WHILE it may sound like a cliché, we wish to say it again that one of the most shining milestones that we have marked this year is the declaration of Naga by the National Competitiveness Council as the Most Competitive Component City in the Philippines for 2015. This is another testament to, and in fact a re-affirmation of, our impressive achievements not only in nurturing best practices and good governance, but more so in actually delivering measurable results that make a difference in the lives of our people.

And the city’s basic strength that hastened the transformation of Naga into Bicol’s growth center are transparency, accountability and people participation that have been spurred by information openness and providing avenues for constructive dialogues and intelligent resolution of issues and concerns between the constituencies and their servants at city hall.

In fact, this gazette that you are holding now is only one of our communication tools that serves as the journal of the city government, one of the few LGUs that have done such, so that the people may be duly informed of the executive issuances, legislative ordinances and resolutions that were crafted upon thorough consultations and deliberations with the concerned stakeholders and the general public. The others are our re-engineered and award winning naga.gov.ph, installed in the Hall of Fame for being Best City Website for three consecutive years by the National Communications Center. Then we also have facebook.com.NagaSmilesToTheWorld, conceded to be among the most updated and hyperactive tools that LGU-Naga has taken advantage of and has made them among the key player in the social media. We regularly publish the Naga SMILES Magazine, a quarterly publication which records and reports the highlight activities and events as well as accomplishments that have taken place in the city during each quarter. The City Events, Protocol and Public Information Office also produces and hosts a weekly news program, “An Naga Ngonian (ANN) News,” for the latest local news and events, as well as important announcements that are aired both in local radio and TV for wider dissemination.

For its part, the Sangguniang Panglunsod created its own website (sp.naga.gov.ph), Facebook page, and Twitter account (www.twitter.com/spnagacity). The primary goal is to post updates and current activities and to solicit comments and obtain suggestions on new ordinances, improvement of existing ones, and enhancement of proposed legislations. The city council’s regular sessions are aired live through “SP Naga Live at Sky Cable TV 6,” broadcasting every Tuesday from 8:00 a.m. until the session is adjourned for the day.

Through efficient communication and information openness, it becomes easier for the people to trust their local leaders and be empowered and therefore become active participants in all community decision-making processes. Such environment, which the Naga people themselves helped to create, naturally leads to the erection of guideposts and more targets to be pursued towards progress and development. The city hall, for its part, is even more inspired to do its best.

The harmonious relationship and strategic collaboration between the private sector and city leads Naga to become the Most Competitive Component City of the Philippines for 2015. Along with the competence and efficiency of our employees, the brilliant suggestions and insights of our citizenry have served as a vital element in propelling our city towards sustainable, inclusive and robust development.

Given this, we in the 11th Sangguniang Panlungsod of Naga, have put premium on expanding avenues for people empowerment and participation. The legislative measures published in this Gazette speak for themselves, our efforts to involve the youth, the marginalized, and other sectors of society in our policy-making processes.

For instance, Ordinance No. 2015-064, which renames the Raul S. Roco Library to Raul Roco-Naga City Public Library (RNPL) and mandates the implementation of a Long-term Public Library Development Program, is based on the recommendations submitted by the Nagueňo Youth Parliament.

Naga’s tertiary students were convened during the Nagueňo Student-Leaders Congress at Regent Hotel, Dinaga, Naga City and together were guided to craft policy recommendations in eight areas outlined in our H2ELP your CiTy Agenda (Health and Nutrition, Housing and Urban Poor, Education, Arts and Sports, Livelihood and Business, Peace and Order, Public Utilities, Cleanliness and Environment Protection and Transparency, Accountability and Good Governance). On the sector of education, they advocated for the improvement of the Raul S. Roco Library by upgrading the facilities and educational materials therein and instituting additional sections for exhibits of Bicolano artists. Ordinance No. 2015-064 served, therefore, as our positive response on the matter.

Another piece of legislation that exhibits our commitment to solicit the participation of the private sector in local governance is Ordinance No. 2015-038. This legislative measure allocates an equivalent of 1.25 percent of the Local Development Fund to people-empowerment activities. In effect, by allotting specific financial resources, the ordinance cements the obligation of the city government to advance participatory governance.

It is our hope that the aforesaid ordinances, along with the other local law printed in this Gazette, shall be utilized in the continuous innovation of the city’s systems and processes. Our gains this 2015 is but a start. By working closely, we can sustain our gains, fill in identified rooms for improvement, strengthen further our best practices and continually make the best better.

CREATING AND IMPLEMENTING THE “PRE-SCHOOL TEACHER ON FOOT” (PTF) PROGRAM IN

THE CITY OF NAGA

ISSUED: November 24, 2015

Whereas, the City Government of Naga deems it imperative to enhance the city’s programs particularly in education for children. One such innovation is the multi-awarded Naga City Early Education and Development (NEED) Program, more popularly known as Educare, a Montessori-approach type of learning adopted in all day-care centers in the City of Naga with the primary goal of providing equal opportunity for an excellent, quality basic education to Nagueño children regardless of social status;

Whereas, since its inception up to the present, Educare, with the full support of LGU NAGA, has been very consistent and successful in meeting the standards for a conducive learning environment for its pupils;

Whereas, however, the city government also recognizes the need to give equal learning opportunities to children of pre-school age (3-4 years old) who live in hardly accessible communities, by providing them with an alternative learning opportunity that best suits their peculiar situations and needs;

Whereas, every Nagueño child is an asset and treasure of the city, and being so, the city government has the primary obligation to provide an inclusive and universal quality pre-school education even outside the 4 corners of the Educare classroom in order to bring learning opportunity closer to the remote homes of pre-school children;

Whereas, in a few far flung areas in the city, where building an Educare center is either impracticable or not feasible due to some legal impediments, there is a need to bring the teacher to these remote places so that little children of tender age (3-4 years old) will be afforded the opportunity to grow the Educare way;

NOW, THEREFORE, I, JOHN G. BONGAT, Mayor of the City of Naga, by virtue of the powers vested in me by law, do hereby order:

Section 1. In order to further expand the reach of the Educare system, the Local Government of Naga shall pilot the PRE-SCHOOL TEACHER ON FOOT program initially to be implemented in Zone 6, Barangay Panicuason, Austria Village, Barangay Carolina, Sitio Pasto, Barangay Cararayan and Zone 1, Barangay San Isidro, and later on to be replicated in similar areas, as need arises. The PRE-SCHOOL TEACHER ON FOOT (PTF) program shall promote a reasonable arrangement for basic formative education thru deployment of highly trained and dedicated teachers who can easily immerse and completely involve themselves in communities and hold classes in makeshift structures or in any appropriate area or private property until such time that the local government finds a suitable location to build permanent structures in or near such communities.

Section 2. The Educare Division Head of the CSWDO, under

EXECUTIVE ORDERS

authority of Executive Order No. 2015-030 (September 14, 2015), shall identify areas in the City where services and deployment of “Pre-school Teachers on Foot” are needed, even in areas that may not necessarily be remote but experience high rate/incidence of pre-school non-participation or drop-out. They shall receive a monthly honorarium of Php 3,500.00 from the City Government, with additional hazard pay of Php 500.00 per month, or a total amount of Php 4,000.00, save for the Educare Teacher assigned at Austria Village, who shall retain the present honorarium received from the city. The PTF shall be entitled to a counterpart honorarium from the barangay equal to the honorarium received by the regular Educare teacher.

Section 3. The Educare Division Head of the CSWDO, in collaboration with the Naga City School Board, shall recommend to the City Mayor, within ten (10) days from effectivity of this Executive Order, the additional Educare Teacher/s who shall serve as Educare Teacher/s on Foot to afford 3-to 4-year old children in remote areas equal access/opportunity to pre-school education.

