Whereas, the land, specification whereof are given in “Annexure-A”to this notification, is required for public purpose, viz. constructionof Ring Road by NHAI at Village Chak Murar, Tehsil Bishnah,District Jammu ; and

Whereas, on the basis of indent prepared by Project Director,NHAI, 315/1, Jammu, a notification under section 4 (1) was issuedby Collector, Land Acquisition (SDM South), Jammu South videNo. SDM/Jmu-S/970-971 dated 12-08-2016 for land measuring69 Kanals situated at Village Chak Murar, Tehsil Bishnah,District Jammu ; and

Whereas, the Collector, Land Acquisition (SDM), South Jammu, videNo. SDM/Jmu-S/1104-05 dated 17-09-2016 has reported that thenotification issued under section 4 (1) of the J&K State Land AcquisitionAct by him was served upon the interested persons for filing objections,if any, to the proposed acquisition, but no objection was received from the

land owners/interested persons within the prescribed period as requiredunder sections 5 & 5-A of the Land Acquisition Act ; and

Whereas, the report furnished by Collector, Land Acquisition (SDM),South Jammu, vide above referred letter duly endorsed by District Collector(DC), Jammu, vide No. 502/2715/R-R-NHAI/Chak Murar/J/16/1873-76dated 13-10-2016, has been examined and it has been found that the landowners did not file any objection to the proposed acquisition ; and

Whereas, the Government is satisfied that the land particulars whereofare given above, is required for public purpose viz., for construction of RingRoad by NHAI at Village Chak Murar, Tehsil Bishnah, District Jammu ;

Whereas, the Indenting Department/Collector have expressed urgencyfor taking over the possession of the land.

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that the land measuring69 Kanals, situated at Village Chak Murar, Tehsil Bishnah, District Jammu,particulars whereof are given in “Annexure A” is required for public purposesviz. for construction of Ring Road by NHAI. Further, the Collector, LandAcquisition (SDM), Jammu is directed under section 7 of the said Act totake orders for acquisition of the said land after giving prescribed notice tothe interested person(s) as required under the Land Acquisition Act/Rules.

Further, in pursuance of section 17 of the Land Acquisition Act,Samvat 1990, it is also ordered that on expiry of fifteen days from thepublication of the notification under section 9 (2) of the said Act, theCollector will take possession of the aforementioned land in Village ChakMurar, Tehsil Bishnah, District Jammu, required for public purposes,subject to fulfillment of the conditions prescribed under section 9 (2) andsection 17-A of the Land Acquisition Act and Rule 63 of the LandAcquisition Rules.

However, the Collector concerned shall be personally responsible foridentification and proper title verification of all types of land involved in thecase for making apportionment of compensation amongst all the interested

Whereas, the land, specification whereof are given at “Annexure-A”to this notification, is required for public purpose, viz. for construction ofRing Road by NHAI at Village Kalwal, Tehsil Bishnah, DistrictJammu ; and

Whereas, on the basis of indent prepared by Project Director, NHAI,315/1, Jammu, a notification under section 4 (1) was issued by Collector,Land Acquisition (SDM), Jammu South vide No. SDMR/Jmu-S/851-57dated 12-08-2016 for land measuring 12 Kanals, 14 Marlas situated at VillageKalwal, Tehsil Bishnah, District Jammu ; and

Whereas, the Collector, Land Acquisition (SDM), South Jammu videNo. SDM/Jmu-S/1100-01 dated 17-09-2016 has reported that the notificationissued under section 4 (1) of the J&K State Land Acquisition Act by

him was served upon the interested persons for filing objections, if any, tothe proposed acquisition, but no objection was received from the landowners/interested persons within the prescribed period as required undersections 5 & 5-A of the Land Acquisition Act ; and

Whereas, the report furnished by Collector, Land Acquisition(SDM), South Jammu, vide above referred letter duly endorsed byDistrict Collector (DC), Jammu, vide No. 502/2715/R-R-NHAI/Kalwal/J/16/1862-65 dated 13-10-2016, has been examined and it has been foundthat the land owners did not file any objection to the proposed acquisition ;and

Whereas, the Government is satisfied that the land particulars whereofare given above, is required for public purpose viz., for construction ofRing Road by NHAI at Village Kalwal, Tehsil Bishnah, District Jammu ;

Whereas, the Indenting Department/Collector have expressed urgencyfor taking over the possession of the land.

