Power of Association:Thethemeofthisyear’sannualreportis“PowerofAssociation”.Duringmyyears on the Board I have expandedmy knowledge well beyond the scopeof work my own company does andlearnedtovalueandappreciatethefullrangeofskillsandabilitiesourvariouscontractorsbring toourmembership.

Nothing has given greater satisfaction than participating in the“PowerofAssociation”inaffectingtheworkofourindustryandbeingabletoshapetheenvironmentinwhichourmemberscompeteandoperate.Itissometimestooeasytotakeforgrantedtheimpactandimportanceofthings likestandardpractices,contentandqualityoftraining,healthandsafetyissues,buildingcodesandallthevariousgoverninglegislationaffectingourbusiness.Asindividualswehavelittle,ifany,impactonchangingorcontrollingtheseareas.Asagroupforminganassociationoflike-mindedindividualsandworkingwithotherrelatedassociationsinoursameindustryourvoicescannotonlybeheardbutwillbelistenedto!

The Power of Association was demonstrated through the excellentwork of your Electrical Contractors Association of Ontario duringthelast12months.

Despite a continuing but relatively slow economic recovery in theprivate sector, we still generated over 19 million hours of work…the second highest ever. 2011 was a good year overall as a resultof continued spending by government, financial institutions andrenewableenergydevelopers.InspiteoftheregulatorywrangleoverTorontoHydro’s rateapplication,utilityworkalsogrewatarecordpaceastheformerPUCsbegansystemexpansionandreinforcement.Ibelieveour success in2011was alsodue, inpart, to theprogressmadebyECAOonclearingawayrealandartificialbarrierssothatwemightlegitimatelycompeteforbothnewandexpandedmarketshareopportunities.Onceevident,ourmembershavealwaysdemonstratedtheiracutebusinessacumen,andultimatesuccess,byrespondingandadaptingtovirtuallyall thebusinessopportunitieswithwhichtheymaybepresented.

Forexample,ECAOworkeddiligentlytoensurethenewmarketforphotovoltaicworkisrecognizedasapartoftheelectricaltrade.Whileothersdithered,ECAOdrovethenewlycreatednationaloccupationanalysis(NOA)forelectriciansdoingsolarinstallationsdevelopedbytheNationalElectricalTradeCouncilintoaCSApersonnelcertifica-tionwhichwaslaunchedthispastDecember.Thisisthefirstprogram

inCanadatoofferarealcertificationbasedonthetasksthatqualifiedjourneypersonconstructionelectriciansdoinapplyingtheirskillstotheinstallationandmaintenanceofsolarphotovoltaic(PV)systemsandclearlyallowsustodifferentiateourproductfromallothers.

Gettingworkopportunitiesishardenoughinourindustry,butgettingpaidinatimelyfashionisbecomingincreasinglydifficult.ThePowerofAssociationwasbroughttobearonthisissuebyworkingthroughtheCanadianElectricalContractorsAssociationand inpartnershipwithournational tradecontractor colleagues at theNationalTradeContractorsCoalitionofCanada(NTCCC).Togetherwedevelopeda template forPromptPaymentLegislationwhichwas sharedwithall otherprovinces and isnowat the centreof adialoguewith theOntario General Contractors Association (OGCA) where we aretryingtobuilda“madeinOntario”consensus.

ECAOrecommendedandreceivedseveralassociationrepresentativeappointmentsintothegovernancestructureofthenewOntarioCol-legeofTrades(OCOT).Wenowprepareforconsiderationofratioreviewof theConstructionandMaintenanceElectrician,DomesticandRuralElectricianandPowerlineTechniciantradeslikelytooccurin late2012.ECAOwill alsoadvanceour request throughOCOTforcompulsorycertificationofourPowerlineTechniciantradeatourearliestopportunity.ECAOhasestablishedabroad-basedcoalitionofstakeholderstomoveforwardonthischallenge.Thisdiversegroupismadeupoftradeassociations,safetyassociations,unions,contractors(bothunionandnon-union),andutilities.Whilemanyplayersmayhavecompeting interestsatother times, in thiscommittee theyareunifiedingettingthingsdone.HereagainisthePowerofAssociationatwork.

