LAW (LEGISLATIVE DRAFTING) DEPARTMENT (Group-11) NOTIFICATION Jaipur, April .^o, 2012 No. F. 4(7) Vidhi/2/2012.- In pursuance of Clause (3),of Article 348 of the Constitution of India, the Governor is pleased to authorise the publication in the Rajasthan Gazette of the following translation in the English language of the Kota Vishwavidhyalaya (Amendment) Adhyadesh, 2012 (2012 Ka Adhyadesh Sankhyank 3) promulgated by him on ihe 301*1day of April, 2012:- (Authorised English Translation) THE UNIVERSITY OK KOTA (AMENDMENT) ORDINANCE, 2012 (Ordinance No. 3 of 2012) (Made and promulgated by the Governor on the 30th day of April, 2012) An Ordinance to amend the University o fKota Act , 2003. NVhercas, the Rajasthan State Legislative Assembly if not in sc 99ioti. and the Governor of the State of Rajasthan is satisfied that circumstances exist which render It necessary for him to take immediate action; Now, therefore, in exercise of the powers conferred by clausc (1) of Anicle 213 of the Constitution of India, the Governor hereby promulgates in the Sixty-third Year of the Republic of India, the following Ordinance, namely:* 1. Short title und commencement.- (1) This Ordinance may be called the University of Kota (Amendment) Ordinance, 2012. (2) It shall come into, force at once. 2. 1. S ho rt title, extent a:ul com m encem ent.- ( I) This Act may be called the University o f Kola Ael, 2003.

(2) It extends lo the whole o f the Slate o f Rajasthan.

(3) It shall come inlo force at once.

2. Definitions. - In this A c t . unless the subject or co n ^ x t requires otherwise.-

(a) "Academic Council" means the Acadcmic Council o f the University as constituted under section 21:

(b) "affiliated college” means an educational institution admitted to the privileges o f the University;

(c) "autonomous college" means an educational institution declared as such under the provisions o f this Act:

(d) "Board" means the Board o f Management o f the University constituted under section 19;

(e) "conslilucnl college" means a college mainlaincd by the University;

(0 "Faculty" means a Faculty o f the University;

(g) "prescribed" means prescribed by the Statutes ;

(h) " Principal" means the Chief Executive Officer o f a college or any person duly appointed to act as such;

(i) "Slatules", "Ordinances" apd "Regulations" means, respectively, the S l a v e s , • Ordinances and Regulations o f the University made under this Act;

(j) "student o f the University" means a person enrolledin the University for taking a course o f study for a degree, diploma or other academic distinction duly instituted:

(k) "leaeher" means a person appointed or recognizedby the University for the purpose o f imparting instruction o r conducting and guiding research and includes a person who may be declared by the Statutes to be a leaeher;

Provided that no such lease, sale or transler o f such properly shall be made without the prior approval o f the State Government,

(3) The Headquarters o f the University shall be at Kota which shall bo the headquarters o f the Vice- Chancellor.

4. Jurisd iciion (1) Notwithstanding any tiling contained in any law for the lime being in force-but subject to the provisions o f th e U n iv e rs i ty . a f Rajasthan Act, 1946. the Rajasthan Agriculture University Bikaner Act, 1987 (Act No. 39 o f 1987 ). the Rajasthan Sanskrit University Act. 1998 (Act No. 10 of 1998). the. Maharana Pi atap U niversity 'of Agriculture.and Technology Udaipur Act. 2000(Acl No. 8qP2Q0n) and Uvi Rajasthan Ayurved University. (?.) The State Government may. by order in writing

(a) require any institute, institution or college within the territorial limits o f the University to terminate, with effect from such date as may be specified in the order, its association with, or its admission to the privileges o f any oilier University incorporated bv law to such extent as mav be considered+ * necessary and proper, or

(b) exclude, to such e.xlenl as may be considered necessary and proper, ifrom association with, o r from admission to the privileges o f the University constituted by this Act any institule. institution o r college specified in the order which, in the opinion o f the State Government, is required to be sell" governing or lo be associated with or admitted to the privileges of. any other University or body.