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that the land measuring12 Kanals, 14 Marlas situated at Village Kalwal, Tehsil Bishnah,District Jammu, particulars whereof are given in “Annexure A” is requiredfor public purposes viz. for construction of Ring Road by NHAI. Further,the Collector, Land Acquisition (SDM), Jammu is directed under section 7of the said Act to take orders for acquisition of the said land after givingprescribed notice to the interested person(s) as required under the LandAcquisition Act/Rules.

Further, in pursuance of section 17 of the Land Acquisition Act, Samvat1990, it is also ordered that on expiry of fifteen days from the publication ofthe notification under section 9 (2) of the said Act, the Collector will takepossession of the aforementioned land in Village Kalwal, Tehsil Bishnah,District Jammu, required for public purposes, subject to fulfillment of theconditions prescribed under section 9 (2) and section 17-A of the LandAcquisition Act and Rule 63 of the Land Acquisition Rules.

Whereas, an area measuring 15 Marlas under Khasra No. 2502/1729min in Village Chotipora, Teshil Handwara, District Kupwara, was alsoacquired but possession of the said land was not taken over by the IndentingDepartment ; and

Whereas, Area Marketing Officer, Horticulture (P&M), Kupwara,vide his letter No. 82-AMO/HPM/KUP/2016/35-37 dated 28-05-2016,reported that the possession of aforesaid land measuring 15 Marlas underKhasra No. 2502 min has not been taken over by the Horticulture Planningand Marketing Department as the said land owner did not receive the landcompensation ; and

Whereas, Area Marketing Officer, Horticulture (P&M), Kupwara,has further stated that the said piece of land has lost its utility for thedepartment and that the same may be de-notified ; and

Whereas, the Collector, Land Acquisition (ADC), Handwara, vide hisletter No. ADSCH/LA/16/88 dated 11-08-2016 has stated that since thepossession of said land had not taken over by the department andcompensation not paid, the land measuring 15 Marlas may be de-notifiedfrom the acquisition proceedings ; and

Whereas, the Intending Department does not have any objection tothe proposed de-notification.

Therefore, sanction is hereby accorded, in terms of section 46 ofLand Acquisition Act read with rule 43 of Land Acquisition Rules, to thede-notification of land measuring 15 Marlas, under Kharsa No. 2502/1729min, situated in Village Chotipora, Teshil Handwara, District Kupwara,subject to the following conditions :–

1. the possession of land must not have been transferred to theacquiring department.

2. payment of compensation, if any, made to the land owners/interested person(s) shall be recovered.

Whereas, there is also urgency in taking over the possession ofthe land.

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that the land measuring43 Kanals and 06 Marlas situated in Village Chak Sardar Desa Singh, TehsilMandal, District Jammu, particulars whereof are given in “Annexure A”is required for public purposes viz. for construction of Ring Road by NHAI.Further, the Collector, Land Acquisition (SDM, South), Jammu is directedunder section 7 of the said Act to take orders for acquisition of the said landafter giving prescribed notice to the interested person(s) as required underthe Land Acquisition Act/Rules.

Further, in pursuance of section 17 of the Land Acquisition Act,Samvat 1990, it is also ordered that on expiry of fifteen days from thepublication of the notification under section 9 (2) of the said Act, theCollector will take possession of the aforementioned land in Village ChakSardar Desa Singh, Tehsil Mandal, District Jammu, required for publicpurposes, subject to fulfillment of the conditions prescribed under section9 (2) and section 17-A of the Land Acquisition Act and Rule 63 of the LandAcquisition Rules.

However, the Collector concerned shall be personally responsible foridentification and proper title verification of all types of land involved in thecase for making apportionment of compensation amongst all the interestedpersons/rightful claimants, in accordance with the relevant laws/rules inforce, while making the award.

Be it enacted by the Jammu and Kashmir State Legislature inthe Sixty-eighth Year of the Republic of India as follows :––

1. Short title and commencement.––(1) This Act may be called

the Jammu and Kashmir Persons with Disabilities (Equal Opportunities,

Protection of Rights and Full Participation) (Amendment) Act, 2017.

(2) It shall come into force from the date of its publication in

the Government Gazette.

2. Amendment of Section 46, Act No. VI of 1998.––(1) In the

Jammu and Kashmir Persons with Disabilities (Equal Opportunities,

Protection of Rights and Full Participation) Act (hereinafter referred

to as ‘the principal Act’) in Section 46––

I. For sub-section (1), the following sub-section shall be

substituted, namely :––

“(1) The Government may, by notification, in the

Government Gazette, appoint Commissioner for Persons

with Disabilities, for purpose of this Act.”