ThePower ofAssociation also translates intoPurchasingPower. Inaddition to the traditional bulk buying services, ECAO’s memberadvantage catalogue contains two very important and valuableworkplace safety services. The Quality Connection occupationalhealthandsafetyprogramisavailablefreetomembers.Theonlycostbeingyoureffortsinimplementingtheprogramandveryreasonableauditfees,ifyouoptforthatservice.SecondisTeksMed,ourWSIBclaims management service which provides all members with theclaimsmanagementandreturntoworkcapabilitiesneededtocontrolcompensation costs and overhead. 2011 saw ECAO andTeksMed

enterintoa3-yeargrouppurchaseagreement.Aswordspreadsaboutthisservice,ECAOexpectstobuilduponthe110orsoparticipatingemployerswhoarecurrentlyenrolled.

Notallthingswhichhappeninassociationlandarepositive,buthowyoureacttothosechallengeshadbetterbeifyouintendtobesuccess-fulasanorganization.Onethingdeartomyheartislabourrelationsand specifically labour relations affecting the Power LineTrade. Aseries of Labour Board cases involving line contractors specializinginsubstationconstructionhasupsetthestatusquoofinside/outsidejurisdiction within the IBEW and may force some contractors tochangetheirtraditionalbusinessmodel.Recognizingthisandotherlanguageissueswhichhavegrownoverthepastthreeagreementsorso,theElectricalTradeBargainingAgency(ETBA)andtheIBEWhavebeguntoexploreveryearlytalksthisyearinthehopesofclearingawaythebacklogoflanguageissueswellaheadof2013province-widenego-tiations.MoreaboutthisinErylRoberts’reportlaterinthisvolume.

Strategic Plan:WecertainlyoweaverylargethankyoutoPastPresidentJohnRaepplefortheexcellentworkhedidalongwithourECAareadirectorsandlabour relations reps inputting together thenewStrategicPlan forECAOcovering2011through2016. ThisplanwaspresentedandapprovedbythemembershipatourlastAnnualGeneralMeetingheldJune16inToronto.

Withavisiontobe“theChampionofManagementinterestsintheelectricalcontractingindustryinOntario”andamissiontorepresentthose management interests in labour, industry, government andpublicrelations;weembarkonourmostambitiousplanningperiodsofar.WewilldomoreandbetterresearchtogiveourmembersbettertoolstomakedecisionsonMarketShare,GreenConstruction,SafetyandProductivityImprovements.Wewilldobetteratcommunicat-ingthisinformationtoyouonatimelierbasis.We’llreorganizeandrevitalize our ECAs, address training, mobility and market shareissues,takeactionstomakesureyougetpaidonatimelierbasisandnegotiateforyourinterestsinanewCollectiveBargainingAgreement.We will strive to make your membership in ECAO a most valuedasset!PleasetakethetimetolookattheStrategicPlandetailsinthechartsaboveandonthemembers’sectionoftheECAOwebsite.ThisisthePowerofAssociationinaction!

AtECAOwewillalwaysrespectandhonourthosewhotrulygivePowertoAssociations.Thankyou.

Projects,programs,lobbyefforts,seminarsandtraininginitiativeshaveallbeenintendedtohelpincreaseourskills,improveourabilitiestocompete,andbroadenelectrical involvements sowecanexpand the rangeofworkwearequalifiedtodo.

As you have read in other parts ofthis report, ECAO has a new visionas the “Champion” of management’sinterests. The word champion hasmanymeanings.Inourcasewemeandefenderorrepresentative.Historicallyawell-armedindividualororganizationwould be asked to champion or bestrepresenttheinterestsofothersastheybattledandcompetedonthe joustingfields.Perhapstodaythejoustingfieldshave been replaced by Queen’s Park,

courts and tribunals, bargaining tables or other similar venues, buttheneedforskilledandqualifiedchampionstorepresentthebroaderinterestremainslittlechanged.

ECAO counts on about 100 member firms who are always thereworking on behalf of the entire membership. Along with staff andcounseltheyformaverywellskilledandknowledgeableforcewhenitcomestorepresentingmanagementissuesaffectingelectricalcontract-orsinthisProvince.Soitseemsonlylogicalthatwhentheyputthestrategicplantogetherthisconceptofchampionshipwouldcometothefore.

