Winter did not exactly take its time this year. Snow has been falling all over and now we sit and wait; for that

one day that the weather creeps above freezing so we can sneak the bike out for a short ride. I know I am a weather channel stalker looking for that one day.

This is the time of year were a lot of us will be breaking down the rides for upgrades or maybe a repair from all the hard riding this season. Maybe you’re thinking of trading in and upgrading you whole ride. There has been a lot of new products and great rides come out this year so happy shopping.

To keep it short this month, all of the Owners and Road Crew here at Thunder Roads Magazine West Virginia would like to wish you and yours a Very Happy Holidays and New Year.

We have all heard it said how greatful we should for the prayer of our grandparents. Well my dear friends, how true this is. I

must confess that over the past three years with added faith, i can attest the truth of this thing called pryers.We all have someone or know someone who is in need of something. No matter how great or how small the need, God is big enough to take care it. Here at Rushing Wind Church, we have a cross with desires of the hearts and many needs hand written and tacked to the cross. In a box, we have many more needs and prayer request that are prayed over by many people of the church on a regular basis. With that said, many of these request, send to God and delivered by angel messengers, have been answered. As the request come in, they are lifted to God for his divine provision. God hears and answers.My friends, do not think your need is to too small, too big, unimportant, or not necessary to God. God hears our every cry and sees every tear we cry. We are very important to God and he wants good things for us. Through times of prayer and answers we also need not to forget to give God great thanks for everything... great and small, good and bad, strong and weak. We need to have a heart of thanksgiving. Not because God needs it, but because he deserves it. God is good in every circumstance and situation.So dear friends, as we approach the holy seasons that are upon us, let us give thanks in all we

Sippin Shine with Hillbilly and Chris Janson

I have been a fan of Chris Janson for a couple of years now. He is one of the new bright and talented stars that are coming out in country music. He is one of

the guys that might be able to fill those shoes. I don’t want to put that kind of pressure on him but I do think he’s very talented and people are going to start paying more attention soon. He has written or co-written songs with or for Tim McGraw, Justin Moore and more. Truck Yeah that was recorded by Tim McGraw and co-written by Chris just went platinum. If you go to You Tube you will be able to find a lot of his music and I dare you not to tap your feet along with the songs. His new single is Better I Don’t. I love it. He must’ve been following me and old Blue around on the weekends. The only difference is Chris has willpower and I thought will power was someone’s name. His other songs like Corn, Redneck Revival, When I’m Holding Her, are just a sample of his songs that I think will make you a fan of his when you listen. I had the good fortune to be at Mountain fest this past summer and got to see him perform. His show was terrific and everybody there had a great time. After the show he signed autographs and talked to his fans. It wasn’t an act I got the chance to sit down and sip a little shine with Chris. I did the sippin he did the talking. He is one of the nicest young men I have gotten the chance to talk to. Here is that conversation.HB- Do you ride now or have you in the past? If so what kind?CJ- YES I DO! Man I used to build bikes as a side hobby with my Dad. Harleys of course. Fresno style was the look we always did.HB- Where are you from?CJ- I’m from Missouri. I come from the boot hill in the southeast part of the state a little town called Perryville. It’s a pretty tight knit little biker community.HB- Is that how you get some of the inspiration for your song writing? Growing up in Perryville?CJ- Yes, West Virginia has always been like a second home to me because of the big following we had up here and our friendship with the Davisson Brothers Band. I really got my first taste of being on the road touring around here. I got the idea for my song Redneck Revival when I was

leaving home from here on one of those trips. A farm field full of Road King Hogs. I’ve been here at Mountain Fest before. I just never played here before. Matter of fact the last time I was here I came on a bike. A lot of my songs inspiration came from riding around this state.HB-What big things are happening for you now? You seem to be getting bigger all the time.CJ- Well I always wanted to play on the Grand Ole Opry and this past week I played there for the 51st time. I closed the show. It was my biggest goal ever to play there. When I did it the first time I thought if I die now my life is complete. Even though I say I have played there 51 times I say that with reverence and thankfulness. It’s the only thing I wanted to do musically and I hit that


