Exxon Mobil overtakes Wal-Mart to top Fortune 500Exxon Mobil Corp. unseated Wal-Mart Stores Inc. in the 2009 Fortune 500 list, shrugging off the oil price bubble and weathering what the magazine called the worst year ever for the country's largest publicly traded companies.Fortune's closely watched list, released Sunday, ranked companies by their revenue in 2008. Irving, Texas-based Exxon took in $442.85 billion in revenue last year, up almost 19 percent from 2007. The company also raked in the biggest annual profit, earning $45.2 billion.Bentonville, Ark.-based Wal-Mart had held the top spot for six of the last seven years but fell to No. 2 this year. Still, the retail giant's 2008 revenue climbed 7 percent to $405.6 billion, as the battered economy sent more consumers searching for bargains. The world's largest retailer took in $13.4 billion in annual profit, an increase of about 5 percent.Energy companies continued to dominate many of the top positions, as last summer's skyrocketing oil and gas prices more than compensated for their plunge later that fall. Chevron Corp. held on to third place with $263.16 billion in revenue, up 25 percent. ConocoPhillips climbed one place to fourth, with $230.76 billion in revenue.Three of the top 5 Fortune 500 companies were oil companies; ExxonMobil, Chevron Corp. and ConnocoPhillips.

Lower Energy Prices Batter Industry’s Q1 Results ConocoPhillips The nation’s third largest oil company’s net profit for the January to March period was $840 millionfor the first quarter.First-quarter results for the entire oil industry are expected to be lower as the global economic downturn saps demand for energy. After peaking around $150 in July, the price of crude tumbled hard and fast, and today costs less than $50 a barrel, according to reports.Despite the difficult year-to-year comparisons, ConocoPhillips' first quarter results were actually much better than the fourth quarter 2008, when the company took $34 billion in asset write-downs linked in part to lower commodity prices. In January, Conoco announced 1,300 job cuts and, anticipating a difficult 2009.Many refiners have slowed production in recent months because consumers are driving less due to the bad economy. ConocoPhillips is the third-largest U.S. oil company in revenue, after ExxonMobil and Chevron. The company recently climbed a notch to fourth place on the Fortune 500 list of highest-revenue companies, with sales of $230.76 billion in 2008.ExxonMobil 1Q profitExxonMobil based in Irving, Texas, said net profits for the first three months of the year came to $4.6 billion from revenue of$64 billion. ExxonMobil spent $7.9 billion buying back its own shares during the quarter.Royal Dutch Shell Plc and BP PlcThe two largest oil companies in Europe reported net profit for the first-quarter of 2009; Shell’s was $3.5 billion and BP’s was $2.2 billion.

Lawsuit from 1990s is revived: alleges gasoline price-fixing by Arco, Chevron, othersLos Angeles - The U.S. 9th Circuit Court of Appeals on Friday revived a class-action lawsuit accusing Arco, Chevron and several other refiners of conspiring to fix gasoline prices during the mid-1990s, reported The Los Angeles Times. But the same panel expressed doubt that the plaintiffs would be able to prove their case.The ruling stems from a suit filed by William O. Gilley on behalf of other wholesale buyers of the cleaner-burning fuel that since 1996 has been required in California. Attorneys for Gilley contend that the defendants had violated the Sherman Antitrust Act by limiting the supply of gasoline to raise prices and keep them high, said the report.A federal judge dismissed the case in 2002, arguing that Gilley was precluded from re-litigating claims from a 1996 case that had determined no such conspiracy existed.Two members of the three-judge appeals panel ruled that the Gilley case explored a new area: whether the total effect of production-sharing agreements entered into individually by refiners could squeeze supply. The panel also ruled that the lower court had erred in not allowing the plaintiffs to argue that there could have been an anti-competitive effect on pricing even without evidence of collusion.Plaintiffs' attorney Timothy D. Cohelan said it was a major breakthrough for the case. "Now, we can analyze the combined effect of these contracts to determine whether or not they are having an anti-competitive effect," he told the newspaper.Judy Dugan of Consumer Watchdog, an advocacy group critical of the petroleum industry, said she was not sure whether the case could be proven, but added that "almost any gas station will tell you that the refiners are fixing the price to keep it

high." Dugan told the Times that the state attorney general's office "ought to demand more and better information from refineries about what they pay and on exactly how they set their prices."