(3) The State Government may . in consultation with the University, by notification published in the Official Gazette, enumerate any Government college situated in the jurisdiction o f the University lo be a conslilucnl College o f the University . The land . buildings. laboratories , equipments , books and any other properties o f such college shall ihen vest in the University and the officers , teachers and employees o f sucli college, alter being found suitable through screening and on fulfilling such terms and conditions as may be laid down in the notification. shall be deemed <lo be the officers, teachers or. as the ease may be. employees o f the University .

5. O bjects oT the Univcrsilv.-The University shall be deemed to have been established and incorporated lor ihe purpose, among others, of-

(i) making provision lor imparting education in different branches o f learning : and

(ii) furthering the prosecution o f research in all brancheso f learning.

the provisions o f this Act and the Statutes, •Ordinances and Regulations be open l'-1 all persons but'nothing in this section shall be deemed lo require the University to admit to any course o f study students larger in number than, or with academic o* other qualifications lower than, those prescribed.

7. Towers of the Universily.-The University shall have the following powers, namely:-

(a) to provide for instruction in various branches o f learning as the University may deem III;

(b) lo make provision for (1) research, and (2)advancement o f knowledge and dissemination of the findings o f research and knowledge;

(c) lo institute and confer degrees, diplomas and other academic distinctions;

(d) lo confer honorary degrees or other distinctions ;

(e) to admit colleges, institutions and institutes notmaintained by ihe University, lo ihc privileges o f the University, and lo withdraw all.or any o f these privileges;

(0 to confer autonomous status on a college, institutionor department, as the case may be, subject lo such conditions as may be laid down in tliis Act or as may be prescribed by Ihe Statutes and to withdraw the autonomy;

(g) to co-operate with other University and authoritiesin such maimer arid for such purpose as the University may determ ine;.

(h) to institute teaching, research ami...other posts required' by the U niversity and to make appointment thereto;

(i) to create administrative, . ministerial and othernecessary posts and make appointments thereto;

lo institute and niamiain residential accommodation for ihe students o f the University:

lo demand and receive such fees and other charges as may be prescribed:

lo supervise and control the residential accommodation for siudenls and to rcgulaie the discipline o f the siudenls o f the University and to make arrangements for promoting their hcallh and welfare: and

lo do all such acls and lliings. whether incidental lo the powers aforesaid or not. as may bo requisite in order lo further the objects o f ihe University.

8. V isita tion .- (1) The Slate Government may cause an inspection to be made by such person or persons, as it may. dirccl. o f the University, its buildings, laboratories and equipments, and o f tiny institution maintained by the University and to cause an enquiry to be made in like manner in respect o f any other matter connected with llic administration and linances o f the University.

•(2) The Stale Government shall, in every case, give lo the

University notice o f its intention to inspect Or make an enquiry and the University shall be entitled to appoint a representative who shall have the right to be present find be heard at such inspection or enquiry.

(3) The State Governmcpt may address the Board with reference lo the result o f such inspection and enquiry and^lender such advice as the State Government may oiler regarding the action to be taken by the University.

(4) The Board shall communicate to the Slate Government such action as il proposes to take or has taken as a result-of such inspection or enquiry.

9. Officers and A uthorities of the Universilv.-Thcfollowing shall be the ollicerii and authorim.^ V ihe Universil}. namely:-

(;i) Officers o f llie University : -

(i) the Chancellor.

(ii) the Vice-Chancellor.

(iii) ihe Registrar.

(iv) the Comptroller

(v) . the H s la ic .O fficer.

(vi) the Dean o f Student Welfare.

(vii) the D eans 'of faculties, and

(viii) such other persons in the service o f theUniversity as may be declared by the Statutes lo be officers-o f the University.

(b) A uthorities o f the University

(i) The Board o f Managen ent,

(ii) the Academic Council.

