The BPR&D is undertaking a research study titled "A Study of FactorsResponsible for Recidivism", through the National Forensic Sciences University,Gandhinagar, Gujarat.

2. For the purpose of collection of data, statistical analysis of data, and othertasks related to research work, the BPR&D is looking for young, qualified, innovativeand dynamic Young Professionals (YPs)/Research Assistants (RAs), as per detailsgiven below:

8. Job description 1. Collect primary and secondary data for theresearch study.

2. Conduct statistical analysis of the collecteddata for the research study.

3. Prepare and submit consolidated progressreport of the research study to the supervisoryofficer/ MOB Committee/BPR&D.

4. Make presentation(s) on the progress of datacollection and analysis and preparation of thedraft report of the research study.

5. Prepare final report of the research studyunder the supervisory officer/ MOBCommittee/BPR&D.

6. Any other task as assigned by the supervisoryofficer/ MOB Committee/BPR&D or theResearch & Correctional AdministrationDivision, BPR&D.

9. Mode of Engagement: All the applications received within the stipulated timeshall be scrutinized and shortlisted by a Screening Committee. The shortlistedcandidates would then be interviewed by the Consultancy Evaluation Committee(CEC). Shortlisted candidates are required to carry original documents at the time ofinterview. The joining of the selected candidates shall be subject to satisfactoryverification of original documents by the BPR&D.

10. Submission of Applications: Eligible candidates are required to sendscanned copies of completed application form along with self-attested documents (asrequired) at email id: [email protected]. 11. Last Date for Receipt of Applications: The last date for receipt ofapplications in the BPR&D is seven (07) days from the date of advertisement. Anyapplication received after the due date/ time shall be rejected.

12. Working Hours/ Leave: Working hours shall normally be from 9.30AM to 6.00PM during working days including half an hour lunch break in between 1.30 pm to 2.00pm. However, in case of exigency, the YPs/RAs may be required to sit late and maybe called on Saturdays/ Sundays and other holidays also. The YPs/RAs will be eligiblefor six (06) days paid leave during the period of seven (07) months, subject to theapproval of the Controlling Officer.

13. The YPs/RAs will be governed by the Official Secrets Act, 1923, as amendedfrom time to time and will not disclose to any unauthorized person(s) anyinformation/data that may be supplied to them during the period of their stay in theBPR&D. All such documents will be property of the BPR&D.

14. This is NOT an offer for employment in the BPR&D and is solely related toworking for the aforementioned research study. This opportunity DOES NOT confirmany right to the Young Professional to any position or job in the BPR&D or anypreference in employment after the expiry of this contract based hiring of services oranytime in future.

15. The BPR&D reserves its right NOT TO ENGAGE any candidate in responseto the advertisement and this is only an invitation to young persons to apply for theposition of YPs/RAs.

16. Police Verification: Police verification of the YPs/RAs shall be done as perthe latest instructions issued by the MHA. In case, an adverse input is received in thecourse of the police verification, the contract shall cease to exist with immediate effectwithout any notice.

17. The YPs/RAs engaged shall continue to be governed by the terms andconditions of the NITI Aayog guidelines, dated 29.07.2020 (Annexure-1), till theexpiry of the existing contract. Any extension will be subject to the new guidelines, ifany.

18. The candidates will be required to make a presentation about howwell versedthey are, with reference to research methodology and related matters and how theycan contribute towards the same. They will be assessed on a scale of 0-100 on thebasis of their academic performance and their presentation to assess them on qualityindex.

19. A list of all candidates shall be prepared in the descending order of theirscores, with candidates obtaining highest quality index being kept at the top. Selectionof candidates will be made on the basis of their scores.

20. In case, the selected candidate(s) is unwilling to work or the selectedcandidate(s) wishes to leave the BPR&D, after giving one-month prior notice, thecandidate who is next in the merit list will be given the offer for the remaining periodof contract.

21. TA/DA: In case of domestic tours undertaken by YPs/RAs, subject to theapproval by the Competent Authority, TA/DA shall be allowed as per Para 7 of the NITIAayog's guidelines, dated 29.07.2020, on engagement of YPs.

22. YPs/RAs are required to submit a Certificate of Good Health from arecognized physician, prior to commencement of work at the BPR&D.

23. No disclosure shall be made to any person by the YPs/RAs as to the contentsof the research work and tentative inferences drawn therefrom, without the priorapproval of the DG, BPR&D.

24. This engagement shall be subject to the applicable laws and regulations of Indiafrom time to time.

25. All disputes, if any, arising out of this contract shall be subject to the jurisdiction ofthe competent courts of Delhi/ New Delhi.

