National Trust The National Trust is Europe’s leading conservation charity, and is committed to preserving special places for ever, for everyone. The National Trust depends on the income it generates from its rental properties, and could not deliver its core objectives without the support of its thousands of tenants and volunteers. Ty’n y Coed Uchaf is part of the Ysbyty Estate which extends to over 20,000 acres and was acquired by the National Trust in 1951. The estate includes 52 farm holdings and 31 cottages and is one of the National Trust’s largest estates.

General Description Ty’n y Coed Uchaf is located approximately 1.1 miles off the A5, on the B4406 towards Penmachno, 4 miles from Betws y Coed and 4.52 miles from Pentrefoalas. Primary education is available in Penmachno and secondary education is available in Llanrwst which is also the nearest market town. The farmhouse and outbuildings are situated in an elevated position overlooking the Machno valley. Extending to approximately 17.4ha (43 acres) the land ranges from species rich grasslands adjoining the Machno river, permanent pasture near the farmstead and wood pasture, woodland and wet heath further to the east. High Nature Status This is the National Trusts commitment to farming which results in a healthy and rich natural environment that will not only benefit the wildlife but also safeguard the resources we depend on to produce food in the long term. The land at Ty’n y Coed Uchaf is considered important in terms of its conservation interest and the management system practiced in recent times has enhanced the diverse range of plants and wildlife throughout the holding, achieving a High Nature Status.

The National Trust is now seeking a new tenant to continue with a prescriptive management system that will integrate farming with conservation which will be achieved through a mixed grazing (sheep and cattle) system to further improve and maintain the condition of approximately 13ha of species –rich grassland, scrub, wood pasture woodland and wet heath. Due to the sensitivity of the land and the diverse range of habitats within it, restrictions on agricultural improvements and grazing patterns will apply at Ty’n y Coed Uchaf and prospective applicant’s should bear this in mind when submitting their tender and application. An upper stocking limit will be imposed at a rate of 9.5LSU in total at any time. The letting of Ty’n y Coed Uchaf will be ideal for those with a strong conservation interest and are looking to farm on a hobby or part time basis rather than for intensive and business purposes.

Tenure The holding will be let on a Farm Business Tenancy for a 10 year period with effect from the 29th September 2019 with a 5 year break clause. Ty’n y Coed Uchaf Farmhouse Dating from around the early 18th Century (1700’s), the detached farmhouse is of a random stone construction with a slate roof and underwent renovation and modernisation in 2012. A potato clamp near the farmhouse is Grade II listed, but not the farmhouse itself is not. A floor plan can be found on page 13. The accommodation includes:

Outgoings and Council Tax The tenant is to pay Council Tax, and all other outgoings relating to the property. The property is in Band D for Council Tax and the standard charge for 2018/2019 payable to Conwy County Borough Council is £1,469.16. Energy Performance Certificate Band Rating E. The Land The land is a mixture of improved and semi-improved grassland alongside the Afon Machno with slopping wood pasture, woodland and wet heath. All of the fields below the road are species rich grasslands and are valuable habitats that are to be maintained as hay meadows. The plant diversity is quite high with rare species such as lady’s mantle, wood vetch and butterfly orchid. The enclosed woodland and the ffridd wood pasture are important habitats for a whole range of plant and animal species with the open woodland perfect for pied flycatcher and wood warbler. The FBT will be subject to grazing and management conditions which can be found on page 5 with the map on page 6. Field Schedule

Management Prescriptions

• No drainage • No fertilizer/slurry or farmyard manure. • A light application of farmyard manure can be spread on Ddol Cadwgan (Field no 8994) • No ploughing or reseeding • No pesticides • No Liming • No Supplementary feeding areas • Stock exclusion from 10th April – late July • Cut hay no earlier than 15th July • Light grazing between September and April. Remove stock if supplementary feeding is

required. • Cut Willow coppice on long term rotation and not all at once. Limit to current extent. • Bracken control permitted

The Tenancy 1. Agreement The agreement will be in a form of a standard National Trust Farm Business Tenancy

and will be available for inspection on the viewing day and thereafter at the Ysbyty Estate Office during office hours until the 13th June 2019).

2. Term The holding will be let on a Farm Business Tenancy for a 10 year period with a break

clause in favour of either the Landlord or Tenant on the 5th anniversary of the term date. 3. Rental Payments

Rent will be payable half yearly in advance on the 29th September and the 25th March in each year with the first payment becoming due on the 29th September 2019.