(iii) the fa c u l t ie s .

(iv) the Board o f Studies , and.

(v) such oilier authorities as may be declared by the Statutes' to be the 'authorities o f ihe University.

10.- Clwmceljor.- ' ( I ) The Governor o f the Stale o f Rajasthan shall be the Chancellor o f lh e University, lie 'shall, by virtue .'of his office. be the head’o f the University and shall', when present, preside at the convocations thereof.

conferred on him hv this Act or ihe Statutes made thereunder.

1 1. \ ie c -O h a n c d lo r .- (1) I he Vice-Chancellor shall be a whole lime paid officer o f ihc University and shall be appointed by the Chancellor on the advice o f ihe State Government upon recommendation o f a Selection Committee consisting o f -

(1) one person nominated by the Board not conncctcdwith the University or any college thereof:

(ii) one person nominated by the Chairman. UniversityGrants Commission:

(iii) one educationist nominated by the Chancellor:

(iv) two persons nominated by the Stale Cio\ernment;

and the Chancellor shall appoint one o f these persons to be the Chairman o f the Committee.

(2) The term o f ihe office o f the Vice-Chancellor shall be three years from ihe date on which he enters upon his office or uniil he attains the age o f si\ty-iw o years, which ever is earlier:

Provided that the same persop shall be eligible for' reappointment for a second term.

(3). The Vice-Chancellor shall receive such pay and allowances as may be determined by ihe Slale Government. In addition, he shall be entitled lo free furnisjicd residence maintained by the University and such other perquisites as may be prescribed.

(4) When a permanent vacancy in the office o f the Vice- Chancellor occurs by reason o f his death, resignation, removal or the expiry o f his term o f office, it shall bo filled by the Chancellor in accordance with sub-section ( I ) and for so long as it is not so filled, stop-gap arrangement shall be made by him under and in accordance with sub-seclion(5).

(5) When a temporary vacancy in the office o f the Vice- Chancellor occurs by reason o f leave, suspension o r otherwise or when a stop-gap arrangement is necessary under sub-section (4), the Registrar shall forthwith report the n a t te r to the Chancellor, who shall - make, on the advice o f the Stale Government, arrangem ent for the carrying on o f the functions o f the office o f the Vice-Chancellor.

(7) The Vice-Chancellor may at an> time relinquish office by submitting, not less than si.My days in advance o f the date on which he wishes to be relieved, his resignation lo the Chancellor.

(S) Such resignation shall lake effect from the date determined by the Chancellor and convejed to the Vice- Chancellor.

12. lo w ers a n d duties u f the Viee-Chaiiccllor.- (1) The Vice-Chancellor shall be the principal executive and acadcmic officer o f the Universilv and shall, in the absence o f the*Chancellor, preside at the convocations o f lh e University.

(2) The Vice-Chancellor shall be ex-officio Chairman o f the Board and Academic Council.

(3) The Vice-Chancellor shall Ik* responsible for presenting to the Hoard for its deliberations and consideration mailers o f concern to the University. He shall have power to convene the meetings o f the Board and the Academic Council.

(4) The ViccrChimccllor shall exercise general control over the affairs o f lh e University and shall be responsible for the due maintenance o f discipline in the University.

(5) The Vice-Chancellor shall ensu re ' the faithlul observance o f lh e provisions o f this Act and the Statutes and the Ordinances and shall possess all such powers as may be necessary for the purpose.

(0) In an emergency, which in the opinion o f the Vice- Chancellor requires immediate action to be taken he shall take such action as he deems necessary and'shall at the earliest opportunity report the action taken lo the officer, authority o r other body who or which in the ordinary course .would ha\e dealt w ith the matter.

(3) The Registrar shall lie responsible for the custody o f the records and the common seal o f the University. He shall be ex- olfieio secretary o f the Board o f Management and Academic Council. He shall place before i( all such information as may be necessary for the transaction o f its business, l ie shall roceivc applications lor entrance to the University and shall 'keep a permanent record o f ail syllabi. curricula and such other informations as may be deemed necessary-.