II. After sub-section (1), the following sub-sections shall be

inserted, namely :––

“(2) A person shall not be eligible for appointment

as Commissioner for persons with disabilities, unless,

he/she––

(a) must have special knowledge of practical experience

in respect of matters relating to rehabilitation of persons

with disabilities ;

(b) should not have attained the age of 65 years on the

last date of receipt of application ;

(c) possesses such other experience as may be prescribed

by the Government from time to time.

(3) In case the Commissioner appointed under this Act is

in service under the State or Central Government or any

other Institution or Organization, he/she, before entering the

office resign from such service.

(4) The Commissioner shall be appointed in the manner

as may be prescribed on the recommendations of a Search-

cum-Selection Committee consisting of following officers,

namely :––

(a) Administrative Secretary, : Chairperson

Social Welfare Department

(b) Administrative Secretary, : Member

Department of Law, Justice

and Parliamentary Affairs

(c) Director, Social Welfare, : Member(s)

Kashmir/Jammu

(d) Director, Composite Regional : Member

Centre, J&K

(e) Special Secretary to : Member-

Government, Social Welfare Secretary :

Department

Provided that initial appointment under this clause

shall be made by the Government in Social Welfare

Department by nomination amongst the persons who

fulfill the eligibility for appointment as Commissioner

for Persons with Disabilities as provided in sub-

section (2).

(5) The salary and allowances payable to the

Commissioner shall be same as to that of the Secretary

to Government.

(6) The Commissioner shall hold the office for a periodof three years or till he attains the age of sixty five years,whichever is earlier, which shall be extendable by a furtherperiod of three years and thereafter he/she shall not beeligible for reappointment/extension in service.”

III. Sub-sections (2), (3) and (4) shall be renumbered assub-sections (7), (8) and (9) respectively.

3. Amendment of Section 54, Act No. VI of 1998.––In Section54 of the principal Act, in sub-section (2),––

I. Clause (q) shall be omitted.

II. Clauses (r), (s), (t) and (u) shall be renumbered as (q),(r), (s) and (t) respectively.

III. After clause (s) so renumbered, the following clause shallbe inserted, namely :––

“(sa) The experience for appointment as Commissioner andmanner of appointment of Commissioner under Section46.”

elect a member and under Section 30 of the Representation of People Act,1951(43 of 1951), the Commission fixed different dates for various stagesof election, as under :—

(a) the 24th March, 2017 (Friday), as the last date for makingnominations ;

(b) the 27th March, 2017 (Monday), as the date for the scrutiny ofnominations ;

(c) the 29th March, 2017 (Wednesday), as the last date for thewithdrawal of candidatures ;

(d) the 12th April, 2017 (Wednesday), as the date on which a pollshall, if necessary, be taken ; and

(e) the 16 April, 2017 (Sunday), as the date before which the electionshall be completed.

3. The Commission made elaborate arrangements for conduct offree and fair poll in the constituency and issued extensive guidelines withregard to maintenance of law & order, monitoring of expenditure of thecandidates and political parties, enforcement of Model Code of Conduct(MCC) etc. Immediately on announcement of the bye- election on 09 March,2017, the enforcement of MCC was commenced by putting in place 20Flying Squad Teams (FSTs), 28 Static Surveillance Teams (SSTs), 16Assistant Expenditure observers with surveillance team, 15 VideoSurveillance Teams (VSTs) and 20 Nakas and the same have beencontinuing to operate round the clock. A total number of four GeneralObservers, one Police Observer and one Expenditure Observer have beendeployed by the Commission to oversee the conduct of elections as per theprocedure laid down.

4. The State Administration in its reports dated 16th and 17th March,2017 informed that certain elements have started anti-election campaignagainst the upcoming bye-elections, there is increase in terrorist relatedincidents and threat posters warning people to boycott poll have been foundpasted at several places, more so in South Kashmir. The State Administrationfurther requested that the situation being so challenging 300 companies(Coys.) of Central Armed Police Forces (CAPFs) would be required forconduct of bye-elections from the two parliamentary constituencies (as abye-election from 2-Srinagar PC was also simultaneously called). TheCommission took up the matter with Ministry of Home Affairs (MHA) and300 Coys. of CAPF were provided to the State Government.

5. As per the schedule, poll for bye-election from 2-Srinagar PCwas held on 09th April, 2017 but due to mob violence and unruly law andorder situation, the poll in some polling stations in 2-Srinagar PC wasdisrupted. During the poll day, many incidents were reported involving fewcasualties and many injuries and several JKSRTC vehicles deployed forbye-election were damaged.

