Under section 9 of the Employment Standards Act, the Lieutenant-Governor in Council makes the following Regulation:

Citation

1 This regulation may be cited as the Minimum Wage Regulation -Employment Standards Act.

Application

2 This Regulation applies to every employee and employer inNew Brunswick.

Higher wage may be paid

3 The minimum wage fixed by this Regulation is a minimum wageonly, and a higher wage may be paid by an employer.

Maximum number of hours of work at minimum wage

4 The maximum number of hours of work for which the minimumwage fixed under section 5 shall be paid is 44 hours per week.

Minimum wage

5(1) Subject to subsection (3), the minimum wage is $6.20 per hour.

5(2) Wages paid to piece workers shall not be less that the minimumwage for the number of hours actually worked during a pay period.

5(3) The minimum wage for employees whose hours of work perweek are unverifiable and who are not strictly employed on a commis-sion basis is $272.80 per week.

En vertu de l’article 9 de la Loi sur les normes d’emploi, lelieutenant-gouverneur en conseil établit le règlement suivant :

1 Le présent règlement peut être cité sous le titre : Règlement sur lesalaire minimum – Loi sur les normes d’emploi.

Application

2 Le présent règlement s’applique à tous les salariés et employeursdu Nouveau-Brunswick.

Salaire plus élevé peut être versé

3 Le salaire minimum fixé par le présent règlement n’est qu’un sa-laire minimum et n’empêche pas le paiement d’un salaire plus élevépar l’employeur.

Nombre maximum d’heures de travail au salaire minimum

4 Le nombre maximum d’heures de travail pour lequel le salaire mi-nimum fixé en vertu de l’article 5 est versé est de quarante-quatre heu-res par semaine.

Salaire minimum

5(1) Sous réserve du paragraphe (3), le salaire minimum est de 6,20 $l’heure.

5(2) Le salaire versé pour le travail à la pièce ne peut être inférieur ausalaire minimum pour le nombre d’heures effectivement travaillées aucours d’une période de paye.

5(3) Le salaire minimum des salariés dont le nombre d’heures de tra-vail par semaine ne peut être vérifié et qui ne sont pas strictement ré-munérés à la commission est de 272,80 $ par semaine.

6 The minimum wage payable for time worked in excess of the max-imum number of hours of work established under section 4 is $9.30 perhour.

Board or lodging

7 No amount shall be deducted from the minimum wage by an em-ployer for board or lodging which was not furnished by the employerto the employee.

Repeal

8 New Brunswick Regulation 2002-15 under the EmploymentStandards Act is repealed.

Commencement

9 This regulation comes into force on January 1, 2004.