(4) The Registrar shall perform such other duties as may be prescribed or required o f him from time lo lime by the Vice- Chancellor.

(1)-: advise in regard to the financial policy o f the University and be responsible for the preparation o f its budget and for the presentation'thereof Jo the Board through the Vice-Chancellor;

(ii) nuyiago the properties, movable and immovable, and investments o f the University;

(iii) keep all moneys belonging to the University in a scheduled bank or in the Rajasthan State Co­operative Bank Ltd., or Central Co-operative Bail!; execpt the amounts needed as imprest casli (to be prescribed by the Vice-Chancellor) in transacting business o f the University;

(iv) ensure that no expenditure not authorized in the budget is incurred by the University otherwise than by way o f investment;

(v) disallow any expenditure which may contravene the terms o f any statute or for w'hich provision is required lo be made by a statute but has not been made; and

(vi) ensure the co m p lia n c e /o f the provisions o f section 34.

Iii. Estate OHIccr and Dean o f S tu d en t W elfare.- (1) The Board may appoint any one or more o f the following officers, namely:-

(i) the Estate Officer, and

(ii) the Dean o f Students Welfare.‘ i

(2) The Estate Officer shall be incharge o f all the buildings, lawns, garden?; and other immovable property uftlie University.

(3) The peart o f Student Welfare shall have the followingdulies:-

(a) to make arrangements o f the housing o f students.

16. Deans o f faculties an d th e ir functions.- (1) There shall be a Dean o f each Faculty.

(2) The Deans o f Faculties shall be appointed by the Vicc- Chanccllor in a manner as may be prescribed.

(3) The Deans shall perform sucli functions as may be prescribed by the Statutes .

17. O tiic r officer? a n d employees.- The mode o f appointment and the functions o f other officers mentioned in clause (a) o f section 9 and o f the employees o f the University shall be as provided in this Act or as prescribed by Statutes . Ordinances and Regulations.-

13. R em unera tion of officers and employees.- No officer or employee o f tjic University shall be offered nor shall he accept any remuneration for any work in the University save as may be provided for in the Statutes.

19. C onstitu tion a n d com position o f the B oard ofM anagem en t.- ( I ) The Board o f Management shall be the highest executive body o f the University and shall consist o f the following mcml>ers, namely:-

(5) The minutes o f meeting o f the Hoard shall be recorded and maintained by the M em ber Secretary o f the Board.

22. F u n c tio n s o f the a c a d e m ic council.- (1) TheAcademic Council shall be in-charge o f the academic affairs o f the University and shall, subject lo the provisions o f this Act and the S tatu tes and Ordinances made (hereunder have control over, and be responsible for the maintenance o f standards o f instructions, education and examinations and fur the requirem ents for the award o f degrees and diplomas.

(2) The Academic Council shall exercise such o ther pow ers and perform such other duties as may be conferred or imposed upon it by the S tatutes and shall 'adv ise the Vice- Chancellor on all academic matters.

23. C o m p o sitio n a n d func tion o f facu lties.- (1) There .shall be such faculties in the University as may be prescribed by the Statutes.

(2) Each faculty shall consist o f the following:-

(a) Dean o f the Faculty - Chairman :

(b) University Professors o f the subjects assigned lo the Faculty ;

(c) Chairmen o f the Boards p f Studies in the faculty ;

(d) One Post - graduate College Principal and one Post­graduate D epartm ent Head in cach subjcct o f the faculty from affiliated . colleges , nominated by the State G o v e rn m e n t;

(c) Tw o external exports nominated by the Acadcrnic Council.

prescribed by the Statutes .

2-J. Board of studies.- ( I ) There shall be such number o f Boards o f Studies as may be determined by the Statute.

(2) A Board o f Studies shall be constituted in the manner, consist o f such members, exercise such powers and perform such functions as may bo proscribed.

