PURSUANT to the provisions of Section 163AA of the RoadTraffic Act 1961, as amended, Road Traffic Act Regulation 10.08,and in accordance with the instrument of delegation from theMinister for Transport and Urban Planning I, T. N. Argent,Executive Director of Transport SA, exempt agricultural vehicles(tractors used for agricultural purposes; self propelled agriculturalmachines; and agricultural implements) from the provisions of:

Road Traffic Act:� Section 133�Warning Devices;� Section 137�Rear Vision Mirrors or Devices, and

Road Traffic Act Regulations:� 5.01 - Headlamps� 5.02 - Rear Lights� 5.03 - Reflectors� 5.04 - Clearance Lamps� 5.08 - Parking Lights� 5.12 - Stop Lamp Requirements� 7.03 - Mudguards on Vehicles

subject to the following conditions;

1. Headlamps, Rear Lights, Reflectors, Clearance Lamps,Parking Lights, and Stop Lamp Requirements.

1.1 The agricultural vehicle is not driven or used on publicroads between sunset and sunrise or during periods oflow visibility.

1.2 That only agricultural vehicles wider than 3.0 mmanufactured prior to 1 July 2001 are exempt from thefitting of Stop Lamps and are subject to conditions 1.1and 5 of this notice and the following conditions:

(a) Travel is not permitted in the Adelaide Metropolitanand Adelaide Hills areas as defined in the documenttitled �Operation of Agricultural Vehicles in SouthAustralia� dated September 1999.

(b) Speed on the open road does not exceed 40 km/h.

(c) Speed in towns does not exceed 25 km/h.

(d) The agricultural vehicle shall display a yellowrevolving flashing light or lights visible from allsides, fixed to the highest practical point on thevehicle.

(e) The agricultural vehicle shall be accompanied by apilot vehicle(s) in accordance with Table 5, �MajorRoads in SA Country� and Table 6 �Pilot Vehicles�of the document titled �Operation of AgriculturalVehicles in South Australia� dated September 1999.

2. Mudguards

2.1 The agricultural vehicle is not operated at a speedexceeding 40 km/h per hour unless mudguards arefitted.

3. Warning Devices

3.1 That if the agricultural vehicle was manufactured on orafter 1 July 1996 it must be fitted with a warningdevice.

4. Mirrors

4.1 That if the agricultural vehicle was manufactured on orafter 1 July 1996, it must be fitted with a rear visionmirror or mirrors giving a clear view to the sides andrear of the vehicle unless the primary use of theagricultural vehicle is under or in, or about trees orvines, or any other place which is too low, or toonarrow to work when the vehicle is fitted with mirrors.

5. All agricultural vehicles

5.1 Tractors used for agricultural purposes and selfpropelled agricultural machines are registered asrequired under Section 25, �Conditional Registration ofCertain Classes of Vehicles� of the Motor Vehicles Act1959.

The previous notice appearing in the South AustralianGovernment Gazette dated 11 September 1997, titled �Notice ofDispensation from the Regulations under the Road Traffic Act forthe Fitting of Lighting Equipment, Mudguards, Rear VisionMirrors and a Warning Device to Tractors used for AgriculturalPurposes, Self Propelled Agricultural Machines and AgriculturalImplements� is hereby revoked.

Adoption of BudgetThe Budget for that year as laid before the council at this

The most recent valuation of the Valuer-General available to thecouncil of the site value of land within the council�s area beadopted, totalling $57 383 380 for rateable land, and $2 950 320for non-rateable land.

Attribution of Land Uses1. The numbers indicated against the various categories of land

use prescribed by the Local Government (Land Use) Regulations1989 (the �regulations�) be used to designate land uses in theAssessment Book.

2. The use indicated by those numbers in respect of eachseparate assessment of land described in the Assessment Book onthis date be attributed to each such assessment respectively.

3. Reference in this resolution to land being of a certaincategory use means the use indicated by that category number inthe Regulations.

Declaration of RatesIn order to raise the amount as indicated above that is required

to be raised from rates the council pursuant to section 176 (1) (c)of the Act declares differential rates on the basis of locality andland use as follows:

1. (a) in the township of Sceale Bay, 0.9 cents in the dollarof the site value of rateable land;

(b) in the township of Baird Bay, 0.9 cents in the dollar ofthe site value of rateable land;

(c) in the township of Haslam, 0.9 cents in the dollar ofthe site value of rateable land;

(d) in the township of Wirrulla, 10 cents in the dollar ofthe site value of rateable land;

(e) in the township of Poochera, 10 cents in the dollar ofthe site value of rateable land;

(f) in the township of Cungena, 10 cents in the dollar ofthe site value of rateable land;

(g) in the township of Streaky Bay:(i) 2.25 cents in the dollar of the site value of

rateable land of categories 1, 8 and 9 use:(ii) 3 cents in the dollar of the site value of rateable

land of categories 2 to 6 use;(iii) 0.84 cents in the dollar of the site value of

rateable land of category 7 use;(h) in respect of holiday house zones as identified in

STEDS ChargesThe Septic Tank Effluent Disposal System charges applicable to

land benefiting from the Septic Tank Effluent Disposal Schemeswithin the township of Streaky Bay are as follows:

Stage 1(a) Scheme 3�$75 per unit(b) Scheme 4�$105 per unit(c) Scheme 5�$110 per unit

Stage 2$115 per unit

3. An additional annual charge of $39 for vacant allotmentsand $59 per unit for occupied allotments apply in respect of allland benefiting from both Stages of STEDS.

4. Unit being as set out in the document entitled�Determination of Service Charges�Septic Tank EffluentDisposal Schemes� issued by the STEDS Advisory Committeeand dated 1 September 1992.

PaymentAll rates be payable in a single instalment (unless otherwise

agreed with the Principal Ratepayer) by 1 November 1999,provided that in cases where the initial account requiring paymentof rates is not sent at least 60 days prior to this date, or anamended account is required to be sent, authority to fix the date bywhich rates must be paid in respect to those assessments affectedis hereby delegated to the District Clerk.

The District Clerk be authorised to enter into agreementspursuant to section 184 (6) of the Act with Principal Ratepayersfor the payment of rates in four instalments in any case where heconsiders it necessary or desirable to do so. That in respect ofapplications for Payment of Rates by instalments, a charge of 1%interest will apply on all amounts approved for payment byinstalment.

Written applications for instalments received prior to18 October 1999 will be approved on the basis of fourapproximately equal instalments payable by 1 November 1999,1 December 1999, 5 January 2000 and 7 February 2000.

In recognition of the current economic climate council will,pursuant to section 185 (1) (b) of the Local Government Act 1934,postpone payment of rates for ratepayers who produce writtenconfirmation of financial hardship, prior to 18 October 1999, froma rural counsellor. Such postponement will be until 7 February2000 and be on the condition that, if all rates are not paid by thisdate then the ratepayer will be liable for interest incurred since1 November 1999.