goal every time I play there. It’s the greatest achievement in my life where music is concerned. To be honest with you it’s also the most humbling experience as well.HB- Ok what else is going on with your music?CJ- Well you know I’m a songwriter and an artist. They go together and they have two different avenues. I’m constantly writing for other artists and making new music myself. I have a bunch of new things that are happening. I was at the CMA fest this year and it kicked off touring season for me. Rolling Stone magazine gave me 3 write ups and I had never been in that magazine before. I have over 200 tour dates coming up. My whole like is built around God, my wife, kids and my music. I’m just touring and working. I mean come on we are working class and that’s what we are doing.HB- It’s nice to hear your priorities and I’m glad success is coming your way.CJ- Well I don’t come from money. I have had to work hard for everything I have. You know I have this big new bus and I don’t take any of it for granted. I’m thankful for being able to tour like this now. I know what it’s like to drive to WV in my truck and tour. I also remember what it was like to struggle for $250 or $500 here or there. To be rolling like we are now all I can say is Thank You Jesus.HB- I was so excited for you to get here and have the opportunity to talk with you. I really feel like big things are headed your way. Your songs are about what a lot of us deal with in life. I really can’t wait to see your show.CJ- Thank you so much I really appreciate the nice words. I’m never changing, this is just my livelihood and the way that I do things. I really love the biker community it’s always been a good market for me. A lot of my friends are here. Bikers get Bikers and I think you all understand what I mean by that. Even though I don’t get to ride as often as I used to I’m still one of the crowd. Every time I see a bike go down the road I want to go ride.HB- Well at least you could buy a nicer bike nowadays.CJ- No thanks I’m old school. I like the ones that drip a little in the driveway. Remember these are my people I really love this place.HB- Do you have anything that you would like to say to the biker community in closing?

CJ- Just much respect and brotherly love. Thanks for coming to the shows and ride safe.I did stick around and watch his show from backstage and I’m sure glad I did. He truly is one of us. He works hard and puts on a great show. One thing he said during his show tells you the kind of person he is on and off stage. He was talking about his children that he was not the biological father of and said that he didn’t call them step children he called them his bonus children. They were a bonus in his marriage. What a good guy. That wraps it up for this month and come to think of it this will wrap up another year of sippin shine with me. I wanna THANK you for sippin shine with me and for the kind words that you share with me when we meet up on the road. If you do meet up with me on the road remember it doesn’t matter what flavor I pretty much like them all. Remember when sippin always share with your friends and drink in a circle and throw that lid away. Sandman get well soon so you and I can skip spots in the circle. A golfer is in a Christmas Charity Tournament with a friend, who is ahead by a couple of strokes. “Boy, I’d give anything to sink this putt,” the golfer mumbles to himself.Just then, a stranger walks up beside him and whispers, “Would you be willing to give up one-fourth of your sex life?”Thinking the man is crazy and his answer will be meaningless, the golfer also feels that maybe this is a good omen, so he says,“Sure,” and sinks the putt.Two holes later, he mumbles to himself again, “Gee, I sure would like to get an eagle on this one.”The same stranger is at his side again and whispers, “Would it be worth giving up another fourth of your sex life?”Shrugging, the golfer replies, “Okay.” And he makes an eagle.On the final hole, the golfer needs another eagle to win.Without waiting for him to say anything, the stranger quickly moves to his side and says, “Would winning this match be worth giving up the rest of your sex life?” The golfer is in the zone and most assuredly wants the win. “Definitely,” the golfer replies, and he makes the eagle.As the golfer is walking to the club house, the stranger walks alongside him and says, “I haven’t really been fair with you because you don’t know who I am. I’m Satan, and from this day forward you will have no sex life.”“Ahh, top of the day to you,“ the golfer replies, “I’m Father O’Malley. Merry Christmas to ya’ then”.

A little old lady was walking down the street dragging two large plastic garbage bags behind her.One of the bags was ripped and every once in awhile a $20 bill fell out onto the sidewalk. Noticing this, a policeman stopped her, and said, ”Ma’am, there are $20 bills falling out of that bag.” “Oh, really? Darn it!” said the little old lady. “I’d better go back and see if I can find them. Thanks for telling me, Officer.” “Well, now, not so fast,” said the cop. “Where did you get all that money? You didn’t steal it, did you?” “Oh, no, no”, said the old lady. “You see, my back yard is right next to a Golf course. A lot of Golfers come and pee through a knot hole in my fence, right into my flower garden.