2011, as you have just read, was a successful year for both ECAOanditsmembersbutstrategicplansarealreadyinplacetotackleevenmoreissuesintheyearsahead…andthat’swhatIwanttoconcentrateonhere.

Collective bargainingIt’stimetobegintobargainanewPrincipalAgreement.TheElectricalTradeBargainingAgency(ETBA)recognizesthattherehasbeentoolittle heed given to language negotiations under the No Strike/NoLockoutprotocol(JointProposal)inthelastthreebargainingrounds.Toomuchtimeandmoneyhasbeenspentbybothsides“negotiating”attheOntarioLabourRelationsBoardthroughgrievances,andnotenoughtimespentinface-to-facedialogueaboutissues.In2012theETBA will attempt to engage the IBEW in mid-term negotiationsfocused on modernizing and clarifying the Principal Agreement,includingaccommodatingthevariousLabourBoarddecisionswhichhavecomedowninthelastfewyears.Nottheleastofourchallenges

in that respect is the resolution of inside/outside jurisdictional dis-putes which have proved factional and damaging for both labourandmanagement.

Thedualobjective is todealwith language issuesnow,clearingthedecksforastraightforwardrenewaloftheJointProposalatyearendforthemonetarysideofthings.

Ontario College of Trades (OCOT)ECAO supports the recommendation of the Drummond Reportwhereby he urges the government to turn over complete respon-sibility for all aspects of apprenticeship to OCOT and not retainanythingattheMinistryofTrainingCollegesandUniversities.Thischangewouldallowforcompleteself-regulationbyourindustryforourindustry.

While ECAO was not particularly happy with OCOT’s recentappointments to the Roster of Adjudicators and expressed thoseconcernstoboththeAppointmentsCouncilandadministration,wecontinuetobelieveinandwillsupporttheoveralleffortsofOCOTgiving greater direct voice to our industry in matters affecting ourtrades’skillsdevelopment.

Among the issues of concern to ECAO is the ratio review to beconductedbytheOntarioCollegeofTrades.Theratioreviewforelec-tricaltradestakesplaceinlate2012.Thiswillbethefirstopportunityforanindustry-drivenconsiderationoftheapprenticeshipratiothatisappropriateforeachtradegivenitsspecificcircumstances.Weareworking toachieveaconsensuswith the IBEWandother industryplayersabouthowtogettotherightanswer.Profitsfromfrontendloadedapprenticeshipgrantsandthedeterminationbysometolowerlabourcoststhroughratiomanipulationareunspokenagendascom-plicatingoureffortsinthisregard.TheelectricalreviewwillbeasterntestoftheOCOT’sabilitytosticktothecriteria,ignorethepoliticsandbemindfulofhiddenagendas.

Also very high on the ECAO/OCOT agenda is an application totheCollege ofTrades for compulsory status for the tradeofPowerLineTechnician.ECAOhasalreadydeterminedtoleadtheindustrycoalitiontoachievethisobjective.Wehavealreadystruckandheldmeetings with a representative committee of stakeholders to both

considerourpositionandmake representation toOCOToncom-pulsorycertification.

Prompt Payment and Tendering PracticesThenew stand-aloneStandardPracticesCommittee formedby theStrategicPlan ischampioning thecase forpromptpayment legisla-tion.WeareworkingwiththeOGCAandagroupofOntariotradecontractor associations to develop a consensus draft based on thetemplate originally developed by the National Trade ContractorsCoalitionofCanada.SinceSeptember2011,wehavebeenthroughmanyiterationsofthedocument,andwitheachrevisionitbecomesmore inclusive.The objective is to achieve industry consensus andmoveforwardbeforetheLegislaturebreaksforthesummer.Thisisaveryambitiousschedule,butthereisasenseofdeterminationaroundthisprojectthatmotivateseveryonetosucceed.

Another forward looking item on the Standard Practices agendais tendering. ECAO went ahead and became a major sponsor of“ProcurementDay” conceived andpromotedbyOGCA.Asof thewritingofthisreporttheeventisyettotakeplace,butECAOwillberepresentedby7-10membersputtingforwardtheECAOpositionsonthecurrentbiddingprocess.