NOTE: The contractual terms and conditions of engagement of the YoungProfessionals/Research Assistants will be according to Para 3 of the NITI Aayog'sGuidelines on Engagement of YPs, dated 29.07.2020 (Annexure-1), as revised fromtime to time.

Subject: Procedure and guidelines for engagement of Gonsultants/Senior Consultants/ /Young Professionals in NlTl Aayog.

ln supersession of "Procedure and Guidelines for engagement ofConsultants/ Senior Consultants in NlTl Aayog" dated 01.08.2018, thefollowing guidelines and procedures are being prescribed for engagement ofConsultants/Sr. ConsultantsfYoung Professionals in NlTl Aayog until suchtime as these guidelines are amended or new guidelines issued. Theseguidelines will come into effect from the date of issue.

1. Purpose and Scope of Application

1.1 The NlTl Aayog is committed to cooperative federalism, promotion ofcitizen engagement, access to opportunity, participatory and adoptivegovernance and increasing use of technology to provide critical directional andstrategic inputs into the development process. NlTl Aayog is also mandated tofunction as a think tank, which requires greater flexibility in hiring of personnelthan was the case under the erstwhile Planning Commission. lt is essential tohave the Young Professionals/Consultants/Sr. Consultants who possess therequisite skill set. These Young Professionals/Consultants/Sr.Consultants will be expected to deliver in such areas where in-houseexpertise is not readily available within the framework of NlTl Aayog. Theyshould be high quality professionals, capable of lending their expertise in thefields such as Economics, Finance, Education, Public Health, Social Sciences,Engineering, Urban Planning, lnfrastructure etc. as per the requirements ofNlTl Aayog.

1.2 The General conditions of Contracts for the services of YoungProfessionals/Consultants/Sr. Consultants will be incorporated into theirindividual contracts.

2. Definitions: The following definitions apply for the purpose of the presentinstructions:

2.1 "lndividual consultant or service provider" means Young Professionalor Consultant Grade- 1 or Consultant Grade- 2 or Senior Consultantdepending upon their experience. lndividual Consultants or service providersare recruited for similar activities as Consultancy/Service providing firms when

a full team is not considered necessary. They may be independent experts notpermanently associated with any particular firm, or they may be employees ofa firm recruited on an individual basis. They may also be employees of anagency, institution, or university. They are normally recruited for projectimplementation supervision, provision of specific expert advice on a highlytechnical subject, policy guidance, special studies, compliance supervision,training, or implementation monitoring. lndividual consultants/service providersare not normally recruited for project preparation unless the proposed projectis simple and, generally, a repeat of an already established and successfulproject.

2.2 "Consultancy Services" covers a range of services that are of anadvisory or professional nature and are provided by consultants. Theseservices typically involve providing expert or strategic advice e.g.management consultants, policy consultants or communicationsconsultants. Advisory and project related Consultancy services which include,for example feasibility studies, project management, Engineering services,Architectural services, finance accounting and taxation services, training anddevelopment.

3. Contractual terms and conditions

3.1 Legal Status: The lndividual Consultant shall have the legal status of anindependent Consultant vis-d-vis, NlTl Aayog and shall not be regarded, forany purposes, as being either a "staff member" of NlTl Aayog, or an "official"of NlTl Aayog. Accordingly, nothing within or relating to the Contract shallestablish the relationshi o of empl o er and em D lo ee or of principal and agent,between NlTl Aayog and the lndividual Consultant.

3.2 Standards of Conduct:

3.2.1 ln General the lndividual Consultant shall neither seek nor acceptinstructions from any authority external to NlTl Aayog in connection with theperformance of its obligations under the Contract. The lndividual Consultantshall not take any action in respect of its performance of the Contract orotherwise related to its obligations under the Contract that may adverselyaffect the interests of NlTl Aayog, and the lndividual Consultant shall performits obligations under the Contract with the fullest regard to the interests of NlllAayog. The lndividual Consultant warrants that it has not and shall not offerany direct or indirect benefit arising from or related to the performance of theContract or the award thereof to any representative, official, employee or otheragent of NlTl Aayog. The lndividual Consultant shall comply with all laws,ordinances, rules and regulations bearing upon the performance of itsobligations under the Contract. ln the performance of the Contract thelndividual Consultant shall comply with the standards of Conduct. Failure tocomply with the same is grounds for termination of the lndividual Consultantfor cause.