25. Teaching of the University.- (1) All teaching recognized by the University shall be conducted in the University departments or in colleges, institutes and institutions.

(2) The authorities responsible for organizing such leaching shall be such as may be prescribed.

(3) The courses o f study and curricula shall be such as may be. prescribed by Ordinances and, subject thereto, by the Regulations.

26. Conferm ent o f au touoiuous s ta tus .- (1) An alliliatcd college or a'recognized institution or a University Department may be conferred the autonomous status by the University in the matter q f admission o f students, prescribing the courses o f studies, imparting .instructions and training, holding o f examinations and the powers lo make neccssary rules for the purpose.

(2) The Board shall for the purpose o f satisfying itself aooul the standards o f education in sucli a college, institution or department may direct an enquiry to be made iii the prescribed irenner by a standing committee consisting o f such persons as are deemed fit.

(3) On receipt o f the report o f the said committee and the recomrr.cr.daiions o f the Academic Council thereon, the Board on .being satisfied, shall refer the matter lo the University Grants Commission and the Slate Government to obtain their concurrence.

(•JJ On rcccipl o f iuch concurrence, the University shall confer the autonomous status on the College, the institution or the department, as the case may be.

(5) The status o f autonomy may be granted initially for a period o f five years subject to ‘review by an expert commit tee lo be constituted for this purpose. The committee shall comprise the following, namely:-

(6) The Committee shall submit its report to the Board lor further action.

(7) The University shall continue to exercise general supervision over such college, institution or department and to confer degree on the students o f such collegc. institution or department.

(8) The autonomous college, institution or department shall appoint such eommillccs as may be prescribed for ihe proper management relating lo academic, financial and administrative affairs.

(9) Every autonomous college, institution or department shall furnish sueh reports, returns and other information as the Board may require from lime to time.

(10) The Board shall cause eve 17 autonomous college, institution or department lo be inspected from time to lime.

27. W ith d ra w a l o f au tonom ous s ta tus.- (1) The conferment o f autonomous stilus may be withdrawn by the University if the college, institution or department has failed-to observe any o f the conditions u f its conferment or the effieicncy thereof has so deteriorated that iii the interest o f education il is necessary lo do so .

(2) Before an order under sub-section (1) is made, the Board shall, by one month's police in writing, call upon the college, institution or department to show cause why such an order should nol be made.

(3) On receipt o f the explanation, if any, made by the college, institution or department in reply to the nolice, ihe Board shall, allcr consulting the Acadcmic Council and the University Grants Commission report the n a t te r to the Slate Government.

23. .S’u ^ j jk ju e iu a iy provisions i .h u m i; *o m cm bcrsh ip .-(1) All casual vacancies among the members (other than cx-ollicio members) o f any authority or body o f the University shall be filled as soon as possible l>> appointment, nomination or election according as the member who.se place became vacant was appointed, nominated or elected and ihe person appointed, nominated or elected to a casual \ucancy shall be a member o f such authority or body for the residuary period o f the term for which the person whose place he fills would have continued but for the vacancx.

boon appointed, nominated or elected, as or is entitled lo be, a member 'o f any authority o f the University subordinate to the Board or regarding any decision o f the Board under this Act and the Statutes, the matter shall be referred to the Chancellor for his decision, and the decision o f the Chancellor shall be final.

29. Proceedings of University authorities and bodies not to be invalidated by reason o f any vacancy.- No act or proceeding o f any authority or body o f the University shall be invalidated by reason o f the existence o f a vacancy among its members or by reason o f some person having taken part in the proceedings who is subsequently found not to have been entitled to do so.

30. Af»e of rctirenicnt.-Subjcct lo any provision in the Statutes to the contrary or any directions or policy o f the Slate Government in this regard all the employees o f lh e University shall ordinarily retire from scrvicc upon attaining the age o f sixty years.

