successful bidder will have forty-five (45) days from the recording of the deed to applyto the Town for a demolition permit and one year from the date of the demolition permit tocomplete all demolition, removal of debris and general clean-up of the parcel. Successfulbidder will be responsible for either replacing the fence that currently encloses the structureor taking over the rental of the fence from the date the bid is accepted by the Town.

9) Successful Bidder shall provide a Performance Bond, Letter of Credit or Cash Deposit in theamount of $50,000 at the same time the bid price is delivered to the Town of Milton thatshall be called by the Town in the event that the demolition and clean-up is not completedas described in Item 8.

ATTACHMENT 1

INSURANCE REQUIREMENTSAMOUNT OF INSURANCE

Additionally, the Contractor shall purchase and maintain the following types of insurance:

A) Workers Comprehensive Insurance coverage for all people employed by the Contractor to perform work onthis project. This insurance shall at a minimum meet the requirements of the most current laws of the Stateof New Hampshire.

B) Contractual Liability Insurance coverage in the amounts specified above under Comprehensive GeneralLiability.

C) Product and Completed Operations coverage to be included in the amounts specified above underComprehensive General Liability.

ADDITIONAL INSURED

All liability policies (including any excess policies used to meet coverage requirements) shall include the Town of Milton, New Hampshire as named Additional Insured.

1) The contractor's insurance shall be primary in the event of a loss.

2) The additional insured endorsement must include language specifically stating that the entity is to be coveredfor all activities performed by, or on behalf of, the contractor, including the Town of Milton's generalsupervision of the contractor.

3) Town of Milton shall be listed as a Certificate Holder. The Town shall be identified as follows:

ORDER OF FINAL JUDGMENT

Following a hearing on January 15, 2020, at which the Town of Milton was present with

counsel and as well as guardian ad litem Attorney Aaby for all unknown parties who may have

some right, title or interest in the subject property, and based upon the Petition and Verified

Motion for Entry of Final Judgment made by the Petitioner Town of Milton, the Court finds and

rules as follows:

1. On July 18, 2019, the Town filed a Petition for Quiet Title for property located at

565 White Mountain Highway in the Town of Milton ("Property") previously owned by Warner

and Lorette (also referred to as "Loretta") Collins by deed recorded at Book 858, Page 214.

2. Warner and Lorette Collins are both deceased. Petition at ¶1[2, 3.

3. Warner and Lorette Collins are known to have two heirs — their sons, Patrick

Collins and Norman Collins. Petition at D.

4. The tax bill for the Property for year 2015 (and subsequent years 2016, 2017 and

2018) was not paid and on August 15, 2016 the Town liened the Property pursuant to RSA 80:59

and on August 16, 2018, the Town took the Property by tax deed as mandated by law, RSA

80:76 for unpaid taxes for the 2015 tax year. Petition at 91919, 10, 11.

5. The notice of the impending tax lien notice and the notice of the impending tax

deed were sent to the address on file for Lorette and were signed for by Norman Collins.

Petition at 110. The Town was not aware she was deceased at the time the notices were sent.

Prior taxes had been paid on the Property before 2015 and after her death. Petition at 19.

6. On August 27, 2019, the Court ordered service upon Patrick Collins and Norman

Collins in hand or at their abode, as well as by publication in the Union Leader.

7. The Sheriff served Patrick Collins in-hand on September 6, 2019 and served

Norman Collins in-hand on September 14, 2019.

8. The Town published notice of the Petition in the Union Leader twice in

consecutive weeks on September 3, 2019 and September 10, 2019.

9. The Court-appointed Guardian ad Litem submitted a report to the Court which

identified Norman Collins and Patrick Collins as the only likely heirs and which also stated that

the GAL sent correspondence to each and also to other potential relatives of Lorette Collins; the

GAL received no response from anyone.

10. Norman Collins filed an appearance but did not file a plea, answer or demurrer

with the Court.

11. Patrick Collins filed neither an appearance nor a plea, answer or demurrer.

12. No other claimed heirs filed an appearance, or a plea, answer or demurrer.

13. The Town's Petition is therefore taken as confessed by any and all potential heirs

of Warner and Lorette Collins.

14. The Court therefore accepts as fact the Town's verified allegations in its Motion

for Final Judgment. The Court further finds that the only known heirs were provided in-hand

service of this action but have not filed a plea, answer or demurrer and therefore have failed to

15. The Court Orders that title to the Property located at 565 White Mountain

Highway (Map 42, Lot 117) in Milton, N.H. is quieted and the Town of Milton holds full fee

simple title to the Property, and none of the Respondents, nor any parties named or unnamed

claiming by or through the Respondents have any right, title, claim, lien or interest in the

Property.

16. A copy of this Order may be filed in the Rockingham County Registry of Deeds.