6. To monitor the situation, the Commission held a Video Conference(VC) on 10th April, 2017 with the State’s Chief Secretary (CS), ChiefElectoral Officer (CEO), Home Secretary, Director General of Police(DGP), Divisional Commissioner of Kashmir, CAPF Coordinator and othersenior officers of the State. During the Video Conference, the StateAdministration expressed their apprehension of further escalation of violence,more casualties and more incidents of law and order, if the poll for 3-Anantnag PC was conducted on 12th April, 2017 as per schedule. TheCommission directed to send a detailed assessment report on law and ordersituation.

7. The State Administration in its report dated 10th April, 2017informed that all the four districts of Anantnag, Pulwama, Kulgam andShopian, which constitute Anantnag PC, were the worst affected duringthe last year's law and order disturbances and many militants, activelyoperating in the area, may also join the violent stone throwing crowds tofurther fuel the cycle of violence, death and destruction on the day of poll.In this background, the State Administration requested to defer the electionto the 3-Anantnag PC. As also directed during the Video Conference, CEO,J&K convened an emergency meeting of representatives of political partiesto obtain their feedback on the above issues and also those who were notable to attend the meeting, were contacted over phone by the CEO toobtain their views. The representatives of political parties expressed diverseviews and opinions about holding election to 3-Anantnag PC.

8. Keeping in view the ground situation prevailing in the valley andhaving considered the reports of the CS/DGP/ Divisional Commissioner ofKashmir and CEO that the law and order situation prevailing in the 3-Anantnag PC is not conducive to the holding of free and fair poll in theconstituency on 12th April, 2017 as scheduled, the Commission postponedthe poll for 3-Anantnag PC to 25th May, 2017 vide its Notification dated10.04.2017, expecting the law and order situation and the security scenarioin the constituency to improve and become conducive to the holding of freeand fair election.

9. A joint delegation of J&K Pradesh Congress Committee andNational Conference met the Commission on 18th April, 2017 and expressedconcerns over the deteriorating law and order situation in Kashmir valleyand the security aspects of the matter including those of the political activistsand requested the Commission to take such extra necessary and adequatemeasures to instil the confidence amongst the voters in order to ensureconduct of bye-election in a free, fair and impartial manner. Sh. MuftiTassaduq Hussain, candidate of J&K Peoples Democratic Party (PDP)from 3-Anantnag PC, sent a representation on 20th April, 2017 statingtherein that the 3-Anantnag PC bye-poll might vitiate further the disturbedatmosphere in entire Kashmir valley and requested the Commission forfurther deferment of poll for 3-Anantnag PC till improvement in the groundsituation in Kashmir.

10. The Commission directed the CS and DGP of the State on20th April, 2017 to submit a joint detailed report to identify and analyse thecauses and reasons etc. of poll violence occurred during poll day on9th April, 2017 in 2-Srinagar PC and delineate strategy to conduct free andfair election in 3-Anantnag PC. The CEO, J&K was also asked to furnishhis own assessment on the above points and suggest strategy for free andfair elections.

11. In the meantime, the Chief Secretary to the Government of J&Kin his report dated 20th April, 2017 informed that during the past few days,a number of incidents of burning of Schools/Panchayat Ghars which weredesignated Polling Stations falling under 3-Anantnag PC and attacks on thepolitical personalities have taken place and reports about the militantsharassing the Policemen and their families, to generate an environment ofinsecurity, fear and chaos have been received. The apprehension was alsoexpressed that conduct of election from 3-Anantnag PC on the scheduleddate i.e. 25th May, 2017 might witness not only large scale violence but canalso result in an even lower voter turnout. He concluded that StateGovernment is of the considered opinion that the overall security and lawand order situation in the Valley particularly in South Kashmir is not conducivefor holding the bye-election from 3-Anantnag PC on 25th May, 2017 asscheduled and recommended that the election from 3-Anantnag PC bedeferred at least up to the end of October, 2017.

12. The State Administration, in response to the Commission’s direction,in its joint report dated 21st April, 2017 submitted that in the wake of violentincidents taken place on 9 April, 2017 during bye-election from 2-SrinagarPC, a large scale security deployment is needed for conduct of bye-election

from 3-Anantnag PC. It was also reported that non-postponement of theelection from 3-Anantnag PC would severely impair the resumption ofanti-militancy operations, to effectively counter the trend of increase inmilitancy related activities, by the Security Forces/State Police during thecoming months to restore secured environment and public order for a freeand fair conduct of elections at the appropriate stage beyond October, 2017.The CEO, J&K reported that atleast four sections of CAPF should bestationed at each and every polling location to ensure free and fair election.