Section 4. Funding for this program may be charged against the budget allotted for Educare or against the Special Education Fund, subject to existing Commission on Audit (COA) rules and regulations.

Section 5. Effectivity. This Executive Order shall take effect immediately.

EXTENDING SUPPORT TO THE NAGA CITY SENIOR CITIZENS

FEDERATION BY AUTHORIZING THE GRANT OF PER DIEM TO ITS OFFICERS AND BOARD

MEMBERS

ISSUED: November 19, 2015

WHEREAS, the Naga City Senior Citizens Federation and its member Barangay Associations of Senior Citizens are duly accredited people’s organizations organized under existing laws to advance the interests and sectoral issues of the elderly in Naga City;

WHEREAS, the Federation conducts monthly Board meetings and other activities attended by BASCA presidents from the 27 barangays of the city;

WHEREAS, there is a need to extend support to these Federation officers in the conduct of their regular business in order to strengthen their organization as an institution and as an effective partner of the city government in the promotion of the welfare of the elderly;

WHEREAS, NGO, PO and private sector representatives in government boards, councils, and other special bodies who receive no compensation for their membership therein are normally granted per diems to cover the cost of their attendance

REORGANIZING THE LOCAL POVERTY REDUCTION ACTION TEAM (LPRAT) OF THE CITY OF

NAGA

ISSUED: November 19, 2015

WHEREAS, in pursuit of attaining the Millennium Development Goal of reducing poverty from 26.50% in 2009 to 16.60% by 2015 and attaining the Philippines Development Plan’s goal of inclusive growth and poverty reduction, the Human Development and Poverty Reduction (HDPRC) and the Good Governance and Anti-Corruption Cluster (GGAC) and the Economic Development Cluster (EDC) organized under Executive Order 43. S. 2011, the City of Naga shall implement Bottom-Up Budgeting (BUB) Process for the FY 2017 Budget Preparation to ensure the inclusion of the funding requirement for the development needs of focus cities and municipalities in the budget proposals of the participating agencies;

WHEREAS, DBM-DILG-DSWD-NAPC Joint Memorandum Circular No. 7 dated November 3, 2015 states the need to reorganize the existing LPRAT and its purpose to which is to provide participating agencies and local government units with the responsibilities and timelines in the grassroots budgeting approach to be applied in the preparation of the 2017 National Expenditure Program.

Strictly enforce the provisions of Republic Act No. 7183 or the law regulating the manufacture and sale of firecrackers and pyrotechnics, and ensure that all banned products as classified and declared by the Department of Health, the Department of Trade and Industry and other regulatory agencies will not be sold in the market;

3. Closely coordinate with firecrackers and pyrotechnics distributors and/or retailers to prevent any untoward incident such as fires and explosions in their stores and most importantly, to reduce firecracker-related deaths and injuries;

4. Ensure that only those with special business permits may sell and distribute pyrotechnic products in the city;

5. Implement an aggressive campaign against smuggled firecrackers and pyrotechnic products by going after unscrupulous traders and distributors;

6. Cause the confiscation and disposal of firecrackers and pyrotechnic devices being sold illegally;

7. Cause the prosecution of violators of existing national laws, rules and regulations, and ordinances on manufacture, sale and distribution of firecrackers and pyrotechnics; and

8. Perform other functions incidental to the proper implementation of this Executive Order.

2.1 The LOCAL POVERTY REDUCTION ACTION TEAM (LPRAT) shall have the following roles and responsibilities:

a. Organize and facilitate the conduct of a local poverty reduction action planning workshop for the formulation of the LPRAT and the identification of priority poverty reduction projects:

b. Agree on a list of priority poverty reduction projects for FY 2017 based on a thorough poverty analysis and submit the LPRAT to the RPRAT using the templates provided in Annex B2 of DBM-DILG-DSWD-NAPC Joint Memorandum Circular No. 7, and,

c. Conduct quarterly meetings to monitor the status of the approval and integration of the priority poverty reduction projects into budgets of participating agencies and monitor the implementation and status of the projects

2.2 The CSO Members of the LPRAT shall have the following roles and responsibilities:

a. Actively participate in the formulation of the LPRAT and in the identification of the priority poverty reduction projects;

b. Through their elected representatives identified during the CSO Assembly, endorse the LPRAP and the list of priority poverty reduction projects for approval of the Sangguniang Panlungsod; and

c. Advocate for the SP’s adoption of the list of priority poverty reduction projects, when necessary; and

d. Remind and demand that the Local Chief Executive shall convene the quarterly meeting to report on the status of the implementation of the priority poverty reduction projects so that they can monitor the implementation of the projects. They may also undertake monitoring activities independent of the LGU.

2.3 The Sangguniang Panlungsod shall review and adopt the list of the priority poverty reduction projects to be submitted to the RPRAT. It shall pass as SP resolution using the form prescribed in the DBM-DILG-DSWD-NAPC Joint Memorandum Circular No. 7 in endorsing the list of priority poverty reduction projects.

Section 3. Effectivity- This order shall take effect immediately.

Whereas, pursuant to Republic Act No. 9418, otherwise known as the Volunteer Act of 2007, “It shall be the policy of the State to promote the participation of the various sectors of the Filipino Society, and as necessary, international and foreign volunteer organization in public and civic affairs and adopt and strengthen the practice of volunteerism as a strategy in order to attain national development and international understanding. The inculcation of volunteerism as a way of life shall rekindle in every Filipino the time-honored tradition of Bayanihan to foster social justice, solidarity and sustainable development.”;

Whereas, the City Government of Naga gives priority to good governance in order to serve the needs of the community in an appropriate and responsive manner;

Whereas, good governance could be further enhanced in the City of Naga if untapped human resource could be harnessed and mainstreamed into community endeavors in the different service areas of local governance;

Whereas,benevolent actswhich exemplify the trait of volunteerism are regularly happening in the city;

Whereas, the city government sees the importance of creating an avenue for appropriate coordination for those individuals, groups and organizations, both local and foreign, who would want to offer their services and expertise to aid the lives of Nagueños;

Whereas, such system is based on and motivated by the following: 1) harnessing of available human resources in the community towards productive ends; 2) maximizing enrolment of committed volunteers to the program to volunteer their services for free in their chosen areas of expertise and interest; 3) mapping-out voluntary services offered by individuals, groups and organizations; 4) matching of existing volunteer services in the community as the need arise; and 5) tracking the progress of the participating volunteers in the locality;

Now, therefore, I, John G. Bongat, Mayor of the City of Naga, by virtue of the powers vested in me by law, do hereby order:

Section 1.Creation.In order to address the aforementioned points, the Naga City Volunteer and Citizenship Council (NCVCC) is hereby created, with the main objective of promoting volunteerism among individuals and organizations in pursuit of the priority developmental objectives of the City Government of Naga.

Section 2.Composition. The NCVCC shall be chaired by the City Mayor and shall be composed of the following members:

1. Head, Lingkod Barangay Office;2. Head, Education, Scholarship and Sports Office;3. Head, City Disaster Risk Reduction and Management Office;4. Administrator, Philippine Red Cross-Camarines Sur;5. Program Director, Naga City People’s Council;6. Three representatives from Naga City-based civic

organizations or Non-Government Organizations (NGOs), to be appointed by the City Mayor;

7. Federation President, Happy Youth Movement in Naga (HYMN).

The members shall choose from among themselves a Secretary who shall record the minutes of all meetings and shall be the custodian of all records of theNCVCC.

A regular report on the status of program implementation will be submitted quarterly to the Office of the City Mayor.

Section 3.Meetings.The NCVCC shall meet once a month as may be agreed upon by the members. The Chairperson, however, may convene the Committee for special meetings as the need arises.