31 . Pension or provident fund.- (1) For the benefit o f its officers, teachers, clerical staff and other employees, the University shall constitute, in such manner and subjcct to such conditions as may be prescribed, such pension, gratuity, insurance and provident fund as it may deem fit.

(2) Provision shall be made in Statutes to ensure that slafF members transferred from employment in the scrvicc o f the Slate shall have their accrued service benefits protected, upon such transfer.

32. Teachers and Officers o f the University.- (I) The appointment o f teachers and officers o f the University shall be made in accordance wilh provisions o f the Rajasthan Universities' Teachers and Officers (Selection lor Appointment) Acl. 1974 (Ael No. 13 o f 1974).

(2) Except in cases provided for by the Statutes, teachers and officers o f the University shall be appointed under a written contract. The contract shall be lodged with the Vice-Chancellor and a copy thereof shall be liirpished to ihe teacher or officer concerned. The contract shalj nol be inconsistent wilh the provisions of this Acl and the Statutes for ihe lime being in force in relation lo ihe conditions o f service.

maintain and administer a fund lo be called ihc University l;und.

(2) The following moneys shall form part of. and be paid into, llic University fund, namely

(a) any contribution or grant by the Slate Government;

(b) income arising lo ihe University from all sources including income from fees and charges;

(c) trusts, bequests, donations, endowments and other grants, if any;

(d) such other moneys as may be prescribed by ihe Statutes.

(3) The matters to which the fund may be applied and appropriated shall be those prescribed by tliis Act or the Statutes.

(4) All expenses incurred under and in pursuance o f any provision contained in this Act shall be met out o f the University fund.

(5) The University shall have pow er lo borrow, on the security o f the Upiyersity'properties and with the concurrence o f Jw StatcGovcrnn}cpt. money for the purposes o f the University.

34. C ou trp l o f the S ta te G overum ent.-W hcre the State Government funds are involved the University shall abide by the [emis and conditions attached to the sanction o f such funds which TOy irJcr alia incjude prior permission o f the State Government in rcspcct o f the following, namcly:-

(a) creation o f the new posts o f teachers, ofticers or other emDloyccs;

(b) revision - o f the pay, allowances, post-retirement benefits and. other benefits to its teachers, officers an4 other employees;

(c) grant of-any additional / special pay, allowance or olfyef extra remuneration o f any description wljalsocvcr, including ex-gratia payment o r other benefits having financial implications, to any o f its tcqpjiers, officers or other employees;

35. A ssu m p tio n (»f f in an c ia l co n tro l by th e S ta te G o v c n i in c n t as cincr<'ciicy m e a su re .- I f tlie S tale G overnm ent is satisfied that owing to mal-administration o r financial mismanagement in Ihe University a situation has arisen whereby financial stability o f the University has Iwcomc insceurc, il may, by a notification, declare that the finances o f ihc University shall be subject to the control o f Ijie S ta te ’Government and shall issue such o ther directions as il m;iy deem 111 for ihe purpose and the same shall be binding on the University.

(a) the constitution, pow ers and duties o f the authorities o f the University;

(b) the appointm ent, nomination o r election and continuance in office o f the m embers o f the authorities o f ;Jie University and all o ther matters relating lo llicso authorities for which it may be necessary o r desirable lo proside;

(I) the conferment ofhonorary degrees;

(g) the establishment, amalgamation, sub-division andabolition o f departments;

(h) the establishment and abolition o f hostelsinaintained b\ the Urmersity;

(i) the moneys to form part o f and lo be paid into theUniversity fund and the matters lo which the fund piay be applied and appropriated;

(j) the number and emoluments o f teachers o f theUniversity and ihe preparation and maintenance o f a record o f their services and activities;

(k) ihc remuneration and allowances, includingtravelling and daily allowances to be paid lo persons employed in.the business o f ihe University; and

(1) all'other matters which by this Act are required tobe or may be provided for or prescribed otherwisethan by ihe Regulations.

37. Statutes how made.- (1) The Statutes may bo made, amended or repealed'by the Board o f Management in the manner hereinafter provided.