13. Later, a Video Conference was conducted by the Commissionon 24th April, 2017 with representatives of political parties and candidatesto assess the ground situations also those who could not attend the meeting,were contacted over phone by the CEO to obtain their views. Therepresentatives of political parties and candidates expressed mixed responsestowards holding bye-election in May, 2017; however, the majority of themrequested for further deferment of election in view of the prevailing lawand order situation.

14. On the same day another Video Conference was convened bythe Commission with the CEO, Police Nodal Officer, IGP, Kashmir, DivisionalCommissioner, Kashmir, CRPF Coordinator and the Dy.Commissioners, SSPs of Anantnag, Kulgam, Shopian and Pulwama districtsand it was informed that no political activity is taking place since 10th April,2017. The ADGP/Police Nodal Officer stated that situation in SouthKashmir is not good, overall situation is scary and not very conducive atpresent and candidates, police, civil staff on election duty are vulnerable.The IGP, Kashmir informed that 687 Coys. of CAPFs would be requiredby the State Government to guard all the 1117 polling station locationsincluding the Quick Response Teams (QRTs).

15. The Commission again directed the CEO and the StateAdministration on 27th April, 2017 to furnish latest law and order assessmentreports and security scenario with regard to Bye-election from 3-AnantnagPC by 28th April, 2017.

16. The CEO, J&K in his report dated 27th April, 2017 informedthat the main challenges would be security of polling stations, polling partiesand EVM ; the security, transportation and logistics of the large number ofCAPFs coming from outside and arranging requisite transport facilities forpolling parties and security personnel. The CEO further informed that

post-Srinagar bye-poll, number of law and order incidents has substantiallyincreased and more than 80 cases of stone pelting incidents by protestershave been reported in the Valley since 10th April, 2017. He further reportedthat there has been spurt in militancy related incidents also and 12 majorincidents have occurred in the last 21 days resulting in loss of life anddamage to property in some cases. Even today, a serious incident of ambushby certain elements resulting into casualties in Kulgam district has beenreported.

17. The State Administration in its report dated 28th April, 2017informed that separatists and anti-national elements, in addition to anti-election campaign, have launched extensive campaign on social media formobilizing the youth and also threatened the general public againstparticipation in polls by way of targeting political workers and families ofpolice officers. Certain elements have also resorted to use of force whichhas a demoralising effect on the overall environment in the area. In view ofthe above, the State Government has expressed serious apprehension offurther disturbances of law and order across the Valley and requested thatthe bye-election to the 3-Anantnag PC be deferred and scheduled afterOctober, 2017.

18. The MHA in its letter dated 28th April, 2017, on the issueof providing 687 Coys. of CAPFs for conduct of bye-election from3-Anantnag PC, informed that considering the commitments in other regionsof the country and logistics associated with proposed heavy deployment,making available such a large number of CAPFs does not seem feasible orpossible in the given time frame. Finally, the MHA in another communicationdated 28th April, 2017 informed that 250 Coys. of CAPFs shall be madeavailable to the State Government for conduct of bye-election from 3-Anantnag PC in addition to 54 Coys. of CAPFs already retained for pre-poll arrangements.

19. The State Administration has time and again reiterated its requestto further defer the bye-election to 3-Anantnag PC in view of disturbedlaw and order situation and has also demanded for additional 687 Coys. ofCAPF in the event of conduct of poll as scheduled ; however, MHA hasexpressed its inability to meet the requirement in full and has conveyed thatonly additional 250 Coys. of CAPFs can be made available.

20. The Commission has carefully examined and analysed all aspectsof the on-going bye-election from 3-Anantnag Parliamentary Constituency,in the light of the inputs received from the State Administration of Jammu

and Kashmir as well as from the Central Government in the Ministry ofHome Affairs regarding availability of requisite forces. The reports receivedfrom the State Administration of Jammu and Kashmir, including the reportsof the Chief Electoral Officer of the State and the Divisional Commissioner,Kashmir, show that there has been no noticeable improvement in the lawand order situation in the four districts of Anantnag, Pulwama, Shopian andKulgam which constitute the 3-Anantnag Parliamentary Constituency, afterthe 10th April, 2017, when the Commission deferred the date of poll in theconstituency from 12th April to 25th May, 2017. On the contrary, thesereports reveal further continuous deterioration in the situation and theincidents of stone pelting, violence and rioting have rather been on theincrease including loss of life. The apprehension expressed by the ChiefElectoral Officer that there may be reluctance on the part of the pollingpersonnel to go to the polling locations in view of the fear in their mindswith regard to their safety and security is also a matter of serious concern.