In line at the company cafeteria, Bubba says to Ernie behind him, ‘My elbow hurts like hell. I guess I’d better see a doctor.’‘Listen, you don’t have to spend that kind of money, Ernie replies.‘There’s a diagnostic computer down at Smart-Mart. Just give it a urine sample and the computer will tell you what’s wrong and what to do about it.It takes ten seconds and only costs ten bucks. Helluva’ lot cheaper than a doctor.’So, Bubba deposits a urine sample in a small jar and takes it to Smart-Mart.He deposits ten dollars, and the computer lights up and asks for the urine sample. He pours the sample into the slot and waits.Ten seconds later, the computer ejects a printout:‘You have tennis elbow. Soak your arm in warm water and avoid heavy activity. It will improve in two weeks. Thank you for shop-ping @ Smart-Mart.’That evening, while thinking how amazing this new technology was, Bubba began wondering if the computer could be fooled.He mixed some tap water, a stool sample from his dog, urine samples from his wife and daughter, and a sperm sample for good measure.Bubba hurries back to Smart-Mart, eager to check the results. He deposits ten dollars, pours in his concoction, and awaits the results.The computer prints the following:1. Your tap water is too hard. Get a water softener. (Aisle 9)2. Your dog has ringworm. Bathe him with anti-fungal shampoo. (Aisle 7)3. Your daughter has a cocaine habit. Get her into rehab. Talk to your Family Physician. 4 Your wife is pregnant. Twins. They aren’t yours. Get a lawyer.5. If you don’t stop playing with yourself, your elbow will never get better!Merry Christmas and Thank You for Shopping at Smart-Mart.

It used to really tick me off. Kills the flowers, you know. Then I thought, ‘why not make the best of it?’ So, now, I stand behind the fence by the knot hole, real quiet, with my hedge clippers. Ev-ery time some guy sticks his pecker through my fence, I surprise him, grab hold of it and say, ‘O.K., buddy! Give me $20 or off it comes!’ “Well, that seems only fair,” said the cop, laughing. “OK. Good luck! Oh, by the way, what’s in the other bag?” “Well…..not everybody pays.”

Old people used to come up to me at weddings, poking me in the ribs and cackling, telling me, Enjoy it while you can; “You’re next.”They stopped after I started doing thesame thing to them at funerals.

BRIOCHE ENCRUSTED CHRISTMAS HAM (French meaning for “rich bread covering”)*inspired by Mario Batali on abc’s The Chew, but modified by MaMa Thunder, for simplicity. Score the ham. This means you make shallow cutsin a criss-cross pattern, all over entire top and sides of ham. Make sure ham has set out a full hour and room temp. & on a big platter. Preheat oven to 425 degrees. 1 7 to 10 Pound Boneless, Smoked Ham1 Tube of Pre-done Pastry Dough (thawed, but chilled)1 Bottle of powdered Clove Seasoning1 Can of your fave juice that you feel pairs best w/ Ham; Pear juice, Apple Cider, Mango, Pineapple.....whatevva’. 1 Tbls. of powdered Cinnamon 1 Smaller Bottle of Apricot Preserves (quality brand)1/2 Level teaspoon of Red Pepper Flakes2 Beaten Eggs 1/2 Stick of Real Butter; melted by microwave1 Heavy Aluminum, Square shaped, throw away, “turkey or big-ass ham” pan. Buy cheap @ WallyWorld. Mix up your clove powder and cinnamon powder together.After you’ve scored your ham, pour your juice preferenceall over ham and make sure it’s down in all the little checker-board crevices you’ve scored. Now take your clove & cinnamon mix and put some in your hands and sprinkle all over ham, making sure you get some down in every single crevice. If you need more, make up another batch of it; only takes a sec. Now, just let it set while you prepare the dough. Now, you can go to The Chew and make your own authentic Brioche dough if you’re skilled in “scratch” pie crusts, etc., but throw some flour down on your counter, pop open tube of dough and lay it out, throw some flour on your rolling pin and just start rolling out until it’s big enough cover the entire ham (just eyeball it), but don’t get dough so thin it will split open the sec you start to cover ham with it. Pour your Apricot Preserve into a small bowl and mix in your Red Pepper Flakes. Gently smear this all over top & sides of ham. Remove from platter and dry the bottom of ham good so not leaking. Place ham in middle of rolled-out dough. Very Gently bring all 4 sides up to the top and just take the dough and twist into a little knot on top and pat down. Take Egg Wash (combined melted butter & beaten eggs) and brush All Over entire dough, even up underneath. Place on rack that is placed in aluminum pan. As soon as you put in oven, turn oven down to 350 degrees. Bake for 2 hours. If it looks like it’s getting too brown towards the end, then