3.2.2Prohibition of Sexual Exploitation and Abuse: ln the performance ofthe Contract, the lndividual Consultant shall comply with the "SexualHarassment of Women at Workplace (Prevention, Prohibition and Redressal)Act, 2013". The lndividual Consultant acknowledges and agrees that anybreach of any of the provisions hereof shall constitute a breach of an essentialterm of the Contract, and, in addition to any other legal rights or remediesavailable to any person, shall give rise to grounds for termination of theContract. ln addition, nothing herein shall limit the right of NlTl Aayog to referany alleged breach of the foregoing standards of conduct to the relevantnational authorities for appropriate legal action.

3.3 Title Rights, Copyrights, Patents and Other Proprietary Rights:

3.3.1 Title to any equipment and supplies that may be furnished by NlTlAayog to the lndividual Consultant for the performance of any obligationsunder the Contract shall rest with NlTl Aayog, and any such equipment shallbe returned to NlTl Aayog at the conclusion of the Contract or when no longerneeded by the lndividual Consultant. Such equipment, when returned to NlTlAayog, shall be in the same condition as when delivered to the lndividualConsultant, subject to normal wear and tear, and the lndividual Consultantshall be liable to compensate NlTl Aayog for any damage or degradation ofthe equipment that is beyond normal wear and tear.

3.3.2 NlTl Aayog shall be entitled to all intellectual property and otherproprietary rights, including, but not limited to, patents, copyrights andtrademarks, with regard to products, processes, inventions, ideas, know-howor documents and other materials which the lndividual Consultant hasdeveloped for NlTl Aayog under the Contract and which bear a direct relationto or are produced or prepared or collected in consequence of, or during thecourse of, the performance of the Contract, and the lndividual Consultantacknowledges and agrees that such products, documents and other materialsconstitute works made for hire for NlTl Aayog. Subject to the foregoingprovisions, all maps, drawings, photographs, mosaics, plans, reports,estimates, recommendations, documents and all other data compiled by orreceived by the lndividual Consultant under the Contract shall be the propertyof NlTl Aayog, shall be made available for use or inspection by NlTl Aayog atreasonable times and in reasonable places, shall be treated as confidentialand shall be delivered only to NlTl Aayog authorized officials on completion ofwork under the Contract.

3.4 Confidential Nature of Documents and lnformation: The lndividualConsultant would be subject to the provisions of the lndian Official SecretsAct, 1923. The lndividual Consultant shall not, except with the previoussanction of NlTl Aayog or in the bona fide discharge of his or her duties,publish a book or a compilation of articles or participate in radio broadcast orcontribute an article or write a letter in any newspapers or periodical either inhis own name or anonymously or pseudonymously in the name of any other

person, if such book, article, broadcast or letter relates to subjecr matterassigned to him by NlTl Aayog.

3.5 Use Of Name, Emblem or Official Seal of The NlTl Aayog: lndividualconsultant shall not advertise or otherwise make public for purposes ofcommercial advantage that it has a contractual relationship with Nll Aayog,nor shall the lndividual consultant, in any manner whatsoever, use tre name,emblem or official seal of Nlrl Aayog, or any abbreviation of the name of NIIAayog, in connection with its business or otherwise without the writtenpermission of NlTl Aayog.

3.6 lnsurance: The lndividual consultant shall be solely responsible for takingout and for maintaining adequate insurance required to meet any of itsobligations under the contract, as well as for arranging, at the lrrdividualconsultant's sole expense, such life, health and other forms of insurance asthe lndividual consultant may consider to be appropriate to cover the periodduring which the lndividual consultant provides services under the contract.

3.7 Travel, Medical Clearance and Service lncurred Death, lnjury orlllness:

3.7.1 Nlrl Aayog may require the lndividual consultant to submit a statementof Good Health from a recoqnized ohvsrcran prior to commencement of workin anv offices orp remises of Nlll Aavoq

3.7.2 ln the event of the death, injury or illness of the lndividual consultantwhich is attributable to the performance of services on behalf of Nl1-l Aayogunder the terms of the contract while the lndividual consultant is traveling atNlTl Aayog expense or is performing any services under the Contrar:t in anyoffices or premises of Nlrl Aayog or Government of lndia, the lndividualconsultant or the lndividual consultant's dependents, as appropriate, shall notbe entitled to any compensation.

3.8 Force Majeure and other Conditions:

3.8.1 Force majeure as used herein means any unforeseeable and irresistibleact of nature, any act of war (whether declared or not), invasion, revolution,insurrection, or any other acts of a similar nature or force, provided that suchacts arise from causes beyond the control and without the fault or negligenceof the lndividual consultant.