Codes and Standards – Solar PvTheCodesandStandardsCommitteeischampioningour‘whatwethinkisright’positionondefiningsolarrulesforsolarphotovoltaicwork.Wegotanearlylegupinthisemergingmarketbyrealizingtheneedforeffectiveinstallationstandardstopromotebothworkersafetyandconsumerprotection.In2012ECAOisrollingoutitscontractorsolar certification program. By the time this report is published inmid-yearwehopetohavetrainedandcertifiedallkeyon-siteperson-nelofECAOcontractorsperformingsolarPVinstallations.

electrical utility SectorIn2012theOntarioEnergyBoardwillre-writethepolicyframeworkforsettingrateschargedbyelectricalutilities.ECAOistheonlystake-holderadvocatingtheneedtoactuallyverifycostsbycomparingcoststomarketvalue.Theprimarymechanismforthisiscontractingoutandtenderingforbothcapitalconstructionandoperationalsupport.OntarioEnergyBoardrecognizes thatcontractingoutwill improveefficienciesandourchallengeistogetthemtoincludeincentivesinthe rate setting formula that rewards thoseutilitieswhichuse con-tractorservices.

Inreturnweexpectmoreopportunitiesforourmemberstobidandperformthiswork.Weareconfidentenoughintheseeffortsthatwearebeefinguptherelatedtrainingfundsothatwewillhavethefundsavailabletoensurewecantrainevenmoretradespersonstobeabletoperformaneverincreasingamountofthisworkinthefuture.

eCA ConsolidationWeremainfirminourcommitmenttorestructuringandrevitalizingourECAnetworkbymergingsomeareastogetherwhilecontinuingtoensureeffectiveregionalrepresentation.FewerbutstrongerECAsallowforimprovedefficiencies,morefocusedbusinessplanningandbetterrepresentation.

Unfortunately, the impetus has been stalled due to the protractedOLRBcasecausedwhenIBEWorderedthemergerofLocalUnions353,1739and894.Wearehopefulthatthematterwillberesolvedin2012andhaveretainedcounseltohelpredrafttheECAOandtheETBA bylaws to conform to the eventual decision.What we learnin implementing the decision, whatever it may be, will become atemplateinadvancingthisobjectiveinotherareas.

Conclusion and ThanksECAOisabletobeaneffectivechampionbecauseweworkhardatattracting volunteer participation from amongst our very capablemembership, armthemwith the resources toget the jobdoneandtakeonmeaningfulobjectives,positivelyandwithintegrity.Weneveraskthemtotiltatwindmills.The100areeasytorecognize.YouwillfindthemonourECAOcommitteelistsonthewebsite,representingyouonESAcommitteesandonOCOT,aswellasservingonlocalboardsandapprenticeshipcommittees.Iaskyoutothankthemwhenyou see them at ECA functions, but this year why don’t you alsoconsiderjoiningthem?

One was called “Niche Aging”and principally focused on niche communities where choosy BabyBoomerscangrowoldalongsideotherBoomerswhoshareaspecificinterest.Wehavehadadultgolfcommunitiesforyears,butnowtheyare adding country music themed developments and communitiescateringtodifferentethnicgroups.Onedeveloper isbuildingcom-munities in university towns, because the Boomers want to keeplearningandtakingcourses.Thesecommunitiesarebeingdriven,inpart,becauseboomersarestayinghealthierandactivelongerandwantand need things to do. And they have the money to do it as theycontrol70percentofthewealthinNorthAmerica.

WhatdoesallofthismeanforbusinessownerswhoareputtingoffSuccessionPlanningbecausetheythinkitisthebeginningoftheend(andthestartofwatching-the-world-go-byintheirrockers)?

Untilrecently,theownerswhosoldtheirbusinesscouldnotenvisionmuchofalifeforthemselves,astheyhadbeenconsumedbythebusi-ness.Indeed,theyhadidentifiedthemselvesbywhattheydid,ratherthanwhotheywere.Wearenowseeingthat,evenwiththeexampleabove,oncethebusinessissoldtheownercan(inmostcases)begintoenjoythelastquarteroftheirlives,possiblydoingwhattheyalwayswanted todo,but forwhichheor shedidnotpreviouslyhave thetimeormoney.