make an aluminum foil V-tent and tent the ham so that it comes out golden brown and not dark brown. Remove from oven, brush all over with melted butter & must cool for full 15 minutes. If possible when cutting, use a serrated electric knife. If not electric, use a very sharp serrated knife. Make up another batch of Apricot Preserves w/ Red Pepper flakes only melt down on stove top and use as a gravy. Perfection!

SUPER E-Z“Gourmet” GARLIC MASHED TATERS1 Tub of Bob Evans Creamy Mashed Potatoes1 Tub of Bob Evans Sour Cream n’ Chive Potatoes1 Small Tub of Premium brand Sour Cream1 Small Tub of Premium brand Whipped Philly Cream Cheese (room temp)1 Medium Garlic Bulb; cut off ends, place in alum. foil, seal tight, cook in 425 oven for 40 minutes and then mush it down blend into potato mixture.1 Pound of Gourmet Cheese; your favorite; Gruyere (pro-nounced Gre-air), Real Mozzarella (from Deli), Real Parmi-giano Reggiano, Crumbled Bleu Cheese, Fontina or Pecorino, all excellent for this dish. Preheat oven to 350 degrees. Take a large casserole dish and spray with quality butter spray or wipe down with Premium EVOO (Extra Virgin Olive Oil) Blend your 2 potatoes together in one bowl while mixing in the sour cream & the whipped cream cheese. Add a dash of Nutmeg and salt & pepper to taste. Spoon potatoes in 1st, then a layer of cheese of choice, then more potato mix, cheese, potatoes, cheese; all the way up to the top and you should end up with cheese on top of all your layers. Bake for 30 minutes until golden brown and bubbly. Remove from oven and sprinkle chives all over top. Serve asap. E-Z Divine!

SIMPLE CLASSIC BAKED BRIE w/ PRESERVESPreheat oven to 400 degrees. 1 Pound of Brie Cheese1 Tube of Pastry Dough; flour counter & gently lay out. Take a pizza wheel & cut 3 even lines straight down and 2 lines across to form perfect squares. 1 Jar of Your Favorite Preserves; add nutmeg or cinnamon or even a little spice; spice & sweet is good. Use pastry dough still chilled; easier to handle. Lay on floured counter like a triangle. Whip your Brie up fluffy. Take a teaspoon and plop a dollop of Preserves, then a dollop of Brie on top; smoosh to even out. Fold triangle over; wet edges w/ warm water just a tad, take fork and run all along both sides to seam it up. Brush w/ egg wash, bake golden brown, brush w/but-ter when take out & sprinkle w/ confectioners’ sugar......sugar. Serve piping hot w/ whipped cream.

DIARY OF A BIKER CHIC Stereotype

Iwas in the store a couple of weeks ago, trying to find a birthday card for a friend. I was looking through the cards that were marked “birthday for him” and I saw one with a motorcycle on it. My friend that I was buying for does not ride, but I was of course intrigued by the card; especially since it was in the “birthday for him”

section. So I took the card out and read it. On the front was:

“Life is a journey, filled with possibilities, new roads to take, adventures to experience, all waiting just for you.”

Okay, that was nice but there was nothing there that said it was just for a guy. So I opened it up and read what was on the inside:

“Enjoy every minute as you explore everything the year ahead holds.”

Hmmm…still nothing specifically saying this is for a guy. I checked out the back of the card but there was nothing there. To say it didn’t bother me that this card was in the “birthday for him” section would be a lie. It could have been in the “birthday for her” section, but it wasn’t. Why not? I’ve been asked before if I’ve ever experienced any sort of discrimination being a female rider. For the most part, no, I haven’t. I do recall a few years back, walking into the bank to make a deposit and I carried my helmet in with me. I don’t like leaving my helmet on my bike in some areas because it is a rather expensive helmet. I walked in and was immediately helped by the teller; a younger dude who gave me a “disgusted look.” He asked me, “what are you riding?” but he said it in a taunting way, almost as if he was making fun of me, probably expecting me to say I was on a scooter. I looked him up and down with my own disgust and told him I was on a Vulcan in the snottiest voice I could muster. He quickly said, “Oh” and shut up about it.