Section 4.Functions.The NCVCC shall have the following functions:

1. Coordinate and work hand in hand with the Department of the Interior and Local Government (DILG) on any matter or issue concerning the implementation of the program;

2. Match volunteers with existing needs, demands, and circumstances;

3. Maintain a profile and database of locally available volunteers;

4. Disseminate all information relevant to the activities in order to generate awareness and support;

5. Enlist and organize into a federation all volunteer individuals and/or groups and identify the different areas of intervention where volunteer assistance, in any form or whatever means, are most needed; and

6. Perform such other functions as may be consistent with the above and as may be necessary and required for the success of the program.

Section 5.Funding. Expenses to be incurred in the conduct of activities of the NCVCC may be charged against the Grassroots Empowerment Fund.

Section 6.Effectivity. This Executive Order shall take effect immediately.

MANDATING AND ADVOCATING THE IMPORTANCE OF

ENROLLING CHLDREN IN THE CITY OF NAGA, WHO ARE 3-4

YEARS OLD, TO THE EDUCARE PROGRAM

WHEREAS, the competitive world of modern times requires early education intervention in the life of pre-school children;

WHEREAS, it is imperative that every child at a tender age be given the opportunity to go to school, and learn the subjects and concepts being taught;

WHEREAS, a child deprived of proper education at an early age will actually be deprived of the academic foundation needed for Kinder and Grade 1 especially in light of DepEd’s K-12 program;

WHEREAS, Educare is an early intervention program that prepares young, children for basic education;

WHEREAS, each educare center is a specially-designed place

WHEREAS, upon consultations with public school kindergarten teachers in the City of Naga, the undersigned City Mayor has validated that children who have not gone through pre-school are having difficulties coping with the lessons taught when they go to kindergarten;

NOW THEREFORE, I, JOHN G. BONGAT, Mayor of the City of Naga, by virtue of the powers vested in me by law, do hereby order:

Section 1. Directive. In order to address the aforementioned points, all Educare teachers in the City of Naga are directed to:

• Find and make a list of the names of children in the barangay where they are detailed who are 3-4 years old, and are not going to school. This list should be updated at the beginning of every school year immediately after the issuance of this Executive Order.

• Submit the list to the Naga City School Board for reference and for proper disposition on how to prescribe to the parents/guardians that their child/ren should be enrolled in the Educare Program.

CREATING THE PANICUASON PROTECTED AREA

MANAGEMENT BOARD (PPAMB), DEFINING ITS COMPOSITION,

AND IDENTIFYING ITS PURPOSE, GOALS, OBJECTIVES, SCOPE AND RESPONSIBILITIES

ISSUED: September 7, 2015

Whereas, Republic Act 7586 or the National Integrated Protected Areas System (NIPAS) Act recognize the impact of human development on the natural environment, as well as the importance of protecting and maintaining the natural biological and physical diversities of protected areas to sustain human life and development, as well as plant and animal life;

Whereas, the NIPAS Act also recognize that the effective administration of these areas is possible only through cooperation among national government, local government and concerned private organizations and that the use and enjoyment of these protected areas must be consistent with the principles of biological diversity and sustainable development;

Whereas, in 2011, the City Government of Naga and the Department of Environment and Natural Resources (DENR) entered into an agreement for the co-management of the 664 hectares portion of the Mt. Isarog Natural Park (MINP),

specifically situated in the headwaters of the Naga River in Barangay Panicuason, Naga City;

Whereas, under the agreement, the City Government of Naga has the responsibility of taking charge of the repair/rehabilitation of existing facilities and trails inside the MINP, Brgy. Panicuason side, as well as the option to enter into agreements with the national government or the private sector for the development of facilities to cater to the needs of tourists, mountaineers, and visitors;

Whereas, the increasing number of visitors to MINP, particularly Malabsay Falls, requires the improvement of policies, effective implementation of rules and regulations, and increased focus and deployment of resources to ensure the safety and security of visitors, safeguard the natural environment, and assure visitors of a positive experience within the area of concern;

Whereas, the area of concern is located within the East Highland Tourism Zone of Naga, which covers the upper barangays of Carolina and Panicuason, with the said zone the focus of tourism development by the City Government because of its complementing natural attractions and ideal location for resorts;

Now therefore, I, John G. Bongat, Mayor of the City Government of Naga, by virtue of the powers vested in me by law, do hereby order the following:

Section 1. To effectively administer and manage the implementation of City Government’s responsibilities under the co-management agreement with the DENR and to ensure the sustainable development of the area of concern in accordance with the NIPAS Act and Naga’s tourism development program, the Panicuason Protected Area Management Board (PPAMB) is hereby established.

5. Recommend the conduct of manpower training projects and activities for tourism and conservation workers of the city government, barangay governments and private establishmentswithin the East Highland Tourism Zone

6. Review proposals for partnerships from government agencies, the private sector, and the academe and recommend actions to the city government

7. Consult regularly with stakeholders within the area of concern and the East Highland Tourism Zone such as, but not limited to: barangay government officials, community leaders, NGOs/POs, tourism-oriented establishments regarding the formulation, implementation and impact of policies, rules, regulations and local ordinances, as well as economic ventures (whether public or private) within the area of concern and the East Highland Tourism Zone

8. Conduct regular monitoring, evaluation and assessment of the implementation, effectiveness and impact of strategies, policies, rules, regulations and local ordinances, as well as economic ventures (whether public or private) and park

WATERWAYS MANAGEMENT COUNCIL

WHEREAS, a group of young community leaders were able to successfully revive the dead Maningning Creek in Taytay, Rizal. The Maningning Creek experiment is now being used as a model for the rehabilitation of Waterways in Cambodia, Vietnam, Malaysia, and Laos;

WHEREAS, the Maningning Creek model inspired group of students in Ateneo de Naga University to replicate it on the waterways of Naga City;

WHEREAS, there is a need to include additional functional and responsibility of the council to coordinate with various non-government organizations that are interested to actively participate in the clean-up, rehabilitation, and revival efforts of the council, of Naga’s natural waterways;

Now, therefore, I, JOHN G. BONGAT, Mayor of the City of Naga, by virtue of the powers vested in me by law, do hereby order that the following:

Section 2, as amended, shall now read thus “Section 2. Composition. The Naga City Natural Waterways Management Council’s function and responsibilities are as follows:

1. Identify the natural waterways in the different barangays of Naga City;

2. Cause the preparation of topographic map for Naga City indicating all natural waterways in relation to the topography of adjoining municipalities, aimed at determining the flow of water in existing natural waterways;

3. Coordinate with the Naga City Flood Mitigation Board in integrating programs to preserve and clean-up such waterways;

4. Engage the services of the academe and/or flood experts in introducing engineering and scientific solutions to flooding;

5. Conduct public awareness campaign encouraging/engaging people’s participation in the maintenance and upkeep of natural waterways;

6. Organize residents along Naga and Bicol Rivers into “Defenders of Naga River”, as the lead, barangay-based organization charged with the function of ensuring cleanliness of riverbanks and the river;

7. Act as coordinating body to various NGOs that are interested and willing to provide support to the clean-up, rehabilitation, and revival efforts of the council; and

8. Perform such other functions in pursuit of the above.”

WHEREAS, in June 2004, the Naga City Population Office, now known as the City Population and Nutrition Office (CPNO), in coordination with the Center for Health Development Bicol conducted a forum on Natural Family Planning (NFP). The body felt the need to address essential issues on the growing problem in population and women’s health and ensure that the community will uphold and protect life and family according to natural norms;

CREATING THE HAPPY YOUTH

ISSUED: August 3, 2015

WHEREAS, pursuant to its mandate under the General Welfare Clause of the Local Government Code and backstopped by the City Ordinance on Child and Youth Welfare, particularly Ordinance No. 2012-035 (otherwise known as the Naga City Youth Code) the City Government of Naga sees the imperative need to galvanize its strong vigilance and guidance over Nagueño out-of-school youth (OSY) aged 15-30 years to transform them into responsible, civic-conscious and productive citizens of the barangay and the city;

WHEREAS, there is also a crucial need to form a cohesive interlinking among key stakeholders for a more comprehensive approach over initiatives, programs, projects and activities geared towards OSY development, involvement and engagement in the local community; WHEREAS, given the immense, immeasurable and inexhaustible dynamism, vigor, creativity and energy waiting to be tapped among our youth, especially those who have a lot of idle and unproductive time, it shall be deemed essential that an all-inclusive and well-coordinated program to be called as the Happy Youth Movement in Naga (HYMN) be created and organized;

NOW, THEREFORE, I, JOHN G. BONGAT, Mayor of the City of Naga, by virtue of the powers and authority vested in me by law, do hereby order the following:

Section 1. Creation and Purpose. The Happy Youth Movement in Naga (HYMN) is a far-reaching, city-wide, all-embracing program advocating youth empowerment and development, to be organized as a dynamic movement aimed at securing to our youth the blessings of democracy, and inculcating in them the values of civic-mindedness, health and wellness, resourcefulness, community- and nation-building. This will in effect drive them away from iniquitous vices and transform them into relevant and productive members of the community, future leaders and movers of our city.

