Time is flying by this fiscal year… I can't believe my presi-dency is nearing the end al-ready! September is around the corner and Mr. Vance Brinker-hoff will be taking over the helm soon.

At our last general membership meeting, it was fun to watch and listen to all the nominees selected to run for the various board positions and speak to our membership. And learning of the nominees for the various awards in-

cluding REALTOR®

of the Year, Affiliate of the Year and

Rookie of the Year is always an interesting competition to watch. All are deserving and I applaud you for stepping up and your willingness to serve.

It takes some courage to get up in front of 100+ of your peers on a microphone to present why each feels they are deserving of your vote. Well done to the 2017 nominees! With that, there were many more members who were se-lected to interview for a board position, but may not have made this year's nominee slate. Please don't be disappoint-ed. To be called to interview says a lot that you stand out among your peers so if you are one of those folks, please consider doing it again the next time the call comes in.

REGISTRY DEADLINE: *2 Calendar Days PRIOR to the scheduled course or event, by 11:59PM (Midnight). Anyone registered after the pre-registration deadline will be considered a LATE registry and will be required to pay full price prior to attending the activity.

NO SHOWS: Anyone registered for a course or event and they do not attend or fail to cancel their registration PRIOR to the registration deadline will be billed $10.00 as a No Show fee.

CANCELLATIONS: Cancellations must be called into the Association office or emailed to [email protected] PRIOR to the registration deadline to avoid the $10.00 No Show fee.

All students registered for an RAIRC CEU course will receive an email confirmation at least 2 days prior to the scheduled course. If you have not received a confirmation email by that time, please contact the Association to confirm your registration. If you are not on the registration roster the day of class, you will be required to pay a Late Registry fee (see above for fee information)

We will be implementing the use of membership cards starting August 1, 2016. The purpose of the

membership card is to completely remove the sign-in sheet and prevent errors. The benefit of using your

membership card is for electronic registration and easy transfer of credits. RAIRC membership cards will

be required when attending classes. If your membership card is not present, a photo ID will be required when

signing in and out manually.

Becky Goodner was born and raised right here in Vero Beach, FL. She takes pride in her community and enjoys giving back when she can. She is currently working with 

the Education Foundation of Indian River County, collecting donations of school supplies for Vero Beach Elementary for the upcoming 2016‐2017 school year. 

Becky has been a part of our Vero Beach team for over 4 years now. She was originally hired with little Real Estate experience as an Escrow Assistant in 2012, however her background in exceptional customer service made her a perfect fit for First American. She quickly learned the ins and outs of Title & Escrow and has received multiple

United States.

Case #4-3: Disclosure of Family Interest ily Interest

(Revised Case #13-4 May, 1988. Transferred to Article 4 November, 1994.)

REALTOR® A listed Client B’s home and subsequently advised him to accept an offer from Buyer C at less than the listed price. Client B later filed a complaint against REALTOR® A with the Board stating that REALTOR® A had not disclosed that Buyer C was REALTOR® A’s father-in-law; that REALTOR® A’s strong urging had convinced Client B, the seller, to accept an offer below the listed price; and that REALTOR® A had acted more in the interests of the buyer than in the best interests of the seller. At the hearing, REALTOR® A defended his actions stating that Article 4 of the Code requires disclosure when the purchaser is a member of the REALTOR® ’S immediate family, and that his father-in-law was not a member of REALTOR® A’s immediate family. REALTOR® A also demonstrated that he had presented two other offers to Client B, both lower than Buyer C’s offer, and stated that, in his opinion, the price paid by Buyer C had been the fair market price. REALTOR® A’s defense was found by the Hearing Panel to be inadequate. The panel concluded that Article 4 forbids a REALTOR® to “acquire an interest in” property listed with him unless the interest is disclosed to the seller or the seller’s agent; that the possibility, even remote, of REALTOR® A’s acquiring an interest in the property from his father-in-law by inheritance gave the REALTOR® a potential interest in it; that REALTOR® A’s conduct was clearly contrary to the intent of Article 4, since interest in property created through a family relationship can be closer and more tangible than through a corporate relationship which is cited in the Code as an interest requiring disclosure. REALTOR® A was found to have violated Article 4 for failing to disclose to Client B that the buyer was his father-in-law.