21. Further, the assessment of the police authorities of the State isthat they may be requiring additional 687 Coys. of CAPFs to provide securitycover to the polling stations, polling personnel and polling materials, apartfrom providing adequate security cover to the electorate of the constituencyto instil a sense of sufficient confidence in their minds to come out on theday of poll to go to the polling stations. The MHA has however expressedcertain constraints in making required CAPFs available in the given timeframe. They finally have committed only 250 numbers of additional Coys.of CAPFs against the estimated requirement of 687 Coys. communicatedby the State Administration. Furthermore even in the event of deploymentof 687 Coys. of CAPFs there is no assurance from the State Administrationthat the poll scheduled to be taken on 25th May, 2017 would be a peacefulaffair now, with only 250 Coys. as committed by the Ministry of HomeAffairs, it would be a bigger challenge to conduct smooth and peacefulelection.

22. In view of the prevailing ground situation and non-availability ofsufficient security forces, the Commission is of the considered view thatpeaceful, free and fair poll is not feasible on 25th May, 2017, as scheduledat present, though some political parties have asked for the same.

23. The Commission has also considered the option of furtherdeferment of the election as requested by some political parties and theState Administration. In the context of requests for deferment, the

Commission has taken note of the fact that the Holy month of Ramzan isfast approaching which will be celebrated during the months of May andJune, 2017. Further, the annual Amarnath Yatra to the Holy Shrine which,quite significantly, falls in the Anantnag District itself is due to take placefrom the last week of June till the middle of August, 2017. The StateAdministration is wholly engaged in necessary preparations for thecelebrations of these two most important festivals for the whole populationin the State, apart from the lakhs of pilgrims visiting the Holy Shrine fromall parts of the country. Besides, this period also is important tourist seasonwhich affects the whole trade, business and commerce activities ofthe State. Above all, the continuance of the Model Code of Conduct in the3-Anantnag Parliamentary Constituency covering four important districtsof the State during this peak period of festivities and tourism would alsoadversely affect the daily lives of the people of the area. Therefore, deferringthe elections further also does not seem to be a feasible option.

24. Thus, having regard to the totality of the facts and circumstancesenumerated above, and taking note of the fact that no immediate improvementin the law and order situation is in sight, the Commission is of the consideredopinion that this is not the opportune time to continue with the exercise ofthe conduct of bye-election from 3-Anantnag Parliamentary Constituency.In this context, it may be relevant to state that the Hon’ble Supreme Court,while holding in Election Commission Vs. State of Haryana (AIR 1984SC 1406) that ‘the ultimate decision as to whether it is possible andexpedient to hold the elections at any given point of time must rest withthe Election Commission’ has further observed in that case that ‘A senseof realism, objectivity and non-alignment must inform the decision ofthe Commission on such issue’.

25. Accordingly, the Commission hereby directs, under Article 324of the Constitution read with sections 149, 30 and 56 of the Representationof the People Act, 1951, and further read with Section 21 of the GeneralClauses Act, 1897 and all other powers enabling it in this behalf, that theCommission's Notifications No. 100/ECI/TERR/NOR-l/J&K-HP 2017(2)dated 17th March, 2017 and 10th April, 2017, calling upon the said3-Anantnag Parliamentary Constituency to elect a member to the Houseof the People shall stand rescinded forthwith. Consequently, all actionsand steps taken by the Returning Officer of the said 3-AnantnagParliamentary Constituency, District Election Officer, Anantnag and all otherelectoral authorities concerned are hereby declared as null and void.

SRO-135.––In exercise of the powers conferred by section 15 readwith section 23C of the Mines and Minerals (Development and Regulation)Act, 1957 (Central Act 67 of 1957), the Government of Jammu andKashmir hereby makes the following amendments in the Jammu andKashmir Minor Mineral Concession, Storage, Transportation of Mineralsand Prevention of Illegal Mining Rules, 2016 notified vide SRO-l05 dated31-03-2016, namely :––

l. In rule 33, for the figures and words “50 hectares” the figuresand words “10 hectares” shall be substituted.

2. In rule 43, the following shall be added as 2nd proviso,namely :––

“Provided further that Quarry Licence up to one hectare shallbe granted only to the residents of Jammu and Kashmir.However, in case of Government works and emergent natureworks, the Quarry Licence shall be granted to the Central/State Government Institution such as BRO, NHAI, CPWD,JKPCC etc.”.

3. In rule 52, the following shall be added as proviso, namely :–

“Provided that the mining leases through open auction up to 5hectares, shall be granted only to permanent residents of Jammuand Kashmir State, and above 5 hectares, preference will begiven to State Subject either individually or in Joint Venturewith non-residents”.

