GENERATION OF MATTER

On 6 July, 1979, the Texans for Tower Committee (the Committee)referred to the Office of General Counsel by the Reports AnalysisDivision (RAD) for receipt of an excessive contribution in violation

_of 2 U.S.C. S 441a(a) (1) (A).

EVIDENCE

On their 30 Day Post-General Report, the Texans for Tower Committeedisclosed a $2,000 contribution on October 30, 1978 from Mrs. John

SMatthews, a private individual. A surface violation letter was sentNto the Committee on 1 March, 1979. On 15 March, 1979, the Commissionreceived a letter from John F. Davis, the Co=.mittee Treasurer. Mr. Davisadmitted the mistake and included a copy of a March 12, 1979 refundcheck for $1,000 which the Committee sent to the contributor. In ad-dition, Mr. Davis explained the Committee's failure to return theexcess amount earlier by stating that "... All of our inter-officepaper work was completed for the refund, (but) the refund check wasnever written." The refund was disclosed in the Committee's April 10,1979 report.

LEGAL ANALYSIS

The excessive contribution was clearly made by Mrs. Matthewsand accepted by the Committee. Mitigating circumstances doexist though. The Committee treasurer indicated that thisexcessive contribution escaped scrutiny via inadvertance, butthe paperwork for the refund had been completed. In view ofthe steps taken on the Committees own initiative, and becausethe excess here was not great, the Commission should take nofurther action and close the file.

RECOMMENDATION

1. Take no further action in this matter.

2. Close file

PRELIMINARY LEGAL ANALYSIS

While the Committee treasurer app ears tobe saying that the Committee was prepared to refund this excess muchearlier and failed to do so through inadvertence, this explanation ought tobe explored prior to any final determination in the matter. The Commissionshould now find reason to believe that both the contributor and the recipientviolated S44la and request additional information.

Recommendations

1. Find reason to believe that both contributor and recipientCommittee violated 2 U.S.C. S44la.

2. Approve the attached letters.