The target youth sector shall have the following qualifications:

1. He/she must be 15-30 years old;

2. He/she must be an OSY who is not yet enrolled under the Alternative Learning System (ALS), or who failed in the A & E examination, or who is a high school graduate but not presently enrolled in either tech-voc or college course, or has dropped out for whatever reason;

3. He/she must be unemployed, and has a lot of idle and unproductive time;

4. He/she must be a resident of Naga;

The above fields of interest shall be treated as the six (6) thrusts or key areas of OSY development under the HYMN Program, falling under the three (3) pillars of HYMN, namely, i) Balik-Eskwela; ii) Discovery of Talent; and iii) Community Service.

Section 2. Composition of the HYMN City Council. The Happy Youth Movement in Naga (HYMN) Council, to serve as the exclusive organizing, policy-making and executive body for the HYMN program, shall be composed of the following:

Section 3. Functions. – The HYMN City Council shall have the following functions:

a. Formulate policies to effect the purposes and objectives in Section 1 hereof;

b. Organize the HYMN in every barangay as a chapter with the following officers: President, Vice President, Secretary, Treasurer, Auditor, Program Officer, and Public Information Officer, with the Punong Barangay (PB) as Adviser and the Sangguniang Barangay Chairperson on Youth Affairs as Barangay Executive Officer;

c. Develop a database of all members per barangay;

d. Create a profile of each HYMN member per zone/per barangay that indicates age, gender, educational attainment, favorite sport/skill/talent in music and the arts, and ambition in life;

e. Formulate projects and activities in the areas of health and wellness, sports, skills and talent development, whether in music or the arts, etc.;

f. Initiate and coordinate all significant pro-OSY activities, events, and programs that will cater towards drug use prevention, youth productivity and moral values orientation and recovery programs;

g. Promote youth empowerment through active engagement in manual, intellectual, and psychomotor activities and social collaboration with other key sectors of the community;

h. Engender youth productivity through exposure in various technical skills-enhancing activities undertaken by the City Engineer’s Office (CEO) and General Services Department (GSD), Metro PESO, DTI, etc.; and

i. Perform such other activities consistent with or in pursuance of the above functions.

Section 4. Funding. The City Government shall allocate the amount necessary to cover the expenses for the implementation of the activities of the HYMN Program chargeable against the Youth Development Fund, the city sports and scholarships funds, peace and order fund, environment fund, health and nutrition fund, Local Disaster Risk Reduction and Management Fund (LDRRMF), arts and culture funds, livelihood and agriculture funds.

Section 5. Effectivity. This Executive Order shall take effect immediately.

EXPLANATORY NOTE

The barangays, being the basic units of government, are at the forefront of delivery of crucial social services to the Nagueños. They are vital in the sustainable and inclusive economic development and social progress of Naga. Their competence and responsiveness in addressing the needs of the people shall form a great part in shaping Naga as one of the most competitive and most liveable cities in the country and in the world.

Hence, it is necessary for the city government to ensure that elected officials in the 27 barangays of the city are healthy and physically fit to conduct their duties and perform their obligations. They should be provided with access to quality health care.

To achieve this end, this ordinance is hereby conceptualized.

BE IT ORDAINED, therefore, by the Sangguniang Panlungsod of the City of Naga, that:

SECTION 1. - TITLE. - This ordinance shall be known as “Barangay Officials Annual Executive Check-Up Ordinance”.

SECTION 2. - PURPOSE.- This ordinance is enacted in order to:

1. Enhance the performance of barangay officials of their functions, duties and obligations, by ensuring that they are physically fit and healthy to do the same; and

2. Strengthen the partnership between and among the officials of the city government and of the 27 barangay governments of Naga City.

SECTION 3. - SCOPE. This ordinance shall cover all incumbent barangay officials of the 27 barangay governments of Naga City, namely the Punong Barangay, Barangay Kagawads, Sangguniang Kabataan Chairman, SK Kagawads, Barangay Secretary, Barangay Treasurer and Barangay Record Keeper.

SECTION 4. - ANNUAL EXECUTIVE CHECK-UP.- Barangay officials, as enumerated above, of the 27 barangay government of Naga City shall be conferred the privilege of availing an executive check-up at the Naga City Hospital during their respective birth months.

The executive check-up shall cover ECG, chest x-ray, urinalysis and complete blood test ( includes CBC/platelet, FBS, uric acid, blood urea nitrogen, SGPT, SGOT, croatinine, triglycerides, cholesterol, HDI, I.DI., BUN, SGPT and SGOT).

This privilege shall be solely extended to the officials of the barangays and shall be non-transferable to their kin, and relative or friends.

This privilege shall also be availed during the period of their birth months. In this connection, all barangays of Naga City are hereby enjoined to submit a list of their respective Barangay officials with corresponding date of birth to the office of the head of the Naga City Hospital.

SECTION 5. FUNDING. - The Naga City Hospital shall incorporate in their annual budget an appropriation for the purpose.

SECTION 6. - SEPARABILITY CLAUSE.-Any provision or portion of this ordinance found to be unconstitutional or invalid

SECTION 1. Title - This ordinance shall be known as the Fire Lane Ordinance.

SECTION 2. Purpose - This ordinance shall ensure that the immediate exit roads from the Naga City Fire Protection Office (NCFPO) provide clear lanes to the main roads to speed up response time in case of emergency.

SECTION 3. Fire Lanes - The following streets are declared fire lanes from the gate of the NCFPO to the corners of main roads as indicated:

a. J. Miranda Avenue, northbound to corner of Taal Avenue

b. Mayflower Street, eastbound to corner of Magasaysay Avenue

c. J. Miranda Avenue, southbound to corner of Panganiban Drive

SECTION 4. Observance of the Fire Lanes - To ensure the immediate response to emergency calls, all concerned shall observe the following:

a. This ordinance covers all motor vehicles, pedicabs, bicycles,

pushcarts, as well as their respective drivers/operators.b. There shall be no parking/obstruction on these lanes 24

hours a day, seven days a week.c. Drivers should ensure speedy loading and unloading of

passengers along the fire lanes. In case of emergency sirens, they and all others on or along the fire lanes should promptly and completely clear the lane.

d. Drivers may park or stop and unload cargo only along the opposite lanes.

SECTION 5. Penalties - For violation relative to any or all of the provisions above, the following sanctions shall be implemented:

a. Citation tickets shall be served for all motor vehicles and all other matters parked on and/or obstructing the fire lane beyond five minutes. The penalty for this is P100.00 for the first hour and P100.00 every hour thereafter payable at the City Treasurer’s Office.

b. P500.00 shall be imposed on potentially or actually obstructive cargo unloaded on the fire lanes.

c. The penalties shall automatically be doubled in cases of vehicles and other matters actually parked on and/or obstructing the fire lane during emergency.