MLS Statistics

Statistics developed by the REALTORS Association of Indian River County through its

Multiple Listing Service and in conjunction with Florida REALTORS reflect the following for May 2016/2015. The Residential closed sales of single family detached

homes totaled 253 units for May 2016. This compares to a total of 285 units in May 2015. The median price of single

family detached homes sold by members of the REALTORS Association of Indian River County MLS for May 2016 was $204,000. This compares to a median price

of $214,000 for May 2015. Current active inventory of residential single family detached homes total 1293 for

May 2016. This compares to the active inventory of 1257 for May 2015.

The Residential closed sales of condominium homes

totaled 93 units for May 2016. This compares to a total of 95 units in May 2015. The median price of condominium homes sold by members of the REALTORS Association of Indian River County MLS for May 2016 was $160,500.

This compares to a median price of $110,000 for May 2015. Current active inventory of condominium homes

total 329 for May 2016. This compares to the active inventory of 329 for May 2015.

NAR took a forceful step against patent trolls in May by filing a petition with the U.S. Patent Office challenging the validity of patent claims by a company that's been threatening infringement lawsuits against several real estate companies.

For several years one company, Data Distribution Technologies, has been sending letters to real estate companies demanding payment to use old and widely available technology that the company claims infringes its patent.

Data Distribution Technologies is considered a non-practicing entity, or patent troll, because its business model is based exclusively on buying overbroad patents and sending demand or "license" letters to users of products whose technology supposedly falls under the unreasonably broad scope of the patents. The letters demand payment of a licensing fee or face an expensive, resource-consuming patent-infringement lawsuit.

NAR has also been working the patent troll issue for several years on the legislative front. The association supports legislation in Congress, including "The Innovation Act," H.R. 9, that would make it harder for patent trolls to sue companies for patent infringement and also make it easier for companies to defend themselves. Move Inc.-Zillow Lawsuit Settled

Zillow agreed to pay $130 million to settle allegations that two of its executives stole trade secrets from Move Inc., operator of realtor.com®. "We are pleased that the parties have reached an amicable resolution," NAR President Tom Salomone said in a prepared statement. NAR was a co-plaintiff in the suit, brought in 2014 against Zillow and the two executives, both former executives of Move. Move and NAR had accused the former Move executives, Errol Samuelson and Curt Beardsley, of stealing confidential documents and breaching their fiduciary duties to the company. House Examines Banking Rules

NAR expressed its support for a hearing the House Small Business Committee held June 9 to examine the burden the Dodd-Frank banking regulations have placed on small banks and rural communities. During the hearing, representatives of community banks testified that the increase in compliance requirements has impacted their ability make lending decisions based on creditworthiness.

FAA Publishes Final Commercial Drone Rule

Commercial use of drones is set to expand under the Federal Aviation Administration rule it released yesterday. The rule takes effect in August and NAR is pleased it paves the way for responsible use of small drones for commercial purposes. Despite eliminating the requirement that operators hold a pilot's license, anyone looking to fly drones commercially will still have to comply with strict requirements designed to protect people on the ground. NAR's work on this issue will continue calling for eased restrictions on a "micro" category of drones; drones in this category weigh less than four pounds and present a much smaller safety risk than certain drones in the under-55 pound category covered by the rule released today. NAR also believes there is an ongoing need for a drone strategy that allows for "beyond visual line-of-sight" flights, or those where the operator cannot physically see the drone throughout the entire operation. These flights are particularly important for aerial photography across large buildings or tracts of land. Owners Can Sue Upfront on Clean Water Ruling

Developers can sue the U.S. Army Corps of Engineers to get a definitive ruling on whether their property is subject to regulation under the Clean Water Act without first having to go through an expensive and time consuming permit process, the U.S. Supreme court ruled unanimously. The decision is consistent with what NAR and the National Association of Home Builders sought in an amicus brief they filed with the court on behalf of property owners.

“Permission To Advertise”

Permission to Advertise is a field used to indicate that you are giving other participants permission to advertise your listing in the media, billboard, other real estate books, on Facebook, or even on Craig’s list by indicating yes. There is no rule that says you must say that the listing belongs to another broker. The default is no, but you do have the option to change to yes. If you find that someone is advertising without your permission you might want to check your answer of this field on your listing

“Second Unbranded Virtual Tour Link” Now available for input is a second virtual tour link for a second URL to another unbranded virtual tour for your listing. The 2nd tour could be a tour of the outside or a 3D tour of the property. Photos for maximum quality, upload photos at least 1024x768 pixels in size.