3.8.2 The lndividual consultant acknowledges and agrees that, with respect toany obligations under the Contract that the Individual consultant must performin or for any areas in which NlTl Aayog is engaged in, preparing to engage in,or disengaging from any peacekeeping, humanitarian or similar operations,any delay or failure to perform such obligations arising from or re ating toharsh conditions within such areas or to any incidents of civil unrest occurringin such areas shall not, in and of itself, constitute force majeure under theContract.

3.9 Termination: The NlTl Aayog can terminate the contract at any timewithout prior notice and without providing any reason for it. However, in thenormal course it will provide one month's notice to the individualconsultant. The individual consultant can also seek for termination of thecontract upon giving one month's notice to the NlTl Aayog.

3.10. Audits and lnvestigations: Each invoice paid by NlTl Aayog shall besubject to a post-payment audit by auditors, whether internal or external,ofNlTl Aayog or by other authorized and qualified agents of NlTl Aayog at anytime during the term of the Contract and for a period of two (2) years followingthe expiration or prior termination of the Contract. NlTl Aayog shall be entitledto a refund from the lndividual Consultant for any amounts shown by suchaudits to have been paid by NlTl Aayog other than in accordance with theterms and conditions of the Contract. The lndividual Consultantacknowledges and agrees that, from time to time, NlTl Aayog may conductinvestigations relating to any aspect of the Contract or the award thereof, theobligations performed under the Contract, and the operations of the lndividualConsultant generally relating to performance of the Contract. The right of NlTlAayog to conduct an investigation and the lndividual Consultant's obligation tocomply with such an investigation shall not lapse upon expiration or priortermination of the Contract. The lndividual Consultant shall provide its full andtimely cooperation with any such inspections, post-payment audits orinvestigations. Such cooperation shall include, but shall not be limited to, thelndividual Consultant's obligation to make available its personnel and anyrelevant documentation for such purposes at reasonable times and onreasonable conditions and to grant to NlTl Aayog access to the lndividualConsultant's premises at reasonable times and on reasonable conditions inconnection with such access to the lndividual Consultant's personnel andrelevant documentation.

3.11 Settlement of Disputes: NlTl Aayog and the Individual Consultantshall use their best efforts to amicably settle any dispute, controversy or claimarising out of the Contract or the breach, termination or invalidity thereof.

3.12 Arbitration: Any dispute, controversy or claim between the partiesarising out of the Contract, or the breach, termination, or invalidity thereof,unless settled amicably, as provided above, shall be referred by either of theparties to the CEO, NlTl Aayog for arbitration. The CEO NlTl Aayog mayappoint an arbitrator for the settlement of the controversy.

3.13. Conflict of lnterest: The lndividual Consultant shall be expected tofollow all the rules and regulations of the Government of lndia which are inforce. He/she will be expected to display utmost honesty, secrecy of office andsincerity while discharging his/her duties. ln case the services of the lndividualConsultant are not found satisfactory or found in conflict with the interests ofthe NlTl Aayog/Government of lndia, his/her services will be liable fordiscontinuation without assigning any reason.

4. Terms of reference

4.1 Heads of verticals are responsible for ensuring that detailed terms ofreference describing the work to be performed are prepared well in advance ofthe engagement of the individual consultant and submit it in Annexure-l in atimely manner to the executive or administrative office for processing.

4.2 The terms of reference are mandatory and shall form part of theindividual contract. The terms of reference shall include the ouiputs to bedelivered and the functions to be performed. The outputs and functions shallbe specific, measurable, attainable, results-based and time-bound.

5. General Terms & Conditions

5.1. Tenure: lndividual consultants will be engaged for a fixed period but notexceeding 3 years for providing high quality services on specific prr:jects asper requirement of the verticals. However, their continuation in theirrespective position beyond the first and subsequent years, would becontingent on a satisfactory Annual performance Review based on clearlydefined Key Performance lndicators. Extension beyond three years may beconsidered under exceptional circumstances with the approval of ViceChairman, NlTl Aayog. However, no extension will be given beyond the age of65 years.

5-2- Professionals with requisite qualification and experience as prescribedwould be hired as lndividual Consultants. As per Rule 177 of GFR 2:.017,lheconsulting services do not include direct engagement of retired Governmentservants. However, a retired Govt servant can be hired as consultant througha competitive process. They should not be engaged against regular vacantposts as consultant under this rule. Retired government servants can beengaged only for the specific tasks and for specific duration asconsultant. They should be assigned clear output related goals.

5.3 The Individual Consultants may be appointed on part{ime or full-timebasis. consultants appointed on full{ime basis would not be permitterl to takeup any other assignment during the period of Consultancy with NlTl Aayog.