SECTION 6.Repealing Clause - Upon effectivity of this ordinance, all related ordinances are hereby repealed.

SECTION 7. Separabilty Clause - Should any portion or provision of this ordinance be declared unconstitutional or invalid, the other parts thereof which are not affected thereby and shall continue to be in full force and effect.

SECTION 8. Effectivity - This ordinance shall be effective fifteen days after publication.

SECTION 1. Title - This ordinance shall be known as the Raul S. Roco-Naga City Public Library Development Ordinance.

SECTION 2. Declaration of Purpose and Policy - The City of Naga subscribes to Republic Act No. 7743, the Act Providing for the Establishment of Congressional, City and Municipal Libraries and Barangay Reading Centers Throughout the Philippines . . ., to the Public Library Manifesto of the International Federation

of Library Associations and the United Nations Educational, Scientific, and Cultural Organization (IFLA-UNESCO), and to the Standards for Philippine Libraries: Public Libraries of the Board of Librarians–Professional Regulation Commission.

Thus, the general purposes of the public library of the City of Naga are:

a. To provide library and information service to the needs of the community;

b. To build within the library an information center about Bicol and the City of Naga—their histories, resources, people, customs and traditions, etc.;

c. To establish linkages with other libraries to facilitate reference needs of its patrons

SECTION 3. Name - The local library established as the provincial public library in 1921, reestablished as the city public library in 1957, renamed as the Raul S. Roco Library in 2005, in honor of that erudite, great Bicolano leader, shall henceforth be known as the Raul S. Roco-Naga City Public Library, Raul Roco-Naga Public Library for short (RNPL).

SECTION 4. Standardization - The RNPL shall by the end of 2017 meet at least the minimum requirements based on the Standards for Public Libraries prescribed by the Philippine Board of Librarians, and by the end 2019 shall rate satisfactory in all the aspects of library operations, namely:

The RNPL Standardization Committee shall adapt the Standards for Public Libraries for its evaluation instrument or any such veritable instrument as may be available. It shall submit its first Evaluation Report to the City Mayor and the Sangguniang Panlungsod no later than 30 June 2016, and every June 30 thereafter. The 2016 and later reports shall contain Analysis, Evaluation, and Recommendation. 2017 thenceforth the reports shall add the section Action Taken on Previous Recommendations.

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:SECTION 1. – Necessity and Purpose of Expropriation. – The subject property has long been used as a road used by the general public particularly by residents of Zone 1, Concepcion Grande Dry Creek Urban Poor community, and by the beneficiaries of the Urban Poor Relocation Site in Barangay Balatas. In order to provide unimpeded use by the public over this subject property to protect their welfare, there is a need for the City Government to exercise its power of eminent domain thereon;

SECTION 2. Compliance with Procedural Requirements. On March 10, 2015, the Sangguniang Panlungsod of Naga passed Resolution No. 2015-072 authorizing the City Mayor to negotiate for the acquisition of the subject property. Pursuant to the said Resolution, the City Mayor sent a letter offer to the landowner dated 19 March 2015 for the purchase thereof. Upon personal

service of the said letter-offer, the Authorized Representative of the landowner, Mrs. Zenaida Salvador, openly expressed her opposition and rejection of the offer. Based on the said response of the landowner’s authorized representative, the Sangguniang Panlungsod of Naga passed Ordinance No. 2015-013 expropriating the subject property. Upon information that another representative of the landowner requested until April 18, 2015 within which to submit their final response, the Sangguniang Panlungsod revoked Ordinance No. 2015-013 by re-passing another expropriation ordinance, Ordinance No. 2015-052 in view of the failure of negotiation as evidenced by the landowner’s failure to give its reply to the City’s offer within the period requested by her despite several months having already passed. In the City’s desire to spell out concretely its compliance with the requirements for expropriation, the Sangguniang Panlungsod hereby revises Ordinance No. 2015-052.

SECTION 3. Exercise of the Power of Eminent Domain. In view of the apparent refusal of the landowner to accept the offer of the City Government to buy the subject property in order that the same may be utilized as a public road, the City Government of Naga hereby exercises its power of eminent domain over the parcel of land being described as lot 1-b-2-c-2-a, Psd-05-010441, being a portion of lot 1-b-2-c-2, Psd-05-009264 with TCT number 19965 with an area of one hundred twenty seven (127) square meters, located at Barangay Concepcion Grande, Naga City, registered in the name of Mercedes N. Abella, et al now owned by Lynn S. Staggs;

SECTION 4. Authority. The City Mayor is hereby authorized to sign and file the initiatory complaint/pleading in the proper court and to represent the city in all the stages of the proceedings thereon, to make stipulations and/or admissions of facts in the pre-trial, to enter into a compromise or amicable settlement, to submit to alternative modes of dispute resolution, and to perform such acts and things as may be necessary to carry out the foregoing authority.

In view of the urgency of the matter considering the situation of the immediately affected residents that poses danger to their safety and well-being due to lack of access road, this authority shall be acted upon with dispatch.

In case of a settlement or compromise agreement, the same shall be subject to the ratification of the Sangguniang Panlungsod.

SECTION 5.- Appropriation. The amount of One Hundred One Thousand Six Hundred (P101,600.00) Pesos is hereby appropriated to cover the payment for just compensation, chargeable against the 2014 Surplus;

SECTION 6. Effectivity. This ordinance shall take effect immediately upon its approval.

WHEREAS, on February 25, 2009, then City Mayor Jesse M. Robredo issued Executive Order No. 2009-004 which established the Naga City Governance Institute to scale up the city government’s innovative practices on good local governance and sustain its growing reputation as top destination for researchers and study tours both local and overseas;

WHEREAS, in recognition of the beloved Former Naga City Mayor and DILG Secretary Jesse M. Robredo’s pioneering efforts and sterling achievements in transformative governance, the Honorable City Mayor, John G. Bongat, issued Executive Order No. 2013-024 and 2013-024-A that renamed the Naga City Governance Institute to Jesse M. Robredo Good Governance Center (JMRGGC), redefined its mandates, and reconstituted its governing board;

WHEREAS, in order to unequivocally express the City Government of Naga’s commitment to continually raise the bar of good governance, there is a need to further institutionalize and strengthen the JMRGGC as the City Government of Naga’s everlasting instrument in honoring the memories of the beloved Jesse M. Robredo;

WHEREAS, the way by which the City Government of Naga shall further institutionalize and strengthen the JMRGGC is through the passage of this ordinance to ensure the continuity and effectiveness of its operations.

NOW, THEREFORE, on motion of Honorable City Councilor Mila Raquid Arroyo, seconded by Hon. Elmer S. Baldemoro, be it ordained, as it is hereby ordained, by the Sangguniang Panlungsod of Naga, in session assembled:

SECTION 1. Institutionalization of the Jesse M. Robredo Good Governance Center as Beacon of Good Governance. As initially created under Executive Order Number 2009-004 as Naga City Governance Institute and renamed and redefined under Executive Order Nos. 2013-024 and 2013-024-A as Jesse M. Robredo Good Governance Center, the Jesse M. Robredo Good Governance Center (JMRGGC) is hereby institutionalized as the Beacon of Good Governance.