A few years ago, I was at a bike show and I was looking to buy some heated gear. I was with my mom who also rides and we walked over to a vendor that was selling heated gear. They were not helping anyone at the moment. It was just my mom and I standing there. I was looking through their pamphlets, playing with their display items and not one single person offered to help me. I also had this problem when I was looking at bikes at the start of spring this year. I wasn’t sure what I wanted to buy so I was going to almost every dealership in the area I could think of. You name it and I was there. I walked into every single dealership alone and was never once approached in any of the dealerships. I ended up going back to the place I bought my first bike (Ellicott City Motorsports) and got excellent service. I was

upset that I was never treated as a customer in any of those other places. It’s too bad because had I gotten good customer service, they would have made a sell for sure. Someone told me it wasn’t that I was a female, it was based on my looks alone and if I looked “poor” then I wouldn’t get service and it happens to guys as well. I’m not so sure about that; but okay.

Fall time is in full swing now and before long winter will be sliding its way into our lives – nothing I look forward to. I’ve never liked winter because I don’t like the cold but as a biker, I really hate it. In all the years I’ve been riding, I’ve never been a winter rider. I always store my bike away for the winter. This year, however, after buying my new bike in April, I’m just not ready to put it away for a few months. I’m in love with my bike too much to say goodbye, so I decided it was time to buy some heated gear. I looked around online but I didn’t know what size would work for me and so I didn’t buy online. I went to one store but they didn’t have heated gear in yet. Someone told me about Cycle Gear in Laurel. I had no idea it was there which was odd because it’s not really that far from where I live. I walked in and was immediately greeted by a couple of guys standing behind the counter; Scott and Nicholas. I told them I was looking for heated gear and Nicholas was eager to help me. It was his first day so he was still learning, so Scott took over. Scott took me over to where their heated gear was and began explaining it all to me and let me try on the pants. At no time did I feel uncomfortable or feel like I was being discriminated against. He spent quite a while with me talking about the gear and unfortunately,


they didn’t have my size but he said he could order it from other stores and have it in within a few days; which was perfect because I needed it for the following weekend. I walked out of there feeling like my mission was accomplished. True to his word, Scott called me a few days later to let me know my stuff was in. I went in to pick it up and it was like Christmas came early! I walked out with heated pants, a heated jacket, all the connectors I’d need, and a smile on my face! I got great customer service there and it will be my first stop when I need any kind of gear or accessories.

The plan was to use the gear the next weekend for the toy drive but that morning, I tried hooking the gear up and was unable to get to my battery due to a screw that I couldn’t get loose; first time for everything! I didn’t have access to a power drill so I didn’t get to try out my gear that day. I got the gear

hooked up the next day and I finally took it out the following weekend to try it out. It was 54 degrees and was the first time I had ever ridden in such cooler temperatures. I have to say that the heated gear was a great investment. What I learned on this ride was that I need to have layers over the heated gear to keep the heat in, my glove

liners that I already had work but it’s hard to fit regular gloves over them so I may have to buy the heated gloves, and my feet were getting cold. I need to buy the heated soles to put inside my shoes. The hardest part of owning this heated gear it remembering to unhook myself when I get off the bike!

I pulled over at a little post office to get a quick picture and when I did, I saw another biker go by and they had a scarf around their neck. It made me smile a little as I realized it was another female rider. Like it or not, us chic riders are here to stay so either embrace us or get out of our way!!

Here I sit ready for another great smoke and I have decided to tackle a cigar that first made the scene in 2010. The La Aroma De Cuba Mi Amore is a lovely lady indeed. From the dark San Andreas wrapper

hugging a delicious Nicaraguan filler and binder Ashton and Don Pepin Garcia have brought the goods and delivered them

box-pressed. I have personally always loved a good box press cigar the rounded square shape is often

more pleasing to smoke and they tend to roll off of tables less to boot.

Now there are some draw

backs as with anything box press cigars can have burn issues like runs and can be a bit of a hassle in that department.