5.4 The appointment of lndividual Consultants is of a temporar! nature andthe NlTl Aayog can cancel the appointment at any time without provirJipg apyreason for it.

5.5 Part-time Consultants will be appointed subject to the condition that theyface no conflict of interest with respect to the work they are handling in NlllAayog.

5.6 Number of lndividual Consuttants: The total number of IndividualConsultants to be engaged by NlTl Aayog shall depend on the actualrequirement at a particular point of time and provision of budget.

6. Educational Qualifications, Age, Experience and Remuneration:

6.1 Educational Qualification: ln general following qualifications arerequired, however any specific Educational Qualifications may be prescribedas per actual requirement of the verticals.

Essential - [\/aster's Degree in relevant subject or BE/B.Tech or 2Years PG Diploma in lVlanagement or [\4BBS or LLB or CA or ICWA orpossessing any Professional Degree earned after a study of 4 years ormore acquired after 10+2.

Desirable - Persons with l\4.Phil., tvl.Tech. tvl.S., LLMI, Ph.D, additionalqualifications, research experience, published papers and postqualification experience in the relevant field would be preferred.

6.3 The Consultation Evaluation Committee shall fix the consolidatedremuneration for the positions of Consultant /Sr. Consultant. The consolidatedremuneration will be inclusive of all applicable taxes and no other facility orallowance will be allowed.

8. SELECTION PROCESS

8.7 ln certain exceptional cases, with the approval of the Vice Chairmanselection from a single source as per GFR 2017 may also be considered.

8.1 The selection of Consultants shall be made in accordance with theprovisions contained in GFR 2017 under Rules 177 to'196 and Chapter 7 -Selection of lndividual Consultant/Service Provider (para 7.1 and 7.2)

8.2 The requirement of NlTl Aayog will be advertised from time to time on itswebsite as well as in at least one newspaper (both Hindi and English).

8.3 The applications received shall be placed before a Screening Committeewith following composition :

However, full justification for this must be given by the consultancy EvaluationCommittee (CEC).

8.8 NlTl Aayog may also hire consultants on secondment basis under Rule'194 of GFR, 2017 from established Research Organisations e.g. NlpFp, lEG,NCAER, Universities, Educational lnstitutions, including but not limited to llrs,llMs, AIIMS and other Research lnstitutions like ICAR, pSUs and GovernmentOrganizations. ln exceptional cases, individuals can also be hired onsecondment basis from Private lnstitutions/organisations/Think ranks likelCRlER, FlCCl, Cll, Centre for Policy Research with the approval of ViceChairman. This engagement will be based on payment of such monthly sumto the parent employer as would cover the cost of salary and other allowancesdue to the selected individual and additional expenditure in terms ofDepartment of Expenditure's approval conveyed vide lD No. 2611/2016- ppDdated 25-10-2016.

8.9 Payment: The payment will be released by NlTl Aayog within oneweek after completion of the month based on the biometric attendanceregistered by the individual consultant or on certification by concerned Adviserin case the individual consultant has been deputed to other place

9. Leave - The lndividual Consultants shall be entifled to leave of 8 days in ayear on pro-rata basis. Further, the absence up to one month may beconsidered without remuneration. However, in Exceptional cases forprofessional development, training etc. this condition may be relaxed by CEO,NlTl Aayog. Apart from this the women Consultant may be eligible formaternity leave as per the tVlaternity Benefit (Amendment) Act,2017 issued byMinistry of Labour and Employment vide no 5-36012/03/201S-SS-1 dated12thApril,2017.

10. Tax Deduction at Source: The lncome Tax or any other tax liable to bededucted , as per the prevailing rules will be deducted at source beforeeffecting the payment, for which the NlTl Aayog will issue TDS Certificate/s.Goods and Service Tax, as applicable shall be admissible to thelndividual Consultants. The NlTl Aayogundertake no liability for taxes or othercontribution payable by the lndividual Consultant on payments made underthis contract.

11. Police Verification: Police verification of the lndividual Consultants shallbe done as per the latest instructions issued by MHA. ln case the policeverification is received as negative, the contract of individual consultant shallcease to exist with immediate effect without any notice.

12. Training: After joining, a minimum of three days induction training ( not tobe paid) be organized for all the individual consultants.

13- Relaxation: Where the Vice Chairman NlTl Aayog is of the opinion that itis necessary or expedient so to do, it may by order and for reasons to berecorded in writing, relax any of the provisions of these rules.

'14. Consultants/Sr. Consultants, YPs and RAs engaged under the previousguidelines, shall continue to be governed by the terms and conditions of thoseguidelines till the expiry of their existing contract. Any extension will be subjectto these new guidelines.