“REALTORS® Property Resource Program”

Soon to be available , REALTORS® Property Resource (RPR) is owned and operated by National Association of Realtors® as a RAIRC member benefit for all Realtors®. Only Realtors® can access RPR. A single entry point for data simplifies the process. The data entry and collection platform would comply with RESO standards, ensuring the quality of data across the industry. Brokers can more easily control where and how listing information is displayed. RPR gathers available data on a property and organizes it for your benefit. Customizable reports for any property will be available from your IOS or Android device. Send reports directly to your clients, with your branding and your own notes and photos. “Reporting NON-MLS Property as Sold for Comps”

A $30 fee for listing entry by Association staff applies to and includes Non-MLS property when entered and reported as sold in the MLS for comparable purposes. A sold property will be allowed to be entered when sold by an MLS Participant firm when the following criteria is met and documentation is provided by mailing to RAIRC MLS Staff for entry into the MLS. The following are required: 1. Completed MLS data input sheet with all required fields describing the property for input and fill out the sold data on the change form 2. Exterior photo of the property emailed to MLS in jpg format and 3. One of the following to support that MLS Participant participated in the sell of the property; a. Signed Buyers Brokers Agreement with Buyer of Property. b. Copy of HUD showing participating brokerage firms to the transaction. or c. Copy of the commission check form Seller/closing Agent (FSBO) or Brokerage (Non-MLS Participant) showing the requesting office participated in the transaction. 4. Payment of $30 by Visa or Master Card . All other listings reported as ‘Sold’ must have a valid listing agreement and be entered into the MLS system prior to being sold in order to be reported as a sale through the MLS. Sold transactions will only be required to send to the MLS when necessary and requested by MLS along with the listing agreement.

“Property Sub Type” The “Property Sub Type” field, if indicated as attached means that the property is connected to another home/structure, for example a condo unit. It does not mean to a garage. The garage is indicated under “Parking.”

“New and Enhanced Features in Matrix ” There are a few interface enhancement changes in Matrix designed to improve consumer experience. Just to name a few; the customer portal header and footer packages and styles will be updated to be wider to span the entire width of the portal. The previous headers were 745 pixels wide and now will be 1200 pixels. A new side-by-side thumbnail and map display will be created. This new display will be more consumer friendly report with a more info option to display the full consumer report. MLS Basic training is on July 18th from 10-noon.

How to View the Access Log

Any time someone uses their SentriCard®, contractor code or 1 day code to access the key compartment of a lockbox, the lockbox and SentriCard® records certain access information. You can view this information on the Lockbox Access Report or Lockbox Access Log.

1. Insert your SentriCard® into the Reader and Login.

2. From the Main Menu, click Lockboxes or My Lock-boxes.

3. On the Lockboxes window, click the lockbox's View Access Log hyperlink. You can also click the View Access Log hyperlink on the Edit Lockbox window.

4. The SentriLock Server will display the Access Log.

Using the Sentrilock app versus your card:

When having difficulties, please call Sentrilock (877-736-8745). They can easily troubleshoot any issues as the app does not always have signal. In some cases, the

lockbox needs to be woken up by having a card stuck into the box then it works.

If you remove the battery for more than a few minutes; or if the battery runs down completely, you may need to update the lockbox clock. Note: The lockboxes have a memory backup circuit that will retain the lockbox settings and timekeeping

system during the battery replacement.

** After replacing your lockbox battery, the internal clock on the lockbox may need to be updated if the memory backup

circuit stopped operating during the battery replacement. It is recommended to update the lockbox clock after every battery

replacement.

REGISTRATION: We appreciate your cooperation in your timely arrival as the course will begin promptly as scheduled. Due to DBPR requirements, Registration Sign-In will begin 30 minutes PRIOR to the start of ALL scheduled courses.

REGISTRY DEADLINE: *2 Calendar Days PRIOR to the scheduled course or event,

by (Midnight) 11:59PM.

Anyone registered after the deadline will be considered a LATE registry and will be REQUIRED to pay FULL PRICE prior to attending the course or event.

REGISTRATION CONFIRMATION: Anyone who registers for a course using the website, www.RAIRC.com, will receive a registration confirmation number. All students registered for an RAIRC CEU course or event will receive an email confirmation 2 days prior to the scheduled course. If you have not received a confirmation email by this time, contact the Association to confirm you’re registered. If you register after this time, you will not receive an email confirmation. If you are not on the registration roster the day of class, you will be required to pay a Late Registry fee (see below for fee information).
