Toronto Family Lawyer’s 7 areas of Expertise

Have you ever wondered what exactly a Toronto Family Lawyer can do for you?  At Baker & Baker Family Law we can offer you expert advice and support in the following seven areas:

1.  Child Support

Child support is the amount of money paid by one parent to the other for the care and upbringing of dependent children. Parents, whether biological or not, are obligated to pay in both legal and common law marriages.  The amount of child support payable, as established by the federal and provincial governments, is determined by the custody arrangement, number of children, and payor's annual income.

2.  Mediation

Mediation allows you to contribute to and resolve family law and divorce issues with dignity and saves you thousands of dollars in legal fees.  When parties mediate, they work with the same impartial, trained mediator. Together, all matters relating to divorce issues are effectively resolved. Mediation is a quick and private divorce solution.

3.  Child & Custody Access

Child custody is the most important decision you will be faced with. Issues relating to custody and access are often the most difficult to resolve; the reason being that they are often based on the emotions of the parents. We, as lawyers, try our best to instruct clients to try and step back from these arguments and focus on the child.

4.  Spousal Support

Spousal support determination in Ontario is complex because there any many different conditions to take into consideration including the occupation of each spouse during the marriage, the length of the marriage, age, physical health and career potential of each party.

5.  Property Division

With in-depth experience in determining property division, clients in Ontario trust us with supplying useful advice during divorce that reflects a genuine insight of their requirements.  Property division at separation entitles each legally married spouse to an equalization of their net family property. This is a division of the value of the property, not the property itself.

6.  Divorce

Divorce legally ends a marriage where the relationship has been severely damaged by mental or physical abuse.   If you have children, they should be your main concern.  We are committed to helping you through separation negotiations in a compassionate and congenial manner.  If you and your spouse have lived separate and apart for at least one year a divorce can be granted or if you can prove that your marriage has broken down because of physical or mental cruelty or adultery.

7.  Marriage Contracts

Marriage contracts (prenuptial agreements) are commonly applied in remarriage, particularly when there are children from a previous marriage and when people have accumulated assets. The benefit of an agreement is the certainty it gives a couple about their rights and obligations relating to property, separation, divorce or death.  Often people who own a number of assets on the date of marriage would like a marriage contract to substantiate what each spouse has possession of at the date of marriage and the value of such assets. This reduces a lot of difficulties if the couple separate.