(2) The Board o f Management may lake into consideration the drall o f a Statute cithcr-al its own motion or on a proposal by any authority o f the University.

(3) The Board o f Management, if it thinks necessary, may ;ilso obtain the opinion o f any officer, authority or body o f the University in regard to any drall Statute, which is before it for consideration.

(5) No Statute passed by ihc Board o f Management shall be valid or shall com e into force until assented to by the Chancellor.

(6) Notwithstanding anything contained in the foregoing sub-sections. the Chancellor, either suo motu o r 011 the advicc o f the State Government, may, direct the University to make provisions in ihc Statutes in rcspcct o f any matter specified by him and if the Board o f Management fails to implement such a direction within sixty days o f its receipt, the Chancellor may, after considering the reasons, if any, communicatcd by the Board o f Management for its inability tp comply with such direction, make or amend the Statutes suitably.

38. O rdinauccs.-Subjcct to the provisions o f this Act and the Statutes , the Ordinances may provide for all o r any o f the following matters . namely

(a) the eourscs o f study, admission or enrolment o f students, fee, qualifications o r conditions requisite for any degree, diploma, certificate o r fellowship;

(b) the conduct o f examinations including theappointments o f examiners and their terms and conditions;

(c) ihe conditions fof fesiding in any hostel or otherplace o f residence run or maintained by the University, the Icvyipg o f charges therefor and other related matters;

(d) the recognition ancj supervision o f hostels not run ormaintained by the University;

(e) any other matter required by tills Act o r the Statuteslo be dealt by or under the Ordinances o f the University.

39. GrjdinaiYccs how m ade.- .(1) The Board o f Management nuty make, amend f or*- repeal Ordinances in the manner hereinafter provided.

be made by llie Board o f Management unless a draft thereof lias been proposed by the Academic Council.

(3) The Board o f Management shall not have the power to amend any dralt proposed by the Academic Council under sub­section (2), bill may reject or return it to the Academic Council for reconsideration, in part or in whole, together with any amendments which the Board o f Management may suggest.

(•1) /Ml Ordinances made by the Board o f Management shall have efleet from such dale as it may direel, but every Ordinance so made shall bo submitted to the Chancellor within two weeks. The Chancellor shall have the power to direct the Board o f Management, within four weeks o f the receipl o f the Ordinance lo suojvnd its operation, and he .shall, as soon as possible, inform the Board o f Management o f his objection lo it. lie may. aller receiving ihe comments o f (lie Board o f Management, either withdraw the order suspending the Ordinance or disallow the Ordinance, and liis decision shall be final.

140. Regulations.- (1) Ever)' authority o f the University

may make Regulations consistent with this Act and the Statutes and Ordinances -

(a) laying down the procedure lo be observed at their meetings and the number o f members required lo form a quorum;

(b) providing for all matters wliich by this Act and the Statutes or Ordinances are to be provided for by lhal authority by the Regulations; and

(c) providing for any other matter solely conccrning such authority and not provided for by this Act and the Statutes or Ordinances .

(2) Every authority o f the University shall make Regulations providing for the giving o f notice to the members o f r-uch authority o f the dales o f meetings and o f ihe business lo be transacted thereat and for the keeping o f a record o f the proceeding o f meetings.

l3) The BoarJ may direct the amendment, in such manner as it may :>pecjly» o f an> Regulations made under this seel ion or ihe annulment thereof by an> authority o f the University.

accommodation provided by ihe University or approved by the Vice-Chancellor subject lo the conditions prescribed.

42 . Delegation o f pow ers.- The Board may by Statutes delegate lo any officer or authority any o f the powers conferred upon it by this Act , lo be excrciscd subject to such restrictions and conditions as may be prescribed.

43. A nnual repo rt.- The annual report o f Ihe University shall be prepared under the direction o f the Vice-Chancellor and circulated among the members o f the Board one month before the annual meeting o f the Board at which il is lo be considered. The annual report, as approved by the Board, shall be sent lo the Government for being laid on the lable o f the 1 louse o f ihc Stale Legislature.