4. Rent Reviews

The National Trust reserves the right to carry out rent reviews of the property on the third anniversary of the start date to open market value.

5. Insurance

The National Trust will be responsible for insuring the buildings and landlord’s fixtures. The Tenant will be responsible for insuring the Tenants improvements/contents/own possessions/machinery and public liability.

6. Repairing Responsibilities (Summary) The Tenant will be responsible for internal repairs and decoration, maintaining the

garden, all gates, boundaries and fences and the cost of servicing appliances.

The Tenant will be responsible for ensuring that the septic tank is emptied at regular intervals as necessary and that the chimney is swept at least every 6 months.

Full details of repairing responsibilities are contained in the draft Tenancy Agreement.

7. Sub Letting There will be no right to assign, sub-let or part with possession of the whole or any part

of the premises.

Other matters affecting the holding Basic Payment Scheme The land is registered on Rural Payment Wales for the Basic Payment Scheme and we understand the 2019 SAF will be claimed for. No entitlements are available with the property and prospective tenants are to source themselves. The transfer of land to the new tenant will be completed at the start of the tenancy via RPW Online. Timber Reserved in favour of the National Trust. Agri-Environment Schemes The land is let subject to the following Glastir Options:

• Option 19, Management of Lowland Marshy Grassland – no supplementary feeding • Option 22, Maintenance of Existing Hay Meadow – keep stocking diary • Option 38, New Bird / Bat boxes being applicable –boxes to remain in place.

The 5 year Contract expires in December 2019. The incoming tenant will be expected to comply with the Glastir rules for the remainder of the contract, including the whole farm code. A copy of the Contract will be available to view alongside the FBT. The Glastir payment for 2019 will be claimed for by the outgoing tenant. Future agri-environment schemes will need to be applied for by the ingoing tenant and discussion had with the National Trust to ensure that the options are compliant with the conditions of the FBT. Wayleaves, Easements and Rights of Way The farm is let subject to all existing Easements, Wayleaves and Rights of Way. There are a number of footpaths crossing the land and access to a neighbouring farm is shared with Ty’n y Coed Uchaf. Boundaries All boundaries will be maintained by the new tenant, where applicable and in accordance with the Tenancy Agreement and as shown on the Tenancy Agreement Plan. Other matters Fodder – the outgoing tenant will not be producing any fodder during 2019 and the incoming tenant will be responsible for sourcing their own fodder in time for the start of the tenancy. Viewing the farm and further information The farm may only be viewed on the specific viewing day of the 2nd May 2019 between 10am and 4pm The property may not be viewed at any other time other than the prescribed viewing day. Submission of Tenders Tenders should be submitted subject to the following conditions: 1. Tenders must be submitted using the tender form which will be available on the

viewing day together with all the supporting information as requested. 2. The tender must include the tenant’s signature to confirm that the information given is

correct. 3. The tender must be for a specific sum. 4. The tender must be submitted in the applicant’s name only. The National Trust will not

accept tenders submitted in either a company name, on behalf of a partnership or from joint applicants.

5. The applicant must provide the names and addresses of at least three referees who must be acquainted with the applicant in a business capacity only. At least one of these references must be from the applicant’s bank. Prospective applicants must also be prepared to allow representatives from the National Trust to inspect their current holdings if applicable and if deemed necessary.

6. The National Trust reserves the right not to accept the highest tender nor any tender. 7. Please note: VAT is chargeable on the rental figure tendered. Applications As a general guide, prospective applicants should possess the following qualities: 1. Sufficient capital to adequately stock, farm and manage the holding in accordance with

the terms of the tenancy, to pay the rent and for any improvements which are considered necessary as well as to pay for any ingoing payments due.

2. The applicant must have experience in livestock husbandry and management and demonstrate a level of agricultural knowledge and background.

3. An appreciation and an understanding of the work of the National Trust and an interest in integrating farming with conservation of the landscape. Applicants should note that preference will be given to those demonstrating that the land will be farmed in an environmentally sensitive manner.

4. In addition to the information required on the tender and application form attached, applicants must also include a cash flow statement for the next two years, together with detailed information about their existing capital position, assets live and dead stock. Applicant should also detail their proposals for the future farming system on the holding.