SECTION 2. Purpose. The institutionalization of the Jesse M. Robredo Good Governance Center as the Beacon of Good Governance shall serve as the City Government of Naga’s continuing commitment to raise the bar of good governance and to the continuing replication of the mechanisms and examples inspired by the late Jesse M. Robredo on how the government

FUNCTIONS, RECONSTITUTING ITS GOVERNING BOARD,

SECTION 3. Functions. The JMRGGC shall serve as a mechanism for knowledge-sharing geared towards the strengthening of capacities for good local governance. It shall also secure the gains in good governance already achieved by the City of Naga. Specifically, the JMRGGC shall function as follows:

I. As Data Bank of Innovations and Best Practices in Local Governance;

II. As Mechanism for knowledge-sharing on good governance innovations and best practices to facilitate replication;

III. As Mechanism for discussion/consultation on burning public-interest issues to facilitate the formation of informed public opinion

IV. As Mechanism for periodic review of the good governance practices of the City Government of Naga and the formulation of measures on how to further improve on them. Specifically, the following programs/ordinances, among others, shall be given special attention to ensure their continuity and improvement:

1. The Empowerment Ordinance of Naga City;2. The Kaantabay sa Kauswagan Ordinance;3. The Personnel Productivity Improvement Program4. The Citizen’s Charter5. The City Youth Officials Program6. The EnAble Program7. The Student Participation Program

SECTION 4. Networking and Partnership-building as the Main Strategy. To perform the above-mandated functions, the JMRGGC shall network, link, coordinate, and partner with pertinent government agencies, offices, and private individuals and organizations in the conduct of research, training, workshops, public fora, and such other activities as it may deem necessary to achieve the purposes of this Ordinance.

a. Documentation of governance innovations and best practices in Naga City and the Bicol Region with the end in view of facilitating sharing and replication;

b. Study of innovations and best practices in local governance with the end in view of continually improving on them;

SECTION 5. Governing Board. The Operations of the JMRGGC shall be governed by a Board of Directors composed of the following:

SECTION 6. Powers and Duties of the Chairperson. The Chairperson of the Board of Directors of the JMRGGC shall be its Chief Executive Officer. He shall preside over the meetings of the Board and shall not vote except to break a tie. He shall act as the official representative of the JMRGGC in all its functions, without prejudice to his authority to designate his official representative in any such functions. SECTION 7. Powers and Duties of the Governing Board. The Board of Trustees of the JMRGGC shall have the following powers and duties:

1. Formulate policies necessary to carry out the mandates of the JMRGGC, subject to the approval of the Sangguniang Panlungsod;

2. Recommend policies, programs, or measures that will help the City Government of Naga safeguard its gains in good governance and continually improve on them and facilitate their replication;

3. Approve the JMRGGC Annual Plan and Budget for inclusion in the Annual Budget of the City Government of Naga;

4. Approve the processes and procedures necessary in the implementation of its programs;

5. Formulate policies and guidelines, subject to the approval of the Sangguniang Panlungsod on the use and maintenance of the JMRGGC Building once completed;

6. Formulate its own internal rules in the conduct of its meetings;

7. Carry out such other functions as are necessary to achieve the purposes of this Ordinance.

SECTION 8. Meetings and Compensation of the JMRGGC Board of Trustees. The Board of Trustees of the JMRGGC shall meet twice a year, and as often as it may deem necessary.

SECTION 9. The JMRGGC Executive Committee. There is hereby created the JMRGGC Executive Committee who shall act in between meetings of the Board of Trustees, recommend policies for approval of the Board, and oversee the implementation of the decisions approved by the Board, and oversee the performance of the functions of the JMRGGC Secretariat. The JMRGGC Executive Committee shall be composed of the following:

1. The JMRGGC Chairperson 2. The JMRGGC Vice-Chairperson;3. One Representative from the Sangguniang Panlungsod

Committee on People Empowerment; 4. JMRGGC BOT Member (Representative of the Pioneers

of the Naga City Empowerment Ordinance)5. JMRGGC BOT Member (Representative of the Family of

the Late Jesse M. Robredo)6. The JMRGGC Executive Officer

SECTION 10. The JMRGGC Secretariat. The Board of Trustees, the JMRGGC Executive Committee, and the Chairperson of the JMRGGC BOT shall be assisted by a Secretariat headed by an Executive Officer who shall occupy a plantilla position with salary grade of at least SG-18. The Secretariat shall be composed of as many personnel as the Board of Trustees may determine and as may be provided under its approved annual budget.

SECTION 11. The JMRGGC Official Business Address. Until such time that the JMRGGC Building is ready for occupancy, the JMRGCC official business address shall be City Hall Main Building, J. Miranda Avenue, Naga City.

SECTION 12. Appropriation. The amount of Five Hundred Thousand Pesos (P500,000.00) in addition to the amount already appropriated under the 2015 Annual Budget which shall be sourced from the unexpended balances of the appropriations in the 2015 Annual Budget shall be appropriated for the purpose of this Ordinance. Thereafter, the annual appropriation for the operation of the JMRGGC shall be submitted for inclusion in the Annual Budget of the City Government of Naga.

SECTION 13. Transitory Provision. All arrangements, processes and structures already existing at the time of the approval of this Ordinance by virtue of the implementation of Executive Order Nos. 2013-024 and 2013-024-A shall continue to be effective and shall be deemed amended only as to give effect to, and implement the, provisions of this Ordinance.

SECTION 14. Separability Clause. Any provision or portion of this Ordinance found to be in violation of the Constitution or declared invalid by a competent court, shall not affect the validity and effectivity of the other provisions hereof.

SECTION 16. Repealing Clause. All ordinances, executive issuances, rules and regulations or parts thereof, which are inconsistent or in conflict with the provisions of this Ordinance, are hereby repealed and/or modified accordingly.

SECTION 17. Effectivity - This Ordinance shall take effect immediately upon its approval.

SECTION 1. Title. This ordinance shall be known as the “New Senior Citizens ID Ordinance”.

SECTION 2. Adoption of Policies and Objectives. The City of Naga hereby adopts the declared policies and objectives in Section 2 of R.A. 9994, otherwise known as “An Act Granting Additional Benefits and Privileges to Senior Citizens, Further Amending Republic Act No. 7432, as Amended, Otherwise Known as ‘An Act to Maximize the Contribution of Senior Citizens to Nation Building, Grant Benefits and Special Privileges and for Other Purposes’”, more specifically:

a. To establish mechanisms whereby the contributions of the senior citizens may be maximized;

b. To adopt measures whereby our senior citizens are assisted and appreciated by the community as a whole;

c. To establish a program beneficial to senior citizens, their families, and the rest of the community they serve;

d. To establish community-based health and rehabilitation programs for senior citizens in every political unit of society.

SECTION 3. Prescription of New Senior Citizens Identification Card. A new senior citizens identification card (ID) is hereby prescribed effective 1 January 2016.

a. The new ID shall be of polyvinyl chloride material (PVC) measuring about eight by five centimeters.

b. Its four corners shall be rounded.

c. The front shall be colored with predominant blue and yellow background

d. The front shall be portrait oriented and bear: (1) the heading: “Republic of the Philippines / City Government of Naga / Office for Senior Citizens Affairs; (2) the senior citizen’s photograph; (3) his/her full name—first, middle initial, family; (4) his/her ID number and bar code; (5) the Mayor’s name and signature; (6) the official seal of the City of Naga.

e. The back shall be landscape oriented and shall bear: (a) the senior citizen’s Naga City address, date of birth, gender; (b) names of 2 persons to notify in case of emergency, together with their addresses and contact numbers; (d) Name and signature of the OSCA Head.

f. The front shall indicate the non-transferability of the ID as well as its validity for use nationwide. The back shall warn on penalties for violation of RAs 9257 and 9994.

SECTION 4. Invalidation of old Identification Cards. All Naga City white senior citizens ID cards shall be deemed invalid in Naga City beginning 1 January 2016. SECTION 5. Replacement of Old ID Cards. All old Naga City senior citizen white ID cards shall be replaced with the new ID card free of charge.