44. Accounts and aud i(.- ( I ) The annual accounts and balance sheet o f the University shall be prepared by the Comptroller under the .direction o f the Vice-Chancellor and all moneys accruing lo or received by I lie University from whatever source and all amounts disbursed or paid shall be entered in the accounts.

(2) Such accounts shall be audited in the proscribed manner by such auditors as ihe Stale Governmeni may direct anti ihc cost ol’such audit shall be a charge on the University fund.

(3) The accounts when audited shall Ik printed and copiesthereof, together with the audit report, shall be submitted by the Vice-Chancellor to the Board which shall forward them lo iheStale Government with such comments as may be deemedncccssarv.

45. T em p o ra ry a rran g em en ts .- (1) At any time allcr Ihepassing o f lliis Acl and until such time as the authorities o f theUniversity are duly constituted any officer o f lh e University may be appointed by ihc Vice-Chancellor wilh the prior approval o f the Chancellor to carry on the duties o f any such authority.

(2) Ihe Vice-Chancellor may make temporary appointments, subject lo ihc approval o f the Board at its next meeting, following the making o f such appointments.

ease of change of designation as reference (o corresponding offices.- Where any provision o f this Act or o f the Statutes , Ordinances or Regqlalions refer lo an officer o f the Stale Go\emn:oni by designation, then, if iliat designation is altered or tlul office ceases to exist the reference shall bo construed as a reference to the altered designation, or as the ease may bo, to such conespotiding officer as the State Government may direct.

47. T ransfer of properties and m aupow er.-Noiwithstamling anything contained in any law for the lime being in force, the Chancellor may. in order to give effect lo the provisions o f this Act. on the advice o f Ihe Slate Government, make such orders as are deemed necessary , for the transfer o f -

(a) any ollicer, teacher, employee or servan t,

(b) any movable or immovable property situated in the jurisdictional area o f this University or any rights or interest therein.

(c) any fund, grant, contribution, donation, aid or benefaction received, accrued or promised,

from ihe Maharshi Dayanand Sarswali University, Ajmer or any other Univcrsily lo tliis University on such terms and conditions as may be specified in the orders .

48. Transitory provisions.- (1) All Statutes, Ordinances :ihd. .Regulations made under ihe MaJiarslii Dayanand Safaswali Univeniily Act, 1987 (Act-Nto.38 o f 1987) shall, in so far as they are‘not inconsistent, with the provisions o f Ihis Acl, be deemed to have .been nude under, tliis Act and sliall continue to be in force until, they are superseded or modified by the Statutes, Ordinances sr Regulations nude under this Act.

(2) Ail notices apd orders, made or issued by any authority under Malurshi Dayanand Saraswati University Act, 1987 (Act No. 3S o f 1987) shall, in so far as they are not inconsistent-wilh the provisions 'of tiiis Act, be deemed to have been made o r issued by the corresponding authority under tliis. Act-'- and .sliall..continue to be in lbrce until they are superseded or modified unden,tliis;Acl.

49. Residuary:' provisions.- The Board shall have the itiihoriJy to deal with any nutter-pertaining- to the University and xn specifically dealt \yi;[iin this A c t . The decision o f the Board on

50. Rcuiov;)] of difficulties.- ( I ) The State Government may lor the purpose o f removing any difficulties, in the area and in mailers covered by this Act, by order published in the Official Gazelte-

(a) direct that this Act shall during such period as may bespecified in the order take effect subject to such, adaptations whether by way o f modification, addition or,omission consistent with this Act. as it may deem fit tobe necessary or expedient, or

(b) give such directions as appear to it to be necessary Ibithe removal o f such difficulties that may arise in giving! ell’ect to the provisions o f this Acl, ]

(c) make such*other temporary provisions for the purposcjo f removing any such difficulties as it may deem lit loij be necessary or expedient: jj