If the developers are seeing the opportunity of developing specificcommunitiesforactiveBoomers,itwouldbesmartformanybusiness

ownerstogetonthebandwagonandbegintothinkabouttakingthenext steps towards the successful exit of their business so they canenjoytheirwealthandhealthinnewanddifferentways.

Ibelievethatasignificantmind-setshift,orparadigmshift,isrequiredformostbusinessowners.Yes,havingcontrol,makingallofthedeci-sionsisgreat;however,thereareanumberofkeydecisionsthathavetobemadeasanownerpreparestheirbusinessforsaleandthereisnotimelikethepresenttostartaskingandansweringthesequestions.

Theprocesscancertainlybedifficultandfullofconflict.Weoftenhearownerssay“Wheredowestartthisprocessofsuccessionplan-ning?”Thereare,however, somegoodmethodologies thatcanhelpdeveloparoadmapforthecreationofasolidblueprintforsuccession,whichcanmaketheprocessmorepalatabletobusinessowners.

Asyoureadthisarticleandbegintoreflectonthepotentialahead–ratherthanleavingthepastbehind–youshouldstarttoseethatitisagoodpracticetostartandfinishthesuccessionplan,asitallowsyoutimetoachieveyourpotentialinsomenewanddifferentareas.

Hereisoneclosingthought:Thereareover7.4millionBabyBoomersinCanadatoday.Thosethatwillneedtoselltheirbusinesstoreleasetheirwealthshouldstartplanningtoday,astherearegoingtobelotsofbusinesses for salebut fewer and fewerbuyers as thepopulationages.Thebusinessesthatwillstandoutandwillsellforthehighestpricewillbethosewherethere isagoodplan inplace.There isnotimelikethepresent!

IntroductionOSHA accumulates statistics and releases areporteachyear.Thisreportshowsaccidentsand injuries ranked by type and ranked bycause. So you may have heard a safety talkbasedonthatreport.

This safety talk isn’t about specific kindsofaccidents or injuries. Instead, it’s about fivedangersthatleadtothosekindsofaccidents.You’ll notice the items being discussedaddress yourgeneral approach towork,notspecificallyhowyouusealadderorwhentotestaGFCI.

Manypeople think that addressingphysicalhazards on the site should be the goal of agoodsafetyprogram.Butmostinjuriesoccuras a result of unsafe acts, and those actsoccuras a resultofdangerousattitudesandpractices.

Five dangers people don’t think about1. Failing to verify. Following lockout/

tagoutproceduresdoesnotautomaticallyensure a circuit is de-energized. Alwaysverifywithameter.

2. Lackofalertness.Ittakesonlyasecondofinattentiontoresultindisaster.

3. Rushing.When you get in a hurry, youmake mistakes. These can include any-thingfromnotproperlysecuringaladdertousingatoolinadangerousway.

4. Failingtocommunicate.Communicationis a two-way street. You need to listencarefully to your foreman when he orshe is going over the job and the safety

requirements. Your foreman also needsto listen to you. Ask questions and getanswers.Donotguess.

5. Failing to follow safety instructions.Product labels, MSDS, posted signs,checklists, and work procedures all con-tain safety instructions. Many reportedinjuries would not have happened ifpeople had read, understood, and fol-lowedtheinstructionsinthesesourcesofinformation.

DemonstrationArguablythemostpreventableOSHAeventis shock on a circuit that is assumed to bede-energized.Usingyourprops,haveatleastonecrewmemberdemonstrateverifyingthecircuitisde-energized.Discusswiththecrewwhat tocheckandwhy.AlsobrieflydiscussusingthecorrecttestequipmentandPPEforthevoltageofthatequipment.

Fromelectricalpowerbarstoholidaylights,circuit breakers to light bulbs, if it can bepurchased legally at themanufacturer’s sug-gestedretailprice,itcanbecounterfeitedandsoldtounsuspectingconsumersatafractionof the cost. Not surprisingly, that reducedpricecancomeat theexpenseof importantsafetycomponents.

Compounding the problem, counterfeitersevencopytheproprietarycertificationmarksof testing and certification organizationslike CSA Group to give their products agreater appearance of legitimacy. Fooledconsumersbelievetheyarebuyinglegitimateproductswithauthenticcertificationmarks,leadingthemtobelievetheitemshavebeentested to the requirements of applicablesafetystandards.