SECTION 6. Requirements for New Entrants. All senior citizens applying for registration for the first time and for issuance of the new senior citizen’s ID free of charge shall submit the following:

a. Duly accomplished application formb. Birth certificate, or any public document indicating the

applicant’s Filipino and senior citizenshipc. Barangay Certificate of Residency or two (2) proofs of billingd. Photocopy of Naga City Voter’s ID/COMELEC Certificate

of Registration/COMELEC Certification of Cancellation of Registration

SECTION 7. Requirements for Replacement of Old ID Cards. All senior citizens applying for replacement of their old IDs with the new ones shall surrender their old IDs and submit the same items listed in Section 6. The same requirements shall be required of all senior citizens who have transferred residence from elsewhere to Naga City provided that their barangay certificate shall indicate at least six months residency in the barangay.

All senior citizens whose old, white ID cards were issued later than 5 March 2015 need only to surrender their old ID cards for replacement.

SECTION 8. Requirements for Replacement of Lost ID Cards. All senior citizens applying for replacement of their lost old or new IDs with the new ones shall submit the same items listed in Section 6 together with an affidavit of loss. One hundred pesos (P100.00) shall be charged for the replacement.

SECTION 9. Personal Verification. For all senior citizens either applying for first time registration or for replacement of old or lost IDs shall do so personally at the OSCA center or at designated times and places in their respective barangays so that their photographs may be taken. CSWDO Barangay Health Workers shall assist the registration and/or replacement of IDs and take the photographs of senior citizens who for reason of infirmity can no longer go to the OSCA or at the designated time and place in their barangays.

SECTION 10. Benefits Exclusive to Naga City OSCA ID Bearers. Even as presentation of any proof of senior citizenship entitles the bearer to the benefits and privileges enumerated in RA 9994 and issuances of various government agencies, only Naga City new OSCA ID bearers shall be entitled to free movies at SM City and such other designated cinemas, as well as the additional one thousand pesos (P1,000.00) burial benefits, and such other benefits that Naga City may later grant over and beyond those provided in RA 9994.

SECTION 11. Wait Time. The new IDs shall be available upon registration at the OSCA or at most fifteen working days from the time the application for first time registration or for replacement is filed at the OSCA or at designated centers in the barangay.

SECTION 12. Funding. The cost for the new IDs either for new applicants or replacements within 2015 shall be charged to the Mandatory Appropriation of the 2014 Surplus (Ordinance No. 2015-042). Beginning 1 January 2016 the cost for the new IDs either for new applicants or replacements shall be borne by the 2016 annual budget and so forth.

SECTION 13. Effectivity. This ordinance shall become effective fifteen days after publication.

WHEREAS, in response to the years of clamor raised by CASURECO II members-consumers to the National Electrification Administration (NEA) for the removal of Mrs. Jane Barrameda as OIC General Manager of CASURECO II, the NEA appointed Dr. Bernadette Gavino-Gumba as CASURECO II General Manager effective October 20, 2014;

WHEREAS, in accordance with the policies and procedures of the NEA, an electric cooperative General Manager is required to enter into a one-year Performance Management Contract (PMC) stipulating therein the parameters by which the performance of such general manager shall be evaluated to determine whether the appointment as such will be made permanent;

WHEREAS, under the said PMC, the following targets were set to measure Dr. Gavino-Gumba’s accomplishments: TARGET

WHEREAS, under the said PMC, CASURECO II shall create a committee to assess/evaluate the performance of Dr. Gavino-Gumba under the aforementioned parameters and send the result of its evaluation through a Board Resolution and NEA will conduct a validation thereof;

WHEREAS, on September 29, 2015, the NEA Administrator, Ms. Edita S. Bueno, sent a letter to the CASURECO II Board of Directors in response to CASURECO II Board Resolution No. 2015-079B which appointed themselves as the Committee for the Evaluation of the Performance of Dr. Gavino-Gumba and Resolution No. 2015-113 which conveyed to the NEA an unfavorable evaluation of the performance of Dr. Gavino-Gumba. A copy of this letter is hereto attached as Annex “A” for immediate reference;

WHEREAS, as contained in the said September 29, 2015 letter of the NEA Administrator, the unfavorable result of the evaluation of the performance of Dr.+ Bernadette Gavino-Gumba were based on an alleged failure to meet three major parameters as follows: Parameter Target 2014 2015 (Jan-June)

WHEREAS, based on the records of the CASURECO II, the aforementioned result of the evaluation of performance of Dr. Gavino-Gumba appears to be erroneous and unfair in view of the following:

1. The entire performance of CASURECO II for the year 2014 were all attributed to her when in fact Dr. Gumba assumed office only on October 20, 2014;

2. The performance for the year 2015 was measured much earlier (January to June, 2015) than what should have been (January-October 19, 2015), thereby failing to take into consideration the considerable change/improvement in the performance of CASURECO II for July, August, and September 2015;

3. If the performance of Dr. Gumba for just the additional

months of July August and September were considered, a significant improvement would have been noted as the result of operations in these two months were so good that the resulting annual average would show a marked improvement. As culled from the Attached as Annexes “B” and “C” which are records of the result of CASURECO II operations clearly show the following:

average result of a 12-month operation period. Thus, if measured only for a half year, the resulting figure will definitely not speak of the true result;

5. The other areas of operations of CASURECO II have likewise shown marked improvement as follows:

1. Provision of Sinking Fund for capital expenditure, consumer PB deposit, and Retirement Fund for employees which before Dr. Gumba was inexistent;

2. Reduction of Non-power/overhead cost;

3. Low power rates for consumers

6. As contained in the letters sent by Dr. Gumba to the NEA, dated October 5, 2015 and October 13, 2015, it was utterly and grossly unfair that the entire performance of CASURECO II will be attributed entirely to her when in fact her decisions are subject to the approval of two other decision-makers in the CASURECO II, i.e., the Board of Directors and the NEA Project Supervisor Atty. Veronica Briones.

WHEREAS, among all the other persons who served as head of the management of CASURECO II, Dr. Gavino-Gumba epitomizes the leader who truly listens and responds to the aspirations of the people she serves and meaningfully engages them through transparency and participatory mechanisms;

WHEREAS, it will be such a great loss if a leader, like Dr. Bernadette Gavino Gumba, will be denied the opportunity to serve and serve longer the members-consumers of CASURECO II especially if such denial would be based on a performance evaluation that is erroneous and unfair.NOW THEREFORE, on motion of Hon. WHEREAS, on September 21, 2015, in response to the aforementioned Resolution, the National Electrification Administration (NEA) furnished the Sangguniang Panlungsod of Naga with the Report of the NEA Audit Department on the subject matter;

WHEREAS, clear from the Audit Report of the NEA Audit Department that the transactions involved in securing the insurance policies for the years 2011 to 2013 were anomalous as such transactions not only violated required legal procurement procedures but the insurance policies were also inexistent;

WHEREAS, among the recommendations contained in the said

NEA Audit Report is the motu proprio conduct of administrative proceedings which must be undertaken against those who appear liable for the aforementioned anomalous transactions;

WHEREAS, in order that future anomalies in the affairs of CASURECO II may be deterred and prevented, it is urgent and imperative that those who appear responsible and liable for the anomalous transactions as found by the NEA Audit Department be correspondingly and immediately proceeded against;

WHEREAS, it is within the authority of the National Electrification Administration (NEA) to motu propio proceed administratively against the officers of electric cooperatives in order to ensure compliance with law and protect the interest of the public;

WHEREAS, the immediate action of the National Electrification Administration on the recommendation of its own department will surely show that, indeed, the road that government offices are taking under the present government administration is the “Matuwid na Daan”.