Drop in Gas Sales, Despite Lower Prices San Francisco – Despite the lowest gasoline prices in five years, California motor fuel sales decreased in December, reports the San Francisco Chronicle.Overall, Californians spent 6.3 percent less on gasoline in December 2008 than in December 2007. Annually, per-person consumption dropped 4.1 percent. "If you just look at price, you'd expect consumption to go back up," said Daniel Sperling, head of the UC Davis Institute of Transportation Studies. "People have lost income, and they're very nervous about the future, so we're seeing them drive less." He predicts that sales will remain flat until the economy picks up."As soon as people start feeling more hopeful about the future, we'll see gasoline sales rise," said Sperling. The sales drop continues a three-year trend. However, the previous decreases were attributed to high gas prices, which reached a high of $4.61 per gallon last summer. After the economic crisis hit and prices fell, though, sales continued to drop.Diesel sales suffered the greatest sales hit, plunging 9.2 percent in December and 8.3 percent for the year. The California dip stands in contrast to a nationwide decrease that has now leveled off. After decreasing 2.2 percent in 2008, national gas sales are only 0.4 percent less now than they were a year ago.

Running Out on Gas?Oil industry bracing for drop in U.S. thirst for gasolineDallas -- A growing number of industry players believe that era of ever-increasing gasoline volumes is over. Among those who say U.S. consumption of gasoline has peaked are executives at the world's biggest publicly traded oil company, Exxon Mobil Corp., as well as many private analysts and government energy forecasters, reported The Wall Street Journal.The reasons include changes in the way Americans live and the transportation they choose, along with a growing emphasis on alternative fuels. The result could be profound transformations not only for refiners, but also for state and federal budgets and for consumers, the report said. Much of contemporary America, from the design of its cities to its tax code and its foreign policy, is predicated on a growing thirst for gasoline.In the vast market for crude oil, American gasoline consumption matters. One of every 10 barrels of crude ends up in U.S. gasoline tanks, more than is used by the entire Chinese economy.Right now, the recession is curbing U.S. gasoline consumption, as laid-off workers stop commuting and budget-conscious families forgo long road trips. Drivers filled their cars with 371.2 million gallons of petroleum-based gasoline every day in 2007, according to the U.S. Energy Information Administration. It expects that to fall 6.9% to 345.7 million gallons in 2009, as demand at the pump declines and the use of plant-based ethanol increases. Even if usage climbs after the recession ends, it won't exceed 2007 levels, according to EIA forecasts.

Crude Oil Falls After IEA Cuts Demand Forecast to Five-Year Low April, crude oil declined after an International Energy Agency report showed that 2009 demand may slump to the lowest level in five years as factories shut and car sales tumble amid a deepening global recession. World consumption will fall 2.4 million barrels a day this year, about the same amount that Iraq produces, to 83.4 million barrels a day, according to the IEA report on April 10. “When the IEA makes a big cut in its demand forecast, the oil market has to notice,” said Phil Flynn, senior trader at Alaron Trading Corp. in Chicago. “It’s hard to sustain any rallies when demand is down.” Oil demand will shrink by 2.8 percent this year. “The pace of contraction is close to early 1980s levels, with a growing consensus that economic and oil-demand recovery will be deferred to 2010,” the Paris-based agency said in its monthly report.

C-store Chains Cashing In on Prepaid CardsNew York -- Branded and private-label prepaid card transactions are expected to hit $178 billion by next year, up from $113 billion in 2007, according to a study by Aite Group LLC.Mike Zielinski, president of Royal Buying Group, which represents 6,000 c-stores and petroleum marketers, said the cards would be a difficult sell for the suppliers, but he can see why some retailers would be interested in them. "There is a demand for that product and every retailer is looking for more sales," he said, "but they need to consider who their customers are and what pushback they'd get from shoppers who would take offense."If a retailer did offer them and were rigorously checking IDs before selling them, they could gain respect in the neighborhood for selling adult products only to adults. But where do you cross the line? Some companies think Playboy and Penthouse are pornographic, others consider those magazines as 'adult sophisticates' but would not sell Hustler."Online entertainment cards, including those used to access online gaming, virtual worlds and social networks, are gaining attention. "These categories are showing strong user growth, and with a young demographic that may not have access to credit, there's a demand for prepaid," said Mike Skinner, general manager, Coinstar E-Payment Services, based in Bellevue, Wash.