Dangerous and DeadlyTheconsequencesofproductcounterfeitingcanbebothdangerousanddeadly.Counter-feitcircuitbreakerswerefoundinuseintheindustrialelectricalpanelatonehospital.Thecircuitbreakerswerecompletelyincapableofhandlingtherequiredload.

CSAGroup is currently investigating suspi-ciousaftermarketelectricalcomponentsthatwere recently found at a national hardwareretailer in Canada, and recently workedwith the Royal Canadian Mounted Police(RCMP)investigatingtheseizureofcounter-feitprescriptionpillbottles.

In the fall of 2011, CSA Group wasanonymously notified that electric seasonalholiday decorations destined for a majorretail chain in Ontario, Canada, were mis-sing proper certification marks and werepotentially counterfeit. CSA worked withlaw enforcement officials and the importerto have the container quarantined untilthe items could be inspected. Subsequentinvestigations proved the suspicions to becorrect: the products bore counterfeit CSAregistered trademarks, cautionary labelingandpackaging.Intheend,theproductsdidnotreachtheconsumerandwerethesubjectofaCSASafetyAlert–atwww.csagroup.org/product_recalls/

CSA also took an active lead in a Quebecinvestigation that resulted in the deliberatedestructionofalargenumberofcounterfeitelectricalandconduitboxesbearingtheCSAcertificationmark.

Protecting the supply chainMany North American manufacturers haveexported the production and assembly oftheirproductstodifferentpartsoftheworldto maximize profits. Consequently, they

grapple with long, complex supply chainswhich can often be difficult to audit. Theproductsthemselvesarealsobecomingmorecomplicated as manufacturers combinecomponentsandservicesfrommultiplesup-pliersandmultiplejurisdictions.Asaresult,products as a whole and their individualcomponentsareatriskofhavingcounterfeit-ersbreachtheintegrityofthesupplychain.

Protecting supply chain integrity is of theutmostimportanceformanufacturerswhosereputations are at stake.To effectively safe-guardagainstcounterfeiting,thereareseveralsteps that manufacturers can take at eachpointintheirproductionprocess.

To combat the proliferation of counterfeitproducts,membersofthesupplychainmustcollaborate to institute a better componenttracking system. A rigorous internal qualitystandard based on an inspection programof all incoming parts can help to keep thesupplychainclean.

Itisimportanttodocumentdates,lotcodes,and photograph all products to maximizetraceability if a product is found to becounterfeitorsub-standard.

Manufacturers should also performdue diligence when working with newcomponentsuppliers.

Establishingasystemofchecksandbalancesthroughoutthesupplychaincanhelpmanu-facturers detect counterfeit components.Frequentandrandomtestingandretestingofproductsampleswillaidinexposingcounter-feitcomponents.Inaddition,internalqualityassurance inspectors should be encouragedto act as whistle-blowers if they spotsomethingsuspicious.

Providing Localized servicesAsmanufacturingcontinuestogrowabroad,many certification and product evaluationorganizations, including CSA Group, areestablishing laboratories around the worldto provide localized services. This globalnetwork approach shortens testing andcertificationtimessinceproductsdon’thaveto be verified in North America. It alsohelps to identifypotentialproblems sooner,enablingcertifiedproductstobeintroducedtothemarketinatimelymanner—acrucialconsiderationformanufacturerstryingtogetaheadofthecompetition.

Thetrendtowardsoutsourcingmanufactur-ingbyWesternindustriestoAsiahasenabledcounterfeiters in those countries to quicklylearn and easily copy designs and advancedproduction techniques. Foreign regulatorsand enforcement agencies have often beenoverwhelmed in enforcing intellectualpropertystatuteswhilecorruptionatthelawenforcement levelcanbeaprobleminvari-ousregions.

Consumers,retailersandmanufacturersneedtobeconcernedwithcounterfeit items thatenter the market, and also be aware of thewidespread use of counterfeit certificationmarks.Counterfeitersknowthatinordertopass their products off as legitimate goodsa certification mark is necessary to gainmarketentry.