WHEREAS, received by the Sangguniang Panlungsod for appropriate action is Resolution No. 2015-001 of the Nagueño Youth Parliament, entitled: “A resolution expressing to the City Government of Naga the aspirations of the Nagueño Youth and its recommendations on the areas of Health and Nutrition, Housing and Urban Poor, Education, Arts and Sports, Livelihood and Business, Peace and Order, Public Utilities, Cleanliness and Environment, and Transparency, Accountability, and Good Governance”;

WHEREAS, in the field of Housing and Urban Poor, the Nagueño Youth Parliament recommended the declaration of the month of April as Urban Poor Celebration wherein the NYP shall conduct volunteerism on urban poor activities throughout the year but the culminating activity will only be held in the month of April;

WHEREAS, given this intent, the Nagueño Youth Parliament should consider coordinating with existing similar initiatives like the Ginhawang Nagueñ Program, the Happy Youth Movement in Naga (HYMN), and the City Youth Officials Program in order to establish a coordination mechanism for youth program of the city government;

WHEREAS, finding the same to be in order and necessary in the furtherance of the city’s Socialized Housing Program;

WHEREAS, received by the Sangguniang Panlungsod for appropriate action is the 1st Indorsement dated July 6, 2015 from His Honor, the City Mayor, requesting authority to enter into a Deed of Usufruct on the Land with Exchange of Building with the Cooperative Development Authority (CDA), and for ratification of the said Agreement;

WHEREAS, in October 20, 1997, the Cooperative Development Authority (CDA) constructed a concrete building covering an area of 600 square meters that forms part of the Naga City Hall Building as CDA Regional Office for Bicol Region by virtue of a Deed of Usufruct;

WHEREAS, the status and results of the 2014 CBMS show that out of 27 barangays of the city, only 15 barangays with complete data, or out of the total 25,000 households, there is still around 10,000 households with incomplete CBMS data;

WHEREAS, report further shows that there is a problem in the system of the National Anti-Poverty Commission (NAPC) that causes the delay in the downloading and processing of CBMS data;

WHEREAS, finding the importance of such information in local planning and project implementation, it is imperative for the National Anti-Poverty Commission (NAPC) to immediately act on this matter in order to make available the CBMS data and information that still need to undergo community validation;

WHEREAS, such resolution was adopted because over the past few weeks, the airwaves had been filled with news items and media commentaries concerning an allegedly anomalous property insurance purchased by CASURECO II from Liberty Insurance Corporation;

WHEREAS, in the said news items and media commentaries, it was revealed that the said insurance supposedly for the purpose of equipping CASURECO II with funds necessary to repair/replace distribution lines and facilities destroyed by natural calamities;

WHEREAS, in the said news items and media commentaries, it was further revealed that CASURECO II discovered the alleged anomaly when, on the aftermath of Typhoon Glenda, its request for payment was refused by the said insurance company on the ground that no such insurance policy was ever issued by it;

WHEREAS, the said anomalous transaction, if true, is gravely prejudicial to public interest as it seriously undermined the capacity of CASURECO II to immediately respond to the needs of its members-consumers in times of calamities;

WHEREAS, on July 14, 2015, CASURECO II General Manager Bernadette G. Gumba, Ph.D, CPA, appeared before the Sangguniang Panlungsod and clarified that the involved amount of policy insurance is some 16 Million Pesos and not 27 Million Pesos, and informed that in view of the fact that the issue is now subject of an audit by the National Electrification Administration (NEA), it will be best if specific information on this matter be provided after the result of the audit;

WHEREAS, in view of the magnitude of the possible impact of the aforementioned issue on the members-consumers of CASURECO II, transparency and public accountability demands that accurate information on the matter be made available to them;

NOW, THEREFORE, on motion of Hon. Mila S.D. Raquid-Arroyo, seconded by Hon. Jose A. Tuason;

WHEREAS, on July 2, 2015, a public consultation on the proposed septage facility project of the MNWD was conducted at the Naga City People’s Hall, City Hall Compound, Naga City;

WHEREAS, on July 3, 2015, a Joint Report on the results of the said consultation was submitted to the Sangguniang Panlungsod of the Naga by the City Environment and Natural Resources Officer, the City Budget Officer, and the City Planning and Development Officer;

WHEREAS, a contained in the aforementioned Joint Report, the following serious concerns were raised in the said consultation but were not satisfactorily responded to or were left unresolved, to wit:

1. The MNWD failed to present alternative options considered by it in responding to the problem sought to be responded to by the proposed project. A good solution is one chosen from several options using a set of parameters or criteria. No such options or criteria were presented;

2. There is no reasonable basis for the very short (5-year) recovery period for the P12.6 Million outlay for equipment (about 50% of the total). Adopting a longer period for cost recovery will certainly lighten the burden of the consumers;

3. The proposed rate, which is P2.72/cu.m. rate, is much higher than the rate (P1.83/cu.m.) presented by the MNWD when City Ordinance No. 2014-076 was still being deliberated upon. What accounted for the difference?

4. A flat rate for recovering project cost is not to the best interest of the consumers. A more reasonable rate is one that diminishes within the span of the recovery period;

WHEREAS, in recognition of the fact that responding to the urgent need for septage facility is a joint responsibility of local governments and the water districts, Naga City Ordinance No. 2014-076 strongly encourages the partnership between the City Government and the MNWD in undertaking the septage project, however, MNWD’s proposal has totally disregarded this partnership thrust enshrined in the said Ordinance;

WHEREAS, it is to the best interest of the public if the aforementioned concerns are fully responded to before the proposed septage project of the MNWD is acted upon and such response be presented in another public consultation.

WHEREAS, the LGU of Naga City has been in attendance on the five regional workshops organized in June 2013 and December 2013 in Bangkok, Thailand, in June 2014 in DA Yang, Vietnam, in November 2014, in Ulaanbaatar, Mongolia and recently last June 17-19, 2015, in Chiang Mai, Thailand;

WHEREAS, the City of Naga is one of the member-cities that tends to share its experiences in developing nexus projects and together with other member-cities have committed to realize this Nexus Partnership Declaration, to wit;

a) To raise the level of ambition at the local level to design and implement programs and projects applying Nexus principles;

b) To strengthen local governance by creating an enabling environment for various departments to work together;

c) To develop and implement initiatives to increase various stakeholder’s awareness of the nexus approach and its underlying principles;

d) To continuously and actively engage with other cities to share nexus experiences and lessons learnt, and to replicate successes where possible, and;

e) To create multi-stakeholder platforms for discussions and dialogue in order to jointly identify solutions and enabling factors in the nexus sectors;

IN PURSUANCE OF THE ACCOUNTABILITY and transparency thrust of the city government which is a primordial element in making intelligent decisons not only among policymakers, but more so among the constituents and other stakeholders who are after all the reason for Naga’s existence, City Mayor John G. Bongat ordered the publication of the city’s official gazette which shall henceforth serve as the journal of the city goverment.

As such, the Naga City Official Gazette will publish (1) all important LEGISLATIVE acts and resolutions of the Sangguniang Panlungsod which are public in nature; (2) all executive and administrative orders and proclamations, except those having no general applicability; (3) such documents or classes of documents as may be required so to published by law; and (4) such documents or classes of documents as the City Mayor of the Sanggunian shall determine from time to time to have general applicability and legal effect, or which they may authorize so to published.

Additionally, official reports, researches, paper presentations, including copies of privilege speeches and official communication and correspondence, as may be deemed urgent for the public to know, may also be given space. The furtherance of transparency, accountability and unrestrained public debate and discussion as hallmarks of good governance and true democracy will be the primary goal of this publication.

“Gazette” comes from the word gazetta, a Venetian coin used to buy early Italian newspapers. The word later on was loaned into English to describe a newspaper.

In came to be used for an official goverment paper with the creation of the London Gazette, first published in 1665 under the title of The Oxford Gazette.

In the Philippines, the Official Gazette first appeared on August 23, 1898, ten days after the Battle of Manila when the Spanish surrendered to the Americans. Since then, it became an American era periodical. Today, the Gazette is traditionally referred to as the official organ of the Philippine government.

Naga City, for its part, is once more breaking through a new era where new city administration promises to make good governance even better.