Sales of gaming cards have grown more than 200 percent year over year, according to Thomas Solomon, vice president, sales, grocery and convenience for InComm, the Atlanta-based prepaid product provider.Reloadable debit card sales have grown at rates of more than 100 percent annually, as they become mainstream; consumers are looking for more ways to control costs and budget more effectively, Skinner added. "We are seeing these cards starting to stick among people who have chosen not to or are unable to have a traditional banking relationship. For convenience, a large number of individuals have their paychecks deposited to them."Consumers typically pay for the reloadable card, pay to reload it and may pay a monthly fee to keep the card activated. "Even though there are fees associated with the reloadable cards, it is still a less expensive option than how some are doing their banking today," Solomon noted.7-Eleven's Haynes sees reloadable debit cards as "a big opportunity for us in the near future."

Rex Tillerson: ExxonMobil to Invest $129B in Five Years IRVING, Texas -- Exxon Mobil Corp. Chairman and Chief Executive Rex Tillerson said the major energy firm is not planning to shrink its staff or cut back on investment due to the global economic downturn, and expects to spend $129 billion on new projects over the next five years, the Associated Press reported.The figure "spans across the entire scope" of the company's business, including oil and gas exploration as well as refining, he said earlier this week after the inauguration of a liquefied natural gas plant in Qatar."Our business plans are developed with a very long view in mind," Tillerson said. "So the fact that we're in a temporary economic downturn—and it will be temporary, it will turn—really does not affect our business plans at all."Exxon Mobil's capital spending would hit $29 billion this year, up from the $26.1 billion it spent in 2008, he said last month. At that time, he said spending levels would likely stay in the $25 billion to $30 billion range through 2013, according to the report.High oil prices and a cash-conserving strategy have left Exxon better positioned to weather the recession than other U.S. companies and industry peers, the AP reported.Exxon Mobil CEO Rex Tillerson gets $23.9 million in 2008 payExxon Mobil Corp., which set annual profit records in each of the last two years, rewarded its chief executive with a 10 percent raise that brought his total compensation to $23.9 million in 2008, according to an Associated Press analysis of a regulatory filing.

The Importance of Fully Funding Petroleum Clean-UpsThe Inland Protection Trust Fund (IPTF) was created so that Florida could protect drinking water supplies. Over 90% of our drinking water comes from underground sources and it is absolutely imperative that we address existingcontamination.At the inception of the clean-up program, the state entered into an agreement with owners of contaminated property that their sites would be cleaned up. The constant irregularity in the funding of the program has producedunintended consequences.First, we have extended the program end date by decades. Secondly, we have harmed small business owners who either want to sell their property or borrow money against it for capital improvements. Uneven funding makes either onealmost impossible to achieve. Third, was the creation of an industry whose job it is to clean-up contaminatedsites. They are comprised primarily of professionals in the fields of engineering and geology. For the most part, they are small business entrepreneurs who have taken their education and expertise and applied it to a need. Improperfunding levels are causing some of these businesses to close or move from Florida. The state would be better served by having thriving businesses paying taxes and employing Floridians.While we believe there is certainly room for improvement, we acknowledge that the program will never be efficient or effective if we continue to under fund it. While we fully understand the current economic situation we face in Florida,we can’t exacerbate our problems with the potential for contaminating our most precious resource, drinking water. The revenue projections are $209 million and costs to run the program are around $50 million and continue to encourage them to protect ground water. Urge your legislators to fund the program at the highest level possible. The clean-up program must be properly funded with revenues generated by the IPTF, if not the issue of those unintended consequences will only get worse.

Cigarette Sales Down After Tax Increases Cumberland, R.I. and Treasure Coast, Fla. -- It's not a hard concept to grasp as taxes on cigarettes goes up, sales of cigarettes go down but the latest tax increases on the products are once again hitting many local convenience stores hard, according to area news reports in The Valley Breeze and Hometown News.  Rhode Island's latest tax increase on nicotine places the nation's smallest state at the top of the tax heap and the effect is hurting retailers including Steven Biron, who owns a Sunoco Gas station and Stop 'n Save Neighborhood Store in Burrillville, R.I. Biron told The Valley Breeze his weekly order was 25 cartons fewer than normal, following a slow weekend during which a pack of cigarettes hit a record price of $8.35, up from $6.50 in the state.