Counterfeit marks undermine the entireglobalsystemofstandards,testingandcertifi-cationthathavebeenputinplacetoprotectthe interest of retailers, regulators, productmanufacturers and, most importantly, con-sumers.Theyalsopresentarealdangertothepublicascounterfeitersoftenusesubstandardmaterialsorbypasssafetyfeaturesinordertomakeaprofit.If leftunchecked,counterfeitcertificationmarkscanenableunsafeordefi-cient products to gain widespread access totheNorthAmericanmarket—adirectsafetyrisktoconsumers.

“Counterfeiters can no longer be dismissedas con artists, or isolated street peddlerstryingtoearnafewdollars,”saidRJFalconi,executivevicepresident,generalcounselandcorporate secretary of CSA Group. “Theyare criminals, as surely as those who wouldsteal your identity because they are stealingthe identities and valuable brand names of

responsiblemanufacturers,aswellastheCSAcertificationmark.

“At CSA, we have a zero tolerance policywhenitcomestotheunauthorizeduseofourmark,whichisultimatelyourmostvaluableasset.Ifwefinditonproductsthathavenotearned it, we will confiscate it and we willdestroyit.Itisthatimportanttous.”

covert security FeaturesMany legitimate certification marks usecovert security features to help preventunauthorizedduplication.Butraisingaware-ness about the risk of counterfeit productsandeducatingconsumersabouttheprocessesneeded to identify legitimate certificationmarksisalsocritical.

Globally, manufacturers, retailers, lawenforcement and regulators must workcooperativelytoensuremessagesaredeliveredandconsumersareprotected.

Theundergroundnatureofproductcounter-feitingmeanswewilllikelyneverunderstandthe true economic impact of counterfeitingon the economy. Investigative agenciesincludingtheU.S.DepartmentofHomelandSecurity,theFederalBureauofInvestigation(FBI) and international police services suchas INTERPOL estimate the impact to behundreds of billions of dollars annually. In2011alone,U.S.Customsseizedmorethan$10 million worth of electrical productsillegallybearingtheCSAcertificationmark.

Inaddition,therearecosts totheeconomy,includingthelossofsalesrevenue,taxesandjobsduetodecliningsalesoflegitimateprod-ucts.Counterfeitproducts also compromisebrand integrity and consumer confidence,and increase the risk of legal action andunfavorablepublicitytostakeholders.

Ata2008summitatINTERPOLheadquar-tersinLyon,France,11oftheworld’slead-ing certification peer organizations joinedtogether to form the Certification IndustryAnti-Counterfeiting Coalition.The summitservedasthecornerstonetolaunchOperationOvershock,anongoingglobaloperationthatis targeting products bearing counterfeitcertification marks.The operation involvedinternationalpoliceandcustomsagenciesinpartnership with certification bodies fromaroundtheworld.

The CCPSA adopts modern tools and tech-niques that strengthen protection and bringCanada’sconsumerproductsafetysystemintolinewithkeytradingpartnersglobally.

Thenewlawappliestoawidevarietyofcon-sumerproductsincludinghouseholdproducts,sportinggoodsandchildren’stoys,butexcludesproductslikemotorvehiclesandtheirintegralparts, food, drugs (including natural healthproducts)andanimalsastheseareregulatedbyotherCanadianlaws.

“WearedelightedthatthisactisgivingCanadasomeofthestrongestconsumerproductsafetylegislation in theworld,” saidSuzanneKiraly,executive vice-president, Global BusinessStrategy & Government Relations for CSAGroup.“CSAGrouphasbeenanactivepartnerinraisingawarenessofunsafe,uncertifiedandcounterfeit products in the Canadian andglobal marketplace.” Both domestically andinternationally, CSA Group actively attemptstostemtheflowofcounterfeitproducts.

The event was co-hosted byINTERPOLandEuropol,inpartnershipwithUnderwritersLaboratories.

Significantly lower pricing: if it seemstoogood tobe true, it probably is.Comparepricingofsimilarproducts,aswellaswarrantyandcertificationmarks.

Cheap production: check and compare the“lookandfeel”ofgoods.Fakesareoftenlightandtooflimsy.

Look for the mark:asystemofstandardshasbeenputinplacetotestandcertifyproducts.Avoid electrical, mechanical, plumbing, gasor other standardized products if a certifica-tion mark from a recognized certificationorganization ismissing.Take ituponyourselftoensurethatyoupurchaseacertifiedproduct,everytime.

