That is something sorely needed here in San Diego, so I started attending Voice of San Diego "community coffees" early on during my AGC tenure. The goal of the gatherings is to bring to the surface the major issues facing San Diego - I thought my background on public policy would be welcomed. Well, just like any investigative body, the selection of targets introduces bias just as much as how the search for facts is conducted. In the case of VOSD, the gatherings were attended by a small cross section of the community, mostly with an anti-business axe to grind. After a few interactions with reporters on issues since, I have come to realize that they will write to their audience bias, and the facts be damned. Late last year, VOSD wrote an article on a school Bond Oversight Committee member's potential conflict of interest. Those following the issue were excited that they finally stumbled on the massive, barely discussed scandal here in San Diego - a powerful political interest group directing over $6 billion of public funding to their own pockets. It turns out, they were just going after a business association, not it's affiliation with organized labor, per their "Community Coffees" biases. Well, that article seems to have struck too close to home. When AGC staff members met with VOSD last month, the "reporters" admitted to getting push back from Labor Unions on their story, and they seemed out to do a "make up" story; it was pretty clear by their questions they had the story written before they walked in the door! Organized labors' takeover of school boards for the sole purpose of directing construction funds to union coffers is a huge scandal. It raises costs of construction, and denies students new and upgraded facilities as voted on by the taxpayers; including air conditioned schools in San Diego Unified - an issue VOSD thankfully HAS covered. Even worse, the expensive union takeover of school funding will make it harder to convince taxpayers to authorize future tax dollars to build 21st century schools. If VOSD really wants a story, it would do well to focus less on oversight committees that act as watchdogs for the public. Instead, pay some attention to the decision making bodies that have ignored their very own oversight committees to go against the will of the voting public, while having an actual

(not imagined) conflict of interest. There is still hope VOSD can become a truly non-biased investigative outfit,and not just another left-of-center news and opinion blog.

AGC represents over 1,100 union and non-union firms that support fair andopen competition in construction.

A Clear Definition of "Infrastructure" a Must for Passage ofProposed City of San Diego Ballot MeasureBy Brad Barnum, Executive Vice President It may be hard to believe, but the passage of a proposed ballot measure bySan Diego City Council Member Mark Kersey that would dedicate funding tohelp pay for needed infrastructure projects in the City of San Diego may hingeon the actual definition of "infrastructure."

Last Tuesday, the City Council voted 8-1 to have City Attorney Jan Goldsmithdraft the ballot language. There was quite a bit of discussion about the lengthof time of some of the funding mechanisms; however, an interesting stickingpoint could be the actual projects to be funded.

Before we go any further, let's look at the Wikipedia definition of"infrastructure": The fundamental facilities and systems serving a country, city,or area, including the services and facilities necessary for its economy tofunction. It typically characterizes technical structures such as roads, bridges,tunnels, water supply, sewers, electrical grids, telecommunications, and soforth.

Council Member Kersey's proposal will direct approximately $5 billion over thenext 30 years from three revenue sources to capital and maintenance costsassociated with neighborhood infrastructure, including streets, sidewalks,storm drains, park and recreation facilities, libraries, and police and firestations. These projects appear to be in line with the above definition ofinfrastructure; however, comments made at City Council reveal someinteresting twists:

Independent Budget Analyst (IBA): Besides for construction, funds canbe used for initial furnishings, equipment software, supplies,inventory...and for the costs of management and maintenance,including personnel, software, facilities, equipment, and related costs.

City Attorney Jan Goldsmith: Definition of "infrastructure" is important. The IBA definition is very broad, and it is not clear that it even coversstreets and sidewalks. The intent of the proposal needs to be clear, anda narrow and specific definition needs to be crafted.

San Diego Regional Chamber of Commerce, Building Owners andManagers Association, and National Association of Industrial and OfficeProperties: Prioritize infrastructure that supports affordable housing.

Affirmed Housing, and San Diego Housing Federation: Includeaffordable housing in the ballot measure.

Circulate San Diego: Set aside 20% to fund affordable housing, andensure transit, walking, and biking projects are adequately funded.

While all agree infrastructure improvements are needed, the question toponder is whether or not affordable housing is considered a "fundamentalfacility" as defined in Wikipedia?

Investing in the region's infrastructure is a high priority for AGC, and we whole-heartedly agree that it must be clear where project funding is directed. Recentexperience with school districts using bond funds to repair a washer and dryer,replace a water heater, or purchase Ipads was not what voters intended whenthey passed school construction bonds. We hope the City Council doesn't godown a similar road.

Council Member Kersey, we applaud your efforts to keep this issue in theforefront, and look forward to participating in any future stakeholder meetings. In the end, we hope the definition of "infrastructure" doesn't become too broadthat it will threaten the proposed ballot measure at City Hall or at the ballot box.