Biron said it is too early for convenience store owners to know the true impact of a $1 increase in the state's excise tax—to $3.46 a pack because many of those who vowed to quit smoking due to the price hike. The increase has pushed Rhode Island's cigarette tax to nearly $1 more than neighboring Massachusetts, and $1.50 more than Connecticut, creating huge competitive disadvantage, which Biron and others said could put them out of business.  When a customer buys a pack of cigarettes, he or she most often also purchases coffee, soda, food and lottery tickets. The lottery is a huge source of revenue to the state, which could be hurt in the coming weeks as customers cross the border into neighboring states for gas and cigarette needs.Meanwhile, in Treasure Coast, Fla., some small c-store owners are seeing decreases in cigarettes sales ranging from 10 percent to 25 percent, following the new federal tax rate increase.  In Tallahassee, lawmakers in the Senate are considering raising the state cigarette tax from 34 cents per pack to $1.34 per pack.  A Senate committee of three Republicans and two Democrats approved the tax increase, but no date has been set for a full Senate vote, reported Hometown News. 

Wisconsin Governor: Raising Gas Tax Worth Considering Madison, Wis. -- Gov. Jim Doyle said raising the gas tax by three cents a gallon is an idea worth considering, according to a report by area television station WCCO.com, despite the fact he previously promised not to increase the tax during his second term in office.Doyle said he prefers to tax oil companies, instead of consumers, in order to fund road construction and deal with the $5 billion, two-year budget deficit, according to the report. Under his proposal, the oil companies would be prohibited from passing the tax onto consumers. However, convenience store retailers and others argue it wouldn’t survive a legal challenge.Wisconsin's gas tax is already among the top 10 in the nation at nearly 33 cents a gallon, and the federal gas tax adds another 18.4 cents.States looking at a gasoline tax increase plus cigarettes, beer, and fast foodIt looks like many states are raising their gasoline tax to balance their budgets. Also on the states agenda is a tax on cigarettes, beer, and fast food that are the foundation of the convenience and petroleum retailing industry.

Credit, debit cards ‘skimmed’ at Raceway station in Georgia; investigation underway A skimming device was recently recovered at a Raceway gas station in West Bibb, Ga., the Bibb County Sheriff’s Office said in a press release. The device is being held at the Atlanta Field Office of the U.S. Secret Service while the Sheriff's Office, Macon police, and the Secret Service conduct an investigation of cases in which debit and credit cards were skimmed in the Macon-Bibb County area, the Sheriff’s office said.Investigation results indicate that unknown suspects may have also used similar devices at one other Raceway location in the city of Macon as well as a Murphy USA location, according to the Sheriff’s office. All three locations have since been checked and were found to be free of skimming devices. The suspects have used the stolen account information to retrieve money from various accounts through bank branches located in the North Atlanta area, the Sheriff’s office said. The suspects were last seen in a late model black or dark blue Honda Odyssey mini van.Be sure to check your pumps for tampering and investigate anything suspicious. Debit Card Use Takes Over New York – In today’s economic climate, it appears that consumers are getting more conservative about their method of payment. Recent Visa information suggests that consumers are turning to debit to make purchases, therefore only spending what they know they have. The Wall Street Journal wrote yesterday that Visa Inc. reported the “the total dollar volume of purchases made using its branded debit cards surpassed credit card purchases for the first time during the last three months of 2008” and that the $206 billion debit card transactions in the U.S. that were processed by Visa were up 50.4% of the company’s total transaction volume that same time period, which is up from about 40% in 2003.

FinCEN Announces Launch of FinCEN Updates E-mail Subscription News ServiceThe Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.

FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security. Users can opt to have FinCEN Updates sent immediately, daily, weekly, or monthly to their e-mail accounts or directly to a wireless device.FinCEN selected the GovDelivery® E-Mail Subscription Management service to monitor designated website content and to send an e-mail to alert subscribers when there is new information posted on FinCEN’s public websites.