Braking into the meat and potatoes here the cigar is dark in hue with a beautiful double band featuring a portrait of a lovely woman. The pre-light draw is a bit loose which is common with a box-pressed cigar. From the very first pull to your last you’ll note the creaminess of this smoke with slight spice and pepper, it has an earthy tone through the first third with some tart sweetness that is hard to place. Into the second third you will find some chocolaty undertones with rich cedar and coffee. Leather and some lingering spice are also in this third and of course the smooth creaminess. Now the final third holds strong with the spicy finish and presents with some earthy cocoa and a resurgence of pepper and that same tartness from the first third. This is certainly a hard stick to put down I almost always burn my fingers. The ash remains strong with only a little flaking odd for a box press, but certainly lends to good construction.

Now as I type with my burned fingers I can say that Ashton put a great price on this cigar at an MSRP of $6.75 for the Robusto (5’’x50) it is a lot of goodness for the buck. It is one of my go to stogies for almost any occasion the one thing I can take away from this cigar is that I wish it had a fuller flavor. The flavors are there and they are good I just wish they were stronger, but this cigar is always in my humidor and it should find its way into yours.

MOTORCYCLISTS GAIN SOME RELIEF FROM CONGRESSIONAL HELMET LAW EFFORTS

Driven by discontent, disillusionment and distrust, American voters saw red in November’s mid-term elections and whisked control of the Unites States Senate to the first Republican majority since 2006 and won additional seats in the Republican-led U.S. House of Representatives, as well as favoring the GOP in numerous statewide races and a majority of gubernatorial contests nationwide.While most of the electorate is simply happy to see an end to a record $4 billion in campaign ads appearing incessantly on television, radio and newspapers, and in in-boxes and mailboxes everywhere, motorcycle riders should be especially glad to have won at least a temporary respite from helmet law threats from Congress and in states where Republicans have remained or gained in governance.As recently as this summer, the Obama Administration included a thinly-veiled attempt to impose a national helmet law through the U.S. Department of Transportation’s (DOT) surface transportation reauthorization proposal to Congress, but the measure was derailed by the Republican-controlled House. Three years ago, motorcyclists across America successfully opposed a proposed amendment to S.1449, the “Motor Vehicle and Highway Safety Improvement Act of 2011,” that would have called for a National Mandatory Helmet Law for all motorcyclists.Although federal agencies like the National Highway Traffic Safety Administration (NHTSA), the National Transportation Safety Board (NTSB) and Centers for Disease Control (CDC) will undoubtedly continue to advance their pro-helmet law agendas, lacking a Democrat majority in either chamber will likely curb enthusiasm for helmet law mandates from Washington, for now.

PAY-TO-PLAY HELMET LAW PROPOSED IN NEW MEXICOIn a unique scheme to punish motorcyclists for exercising their right to ride without a helmet, a Discussion Draft of a Senate bill proposed for the 2015 52nd Legislature for the state of New Mexico would create a system of taxation for riders who opt not to wear a helmet.Specifically, “The department [Motor Vehicles Division] shall make available distinctive motorcycle validation stickers that signify that any person age eighteen or older who operates a motorcycle on which that sticker is affixed are not required by law to wear a safety helmet. The department shall issue validation sticker when a qualifying person pays the fee as provided for.”A standard validation sticker is just $15 annually, but it would cost $692 per year for the “distinctive motorcycle validating sticker” that allows the rider to go lidless…the additional tax revenue to be distributed as follows: $541.60 to the trauma system fund, $135.40 to the brain injury services fund, and $15 as additionally provided by law. Otherwise, the rider and passengers must wear a helmet, even though New Mexico law currently does not require helmet use for those 18 and older.“My concern is this will turn into a helmet law in New Mexico,” said Annette Torrez, chairperson for the New Mexico Motorcycle Rights Organization (NMMRO) and a member of the National Coalition of Motorcyclists (NCOM) board of directors, who reported on the effort

at a recent NCOM Regional Meeting in Baltimore, Maryland. “We found out that a lobbyist in New Mexico asked a senator to draft the bill, and though it does not have a sponsor yet, we are currently researching who is behind it.”