AGC's Liaison Committee Meetings Get Underway thisMonthBy Brad Barnum, Executive Vice President We wanted to remind you about a critical tool for public works contractors, theAGC's Industry Relations Committees. These "liaison" committees allow for anopen and continuing dialogue between contractors, subcontractors, materialsuppliers, and public agencies. This results in successful construction projects,which utilize public tax dollars in the most efficient and effective mannerpossible. AGC routinely meets with the City and County of San Diego, Port District,Airport Authority, Caltrans/SANDAG, San Diego Water Authority, andNAVFAC. With the continued financial constraints at the state and federallevels flowing down to some of these agencies, it may be a good time for youto get involved! It should be noted that although the Public Building Committee doesn't pertainto one specific agency, it does focus on public building projects. Thecommittee often meets with representatives of local school districts to reviewconstruction bond programs, and at the February 3 meeting they will be joinedby representatives from California's Coalition for Adequate School Housing, todiscuss legislative issues and a potential statewide school bond measure. Consensus Docs Seminar February 17th

Consensus Docs were developed with the collaboration of more than 40industry groups, with heavy involvement by AGC of America, and provide over100 industry-accepted standard contracts. These documents better allocaterisk in contracts, allowing for mutually beneficial outcomes for owners andcontractors. The potential cost savings are so great, Brian Perlberg is flying out fromD.C. to give a presentation on the topic. Brian is the AGC of AmericaSenior Counsel for Construction Law and Contracts and is the authority onConsensus Docs. AGC San Diego staff will be reaching out to owners and industry partners toattend, but first contractor support is needed. You can do that by signingup for the Consensus Doc luncheon. Everyone related to the construction process has incentive to get the projectdone faster and at a lower cost - from the project owners who want to seetangible results for their investment, to the contractors and designers who wantto do their job well and move on to the next project.

What is Lean? Lean Construction is based on the holistic pursuit of continuousimprovements aimed at minimizing costs and maximizing value on aconstruction project: planning, design, construction, activation, operations,maintenance, salvaging, and recycling.

In November 2015, AGC announced that the first group of 51 participants hadbeen awarded the Certificate of Management-Lean Construction (CM-Lean)credential. The CM-Lean credential was created to allow individuals theopportunity to demonstrate knowledge and understanding of concepts relatedto lean principles, processes, and tools as they relate to the constructionindustry as defined in AGC's Lean Construction Education Program.

The CM-Lean designation is earned by completing the seven units of AGC'sLean Construction Education Program and passing an exam based on thelearning events of each unit. The exam consists of 150 multiple choicequestions and must be completed within four hours. The credential is valid fora period of three years. CM-Lean holders will be required to submit 30 hours oflean construction-related continuing education hours to renew their credentialon a three year cycle.

"This new certificate program is part of our broader commitment to providingrigorous and relevant education and professional development opportunitiesfor construction professionals," said Stephen E. Sandherr, AGC of America'sChief Executive Officer. "This is another example of how we are building aneven stronger future for the industry."

Now, for the first time, AGC of America is enabling local chapters to providethis popular training in each market. San Diego is at the forefront of the LeanConstruction movement, and has secured AGC Lean Accredited InstructorDan Passick of On Point Lean Consulting to instruct.

The AGC San Diego Chapter will be holding the first Lean ConstructionEducation Program, Units 1 - 7, the week of March 14 - 18, 2016 at the AGCtraining facility located at 6212 Ferris Square. "This is excellent training developed by AGC of America. These are universalconcepts that are being taught in the local, San Diego, context. This trainingwill be a boost to the bottom line of contractors who take advantage of it." JimRyan of AGC San Diego.

Since 1991, AGCNational has offered AGC members an opportunity to evaluate their OSHAform 300A "Summary of Work-Related Injuries and Illnesses".

AGC National utilizes an outside audit agency to calculate and compare anAGC member's annual safety record with other AGC members according tothe member size and construction type: Building, Highway, Federal & Heavy,Municipal/Utilities and Associate/Specialty.

Additionally, the NASA program provides a great opportunity for contractormembers who have excellent safety records to compete for other nationallyrecognized awards.

Safety Committee In an ongoing effort to update our members on the active discussions withinthe Safety Committee here at the AGC of San Diego, the following were someof the most recent highlights of what was discussed and reviewed during theJanuary Safety Committee meeting: New Leadership: Brandy Fischer of Harper Construction moved into her newrole as Chair of the 2016 Safety Committee with Pamela Mark of A&DCompanies taking over as Vice Chair. We are confident with their leadershipwe will continue to educate and promote safety in the San Diego constructionindustry. Brandy replaces past Chair Dave Alofaituli who served thecommittee very well during his 2014/2015 term. Use of Video on the Project Site: A new innovative way of ensuring safety inthe workplace is the increasing use of video devices (i.e. GoPro) to live streamcertain activities providing visual assistance to those activities that canotherwise prove difficult, or those where verbal communication is relied upon. One such use discussed was by crane operators when moving a load to allowthem to see firsthand the area where they intend to place the load ensuring it

Substance Abuse in the Workplace: With the ever changing landscape ofrecreational or medical use of marijuana, the question will continue to arise onhow to handle those employees that allege to have to use for medicalpurposes. Does the company's drug free workplace policy allow a company toforbid such use? Does it pose a safety concern not only to the employeeusing, but those around them? These are questions that were reviewed, arebeing further researched, and discussed. We will continue theseconversations in the coming months. It is the mission of the safety committee as a core value to promote safetywithin our industry and part of that is sharing with the building communityinformation that could assist in the safety programs of others. The safetycommittee meets the first Wednesday of each month from 7:00 - 9:00 AM andwe welcome any members to join.