4. In rule 56 after clause (v) of sub-rule (l), the following shall beadded as “clause (vi)”, namely :––

“(vi) Short Term Permit, up to one hectare shall be grantedonly to the residents of Jammu and Kashmir. However, incase of Government works and emergent nature works, theShort Term Permit shall be granted to the Central/StateGovernment Institution such as BRO, NHAI, CPWD,JKPCC etc.”.

5. In schedule-I at serial No. 5.2 and 5.4, for the figures “25”, thefigures “20” shall be substituted.

due to law and order situation in the State from 1st July, 2016 to

31st December, 2016 subject to the condition that the owner of the

vehicle shall furnish an affidavit to the effect that his/her vehicle

actually remained off road during that period.

JAMMU AND KASHMIR STATE WOMEN’S DEVELOPMENTCORPORATION SERVICE REGULATIONS

1. Short title and commencement.—

(i) These rules may be called the Jammu and KashmirState Women’s Development Corporation Service RecruitmentRules, 2011.

(ii) These rules shall come into force from the date the rulesare notified.

2. Definitions.—In these rules, unless the context otherwiseprovides,—

(a) ‘Act’ means the Companies Act, 1956.

(b) ‘Board’ means Board of Directors of the Corporation.

(c) ‘Company’ means registered company under section 25 ofthe Act.

(d) ‘Corporation’ means J&K State Women’s DevelopmentCorporation Limited registered under Companies Act, 1956.

(e) ‘Chairman’ means Chairman of the Board of Directors.

(f) ‘Cadre’ means the cadre of service in the Corporation.

(g) ‘Employee’ means a person whether an officer or any otheremployee working against any substantive post of theCorporation.

(h) ‘Government’ means the Government of Jammu and Kashmir.

(i) ‘State’ means the Jammu and Kashmir State.

(j) ‘Managing Director’ means the person who is the ChiefExecutive of the Corporation.

(k) ‘Member of the service’ means a person appointed to a postin the service under the provisions of these rules.

(l) ‘Schedule’ means Schedule appended to these rules.

(m) ‘Service’ means J&K State Women’s Development CorporationService.

(n) ‘Appointing Authority’ means the authority empowered tomake appointments to the posts indicated in Rule 17(2).

(o) ‘Competent Authority’ means the authority to which theauthority is designated or the Board in absence of suchauthority.

3. Application of rules.— These rules shall apply to all employeesof the Corporation appointed to posts under the Corporation whethertemporary or permanent whether before or after the commencementof these rules.

4. Initial constitution of the service.—Any person who at thetime of the commencement of these rules is holding or is appointedto any post included in the cadre of the service of the Corporationin its sanctioned scale of pay and satisfies the requirement as toqualifications and experience as laid down in the rules and schedulesfor holding or being appointed to such post under these rules shall bedeemed to have been appointed to the service under rules if he/sheis fully qualified, to hold the post in a substantive capacity under theserules unless he/she opts otherwise within 15 days from the commencementof these rules.

Explanation :— The word ‘holding/appointed’ means a personholding/appointed to a post included in theschedules as its sanctioned scale of pay onsubstantively regular basis under orders of thecompetent authority and shall not cover theperson’s holding post on deputation basis or onad hoc, contractual or in a stop gap arrangement.

5. Strength and composition of the service. —(1) The authorizedstrength of the cadre and nature of the posts included therein shallbe determined by the Corporation from time to time and the compositionof the service in the Corporation shall be notified by Managing Directorseparately.

(2) The Board shall at the interval of every three years or atsuch other intervals, as may be considered necessary by the competentauthority, re-examine the strength and composition of the cadre of theservice in the Corporation and make such alternation therein as it deemfit. Provided that nothing in this sub-rule shall be deemed to affect thepower of the Board to alter the strength and composition of the cadreat any time.

(3) The Board may create temporary posts in the cadre or theservice for a specified period and purpose, as may be considerednecessary from time to time.

6. Qualification and method of recruitment.—(1) No personshall be eligible for appointment or promotion to any post in any class,

category or grade in the service of the Corporation unless he or shepossesses the qualifications as laid down in the schedules to these rulesand fulfils other requirements as prescribed therein. Provided that nothingin this rule shall be deemed to effect the power of the Board to alteror relax the qualification so prescribed in these rules.

(2) Appointment to the service shall be made—

(a) By direct recruitment (which will include appointmentby transfer) ;

(b) By promotion ; or

(c) Partly by promotion and partly by direct recruitment inthe ratio and in the manner as mentioned against eachpost in the Schedule-II ; and

(d) On contractual and consolidated basis up to a monthlywages of Rs. 3000/- for such period as may be determinedby the competent authority in the interest of the businessof the Corporation, but the same period shall not exceeda period of two years in a continuous year.