Poor spelling: look formisspellings andun-clear printing on packaging, products, labels,orinstructions.

Inferior packaging: packagingofcounterfeitgoods often has poor design or shows onlypartialillustrations.

Missing items: check for a discrepancybetween the contents of the package and theitem’sdescriptionon theoutsideof thepack-age,aswellasformissingproductinformation.

Know your retailer: if in doubt, buy onlyfromreputable,well-knownstores.

Give with a conscience: before wrappinga gift for your special someone, make sure itdisplays any applicable certification marks.Also check for hazards such as loose parts orpoorconstruction.

tThe Electrical Contractors Association of Ontario and the Inter-nationalBrotherhoodofElectricalWorkersmadeabigsplashatthe2011CanadianSolarIndustryAssociation(CanSIA)ConferenceandTradeShow.TheECAOandIBEWnotonlyhadoneofthemosteye-catching booths on the trade floor, we also stole the show onTuesday,December6withourpressconferencepromotingtheCSAStandards&NationalElectricalTradesCouncil(NETCO)personnelcertificationprogramforSolarPV.

The solar PV industry has exploded in Ontario as a result of thegovernment’sintroductionoftheGreen Energy ActandthegenesisoftheFeed-in-Tariff(FIT)program.CanSIAisaprimeexampleofthisgrowthastheconferencehasgrownfroma‘kitchentable’gatheringtooneofthelargestconventionsandtradeshowsinCanada.

“Personhoursofemploymentareupsignificantlyfromlastyear,”saidJohnGrimshaw,ExecutiveSecretary-TreasureroftheIBEWConstruc-tionCouncilofOntario.“ECAOcontractorshaveundertakenmanydifferentSolarPVinstallationsacrosstheprovincefrommicro-fittohugesolarfarms.OurpresenceatCanSIAletsusshowmanufacturers

There were several highlights of the trade show from the ECAO/IBEWperspective.Asmentionedintheintroduction,apressconfer-encewasheldtoraise theprofileof theCSAendorsedcertificationprogram.Atthistime,the“firstclass”toreceivetheircertificationswereintroduced.ThisgroupconsistedofLeeCaprio(Toronto),DaveCribb(Ottawa),RudyLenneau(Kingston),PeterOlders(OEIT)andArthur Verway (Toronto). All received their certificates from theECAO’sErylRoberts,IBEWInternationalVicePresidentforthe1stDistrict,PhilFlemmingandRezaMoridi,MPP,RichmondHillandtheParliamentaryAssistanttotheMinisterofEnergy.Inhisremarks,Mr.Flemming congratulated theECAOand IBEW for “being thefirstinOntariotohaveitsSolarPVtrainingcurriculumrecognizedbyCSA.”

During the ceremony, Eryl Roberts noted the motivation fordeveloping the training standard. “The Construction Electrician(NOC 7241) Solar Photovoltaic Systems Certified PersonnelCertificationprogramwasdrivenby theassertion thatallSolarPVinstallations should be done by qualified electricians working forlicensedcontractors.”

Anotherhighlightof the trade showwas theattentiongiven to theECAO/IBEW booth by politicians. In addition to Mr. Moridi’sinvolvementinthepressconference,boththeMinisterofEnergy,TheHon.ChrisBentleyandtheMinisterofInfrastructure,theHon.BobChiarellimadeextendedvisits.Intouringthebooth,MinisterBent-leynotedthequalityandsafetythatarethehallmarksoftheECAO/IBEW partnership. “Thanks for all the work that you have done.Thanks for ensuring that people can involve themselves in greenenergysafely.Thatisthekey.”ThesecommentsarehighpraisefromMr.BentleyashepreviouslyservedasOntario’sMinisterofLabour.

Agreatdealofhardworkwentintogettingtheboothready,meetingthetradeshowattendeesandinpullingoffthepressconference.Abigthankyoutoallwhoattendedandspenttimeinthebooth.Greenenergyopportunitiesshouldcontinuetogrowasaresultoftherecentelectionoutcomeandthegovernment’scommitmenttogetOntariooffofcoal.BeingpresentatanimportanteventlikeCanSIAwillhelpprovideopportunitiesforourcontractorsandIBEWmemberstofindworkinthisimportantsectoroftheelectricalindustry.