TEXAS SAYS NO POLARIS SLINGSHOTSThe Polaris Slingshot, a brand new three-wheeled sports-vehicle now just arriving at dealerships across the U.S., lacks componentry necessary to be considered “a car” and in most states you register it as a motorcycle; but the Texas DMV says “Whoa pardner, not so fast.”Though Polaris says they’d already received approval from the Lone Star State to sell their Slingshot there, according to a letter to Texas Polaris dealers posted on a Slingshot forum on November 4th they were notified by the Vehicle Titling and Registration Division of the Texas Department of Motor Vehicles that the DMV is taking the position that even if dealers are licensed to sell it as a motorcycle, owners of the Slingshot will not be able to register it because it is not street legal as far as Texas “motorcycles” are concerned.The conflict hinges on the wording used to define a motorcycle in Texas. The Texas Department of Public Safety Motorcycle Operator’s Manual says three-wheelers are defined by certain characteristics, one of them being “saddle seating,” meaning “seating in which the rider/passenger straddles the vehicle,” but the Slingshot’s seats sit side-by-side. Because it doesn’t have a “saddle,” the DMV ruling prohibits the Polaris Slingshot from being registered as a motorcycle, so they will not be sold in the state until this “VERY urgent matter” is resolved.The Texas precedence has the potential to sway other states to define the Slingshot similarly, a scenario Polaris is surely hoping to avoid.Polaris has fought hard for their not-car classification, and have used the fact that their vehicles are legally considered motorcycles to ease their passage through regulatory waters, but this gray area has led to some other unintended legal consequences, such as operator licensing, vehicle registration and applicable helmet requirements. Ultimately, it has everything to do with the way laws are written and how “motorcycle” is defined therein, which varies from state to state. INDIANA SCOOTER RIDERS FACE NEW REGULATIONS

Indiana officials are warning motor scooter drivers that starting in January they’ll need license plates on those bikes. Legislators have approved Indiana’s first license requirements for scooters, and under the new law drivers of scooters with engines of 50 cubic centimeters or less will need to buy license plates and pass a Bureau of Motor Vehicles test involving road signals and signs. Operators of scooters with larger engines will be required to follow motorcycle requirements, including holding a valid motorcycle license or learner’s permit.Evansville police officials told a legislative committee that scooters had often been involved in accidents and used in crimes such as robberies, but that the owners couldn’t be found because they lacked any registration.The new law doesn’t require insurance for drivers of the smaller scooters, and the registration will cost $26.35, plus a $10 excise tax.Law sponsor Rep. Dave Wolkins (R-Winona Lake) said not


requiring a driver’s license for scooter operators was important because he felt it was necessary that those with drunken driving convictions still have a way to get to work.

MINIBIKE MANUFACTURER TO PAY RECORD $4.3 MILLION FEDERAL FINE

Baja Inc. of Anderson, South Carolina, has agreed to pay a record $4.3 million civil penalty to settle a complaint from federal regulators that it delayed reporting safety defects on its go-karts and minibikes, the Consumer Product Safety Commission has reported.The settlement resolves CPSC charges that the firm knowingly failed to report within 24 hours, as required by federal law, known defects and an unreasonable risk of serious injury involving 11 models of minibikes and go-carts sold nationwide from November 2004 through June 2010.The defects in Baja’s products, which consisted of fuel leaks and unintended acceleration, resulted in the recall in 2010 of 308,000 Baja Motorsports minibikes and go-karts, which is when Baja filed its Full Report with CPSC.Although the company agreed to pay the fine, it did not admit any wrongdoing and said it was paying to “avoid the cost, distraction, delay and uncertainty” of continued proceedings.Previously, the highest penalty the safety commission had issued was a $4 million fine against Graco Children’s Products in 2005 for failure to inform CPSC about dangers to children.

NEW ARMY RULES BAN BASKETBALL SHOES AND CLUB COLORS

U.S. Military installations worldwide require military members and employees to utilize a variety of safety equipment to ride motorcycles on base that is not required by laws outside their boundaries, but some new Army rules in Hawaii sound way off base.On Nov. 1, Military Police and leaders at all levels began enforcement of U.S. Army-Hawaii Policy Letter 11 on Motorcycle Safety, consisting of four major changes to the pre-existing policy, including changes to required safety equipment and prohibited equipment.“When operating a motorcycle on USARHAW installations, riders must wear a DOT approved helmet, protective eyewear, abrasion-resistant gloves, long pants (excluding PT pants), long sleeves, and leather/canvass boots or sturdy over-the-ankle shoes,” and such regs are typical of most military bases, but their new policy “prohibits riders from wearing high-top basketball shoes while riding.”Additionally, the new policy specifies the use of reflective gear at all times, and riders must wear either a fluorescent (brightly colored) and reflective vest, jacket or upper outer garment, or they must wear a motorcycle specific jacket with padding/armor.But what’s most concerning is “Prohibited Equipment” that is NOT allowed to be worn: “Riders on-post are not authorized to wear any garment that displays an affiliation with a motorcycle club or other group that offers or solicits membership.”The new policy applies to all motorcycle operators on USARHAW installations. In addition, the policy applies to all 25th Infantry Division Soldiers, both on and off-post.