7. Age limit/record of age.—(1) The Corporation shall recordthe age of every employee at the time the employee enters theCorporation services and Matriculation Certificate shall be the satisfactoryproof of age for such posts where the minimum qualification is matricand above. The age of an employee as recorded with the Corporationat the time of employment shall not thereafter be altered.

(2) The age of recruitment will be the same as prescribed bythe Government from time to time.

(3) A person who has not attained the prescribed age or whoseage exceeds the prescribed age limit, shall not ordinarily be admittedinto the service of the Corporation, provided that the competent authoritymay for reasons to be recorded, relax the age bar in individual casesup to a period of two years with prior approval of the Board.

8. Probation.—Persons appointed to the service either by directrecruitment or by promotion shall be on probation or trial for a periodof two years and their confirmation in a category or grade shall bemade subject to the passing of any training or departmental examinationas may be prescribed by the Corporation.

9. Training and departmental examination.—Persons appointedto the service by competitive examination may be required to undergosuch training from time to time during the course of service and topass during the period of probation or trial such departmental examinationas the Corporation may prescribe :

Provided that the Competent Authority may exempt whetherwholly or partly from such training or departmental examination personswho have passed a departmental examination or undergone trainingdeclared by the Corporation to be equivalent to a departmentalexamination or training, if any, prescribed under these rules.

10. Method of promotion.—Promotions to posts covered underthese rule shall be made by the competent authority in accordance withrules governing such posts on the basis of merit and suitability withdue regard to seniority and on the basis of the recommendations ofthe Departmental Promotion Committee.

11. Constitution of Selection Committee.—The Board mayconstitute or authorize constitution of such committee for directrecruitment to the posts belonging to various cadres as it may deemfit from time to time.

12. Constitution of Departmental Promotion Committees.— TheBoard may constitute or authorize constitution of such committee fordirect recruitment to the posts belonging to various cadres as it maydeem fit from time to time.

13. Maintenance of seniority lists.—(1) Seniority shall bedetermined by the order in which appointments are made to any class,category or grade of posts, provided that where more than one personare selected simultaneously for the same class, category or grade bya Selection Committee, the seniority of such persons, shall be as

recommended by the Selection Committee either specifically or byindicating the order of precedence.

(2) In case of departmental promotions, seniority of any employeein a class, category or grade shall be from the date of his promotionto that category or grade.

(3) When more than one employee is promoted on the same date,their relative seniority shall be determined on the basis of the meritlist prepared at the time of their selection for promotion. Whenemployees have been placed in equal position in the merit list, thentheir relative seniority shall be determined with reference to theirseniority in the immediate lower grade held previously by them.

14. Reservation in appointments.—While making appointmentseither by promotion or by direct recruitment reservation shall be madein accordance with the rules and orders issued by the Govt. from timeto time in respect of the members of Scheduled Caste/Scheduled TribesCategory/Backward Classes or may other category.

15. Power to issue instructions.— The Board of Directors ofthe Corporation may from time to time issue such directive(s) orinstruction(s) as may be necessary for the purpose of carrying out theprovisions of these rules.

16. Interpretation.—If any question about the interpretation ofthese rules arises, the decision of the Board of Directors shall be finaland binding.

17. Repeal and saving.—(1) All rules corresponding to these rulesand in force immediately before the commencement of these rules arehereby repealed.

(2) Notwithstanding such repeal, any appointment, order made oraction taken under the provisions of the rules so repealed shall bedeemed to have been made or taken under the corresponding provisionsof these rules.

18. Miscellaneous.— (1) With regard to all matters governingthe service conditions of the members of service like seniority, conduct,

discipline etc., the provisions of the J&K Civil Services (Classification,Control and Appeal) Rules, 1956, J&K Govt. Servants Conducts Rules,J&K Govt. T. A. Rules, J&K Civil Service Leave Rules and generalorders regarding reservations for J&K State Women’s DevelopmentCorporation for the time being in force, shall be applicable mutatismutandis to the employees of the Corporation.

(2) The powers exercisable and vested in the Government andHeads of the Departments under the aforesaid rules shall be exercisedand vested in the Chairman/Chairperson and Managing Director of theCorporation respectively.

(3) The Board may relax any provision of these rules or grantany concession outside rules in such cases wherein the opinion of theBoard, the rules apply harshly and require relaxation/grant of concessionsin the interest of the working of the Corporation.
