H.L.A. Hart (1907 - 1992)

The purpose of law is to coerce, or force, people to do certain things and not do others, but since this is difficult to apply in all circumstances, there should be “an open texture of law.”

Law essentially forces people by threat of imprisonment for fine to do certain things (e.g. wear seatbelts) and not do others (e.g. steal), but law should also take into account why people were not wearing seatbelts or why they stole and sentence accordingly.

Thomas Hobbes“No action can be unjust, but when a covenant is made, then to break it is unjust…”

The law itself cannot be just or unjust, the only thing that is unjust is if the law in place at the time is broken.