STUDY SHOWS LANE SPLITTING POSES NO ADDITIONAL DANGERS

A series of new studies out of the University of California, Berkeley found that the practice of lane splitting poses no additional danger to motorcyclists. California is the only state that allows for the maneuver, which is the act of a motorcyclist passing slow or stalled traffic by riding in between cars along the lane lines.Two yearlong studies were recently released by UC Berkeley and were commissioned by the California Highway Patrol and the Office of Traffic Safety, and determined that the seemingly risky move of weaving in-between traffic to be no more dangerous than just riding a motorcycle, when executed in a safe and prudent manner.The state-commissioned research considered thousands of accident reports and found lane splitting is poses no more risk than riding a motorcycle in a marked lane, with the exception when lane splitting (a.k.a.; lane sharing, or filtering) is done at speeds over 10 miles an hour in excess of traffic flow.One report is a crash study that examined 8,262 motorcyclists who were involved in crashes while lane splitting between June 2012 and August 2013. The second report examined lane-splitting habits among various groups in 2012 and 2013.Researchers found lane splitters are less likely to be rear-ended (2.7% of crashes vs. 4.6% for average motorcyclists), and lane-splitting motorcyclists involved in crashes were notably less likely than other motorcyclists to suffer head injury (9.1% vs. 16.5%), torso injury (18.6% vs. 27.3%), or fatal injury (1.4% vs. 3.1%).Lane-splitting in California appears to be on the rise, with 62% of motorcyclists admitting to lane-splitting on both freeways and other roads, a 7.5-percentage-point increase over 2013.Data from the studies will be shared with the CHP, which this year began working on guidelines for lane-splitting. Authors say the report, the first of its kind about lane-splitting, will be followed up by more in-depth analysis, including looking at rider age, rider gender, motorcycle characteristics and collision and roadway characteristics.In many countries, lane splitting and filtering are normal practices for motorcyclists, particularly in highly urbanized areas of Europe and Asia.

LANE FILTERING APPROVED DOWN UNDERFollowing consultation with riders, motorists and road safety groups, the government of Queensland, Australia decided to make changes to the laws regarding motorcycle riding, and beginning early next year motorcyclists will now be able to move around stationary or slow moving vehicles, as long as they are travelling less than 30 kilometres an hour (18.64 mph).A trial in New South Wales found lane filtering could help ease traffic congestion and Transport Minister Scott Emerson agreed it should be rolled out in Queensland, but it will only be allowed for experienced riders and won’t be allowed in school zones during school hours.Among other “sensible changes,” motorcyclists will also now be able to legally stretch their leg off the bike to help avoid fatigue, take both feet off the footsteps to reverse into a parking space and turn their head to do a shoulder check. I love it when a plan comes together. I had been trying for some time to get by Kickstand’s Bar and Grill to visit and check out this bar I had been hearing so much about in Clarksburg, WV. It seemed that every time I set off to Kickstands something always happened and I had to postpone my trip. My recent trip through WV gave me another opportunity to visit the bar. The other good news was that Bike Night (Thursdays) fell on Halloween. That would only increase the fun.

Kickstands is easy to find in Clarksburg at 3200 Junkins Ave. We pulled into Kickstands and went inside. It’s really

a nice bar with a couple of pool tables and a full service bar and kitchen. Eddie Davisson and his band play here each Thursday. Halloween was no exception. The band played and the costumed patrons arrived. Everything from a Dallas Cowboys cheerleader to pirates and everything you would expect to see at grownup costume party.

The beer was cold and the food was good. The band was having a great time and it seemed that a good time was had by all. So if you’re in the area stop in and say Hi to Jeff and his staff. You will be glad you stopped by and I’m sure you will go back. Tell them Hillbilly sent you.
